My Lords, I join the noble Lord, Lord Watson, in thanking young people for their resilience during a crisis this summer that no-one intended them to have to go through. I repeat to your Lordships’ House the apology made by the Secretary of State and in my letter to noble Lords. I thank the noble Lord for his wish to work constructively on these matters.

On schools reopening, the main guidance to put in place the hierarchy of controls, on the need for bubbles or for year groups to be kept separate in secondary schools was issued on 2 July—well in advance of the end of summer term—and enabled schools to prepare. However, for the thankfully very small number of situations where there are additional restrictions, the guidance was issued only recently.

On the noble Lord’s questions about exams, it is important to remember the principle that Ofqual was a body created by Parliament. It was created by statute and is answerable to Parliament. There are good reasons in principle why the regulation of public examinations in this country is not subject to direct government interference. It was Ofqual’s responsibility to have the data to develop the algorithm and then send that algorithm to the various examination boards. There was a reaction at the stages at which the department was made aware of additional concerns and Ofqual met regularly with the department even from before the announcement was made for exams to be cancelled. The department reacted, but Ofqual is the independent regulator.

On sharing data, in the week running up to the A-level results the system was as per any normal year. On the Monday or Tuesday some headline data is given to the department. On the Wednesday that data is shared with schools and is then published on Thursday. To respect the normal division of responsibilities between the department and Ofqual, that long-standing practice was abided by and Ministers did not see the detail of results for individual students or the schools that would have been affected.

Only a tiny fraction of BTEC examination results remains to be communicated to students. That is where further information is needed. Each year there are normally, unfortunately, a small number of results outstanding. Pearson has assured us that it is working to issue these remaining results as soon as possible.

It is envisaged that the first services from the national tutoring programme, which is being delivered by the EEF and Teach First, will be delivered in the second half of the autumn term.

On the specific questions on early years catch-up, of the £350 million tutoring programme, £8 million has been awarded to Nuffield for early language development and there was an announcement that there will be small-group tuition for disadvantaged 16 to 19 year-olds. They are now included in the catch-up.

On the issue around special educational needs students, as noble Lords will be aware, the Oak Academy’s provision of online lessons has of course included some for those with special educational needs. The guidance and the links to the various resources on the Department for Education’s website include links to these. We have been working closely with the sector. Over the next year an additional £730 million will go into the high-needs budget, meaning that it will have grown by £1.5 billion, or 24%, in just two years. We are responding on special educational needs. The £650 million of main catch-up funding going out to schools has been weighted per pupil for specialist schools, because we recognise the higher per pupil costs in those settings.

There will be a contingency plan for examinations next year. There has already been guidance on the curriculum so that schools knew what they were doing from the moment they came back. For instance, in English literature they know that pupils will potentially be examined on only three of the four set texts and there have been changes to field work in geography, et cetera. The question of whether there will be a delay was part of Ofqual’s consultation on the 2021 series, and that will be confirmed as soon as possible.

There is now a higher education task force, chaired by Michelle Donelan, the Minister for Universities, which meets regularly with Universities UK and other stakeholders to work with the sector on the implications of the change in the awarding of grades for A-levels.

Turning to the questions raised by the noble Lord, Lord Storey, I specifically checked and, while it is my personal preference to read the Statement, I was told that in this hybrid situation I do not repeat it. However, I put my view that I want to read it to noble Lords because it helps.

A lot of specific guidance has had to be set out for the sector. Officials and the sector have worked very closely to try to get the right boundary in not being able to be prescriptive, because we have over 20,000 schools in about 70,000 buildings. There must be the framework and the principles for head teachers and other school leaders to make their risk assessments and the changes to their buildings.

Masks are recommended only where we have something such as a tier 2, where there is a local lockdown, but schools can advise their students on that. I hope that the guidance is not contradictory on that matter.

Disadvantaged pupils are of course a concern for noble Lords and for the department. That is why there is the £1 billion catch-up fund. On excluded pupils, many of whom will have been in alternative provision, all schools reopening includes AP schools. At the end of the summer term we announced additional funds for those leaving AP to make sure that they had additional support and did not end up not in education, employment or training. We are working to ensure that they do not fall within the gaps.

On home education specifically, yes, we are particularly concerned. Going back to the cancellation of exams and the work the exam centres did, obviously some home-educated students then register at a school and sit their examinations in that school. As far as possible, we asked those schools to evaluate the performance of that student if they had any data on which to do so, but of course there were situations in which it just was not possible. That is also about the integrity of head teachers and teachers who did not feel they could give a grade. That is why the autumn series of resits in all subjects will be so important, particularly for home-educated students.

There was a recent consultation from the department on whether to have a register with local authorities and whether to pay exam fees for home-educated students, because we are concerned about the rise in the number of home-educated students. The reasons are not, as perhaps they were 10 or 20 years ago, well-meaning parents. Some who are in home education are potentially not getting the education they deserve, but we do not have the data. I will update the House as soon as I can on what is happening with that consultation.

My Lords, is it not incumbent on us all, whatever our political party, to do all we can to encourage and support our country’s teachers and those working responsibly in the teaching unions? Has my noble friend noted the ways in which the recovery of our education system is being assisted by independent schools sharing their online programmes with state-sector colleagues, asking them to join summer courses, and strengthening the flourishing partnership work that benefits both sectors so much?

My Lords, it has been a pleasure during my tenure as Minister to speak regularly to the Boarding Schools’ Association and the Independent Schools Council. One of the things we have seen during the pandemic is a sharing of educational expertise, not only from the independent sector to the state sector but within the state sector, whether that is sharing online classes, as with the Oak National Academy, or teachers sharing lesson plans. I hope that will be one of the positive legacies of this crisis—that we will continue to share the best of our educational practice so that all pupils can benefit from it.

My Lords, would it not be appropriate to extend to the secondary sector the flexibility that primary schools have been given to allow more children back when they can do so safely? Can my noble friend confirm that independent schools, which are actively engaged in the national effort to bring pupils back into school, as she has mentioned, can bring children on to the school site as long as the correct protocols are observed?

My Lords, the flexibility is to respect the professionals on the ground. Unfortunately, because of the specific risks that secondary pupils travel greater distances to school, often use public transport and usually have a wider range of social contacts, we have not been able to have the numbers back in a secondary setting. We are grateful to the independent sector. The guidance is that boarding schools should not expect year 10 and year 12 back; if they can have that face-to-face contact on a day basis, that is permissible. I am grateful that, as they have atypical transition years, they have heeded the Government’s guidance to bring back reception, year 1, year 6, year 10 and year 12, as I have outlined.

Is my noble friend aware that the 1,300 independent schools belonging to the Independent Schools Council want to do all they can to assist their local communities? I declare my interest as a former general secretary of the council. Has my noble friend noted in particular that they are anxious to help with childcare? To that end, they are getting in touch with their local authorities to concert practical plans. Finally, I ask the Government to bear carefully in mind the grave difficulties that independent schools will suffer if they are unable to secure help from insurance companies for business interruption.

I am grateful to my noble friend for that question. Yesterday afternoon, I had the pleasure of speaking to the heads of both the ISC and the Boarding Schools’ Association. They passed on that message, particularly in relation to looked-after children who are in their care and will remain in their care for the moment. We are grateful for their offer of support, which I have passed on to the Secretary of State. When we talk about collaboration locally, that means all schools and colleges, including the independent sector.

I am grateful to the noble Lord. Obviously, within priorities at the moment the most vulnerable group at risk has been that of older people; but, as of last night’s guidance, there was reference to those young people with specific medical conditions, such as severe asthma or cystic fibrosis. They will be contacted directly by the NHS. But we are acutely aware that there are groups of young people, particularly within the SEND population—for instance, those in special residential schools—where there are implications in having any kind of household-type isolation. There are also profound implications for the families; those children are in residential special provision for very good reasons. As we completely realise, it is not as simple as saying “You now need to go home”, so that guidance is being worked on as well.

My Lords, is it not important to try to reduce the large sums of public money that are being spent by local authorities as they attempt to resist legitimate requests by families for special educational needs?

My Lords, I think my noble friend is referring to the tribunal process. Since 2014, the percentage of decisions being taken to the tribunal as a proportion of the overall number of plans is the same. Numerically, it is going up because the number of plans is going up. There are actually now five different decisions, or combinations of decisions, that parents can appeal. But my noble friend is right, too: we have given £365 million of capital so that local authorities can build more spaces because—he might not be happy to hear this—it is actually cheaper for local authorities to provide the spaces themselves, rather than use private or independent providers.

My Lords, all those in our school system who seek to provide better assistance and support to children with dyslexia and neurodiverse conditions have no more determined and effective champion in this House than the noble Lord, Lord Addington. He deserves strong support across the House this evening. The current system is, indeed, in trouble, as he said at the outset.

A government review is in prospect. Announced last September, further details about it are eagerly awaited, as my noble friend who will be replying to this debate will be well aware. The review will need to be conducted thoroughly and swiftly, leading to clear recommendations for improvement. Sadly, these are not always features of government inquiries. The noble Lord, Lord Addington, and his supporters across the House will need to keep a sharp eye on this.

The all-party Commons Select Committee on Education, in its report last year on special educational needs and disabilities, found that

“the 2014 reforms have resulted in confusion and at times unlawful practice, bureaucratic nightmares, buck-passing and a lack of accountability, strained resources and adversarial experiences”.

This is a formidable catalogue of woe. It is up to the Government, through their review, to set the scene at last for the success we all want to see in the reformed system, created amid such high hopes in 2014.

I declare my interest as president of the Independent Schools Association, which works on behalf of nearly 550 smaller, less well-known schools in the independent sector, whose good work attracts little attention in the media. I wish that commentators and education pundits would look more closely at them. They would get a more accurate understanding of what the independent sector as a whole is really like today. Many of the association’s schools are giving very effective help and support to the kind of children who are at the forefront of our thoughts in this debate.

One school in particular always leaps to my mind when dyslexia is under discussion: Maple Hayes Hall School, near Lichfield. It is known to the noble Lord, Lord Storey. It achieves magnificent results year after year for the 100 or so pupils with severe dyslexia that it can accommodate. Ofsted rates it as outstanding. What is the secret of its success? The joint heads, Dr Neville Brown and his son Dr Daryl Brown, explain:

“Pupils who come to us have had great difficulty in learning their letter sounds, in splitting up the oral word into syllables and the syllables into their component sounds or ‘phenomes’, and in getting these sounds and their letters in the right order when spelling words. The dyslexic child has extreme difficulties in learning to read and write by phonics. We specialise in teaching methods which lead away from a dyslexic’s area of weakness and build on their strengths with a range of targeted teaching strategies which do not involve phonics or multi-sensory methods. A good all-round education follows.”


These world-leading experts are now working on a phenome dictionary, which will be the first of its kind in the world. What is truly tragic is the time they have to spend battling with local authorities which seek to obstruct families with EHC plans exercising their right to choose a place at the school. The government review must address not only the inadequate funding of the system as a whole but the bias of some local authorities which want to keep money away from schools such as Maple Hayes, despite the outstanding results achieved.

It is interesting to note that at Maple Hayes the emphasis is on moving away from a child’s weakness and building on their strengths. That is at the heart of the approach advocated by leading authorities on neurodiversity. An American expert, Dr Thomas Armstrong, said in 2017:

“Special education needs to change … For too long it’s been weighed down by a history emphasising deficit, disorder, and dysfunction … the role of the neurodiversity-oriented special educator”


should be

“one of creating environments within which neurodiverse students can thrive.”

Some very useful comments were made by the noble Lord, Lord Addington, as to how a more positive approach could be achieved.

In this debate, we are all conscious primarily that the existing system is far from fulfilling the hopes with which it was introduced in 2014. But is there, perhaps, a deeper problem arising from the deficit model that the system incorporates? That, I think, is a question worth careful consideration.
