Lords ChamberMy Lords, I declare an interest as a member of a trade union ever since my undergraduate days in my first job, during a long vacation, as a garden labourer for the LCC. I joined a trade union as a young man and have remained convinced about the unions’ role in society ever since. They are fundamental to the kind of free society in which we want to live, a society with checks and balances and in which the rights of individuals, whoever they are, can be protected. In the struggles of the trade union movement over many years, we can see how those rights have been hard-won by brave and courageous people who stood up for justice and fairness as they understood it.
I said on the last amendment that the dividing line between a free society and a police state is not always absolutely clear. In our society, while the majority of employers are responsible people, with a sense of responsibility towards their workforce and to all who are involved in their industry, we know that too many employers and people in the private sector are ruthless. They are prepared to do anything to further their profit and financial gain. I add in parenthesis that I always see a correlation between lasting industrial and commercial success—and responsible leadership of industry—with the recognition that the role of trade unions has been central to ensuring that success in the future. I always think people who deny these rights and freedoms, and the importance of organised labour, are in one way or another destined to have a sticky end.
In the kind of society in which we are living, it is therefore crucial to take our responsibility towards the protection of trade unionism and the protection of the rights of workers within our society as fundamentally important. We must not drift into a situation in which, by an inappropriate use of police powers, less savoury elements in our commercial system can exploit the situation for their own good. I always saw the blacklist of people who had been involved in what was regarded as unacceptable activity as pernicious. How many employers are on a blacklist from participation in the economy because of totally unjustifiable things that they have done? That is where we come down to the fundamental fairness and justice in our society. For those reasons, I am very glad that my noble friends have moved this amendment, and I express my strong support for what they have said.
My Lords, I support Amendment 56A in particular. In the earlier debate on the issue of prior judicial authorisation, I made the point that notification of an authorisation of criminal conduct to the IPC, as suggested by the noble Lord, Lord Anderson, and other noble Lords, lacked teeth. In response, the Minister argued that the oversight role of the Investigatory Powers Commissioner has teeth. She said that it includes ensuring that public authorities comply with the law and follow good practice. She added that public authorities must report relevant errors to the IPC office; for example, where activity has taken place without lawful authorisation or there has been a failure to adhere to the required safeguards, saying that the role of the IPC was to make recommendations to public authorities in areas that have fallen short of the required standard. This all may happen after a criminal event has taken place. The so-called safeguards would then bite on nothing.
Alternatively, the Minister relied on a framework in which the safe deployment of the CHIS is made by experienced, highly trained professionals, guided by the code of practice. Like the noble Lord, Lord King of Bridgwater, I have looked at this, but cannot find any guidance as to the areas in which it is appropriate for all these public authorities to deploy CHISs. It says simply that the deployment must be
“necessary and proportionate to the intelligence dividend that it seeks to achieve”
and
“in compliance with relevant Articles of the European Convention on Human Rights”.
The authoriser himself or herself is charged with considering whether the activity to be investigated is an appropriate use of the legislation, which rather begs the question of what, when and where is appropriate. It is entirely the subjective opinion of that individual authoriser. He may object to the secret cultivation of leeks in Dorset, for all that the noble Baroness, Lady Jones, might know.
Examples of the deployment of covert agents, as outlined by the noble Lords, Lord Hain and Lord Mann, and the noble Baroness, Lady Jones, herself, and in the case of the Lawrence family, are dismissed as errors of the past, and that in the bright future under the provisions of this Bill, they would not happen. I agree entirely with the noble Baroness, Lady Chakrabarti, that we learn from the past, and that in this Bill there is a blurring. This bright future includes a novel element: the authorisation of crime with complete and total immunity against prosecution, or against civil suit. The Bill envisages that covert human intelligence sources will be employed in the future by a wide variety of public authorities in a wide variety of unknown situations and areas. Let us consider the areas referred to in these debates: protests against apartheid in South Africa, protests involving the cooling towers of electricity stations, and protests up trees. As for the Lawrence family, I cannot imagine what public interest was being pursued.
I recall prosecuting a case in which the defendants were charged with sending letter bombs. It emerged in the evidence at the trial that a covert security service officer was happily waving a banner in a protest march through Caernarfon in support of the aims of the bombers, shortly before the trial took place. Waving a flag may not be an offence outside Northern Ireland, but the case involved a serious crime that resulted in a 12-year sentence of imprisonment. As prosecutor, I received a knock on my door at home from the local policeman from Rhosllanerchrugog, warning me about my personal security during the trial, and telling me not to open any large letters. Two days later, I was contacted for the same purpose by the security services, who presumably did not feel the same urgency or concern for my safety as my local bobby.

Lords ChamberMy Lords, I want to put on record my admiration for the consistent, valiant work done by the noble Baroness, Lady McIntosh of Pickering. She has proved herself over recent weeks as a champion, almost second to none, of the principle of accountability to Parliament, the importance of Parliament and the importance of always being cautious lest power drifts back to the Executive. If we are to have these new arrangements for regulation and supervision, what she has talked about is a prime candidate for this. I believe it is a test of whether the Government really do believe in parliamentary authority and the accountability and supremacy of Parliament, and whether they really believe that there is no attempt by the Executive to take back power. I thank the noble Baroness for having given us another opportunity to raise this, which I hope the Government will take seriously.
I have immense respect for my noble friends who are working so hard and consistently on our behalf on the Bill. The rest of us who have strong feelings therefore have to be very cautious about getting in their way and making generalised statements that hold up proceedings and in the end undermine the effectiveness of what they are trying to do.
I want to make this point: anyone who believes that the Bill is simply about an internal market must face the reality, given that history will judge the effectiveness of this Chamber as a scrutinising Chamber, that it is about more than that. It is about a determined drive, as I see it, by the present Government all the time to increase the powers of the Executive. We must therefore be on our toes strategically if we are not, in our preoccupation with the detail of the Bill, to lose sight of this major challenge that we constantly have to face. I thank the noble Baroness once again.
My Lords, it is always a delight to follow the noble Lord, Lord Judd, who always helps us with his wisdom and experience. I join him in commending this understandable attempt by the noble Baroness, Lady McIntosh of Pickering, to strengthen the scrutiny of any regulations made by the Minister under the proposed Bill, whether in the exercise of Henry VIII powers or otherwise. While I entirely support their purpose, I cannot support the precise method that the noble Baroness puts forward. The trouble is that there is no single super-affirmative procedure; there are, as the noble Lord, Lord Naseby, pointed out, a whole host of procedures.

Lords ChamberMy Lords, the Minister is always extremely clear on these matters; the whole House appreciates that. I declare an ancient interest, in that I was once a service Minister. This is an opportunity for all of us in the House to put on the record again our admiration for and gratitude to the men and women of the armed services for all they do on our behalf, in some exacting and difficult circumstances.
I would like to raise just one point with the Minister. I am one of those who believes that the highest standards of commitment to human rights and the international conventions are essential to effective defence. If we stand for better things, we must demonstrate all the time that we are behaving in accordance with that conviction.
Sometimes, the circumstances are extremely testing and provocative, but in my view that is exactly when this kind of commitment becomes more important, not less. I would be very grateful for the Minister’s assurance that, in our approach to the Armed Forces, we do not slip into the habit of saying, “These are here. We have a commitment to them and we therefore behave accordingly because it is required of us”. Particularly in the context of ill-informed media comment and so on, when training and preparing our servicemen and women, do we take seriously our responsibility to explain why these commitments are important and how central they are to our credibility and effectiveness? It is not just a matter of obeying orders, but of people understanding why what is required of them is so essential.
I think the Minister will agree that this is particularly important with younger members of the armed services, towards whom we have an obvious duty of care. Any convincing assurances that he can give would be immensely helpful.
My Lords, I declare an interest as chair of the Association of Military Court Advocates, having been involved in a number of courts martial over a considerable period. Things have changed very much for the better since the 1950s and 1960s. At the first court martial I went to, the officers on the panel marched in and put their swords on the table, sheathed, until the verdict. The sword was then moved and you understood the way the verdict had gone from the direction in which it pointed. That practice was abolished. I also claim some credit for raising in this House the practice of the Navy to march the defendant in at the point of a cutlass. I tabled a Question asking why this procedure still went on; it was abolished in the weeks that followed, before the Minister rose to give an Answer. That is my one tiny claim to military justice.
I have spoken on each of the Armed Forces Bills since that of 2000-01; over the years, we have moved to a much better system, very much influenced by the European Court of Human Rights and its decisions, which pointed out deficiencies in the practice and procedure of courts martial. These decisions were led by Judge Advocate General Blackett—to whom the noble and learned Lord, Lord Morris of Aberavon, referred—who has been influential in many ways.
It was as a result of long-term advocacy for reform that eventually the inquiry to which the noble and learned Lord, Lord Morris, referred was instituted by the Ministry of Defence. I had the pleasure of meeting the retired judge who was in charge of that inquiry. I would like to know from the Minister when his report will be available and, in particular, whether it will be available with plenty of time for full consultation throughout the profession, and among other professionals, before we come to deal with the Bill in a year or two’s time. It is very important that we should have the opportunity to consider and, perhaps, contribute to the Bill that will subsequently come before this House.
There has been much progress under all Governments; I hope that progress will be maintained.

Lords ChamberMy Lords, the noble Baroness is to be congratulated on having persevered so well and firmly with this cause, right up to Third Reading. I remember in my early days as director of Oxfam that I was in north-west Brazil where, having travelled overnight in a rickety bus, I arrived in this very poor town. Around the tower of the church, there was a banner in Portuguese which said, “Prison bars will not prevent the truth escaping”. When I, together with the field director, probed to try to find out what had happened and what was wrong, evidently a greedy land grabber had been bribing the judge with cattle and the judge had repeatedly ordered these people off their land. They had no social insurance—nothing. They had no means of surviving but to go on farming the land they traditionally farmed. In the end, because they resisted, he threw them and the local secretary of the peasants’ association into prison for good measure.
I had gone with my colleague to discuss agriculture—wells, tools, seed and irrigation—but what became very clear was that these people were preoccupied totally with justice. They wanted to have some resources to be able to go to the regional court and put their case before it. I can remember us sitting over some beer and doing some rough calculations, and reckoning that we could find a bit of money to help support them to go off to the regional court. One of my best moments in those formative years as director of Oxfam was when I heard at headquarters in Oxford that having taken their case before the regional court, the local judge was in prison and they were back on their land.
I tell this story because I have repeatedly found in my work with the Third World that what holds people back is a lack of justice and fairness, and what they are wanting is a fair crack of the whip. If this is true within the context of their own societies, when we move into a globalised society—with the vast power of the biggest international companies and the almost limitless resources that they have at their disposal for legal undertakings, cases and the rest—the case becomes even more obvious. I am very unhappy with this whole Bill, and have been from the beginning, because it is about limiting access to justice when surely a cause in a civilised society is to increase access to justice. If we have a serious commitment to the people of the Third World, as the Government keep demonstrating that they want to have, nothing is more important than ensuring that they can get access to justice. I really will be very despairing if the Government, even at this 11th hour, cannot respond to what the noble Baroness has argued.
My Lords, I have huge sympathy with the claimants in the Trafigura case, who received £30 million in damages, and if I thought that access to justice for people in their position were being blocked by this Bill I would be entirely with the noble Baroness. Unfortunately, the costs in that case were £100 million, reduced on taxation to £40 million. I do not feel particularly proud of a legal system which produces such a disparity between the damages that were actually received by the claimants and the lawyers who acted on their behalf.
