Lords ChamberBiomass is a perfectly legitimate renewable energy source if the wood that is being used is a renewable and sustainable harvest. My noble friend and the noble Baroness are absolutely right that if the wrong sort of timber is used and being shipped to this country at huge carbon cost, taxpayers, shareholders and investors need to know the precise and genuine cost to our net zero commitments that that poses.

In addition to the list I gave earlier, we are bringing forward the Hunting Trophies (Import Prohibition) Bill; we have supported the Shark Fins Act and the Animals (Low-Welfare Activities Abroad) Bill; the Animal Welfare (Electronic Collars) (England) Regulations are now on the statute book; and we are supporting other Private Members’ Bills. As I said, some items can be done in secondary legislation, but we want to make sure that, as was listed in Our Action Plan for Animal Welfare and in our manifesto, all items will be on the statute book, but there are a variety of vehicles for delivering them.
My Lords, will the Minister indicate whether this legislation will be in the forthcoming King’s Speech? What discussions have already taken place with devolved Administrations, because there is general UK-wide interest in maintaining animal welfare and safety?
The noble Baroness is absolutely right. The consultation was done in conjunction with the Welsh Government. We are talking to our colleagues in Scotland to make sure that they are with us on this. Of course, in Northern Ireland there is a different circumstance, because long before we left the EU there was a one-island policy on biosecurity. There is, from the animals’ point of view, no difference between moving an animal for slaughter from Fermanagh to Cavan, but there is a big difference in moving an animal across the channel to a completely different animal welfare regime. We want to work closely with our colleagues in Northern Ireland to make sure there is free movement of animals within our biosecurity system.

Lords ChamberTo ask His Majesty’s Government what steps they are taking to support the production of nitrate-free bacon and ham in England.
My Lords, I declare my farming interests as set out in the register.
Nitrates are approved additives for use in pork products. The Government consider that existing levels of nitrates in food products are sufficiently protective of consumers. We are keen to support innovation in the food industry. Where individual companies use authorised alternatives, it is ultimately a commercial decision. The Government’s position is that any intervention should be restricted to areas where there are potential health and safety concerns based on available evidence.
My Lords, I thank the Minister for his Answer, but I ask him: will the Government consider a review of regulation surrounding the use of nitrites in food production, following action taken in the French National Assembly to bring in legislation to minimise the use of nitrites in cured meats? Given the association of nitrites with a heightened risk of bowel cancer and that risk-free alternatives are widely available, would the Minister support a ban on the use of these chemicals in food production? When he is next in Northern Ireland, will he visit and tour factories beside me in Downpatrick that use innovation to produce nitrite-free food?
I think the company to which the noble Baroness refers produces something called Better Naked, which is a very worthy product and has a lot of innovative approaches. However, we are following the evidence on this: while the IARC published a report that said that processed meats can be carcinogenic in some cases, it does not make a direct link between the consumption of nitrates and nitrites in processed meats and colorectal cancer. We must be very mindful of the fact that these products in meats inhibit the growth of conditions such as clostridium botulinum, which can of course be fatal.

Lords ChamberThe Government are very keen to see more access to the countryside. We are doing this in a variety of different ways, some of which build on the work of the Agnew commission last year. We want to make sure that we are providing access as close as possible to where people live and where they can get to. The noble Lord makes a very good point about transport. We want to make sure that we are working with land managers to create more access points, so people can go by car, park and go on a circular walk or take a bus and access the countryside, because we understand the well-being that comes from greater public access.
My Lords, taking on board the fact that there is an increase in young people, children and older people suffering from food allergies, will the Minister today commit to working with colleagues to ensure that that level of food allergy is properly addressed through the food strategy and that a programme is put in place to address food allergies?
The noble Baroness speaks on a point that affects many people across these islands. I will take her point and relay it to the relevant Minister in the Department of Health, whoever that may be.

Lords ChamberTo ask Her Majesty’s Government what progress they have made adapting the United Kingdom to climate change risks since the Climate Change Committee’s Independent Assessment of UK Climate Risk, published in June 2021.
My Lords, the Government welcome the Climate Change Committee’s constructive assessment, which informed the UK Climate Change Risk Assessment 2022, published in January. Since then, we have started to develop the third national adaptation programme, using this risk assessment. We know that we must go further and faster to prepare for the impacts of a warmer world. Adapting to climate change is a government-wide challenge, and we are looking across all government policies and programmes to develop NAP 3.
My Lords, the Climate Change Committee clearly recommended that the Government publish how we would adapt to 2 degrees of warming and assess the risks for 4 degrees in the next national adaptation programme, due in 2023. However, the response to the CCC recommendation said only that the Government would address the risks and opportunities of a scenario of 2 degrees of warming. In such circumstances, is it the Government’s view that it is not worth assessing the risks of 4 degrees of warming for the UK, or was this omission accidental? Is there any assessment yet of yesterday’s alarming report, which stated that all of us would cause irreparable damage to our ecosystem?
The noble Baroness is entirely right in her assessment. The Dasgupta review and other work has indicated the impact that global warming will have on our ecosystems and economy. The CCC has identified eight priority areas for urgent attention and considered 61 UK-wide climate risks and opportunities cutting across multiple sectors. We are looking at every risk and tackling those eight priorities, four of which come directly under Defra and all of which are cross-government.

Lords ChamberQuite to the contrary, we want people to eat good-quality, sustainably produced food with high welfare standards. The intention is to enable farmers to produce that successfully in a global marketplace. Ultimately, it is the consumer who makes these choices. We want to ensure that we are giving farmers every support they need to continue producing the high-quality food that our consumers benefit from.
My Lords, Dimbleby’s strategy referred to the rising levels of food allergies, particularly among young children but also among adults. Given the increasing importance of support needed for those affected by food allergies, what discussions has the Minister had, or will he be having, with colleagues in the Department of Health and Social Care, regarding the establishment of a national allergy lead?
I will write to the noble Baroness with details of that. The food strategy is a comprehensive piece of work which looks at a lot of health-related matters. It is across government, and the Department of Health has been very closely involved in putting it together. I cannot tell her exactly whether there will be reference to food allergies in it, but there is certainly a lot of work going on in government on that subject.

Lords ChamberIt is a very similar philosophical point to that raised by disposable nappies. These are created by manufacturers but used by all of us who have children. We need to find a way of giving a clear direction to the industry that one particular type of product will no longer be allowed. Then the industry will innovate and find affordable solutions that the consumer can use. That is the perfect sweet spot to hit when you are trying to regulate against these measures. The precautionary principle is also vital. When talking about biodegradable waste, if there is uncertainty in what we are doing, sometimes we just have to take the precautionary approach.
My Lords, plastics and wet wipes have an impact on our fishing industry and marine environment—on both the catching and the processing sectors. In view of the impact on our hospitality industry and wider society, can the Minister provide us with a timetable that will indicate the implementation of the regulations and an acceptance of the Bill going through the other place that will diminish and eradicate the impact of plastics on our land and marine environments?
We will be working with the proposer of this Bill, Fleur Anderson, to make sure that she understands what we are trying to do alongside her Bill. There are no state secrets here. We will be sharing all the data we get as a result of this call for evidence. We can inform your Lordships about when we are bringing forward measures within the provisions of the Environment Act or other forms of legislation as quickly as possible, recognising the urgency that everybody feels.

Grand CommitteeOn Northern Ireland, I mentioned the importance of a full analysis by Her Majesty’s Government of the interaction of domestic primary and secondary legislation with the protocol. I also asked what is being done to ensure that such analysis takes place and that, if it is taking place, a report could be placed in the Library of both Houses.
The noble Baroness is right to raise this point, as others have done, about the ongoing negotiations around the Northern Ireland protocol. I do not feel qualified give an accurate, up-to-date report. After this Committee, I will find out whether there is going to be an immediate communication about the status of the Northern Ireland protocol and an analysis of its functioning, particularly in relation to this matter. If there is not, I will make sure that she receives more information. The noble Baroness, Lady Jones, raised that as well.

Lords ChamberMy noble friend has done much work in this field. The publication Tackling Obesity: Empowering Adults and Children to Live Healthier Lives takes forward a wide range of measures that all contribute towards reducing excess calorie consumption. These include, for example, measures to restrict the advertising of high fat, sugar and salt products. It is estimated that these measures could remove up to 7.2 billion calories from children’s diets in the United Kingdom over the coming years.
My Lords, for the avoidance of doubt, will the Minister indicate a specific date when the Government will produce their White Paper in response to the Dimbleby report, and the timescale for the subsequent legislation? Will this legislation be accompanied by resources in a cross-departmental way to implement the recommendations in the report, including access to free school meals for many children who are totally disadvantaged, particularly during the pandemic?
The second part of Henry Dimbleby’s report was published in July and the Government made a commitment to respond within six months. The noble Baroness knows that our department is running quite hot on food issues at the moment, but I have heard nothing to suggest that this timetable will not be met.

I thank the hon. Member for Na h-Eileanan an Iar (Mr MacNeil), the Western Isles, for his intervention. [Interruption.] He is correcting my interpretation of his Gaelic, although I suppose I would be speaking in Gaeilge—in Irish.
There was reference to the misuse of mackerel by the Icelandic and Faroese, maximum sustainable yield, MPAs, TACs and quotas, and the need for a bottom-up approach.
The hon. Member for Lancaster and Fleetwood (Eric Ollerenshaw) mentioned renewables and wind energy in the Irish sea. There will be even more wind turbines in the Irish sea, if DONG Energy, Centrica and First Flight Wind get their way. I hope that they bring a lot of sustainability. It is interesting that the fishing industry involved in the Anglo-North Irish Fish Producers’ Organisation in Kilkeel is directly concerned in safeguarding those renewable operations and will gain financial assistance for the fishing industry from them. I see that as a benefit, but I also recognise that the cabling in the Irish sea, along with the MPAs, could interfere with fishing effort. I ask the Minister to take cognisance of that.
The abolition of the CFP was raised. My hon. Friend the Member for Glasgow South indicated that fishing should not become a party political football. I was a little afraid that Euroscepticism was getting in the way of what the fishing industry needs. I hope that we get a properly reformed CFP that reflects the needs of the fishing industry throughout the UK and ensures not only a sustainable fishery, but one that brings benefit offshore and onshore and becomes profitable for all involved, whether fish producer, fisherman, those who are part of a fish producers’ organisation or those involved in fish processing.
I welcome the Minister’s intention to negotiate for a roll-over in the nephrops quota, but there is the whole other issue of the long-term plan for cod. The Scientific, Technical and Economic Committee for Fisheries has acknowledged that the current plan is not working and that stakeholder and industry engagement is essential if a long-term solution is to be found. Obviously, the cod recovery plan has not worked and is not working, and something needs to be done. There is a view among local fishermen and fish producers’ organisations in Northern Ireland that to continue with a freeze on effort might not be a good idea, and it is important to look at that. Regionalisation in the CFP also needs to be explored.
I thank all who have contributed to the debate. We have sent a clear message to the Minister that we wish him well in his negotiations. Whether on the responsible reform of discards, developing a sustainable and economically viable quota system or dealing with regionalisation and the blunt instrument of the CFP, all of the 19 Members who contributed, as well as those who intervened, have spoken with a largely coherent voice, in a non-partisan way, which reflects the many shared interests in this area. We share many concerns. The Minister will have heard the clear interests of those in the devolved regions and, I hope, my argument that greater regionalisation is needed to sculpt a CFP sensitive to the specific concerns of fishermen who operate in the different waters throughout and around these islands.
I wish the Minister well in his negotiations, whether on CFP reform or TAC and the whole area of allocating and fixing quotas. We must remember not only the bands of fishermen and fish producers’ organisations, but those inshore, who sometimes feel that they do not always benefit from the producer organisations, because they are a small group. We must not forget that fishing should provide a sustainable future for our land and marine environment and all those who eke their living from it.
Before the hon. Lady concludes, as we have a couple of minutes left, may I make a point about marine protected areas? Under the two European designations, 23% of our inshore waters are protected under MPAs. I said that I thought that about 25% could be achieved by 2016, which is the date we want. We are not concerned with simply creating lines on maps or doing a numbers job. We want something meaningful.
Many hon. Members raised concerns about the impact of MPAs. We want the management to reflect the science on why the areas need protecting, which means that some activities will be prevented, but others, further up the water column or wherever, will be allowed. It is important. It is a complex area that is causing grave concern. I hope that we can develop ecological coherence around the UK; it was the thread that ran through the Marine and Coastal Access Act 2009 in England and Wales. I hope that we can work together to achieve that.
I thank the Minister for his helpful intervention. As he said, it is important that the needs and requirements of all those involved are reflected when the MPAs are drawn up, notwithstanding the difficulties, such as the wind energy proposals and the considerable cabling in, for example, the Irish sea. There are probably other proposals. I recall a meeting with the Minister 14 months ago, where the chief executive of the ANIFPO had a detailed, layered map to show the amount of activity in the Irish sea that could contribute to a reduction in fishing effort. The MPAs therefore need the best management.
In wishing the Minister well in his negotiations, we must not forget what other Members said about health and safety and the influence of the coast guard in safeguarding fishermen and marine and coastal communities. This was a general debate about fisheries, so some Members mentioned inland fisheries, angling and abstraction. With the hon. Member for Thirsk and Malton (Miss McIntosh), Chair of the Select Committee on Environment, Food and Rural Affairs, we are looking at the draft Water Bill. Yesterday, we looked—without prejudice, I should say—at the outcome of the report into it and the details on abstraction, about which we have talked to various Ministers. Decommissioning was also mentioned, but I thought that we had moved on from that, because it is about taking boats out of the fishing industry, which can be detrimental to financial outcomes.
In conclusion, I thank you, Mr Brady and all Members who contributed. I also thank the shadow Minister, my hon. Friend the Member for Glasgow South, and the Minister. I wish everybody well. We thank the fishing communities for their forbearance and endurance. I wish them well in the future, as we try to sculpt a common fisheries policy that reflects the needs of local fishing communities, without the top-down approach that has proved unworkable to date.

Commons ChamberI am grateful to my hon. Friend for his good wishes for next week’s negotiations, and I confirm that the UK is committed to genuine fundamental reform—to achieving healthy fish stocks, a prosperous fishing industry and a healthy marine environment. Part of that agenda is to ensure that we have regionalised decision making and an end to the top-down failure of the current common fisheries policy, and that we give fishermen a stake in the long-term health of fish stocks. That involves those in the under-10-metre sector; I am deeply mindful of the problems that they have faced in recent years, and I want to give them and the communities that they support a long-term future under a reformed CFP.
As I represent two fishing ports in Northern Ireland, may I ask the Minister what further progress has been made towards regionalisation?
I am grateful to the hon. Lady and to other Northern Ireland Members who have been forceful in putting the case for the fishing communities that they represent. I recognise that they, like many other areas of the country, are affected by an industry in crisis. Our immediate attempts will be to secure for them adequate fish stocks to exploit over the coming year. However, I put on record my determination that they should not continue to live from hand to mouth. As someone who has been in business, I do not know how fishermen can deal with a bank manager when they do not know what they will be able to achieve in three, four or five months’ time. I want to give them a longer-term future, in which they can be part of the solution, rather than being constantly browbeaten by an overbearing and multi-layered regulatory system.
