Lords ChamberI am not aware that we have undertaken a specific study on the impact of Airbnb on the private rented sector. However, we have a clear mission within the levelling-up White Paper to reduce the number of non-decent homes by 50% and therefore see equality of supply. We are looking at whether there is an erosion in the private rented sector through the annual English Housing Survey, which gives some indication of whether there is a need to dig deeper. So far, all indications are that the sector is robust; 4.4 million households are renting privately and it seems to work well. However, we are keeping that matter under review.
My Lords, I welcome many of the reforms. However, have Her Majesty’s Government made any sort of formal economic assessment as to whether these protections will do anything to address the higher costs of private rented accommodation, which can so often drive people to social housing? If not, can they assure this House that there will be sufficient affordable social accommodation for those who really need it?
There are two parts to how the right reverend Prelate has put the question. The first is that we need to make sure that there is enough supply of social housing, otherwise people who should be in social housing rather than in private housing lose out. There is a real commitment in the affordable homes programme to deliver far more social rented homes: 32,000, which is double the amount of social rented homes in this period than in the previous one. On the cost of living, the best thing is to take action now, and there have been quite a few measures. Some are universal but some are aimed at pensioners; there is a separate one-off payment of £300 to 8 million pensioner households, and obviously there are the measures around people who require support around the costs of essentials. The Government have stepped in where there need to be specific measures, as well as universal measures around fuel bills. Equally, however, the right reverend Prelate is right that we need to ensure that we continue to build more homes and especially ensure that there are more social homes.

Lords ChamberI thank my noble friend for stepping in helpfully. Of course, as we approach Report, the Government will bring forward further amendments that will do more to protect leaseholders but will also ensure that the polluters must pay—my noble friend and I share that principle.
I join other noble Lords in thanking the Minister for the considerable progress he has made and his very collaborative approach as we work through the Building Safety Bill. He will be aware that the definition of a qualifying lease in the Bill is set to exclude many small private landlords. We are not talking about the big commercial set-ups but people who have one, two or possibly three flats which they bought simply to provide themselves with a pension. Do Her Majesty’s Government intend to look at that definition of a qualifying lease again? Many of those people are deeply worried at the moment.
I thank the right reverend Prelate, who has also been a consistent campaigner. As a Government we are very much aware of the impact this has on, say, pensioners, where property is their primary pension asset and the annuity from those properties effectively pays for their pensions. As I say, I ask the right reverend Prelate please to wait until we bring forward further amendments on Report, but we are very alive to this issue.

Lords ChamberI am very pleased that the issue of lenders has been raised: it is one area where we need to see a greater sense of proportion. When I have spoken directly to primary insurers, they have given the undertaking that their practices are that, at the moment at which it is clear that cladding remediation costs have been found and that remediation will be undertaken, they can begin to reduce building insurance premiums. That is not the case with the banks. I have had many leaseholders come to me to say that they cannot move on with their lives because the banks are not changing their practices and are not offering mortgages, even when the remediation is locked in or even begun—it often takes about a year to do some of these projects. We will engage with lenders to say, “Can you take a more proportionate approach to risk, to ensure that people can move on with their lives?” I thank the noble Lord for raising that point.
My Lords, the Secretary of State announced an additional £27 million for fire alarms. Are similar grants being considered for installing sprinklers in buildings over 11 metres?
My Lords, I am delighted that we have heard from not just one but two Bishops, because the right reverend Prelate has been a tireless campaigner on behalf of people in St Albans and beyond. The additional £27 million comes on top of the first tranche of money, which was £30 million, so we are talking about nearly £60 million towards providing alarm systems in buildings, rather than the ridiculous practice of having “waking watch” costs month by month, which run to hundreds of thousands of pounds for leaseholders to bear. We must look at how we encourage mitigation as the solution. I am not sure—I am not a fire engineer—but sprinklers are a potential way to achieve that, particularly in low-rise buildings. We have not necessarily looked at taxpayer funding, but we will take that away and see how we can best encourage more mitigation where that is a safe and sensible end-point and ensure that we can avoid costly remediation being the preferred option, if we can make a building safe enough.

Lords ChamberMy Lords, it is for my right honourable friend to set out this approach. It is entirely proper that he should do that, and he has undertaken to do so. He has set out the principles around greater proportionality, protecting leaseholders and getting the polluter to pay, as I have said previously at the Dispatch Box. We must wait for that detailed announcement, but I am taking a personal interest. I have called in registered social landlords who seem to be passing on costs to shared owners and leaseholders, and held them to account. The chief executive of Optivo has indicated to me that it is now not proceeding with costly remediation for Oyster Court or Mill Court. I am also calling in another RSL—Shepherds Bush Housing Group—which seems to be considering passing on costs on a medium rise to shared owners who do not have the bandwidth to be able to pay it. Actually, Shepherds Bush Housing Group was the original developer and was subsidised to do the development; I think it wrong that these registered social landlords are in some cases seeking to pass the costs on to people whose shoulders are not broad enough to bear them.
My Lords, one of the very serious results of this problem is that many people are desperate to move, but simply cannot sell their properties any longer. This is causing huge difficulties for people trying to get jobs in other parts of the country. What assessment have the Government made of the Welsh Government’s proposal to start buying some of the properties that cannot be sold for the moment and turn them into affordable housing and social housing and so on, as a way of trying to break the deadlock?
My Lords, I have always loved a magic bullet, but the reality is that the scale of the cladding and building sector crisis in Wales is a fraction of that in England. That is just a fact: I could give the right reverend Prelate the statistics if he is interested, but we are not going to solve it that way. We need to have a greater sense of proportion. We have made this a bigger scandal than it needs to be because too many buildings have been declared unsafe that are perfectly safe. Frankly, there is an industry profiteering on the back of this, and we need to do something about that. There needs to be a call for innovation to encourage mitigation, more often than not, rather than full-scale costly remediation; we need to make sure that there is an adequate, sensible, proportionate approach to this crisis.

Lords ChamberTo ask Her Majesty’s Government, further to the report by the Rural Services Network Towards the UK Shared Prosperity Fund, published in June, what plans they have accurately to reflect in-work rural poverty in future funding allocation mechanisms.
The UK shared prosperity fund will help us to level up and create opportunity across the United Kingdom in the places most in need and for people who face labour market barriers. The Government are working closely with local areas, including rural communities, to assess how the UK shared prosperity fund can best target places in need.
I thank the Minister for his reply. Recent research by CPRE suggested that just 40% of young people living in rural areas expected to remain there in the next five years. They cited affordable housing, connectivity, rural transport and rural employment as the factors driving them out. If Her Majesty’s Government are to deliver on the levelling-up agenda between urban, rural and suburban, is it not time for them to deliver on the rural strategy promised in the response to the Select Committee report Time for a Strategy for the Rural Economy?
My Lords, the Government are committed to addressing the issues that the right reverend Prelate raises. For instance, the levelling-up fund of some £4.8 billion will focus specifically on the issues around transport connectivity, regeneration and ensuring that we see economic recovery, whereas the shared prosperity fund will deal with the issues around unemployment, skills, productivity and other labour market barriers.

Lords ChamberMy Lords, I am very happy to join the noble Lord in visiting the people who will be demonstrating today at 1 pm. This is continually a moving feast. I am happy to announce that we are increasing the amount of money we are putting in the waking watch relief fund, which has been a crippling cost for many leaseholders, by a further £5 million to the initial £30 million. That has helped around 20,000 leasehold dwellings and 264 buildings to date. We continue to ensure that we find ways to make sure that the original developer pays wherever possible.
My Lords, many people do not seem to realise that this is having a devastating effect on people of every social class. I was 10 minutes late coming in because I was hearing about a lawyer living in St Albans, where I live, who now faces bankruptcy and may no longer be able to practise if she is made bankrupt. If you buy a defective car it gets recalled and has to be sorted out. What attention and consideration are Her Majesty’s Government giving to the polluter pays principle, which we need to build into this issue if we are to address this devastating problem unfolding before our very eyes?
My Lords, we recognise that if you buy a defective dwelling you expect the person responsible for the building of it to do something about it. That is precisely why the Government, as part of the Building Safety Bill, are proposing to increase the Defective Premises Act redress period from six years to 15 years retrospectively, which will bring in a great number of buildings to be able to seek redress from developers. That is why we continue to work on measures that will ensure that the polluter does pay wherever possible, and we are looking very closely at proposals from Steve Day and his team around the polluter pays amendments.

Lords ChamberMy noble friend’s suggestion has some merit. Even a limited revaluation would be costly and would yield significant extra revenue only in those parts of the country where house prices are the highest, given that council tax income is not redistributed. It would also leave council tax payers in a rather odd, and arguably less fair, situation where some were paying their tax based on 1991 values while others were doing so based on prices in the present day.
According to the citizens advice bureau, council tax is the most common debt problem faced by families in Britain, with 86,000 people in England struggling to keep up with payments. The current system heavily favours the south-east and disproportionately disadvantages the poor. As part of the levelling up agenda, what consideration have Her Majesty’s Government given to a land value tax to address these inequalities?
My Lords, the Government do not have any plans to introduce such a land value tax, but they are committed to supporting those on low incomes, including by increasing the living wage and by spending £111 billion on welfare support for people of working age in 2020-21.

Lords ChamberMy Lords, we need to recognise the existing frailties of the current planning system, which has not been reformed for over seven decades and has a very poor record on public engagement. Data shows that less than 1% engage on local planning consultations and only 3% engage on applications. That is something that we intend to improve with the reforms that we have outlined in the White Paper.
My Lords, there is a real risk that the proposed changes to the planning process could mean that fewer accessible homes are built for older and disabled people. Research from the housing association Habinteg reveals that more than half of all local plans make no requirements for new homes to meet any accessible housing standard. Fewer accessible houses are being planned now compared with 2019. What plans do Her Majesty’s Government have to ensure that more homes are built to accessible and adaptable standards?
My Lords, we continue to set standards around accessibility and recognise that it plays an important part in getting the right number of new homes. We have set out an approach that allows more public engagement, so that local communities can shape the places that they live in.

Lords ChamberMy Lords, I have mentioned the unprecedented level of funding that has been put forward towards the remediation of cladding, but the risks inherent in a medium-rise building are far lower than in high-rise buildings, some of which go well over 30 metres—the higher the building, the greater the risk. However, it is a significant commitment to ensure that leaseholders in these medium-rise buildings do not have to pay more than £50 per month to enable the remediation of unsafe cladding.
My Lords, the Government have said that it is not right for the taxpayer to bail out leaseholders, but taxpayers’ money through the building safety fund could be bailing out developers for building substandard developments. What plan do the Government have to investigate whether developments met fire safety regulations at the time of construction and, in those cases where regulations were not met, to apportion remedial liability to the developers, so that those responsible actually pay?
My Lords, we made it a condition of accessing any form of government funding that building owners should go through all the routes of redress, in terms of looking at warranties and taking on areas where there has been poor construction practice, to ensure that remediation costs are not passed on to leaseholders.

Lords ChamberI am very new to this place but, as I have tried to highlight, I do not believe that the solution in large part involves statute. The noble Lord is asking for a further commitment that is really about putting more government money up front to pay for the significant costs faced by leaseholders. It would not be helpful to amend the amendment by removing that word, because I do not think we could accept the amendment in any way whatever. We have set out that we want to focus on the remediation of unsafe cladding because cladding on the outside of buildings is the major fire accelerant. That is what we will focus on and we are putting forward over £5 billion to do precisely that—a significant, globally unprecedented amount. I do not think amending that one word moves us any further forward.
My Lords, I am hugely grateful for the extraordinary range of speeches made today. I acknowledge what Her Majesty’s Government have done; I take the point that this is unprecedented and a major contribution towards trying to sort out this very difficult problem. The Minister knows that I have said on many occasions that I am terribly naive about all this. I was hoping Her Majesty’s Government would help solve it because I am just an amateur paddling around in the shallows. I am hugely grateful to people such as the noble Earl, Lord Lytton, who is a real expert in this area.
I still believe that my amendment is a practical, helpful and just way forward which is in the spirit of what Her Majesty’s Government want and have committed to. I was hugely grateful to the noble Lord, Lord Adonis, for quoting the Minister in the other place. I am still sufficiently positive—noble Lords will probably say naive—about our political system to believe that this amendment could well commend itself to people in the other place when they see that it is within the spirit of what the Government want to do. I hope that it will be taken back to the other place and considered there, or that the Government will wish to introduce something like it, to help us move this forward. I would like us to get this on to the statute book as quickly as possible but, in the light of what I have heard, with reluctance I feel I have no other choice but to divide the House on this Motion.

Lords ChamberI note the points around that consultation, but 66% of local authorities that responded to the 2019 consultation were in favour of introducing a new criminal offence for those who reside on unauthorised encampments, and 94% supported one or more of the proposed amendments in the Bill under consideration.
Research published by the FFT in January 2021 found that there were only 59 permanent and 42 transit pitches available across England. In response to the new police and crime Bill and proposals to allow for greater enforcement against unauthorised encampments, what provisions are being made to provide authorised sites for the GRT community? I am happy for the Minister to write to me if he does not have the figures to hand.
My Lords, Part 4 of the Bill essentially seeks to make something that is a civil offence into a criminal offence. It is based on a similar change in law undertaken in the Republic of Ireland some years ago. I will write to the right reverend Prelate with the specific figures, but looking at transit site provision in addition to the 356 transit pitches that exist will be part of the upcoming cross-Whitehall GRT strategy.

Lords ChamberMy Lords, there is no greater champion of the role of sport, leisure and recreation in place-making. I point out that the towns fund guidance provides the envelope upon which towns can prioritise leisure facilities. As a department, we hope to see many towns come forward, building in leisure facilities, parks and green spaces, cycle lanes and a myriad of sports activities within their bids.
My Lords, I am also delighted that the Government have set up the towns fund, which will make a significant contribution to many poorer communities. Nevertheless, it still remains that the Public Accounts Committee has expressed concerns about why some towns were chosen and some were not. In future, will Her Majesty’s Government undertake to publish the objective criteria and evidence that will be used for selection so that everyone can be assured that there is no political influence in making these selections and choices?
In my answer to the previous question, I made it clear that this is a combination of using an evidence-based methodology and Ministers using their local knowledge. That benefited 101 towns in the first instance. There is more money to be spent on regeneration, but the foundation stone of the allocation of funds was using a clear methodology with multiple criteria, including productivity and exposure to economic shocks.

Lords ChamberMy Lords, I made clear in response to the noble Lord, Lord Best, that we can raise standards while continuing the drive for the numbers of homes, of all types and tenures, that this country so badly needs. However, we have to wait to have time to respond to the ongoing consultation.
My Lords, with regions such as the north-west, the north-east and Yorkshire hosting less than one disabled-access home for every 100 homes, and regions such as the West Midlands hosting just over one disabled-access home for every 300 homes, given that 15.2% of the population is elderly and 18% of the population is disabled, is it now time that the Government mandated targets for disabled-access homes rather than simply relying on local authorities?
My Lords, I am afraid I am the wrong person to answer that. I spent 20 years in local government and have every confidence that local councils know the needs of their communities, and can respond to them in a way that ensures we see the drive for standards and improved accessibility needed in our homes.

Lords ChamberMy Lords, another fellow former council leader raises a very important point. It is reliant on the market and developers to step forward and build the homes that this country needs, and that is taken on board by this Government.
My Lords, the ambition of the White Paper Planning for the Future, to streamline planning permission and impose building targets on local authorities fails to address the existing slow build-out rate that occurs once planning permission has been granted. Will the Government add provisions to ensure that local authorities have adequate scope to alter centralised algorithmic targets in accordance with local supply capabilities and build-out rates?
My Lords, we had a far stricter central approach under the old unitary development plan in the first decade of this year. We then had the era of local plans without any central holding to account. This is a balanced approach to ensure that the country gets the homes it needs.

Lords ChamberMy Lords, there is a strong case for reform of a system that was first put into place some seven decades ago with the Town and Country Planning Act 1947. The focus is on ensuring a much more map-based system towards local plans and engaging with communities to work out whether those developments should take place. In that sense, the development community will follow.
My Lords, the latest English housing survey reveals that only 9% of our housing stock has key disability accessibility features. Disability in old age is frequent, and with the ONS estimating that one in four people will be aged 65 or over by 2050 it is vital that we cater for what we are going to need. Although the recently announced government consultation into this issue is welcome, can the Minister confirm that prior to any changes in planning law, the recommendations of this consultation will be fully implemented to ensure that the vulnerable are not left behind?
My Lords, I can assure the House that we will consider the needs of all residents, including the vulnerable and the disabled, in ensuring that we have the high-quality design and the beautiful and healthy places that they need.

Lords ChamberMy Lords, the decision to close places of worship was not taken lightly, but it was in response to the fact that the virus is highly contagious, particularly in areas where people gather indoors. In recent months, historic places of worship have been able to apply for grants from Historic England and the National Lottery Heritage Fund of some £55 million, and listed places of worship can get around £200 million for heritage construction projects. I refer to the DCMS guidance on my noble friend’s third point.
My Lords, many of our churches and cathedrals are desperate to enable small groups of singers, perhaps four singers standing five metres apart from each other. Is there any possibility that that will be allowed soon? Secondly, will the Minister tell the House whether there are any plans for the compulsory wearing of face masks in places of worship?
My Lords, I will have to write on the policy regarding face masks in places of worship. We have announced that indoor musical performances to a live audience are expected to resume after 1 August, subject to a successful completion of pilots and provided that prevalence remains at around or below current levels.

Lords ChamberMy noble friend is right that churches and all places of worship play a crucial role in the cultural, as well as spiritual and moral, life of our country. Where possible, we should therefore seek to support as a priority the long-term sustainability of places of worship. As to the decision to extend the C-charge to a Sunday, I am wholly opposed to it. That decision was made by the Mayor of London.
My Lords, legislation has not kept up with the practice of public giving or developments in technology, especially now, when, as a result of the pandemic, cash carries the risk of infection. Charities, including churches, can currently claim only on cash and contactless gifts—not on online gifts and donations. Will the Government consider allowing online donations to qualify for gift aid, as part of the gift aid small donations scheme?
We have given guidance to churches on the safe handling of cash, which can continue, and we encourage contactless where possible. We will certainly look to see whether we should extend this to small gift aid donations online. In the meantime, we encourage churches to get people to register, so that the whole amount of their donation can be claimed.

My Lords, it is not only these five councils who are facing severe challenges. Luton Borough Council in my own diocese, which is one of the most innovative and forward-looking councils in the country, owns Luton Airport. Due to the lockdown, the collapse of this income stream is resulting in a massive hole in the council’s revenue. What conversations have Her Majesty’s Government had with Luton Borough Council? What are the Government intending to do to support Luton?
I agree with the right reverend Prelate. A number of local authorities will feel impacts as a result of Covid-19 pressures, particularly Luton Airport. This was raised with me by officials who have been dealing with the local council. As I mentioned before, if there are specific councils that face unique problems, as in the case of Luton Airport, they should contact officials. These will be dealt with on an individual, case-by-case basis.

Lords ChamberI cannot add to the timeline that I have already provided. However, I will say that we are a matter of weeks away from publication of the new building safety Bill, which will transform the safety of many of those who are currently living at risk of similar events to Grenfell. That will form a new regulatory oversight for all tenants, including those in social housing.
My Lords, these Benches welcome the upcoming White Paper, but we are still losing tens of thousands of social housing units annually, with a net loss of 17,000 in 2019 alone. Can the Minister confirm to your Lordships’ House that increasing social housing will be addressed in the White Paper, and is he able to give us some indication as to the steps that Her Majesty’s Government will implement to address this worrying decline?
It is fair to say that the record of this Government is quite impressive when compared with the previous decade under Labour. Some 450,000 affordable homes is considerably more than the 399,000 built during the years 2000 to 2010. Of course, the Chancellor has already set out a considerable sum of money—an unprecedented sum of £12 billion—for the affordable homes programme and, by lifting the housing revenue account borrowing cap, many local authorities are now building council homes again. Although we are waiting on the social housing White Paper, a lot has been done to ensure the continued supply of affordable housing and social rented housing.

Lords ChamberMy Lords, the high street is the very heart of a local economy and a number of measures have been taken by the department. The places, urban centres and green spaces guidance which has been issued will help operators and owners on the high street and in our town centres. In addition, on 25 May the Government established a £50 million Reopening High Streets Safely Fund, as well as enabling an additional £6.1 million funding for business improvement districts in high streets and town centres.
I declare my interest as a vice-president of the Local Government Association. What discussions have taken place about reviewing business rates, so that large online retail companies, which perhaps have no actual shops and many of which pay relatively small amounts of tax, do not have an unfair advantage over our small shops in our high streets which are under threat at the moment?
The most important measure that has taken place during this pandemic is the deferral of business rates, and that is a significant measure to support businesses. I will have to write to the right reverend Prelate about the specifics on the review of business rates.
