Lords ChamberI have probably known the noble Lord, Lord Rennard, even longer than I have known my noble friend Lord Campbell-Savours, and no one has ever accused him of being as ineffective behind the scenes as he is effective on the public stage. I rose immediately after he spoke in order to agree with him and to show that here we are finding common ground, which is desirable for the conduct of the negotiations that are now to take place and will help the Committee out of the current impasse, so accurately described earlier in our proceedings by the Leader of the House.
My Lords, once upon a time there was a place known as the Royal Borough of Sutton Coldfield, just to the north of Birmingham. In the local government boundary changes under the 1970-74 Tory Government, it was added to Birmingham in 1974. The external boundaries of Sutton Coldfield have remained exactly the same but it has simply been added to the north of Birmingham. I declare an interest, as part of the northern boundary was part of my old constituency of Perry Barr. Earlier today I bumped into the noble Lord, Lord Fowler, who thanked his noble friends for the support that he got last week, and we had a chat about our joint boundary, which was always a bit of a bone of contention come the Boundary Commission review.
In my 27 years as an MP I think there were two parliamentary boundary changes and probably three local authority ward changes, but this boundary remained exactly the same. I have just looked at a map again because it is a few years since I represented the area. The historical boundary of the Royal Borough of Sutton Coldfield was built almost on the watershed but was gradually developed. When you look at a map of the area, you say to yourself, “What’s that dotted line that goes across the back gardens and up the alleyways and at one point splits a cul de sac in half?”. This is an urban constituency, and this boundary happens to form the line between the B73 and B44 postcodes. There is no question but that in parts of the country postcodes affect property values. It has already been mentioned, including by me, that wards are building blocks, and the average ward throughout England has about 1,400 constituents. Some of them are really tiny but the average ward in London has about 6,000 constituents. However, once you get out into less populated areas, the wards are tiny. As building blocks they are great because you can add in 100 here or 200 there in order to make the boundaries come right. However, when you have a ward of 18,000, 19,000 or, in some cases such as the old Sutton wards, more than 20,000 constituents, what do you do?

Lords ChamberMy Lords, this amendment is in my name and that of my noble friend Lady McDonagh, who is sorry that she cannot be in her place at this stage of the evening. I was rather amazed to have had an impact with my previous amendment and I very much hope that the Government will be able to accept this one.
It is a perfectly simple amendment. It does not go to the heart of the Bill, the core of the coalition agreement or anything like that. It simply says that if someone marks just one preference when they go into the polling booth and, instead of putting 1, they mark it X, that should count. I do not want to labour the point because I see the noble Lord, Lord Strathclyde, nodding encouragingly. We are in agreement on a lot of things here—we want the maximum number of valid votes in the referendum, as does he—so it is good from that point of view.
I do not understand this. My noble friend is a supporter of AV. Those of us who have been in the other place—that is, those who have been to an election count, and I do not know whether my noble friend has—know that, under the present first past the post system, if someone puts a 1 against a candidate, that counts as a vote because it is a clear indication. So it is bound to be the case under AV that if you put an X against a name, it will count as a vote; the normal rules allow for that.
I thought that the idea of this was to persuade people to use second choices. This is where the con comes in of it being the “optional” AV system. There will be a campaign out there of people saying, “You don’t have to bother with all these numbers—just put an X against my name”. That is what it is all about. The argument that AV gets rid of tactical voting is fraudulent, as I hope my noble friend will admit.
No, because no words are allowed. That is part of the rules. A tick will do if it clearly indicates a preference, but words are not allowed so it would not count.
If my noble friend wants to go home, he should not intervene in the debate. If he would care to read new Section 37A(1)(a) in Clause 9(1), it changes the present situation whereby returning officers can take any old mark and says that there has to be a 1, which is all I am trying to change.

Lords ChamberWhen I took this Bill on holiday to read in the summer, it was 153 pages. When it arrived in this House, it was 300. Yet the Minister has the brass neck to say that the other place was time-wasting, when the Bill doubled because of 286 government amendments that were put into the Bill in the House of Commons. Come off it!
Perhaps I might make a helpful suggestion to the Minister to move things on, because we are getting into other waters. He said something incredibly helpful just now: that this is intended to give part of the powers to be exercised by a Secretary of State for Scotland and a Secretary of State for Wales—by a territorial Minister; that is what the noble Lord said, as he will find when he checks in Hansard—and part of them to be exercised by the Lord President. That is perfectly sensible and a very good description. All he therefore needs to do is to agree to introduce at the next stage of the Bill an amendment that makes that clear and we can move on.

Lords ChamberAt about 2 pm I was given notice about degrouping part of this group. Amendment 5 is mine. I was advised that Amendments 5, 8, 9, 10, 11 and 12, all of which contain specific dates, would be degrouped. They would come after Amendments 4, 6 and 13 which do not contain dates. I was advised to have the debate on that basis. I apologise for not being early enough in the day to give proper notice of that.
I hope my noble friend Lord Foulkes will forgive me because I am going to say something very shocking—I agree with every word of the speech he has just delivered, although from a different perspective on electoral systems.
There is one thing at least that everybody in this House can agree on. The decision that will be made in the referendum—whenever it comes—is extremely important for our country. It is a small change that will make a big difference, for better or for worse. That has very important implications for how that decision is taken. It is extremely important that the British people are thoroughly engaged and take their decision after due consideration of all the facts. This is important not just to those who agree with me that the system should be changed but also to those who do not want the system changed. If you have a mucky referendum result, the issue will not go away—it will come up year after year and the referendum will not have succeeded, as many of us hope it will, in resolving the issue.
Making electoral change in democracies is very hard. According to research from the politics department at the University of Reading, there have been only six major changes in electoral systems in all the established democracies of the world in the past 25 years. The number of countries involved is only four, since the French went one way and back and the Italians went one way and back. It is very rare that a country chooses to change its electoral system. Winning referendums to change electoral systems is not easy either. I am optimistic that the form I favour will win, but I would not be so if I consulted the international form book.
My amendment, which backs up the amendment of my noble friend Lord Foulkes by leaving it to the Government to put in another date to replace the one which he is trying to get removed, would mean that there would be time for a proper debate. It would remove the debate from, let us face it, a rather small inner circle of people who up to now have been interested in the electoral system, and take it to the people for them to make their considered and revered decision. Most of that is probably common ground.
My noble friend Lord Foulkes talks for Scotland; I will talk for Wales, where I live. This is the political prospect facing Wales in the run-up to this election. We have a referendum in March on the legislative powers of the Welsh Assembly, an issue of great importance to many people in Wales. On 6 May, there will be, simultaneously, the elections for the Welsh Assembly—extremely important elections, closely fought, four parties engaged in much of Wales—plus local elections and, at the same time, you will have the campaign about this issue.
I got a feel for what it was like last Saturday because I went to my local Brecon and Radnorshire constituency Labour Party and spoke for AV. I must have been in reasonable form because I felt that I got a pretty sympathetic reaction. There was only one person opposed. The question came, however, of what they were going to do about it. One lady said, “I am not campaigning with the Lib-Dems”. She hated the Lib-Dem council and she was not going on to the streets—however convincing my words—to campaign. Parties form an informative function in our democracies as well as bringing voters out. People learn from those they know and trust locally as well as from their national newspapers, thank God. This lady will not be giving her take—which I hope would have been the take I gave in my speech—because she is not prepared to be knocking on doors at the same time and on the same side as the local Liberal Democrats, who she hates, who are local representatives of the coalition, which she also hates. This is a recipe for a blurred referendum, an uninformed referendum, a referendum where the people’s verdict will not ring as loudly as it could.
I fail to grasp the arguments that are used in favour of this coincidence of dates. The only one I have heard repeated is about cost. The cost of the referendum is £80 million. The additional cost of having them on separate days is said to be £15 million. Perhaps the Minister will confirm those figures. You would not mock £15 million; it is tempting to say that you cannot put a price on democracy, except I am an economist so I can put a price on democracy and anything else you want. Honestly, £15 million will not run the National Health Service for an hour. To take a fundamental decision about a referendum of this importance, of such fundamental impact on our democracy, on the basis of £15 million sounds most peculiar.
I am not naturally a suspicious man, but I suspect that the Lib-Dems have persuaded themselves they are more likely to win a referendum if it takes place on that date. I have done some work on this. I have consulted some of the leading psephologists in the country. There is no evidence of any kind for that proposition; the evidence is rather the other way. There is, for example, the argument that more people will vote in Scotland because it is being held jointly with the Assembly elections, and that they will be more likely to vote for change. YouGov polls have shown that support for AV in a referendum in Scotland is at precisely the same level as that in the rest of the country. There is no evidence for this motivating belief at all. It is not more likely that AV will win in May; my own judgment is that it is somewhat more likely that it will lose.
I am left with a vacuum. Here is a clear case of a democratic abuse which I am sure those on the Cross Benches will be very quick to pick up. Here is an argument from the Government in favour of what they are doing which, even by the standards of the many Governments of all complexions I have known over the years, seems to me extraordinarily thin.
Tonight we have a chance to break this, and we will have other chances in later amendments to the Bill. I hope your Lordships will do so by voting in favour of the amendments in this group.
