Lords ChamberMy Lords, I feel passionately about this issue. I have been wondering why that is the case, especially as so many people that I respect hold exactly the opposite position to myself. Principally, it is because I have often seen, over many years, young people in care being allowed to make decisions that are not age-appropriate. A local authority will, quite commonly, offer a 16 year-old in care a flat of their own and a sum of money or the choice to stay with their foster carer. Many choose to take the flat and the pot of money. We are told that in many cases, drug dealers befriend and move in with them, or they cannot manage to meet the rent and they lose the flat. I spoke to a foster carer who said that her foster daughter was doing so well in school before a local authority offered her a flat of her own; now she is doing very badly in school and the carer does not know how she is doing in her flat. One of the reasons I feel so strongly about this amendment is that I am concerned about whether this is an age-appropriate decision—although clearly children are not going to harm themselves, in the way that children in care apparently can often be harmed by being giving decisions too early, in this particular case.
I listened with great interest to my noble friend. I have sympathy for his concern that this is a very long-term decision that we are coming to as a nation, which will affect the young people in question particularly. But I am afraid I disagree with him; I heard the speech of the noble Lord, Lord Tyler, differently. I respect the great depth of knowledge and the effort that the noble Lord, Lord Tyler, has put into this issue; I have heard him speak about it on many occasions. My sense, is that for him, at least, this is part of a project—not just an issue for this particular referendum Bill but more generally—to lower the franchise. I feel really concerned about that, although there are many people I respect who think it is the right thing to do. Some child development experts would agree with them, while others would be concerned.
There is concern about the impressibility of 16 and 17 year-olds. Some of your Lordships may remember the film “All Quiet on the Western Front”. It begins in a schoolroom, with a teacher talking to young people and enthusing them with notions of the greatness of their country and the importance of fighting for it. It then follows their careers in the Army. Your Lordships may remember that in the Chinese Great Leap Forward young people were targeted and used as the force for taking that forward. Your Lordships may also remember how effective, in the 1930s, some nations were at manipulating their youth to do things none of us would agree with.
There has been concern about growing nationalism across Europe and there are increasing pressures. Thankfully—and tribute should be paid to the Government and the coalition Government before them—we have avoided the serious unemployment which is a large contributory factor to this. But at some future date we may not be so fortunate. It concerns me that we are painting a target on the back of our young people by giving them the vote at the ages of 16 and 17. There are people who are very good at using the internet to manipulate people, and 16 and 17 year-olds, as we know, have been vulnerable to this in various ways.
I am also concerned about the wider ramifications for children around the country. Noble Lords have spoken from experience, which I cannot yet do, about their own children. Of course, many children will not have had the support that I hope your Lordships will have had—I hope I am not speaking out of turn. I am thinking particularly about the work the noble Lord, Lord Faulks, took forward recently during the passage of the Criminal Justice and Courts Bill. The noble Lord listened to the concerns of parents of 17 year-olds who had been held in custody in police cells. They were sometimes held over the weekend for two nights and, regrettably, a number of those young people had taken their own lives after that experience. The noble Lord listened to those concerns and acted promptly to change the law. I was pleased to learn, recently, that it had changed and that 17 year-olds in custody will be treated as children.
The last time that we debated this matter, Barnardo’s produced a briefing in which it sought to change the Children and Young Persons Act 1933. In that Act, the age of majority is 16 and Barnardo’s wanted to see it raised to 17. In aid of his approach, the noble Lord, Lord Tyler, put forward the argument that if you are old enough to marry and join the Army at 16, you should be able to vote. Others may say that if you are old enough to vote at the age of 16, you do not need to be treated as a child and can be put in a police cell at the age of 17. If you are old enough to vote at 16, maybe it is not so outrageous to have an age of criminal responsibility of 10—the lowest in Europe: I think the average age is 14. I am concerned from that angle.
I conclude with my concern about child development issues. These children are in the middle of adolescence, which is a very interesting period. I do not want to be too technical and maybe this will be quite obvious to most of your Lordships. Young children are very attached to their parents and to their siblings. In adolescence, they make a move from that attachment to an attachment to their peers and eventually to a romantic partner of their own. That is a huge change, which will play out in many different ways. Partly, they will react against their parents. Quite often they will take polar opposite views and values to their parents—for some time, at least. I can think of that in my own family history. My father grew up in a landowning family; he was an aristocrat. When he went to private school, he became the school’s only socialist, reacting very strongly against the ideals of his parents. He moderated over time.
We are not talking about young people voting Labour or not, but I worry that if we set this precedent it will be used on other occasions. Young people may be more likely to vote for Labour or the Liberal Democrats—parents tend to be more conservative, so their children may be reacting.
Forgive me, my Lords, I did not understand the last point that the noble Earl made about Conservatives, Liberal Democrats and Labour. The noble Earl makes a very powerful speech, with which I disagree. Will he accept that there are many older vulnerable people who are just as open to persuasion from external forces as young people? The noble Earl will, like many of us, go into schools—with whatever scheme—and find young people who are absolutely able to withstand pressure and who are not vulnerable in that way. I would be grateful if he would explain the point about Conservatives and Labour because this has absolutely nothing to do with party politics. This is about empowering young people however they wish to vote. It is not about being in or out but giving them the ability to vote and determine their future.

Lords ChamberMy Lords, in recent years three children took their own lives after spending a night in a police cell. They were 17 year-olds and, under current legislation, they could be kept in police cells overnight—if they had been 16 that would not have been allowed, but as 17 year-olds, they were. One of them was Kesia Leatherbarrow. Her mother is a teacher. She leads the maths department in her school. Her father is the deputy head of a local school. Those children had parents to advocate for them, parents who were passionate to see that what happened to their children did not happen to other children. Through their advocacy they managed to persuade the Government to change the law so that in future 17 year-olds will not be placed in custody overnight.
I hope I can also express my thanks to the noble Lord, Lord McColl, and my noble and learned friend Lady Butler-Sloss for their hard work and determination over years to bring about the change that we are seeing today. I also thank the Government for working with them and for their constructive engagement in making this the best possible arrangement for these young people, so that while they may lack parents they have the advocates they need to have the best chances in their lives.
I support these amendments. I particularly add my support to the amendment tabled by my noble friend Lord Patel to extend this to all unaccompanied children. This June, thanks to the kind help of the Children’s Commissioner for England, I and some colleagues had the pleasure of meeting five young men from Afghanistan. They had all arrived here as unaccompanied children. One young man was doing extremely well in his studies and spoke with great gratitude of the help he had received. Another had spent time in a mental hospital. His health had been wrecked as a result of the lack of support he had received. I hope your Lordships will agree that we should take steps to ensure that all separated young people have the best help as early as possible so they can do well and not fall. I hope this will be changed as soon as possible. I recognise that the Government have come a long way, but I hope they will give this very careful consideration.
My Lords, I rise to support Amendments 103 and 104 and to speak to Amendments 86 and 86H, to which I have put my name.
The noble Lord, Lord McColl, and the noble and learned Baroness, Lady Butler-Sloss, have been veritable champions of these young vulnerable people and it is thanks to them—I have to say, with our support—that the Government have got far as they have. Of course I welcome Clause 47 and the government amendment that was introduced in the other place—but, as so many have said, we have not quite got there yet, but I have no doubt that we will.
Throughout the passage of the Bill, my colleagues in the Commons, together with some other Members of the House of Commons, consistently argued that unless advocates are given legal powers they will not be able to act effectively in the child’s best interests and truly protect trafficked children. We have a great example before us tonight. It was mentioned by several noble Lords. I pay tribute to the noble Lord, Lord Browne, and to the noble Lord, Lord Morrow, who introduced the Bill in the Northern Ireland Assembly. I hope that our Government will ensure that the laws pertaining to trafficked children are the same throughout the United Kingdom. It is very important and I very much hope we will follow their excellent example.
If we are truly to deliver for these most vulnerable of children, we must ensure that advocates have legal authority to act for the child in cases where they lack the legal capacity to do so. We want guardians to be able to instruct solicitors on their behalf and represent the child’s best interests. Advocates must also have the power to compel local authorities to take action where a child is not receiving the services and support to which they are entitled, such as appropriate accommodation. We also want the UK to be brought into line with its obligations under the Council of Europe convention and, as has been said, under the anti-trafficking directive.
Evidence resulting from the work and experience of members of the Refugee Children’s Consortium and from research commissioned by the Home Office and conducted by the Children’s Society and the Refugee Council demonstrate that local authorities often fail to understand, prioritise and adequately respond to trafficked children’s needs. This too often results in these vulnerable children falling through the gaps, as has been said, being housed in inappropriate and unsafe accommodation, such as bed and breakfast, and receiving inadequate adult and financial support.
Those most closely involved also find that the only way to force local authorities to act is litigation, or the threat of it. A legal advocate with powers to compel the local authority to act is therefore vital if we are to ensure that these children are correctly assessed and get the services to which they are entitled. Evidence from the evaluation of the Scottish guardianship pilot found that because guardians did not have legal powers and were not on the same statutory footing as local authority staff, they sometimes struggled to ensure that local authorities provided trafficked children with the correct services, and that because the service had no statutory footing the guardians found themselves having to negotiate, and sometimes renegotiate, the position in order to assist the young people with whom they worked. We have that very fine example before us. We know that it did not work in Scotland, so please let us act now to ensure that it works when we introduce these advocates.
Giving advocates legal powers to instruct solicitors would not conflict with the local authority, which remains responsible for the welfare and safeguarding of the child. The Northern Ireland Assembly’s amendment to its Human Trafficking and Exploitation Bill 2014 puts child trafficking advocates on an equal footing with the local authority and states that local authorities must recognise and pay due regard to the functions of child trafficking advocates. That is another fine example to be followed. The Northern Ireland Bill even has the wording right.
I urge the Government to support this amendment, or something very similar, in order to ensure that advocates have legal powers and that trafficked children are entitled to the support and protection that they deserve, because they deserve no less.

Lords ChamberMy Lords, I find this procedure extremely confusing. I realise that when a complex amendment is passed which subsumes other amendments it makes life complex, but for future reference, we would be very grateful as a Committee to have clear procedural guidance from the Whips as soon as possible. This has been a very confusing discussion on an extremely important issue.
My Lords, I will speak to Clause 1, and in particular to the concern about young people aged from 18 to 25. As I stressed before, this is a very small group within the larger group we are discussing, and one has to be very concerned that they get the appropriate healthcare and health professional treatment so that they can make fully informed, proper decisions. It is notorious that the transition from children’s services to adult services often causes issues in the treatment of young people.
Many young people may have some difficulty in fully appreciating their own mortality. While it is easy for us to recognise, it may be more difficult for an 18 or 19 year-old to realise that ending one’s life is absolutely final. Therefore I would appreciate consideration being given to the welfare of that particular group, so that whatever progress is made on the Bill in the future, the welfare needs of 18 to 25 year-olds are taken into very careful consideration.

Lords ChamberMy Lords, we have debated this issue several times throughout the passage of the Bill. I believe it is absolutely clear that while teachers will be under a legal duty, as is right and proper, to teach the law of the land—that gay couples will be able to marry—that does not mean that teachers are going to be able to advocate this as the best form of marriage, and nor are they going to be asked to promote same-sex marriage. These are very different things. It is right and proper that teachers in our country should be expected to teach the law of the land—not to promote or advocate but just to teach.
The noble Lord mentioned conscience. I think that he was talking about opt-outs. It would be totally inappropriate for a teacher to opt out of teaching the law of the land. The noble Lord also mentioned a classroom of 13 year-olds and asked whether the line could be drawn between endorsement and explanation. I have utmost confidence in the ability of teachers to do this. They already do so in many circumstances and I see absolutely no reason why they cannot do this with same-sex marriage. I am utterly opposed to the amendment.
My Lords, my noble friend raises a very interesting question about how teachers will work with this legislation. At Second Reading, the noble Baroness, Lady Stowell, made it very clear that this is a Bill about same-sex marriage. The Government have no intention of dealing with any other issue; this is just about same-sex marriage. However, from our debates this afternoon, I think it is also clear that we agree that for many years marriage has been understood to be the stepping stone to starting a family. For many people, it is the basis for going on to have children. Therefore, it does not seem too far-fetched to think that if a Government bring forward a Bill to introduce same-sex marriage, they may by implication be saying, “We have looked at all the research about the outcomes for same-sex marriage and the outcomes for children growing up with two women or two men as parents, and we are sanguine about the results. We are quite confident now that there are no concerns at all about that fashion of bringing up children”. Clearly, from what the noble Baroness said at Second Reading, that is not the Government’s intention, but I can see that this may be a difficulty—that there may be a popular misunderstanding of the Government’s intention in this Bill. Therefore, we need to make the guidance very clear for teachers. My noble friend cited two concerning cases about teachers coming under pressure because they had a different view from that of their head teachers about what should be taught in this area. A lot of work needs to be done in ensuring that the best guidance possible is offered to teachers.
I reiterate that there are strong feelings on both sides of this issue. Some people feel very strongly that with same-sex parenting there is no difference in terms of outcomes for children, and there are others who are very strongly against it. The science so far does not prove the case either way, but both sides want to twist or bend it to a certain degree to make that conclusion. Therefore, this matter requires a lot of attention. There is a need to think really carefully about the evidence involved and to use it in advising teachers and other childcare professionals about the best framework for the best outcomes for children.

Lords ChamberMy Lords, I also want briefly to thank the Minister for this announcement and to say how grateful I am to the Government for the careful way that they have listened to the concerns of noble Lords, for the meetings with the Secretary of State and for their attempts to adjust their plans in order to meet those concerns. I am extremely glad to hear this good news today. There is much more work to be done. As the population of children in custody reduces, as it has been, those remaining in custody are more difficult and challenging, so we need the best possible systems and approaches in place to deal with these higher levels of need. Again, I would like to express my thanks to the Minister and the Secretary of State for this decision.
My Lords, I too was going to speak about heaven and sinners, as did the noble Lord, Lord Elton. But I would like to put on record that the sinner in this case is not the Minister, who I know will have done a fantastic job in persuading the department of the folly of its ways. The Minister himself is certainly not a sinner; he is more heavenly.
We on these Benches are absolutely delighted that the Government are doing the right thing. It might seem churlish, but I have to say that I wonder why it has taken a whole year for them to reach that decision. It was a whole year of insecurity, not just for the Youth Justice Board but for the youth justice system itself. As we know, the Youth Justice Board does a splendid job. By any standard of measurement it is a success story. As the noble Lord, Lord Ramsbotham, and others have said, following this summer’s disturbances —when there is, properly, great consideration being given to the need to tackle youth crime—the need for this excellent body is even greater. We should heed the wise words of the noble Lord, Lord Ramsbotham, and look at the increased potential of this particular body in the difficult times in which we live.
We should pay tribute to the work of the Youth Justice Board itself, but also to the work and the voice of noble Lords all around this Chamber, led by the noble Lord, Lord Ramsbotham, the noble and learned Lord, Lord Woolf, my noble and learned friend Lady Scotland, my noble friend Lord Warner, the noble Baroness, Lady Linklater, and others, all of whom have played a huge role in persuading the Government that it would have been wrong to abolish this excellent board. Long may it continue in its excellent work, which is to the benefit of the youth of this country, but also to the benefit of each and every citizen of this country.
