My Lords, my noble friend raises the important issue of the horticultural industry. On a personal note, during his time as Chief Whip and a Minister I often benefited from the precious gifts he provides around Christmastime to many of us across your Lordships’ House. Flowers bloom in your Lordships’ House courtesy of my noble friend. I think the noble Lord, Lord Collins, is feeling left out, and I say to my noble friend that perhaps that can be extended to him.

Of course, my noble friend is absolutely right. The horticultural industry, as well as all others, is very much part and parcel of our consultations to ensure that businesses operating across the United Kingdom continue to benefit from their own perspective and, importantly, that citizens across the United Kingdom benefit from businesses as well.

My Lords, in the other place, the Secretary of State referred to unintended consequences. I have to say that all the consequences were foreseeable—and indeed were foreseen. The Foreign Secretary said,

“I want to be clear … that this is not about scrapping the protocol”,


and my noble friend Lord Moylan hit the nail on the head. Does this mean that, in perpetuity, laws will be made on behalf of Northern Ireland by a foreign power over which we have neither input nor say?

My Lords, my noble friend brings great insight and experience, and I pay tribute to his work in Northern Ireland. The Government’s position is very clear: we are acting and will continue to act in good faith. Practical issues have arisen from the imposition of the protocol which are simply not working—they are not working for Northern Ireland or for businesses, and they go against the actual agreement that we all want to uphold. As my noble friend Lord Lilley articulated very well, we all want to see the essence of the Good Friday agreement sustained as part and parcel of our discussions going forward. We will continue to work to ensure that all people across Northern Ireland have the opportunities and rights that are protected in that agreement, and where the protocol does not do that, it needs to change.

Before the Minister sits down, while progress has been made on providing funding for the investigatory bodies, given that we expect imminent and immediate impact on investigations from the passage of the Bill, what assurance can he give the Committee that personnel with the necessary qualifications and experience will be available in the very short term, even though the funding may be following them?

My Lords, within the agencies, particularly the NCA, of course we have great expertise and insights. I cannot provide the noble Lord with specific numbers but, as I said earlier, the Government very much stand by the principle that in introducing these regulations and these new powers, and when it comes to the implementation of our sanctions policy, we need to ensure that we are fully and appropriately resourced so that those people who are sanctioned can be acted upon.

As my noble friend knows, the Government have been taking serious regard of all the concerns that have been raised. My honourable friend the Rail Minister meets with GTR weekly. My right honourable friend the Secretary of State has appointed Chris Gibb to look at the issues which arise between Network Rail and GTR, and his report will come through at the end of this year—at the end of this month. As I said, my right honourable friend the Secretary of State has now written directly to both RMT and ASLEF, asking them to meet with Southern at ACAS, where we hope this issue can be resolved. I agree with my noble friend and with all noble Lords; many in this House and beyond have rightly raised this issue because they are exasperated. That is probably a reflection of the sentiment the Government feel. We are taking major steps to resolve this issue, and I implore all parties, particularly those involved with the dispute, to come forward so that we can tackle the dispute and then the long-standing issues which impact negatively on this line and on many people in the south-east of England.

My Lords, will the Minister consider whether the operators of this service are still fit persons to operate it at all, and will that be taken into account when the franchise comes up for renewal?

The noble Lord raises the specific issue of the contract. I assure him that when we have directly raised issues about the failures of this line, as noble Lords will be aware, GTR has raised the issue of force majeure. We have now gone further and are looking at each case of force majeure, which impacts on 10,000 separate train lines, and which it raised between April and June of this year, to see whether they stack up. The DfT is currently looking at that report to ensure that, every time that is claimed on that contract, it is looked at extensively and we can respond accordingly. Until we have completed that exercise, we cannot hold GTR in breach, because we have to establish whether the basis for it claiming force majeure is valid.

On the second practical point, the Government are clear that we have now taken a decision that is focused on the additional runway at Heathrow. The consultation will be focused specifically on ensuring that the challenges, and that runway, can be delivered. On his other point, I thank the noble Lord for his support. Of course I will convey his sentiments to my right honourable friends the Prime Minister and the Secretary of State.

My Lords, the Minister said in his Statement that he is strengthening connectivity for passengers right across the UK. It does not matter how many runways are built. The question is: are there slots for the regions to get access to them? The Minister will know that my Airports (Amendment) Bill, which I introduced some time ago, was designed to guarantee slots. He said that he could not guarantee them because of European Union legislation—but now that we are leaving the European Union, will he, with the vigour, robustness and determination that only he can deliver, take my Bill, which was well ahead of its time, strongly support it, and implement the legislation to guarantee the slots for regions?

I have always regarded the noble Lord as a forward-looking Peer in your Lordships’ House, and he and I have spoken extensively about the importance of regional connectivity. Today’s decision delivers that very regional connectivity. Indeed, Northern Ireland will benefit from the extra availability of slots and connectivity; it will be one of the six regions to benefit directly from this decision. On the issue of PSOs, which he has previously raised, he knows that there are decisions that we have taken—most recently to protect particular routes connecting to London to ensure the continued growth and prosperity of different regions, including Northern Ireland.

The noble Lord has asked me “at last” to acknowledge that, but I have previously done so and acknowledge again that London Luton Airport continues to be an important part of the UK plc airport offering. As he has just outlined, it has been a successful part of that contribution and I am confident that that contribution will grow in the months and years ahead.

My Lords, will the Minister not accept from me that even if a third runway at Heathrow or wherever were to be paved with gold, it matters little to some of us who cannot get access to it? The right reverend Prelate made the point about the comment made by the chief executive of IAG, which is only one comment. But the Minister will know of my interest in this matter; the regions do not have guaranteed access to a major piece of national infrastructure, and through European law the Secretary of State has no power to do anything about it and ensure access. Can the Minister revisit this issue, because it is fundamental? If it is a national piece of infrastructure, all parts of the nation should have access to it, but currently his department has no control over that.

I know that the noble Lord has raised this issue before and, again, I assure him that the Government have an answer to this. If a particular route is affected—for example, Gatwick to Newquay—the Government have stepped in when public concern has been expressed and have guaranteed support and financing for the route. We continue to ensure that all routes that need to be supported are supported. The Government take very seriously connectivity across the whole of the United Kingdom, including Northern Ireland.

The commission report, which I recommend to my noble friend, considers all these areas. We are running near to capacity at Heathrow and at Gatwick as well, so the immediate task for the commission was to look at addressing those needs. The report also looks at further needs beyond 2050.

My Lords, it will be 10 or 15 years before any additional capacity is available. Meanwhile, our internal regional access to our one current hub at Heathrow continues to be at risk. Given that Europe controls the slot allocations at Heathrow, will the Minister give consideration to the Government positively pushing Brussels so that we can regain control over our own national, fundamental piece of aviation infrastructure?

I have never regarded the noble Baroness as being hard line in any respect. I am sure she will agree that it would be inappropriate for me to give a commitment at this time. The Government will evaluate the report, and we will come back on the way forward in the autumn.

My Lords, because the noble Lord’s Question for Short Debate will be taken as last business, the time limit for it will become 90 minutes rather than 60. Therefore, speeches should be limited to seven minutes, except for those of the noble Lord, Lord Empey, and the Minister, for which the limits will remain 10 and 12 minutes respectively.
