Lords ChamberMy Lords, the noble Earl is right about the particular challenges in relation to addiction. He will know that we have designated 83 areas that are receiving assistance in relation to rough sleeping, which helps with hostel spending. They include all of the London boroughs and all of our big cities. I will write to him so that we can share it more widely, and ensure that the list of money going to those local authorities is in that letter and is copied to the Library.
My Lords, today we have local government elections, so it is important to recognise that the £16 billion that has been lost in the reduction of core funding to local government since 2010 cannot be matched by the £100 million—welcome though it is—that the Government intend to spend centrally. That will not solve the problem of homelessness. What will solve it is our local authorities having sufficient funding to be able to reduce homelessness, as we did during the Labour years.
My Lords, I repeat to the noble Baroness that the ring-fence came off under the last Labour Government. She is right about reductions, but it is not simply about local government spending. A lot of spending has come from religious and faith institutions, which we are helping with—and I cited the example I saw yesterday. A lot of good work is going on in authorities up and down the country, with money being spent on, for example, hubs to help with homelessness in Brighton and Hove. It is also important to make this distinction: I was speaking about rough sleeping, not homelessness. Homelessness is a much broader issue, as the noble Baroness will know, and presents very different challenges from the issue of rough sleeping. The figures we have been looking at are largely on rough sleeping, not homelessness.

Lords ChamberI thank the Minister for repeating the Statement. Indeed, two days ago the second man this year died on our parliamentary doorstep. This man has a name: Gyula Remes, a 43 year-old Hungarian who will undoubtedly have a family somewhere in Hungary. Like me, many of your Lordships daily walk past the four or five men and women who have made Parliament’s doorstep their home. It is going to be their home for Christmas, they told me this morning. One of them is an ex-serviceman. Noble Lords who drive into Parliament must have noticed the increase in the number of people sleeping on the doorsteps in Westminster and witnessed the shame that this brings to us all. I suggest that noble Lords who do drive into Parliament might go outside and have a look at the tributes to Gyula.
Does the Minister know these fellow citizens on our doorstep? Has he spoken to them? I hope that when the Minister answers he will address the point that while the Government may have their rough sleepers plan, it is not working. What are this Government going to do about the fact that rough sleeping has doubled on their watch? That is from the Government’s figures, but Crisis says that they are a fivefold underestimate.
Does the Minister agree with his colleague Mr Brokenshire, who says in the newspapers that this explosion in rough sleeping is nothing to do with this Government’s policy, or will he acknowledge that this Government’s policies and priorities will have to change to deal with the shame that this homelessness brings to our rich nation? So many of our fellow citizens have no home and are exposed to danger: 600 deaths this year show a 24% increase in the number of deaths on our streets in the last five years. There is also the awfulness of sleeping in doorways at the entrance to our Parliament. How many more deaths will it take before the Government resolve this problem?
My Lords, I thank the noble Baroness for that contribution and, as she has done, I offer sincere condolences on behalf of the Government and the House to the family of Gyula Remes and his friends—I think he had many in this country as well as in his native Hungary. In answer to the noble Baroness, I do speak to homeless people, and not just in Westminster. She is right that it is a tragedy, but it is a tragedy everywhere—not just here but up and down the country—that this is happening.
However, we have to acknowledge that this is perhaps much more complex than the noble Baroness suggested. For example, from the figures that she has no doubt seen today—the first set of such figures; we never previously had ONS figures on this issue and we should welcome that we now have this analysis—we know they indicate that over a third of the deaths have drugs as an element. That is not to minimise the issue but to show that there are many aspects we need to grapple with. It is not just a question of providing funding without knowing where it is going. Many of the deaths are also related to suicide or alcohol; I think more than half involve those three elements. So while, yes, it is about ensuring that we get the figures down, it is, as I say, much more complex than she suggests.
I also pay tribute, particularly at this time of year, to the many third sector bodies and charities which help. St Mungo’s springs to mind, but many others are helping and we should knowledge the great role they play, as well as local authorities. I will highlight one thing in the Statement. In the other place the Secretary of State highlighted the £5 million fund for cold weather, which was announced in October. A lot of that funding is still not committed and local authorities can bid in for it. The Secretary of State will issue that message to them again today, but I encourage them to bid because there is money available, as well as the money we have announced in relation to the early adopters of the rough sleeping initiative.
Perhaps I could accentuate one other thing in answer to the noble Baroness, Lady Thornton, and for the benefit of the House. These figures do not relate just to rough sleeping; they are homelessness figures. It is where homelessness is featured on the death certificate, and some of those deaths will be people who have not been sleeping rough but have been in emergency accommodation, for example. So, again, it is perhaps a bit more complex than a first sight indicates.

To ask Her Majesty’s Government what action they will take in the wake of reports last week on BBC Northern Ireland concerning access to terminations for women in Northern Ireland who are carrying foetuses with severe abnormalities and wish to end their pregnancy.
My Lords, the Abortion Act 1967 does not extend to Northern Ireland, where abortion law is governed by the Offences Against the Person Act 1861. Constitutionally, abortion law in Northern Ireland is a transferred matter. It is therefore the responsibility of Northern Ireland Executive Ministers and so not a matter where Her Majesty’s Government have any powers to intervene.
I was hoping to have a slightly more hopeful Answer from the noble Baroness, but I thank her for what she said. I hope that she will join me in congratulating the Mary Stopes clinic, which, tomorrow, is marking the first anniversary of its operation in Belfast. I had hoped that she might refer to the review that is taking place about the issue. That review is welcome, but, until it is completed, would it not be fair for Northern Ireland women who need and want terminations under these very unhappy circumstances to have them provided free under the NHS elsewhere in the UK, where that provision is not illegal? Would the noble Baroness care to reflect on the issue raised about how women in one part of the UK are denied rights and access to terminations that are available to all other women in the UK? I recognise that devolution is devolution, but surely it was not intended to achieve this unsatisfactory outcome for women in Northern Ireland.
The noble Baroness will be aware that this case raises some very difficult issues and is very distressing. However, the current difference in legislation means that women travelling to England for an abortion generally make their own arrangements and fund the procedure themselves. To make exceptions to that would be a major departure from the system of residence-based responsibility and the separation of powers between the health services in the four jurisdictions of the UK. The noble Baroness will recognise that this is a sensitive issue that the previous Labour Government, when they were putting in place the devolution settlement, believed should be left to the people of Northern Ireland to decide for themselves.

Lords ChamberThe noble Lord sees things in a mirror glass world and he is entitled to look at them from that perspective. However, I invite him to consider what the impact on the sentiment would be in Wales if, having voted against the proposition that, say, the alternative vote system should be used, it was none the less to be imposed by the rest of the United Kingdom on the people of Wales. I think that that would create a grievance and that it would be an unhappy development. The amendment in the name of my noble friend is well worth the House meditating upon.
My Lords, I do not intend to address Amendments 12 or 15. The noble Lord, Lord Elystan-Morgan, spoke in the earlier debate on Amendment A1 moved by my noble friend Lord Rooker, and I follow his lead in saying that we do not intend to pursue these amendments.
My Lords, we have had another interesting debate on, as the noble Lord, Lord Lipsey, indicated, the difference between the amendments we are discussing here and those which were debated earlier. I only wish that the strength of the argument deployed by the noble Lord against thresholds had been sufficient to persuade everyone to abstention, even if I was unable to do that, but that did not happen.
The manuscript amendment from the noble Lord, Lord Grocott, which would mean that 25 per cent of the electorate would have to vote yes is a reflection of the amendment in the name of the noble Lord, Lord Davies of Stamford, which seeks that 33 per cent of the electorate should vote yes. We then have a straightforward 50 per cent eligibility to vote proposed by the noble Lord, Lord Grocott, and the amendment in the name of the noble Baroness, Lady Hayter, which the noble Lord, Lord Howarth, spoke to, regarding the individual constituent parts of the United Kingdom. I acknowledge also that the noble Baroness, Lady Thornton, did not speak to the amendment in her name and that of the noble Lord, Lord Elystan-Morgan.
I think the arguments against thresholds were put very eloquently by the noble Lord, Lord Lipsey, and are a cogent argument as to why the threshold-against turnout, particularly although not exclusively, does not necessarily lead to fairness compared with a straight situation where people are invited to vote and the majority wins. But the proposals that relate to a threshold that the yes vote has to reach are particularly pernicious. Earlier the noble Lord, Lord Lipsey, referred to the 40 per cent threshold that was imposed on the Scotland and Wales referendums in 1979. The Welsh referendum did not arise because there was a very strong no vote, but although 64 per cent of the electorate turned out in Scotland and a majority voted in favour of devolution, it was not implemented for another 20 years. It did not settle the question. It left, as the noble Lord, Lord Rooker, said earlier, a bad taste. Of all thresholds, it does not satisfy the electorate and particularly those who campaign and those who would seek a yes vote.
The amendment that the noble Lord, Lord Howarth, spoke to on behalf of the noble Baroness, Lady Hayter, would seek a requirement of a majority vote in England, Scotland, Wales and Northern Ireland, rather than a simple majority of all votes taken together. This is a UK-wide referendum on what the electoral system should be to elect the House of Commons in the United Kingdom Parliament. I believe it transcends particular localities or regions. The pros and cons of the system will be debated and considered by people regardless of where they live.
In Committee, the noble Lord, Lord Lipsey, uttered words of caution against this kind of amendment. He said that,
“to seek to set one nation within that kingdom against another kingdom is neither desirable nor wise”. [Official Report, 20/12/10; col. 827.]
The noble and learned Lord, Lord Falconer, rejected this type of amendment because,
“we should do everything to promote coherence in the United Kingdom. That means that, where we are voting on a national voting system, implementation of any referendum should be guided by what the national vote is”.—[Official Report, 20/12/10; cols. 843-4.]
If we were to find, for the sake of argument, that the rest of the United Kingdom—Wales, Northern Ireland and England—had substantially voted in favour of a change yet Scotland had a narrow majority against, it would be unacceptable that that one country with a narrow majority against should effectively exercise a veto over all other parts of the United Kingdom.
Noble Lords who have spoken to their amendments have indicated that they are not going to press them given the vote that was taken earlier. On that basis, I ask the noble Lord, Lord Davies of Stamford, to withdraw his amendment.

Lords ChamberMy Lords, this will be the first of several related discussions. We had a more substantive discussion on Monday about the challenges that having 3.5 million of our fellow citizens not registered to vote poses both for the Bill and for all of us. Today we will discuss some of the problems of individual groups of the population who are overrepresented in that 3.5 million.
I have spent a large part of my life working with young people. I have been a youth club leader and many years ago I worked in a young people's locked custodial establishment, which was known then as a remand home. I have worked in children's homes and, more recently, before I joined the then Government, I worked with and became a trustee of Action for Children. Dealing with many troubled and disadvantaged youngsters convinces me that the amendment is very important.
I also have a local interest as a citizen of Bradford. The Bradford metropolitan district population is set to grow by 27 per cent over the next 20 years, and 25 per cent of that growth will be among young people. At the moment, the Electoral Commission tells us that the electoral roll is inaccurate by a margin of 10 per cent, so if 10 per cent of people are not registered to vote, we have a huge challenge.
I am saying that I think it is more unjust to have the 2015 general election fought on the basis of data that were collected in 2000, not data that were collected in 2010. That would be the injustice. There are the people, to whom the noble Baroness referred, who signed up to the register during the last general election campaign. If we go into the next election on the basis of constituencies in which the electoral registration data for the year 2000 apply, we will miss out those people. There is also the completely different but related issue of trying to improve electoral registration, which we are very much committed to.
I thank the Minister for that, but it seems that he is completely happy to go ahead with the boundary-redrawing knowing that 3.5 million people are not on the register and that a large number of those will be young people. I think that is a shame. Actually, I think it is a disgrace. I do not want to delay indefinitely—
I just want to clarify whether the noble Baroness thinks that it is right that the next general election should use boundaries for which the data were collected in 2000, which will exclude anyone who became 18 since the year 2000.
The point that I was going on to make was that the Government need to get their finger out and get the registers up to date before they get on with the boundary-redrawing. That is what they need to do. I am not saying that we should not move ahead with this, but I cannot believe that the Minister can possibly be satisfied. There were indeed some extra voters on the register as a result of those measures—which, as I said, were positive—but even the Electoral Commission says that the electoral register is hopelessly out of date. Possibly millions are young voters, and I think it is very unsatisfactory that the Government think it is okay to proceed in that situation. I thank my noble friends Lady Hayter and Lord Howarth and my noble and learned friend Lord Falconer for their support.
This House has a great tradition of supporting young people. We have spent many months together over the years discussing how to improve the lot of disadvantaged young people in particular. We have protected their interests; we have promoted their interests. The amendment is about that. It is very unsatisfactory that the Government are not prepared to promote and protect the interests of those young people. Therefore, I would like to test the opinion of the House.

Lords ChamberMy Lords, I am going to use Bradford as my example as I think that it illustrates very well what my noble friend Lord Boateng has just described. I am very proud of my city and love it very much, and I want to put that on the record. On two or three occasions today and on Monday I have spoken about the challenges and problems that Bradford faces in this respect, and I want to make that completely clear. I am grateful to the Leader’s office for making available to me information which amply illustrates the issue that my noble friend has just described. For Bradford, you could substitute Birmingham, Leicester or Tower Hamlets. This is a very serious problem.
On two or three occasions the Minister has repeated the mantra of what the Government intend to do and how they intend to push forward, saying that we cannot go forward with a register that is 10 years out of date and so on. However, that is not what any of us are proposing. I shall come to that in a moment, possibly suggesting a solution. I do not think that what the Minister says will do, as this is a very serious problem in some parts of our towns and cities. Because I do not think that reading out figures in your Lordships’ House is necessarily helpful, I shall write to the Minister setting out what the figures would be if the Government’s proposals in the Bill were superimposed on Bradford. Bradford currently has five MPs representing all the different major parties, so this is not a party-political point. If the proposals in the Bill are applied to Bradford, we will lose a Member of Parliament, which would be very serious. We will go down from five Members of Parliament for our city to four if the proposal goes ahead. It will be on a very inaccurate electoral roll because Bradford has a growing population. As I said, it is expected to grow by 27 per cent over the next 20 years, which is the fastest in the whole Yorkshire region.
A quarter of that growth will be among young people, and we have already discussed the problem of young people not being represented on the electoral roll. We know that the Electoral Commission says that the figure is more than 50 per cent, and Bradford has a young population. The highest birth rates will be in the inner city and central Keighley, so Bradford West and Bradford East are likely to see significant increases in both population size and electorate. The Bradford district has the third highest proportion of BME residents outside London. Research done by the Electoral Commission suggests that there are low levels of voter registration among the BME population, which has been described very adequately by my noble friend. About 31 per cent are not registered and the Joseph Rowntree Foundation found that south Asian adults—particularly Muslims—are less likely to be registered than other groups.
This is not a specifically Bradford problem but it illustrates that there is a serious problem. I have two questions for the Minister. First, the shadow Justice Secretary in another place, Sadiq Khan, called for a delay of one year and an intense voter registration programme to be undertaken. Why is that not possible? Will the Government consider coming back on Report with such a proposal? That would go a long way to satisfying many of these issues. It would need resources, of course. Secondly, did the Government seek advice from the EHRC about this matter and the fact that such communities will find themselves disfranchised? That is very serious in a city like Bradford. I want Bradford to be a healthy, thriving city, and an important way for that to happen is for its citizens to be registered to vote and to participate in civic life and all our elections. I hope that this legislation will help them to do that. That is what we are asking for.
I sympathise with the concern expressed by the noble Lord, Lord Boateng. I live in Herne Hill, which is between Brixton, Peckham and Dulwich, and have done so for almost 40 years. I was the area organiser with the SDP when it was founded, so I have practical experience of the problem, which is a real one in any area where there are ethnic and religious minorities.
I think that the amendment is misconceived because it would place a block on the work of the Boundary Commission until the Secretary of State can certify,
“that particular action has been taken to maximise the proportion of black and minority ethnic British residents who are on the electoral register”.
One of the proud achievements of the previous Government, in which the noble Baroness, Lady Thornton, had a major role, was the enactment of the Equality Act 2010. That Act and the previous one empowered the Equality and Human Rights Commission to play a major public education role in promoting equality. The EHRC was given powerful, strategic roles in law enforcement and the power to deal with political parties that were too passive and which discriminated indirectly, as well as directly.
That body was set up and the Act gave power for positive action to be taken where there was underrepresentation—for example, of black voters—on the register. That should be the body—well funded and with those powers recently approved by Parliament—to deal with the matter. This should not clog up the work of the Boundary Commission. This work needs to go on right now; it needs to go on every year. If the Equality and Human Rights Commission does not do its job properly, it should be called to account by, among other people, Members of this House. It is not sensible to be holding up the work of the Boundary Commission for that to happen. That does not mean that I do not share the objectives; I simply disagree with the means.
My Lords, I think that we could legitimately ask why, in amendment after amendment from the Opposition, such efforts have been made to ensure that the next general election is fought on boundaries based on such an outdated electoral register. Perish the thought that those efforts are motivated in any way by thoughts of party-political advantage—I would not suggest that of the noble and learned Lord. Amendment after amendment has been designed to frustrate our attempts to ensure that the next general election is fought on boundaries that are determined by an electoral register that is far more up to date—by up to 10 years more—than the electoral register that would be used if the opposition amendments were agreed to.
Let me give the noble and learned Lord some reassurance. Whereas his proposals would mean that the 2020 general election would be fought on boundaries based on an electoral register for which the relevant compilation date would, if we allow one year, be 2011—I see the noble and learned Lord, Lord Falconer, nodding that that is his position—the Government’s position, and the position in the Bill, is that the relevant qualifying date for the electoral register that will be used for determining boundaries for the 2020 election will be December 2015. That will allow even more opportunity for the registration of young people, people in the private rented sector and people from black and minority-ethnic communities. In fact, we are going further than would be possible under the amendments that the Opposition have moved today.
Is the Minister saying that the 3.5 million people who are not on the register will need to wait for five or six years? Whether or not they are allowed to register, the fact is that those people are not currently on the register. Does he think that it is acceptable to make those people wait for five or six years before they can participate in our democracy? What is he saying?
I am beginning to wonder whether the noble Baroness understands what electoral registration is about. No one is being denied the opportunity to participate in our democracy by registering. The noble Baroness has suggested that, somehow or other, the Bill will disfranchise people. If people register to vote, they will have the opportunity to vote—although whether or not they in fact vote is a matter for them. I think that there is common ground on both sides of the Committee that we ought to encourage registration.
The proposal that has been made by the noble Baroness’s party is that we should use a relevant qualifying date of 2011, which would mean that the 2015 election boundaries would be fought on data dating back to 2000. I am indicating that we can go better than that. Rather than require that the 2020 election be based on data from December 2011, the Bill will mean that we will use data from December 2015. I very much hope that, during that period, we will have made the kinds of steps forward that have been called for from all sides.

Lords ChamberMy Lords, can a local authority or the Electoral Commission speak with accuracy regarding steps being taken by a local authority? The amendment says that,
“every local authority has taken all reasonable steps to ensure that the electoral register is as complete and accurate as possible”.
That does not mean that it has to be so exact that, as in the days when I was in engineering, you have to be half a thou within your measurement. The amendment says “all reasonable steps”.
I know through experience that the Electoral Commission is a well resourced body. I do not know whether the noble Lord, Lord Tyler, had this experience, but it even said that it wanted copyright for a teaching pack to teach returning officers how to carry out their duties. That is the extent to which the Electoral Commission goes into these matters.
Talking about accuracy, my thoughts go back to the days when Strathclyde region was on the go and the famous poll tax was a big worry for every Member of Parliament in the west of Scotland. Strathclyde region took in the whole of the west of Scotland. People were deliberately staying off the electoral register. It was not a case of the man or woman of the house coming to the door and forgetting to say that one of the sons was working offshore but was resident in the household and therefore the canvass could be inaccurate to one person in a family because of the wrong information. This was particularly single people making sure that they stayed off the register to avoid the poll tax. It used to be called the community charge. That was a nice phrase. We called it the poll tax because that was what it was.
Mr James Woods was put in charge of electoral registration for the whole of Strathclyde. All the Members of Parliament for Strathclyde met him and said that the voters roll would be inaccurate. When it came to appeals and the Boundary Commission, a big matter would be the number of people on the electoral roll. He told us all, “Here is what I’ve done. Come and visit my department. I do a canvass and then I do a second canvass and if we suspect that there are people who are taking their names off the electoral roll, we make inquiries”.
There was also the question of people having two homes. Sometimes a wife would register in one home and a husband in the other to avoid a double poll tax. Mr Woods assured us that he was putting a high and accurate return on to the electoral register. It would be reasonable for the Electoral Commission to interview someone such as Mr Woods and ask, “What are you doing? What facilities have you got? We want to visit your premises and see what you are doing”. That would be good enough to give a certificate.
It must be remembered that people used to speak with fondness about a local authority called Saltcoats down on the Ayrshire coast which had the cheapest rents in Scotland—the reason being that it had no direct works department and was a small local authority. The local authority was so small it would even meet if it had to hire a foreman gardener. Local authorities such as that are no longer with us. Local government has been streamlined. There is often a criticism that some chief executives in local government get paid more than the Prime Minister of the day because of their large responsibilities. I do not wish to go into that as I would stray from the amendment but all local authorities that I know of in the United Kingdom and Northern Ireland would be well able to hire a highly competent electoral registration officer who could easily convince the Electoral Commission to give the local authority a certificate to say that it is working to ensure an accurate register. If the Government had a worry about the Electoral Commission, it need not be the Electoral Commission but someone else. The noble and learned Lord, Lord Wallace, mentioned certification; certification is given to shipping, factories and other bodies.
This is my first intervention in the Bill. I am pleased to join my happy band of colleagues to, I hope, help with the discussions. I want to get involved in the issue of voter registration in this part of the Bill because of my work with young people, particularly excluded ones, in a variety of charities and also because I am from Bradford. My title is Baroness Thornton, of Manningham. I suspect that Manningham in Bradford probably has one of the lowest records of voter registration in the whole of our city, for reasons that we will discuss in the next series of amendments.
We know that those who are absent from the registers are likely to be drawn from the same social groups as under-registered voters in previous decades. This is not a new issue. Variations in registration levels by age, social class and ethnicity have long been recognised and it is predominately densely populated urban areas with significant concentrations of mobile young people that have the highest levels of under-registration. That is why I, along with other noble Lords, support amendments pressing our concerns for different groups of our fellow citizens.
The Electoral Commission’s March 2010 report The Completeness and Accuracy of Electoral Registers in Great Britain highlights that matter. The report states that,
“there are some grounds to suggest that geographical variations in registration levels may have widened since the late 1990s. Available data sources suggest that registration rates in London appear to have stabilised, and may even have improved slightly, since the late 1990s. By contrast, English metropolitan districts appear to have experienced a clear fall in registration levels. Canvass response rates show a similar pattern. In 1996, the average canvass response rates for metropolitan districts were 93%, significantly higher than the 87% achieved by the average London borough. However, by 2004 the average response rate among London boroughs had risen slightly to 89%, while it had fallen to 84% in the English metropolitan districts. Despite improved response rates among metropolitan districts in 2008, the 90% average remained just below the 91% figure achieved by London boroughs”.
As my noble and learned friend Lord Falconer said, if the electoral roll is to be frozen as at 2010, how much more inaccurate will it be in those areas of the greatest vulnerability by 2015? We know that more than 3 million people are not on the electoral roll. How many more voters would the coalition Government find it acceptable not to appear on the electoral roll by 2015? I think that the Minister needs to answer those questions, given that millions of people—young people, ethnic minorities and people who live in rented accommodation in areas of high density—will in effect be disfranchised by the Government’s proposals.
Our amendment suggests, quite reasonably I think, that the Electoral Commission should ensure that the local authorities that have responsibility for the canvasses that produce the electoral roll should do their job as effectively and as efficiently as possible. I cannot see what is unreasonable about that. Indeed, our suggestion seems entirely proper, so I am surprised to hear that the noble Lord, Lord Tyler, has a problem with it, as I cannot think what that problem would be. We need to get those 3.5 million people back on our electoral rolls and then—although, as my noble friend said, this is a different matter—to consider voting. I support Amendment 54A and I hope that the Government will do so as well.
My Lords, I rise to speak on the role of the Electoral Commission, in which I, the noble Lord, Lord Tyler, and others are involved. I apologise first to my noble and learned friend Lord Falconer for missing the opening phrases of his speech, but I know very well what his amendment is about and have considerable sympathy for it—indeed, I fully support it—as it deals with an important issue.
Of the two things that I want to say, the first relates to the Electoral Commission. When I have spoken on previous occasions when we have considered the Bill, I have not mentioned that I am a representative on the Electoral Commission’s parliamentary advisory group, which includes Members of both Houses and all parties. The parliamentary advisory group offers advice on the Electoral Commission’s proposals and the Electoral Commission listens to our comments.
Given that a number of problems with registration need to be looked at, there is certainly a case for having a debate—although perhaps not at this stage—on the role and powers of the Electoral Commission. The commission performs an important job, for which, as the noble Lord, Lord Martin, pointed out, it is also well resourced. However, I think that the noble Lord would agree with me that one problem is the lack of real clarity on the commission’s powers to investigate and to make strong recommendations on the effectiveness of local authority registration processes. Various members of the Electoral Commission frequently mention—and the Members from the political parties who attend the parliamentary advisory group recognise—that, although the commission can try to persuade local authorities to drive up registration levels, it does not have the power to say, “This is not good enough, so we will not certify you”. Without that power, as I think was pointed out by the noble Lord, Lord Martin, the local authorities ultimately do not need to try that hard.
As my noble and learned friend Lord Falconer and others have pointed out, we should all be able to agree that registration levels in this country could and should be far better. The current levels are not good enough. Indeed, my noble friend Lady Thornton quoted the Electoral Commission’s March 2010 report, which makes the point—this is true—that registration levels in London went up and then stabilised but appear to have gone down in other areas.
