I agree with my noble friend: it is unfortunate that Operation Conifer was not able to resolve conclusively the position in respect of all the allegations made against Sir Edward. I obviously recognise the House’s desire to find a solution, but the investigation has already been subject to considerable external scrutiny and the Government do not see the grounds for government intervention. The fact that it involved a former Prime Minister does not of itself warrant government intervention. The Operation Conifer summary closure report emphasised that

“no inference of guilt should be drawn from the fact that Sir Edward Heath would have been interviewed under caution”

had he still been alive.

My Lords, is not the news that the Northern Ireland Assembly is amending the law on anonymity in rape cases to be greatly welcomed? If the law in England had been similarly amended, it is highly unlikely that the injustices in the cases of Sir Edward Heath, Lord Leon Brittan, Sir Cliff Richard, Mr Harvey Proctor and Mr Paul Gambaccini, and in the Janner case, would ever have arisen. Is it not time to reopen the debate on pre-charge anonymity in the rest of the United Kingdom?

My Lords, why can we not have anonymity in accusations of sexual offences, particularly rape? They are a special category of criminal offence where the reputations of the innocent can be destroyed, even by chief constables like Mike Veale. The law is unfair, and I have raised this issue repeatedly over the years. I too congratulate the noble Lord, Lord Lexden, on his unrelenting campaigning on this issue; the House is deeply indebted to him.

My Lords, I am not familiar with the FoI requests that were put in, so I cannot really speak to them. I was very pleased to see that Cleveland’s most recent PEEL report, which was also published on Friday 17 March, indicates that very good progress has been made under the leadership of the chief constable, Mark Webster. The noble Lord will also be aware that the PCC, Steve Turner, attends the PPOGs. I commend them both on doing a decent job.

My Lords, the regulations already exist. In line with the provisions set out in Police Reform and Social Responsibility Act 2011, PCCs must follow the process set out: namely, they must notify the Police and Crime Panel of their proposed senior appointment. The panel must then hold a confirmation hearing and produce a report and recommendation regarding whether it supports the proposed senior appointment. The PCP must do so within three weeks of receiving notification from the PCC of the proposed appointment. This is all set out in statute, so the regulations already exist.

My Lords, in light of the recent speech of the noble Baroness, Lady Burt, when she revealed the six-stage process governing disciplinary actions against police officers—I was shocked—should not the process be revisited in the way she and others are now suggesting? How can there be confidence in systems that protect rogue police officers, and their pensions, delay justice with prolonged processes, offer extended leave and rewards—[Inaudible]—Mike Veale, with further appointments? The Daily Mail should be thanked for its excellent reporting of these matters.

I thank my noble friend for his congratulations. At the moment I am not subject to much congratulation, so I take it where I can get it. I totally agree with him. It might seem like a small step, but it is a huge step for many families who might have found themselves in the same position as Sir David Amess. Guidance is being distributed to forces, and I know that forces were keen to have clarity on what to do in such situations. Coming back to my first point, it is of course an operational matter.

My Lords, would the Minister agree that communication is vital? Will there be a list of priests in each area, with telephone numbers, who could be available if a priest were needed to give the last rites in serious injury cases?

I think that is a very interesting question. Obviously, it might not be entirely predictable where priests might be in the case of a serious incident, but it is certainly true that, in circulating the guidance, police will now be far better informed about how to go about these requests should they arise.

My Lords, I declare an interest as the former president of the National Association of Chaplains to the Police, which I helped to establish over 30 years ago. There were then only two or three chaplains in the whole country; now there are almost 500, most of whom are volunteers, who do a superb job helping and supporting the police service. Will the Minister ensure that Police Chaplaincy UK is fully supported by the Government and is soon, I hope, enshrined into the police covenant?

My Lords, this technology is used by the Chinese Government to micro-manage the lives of its citizens, so its use here needs strict rules and effective oversight. In the absence of legislation, the police have tried to regulate themselves by writing their own rules, but these are so vague that almost anything goes: targeting people who “may cause harm”, whatever that means. When will the Government do their job and legislate to control the risks of this technology?

I totally agree with my noble friend and have said on many occasions that the days when we could import cheap labour from the EU or anywhere else are gone. Our immigration system will be based on the skills that people bring to bear and there will be certain thresholds on incomes.

My Lords, the Minister will be aware that there is some confusion arising from statements made by the Home Secretary about our adherence to the European Convention on Human Rights. Earlier, I think she said that the Government were still adhering to it. Will she confirm that there is no intention in any way to withdraw from the European Convention on Human Rights and the Council of Europe?
