My Lords, I will speak to my Amendment 59 in this group. Clause 5(2) gives the Secretary of State the power to bring any invertebrate of any description within the meaning of “animal” and thus within the scope of the Bill—thus declaring them sentient in law. My noble friend Lord Moylan has already drawn attention to the extraordinary breadth of this new power. At Second Reading, he said:

“The clause that strikes me as most extravagant, however, is the one that gives the Secretary of State the unfettered power to declare, should he wish, that an earthworm is a sentient being. This is a power greater than that given by God to Adam in the Garden of Eden, which, as I recall, was restricted to the power to naming animals. Here, we are giving the Secretary of State the power to reclassify them almost without check.”—[Official Report, 16/6/21; col. 1921.]


I do not feel qualified to comment on the powers that God gave to Adam, so I will, if noble Lords forgive me, confine myself to this Bill.

Many noble Lords, including my noble friend Lord Randall, the noble Lord, Lord Trees, and the noble Baroness, Lady Bakewell, called for decapod crustaceans, including lobsters, crabs and crayfish, and cephalopods, including octopus, squid and cuttlefish, to be included in the scope of the Bill. Some argued this point on the basis of a film called “My Octopus Teacher” and were advised to have tissues on hand to watch it. However, the evidence contained in a tearjerker does not seem to be the best foundation for the law of the land. The law should be based on hard evidence—hard science and sound evidence—and that is where the problems on animal sentience start and lie.

While everyone agrees that animals are sentient, philosophers and scientists are still arguing about what that means. Does a dog, for example, have the same feelings as a crab, or a crayfish the same feelings as a cow? Perhaps that is why there is no definition of sentience in the Bill. Scientists are not agreed, despite the fact that in the previous debate the Minister gave us two separate definitions of sentience, although neither of them are included in the sentience Bill, which strikes me as a bit odd. So how will a committee opine on something that is neither defined and on which there is no widespread agreement, in fact, on which there is widespread disagreement?

The Government have commissioned an independent review of the sentience of decapod crustaceans and cephalopods. This amendment would require only that where the Secretary of State declares an invertebrate sentient, the scientific evidence on which the declaration is based should be published. It seems unarguable that such transparency on the science must be good, and I cannot imagine any arguments for hiding the evidence and not publishing it. If the Minister rejects the amendments, perhaps he can enlighten the Committee about why the science and the evidence should be hidden away.

My Lords, my noble friend has made an important, useful and helpful point to the House, which needs addressing. When noble Lords introduce Motions or move amendments in your Lordships’ House, the normal course of events is that they explain their purpose—what wrong they are trying to right and what purposes and effects they will have. The noble Baroness, Lady Smith, in moving her Motion talked generally about its effect, and we understand that, but she did not mention this at all.

This is a significant change and it is not quite clear why it is necessary. This area of the Standing Orders—the arrangement of business—is quite an old one and the reason why it has not been changed is that it works very well. It is, as my noble friend said, a tradition, but that is probably not its most important point. Standing Orders are practicalities, there for the practical purposes and workings of the House so that we all know how business is arranged, how it is conducted and why it is set out. There is a helpful little book, which I am sure all your Lordships have read—the Companion to the Standing Orders—which explains why those things are and how they work.

My Lords, I, too, support this amendment and will add a small footnote to what the noble and learned Lord, Lord Lloyd, has just said. I understand that an amendment would be needed to the Duchy’s founding charter, drawn up in 1337, to enable a female heir to inherit. As the noble and learned Lord, Lord Lloyd, stressed, this is a Bill that provides for gender equality. If that principle is to be fully and completely embodied in it, action must surely be taken to revise the founding charter of the Duchy of Cornwall so that a female heir to the Crown can succeed to it.

As the noble and learned Lord, Lord Lloyd, so wisely pointed out, there is a further practical consideration. If the Duchy is not held by an individual but placed in abeyance and administered by its council, there is a real risk that its affairs will not be administered with efficiency and skill. There is a strong view held by many that the absence of a Duke of Cornwall between 1936 and 1958 led to a serious decline in the running of its estates and other properties, a decline from which the present Duke, now the Prince of Wales, successfully rescued it. For these reasons, I support this amendment.

My Lords, I, too, support my noble friend’s very important amendment. I was going to make the point that I have heard repeated again and again—which my noble friend Lord Lexden has made very strongly for me—that not only does the Duke of Cornwall need a Duchy but the Duchy needs a Duke. Estates, businesses, or whatever you may choose to call them in the modern day and age, that are run by councils, groups of trustees or boards of directors are all very well but in the case particularly of a large agricultural estate such as the Duchy or Cornwall—and there is none larger or better run—the present Duchy of Cornwall runs so well because the Duke of Cornwall has taken such an interest in it, and if there were not a Duke, regardless of that Duke’s sex, I think that would not happen. My noble friend Lord Lexden’s point is absolutely valid.

Another point that has been made, which I will repeat, is that the splitting apart of ancient titles is unsatisfactory and untidy. In dealing with important constitutional matters, although these are technicalities and perhaps of interest only to historians, politicians and noble Lords who can be bothered to spend their Thursday afternoons in your Lordships’ House, they are important matters and need to be done tidily. I do not think they are done tidily in the Bill.

Lastly, when my noble and learned friend Lord Wallace responds, will he assure the House that the Duke of Cornwall—the Prince of Wales—was consulted over this and that he is comfortable with the way in which the Bill is going forward? I do not wish my noble and learned friend the Minister to breach any confidences or step outside the correct procedures but it would give comfort to the House to know that the Government had consulted His Royal Highness and that the Duchy and the council and the Duke of Cornwall himself were comfortable with the way in which this is proceeding.
