Grand CommitteeMy Lords, I support what the noble Baroness, Lady Hughes of Stretford, has just said and pay tribute to the work of the Labour Government—their huge investment of funds to improve the education of looked-after children; the change in the law; the introduction of designated teachers; and the reform of the school admissions process, which is so important for these young people.
There has been concern about the success in higher education achieved by young people leaving care. It is also very important to bear in mind that many of these young people mature late. As I have mentioned in the Chamber, Dr Mark Kerr, a care leaver himself, who has done research in this area, found that upwards of a quarter of 25 year-olds in the group he looked at had gone on to higher education. I hope these statistics will provide a means of monitoring how many mature students have been through care, so that we can get a more accurate idea of how successful our efforts are. It has been somewhat demoralising to think that all the effort we have put into the education of looked-after children has not been reflected in higher education attainment, although there has been a significant increase from a very low base. Regarding how we might make best use of our resources, it may be helpful to know how many 25 year-olds who have been in care go on to higher education, for instance.
The noble Baroness referred to the Frank Buttle Trust, which has done such important work in this area, and the Who Cares? Trust. One issue the Frank Buttle Trust has identified is that, where there is someone to champion care leavers at university, one needs to plan carefully for that person’s succession. One can have a very good person in place but when they move on, everything can fall back. Therefore, I hope that can be kept in mind in any guidance arising from this work. I am very grateful to the noble Baroness, Lady Hughes, for tabling these two amendments and look forward to the Minister’s response.
My Lords, I, too, support the amendments tabled by the noble Baroness, Lady Hughes. When I was chancellor of a former polytechnic, which became a very successful university, we had a worrying number of undergraduates who left at the end of the first year, or sometimes the second year. We did not know whether or not they had been in care. There was a very good support service at the university which could have been used to help them if they had been identified as needing extra help. These two amendments are very helpful.

Lords ChamberMy Lords, I am a patron—probably the only patron—of a secure unit in Exeter, which, when the children are there for long enough, does an extremely good job. The education there is excellent. The unit receives children under the terms of the Children Act—Section 25, I think—and, certainly in the past and probably still now, children who have offended. It is a good institution. I very much support what the noble Lord, Lord Ramsbotham, said. I am very concerned that this excellent small unit, which does a useful job in Exeter, will be completely got rid of in favour of a large secure college situated somewhere which is miles away for the children who are not from Devon and Cornwall.
My Lords, earlier today I spent some time with an academic who left a young offender institution at the age of 15 without any qualifications. He has some sympathy with what the Government are proposing. As my noble friend said, the impulse to put education at the heart of meeting the needs of these young people is absolutely right. My difficulty, I am afraid to say, is that there is so little detail in what the Minister is proposing that I can see many very poor outcomes arising from it. As parliamentarians, we need to know more about what is going to be delivered to these young people.
I visited the Orchard Lodge unit that my noble friend described and, like him, I was most impressed by the high quality of multidisciplinary services that these young people receive. There may be lessons to be learnt from the research into the educational outcomes of looked-after children. I think that Professor Sonia Jackson was the academic who first drew attention to the disparity in educational outcomes between looked-after children and the general population of children at the end of the 1990s. This is relevant because many among the population in the secure estate have come from local authority care. She wrote to me recently, updating her research and looking again at the continent. She found that the United Kingdom has the best statutory framework for looked-after children and care leavers that we know of. That is a great endorsement of what this Government and the previous Government have done in terms of the legislative framework around these vulnerable young people. However, she also found that we have poorer educational outcomes than many countries on the continent. She ascribed this to the fact that we have such low expectations in terms of the educational qualifications of those who work near these young people.
As I mentioned earlier, in Denmark 90% of staff in children’s homes have a degree-level qualification and in Germany 50%. However, only 30% do in this country. As an authority was telling me recently, less than half of the managers of children’s homes have a degree-level qualification. If we are looking carefully at the policy to improve educational outcomes for our troubling, and often very troubled, children, we must take on board what my noble friend has said and his example from Missouri, where units are staffed by people with degree-level qualifications. I am reminded of the very interesting fact that the principal indicator for a good educational outcome for any young person is the level of qualification of their parents. If a parent has a degree, it is likely that their child will get a degree. It seems to make sense to look at the level of qualifications of people who work near these young people and to ensure that, as far as possible, they are well educated, so that those young people are likely to do far better in their own education.

Grand CommitteeMy Lords, the amendment would ensure that all care leavers, including young asylum seekers and migrants who came to the UK as children, are given the support that they need while they are in the UK by amending Schedule 3 of the Nationality, Immigration and Asylum Act 2002 so that it does not apply to people who initially came to the UK as children. It would not create an automatic right to support but would make sure that a young person is not discriminated against on the basis of his or her immigration status.
The concern is that young people are leaving care and being made destitute. Another point to make clear at the outset is that while being so harsh to these children, it is unlikely that they will be returning home to Eritrea, Afghanistan or anywhere else earlier, and it may well make it more difficult for them to return home as they disappear into prostitution, disappear from sight, and go underground.
Although the immigration status of a separated or unaccompanied child does not affect their entitlements while they are in care and as care leavers under the Children Act 1989, a young person’s entitlements after 18 will depend on their immigration status. There has long been concern about the forced destitution of former separated asylum-seeking children when they turn 18 and a recent report from the Children’s Society found a sharp rise in the number of young people who are experiencing destitution. The majority of unaccompanied children in the UK are seeking protection from violence, abuse and persecution from places like Afghanistan, Eritrea and Iran. Some of these young people experience destitution because they are discharged from children’s services at 18, and have been refused asylum and exhausted their rights to appeal, often despite significant barriers to their return or continuing protection needs.
Case law has made it exceedingly clear that a young person in this situation should not be moved on to support provided by the Home Office but continue to be supported by the local authority. However, in practice, this still happens as the Nationality, Immigration and Asylum Act 2002 prevents some categories of migrants from accessing certain types of support, including leaving-care provisions, and practice among local authorities varies widely due to confusion around entitlements and their budgetary pressures.
The Government say:
“There is absolutely no intention that destitution should be a deliberate aim of public policy. That would be wrong and that is not the aim of immigration policy or any other part of our policy”.
However, the provisions under Schedule 3 have precisely this effect by withdrawing vital leaving-care support from young people while they are still in the UK. This is at odds with the Government’s policy on supporting British care leavers. As I say, there is also no evidence that withdrawing support is effective in encouraging young people to return to their country of origin. A growing body of evidence demonstrates that forced destitution is an ineffective policy. In fact, severing contact between refused asylum seekers and the authorities is likely to make returns more difficult.
Destitution has severe consequences for young people’s safety as these vulnerable young people are forced to take extreme measures to survive, including being sexually exploited, working illegally or being forced into criminality. It also has an impact on a young person’s physical health, for example, through their being malnourished and unable to travel to see their GP or get warm clothing in the winter, as well as having adverse effects on their often already fragile mental state. Various systematic reviews estimate that 19% to 54% of separated children suffer from symptoms of post-traumatic stress disorder compared with 0.4% to 10% of other children in the UK. Being able to access education and safe housing—two key protective factors for separated young people—becomes more difficult when young people are destitute. I beg to move.
My Lords, my name is added to this amendment. I would like to speak particularly about young people who have been trafficked into this country. I declare an interest as the co-chairman of the trafficking parliamentary group and a trustee of the Human Trafficking Foundation. The Refugee Council and the Children’s Society have highlighted this particular group of young people who come within Amendment 234. They are included in the young people to whom the noble Earl, Lord Listowel, referred but they form a very specific group of young people who have been trafficked into this country, are identified as having been slaves and are often put into care or accommodated by the local authority which arranges for them to go to school and live in England until they are 18. Some may be asylum seekers. The latter were referred to by the noble Earl, Lord Listowel. However, some are not asylum seekers and the minute they turn 18 they become illegal immigrants under Schedule 3 to the relevant Act, and there is no one to protect them. If they remain in this country, they are particularly vulnerable. They have no status, no access to public funds and no housing. Some of them sleep on the streets and are dependent on soup kitchens. They are destitute. Others are at real risk of being sent back to the abusing situation in the country of origin from which they had escaped, having been trafficked here. Some of them are terrified at the prospect of going back because they may be retrafficked or may well be very ill-treated for having escaped the traffickers, so to go back to their country of origin, particularly when that is Nigeria, is extremely problematic.
We are in the extraordinary position of having identified these young people as victims of trafficking and having cared for them in this country where they were looked after and made welcome. However, the moment they turn 18, they are considered to be illegal immigrants and no one looks after them. I ask the Minister to look at this group of trafficked children, who probably number 100 or 200, who have been to school in this country. I have no idea what the actual number is but it is tiny. It is a pretty odd situation if we look after them and educate them but then leave them destitute the moment they turn 18.

Grand CommitteeMy Lords, I support Amendment 56 in the name of my noble friend Lord Northbourne, and regret that I failed to add my name to it. When I looked at the figures for the United States recently, I discovered that a third of boys, and two-thirds of black boys, were growing up without a father in the home, which is a pointer to where we might end up if we do not adopt my noble friend’s amendment. I have had the privilege of working with young people. I have worked with young people in hostels and boys have “adopted” me as their father. I have spoken with young men working in those hostels about what it was like for them to be brought up by their mothers on their own, and how guilty they felt about the burden they had put on them. The honourable Andrea Leadsom MP, who does such great work around early years provision, highlights the concern that when mothers bring children up on their own they risk feeling overwhelmed by that burden and withdraw their emotional support for their children.
I believe that this provision is already law in France and several other European countries. This is such an important issue that I hope the Minister will give a positive response. President Barack Obama grew up in a household without a father. Your Lordships may remember the speech he made as a senator in 2008.
He said:
“But if we are honest with ourselves, we’ll admit that … too many fathers … are … missing—missing from too many lives and too many homes. They have abandoned their responsibilities, acting like boys instead of men. And the foundations of our families are weaker because of it. You and I know how true this is in the African-American community. We know that more than half of all black children live in single-parent households, a number that has doubled—doubled—since we were children. We know the statistics—that children who grow up without a father are five times more likely to live in poverty and commit crime; nine times more likely to drop out of schools and 20 times more likely to end up in prison. They are more likely to have behavioural problems, or run away from home or become teenage parents themselves. And the foundations of our community are weaker because of it”.
That is the end of the quotation from his speech.
I hope that the Minister can give a very positive response to my noble friend’s amendment. Parents sticking together and sticking with their children is vital to the well-being of all our children. In my experience, children who do not have parents or carers who stick with them are unlikely to stick at friendships, at being husbands or wives or at jobs or difficult tasks themselves. I support my noble friend, and I look forward to the Minister’s response.
My Lords, I, too, support the principle behind the noble Lord’s amendment. In Section 3(1) of the Children Act 1989, “parental responsibility” means,
“all the rights, duties, powers, responsibilities and authority which by law a parent of a child has in relation to the child and his property”.
As has been said, one of the saddest things is that when parents separate, a substantial number of fathers walk out—very often for good reason—but in doing so they abandon their children. I regret that I have not checked the percentage but it is large, something like 60%. I believe that in the Children Act there should be something to remind the public that those rights, duties and responsibilities include that which the noble Lord has set out.
Perhaps I may say that I had no intention of saying that it was right for young men—or older men—to walk out on their families. They may be justified in walking out on their spouse or partner, but to leave the children behind, or not to look after them, is unacceptable.
May I, too, just say that while I agree that all my noble friend spoke of is vital if we are to change the culture, might not legislative change of the kind that he is proposing also be helpful? It may of minor assistance, but given that this is such a grave matter, might it not be worth pursuing?
My Lords, the conclusions arising from the important research of Dr Julia Brophy are:
“(a) The needs of courts for skilled and experienced practitioners able to produce analytical, evidence based, forensically driven reports which meet the court’s timescale required, and … (b) The realities of resources limitations for some local authorities … In this context, utilising the skills and expertise of independent social workers both pre and within proceedings is likely to remain necessary if courts are to meet current challenges and move forward with appropriate speed and confidence and to do so in a manner which reflects a court practice which is without fear or favour”.
I want to ask the Minister whether the regulations now meet the recommendations made by Dr Brophy and, if not, what amendments he may be considering. Perhaps I may apologise once more to the Minister and the Committee for giving short notice of this debate. If the Minister would prefer to write to me, I will quite understand.
Since this issue has been raised, I am going to jump on the bandwagon just to say that very difficult cases are tried by designated and senior judges and family judges of the High Court where expert evidence is absolutely crucial. I have to say that I have tried cases where I have ended up with 11 expert witnesses on shaken babies with subdural haematomas and so on, asking whether it was the parents or a parent, or whether it was an accident. These are extremely difficult cases. We were greatly assisted by CAFCASS and sometimes assisted by social workers, but even in these difficult cases, the social workers came and went. In some cases there was no consistent social worker to put in a consistent, high-quality report from their point of view. Again and again, High Court and senior circuit judges have asked for an independent social worker, which the local authority has been only too grateful to agree to. That is because the authority knows that in these difficult cases it has not actually been able to do the job itself.
In an ideal world, of course, independent social workers are not needed, but we live in a far from ideal world with children at extraordinary risk of physical injury as well as sexual injury. Here it is physical injury with which I am concerned. Again, as the noble Earl has just said, we need the doctors. I am not sure what the doctors are likely to be paid, but from the point of view of a senior consultant, it is derisory. There is a limit to pro bono, particularly if a doctor has to be in court for a day or two days. Quite simply, these really difficult cases will not be properly tried if they do not have the right experts.
Norgrove was absolutely right to want to cut it down. In the majority of cases it would be quite wrong to go in for the luxury of lots and lots of experts. I am concerned only about the small minority of extremely difficult cases, where the current system is not going to be just to the child, whose welfare, ultimately, is paramount.

Grand CommitteeMy Lords, I agree with the comments of the noble Baroness, Lady Hamwee, as a volunteer who has worked with vulnerable children and alongside those working with vulnerable young people. What a privilege it is to listen to the noble Lord, Lord McColl, who has been a sustained and passionate advocate for these trafficked children; to hear the concerns of the noble Baroness, Lady Massey of Darwen, the chair of the All-Party Parliamentary Group for Children; and to listen to my noble and learned friend, who is the chair of the human trafficking group and whose name escapes me, incredibly.
I re-emphasise the point made by the noble Baroness, Lady Hamwee, that there needs to be training for people working with these vulnerable young people. I am very taken with the notion that there should be volunteer advocates working with them but as a volunteer myself, who has had experience of both very poor support and supervision and very good support and supervision, I suggest that the regulations should be very clear about what sort of supervision, training and support these advocates should receive. That is only fair to volunteers and it will make them much more effective as advocates and supporters of these young people. There is a great dearth of resource in children’s services at the moment and the danger is, if regulations are not clear about what the minimum requirements are, there may be a drive to produce the lowest-cost and lowest-quality advocates for these young people. I had only that comment to make. I very much support the amendment.

Grand CommitteeThey do it already. There is no difference. They have a requirement under the Act to accommodate. They have had that since 1989, or since 1990 when the Act came into force. I am talking about giving them a parental responsibility order, which is a wake-up call and has nothing to do with finances at all.
Just to clarify my position, I was simply using that as an example: that occasionally local authorities are overburdened for one reason or another and we need to support them as far as possible to meet those needs.
I am talking about a very specific group of children. Some trafficked children may seek asylum, but that is a completely different matter. I am talking about children who have through the NRM been positively identified as trafficked or are going through the process of identification—one or the other. I am not talking about children who might possibly be trafficked but who have not yet gone through that identification.
The reason for tabling the amendment was as a wake-up call to local authorities. I totally understand the extent to which they are overburdened and underresourced—I said that—but this small group of children is slipping through the net. I was delighted to hear what the Minister had to say about missing children, because there is a serious lack of data from local authorities on children who go missing. They ought to be able to identify what sort of children they are. Are they the children who keep going missing from children’s homes? We know that there are children who go missing three, four or five times a week. That is not the sort of child we are talking about. The group we should worry about is the child who goes missing and is never identified again as a child who was in a children’s home or a foster home. Local authorities do not even know. They have to get their act together to know that those are trafficked children.
I welcome the opportunity to discuss that further with the noble Baroness. I have no doubt that the group of which I am a co-chairman would very much like the opportunity to do that, particularly the chairman of the Human Trafficking Foundation, Anthony Steen, who was previously an MP who worked tirelessly for this cause. This children issue is one that we are truly concerned about. I very much welcome what the Minister said and I am happy to withdraw the amendment.

Lords ChamberMy Lords, I listened with great interest as the noble and learned Lord, Lord Mackay of Clashfern, presented his case, particularly to what he said about children and families and the importance for children to grow up in a very strong environment, ideally with a father and a mother. I do not think that he said that specifically, but he talked about children coming into the care system and the difficulties at finding someone who will make a real commitment to the child. In my own family, marriage was fairly relaxed from a religious point of view, but it was there in preparation for having a child and gave us children a secure base to look forward to.
I listened to the noble Lord, Lord Lester, speaking about the old view and the modern view of marriage. The old view is there for families and to give a strong framework in which children can grow up, and the modern view is much more about individual adults choosing what is best for them and what they feel most comfortable with. I am reminded of a report from the Children’s Society—the Good Childhood inquiry—some time ago, which drew attention to exactly that change and shift in adults, and the unfortunate consequence for children, with so many children nowadays growing up without contact with their fathers. That freedom of choice for adults has become a very unhappy situation for many children who do not have that security of having a father around.
This is such a difficult question and it is helpful that the noble and learned Lord has tabled the amendment. It is important to distinguish between this new version of marriage that we are discussing today, and traditional marriage, especially as there is some misunderstanding about the impact of same-sex parenting and heterosexual parenting on child development. There are strong feelings on both sides, and some say now that the question is quite finalised: we all know that same-sex parenting has the same outcomes for children as heterosexual parenting. However, I think that there are a number of difficulties about that particular point of view, and I would say briefly that same-sex parenting has been around for only a short time; it is a new phenomenon, so scientifically there has not been the time for extensive or controlled research to verify either way, or to provide data on these outcomes. We will come back to this later in the debate, but I support strongly what the noble and learned Lord proposes, and I hope that the Minister will feel inclined to accept it.
My Lords, I am grateful to the noble and learned Lord across the Chamber. I want to make a brief point to the noble Lord, Lord Lester. If the noble and learned Lord, Lord Mackay, had asked for the phrase, “traditional marriage”, the point made would have some benefit and would be something that we should perhaps take into account. But the amendment refers to “same sex couples” and “opposite sex couples”, so how on earth can anyone suggest anywhere that one sort of couple is better than another sort of couple? They just happen to be different—different and equal. So I cannot see how the noble Lord, Lord Lester, can make the point that one group will be downgraded because they are the same sex and another will not be downgraded because they are opposite. That is not an argument that can be used in the present wording—very clever and careful wording, if I may respectfully say so—of the noble and learned Lord’s amendment.

Lords ChamberMy Lords, I declare an interest as co-chair of the human trafficking parliamentary group. If there are reasonable grounds for someone being understood to be a victim of trafficking, it would be extraordinarily unjust and contrary both to the Council of Europe’s convention and the directive of the European Union, to both of which the Government are signatories, to treat that victim in the way that it is possible that he or she would be treated if the amendment were not passed.
My Lords, I would be most grateful if the Minister could clarify the position, raised by the noble Lord, Lord Avebury, regarding this sudden moment of transition at the age of 18. I would appreciate him reassuring the House that the Government do not consider there to be a single cut-off immediately after the child moves past the age of 18 but that there is humane consideration of a young person’s need for a transition into adulthood. With young people who have been traumatised—for instance, those who have been trafficked—one sees that their development may well be delayed and one has to allow for that. In the Children (Leaving Care) Act, we see special consideration being given to their needs, because of their early trauma, up to the age of 21 and, in some cases, until the age of 25. We need to pay attention to the developmental needs of children and to recognise that some children, particularly those who have been traumatised in their early life, need more care and attention as they make that transition into adulthood.

Lords ChamberAs vice-chair of the Associate Parliamentary Group for Children and Young People In and Leaving Care, I find myself in sympathy with the noble Lord, Lord McKenzie of Luton. The interests of such children and young people need to be considered very carefully. I am concerned that so little time is being allowed to debate the impact of the Bill on these young people. I would grateful to learn from the Minister how it will affect the trust funds for children in care, established by the previous Government, and how the Minister plans to make up for any loss to young people leaving local authority care. Many of us have felt ashamed of our historic treatment of young people in local authority care. It is beyond any doubt that their interests have been overlooked. It was deeply gratifying to see the seriousness with which the previous Government took the welfare of this neglected group and it is encouraging to see the coalition sustaining this.
Ten years ago, only 1 per cent of young people in local authority care went to university. Recent research has highlighted that 8 to 9 per cent are now accessing higher education. That is still disappointing but it is a more than 800 per cent improvement on the past. The lesson is that many of these children can do far better in life than we have allowed. We need to be better at keeping their interests close to our hearts. Given their chaotic early experiences in their families, and often in care, it is vital to offer young people leaving care all the help we can as—we hope—they recover from this chaos and find direction for their lives. That is why the trust fund for children in care is so important to these young people. It helps some of them to make a fresh start and makes up in a small way for the fact that they are often left high and dry, without the support our own children would receive from us.
I support the noble Lord’s amendment. I understand the Minister’s predicament; there is no room for complacency about reducing the deficit. However, we have let these children down too often before by not placing their interests high enough in our priorities. I would welcome information from the Minister on what steps he and his colleagues may be considering to protect the interests of these children once this legislation is passed. A meeting to discuss this would be very welcome.
My Lords, I have some difficulty in understanding the purpose of this amendment. I understand that the Leader of the House has told us that, regardless of what we do in this House, the other place has absolutely no need to take any account of us because this is a money Bill. If it were not a money Bill, I would have some sympathy with the noble Earl, Lord Listowel, and the speakers from the Labour Benches. However, since this is a money Bill, I cannot see what good we can do or why one day would not be sufficient to deal with all these matters. Everybody can—to use a colloquialism—sound off in one day totally effectively when we are dealing with a money Bill.

Lords ChamberMy Lords, I support, first, the amendments tabled by the noble Lord, Lord Low. It is important that special needs are recognised. I also support the amendment of the noble Lord, Lord Northbourne. I have been a governor of a girls’ school and am now a governor of a boys’ school. As a governor of the school to which my daughter went, I was not actually asked to take on the role until she had left. That seems to be the ideal situation because you then have a parent with a real interest in the school but without the rather special interest which is local and time-limited. To have a predominance of parent governors while their own children are in the school would be a retrograde step, so I strongly support the amendment of the noble Lord, Lord Northbourne.
My Lords, I also support my noble friend Lord Northbourne’s amendment. I emphasise that there is much to do. Some children need smaller schools and special teachers to work with them, but others do not, even though they may face serious challenges at home. Good support can be offered in schools to include these children to the benefit of all. I give one example: the charity Voluntary Reading Help, which works in over 1,000 schools. It recruits volunteers to work for one or two lunch hours a week with particularly difficult or challenging children. I have seen for myself in a primary school nearby how the volunteer will sit down and read with a child for half an hour and then play a little game. The child chooses the book and they enjoy their time together. A significant number of these volunteers are men, which is particularly valuable given that we have so many young boys growing up without fathers. These are important relationships that can be built up over the course of a year, which is the minimum commitment. This is the sort of thing that helps to include children who might otherwise be challenging. It is important to consider who should make up the governing body and what its function is. It should take a strategic view and be able to adopt sensible approaches like the one I have outlined.
I was encouraged when Nick Clegg, the Deputy Prime Minister, said last week that he intended to recruit more men into early years childcare. I hope that he will also look at primary schools and how initiatives like Voluntary Reading Help might be developed. The charity is keen to expand in order to be able to help more children.
