Lords ChamberThe noble Lord makes an important point. We want to make sure that those who generously invest in football are able to continue to do so, and to make sure that this investment flows right down the football pyramid so that it can be enjoyed by people, because football clubs are important to their local communities, as noble Lords know. We think that the owner and director test needs to be looked at, but we want to encourage investment across the whole of football.
My Lords, does the Minister accept that history demonstrates the need for tough regulation? I am slightly worried about the wording here, which refers to creating an “independent regulator”. We need something stronger.
My Lords, the independence of the regulator is an important aspect of its work. The Government see the two key problems in English football as the significant risk of financial failure and the risk of harm to the cultural heritage of clubs. That is why we agree with the recommendations of the fan-led review and are setting out our details in another place.

Lords ChamberThe noble Lord is right; it is an excellent report. I had the pleasure of serving on that committee before joining Her Majesty’s Government. The recommendations and evidence contained in it, as well as the 16,000 submissions we have had to our call for evidence, are all forming part of our careful review of the Gambling Act. We will come back with our proposals in due course.
My Lords, it is also important to remember that a great number of people gamble legally and enjoy doing so without harm. We want to strike the right balance to make sure that people can conduct this legal activity, while addressing questions of regional disparities. That is why we have put out our call for evidence. We are glad to have received so many submissions and are considering them carefully.
My Lords, when does the Minister expect the Government to respond to the review of the Gambling Act 2005? We all dislike the involvement of children in gambling, and bringing that to an end is well overdue.
As my honourable friend the Minister with responsibility for gambling has made clear, we will respond to the review in the coming months. My noble friend makes an important point about the role of children. We have looked at the impact of gambling on children as part of our review, and protections are already in place—for instance, to limit children’s exposure to advertising—so we are not waiting for the review to take action where it is needed.

Lords ChamberMy Lords, I thank the noble Lord and the noble Baroness for their remarks, which reflect the cross-party work that has improved this Bill throughout its passage and the interest that it has garnered from all corners for the benefits that it will bring. I am grateful to the noble Lord, Lord Blunkett, for reminding the House of the contribution of the noble Lord, Lord Field of Birkenhead, and indeed many others who have played close attention to this issue for a long time.
To respond to the questions and points raised by the noble Baroness, Lady Barker, we recognise that the provisions that were inserted on Report in your Lordships’ House were permissive, but the Government contend that Amendment 3 is preferable in three main ways. First and foremost, it fulfils our commitment to consult openly; we have emphasised throughout the passage of the Bill that the consultation must be fair and transparent, and we remain mindful of the need to bring industry along with us alongside civil society and the general public. We cannot therefore agree to any amendment that would suggest that the process would be undercut.
Secondly, it recognises the widespread support and positive impact that the current causes of youth, financial inclusion and social investment have had. I am sure that noble Lords did not intend to imply that those would be disregarded, but the provisions that were inserted on Report in your Lordships’ House were silent on those and thereby afforded community wealth funds more legislative attention than those initiatives.
My Lords, who is intended to select the investment managers for these funds?
My noble friend asks a good question, on which I will have to write to give him the answer and the full list, if he will forgive me for doing so.
I was just coming to the third reason why Amendment 3 is our preferred way of proceeding. The provisions inserted in this House would not achieve their objective of speeding up the pace of delivery. We must reiterate that releasing this money will not be immediate; indeed, we anticipate it taking several years for the £880 million to be released, and we do not expect any funds to be available for some time. Undercutting the consultation process would not materially affect the pace of that funding release. The Government have committed to launching the first public consultation on the purposes of the expanded English portion as soon as possible after Royal Assent. We anticipate that it could be live as soon as this summer and will be open for at least 12 weeks.
I repeat my commitment to write to my noble friend with the answer to his question, and I beg to move.

Lords ChamberMy Lords, the European Union was very clear in its negotiations and, alas, did not accept the proposals which the UK put forward during them. That is why we are discussing bilaterally with member states these matters and the implications which she and the noble Earl mentioned and providing as much clarity as we can to the industry, including through specific landing pages on GOV.UK to help it navigate the new arrangements.
My Lords, people working in the fashion sector, as in the creative industries more generally, often have irregular working patterns. Do the Government appreciate that and how have they taken this into account in the visa rules they apply to people working in these important fields?
My noble friend makes an important point. On Monday, we launched a dedicated temporary worker route for creative workers, meaning that creative and sporting workers are no longer grouped together in one immigration route. The temporary work route permits a gap of up to 14 days between engagements. In April, the Home Office introduced a mechanism to stop the clock when calculating that 14-day period, so that any time spent outside the UK is not counted towards it. That new arrangement better reflects the working practices of people in the creative sector and, I am glad to say, has been well received.

Lords ChamberThe Government reviewed all the evidence available and, based on that, concluded that to protect income for good causes and tax revenue for the Exchequer—which, obviously, is also spent in the public interest—the current model of taxation should remain in place.
My Lords, while I accept the good intentions of the noble Lord, Lord Brooke, I cannot agree with his proposal. I support the National Lottery’s existing remit to raise funds for community, arts, heritage and sports projects. Recently, 40% of lottery funding was for health, education, environmental and charitable causes. I estimate that more than £1 billion was awarded over two years to respond to Covid-19—the largest contribution made to pandemic relief beyond that made by government. This seems to illustrate the scope for substantial National Lottery expenditure on health. What is the average annual expenditure on health by the lottery in normal times and what percentage of total lottery spending is accountable for health?
I echo my noble friend’s reflection that the lottery distributors played an important part in responding to the pandemic and getting funding to organisations all around the country. There is no specific figure on health, but he is right that the National Lottery Community Fund has that as one of its four key objectives. More broadly, the work of all the lottery distributors could certainly be argued to be making a difference to the nation’s mental health and, particularly in the case of Sport England, to our physical health as well.

Lords ChamberIt is clear that BBC editorial policy does not trump the law of the land. The noble Lord will be aware that the BBC is undertaking a review of its editorial policy, which will report later this year.
In what specific ways does the Minister think Channel 4 might benefit from private ownership? What changes in its remit, if any, might government propose?
We hope through the consultation to discern two particular areas among others. One is access to additional capital; Channel 4 is reliant on advertising for 90% of its revenue. The other is potentially greater agility to respond to market developments as we move forward.

Lords ChamberPerhaps it would help if I quote directly from the Government’s response to the consultation in relation to the noble Lord’s valid and important point. We said that:
“The government considers that a future decision on decriminalising TV licence evasion would benefit from a clearer picture on the wider drivers of BBC income in the face of market and other trends.”
So, we need a rounded picture of those issues on which to take a decision.
Do the Government agree that legislation decriminalising TV licence evasion would, in practice, render paying for a licence optional and constitute a halfway house towards getting rid of the licence?
I do not entirely agree with my noble friend but he is right that it risks sending the wrong signal to the very small minority who seek to evade payment. We feel that it is more constructive to look at ways in which the BBC can support those on low incomes to pay the licence fee.

Lords ChamberThe right reverend Prelate is absolutely right. The figures that I just gave to my noble friend Lord Black in relation to culture recovery fund recipients do not include the supply chain, where we think significant numbers of contracted employees will also benefit. We are very aware of these issues and share the right reverend Prelate’s concerns.
My Lords, freelance workers in the arts sector have been among the worst hit by the Covid-19 pandemic, with all booked engagements simply cancelled with no remuneration. While the third grant to unemployed arts workers was indeed provided at the end of November, individuals who managed to finance themselves during the first grant and so did not need the grant at that time are unfortunately ineligible for third grants. Will the Government please install their eligibility? The recent measures mean that there will be no live performances in the London area, and the Greater London area theatres do not have the financial resources to put on live performances and will need help when government rules permit live performances.
The Government share my noble friend’s sadness at the impact of the recent decisions on London theatres but, obviously, that decision was taken on public health grounds. Under the new tiers that came into force recently, live performances are permitted in Covid-secure indoor venues in tiers 1 and 2. In relation to those self-employed people who did not access finance in the first two phases, they are not necessarily excluded from the third grant if their business has been badly impacted by Covid-19.

Lords ChamberI thank the noble Baroness for her question. We are delivering on our manifesto commitment to tackle issues around loot boxes. We had a bespoke call for evidence, which closed on 22 November. We plan to publish our response early in 2021.
My Lords, I share the late Lady Thatcher’s discomfort with gambling, which encourages addictive behaviour. I am keen to know what key issues the Government intend to focus on in the forthcoming review of gambling legislation.
I thank my noble friend for his question. The scope of the review is intentionally very broad, because we aim for it to be as comprehensive as possible. The three big priorities are the safety of children and whether we are doing everything we can to keep them safe; whether advertising and promotion are carried out responsibly; and whether the regulatory framework is working. Within that, are the voices of those with lived experience being heard?

Lords ChamberI do not wholly recognise the numbers that the noble Lord cites. We are very clear that we stand by our freelancers across the creative industries, both directly through the Self-employment Income Support Scheme, as well as through major packages such as the £500 million Film and TV Production Restart Scheme. We estimate that this will directly support between 40,000 and 50,000 new jobs in the sector, many of which will be taken by freelancers and the self-employed.
My Lords, what is the estimated value of the total annual output lost by the cultural and creative industries as a result of Covid-19? What proportion of GDP per annum does this represent?
As my noble friend knows, the cultural and creative industries have been a critical and rapidly growing part of our economy, representing about £111 billion of gross value added in 2018—or 6% of GDP. We estimate that, up to August 2020, output in arts, entertainment and recreation was about 28.1% lower than in February 2020.
