Commons ChamberLet me start by congratulating the hon. Members for Congleton (Fiona Bruce), for Ross, Skye and Lochaber (Ian Blackford) and for Strangford (Jim Shannon) and my hon. Friends the Members for Stoke-on-Trent South (Robert Flello) and for Stalybridge and Hyde (Jonathan Reynolds) and my right hon. Friend the Member for East Ham (Stephen Timms) on securing today’s debate, and on all they have done to raise this issue inside and outside the House.
I also personally thank the hon. Member for Congleton for arranging last night’s evidence session. Listening to the very harrowing testimony of Ekhlas touched all Members who were present. I also pay tribute to those Members in the other place who have been raising this issue for some time, including my noble Friend the Baroness Kennedy, who has led on the matter. There have been many excellent contributions in today’s debate from both sides of the House. It appears that the House is united in its view about what the Government should do next.
I want to start by saying something about the nature of the crimes against the Yazidis and others. As we have heard from many Members across the House, Daesh has perpetrated the most heinous of crimes against the Yazidis as well as against other ethnic and religious minorities, including Syrian Christians and various non-Sunni people in the area of northern Iraq that they currently control.
The crimes include mass murder, torture, enslavement and unimaginable sexual violence including systematic rape, often of children. Just returning to what Ekhlas said in her testimony yesterday, the thing that will stay with me is hearing about that nine-year-old girl who was repeatedly gang-raped. When her body could not take the brutality of the assaults any more, she was murdered in the most horrific of circumstances. These are crimes that most of us will struggle to comprehend. As we have heard today, these are not crimes that are being randomly perpetrated; they are organised crimes, deliberately targeted at particular ethnic and religious groups. Amnesty International has described these acts as ethnic cleansing on an historic scale.
Many Members have referred to the first-hand testimonies that they have heard from survivors and from those who have worked directly with survivors. I pay tribute to the unbelievable bravery of all the survivors who have spoken out to alert the world to the plight of the Yazidi population. Meeting survivors has really brought it home to me that this is not some historic event; it is an ongoing atrocity affecting thousands of people. The plight of those affected is highlighted by this quote from Mirze Ezdin, who had 45 relatives—all women and children—abducted by Daesh fighters. He described to Amnesty International the daily hell that this situation has wrought. He said:
“Can you imagine these little ones in the hands of those criminals? Alina is barely three; she was abducted with her mother and her nine-month-old sister; and Rosalinda, five, was abducted with her mother and her three brothers aged eight to 12. We get news from some of them, but others are missing and we don’t know if they are alive or dead or what has happened to them.”
Mirze’s case is far from unique, which is why today’s debate is so important.
I now want to comment on the specific definition of genocide. Although there is no doubt that the crimes that Daesh has committed are horrendous, the motion asks us to consider whether they reach the threshold of genocide. Genocide is not a term we use often; it is one that we reserve for the most heinous crimes and it has a specific meaning. For a set of crimes to constitute a genocide, they must include the killing or serious harm, including sexual harm, of a group of people who have a specific ethnic, religious or racial characteristic. Labour has consistently argued that the crimes committed by Daesh appear to reach that threshold, so it is right for the UK to refer the matter to the UN Security Council for final determination by the ICC.
I am therefore pleased to say that we will be supporting the motion this evening. If this House passes the motion, as I hope we will, it will be an historic moment. I have not been able to find another instance of the House of Commons formally recognising an ongoing conflict as genocide. As we have heard, similar motions have been already passed in the US House of Representatives and the European Parliament. In March, a UN panel concluded that Daesh might have reached the threshold, and the US Government announced that they considered the actions of Daesh to constitute a genocide—this is only the second time that they have recognised an ongoing conflict as a genocide.
Now I want to turn to the question of protection for the Yazidis. The designation of genocide is important, not just because we do it rarely but because it shows intent to end the atrocities and ensure that the perpetrators face justice. I hope that the Minister will be able to reassure us on both of these points when he responds.
First, the Opposition seek an assurance that the Government will recognise the wishes of the House if this motion is passed this afternoon and will refer the matter to the Security Council for referral to the International Criminal Court. The Minister told the House last week that the UK was assisting in the collection of evidence, and of course we welcome that, but I should be grateful if he would lay out in more detail the nature of that technical support. My right hon. Friend the Member for Cynon Valley (Ann Clwyd) raised this point. I would also be grateful for information on the issue of forensic investigative support and how that will be provided, which was also mentioned by the Chair of the International Development Committee, my hon. Friend the Member for Liverpool, West Derby (Stephen Twigg).
Secondly, I want to ask the Minister about the action the UK is taking to protect the Yazidis and other ethnic minority communities in Iraq. It is clear that all states have a duty to prevent genocide. Primarily, this responsibility sits with the state where the genocide is committed. Tragically, Iraq has failed to protect the Yazidis and other ethnic minority citizens, so it is right that the UK and other states should offer support to Iraq in the fight against Daesh. Will the Minister explain what specific action the UK is taking to assist in the protection of the Yazidis and to offer them security?
I also want to press the Minister on the humanitarian assistance given by the UK to the survivors of the Daesh attacks. Many Yazidis are now in refugee camps run by the Kurdistan Government in northern Iraq. These people are not classed as refugees by the UN as they are internally displaced, but we must recognise that they have been displaced from their homes and feel incredibly vulnerable. Will the Minister explain what steps the Government are taking to support these people? It is important to note that none of the people we are discussing today is eligible for relocation to the UK under the Government’s scheme, and I am extremely disappointed that the Government have consistently refused to offer sanctuary to any of these groups. There are compelling arguments for recognising the special needs of these survivors and their need for a safe space and specialist psychiatric support. This is particularly true for the women and children affected.
Already Germany has done so. A few weeks ago I met a Yazidi woman who had been enslaved, had escaped and was offered two years’ protection in Germany and—this is key—specialist psychiatric support. At Foreign and Commonwealth Office questions last week the Minister wrongly said that the German scheme required women to travel to Europe before they could access the scheme. That is not true. The German scheme takes women from the region. I hope the Minister will go away, reflect on what Germany is doing and offer the same protection to victims of what we all agree is genocide.
In conclusion, the people of this country do not walk on by when they see evil being perpetrated against fellow human beings. What is happening to the Yazidis and others is evil. We want our country to stand up and declare solidarity with those people, and refer what is happening to the Security Council. We believe genocide is being committed, and I hope the whole House can come together this evening in support of the motion.

Friend the Member for Swansea East (Carolyn Harris) about the Saudi investigation into the conduct of the coalition campaign in Yemen? Does he have faith that the investigation will be thorough, independent and transparent? Does he expect the initial findings to be published? What follow-up will the UK take if allegations of war crimes are substantiated? Will he also outline the steps that the Government have taken to ensure that the UK liaison officers supporting the Saudi military campaign have not been unwittingly involved in potential war crimes?
As I have said in the Chamber a number of times, we have one of the most robust systems of arms export control licences in the world, and it is important to make sure that they are robust. We have been working closely with the Yemeni authorities, but also with the Saudis, to make sure they put their hands up when a mistake is made. We have frank conversations with them privately to make sure that the investigation will work as we expect it to.

It is a pleasure to serve under your chairmanship, Mr Pritchard. I begin by congratulating the hon. Member for Spelthorne (Kwasi Kwarteng) on securing the debate. He spoke with great experience and knowledge of Egypt and set it in its proper context; I think we all benefited from that introduction. I also pay tribute to my hon. Friend the Member for Cambridge (Daniel Zeichner), who spoke clearly and effectively about the horrific death of Giulio Regeni. I will say a little more about that later on.
The hon. Member for Bristol North West (Charlotte Leslie) set out so well the context of Egypt in the region. She used what I thought was a very good phrase: “democracy was never going to happen as it does in Tunbridge Wells”. That was very telling. The hon. Member for Strangford (Jim Shannon), as ever, stood up for religious freedoms and, of course, blushed at the offer of a holiday with the hon. Lady in Sharm el-Sheikh.
As we have heard, Britain and Egypt have a long, close and often tumultuous relationship, but Egypt remains a key ally for us in the middle east. We are key trading partners, and as the hon. Member for Glenrothes (Peter Grant) said, the UK is the biggest source of direct investment into Egypt. More than 1,000 British companies invest in and operate in Egypt in sectors such as finance, energy, construction, pharmaceuticals and IT.
Of course, as the hon. Members for Spelthorne and for Bristol North West said, there are also the thousands of British tourists who visit each year, or would if they could get to Sharm el-Sheikh. I hope that when the Minister responds, he will be able to update us on the progress made on restoring flights to Sharm el-Sheikh. Those flights are vital for the Egyptian economy, which desperately needs the summer season, and for British holidaymakers, who are already making their plans. In fact, numerous holiday firms, including Thomas Cook, are currently offering holidays to Sharm from May, so is the Minister confident that the security measures will be sufficient by then for flights to resume?
Egypt is, of course, more than just an economic partner to the UK; it is also an important strategic partner in the Arab world and a key ally in the fight against extremism, against Daesh and Assad in Syria, and in north Africa and the Sinai. We need to work with Egypt to tackle extremism, and we want it to do more to tackle terror financing. All of that gives us a very good reason to work with Egypt and, for those reasons, we need a stable Egypt.
It is clear that over the past two years, the Government have improved relations with Egypt. Since the election of President Sisi in June 2014, albeit on quite a small turnout, the Government have gone out of their way to build relations with the Sisi Government, and I welcome many aspects of this Government’s work to improve those relations. First, as I have said, it is very important that we co-operate on security and countering extremism. Secondly, as an MP for Hull, which is a key centre for renewable energy, I was very pleased to see the memorandum of understanding signed on a multibillion pound renewable energy deal with a British company. Thirdly, I am very pleased to see that 2016 is the year of British-Egyptian co-operation on science, innovation and higher education.
However, we have to remain critical friends of the Sisi regime. To promote stability, we need not just to support the Government of President Sisi, but to encourage his Government to tackle some of the underlying issues that have caused so much instability over the past few years. Stability requires respect for human rights, for the constitution and for democratic participation. It requires corruption to be tackled and the rule of law to be promoted, and we cannot promote academic co-operation and innovation unless we also promote academic freedoms.
The Amnesty International report from 2015-16 paints a bleak picture for those aspects of Egyptian society. The rule of law has been undermined by mass detentions and mass trials, which are rarely fair. The relationship between the state and its citizens has been undermined by routine allegations of police brutality, torture, arbitrary arrest and enforced disappearances. The treatment of women is a particular concern in relation to sexual violence.
Respect for democratic institutions has been undermined by repeated attacks on freedoms of assembly and non-governmental organisations, and I am very concerned that those actions, as the hon. Member for Bristol North West said, are fuelling the disquiet that has previously led to problems and revolutions in Egypt, and are making it more difficult for there to be a transition to a fully stable democracy.
Although I agree with much of what the hon. Lady outlines, does she agree that there is a ray of hope in that in the new Parliament, it is surprising how many women representatives, in particular, there are and how many people from different faiths?
I am very pleased to have taken that intervention. I think that is a good sign—if there are more women in any Parliament, it is usually a good sign of progress, so I welcome that.
To get back to my point, it is important that the British Government should be prepared to make it clear to the Government in Egypt that we expect them to operate to a higher standard on human rights issues. It is in our interest to promote British values of human rights and democracy, and it is also in the interests of Egyptian stability for it to do the same. However, as an example of the Government’s reluctance to do that, I want to return to the case of Giulio Regeni, which was raised by my hon. Friend the Member for Cambridge. He set out so effectively what happened in the horrific murder of this academic and talked about what has been described—the systematic ripping out of fingernails, the broken ribs, and the brain haemorrhage that happened to this man. It is just appalling.
I raised some parliamentary questions with our Government to ask what their response was. I was told that the Government support the Egyptian and Italian investigations, but reports suggest that the Egyptian investigation is seriously flawed. The Italian ambassador has complained of a lack of access. There are real concerns about whether Egypt has the capacity to conduct a genuinely impartial investigation.
I wrote to the Minister on 16 February 2016 pressing upon him the importance of this case and the need for Britain to intervene to ensure that an impartial investigation takes place and to offer British assistance. I look forward to receiving a response from him. In particular, given that we are in this year of co-operation on education and research, I would think that the Government have had many opportunities to raise this case. There have been press releases, partnership agreements and a visit from the Prime Minister’s special envoy, but academic freedoms seem to have been excluded from that academic dialogue. We appear to have had a situation in which the Prime Minister’s special envoy was in Egypt discussing academic co-operation, weeks after the body of a murdered British academic was found, but as I understand it, that was not raised.
Other countries have not remained silent. The Italian Prime Minister Renzi stressed that it was because of his Government’s “friendship” with President Sisi that he stood in a position to demand the truth and stressed that it was critical for the future of Italian-Egyptian relations. The UK Government need to realise that it is because of the strength of our economic, social and security co-operation that we can also be in the position of critical friends. Weakness from the Government in not taking the matter up is not helpful. I hope that the Minister, in his response this afternoon, will be able to reassure us that he is having those conversations with the Egyptian authorities. I also look forward to him responding to the other points that I have raised, particularly on tourism.

My hon. Friend, the Chairman of the Foreign Affairs Committee, raises an important point, which I will divide in two, if I may. There is a deconfliction system that makes sure that the coalition’s aircraft and involvement are separated from Russia’s, and that has now been in place for some time. However, what we are talking about here is a verification mechanism for the cessation of hostilities. The verification process has yet to be put in place; it is still being agreed by the co-chairs—Russia and the United States—and details will emerge soon.
I very much welcome the urgent question from my hon. Friend the Member for Batley and Spen (Jo Cox), and I pay tribute to her excellent work on this issue.
The world community is watching the ceasefire very closely, and we all want it to be successful, not least to allow humanitarian aid into areas blighted by the conflict, but also to give a boost to the tentative peace talks. As the ceasefire has now been in operation for a few days, I would like to ask a number of questions.
First, the letter from the Syrian National Council to Ban Ki-moon alleged there were 15 breaches of the ceasefire by Russia and the Assad regime. Following that, France called for an urgent meeting of the International Syria Support Group. Will the Minister confirm when the group will meet? What powers does it have to make a ruling on breaches of the ceasefire? Does it need unanimity to do so?
Among reported breaches of the ceasefire, the most worrying was a reported gas attack in the Irbin area, with indications of a link to the Assad regime. Will the Minister confirm whether the Government are aware of that attack? What special provisions are in place to investigate chemical weapons attacks?
One key problem is a lack of agreement on which groups are terror organisations and what action is allowed. Will the Minister explain whether that will be discussed at the International Syria Support Group?
To address the humanitarian situation, we need access to areas where there are no hostilities. Will the Minister explain what steps have been taken to establish the geographical demarcation of the ceasefire?
Over the past six months, Russia has repeatedly acted to prolong the conflict. What discussions have there been with our allies in the EU to put pressure on Russia to abide by the ceasefire?
Saudi Arabia also has a key position of influence. It is especially concerning, therefore, to hear of a possible Saudi response to Russian action. Has the Minister made any representations to the Saudi Government about that?
Finally, may I ask about the status of the group Ahrar al-Sham? I understand that it was not a signatory to the ceasefire but had indicated that it would abide by it. However, it now claims that its headquarters in Idlib were attacked in a Russian airstrike—a claim backed by several sources. Will the Minister confirm whether the group is considered to be outside the terms of the ceasefire by the UK and the US?
The hon. Lady asked a series of questions. First, the latest UN Security Council resolution—resolution 2268—which confirmed the cessation of hostilities, underlines the importance of a previous one, resolution 2254, which is all about the ability to gain access to various areas where ownership is sometimes confusing. That is done on a very local basis to make sure that agreements take place and that UN and other convoys have the series of permissions they need, so that they are not halted at checkpoints, with the food being taken from them and used as a weapon of war. It is difficult for me to give a comprehensive reply for the whole of Syria, but these things are done on an area-by-area basis. The method for taking deliveries also reflects the threat level. Clearly, there are areas surrounded by Daesh, where it is impossible to have such agreements.
The hon. Lady spoke about the chemical weapons attack. A number of UN organisations are looking into a wider piece to do with the use of chemical weapons across Syria. They are in the process of completing a report to the UN, which is due shortly. If I may, I will write to her with more details on that.
On the work being done to provide international humanitarian aid, I go back to the conference we had, where we were able to garner an awful lot of support, including from Saudi Arabia, for making sure that money is filtered through the various UN organisations so that they can get through to the various locations.
The hon. Lady mentions a number of other extremist groups, including Ahrar al-Sham, and there is Jaysh al-Islam as well. They have not been considered as moderate; they have not been included in the discussions, and they were not represented in the talks where the Saudis brought the moderate groups together.[Official Report, 9 March 2016, Vol. 607, c. 1MC.]

We are dealing with a raised level of Russian assertiveness—indeed, aggression—in many areas: in the Baltic, in Ukraine, and now in the middle east, and we have to be robust in all areas. He is also right—and our hon. Friend the Member for Gainsborough (Sir Edward Leigh) was right—that Russia holds the key to the situation in Syria. I have said in the House before, and I shall say again today, that there is one person in the world who has the power to bring the misery in Syria to an end by picking up the phone and making one phone call, and that person is Vladimir Putin.
The whole House will welcome the ceasefire agreement, which is badly needed, but there have been promises from Russia before. The Russians have repeatedly claimed to attack terrorist groups when, in fact, they have attacked moderate opposition forces and civilians, so can the Foreign Secretary set out how breaches of the ceasefire agreement will be assessed?
The hon. Lady has put her finger on the problem. The ceasefire agreement will allow continued operations against Daesh, al-Nusra and associated terrorist groups designated by the UN Security Council, and no one would disagree with that. The problem is that the Russians claim that all their action to date has been against those groups. On the face of it, the Russians could be entering into this arrangement on the basis that they will not change their behaviour at all. Clearly, the cessation of hostilities will fail before it has even got off the ground if that is their intention, so everything hinges on Russian good intentions.
So can the Foreign Secretary explain what consideration has been given to a UN resolution to strengthen the ceasefire agreement and support the peace talks?
First, an arrangement has been agreed between the Russians and Americans for investigating alleged breaches of the ceasefire, and there is a commitment on both sides to working up a co-ordination cell to try to identify legitimate targets that can be struck during the ceasefire. As for the UN dimension, we are looking at that, and we would very much welcome a UN resolution behind the ceasefire. We already have UN resolution 2254, which we agreed on 18 December in New York, but we welcome further UN resolutions. That can only happen if the Russians are prepared to work with us, because they have a veto.

Commons ChamberMy hon. Friend is right to articulate that point. This is the main funding source that is keeping Daesh alive. It is able to use those funds to pay for the fighters who are causing so many of the problems in Iraq and Syria. It is hoped that the Vienna talks will lock down those countries—Iran has already been named—to ensure that they honour their commitments so that we can close down the financial channels.
Following on from the question from my hon. Friend the Member for Hackney South and Shoreditch (Meg Hillier), an estimate by Associated Press at the end of October 2015 was that between 40,000 and 50,000 barrels of oil a day were being produced to finance Daesh in Iraq and Syria to the tune of $40 million a month. In the light of the agreement on terrorist financing that was reached in December, which the Minister mentioned, and the coalition military action, what is his current estimate of the finances available to Daesh?
I made it clear that there is an estimate that Daesh is receiving between $2.5 million and $4 million a day. This matter is very difficult to understand because it does not keep accounts and it certainly does not share its accounts. There is not the transparency that we would like to see from any country. We are fully aware that its main source of income is the illegal sale of oil to the Assad regime. We have closed off other avenues, but the main one is sales to the Assad regime.

It is a pleasure to serve under your chairmanship today, Mr Chope. I begin by congratulating my hon. Friend the Member for Rotherham (Sarah Champion) on securing the debate and on her excellent opening speech. Since she has been a Member of this House, she has been a constant and tireless campaigner for children, no matter where they live. This debate has been well-attended and well-informed, and has reflected the strong opinions across the House. Many Members have visited the region and speak with experience. We have also benefited from the professional expertise of certain Members, with their backgrounds in psychology, mental health and medicine, and also as a professional soldier.
Before turning to the specific issue of children, I should, as others have, comment on the wider context of today’s debate and reiterate the Labour party’s commitment to support a negotiated two-state solution for the two peoples of Israel and Palestine. As has already been said, the situation in Israel and the west bank is bleak. There are no peace talks, and there is no immediate prospect of peace talks. We appear to be as far from a resolution to the conflict as at any point in the past 20 years, while the continued settlement building makes the prospect of a two-state solution even less likely.
Tensions are escalating on both sides, and sadly we have seen a number of terrorist attacks against both Palestinians and Israelis in recent weeks and months. As with any conflict, it is children who often suffer most. The international community has a particular obligation to children, as laid out in the UN convention on the rights of the child. Israel, as a signatory to that convention, is expected to uphold those rights. Furthermore, as an occupying power, Israel has obligations under the Geneva convention towards Palestinian child prisoners.
As we have heard today, there are numerous and highly concerning reports that the detention of children, some of whom are very young, breaches those obligations. That should concern us all not only because it amounts to abuse, but because we want a better future for Israel and Palestine, and today’s children are central to that hope. What we should be working towards and what the international community should be promoting is co-operation and dialogue between Palestinian and Israeli children, to enable a shared and peaceful future.
I could not agree more on trying to bring groups together. On a recent visit to Israel—I declare an interest—we met the MEET group, which brings Palestinian and Jewish children together. It is a fantastic organisation. However, the hon. Lady knows I was a schoolteacher. Would I have delivered the following to any of my lessons? This is from a grade 8 Palestinian textbook:
“Today’s Muslim countries need urgently Jihad and Jihad fighters in order to liberate the robbed land and to get rid of the robbing Jews”.
That is the context of a lot of the violence. Yes, we must hold Israel to account, but we must also hold the Palestinians to account for the abuse of children through the school system.
I want to come on to deal with the point that the hon. Gentleman has just made. I think that every Member—[Interruption.]
Order. Up until now we have had mutual respect, and I think that should continue.
I think that every Member of this House would agree that the involvement of children in conflict is absolutely wrong. Before I go on to deal with some of the specific issues around the Israeli response to Palestinian child prisoners, I want to refer to the 2005 assertion from Amnesty International:
“Palestinian armed groups have repeatedly shown total disregard for the most fundamental human rights, notably the right to life, by deliberately targeting Israeli civilians and by using Palestinian children in armed attacks. Children are susceptible to recruitment by manipulation or may be driven to join armed groups for a variety of reasons, including a desire to avenge relatives or friends killed by the Israeli army.”
Moving on to the issue before us today—the treatment of child prisoners—in 2012 the Government convened a group of eminent lawyers with expertise in human rights and child welfare to investigate what was going on. I commend the Government for doing that and I commend all the lawyers involved, including my right hon. and learned Friend the Baroness Scotland. The report concluded that Israel’s treatment of Palestinian child prisoners amounted to a series of breaches of the rights of the child, including article 2 on discrimination and article 3 on the child’s best interests. More concerning still, the lawyers encountered significant evidence that Israel may be in breach of the general prohibition on cruel, inhuman or degrading treatment.
The following year, in March 2013, UNICEF released a report, “Children in Israeli Military Detention”, which prompted the UN Committee on the Rights of the Child to express,
“its deepest concern about the reported practice of torture and ill-treatment of Palestinian children arrested, prosecuted and detained by the military and the police, and about the State party’s failure to end these practices in spite of repeated concerns expressed by treaty bodies, special procedures mandate holders and United Nations agencies”.
UNICEF made 38 recommendations to improve the treatment of child detainees. Many of these overlapped with the 40 recommendations from the UK legal delegation, which covered the five clear areas of arrest, interrogation, bail hearings, sentencing and the investigation of complaints. Those were all important recommendations. In response, there have been a few welcome military orders issued by the IDF, including military order 1711, which reduces the time a Palestinian child can be detained prior to appearing before a military court judge, and military order 1745, which requires interrogations to be conducted in a language the child can understand, and to be recorded. However, this order does not apply if a child is suspected of committing a security offence such as throwing stones, and that is of concern.
A 2014 UNICEF working group on grave violations against children gathered 208 statements from detained children and found that, among other things, 171 reported being subject to physical violence and 144 reported being subject to verbal abuse. Of the 38 recommendations made by UNICEF in March 2013, only five were deemed to have been addressed by March 2015, although 15 were partially addressed and 14 were under discussion. It is important to note that Israel has rejected only one recommendation outright. The British Government need to do much more to hold the Israeli Government to account in terms of what they are doing to meet the recommendations that have been made.
In a recent answer to my hon. Friend the Member for Hammersmith (Andy Slaughter), it looked as though there was little tangible progress in implementing the recommendations that have been set out. Nor can I say there is much evidence that the Government are prioritising the issue. Although I welcome the efforts of our ambassador in Tel Aviv to raise the issue, I think Ministers can do far more. In conclusion—

In conclusion, I hope the Minister will make it unambiguously clear today that the UK Government stand behind all 40 of the UK recommendations and will explain to the House how he intends to encourage Israel to do far more to implement the recommendations as soon as possible.

Friend the Member for Leeds Central (Hilary Benn), the shadow Foreign Secretary, who is unable to respond to the statement because he is visiting the Occupied Palestinian Territories and Israel. On behalf of the Opposition, I thank the Foreign Secretary for the courtesy extended to me by his office, for advance sight of his statement and for updating the House before the recess.
The scale of the humanitarian catastrophe stemming from the civil war in Syria is almost too great to comprehend. The death toll is well over 250,000 people. Millions of men, women and children will spend this Christmas as refugees living in tents in Lebanon and Turkey, and in Europe in Greece, Serbia and Calais. Even after all the brutality we have seen over the past four years, the situation continues to deteriorate. This week there were the appalling reports that Daesh will murder children who have Down’s syndrome. The international community has failed the people of Syria and we must now do everything we can to address the situation.
On the military aspect of the UK’s strategy, I note that UK military action up to now has focused, first, on economic infrastructure, particularly oil, which is so key to financing Daesh and, secondly, on alleviating the pressure on Kurdish peshmerga forces operating in Syria. It is notable, however, that the Foreign Secretary did not mention action to support other moderate forces in Syria. Can he update the House on what progress the Government have made in identifying and co-ordinating with such forces?
I note that the Foreign Secretary stated that there had been no civilian casualties resulting from UK military action in Iraq and Syria. Can he outline to the House the steps taken before a strike is authorised to minimise civilian casualties and then after a strike has occurred to ensure any possible civilian casualties are investigated?
I pay tribute to the outstanding bravery and professionalism of the British military personnel who have carried out these early missions. When we all return to our constituencies over the Christmas break, and return to our families, these very brave men and women will be continuing to serve our country in difficult and dangerous circumstances. For this, they deserve our unflinching admiration and respect.
Of course, as the Opposition have consistently argued, military action could only ever be a part of the package of measures needed to defeat Daesh and end the Syrian civil war. The UK’s overriding priority has to be supporting a diplomatic agreement that unites the elements opposed to Daesh within Syria and paves the way for the departure of Assad. The first step to this is an agreement between the Sunni factions opposed to both Assad and Daesh.
I note the progress towards that achieved in Riyadh. There has been a lot of speculation about those talks, so can the Foreign Secretary inform the House how the groups that were invited to attend the talks were selected? Did the UK make representations to the Saudis as to who should be invited? In particular, were key Kurdish groups such as the Syrian Democratic Forces and the Democratic Union party present at the talks?
It was reported that the Salafist group Ahrar al-Sham pulled out of the Riyadh talks last week and was opposed to any peace talks with Assad. It was later reported that it had signed the agreement, so will the Foreign Secretary confirm the correct position? That group has an estimated 20,000 fighters. Will he also confirm whether those 20,000 formed part of the 70,000 figure the Government cited as being moderate forces opposed to Assad and Daesh?
The key test for the Riyadh agreement will be whether it facilitates meaningful peace talks and a ceasefire, as outlined at the second Vienna conference. I am pleased that the Foreign Secretary is optimistic about the possibilities for these talks. Will he confirm whether, following the Riyadh agreement, the Syrian opposition will have a common position and a single representative at these talks, or whether there will be distinct factions represented at the talks?
The original timetable was for a possible cessation of hostilities to coincide with the start of peace talks from 1 January. Does the Foreign Secretary still think this is achievable? Was there a clear commitment to this timetable from all the parties present at the Syria talks in Paris on Monday?
With so many different parties to the Syrian civil war, maintaining a ceasefire will be extremely complex. Have the Government explored the possibility of a UN resolution reinforcing the outline agreement, including the ceasefire, agreed at the second Vienna conference? Can the Government confirm whether they will seek a UN resolution to support any agreement that is reached between Syrian opposition forces and Assad?
Finally, I want to return to the humanitarian response and the millions of refugees in tents this Christmas. In Lebanon, nearly one in four of the population is a recent refugee from Syria. Jordan is hosting more than 1 million Syrian refugees. Around 340,000 refugees have been resettled in Germany. Just this week we saw Canadian Prime Minister Justin Trudeau welcoming the first of 35,000 refugees to be resettled in Canada by next October. And I was pleased to hear in Prime Minister’s questions today that the 1,000 refugees the Government had promised to resettle will be here in the UK by Christmas.
I am grateful to the hon. Lady and she is right to highlight yet another recent example of Daesh’s cruelty. I do not think there is anything that this organisation is not capable of.
The hon. Lady asked about the focus of UK military activity. It is important that I emphasise that we do not do this independently as a national contingent. We are operating as part of a coalition. Our aircraft are assigned to CAOC—the combined air operations centre—which tasks them with whatever needs doing at the time, and this can literally be aircraft in the air being diverted to provide close air support to forces on the ground who are engaged in an action.
The hon. Lady asked about UK support for moderate forces. I am slightly confused by her question because the proposition put before this House two weeks ago was clear and narrow: it was about conducting airstrikes against Daesh in Syria. It was not about intervening in the civil war between the moderate opposition and regime forces. Different Members may have different views about the wisdom of taking such action, but at the moment we are very clear that that is not what the UK is engaged in doing.
I should also just clarify: the hon. Lady said I had said in my statement that there had been no civilian casualties. I cannot, of course, make that statement. What I said was that we have had no reports of civilian casualties arising from UK airstrikes.
The hon. Lady asked what steps we take to minimise the risk of casualties. The RAF has, of course, very strict rules of engagement—among the strictest of any air force in the world. The Defence Secretary explained to the House that he has created structures that give a high degree of direct control over targeting decisions, and we use standard NATO procedures for analysing battle damage and dealing with any allegations of civilian casualties or collateral damage.
I am grateful to the hon. Lady for her acknowledgement of the commitment of our 800 military personnel in theatre and her recognition of the sacrifice that their families in particular will be making this Christmas, spending it without their loved ones who are on active service.
Of course, this military action is part of a comprehensive strategy. I think we all understand in this House that we are not going to resolve this problem by military action alone. The Riyadh talks were an important step forward. It was the Saudi Arabians who brought the opposition together, using their convening power—the convening power of the King of Saudi Arabia as the guardian of the two holy mosques. No one else could have done that. What we have now is a new opposition grouping that includes a large number of representatives of the armed opposition on the ground, and it is a significantly more legitimate body than previous representatives of the opposition, which have tended to represent oppositionists who are outside the country and not directly engaged in the fighting.
In answer to the hon. Lady’s direct question: yes, the UK and other coalition partners provided the Saudis with lists of suggestions about who should be included. Ultimately, who was included in the invitation was their decision.
The hon. Lady asked me about the curious question of Ahrar al-Sham, and she is right to do so because there is a little ambiguity about its position. It attended the conference, it signed the declaration, but it did leave the conference before the end of it. But it has signed the declaration and we take it as bound by the commitments made in that declaration. For clarity, the figure of 70,000 opposition fighters that we have used does not include the Ahrar al-Sham forces. While not extremists like al-Nusra or Daesh, they are clearly not democrats in the sense that Free Syrian Army supporters are, so we do not include them in that figure.
The hon. Lady said I was optimistic about talks. I have to tell her that I am under no illusion that we still have a huge distance to go. We still have a chasm to bridge between ourselves on the one hand and the Russians and the Iranians on the other about the future of Bashar al-Assad, and that will be an issue for many of the oppositionists who are now engaging in this process.
In terms of Syrian opposition unity, the convening power of Saudi Arabia can do a great deal to deliver that. The conference last week was a great step forward, but I do not think anyone should imagine that there will not be disagreements within the Syrian opposition even as they confront the Syrian regime in face-to-face talks, and it will not be a single negotiator; a negotiating panel will be selected.
The hon. Lady asked about the ceasefire. It remains the clear intention of US Secretary of State John Kerry to try to get agreement on Friday in New York to a ceasefire. Frankly, that will be highly challenging, but I commend him for his ambition.
We are also holding this meeting on Friday in New York rather than Vienna specifically to be able to go immediately to the United Nations Security Council if it becomes clear during the morning that it is possible to reach an agreement that the Russians will not veto in the UN Security Council. So there is a possibility—I put it no higher than that—that Friday’s meeting will end with a UN Security Council resolution.
Finally, may I join the hon. Lady in commending the extraordinary effort and sacrifice of the people of Lebanon, Jordan and Turkey in providing refuge to so many of those fleeing the chaos in Syria, and taking this burden on unasked and without fanfare not just over the past few months, but for many, many years?

Commons ChamberI share the hon. Gentleman’s scepticism in this regard. Last Thursday I asked the Prime Minister whether he envisaged circumstances in which the Free Syrian Army and the Kurds would launch a successful ground offensive against Daesh, ignoring the presence of the Syrian army or pretending that it was not actually there. I did not receive a satisfactory answer.
It seems to me that a four-way civil war is taking place in Syria, and that some of those four sides are themselves quite complicated coalitions. If we are to develop a Daesh-first strategy, we shall need to persuade the other three sides to agree to co-ordinated action against Daesh. That is where the focus of diplomatic and political effort should be directed. I realise how difficult it will be. I realise that many of the groups that are associated with the Free Syrian Army, for example, would see Assad as more of an enemy than Daesh, and it will take a great deal of negotiation to bring all that together. It does not mean that all those groups must share a command structure, and it does not mean that they must share zones of operation—those can be separate—but any action must be co-ordinated. We cannot allow a situation in which some of them are simply trying to do what would be our bidding in a completely irrelevant and ineffective manner. That strikes me as a recipe for disaster.
The one hope in all this is the Vienna process, and the fact that a dialogue is under way. We believe that the time now should be spent in boosting that process, and in trying to secure the political and diplomatic agreements that we need for co-ordinated action that will be successful not just in bombing places into the stone age, but in taking control of land, starting with a military administration and then passing it over to civilian administrations month by month, year by year. Unless that framework is in place—and, unlike the Chairman of the Foreign Affairs Committee, for whom I have a great deal of respect, I remain to be convinced that it is—when the opportunity comes on Wednesday, the Scottish National party will not vote to go to war with Syria.
On a point of order, Madam Deputy Speaker. Further to the point of order that was raised earlier in the debate about the Prime Minister making a statement to the media without coming to the House, it appears from social media that the media have already been informed that we will be having a debate and vote on the issue of Syria in the House on Wednesday, immediately after Prime Minister’s Question Time. I wonder whether any Minister has had the courtesy to approach you, Madam Deputy Speaker, and explain that he or she would like to make an announcement to the House before briefing the press about when votes would take place.
I have not received any confirmation or otherwise from a Minister, but I have been in the Chair for the whole of this time. I think that the usual procedure would be for a Minister, or the Leader of the House, to make a supplementary business statement. We must wait to see whether that happens, but so far nothing has been confirmed or otherwise.
I congratulate the hon. Member for Bracknell (Dr Lee) and other Members who secured this timely debate. We know that we will be facing decisions on extending airstrikes into Syria in the coming days. At the start of our debate, the hon. Gentleman set out eloquently the complexities of the region and the many factors and issues that need to be considered when discussing the middle east. He also made a compelling case for the Government to draw up a comprehensive strategy on the middle east.
We have had a good debate and a long one, with 29 contributions and many more interventions, all of them making important points. I shall try to do justice to a few of those points in the short time available to me. Before I do so, I want to mention an hon. Member who is not here tonight—my hon. Friend the Member for Ilford South (Mike Gapes), an esteemed former Chair of the Foreign Affairs Committee, who was unfortunately taken ill in the past few days and is in hospital. I am sure all of us want to send our best wishes to him. I know he would very much like to have been here, taking part in the debate.
Understandably, the focus of the debate today has been mainly on Syria and the prospect of military action. I shall return to the subject of Syria, but first I want to mention the other important issues raised in the debate, which, as we recall, is on the “UK’s role in the Middle East”. It is unusual to have a debate on the middle east where Israel and Palestine are not the main focus, but we have had important contributions from the hon. Members for Strangford (Jim Shannon) and for Hornchurch and Upminster (Dame Angela Watkinson), my hon. Friend the Member for Hammersmith (Andy Slaughter), the right hon. Member for Clwyd West (Mr Jones), my hon. Friend the Member for Foyle (Mark Durkan) and the hon. Member for Twickenham (Dr Mathias) who all talked about how important Israel and Palestine are to the region.
We all know that there are no peace talks at present and there seems to be little prospect of a return to negotiations in the short term. I agree with the view expressed by the hon. Member for Edinburgh East (Tommy Sheppard), who speaks for the SNP: the Government need to do all they can to urge a return to the negotiating table. It falls on all politicians in all parts of the House to reach out to the leaders in both Israel and Palestine and ask them not to take steps that will make a return to negotiations harder to achieve. This means an end to blockade and occupation, and an end to rocket and terror attacks.
Yemen was mentioned in the contributions of my hon. Friend the Member for Hammersmith, the hon. Member for East Kilbride, Strathaven and Lesmahagow (Dr Cameron), the hon. Member for Charnwood (Edward Argar) and my right hon. Friend the Member for Leicester East (Keith Vaz), who chairs the all-party parliamentary group on Yemen. He reminded the House that Syria is not the only ongoing civil war in the region, nor is it the only conflict with an enormous humanitarian cost. The situation in Yemen is desperate, the death toll is rising and hundreds of thousands of people rely on humanitarian aid, which, as we heard, is becoming increasingly hard to get to those in need. I reiterate the Opposition’s call for an immediate return to the negotiations and for the UK Government to do all they can to encourage both sides to participate in the peace talks in Oman in good faith. It is also important that we have a full and impartial investigation into allegations that coalition forces broke international law during their operations in Yemen. The Secretary of State originally supported that proposal, but the Government appear to have U-turned, and I am still seeking an explanation for why.
We also heard contributions on Saudi Arabia from the hon. Members for Glasgow South (Stewart Malcolm McDonald), for Shrewsbury and Atcham (Daniel Kawczynski) and for Glenrothes (Peter Grant). They all pointed out that Saudi Arabia is a key player in the region and highlighted the important role it is playing in Yemen and Syria. My right hon. Friend the Leader of the Opposition has repeatedly and rightly raised the issue of human rights abuses in Saudi Arabia. It is of great concern to us all that there have already been 153 executions this year. We also need to work with the Saudis to ensure that we stop the flow of funding and support to ISIL/Daesh. Closing down the funding stream can be as important as military action, and we need the co-operation of the Saudis in that.
Iran was mentioned as another crucial regional player, particularly in the speeches of the hon. Members for Stratford-on-Avon (Nadhim Zahawi) and for South Ribble (Seema Kennedy). As a key backer of Assad, Iran will be crucial in enabling a political solution to the civil war in Syria, which is a prerequisite for any defeat of ISIL/Daesh. It was notable last week that the Prime Minister highlighted improved relations with Iran as a key reason for optimism on the prospects of a diplomatic breakthrough at the Vienna talks. Of course, that follows the vital nuclear deal agreed last year. Last week the House discussed the deal and the plans to lift sanctions. I would like to reiterate the comments of my right hon. Friend the Member for Wolverhampton South East (Mr McFadden), the shadow Europe Minister, in welcoming that agreement and congratulating all those who have strived to make it possible, including Baroness Ashton and Jack Straw, the former Member of this House.
We also heard an important contribution from the hon. Member for South Derbyshire (Heather Wheeler) about the persecution of Christians and other minorities in the region.
In the few minutes I have left I will turn to Syria. We heard many excellent contributions on the topic, and they all showed how Members of this House are reflecting on the very difficult and complex situation in Syria. We started with the great expertise of my hon. Friend the Member for Bridgend (Mrs Moon), who speaks with great knowledge as a member of the Defence Committee and as chair of the all-party group on the Royal Air Force. I do not have time to acknowledge all the important points that have been made, but it is clear that many Members on both sides of the House are still actively considering the Government’s case for extending bombing. It is also clear that Members are doing this in good faith and that we have the right to expect more information from the Government before being asked to vote on action.
I know that the Minister was limited in time when he spoke earlier, but he did respond to several of the points that were made. Unfortunately, he spoke half-way through the debate and other issues arose in the second half, and I know that he had to make many interventions to deal with those points. The Prime Minister waited several months to bring his case for extending action against ISIL/Daesh to the House, and I welcome the statement that he made last week, and the excellent Foreign Affairs Committee report that he responded to. However, I do not think that this is the end of the debate. There are several areas where the Government need to provide more detail, and a number of those points were raised again tonight.
For example, let us take the issue of ground troops, which was raised by the right hon. Member for Hitchin and Harpenden (Mr Lilley), the hon. Member for Isle of Wight (Mr Turner), my hon. Friend the Member for Hammersmith and the hon. Members for South Dorset (Richard Drax) and for Bolton West (Chris Green). Last week the Prime Minister gave a figure of 70,000 moderate opposition fighters, but he did not elaborate in detail on which groups those fighters represented, where they were located and what contact, if any, had been made with them. A Syria expert at the Brookings Institute, Charles Lister, supported the Government’s estimate of 70,000 fighters but disputed how moderate some of those groups really are. He also argued that to reach 70,000 fighters we would need to combine at least 10 groups that currently have different agendas and are dispersed across the country. Many are currently focusing their efforts on the battle with Assad. The Government need to explain in much greater detail how these forces are going to be used to defeat ISIL/Daesh and how their efforts will be co-ordinated with air strikes.
If the Prime Minister is serious about gaining consensus, as he has said repeatedly, he needs to ensure that there is an opportunity for a proper debate where all these points can be addressed. As now seems to have been announced on the BBC, we are likely to have a debate after Prime Minister’s Question Time on Wednesday and to be asked to vote on that day, despite the Leader of the Opposition having asked for two days so that everyone who wants to contribute and ask questions can be accommodated. As the Minister said, there is a duty to scrutinise, but there is also a duty on the Government to allow that scrutiny to take place. If they are serious about allowing a proper debate on a serious strategy to beat ISIL/Daesh in order to promote our own security and a peaceful future for the middle east, then we need that full and thorough scrutiny in this House before we vote. On that question, I hope that the Minister and the Prime Minister might think again and allow the extended debate that we need.

Commons ChamberHuman Rights Watch has documented 27 air strikes since 26 March that appear to have violated the laws of war in Yemen. On 11 November, the Foreign Secretary that he supported “proper investigations” into human rights violations from all sides in the Yemen conflict. Can the Minister therefore explain why the UK failed to support the Dutch at the last meeting of the UN Human Rights Council when they called for a credible investigation into these violations?
The hon. Lady raises important points. I met non-governmental organisations and had a round-table discussion on policy, and many of these issues were raised. As she states, there was an international discussion on this matter in that process. We have been wanting to encourage Saudi Arabia and other parties that are involved—it is not just the Saudis in this coalition, but 10 other countries—and we want these cases looked into efficiently and properly by the country itself.
