My Lords, the gracious Speech set out a number of the key challenges impinging on our security and His Majesty’s Government’s intentions in addressing them. I shall focus to some degree on the fragility of the international order at present.

I suspect that many of us have an underlying anxiety about the future in terms of the potential for conflict and our ability to either forestall or manage it should it arise. However, in the perspective of much of the world we already live in an era of endemic warfare. By one count, there are 110 international or internal armed conflicts under way as I speak. Only North America is free of any armed clash, and even there the United States is facing historic challenges to its democratic norms.

Conflict is, sadly, not new, and it is tempting to say that we must simply embark on the latest round of realpolitik until things settle down. But there is a worrying recent trend to our instability. The fragility of states maintaining themselves in the face of militarism, populism or, in some cases, organised crime, and the instability of the international order itself, have been marked by a failure to maintain common norms of behaviour and the rule of law. Our contemporary treaties and international structures rely on a common acceptance of their value and an inculcation of the sorts of habits and attitudes that naturally support them, especially at times of stress. It is easy to observe international humanitarian law when you have no incentive to do otherwise.

There is nothing that justifies the attacks on Israeli citizens on 7 October, let alone the taking of hostages and the evil nature of those atrocities. But does the difficulty of military operations against Hamas positions in Gaza City allow the Israel Defense Forces to set aside some aspects of international humanitarian law to manage that difficulty? Clearly, it does not. A ceasefire in Gaza is not only to be hoped for but needs to begin now, with extended pauses for humanitarian relief, medical care and supplies, which will alleviate the ever-increasing levels of innocent suffering. I echo the noble Lord, Lord Coaker, in condemning anti-Semitism and Islamophobia.

There are egregious examples around the world in conflicts in Sudan, Ethiopia and Syria, in the Russian invasion of Ukraine and in other places, where aggressors have not only acted with enormous brutality but, in some cases, managed to solicit sympathy from other states. This has been due to disinformation, self-interest and even venality. But it is also because those of us who argue for a rules-based system are seen as benefiting from a global trading system that treats many people unfairly.

We cannot isolate ourselves from this, because many of the communities around the world caught up in conflict are represented in significant numbers in this country. There is a task for us here to model the norms we promote internationally. This means that we should be scrupulous in our international dealings, including our support for the European Convention on Human Rights. We need to address deep-seated issues around climate change and development.

There is now an opportunity, in the light of the Supreme Court judgment on Rwanda today. As the most reverend Primate the Archbishop of Canterbury has said, the Church of England continues to call for the 1951 refugee convention to be built on, through nations around the world working effectively together, so it can meet the challenges we face today, commending a 10-year strategy for tackling the refugee crisis, human trafficking and people smuggling.

But we also need to respect our own institutions. We should promote dialogue with communities here and abroad. In advance of the state visit of the President of South Korea, His Majesty the King visited New Malden the day after delivering the gracious Speech, engaging with the largest Korean community in Europe. On the evening of the gracious Speech, I commissioned Bishop Moses Yoo of the Anglican Church in Korea to be an assistant bishop in the diocese of Southwark, in order to minister to the large Korean community in south London. He was presented to the King the following day.

The focus being given to “global Britain” in our external relations is mirrored in the increasingly global identity of many of the communities of this land, not least the great metropolis of London, and Southwark, where my diocese is located. In his recognition of this, His Majesty the King is setting an example for us all to emulate in our multicultural local contexts. The fruit of this endeavour will be in building social cohesion that reflects the nation we have become.

I ask for a greater effort, in a larger and better-resourced Foreign, Commonwealth and Development Office, to promote an unapologetic rules-based international order—one no longer on the back foot but gaining in strength.

My Lords, perhaps I may suggest, given the very large number of noble Lords who want to speak, that for the benefit of the House they keep their contributions brief and to the point, so that we can get as many people in as possible. Furthermore, if we can go around the House, as we do at Question Time, it will help create a sense of balance in our debate, which I am sure noble Lords will appreciate. I hope the right reverend Prelate will excuse me—because normally he would take precedence—but I have indicated to the noble Baroness, Lady Campbell of Surbiton, that she might speak next. I hope that he will understand why I wish to do so.

My Lords, I support the amendment to the Motion as tabled by the right reverend Prelate the Lord Bishop of Portsmouth, in the hope that it will indeed give space for further reflection and reconsideration of the tax credit proposals. I believe that it has the potential to do that.

First, I want to record my appreciation for the welcome rhetoric in recent months from members of the Government saying that employment, not least hard work, merits fair pay and some recognition in the national minimum wage. It is this, rather than buttressing from the state, that should provide the income of working people. It follows from this that rising wages and salaries will, of their own accord, not least from the Government’s own national living wage proposals, reduce the use of tax credits in due course without the introduction of the draft regulations before us.

The diocese which it is my calling and privilege to serve covers most of south London and east Surrey—I have the honour of several of your Lordships living within it. It is a large and populous area, encompassing significant pockets of urban deprivation alongside considerable wealth. The unsustainable cost pressures in the property rental market, as well as rapidly rising house prices, already threaten the balance of many communities. I fear that the introduction of these regulations will push a significant number of hard-working although low-earning families to breaking point. A reduction in the threshold for families’ earnings before credits are withdrawn from £6,420 to £3,850 is a very dramatic change, which will adversely affect all but the poorest members of the communities we serve. Families that strive, struggle, aspire and hope to advance their well-being will be thrown back, since few have the sort of margin between income and expenditure to cushion them from the blow that is coming. In the London Borough of Southwark alone, whose 50th anniversary was commemorated in my cathedral this past weekend, it is estimated that some 20,000 families are in receipt of tax credits and, further, that even making allowance for the mitigating factors being introduced by the Government, some 4,000 will remain worse off by these changes. That is in just one London borough.

The sort of wage rises that would mitigate this and the extra hours worked to catch up will be taken away by the loss in other benefits, even if there were enough hours in the day. The rise in personal allowances which benefits a far wider group of people, including Members in this Chamber, will not compensate for this shortfall. By these regulations, we are in fact asking parents to make their children bear a significant adjustment in their economic circumstances—an adjustment that some children will not understand, which in itself will be an added stress to their families. We risk stripping our fellow citizens of their dignity by these provisions, even though the Government’s stated intention with a whole range of economic and fiscal measures is to do the opposite. We should take this opportunity to counsel Her Majesty’s Government not to seek to add to the burdens of those working hard for their families, and to reconsider in detail the impact of these regulations and the need for more fully worked-out transitional arrangements. I therefore support the regret Motion as tabled by the right reverend Prelate.

My Lords, there seem to be two strands to this emotive phrase “constitutional crisis”, which is what I would like to address. The first is that this House should not vote down a statutory instrument—certainly not one that has been through the House of Commons. But there is no Standing Order which lays this down, and the Parliament Acts are silent on the primacy of the Commons over statutory instruments. Yes, it is taking a very rare step, but the footpath is there, even if it is rather overgrown. In this House, we do not look to Erskine May so much as the Companion to the Standing Orders, which is where we find that this House has an unfettered right over statutory instruments. If an instrument is not approved by this House, there is nothing to stop the Government immediately bringing another instrument to both Houses with a minor change. It is time we stopped being bullied over how we consider statutory instruments.

The other strand of the so-called constitutional crisis involves the primacy of the House of Commons over financial matters. Here, I echo what the noble Baroness, Lady Hollis, said. The parent Act from which this instrument comes was not certified by the Speaker as a money Bill, and if this House is entitled to debate the statutory instrument at all—which it is—then it is entitled to approve or to decline to approve it. It is not a question of courtesy; this is what we do and what Parliament has decreed. We would be failing all those affected by this measure if we simply pulled a duvet over our faces and turned our backs to the wall while saying it was none of our business.

If the Government had wanted to avoid this situation, why on earth did they not introduce a very short tax credits amendment Bill? Then we could have debated it in the usual way, with none of this intolerable pressure. If this House had sent back an unacceptable amendment, the Commons could have invoked financial privilege and that would have been that, but we might have found a way to tweak such a Bill that would have found favour with all those Conservative Members who have been calling for just that.

If the Bill route had been taken, we might have had a much more informative impact assessment, which could have told us what was likely to happen to those low-paid workers affected when the tax credit changes happen next April, instead of being told that by 2020 there may not be quite so many losers. We surely know that not all the thousands of employers up and down the country will pay the new living wage immediately to all part-time workers for the same number of hours to make up the shortfall. As it is, for the Government to decide to make a very controversial change by way of an unamendable statutory instrument, and then to bully members of this House into passing it by telling us that we are provoking a constitutional crisis if we do not agree to it, is surely quite unacceptable. We should stand up for what we believe to be morally right. The spirit of 1911 is being invoked, but at least Lloyd George wanted to take from the rich to pay the poor. George Osborne seems to want to do the opposite.

My Lords, I too welcome this debate and thank the noble Lord, Lord Sterling, for securing it. With the strategic defence and security review we have an opportunity for a wider debate on the politics of defence that might help to reshape our understanding of the purpose and task of our Armed Forces. The fundamentals that have underpinned UK foreign policy and defence spending in the past will need to be adapted to the changed circumstances we face, especially in the Middle East and our European neighbourhood.

Responding to this agenda will need a greater commitment to resource and to UN peacekeeping missions. That means looking again at the skills and equipment that are needed to help create the space for conflict resolution and post-conflict stabilisation. In this, we must invest as much in our ability to understand the religious dimensions to the conflicts we face as in providing our troops with the necessary means to mediate between the warring sides. The work of the UN with local partners in this area is vital but could be much improved.

Syria is a case in point. Is there a sense of how we enable Syrian opposition groups to build a coherent political process that will ensure future stability and avoid any further descent into extremism? Will Her Majesty’s Government be willing to contribute to any peacekeeping mission to uphold any future settlement and seek to be an active player in post-conflict stabilisation and reconciliation? I most sincerely hope that strategic thought is being given to supporting fragile and vulnerable minority communities, should there be further destabilisation in Syria, and that lessons have been learnt from the lamentable outcomes in Iraq, for which we bear proportionate responsibility. The vulnerability of the people of Syria is well known, and the same is true of Libya. It is but one reason why people are risking their lives in the waters of the Mediterranean.

The commitment to stabilising local powers throughout the Middle East and recognition of the long-term nature of that work must continue to form an essential part of our overarching foreign policy objectives. Our excellent and gallant Armed Forces, which we look to in this important and dangerous work, deserve our support in ensuring that they are properly resourced and equipped to meet these ever-evolving challenges.

My Lords, it was encouraging to hear the commitment of Her Majesty’s Government in the gracious Speech to various foreign policy objectives in the Middle East. The chaos in the Middle East is all too familiar and arises not from isolated pockets of trouble but from multiple interconnected challenges. Syria’s misery shows no sign of ending; Libya appears torn in half; ISIS continues to make gains in Iraq; and Yemen appears to be sliding into a humanitarian crisis. We are confronted by a Middle East that is coming apart at the seams. These are problems that will not just evaporate. They need careful attention and strategic patience, and I encourage Her Majesty’s Government to remain vigilant to broader aims throughout the region, as well as giving appropriate attention to the constituent parts. ISIS, with its violent and murderous ideology and murderous approach to those in its way, is causing fear and instability well beyond its current reach. This must continue to be an urgent priority. If this form of highly organised, ruthless terrorism is to be defeated, we will need to work closely with allies in the United States as well as more broadly in Europe.

Although media and political attention is understandably fixed on addressing the instability in Libya, Syria, Iraq and Yemen, it is important that we do not lose sight of efforts to secure a two-state solution that provides for the security of Israel, justice for the Palestinians and peace for all. This is a vital strand of the interconnectedness of the region, and bold moves in seeking to unlock this situation are needed if Israel’s security is to be guaranteed and the Palestinians enabled to flourish. This continues to be a vital building block for wider peace throughout the region and for the defeat of terrorism. Despite the expansion of Israel’s settlement programme and the unpromising signs emerging from the new Israeli Government, I trust that Her Majesty’s Government will remain committed to encouraging Israel to fulfil its international obligations as well as to the concept of a two-state solution. There remains no better alternative to the probability of the establishment of either a non-Jewish democracy or a Jewish non-democracy. At a time when the situation on the ground grows ever more dangerous, the Government need to look imaginatively at ways to move beyond the current stalemate.

The status of Palestine is likely to be an issue that reappears once again before the UN Security Council. I sincerely hope that the Government will be supportive of any draft resolution that creates greater equivalence between Israel and Palestine as political entities in the framework of any negotiations. The absence of progress will only allow for extremism to ferment. Indeed, I hope that the Government will draw encouragement from the growing support for the recognition of Palestine, in your Lordships’ House as well as in the wider international community. The Holy See’s recent intervention is but the latest example of this. The recognition of Palestine and upholding Israel’s security will be important stepping stones in securing a long-term peace in the Middle East.

I turn to international development, which did not feature in the gracious Speech, although it was good to hear the noble Earl, Lord Howe, speak on the subject at the start of the debate. It is evident that, even though a fragile cross-party consensus now exists in support of the 0.7% development budget, the public at large remain—if polls are to be believed—suspicious and doubtful of its benefits. Given this scepticism, the transition later this year to an agenda based on sustainable development goals provides a window of opportunity for the Government to publish a new White Paper on international development. It is now eight years since the Department for International Development published its last White Paper and we need a new narrative on international development that reflects the changed reality we now face and has traction with the wider public.

As part of this exercise, we might look again at the role that faith communities play in delivering aid on the ground and in building resilient communities, and the scope for closer partnership. The last Government made some good progress in this area, not least with their faith partnership principles of 2012, but the potential benefits of strategic collaboration between the Department for International Development and the church remain sadly largely untapped. I know only too well from my own links and those of my diocese with Zimbabwe the role that the church can play in challenging circumstances. As that beautiful country once again faces challenges over feeding its population, and given the growing nervousness of what will happen when the Mugabe regime draws to a close, I sincerely hope that the Government will stand ready to meet relief and development needs in that place as well as more widely across the globe.
