My right hon. Friend might be reassured to know that when we cannot prevent someone’s return, we will in all cases seek to question them, investigate them and, where appropriate, prosecute them. Even if they are mono-national, if they are British citizens, we can strip them of their passport, have temporary exclusion orders and manage their return.

Wonderful tributes have been paid to Paul Flynn, and few things demonstrated his place as a wonderful contrarian so well as the fact that he lent his support to my hon. Friend the Member for Leicester West (Liz Kendall) in the 2015 leadership contest despite the fact that he seemed to disagree with all her major policy points. Amid those tributes, I am sure that the House will want to register its thanks to Sir Charles Farr, the head of the Joint Intelligence Committee, who passed away last week.

The Home Secretary talks about people facing consequences for supporting terror, but he knows that far too many of them do not face consequences. He talks about doing whatever it takes to bring people to justice, so why is he not making the very valuable designated area offence, for which many of us campaigned, retrospective? Does he really think that the law as it stands, under which people can go to Syria, make themselves jihadi brides and offer their support to foreign fighters yet not have their prosecution guaranteed, is strong enough? Surely it is not. What measures will he take?

The hon. Gentleman is absolutely right to mention Charles Farr, who has sadly passed away, and to point out the huge contribution that Charles made to the security of this country, both at the Home Office and as the chairman of the JIC. I am pleased that the hon. Gentleman mentioned that, and he was absolutely right to do so.

The hon. Gentleman talks about the laws that are available and the tools for prosecution, and particularly about the new powers in the Counter-Terrorism and Border Security Act 2019. These are far-reaching powers, and we tried to prepare a Bill that had the support of the House while being well balanced and offering due process. As for the designated powers procedures, as I said earlier, we started work on that in anticipation of Royal Assent, which has now happened. We hope to bring an order to the House as soon as possible.

The hon. Gentleman will know that immigration is a reserved matter, but it is very important that we engage with all nations, regions and communities. As we develop the new immigration system set out in the White Paper, I will ensure that that engagement happens and that we set up a system that represents the needs of the entire UK.

Fourthly, in addition to immigration measures, the Bill will allow us to adapt our benefits system as we leave the EU. It will enable the UK to change the retained social security arrangements for EEA and Swiss nationals. British people living abroad will also benefit. The social security powers in the Bill will allow amendments to the retained EU social security co-ordination regime. That will help us to deliver effective support for UK nationals abroad, including pensioners living in the EU. The rights of EU nationals already resident in the UK will be protected, but the powers will allow us to rapidly respond to the outcome of negotiations and to provide reassurance to those who are affected. Any future changes using those powers will be subject to normal parliamentary procedures.

This Bill is just the beginning of our future border and immigration system. We plan to phase in that system, to give individuals and businesses time to adapt. Of course, if we leave the EU without a deal, there will be no implementation period, but we will continue to deliver on the referendum result and end free movement. The automatic right to come to the UK will stop once the Bill is commenced. We will not hesitate to take back control of our borders.

As set out in our no-deal policy paper, which I will publish later today, we will also introduce transitional arrangements to minimise any disruption. Copies of the policy paper will be placed in the Library of the House. This will ensure that we take a practical approach and that the UK stays open for business. Under the arrangements, EEA and Swiss nationals will be able to come here for up to three months without a visa. They will continue to use e-gates, as they do now, and they will not face additional checks at the border. They will be allowed to work temporarily but will need to apply for leave and pay an application fee if they want to stay longer.

We plan to grant them three years’ leave, subject to identity, security and criminality checks. That will give us the time needed to run our EU settlement scheme for EEA and Swiss nationals who are already living here and ensure that there is no sudden shock to UK businesses as the future system is put in place. But the leave will be strictly temporary. It cannot be extended, and those who wish to stay will need to meet our future immigration requirements.

The transitional period will last until 31 December 2020, when our EU settlement scheme closes, and from that point on, businesses will be expected to check that EEA citizens have an immigration status before allowing them to start work. Let me be clear: this policy does not apply to those here before exit day, whose rights to live and work here in the UK will be protected by the EU settlement scheme. We want them to stay, and we value them hugely.

I thank the Home Secretary for giving way; he is being very generous. What is the Government’s estimate of the economic cost of these changes? Why does he think it is worth damaging the economy, with the effect that this may have on jobs and livelihoods?

As my hon. Friend will know, under the current non-EEA system there is a cap of 20,700 a year, with some exemptions. The work of the Migration Advisory Committee has shown that such a cap is not in our economic interests, and that it is far better to control numbers in other ways that are more reflective of economic needs. I think that removing the cap will lead to an economic boost, while also making it easier for students who have studied at our great universities to stay on if they can find a job at the right level. I think that that is very welcome too.

The Home Secretary says that he will protect the rights of EU citizens who are currently here. Does that include the continued right to work even after they have left the country for a period before returning? The Home Secretary also says that he is against increased red tape. Will he therefore publish, as part of the consultation, a full impact assessment of the cost to the public purse and to businesses of whatever processes he sets up to implement the short-term visas?

Under the EU settlement scheme, there will be a requirement for plenty of time—two years—to be provided for individuals to register, however long they have been here. Even if they have been here for only a day, their rights will be guaranteed. My understanding is that once they have registered they will lose their rights if they leave for more than five years, but within that period there is no change.

I will come back to the hon. and learned Lady in a moment.

The Home Office is affected by this deal in two significant areas: security and immigration. Today I will set out what is on offer in these two important areas and why the deal is in the interests of the United Kingdom. Let me start with security. The Brexit deal negotiated by the Prime Minister delivers the solid foundation that we need for future security co-operation with our European partners. It avoids a cliff edge by providing for an implementation period, ensuring a smooth transition from current arrangements to a new, strong partnership.

An unplanned no-deal Brexit would mean an immediate and probably indefinite loss of some security capability, which, despite our best efforts, would likely cause some operational disruption when we leave. As Home Secretary, I know which option I would prefer. I have seen at first hand how important it is to have a strong security partnership with our European allies. I have seen the potential dangers that such co-operation prevents, and the security and safety that it ensures.

Of course, what the Home Secretary says about no deal is right, but the Chancellor has earned some respect for showing a level of candour this week by saying that there will be an economic trade-off with any form of Brexit. Will the Home Secretary be similarly open with the House and the public that there will be some form of security trade-off over Brexit in order to achieve the aims of the Brexiteers?

I point the hon. Gentleman to the assessment of the security arrangements in the deal that we published in quite some detail last week. I accept that, with this deal, security arrangements will inevitably be different because we will be a third country outside the EU, but I think we can safely say that it is the most comprehensive security agreement that the EU has with any third country.

I understand that people will want to hear from the police investigation as soon as possible, but from what I heard from the police in the briefing I received this morning, it will take some time. We need to give them that time, but I assure my hon. Friend that as we get more information we will bring it to this House immediately.

If and when the Government come to the conclusion that Russia was responsible for this attack—whether through targeting or by accident—will the Government pursue further co-ordinated action with our allies in response?

We absolutely need to keep all options open. I think that the hon. Gentleman would understand that the focus right here and now—certainly in today’s Cobra meeting—is very much on public safety, the police investigation and supporting the victims. I am sure that we will be considering other options as more information comes to light.

As my hon. Friend knows, because I have already said it, I met the companies he has mentioned and others last week. This was the only topic that we discussed: the meetings were very focused on terrorist content on the internet. He is right to point out that, through voluntary action and persuasion, a lot has already been achieved, and all these companies understand that legislation has not been ruled out.

My hon. Friend asked me to say a bit more about some of the newer work that the companies are doing, but I hesitate to do so. That sort of thing should be announced at the right time, because it requires international co-ordination. There is a lot more work, and I will say that a lot more effort is going into the use of both machine learning and artificial intelligence to deal with this very important issue. I must now make progress, because a number of Members wish to speak in this debate.

The Bill will extend the ability of police and prosecutors to bring charges for terrorist offences that are committed overseas. It is not of course for the law enforcement agencies in this country to police the world, but if someone travels from the UK and commits a terrorist offence abroad, it is right that they are brought to justice if they return here. This is already the case for many terrorist offences, but there are a few gaps in the coverage. That is why the Bill extends the jurisdiction of the UK courts to cover further terrorist offences that are committed abroad, including the dissemination of terrorist publications and the possession of explosives for the purposes of an act of terrorism.

Why has the Home Secretary decided not to include the Australian scheme using the declared area offence, whereby Australia deems it illegal for people to travel to certain designated terror hotspots, such as Iraq and Syria? The Minister for Security and Economic Crime has been looking at this for some time, yet it is not part of the Bill.

The hon. Gentleman mentions the Australian extraterritorial offence that has been created, and I am looking at just that. There is a bit more work to do, and it is not as straightforward as it might sound. If it is to become a legislative proposal, I obviously want to make sure that we have considered it properly. If I am persuaded by it and we can complete the work in time, I intend to bring that forward as a Government amendment to the Bill.

First, let me, too, commend the First Minister in Wales for his constructive approach. Let me also commend Andrew R. T. Davies, the leader of the Conservative group in Wales, on his approach in making sure that he and his team help in every way they can. On tariffs and measures against dumping, what matters most is measures that actually work, and that is what we have seen so far, but we want to make sure that that continues.

Why can the Secretary of State not just admit that there is a secret deal, which everybody knows about, and that the Chancellor has promised to pull his punches on any effective action against steel dumping so that investment from China keeps flowing into this country?

I do not know where the hon. Gentleman gets that idea from. I talked earlier about the action that we have led. The UK Government have led the way, asking the EU to work even faster. Back in November, for example, I called for—and went to—an extraordinary meeting of the Competitiveness Council so that it could take more action. That will not change.

I must move on.

The code of practice on picketing, which is already followed without difficulty by many unions, requires the appointment of a picket supervisor. The Bill will make that a statutory obligation. It does not add any new requirement that is not already in the code. The supervisor must either attend the picket line or be readily contactable by the union and the police and able to attend at short notice, and he or she must wear an armband or other means to identify them in order to ensure that picketing is peaceful and lawful.

In addition, we consulted over the summer on other measures to tackle wider intimidation. The consultation closed last Wednesday and we are considering whether the Bill should contain further provisions. We will set out our views on that consultation in due course.

If the Secretary of State is so concerned about being even-handed in how he modernises strike law, why has he ruled out modernising how trade unions communicate and how strike ballots are sent out? Why is he focusing only on more punitive measures?

I assume the hon. Gentleman is referring to e-balloting, but I am concerned about fraud and that the identities of people voting in a secret ballot may be revealed. In fact, the Speaker’s Commission on Digital Democracy, which looked at the use of digital apparatus in elections, also shared those concerns. I do not think it would have been appropriate to suggest such changes.

Let me turn to political funds. The introduction of ballot thresholds will help ensure that unions reflect the will of their whole membership and that the views of every member count. Another way we are going to achieve that is through changes to the way in which political funds are managed.

I will say a little more about the timetable in a moment, but it is a bit unfair of the hon. Gentleman to say that the Government have had years to introduce the cap, when the Government whom he supported had 13 years to introduce a cap and did nothing.

A number of steps must be taken before the cap can be implemented. All of those steps are important and if they are rushed, it will put consumer protection at risk for the sake of speed. There must first be evidence gathering and analysis. That is critical in getting the cap right. The FCA will draw on the evidence that the Competition Commission has collected. It might also have to get information from lenders and others in the market to get on with its work as quickly as possible. Yesterday, the Government laid secondary legislation before Parliament that will allow the FCA to seek information from the industry. That will support the design of the cap and the cost-benefit analysis that the FCA must issue.

The second and most vital part of the process is the consultation with interested parties on the proposals and their impact, as set out in the cost-benefit analysis. The final component that is necessary for the successful implementation of the cap is that lenders must be given a short period in which to update their systems and processes to meet the new requirements and become responsible, compliant lenders. Difficult though that is, we are not prepared to compromise on the process because that could lead to poor outcomes for consumers.

I thank the hon. Member for Kilmarnock and Loudoun for giving me the opportunity to set out the FCA’s plans for implementation. I hope that has provided reassurance that the FCA is committed to taking action as soon as possible, and that she will feel able to withdraw her amendment.

In summary, the Government believe that a cap on the cost of payday loans is necessary better to protect consumers from excessive spiralling costs, working alongside regulatory interventions that the FCA is already proposing to clamp down on the causes of consumer harm in the payday lending market.

Amendments 162 and 163 will provide significant benefit to consumers and financial services businesses that have been affected by poor practice in the claims management industry. Claims management companies have a legitimate role in helping consumers claim compensation, but a minority have acted irresponsibly. Despite the threat of suspension or cancellation of authorisation, some CMCs act speculatively and submit illegitimate claims that clog up the system and ultimately impose costs and delays on consumers. The amendments will give the claims management regulator power to impose financial penalties on CMCs that are guilty of misconduct.

The Government’s amendments provide a new form of redress—including financial compensation for consumers affected by a poor service from CMCs—by introducing a mechanism for the cost of handling complaints to be recouped from the industry. Together, the amendments will help ensure that the claims management industry acts more responsibly, and where it does not the regulator and Office for Legal Complaints can take action.

The Government agree with Lords amendments 153 and 154 that provide the PRA with a secondary competition objective and the FCA with competition powers that are exercisable concurrently with the Competition and Markets Authority. The Government are committed to improving competition in our banking sector to drive up consumer outcomes. A secondary competition objective for the PRA was recommended by the PCBS, and the Government accepted it. That objective will ensure that the PRA remains above all the watchdog for financial stability, but we will require it to play a more proactive role on competition.
