To ask Her Majesty’s Government what principal issues they intend to raise in their forthcoming meetings with President Hollande and members of the new Government of France.
My Lords, France is an important partner for the United Kingdom and our dialogue is wide-ranging. The Government look forward to continuing their close co-operation with new French Government, including on foreign and defence policy, energy and immigration. My right honourable friend the Prime Minister had a warm first meeting with President Hollande in Washington. He has invited him to visit London after the French parliamentary elections this month. Other Ministers across government have also met or contacted their new counterparts.
I thank my noble friend for that Answer. With the French Government securing ever greater support for their EU-wide growth agenda, particularly now that they are armed with decisive strength in the French Parliament, including when next Sunday’s results are taken into account, does he agree that it would be very fitting for HMG to join that European-wide effort, because there is now an increasingly urgent need to offset the threat of an international slump?
Yes, we all have to join in the efforts to bring about recovery and end recession in our region and globally. These are matters that we discuss closely with the French. We agree with some of the ideas behind the various projects which Monsieur Hollande has put forward—what has been called the “Hollande vision”—but disagree with others. We have a perfectly amicable difference of view on, for instance, a financial transaction tax, which we believe would be damaging and would, according to the European Commission’s own analysis, take €200 billion out of the European economy. However, on other ideas of Monsieur Hollande—project bonds for infrastructure expansion, for instance—we concur. We reject the idea that there are two alternative strategies that are exclusive: austerity or growth. The answer is that sound budgetary discipline and growth all go together in a sensible and balanced programme.

Lords ChamberI am afraid that I have absolutely no idea about a statement of that kind. I do not know where the noble Lord read it. Perhaps I may find it later. If it was said by the Prime Minister, I am sure that it is true but I do not think that it was.
My Lords, I thank the Minister for once again showing HMG’s resolute determination to help the eurozone leaders in solving this crisis and for ignoring the flimflam from the anti-Europeans. But, without giving instructions of course, would he give some friendly advice to the British press to restrain and reduce their hysteria on this subject of the eurozone crisis at a time when the United States 16 trillion dollar irreducible debt system, which is facing national default yet again, is totally ignored by the British newspapers?
It is not for me to advise the media on their priorities but clearly the eurozone crisis could have considerable impact on all economies in the region and certainly on the United Kingdom. We are right to be concerned about it and the media are right to examine it and to bring home—through their experts and commentators, in addition to the expertise already in this House—that if there are further difficulties and the problems in the eurozone are not resolved, it will certainly hurt the British economy as well. That is inevitable.

Lords ChamberI would not myself put it in the way that the noble Lord has. The United States is one of our priority countries, and we regularly make our views known to the US authorities bilaterally through the European Union and in any other way that we can. We are particularly concerned about individual cases of British nationals facing the death penalty in the USA. It is undeniably a problem, but I do not think that it weakens the argumentation that can be put forward in other countries—where, here and there, there are some definite signs of progress. I remind the noble Lord that, for instance, in 2009 Barbados announced its intention to abolish the death penalty. There is a UN General Assembly resolution coming up on this whole area which we are strongly supporting.
Further to the question from the noble Lord, Lord Dubs, does my noble friend agree that the United States is a particular problem because there are well over 4,000 people on death row, many of whom have been there for many years? That must amount to cruel and inhuman punishment. Some of those are mentally retarded people. Will the Government make real efforts to persuade the United States and the federal government to drop capital punishment?

Lords ChamberMy Lords, I expected to enjoy and appreciate the speech of the noble Lord, Lord Radice, and I have done so even more than I thought I would. I shall embarrass him deliberately by thanking him for a speech which I envy because I wish I had had the chance to make it myself. However, I forgive the noble Lord because some years ago he said to me—I am happy to apologise if my memory is at fault—that despite having a distinguished Italian name, he is not a linguist and does not speak Italian. None the less, he has been a strong European over the years. I recall that in the mid-1990s he succeeded me as chairman of the European Movement in Britain and we have carried on not only a friendship, but also often a mutual appreciation of European matters to such an extent that all I would need to do today, if only the rules of procedure would allow it, would be to cross the Floor of the House, get the text of his speech and read it out again, such is the common sense and wisdom of many of his remarks.
I share with the noble Lord his appreciation of the positive tone in the speech of my noble friend Lord Howell. It certainly ended on a strong upbeat note by stressing the need for Britain to be fully engaged in developments in the European Union. I do not criticise him, but because of the circumstances of receiving notes which one does not have time to read at the Dispatch Box when they are handed to you, he stumbled a bit on the issue of the clarification of the safeguards. I can understand why because unfortunately, and through no fault of my noble friend Lord Howell, the issue remains a product of imagination rather than reality. It remains to be seen what will actually be done by the Government to rectify this most extraordinary omission in the history of international and European negotiations from 9 December onwards. It is not something you would normally expect. To be fair, the UK Government have come forward substantially and since then have been more positive by realising that we really do have to help our colleagues in the eurozone, both indirectly and no doubt directly in some ways. That is the priority and it helps us as well, not just through trade but also in other things, not least the long-term development of the European Union.
I also pay tribute to the interesting, sensible and wise speeches made by the noble Lords, Lord Mandelson and Lord Grenfell. They themselves do not represent the more recent change in many Labour politicians and spokesmen to being keener on Europe than they were in the past; that really was consolidated when the Lisbon treaty was passing through both Houses. I now perceive Labour, particularly in this House but also in the other place, generally as a positive and pro-European party. There is a small number of exceptions among the rather older Labour MPs, but I do not see any other difference.
As our involvement in the EU grows with the passing years, I wish that that was so in the main party in the coalition. However, there have been setbacks in recent years which surprised me before the election and, indeed, surprised me afterwards. Normally, the old historical feature was that parties would become anti-European when they went into opposition. That was the pattern set by the Edward Heath Government, who as a Government were very keen on Europe with Edward Heath pointing the way forward when we first joined the Community. That pattern has been replaced by a new phenomenon of the main party in the Government now being more and more strongly anti-European. A huge number of Conservative MPs in the other place are viscerally opposed to Europe and all its works. Just look at the words they use in speeches in various European debates, and the glee and triumph that greeted the Prime Minister at Chequers when he returned from the 9 December meeting with his so-called deal, which obviously was beginning to unravel almost as soon as the ink was dry in the face of the reality of the situation in this country vis-à-vis our partners and fellow EU members dealing with eurozone problems. It is sad to note that the Conservative Party is like that now and I hope that it sheds this view as quickly as possible, given the reality of our position in the world and the need for us all to work together to deal with the worldwide crisis and the European recession.
The noble Lord, Lord Radice, may have inferred it but did not say it, but I imagine he would agree that you cannot have a genuine, full, single market—to which we are addicted and keep saying as much as a leitmotif—without having a single currency; that has to come. It may be painful on the way, but the European authorities, the heads of government and one head of state in the different countries, mainly France and Germany, are dealing with it and gradually getting there. Although it is a panicky and jittery process, which is inevitable given that these are enormously complicated negotiations in which people often lose their tempers—all the sovereign countries have to be fully consulted, which is very difficult—they are getting there step by step. Enormous progress has been made towards solving the eurozone problem.
I am also very optimistic that there will be a solution for Greece over the next days and weeks. Indeed, everything will have to be in place for the next bond auction date in, I think, the third week of March. I believe it will happen because it has to. It is very distressing to see the animosity that has broken out in the international press, now picked up by the British press, between Germany and Greece, with the leading figures from both countries having a go at each other. That may be a function of the stresses of the day in trying to get the agreement going, and thus is understandable, but it is not something that is of any lasting significance. There is a great relationship historically, although of course I am not referring to the Second World War, over the long term not only between Germany and Greece but also between all other European countries, including ourselves. Greece does need help and she will respond. We shall see the details of the agreement very soon.
I pay tribute to the way this has been achieved very patiently by the people involved. We must now support it more and more rather than waiting with relish for things to collapse. The obsession, unfortunately again mainly in Conservative circles but also in UKIP and among other smaller political parties, with the concept of national sovereignty is now truly outdated and has to be overtaken by events as countries work more and more closely together. There is also an idea that we can shrug off the pronouncements of the credit rating agencies by saying that it does not matter if they downgrade various countries. The United States and, I think, France have now had a downgrade, but we still have our triple-A rating. However, the rating agencies are themselves flawed institutions and make lots of mistakes. They certainly did on their triple-A predictions for the credit rating levels of several institutions that then went bust a week later, sometimes even less than a week in the case of one or two hedge funds and housing loan corporations in the United States.
The United States is a heavily indebted, technically bankrupt federal system, and most of its individual states are technically bankrupt. If they were individuals or companies, they would already be in the bankruptcy court. They can do it because they are states and a federal country, with a $16 trillion debt burden that is incapable of being reduced by the American political process. Those matters should be of greater concern to Conservative politicians than the temporary problems of the eurozone as we get through this very difficult period, which, as the noble Lord, Lord Radice, said, was quite likely caused by the international banking and speculators crisis from which we are all still suffering.
I add my words of praise to what has been said about the euro area crisis. We thank the noble Lord, Lord Harrison, and his team for having produced a very positive report on the way in which, once again, the eurozone is coming through this crisis. On 31 January, the Prime Minister said:
“The principle that the EU institutions should act only with the explicit authorisation of all member states remains. Let me be clear: this is a treaty outside the EU. We are not signing it”.—[Official Report, Commons, 31/1/12; col. 678.]
Since then, the Government have seen the light about the need to work with the other countries. I agree strongly with paragraph 150 of the EU Committee’s report, which states:
“It is unacceptable that the Government have not released appropriate details of the safeguards which the Prime Minister sought at the December European Council. This makes it impossible to form a balanced judgement about the outcome. Coming to the present, we invite the Government to indicate what necessary safeguards they think have yet to be achieved, and what provisions … in the proposed treaty are objectionable to them”.
Until the Government give us that essential information, there will be no underpinning of the emotional support that we want to give them now for sounding more positive about European matters.

Lords ChamberMy Lords, if an aspiring Tory candidate for the other place decides to deny that he is Europhobic to the local party, he will not be selected. That means, logically, that UKIP is not fit for purpose, so will it not disintegrate much quicker than the eurozone recovers from its own crisis?
I am not sure that I quite get the ins and outs of all that. Generally, I hope my noble friend agrees with me that Europe is our neighbourhood but the world is our market, that we must have a balanced and sensible approach in developing good relations with a European Union which obviously requires reforming and modernising to meet the 21st century, and that we must also adjust our own nation to meet this new international landscape.

To ask Her Majesty’s Government when they will next meet other European Union member state Governments to discuss the December 2011 Eurozone agreement.
My Lords, two meetings of the ad hoc working group on the fiscal stability union, in which the UK is participating, have been held so far. The first was on 20 December and discussed general views on the draft international agreement on a reinforced economic union and the practical arrangements for the preparatory work. The second meeting, on 6 January this year, discussed the proposed provisions in the draft agreement, particularly those relating to consistency and relationships with the law of the Union and fiscal issues. The ad hoc working group plans to hold a minimum of a further meeting a week.
My Lords, I thank my noble friend for that Answer. As the Liberal European leaders gave such good advice over the weekend, what is the coalition response to the points that they made, including the vital point about whether there should now be a full EU treaty?
The views expressed by the group to which my noble friend has referred were of course very interesting and coincided broadly with what we all accept: if, as the Deputy Prime Minister rightly said, the UK’s interests are properly and fully safeguarded, then eventually this could emerge as a European treaty. However, at the moment that is not the position, as my right honourable friend the Prime Minister had to make clear in the December Council, where it was plain that our interests were not safeguarded. Until that matter is resolved, it is difficult to see how this can become a full European treaty.

Lords ChamberWe will certainly try. It is not all that easy to pin down and specify the outcomes as time goes by. I know that the noble Lord will be the first to appreciate that these developments, particularly in the field of democracy, are owned by the countries themselves. We are not in a position to score specific targets and to tell them to get to this point or that point. That is not at all the language in which we conduct our affairs. Our respect is for these countries and for their efforts to struggle forward to better and more settled democratic structures. It will not be easy for any of them, but we will give our support and try to score the outcomes and results that we want.
Does the Minister accept that the Palestinians also deserve their Arab spring after 43 years? Will he and the Government work very hard to persuade the United States Government not to exercise a veto—well over the 30th since 1967—stopping Israel behaving according to international law?
As we discussed in this House earlier in the week, it would be desirable to avoid any confrontation and any vetoing. It would also be desirable for as many nations of the world as possible to carry forward their recognition of Palestine, and to move to nationhood and establish some negotiation with Israel which will point them in that direction.

Lords ChamberI am grateful to the noble Lord and, of course, I share and we must all share in the condolences which he touches upon. As to his earlier questions and propositions, I agree with most of them. However, the question hangs in the air, and I hope it will be resolved, as to whether action at the United Nations will enable that move to statehood to take place. That is what we all want and that is what must proceed. We hope that action at the UN will open up a better pathway to negotiation, but if it was the opposite and it led to confrontation—if more business there closed down negotiation—then it clearly would not be such a good thing. We just have to wait and see what the texts are, how the matter is going to be approached—whether through the General Assembly or the UN Security Council—and then we will take our decision.
My Lords, while the recognition of statehood might alter the negotiating parameters and the Minister has affirmed the importance of negotiations towards achieving a final settlement, will he also affirm the important role in any ongoing negotiations of the wider Palestinian diaspora, including those who have the recognised status of refugees? Will he say what the Government are doing to ensure that the rights of such refugees are not compromised or taken away by any recognition of statehood, including their legitimate right to be heard in international fora such as the UN?

Lords ChamberMy Lords, I beg to move Motion B1 in the name of my noble friend Lord Triesman. The original amendment which this House carried reduced the number of referendum locks in the Bill from 56 to three—that is not counting major treaty change. That was the amendment that we carried and that has been considered by the other place. This amendment substitutes for the position we took on that occasion the view that referendums should be mandatory only where, in the view of the Secretary of State, they are of major economic and constitutional significance. I assure noble Lords opposite that that is fully in line with the policy of the Labour Party.
When the Bill first went through the House we were told many times by the noble Lord, Lord Howell, that all the issues covered were constitutionally or economically significant, but when you actually look at it, that cannot be the case. When you look at the questions of moving from consensus, or unanimity, to majority voting listed in Schedule 1 to the Bill, they cannot conceivably be regarded as constitutionally significant. For instance, there are matters such as the approximation of national laws affecting the internal market, the guidelines of economic policies and excessive deficit procedures. As we know, on one of these items—the British Government changing the list of military products exempt from internal market provisions—the noble Lord, Lord Kerr of Kinlochard, pointed out that we had been arguing for this as a country in our national interest for years in the councils of the Union. So the Bill contains far more referendum locks than those that could be regarded as of major constitutional significance.
Noble Lords on the government Benches are fond of quoting the Lords Constitution Committee when it suits them. What they fail to quote is the major conclusion of the Lords Constitution Committee on referendums—that they should be used only on matters of major constitutional significance. They cannot conceivably argue that all the items covered here pass that test. If we do not apply this test, as in this revised amendment, we are making a major move from a representative democracy to a plebiscitary democracy and that is something that should be of as much concern to Eurosceptics as it is to pro-Europeans.
The other problem with this plethora of locks, as we have argued before, is that they will gravely inhibit the ability of any British Minister or Government to represent our national interests in Europe on a flexible basis as issues come up. No Government will volunteer to hold referendums, not because they fear Euroscepticism but because, as has been shown by all the academic evidence that has studied them, referendums are, in the main, decided by the people on issues other than the question being asked. That is what you get in a plebiscitary democracy. All kinds of issues are decided on questions that are nothing to do with the subject of the referendum. If it is impossible to put issues to referendums, then Britain will be very constrained in its European policy. If this is continued for 10 or 20 years, it is bound to lead to a process of British self-marginalisation in the European Union.
I do not believe for a second that that is what the noble Lords, Lord Howell and Lord Wallace, and the Benches opposite want. However, the truth is that the Adullamite cave of anti-Europeans in the other place and in the Conservative Party, who have insisted on putting the Bill in the coalition agreement, want to make Britain marginal in Europe because they want the Bill to lead to Britain coming out of the European Union.
Is not the noble Lord also perturbed that at the last annual Ditchley lecture the former Prime Minister, the right honourable John Major, feared that Britain was already a semi-detached member of the European Union?

To ask Her Majesty’s Government what principal subjects they intend to discuss with the government of Poland when they next meet, in view of the start of the Polish European Union Presidency from 1 July.
My Lords, Her Majesty’s Government engage with the Polish Government at all levels. These meetings are opportunities to discuss a range of issues and occur at both ministerial and official levels. Prior to, and during, the Polish presidency, the Poles have outlined their priorities as being divided into three general themes: European integration as the source of growth; a secure Europe in terms of food, energy and defence; and Europe benefiting from openness.
I thank my noble friend for that Answer. In view of the Energy Secretary’s disappointment about the Polish Government’s refusal last Tuesday to accept the 20 per cent target for emissions by 2020, will my noble friend confirm that Poland is willing to accept a compromise solution to this unexpected problem during its presidency period?
We shall have to see how this works out. Obviously, there are a lot of elements in this debate as we move forward to a new energy mix and the energy transition throughout Europe. Poland will play a leading part in that, whether or not it accepts the immediate renewables targets, because it is seeking to change its own economy away from a heavy coal base and a reliance on Russian gas to a more modern mixture of energy developments. That will include renewables and, possibly, the major development of shale gas and other unconventional gas sources.
