My Lords, I want to say a few words because, very unusually, I want to express a different view from that of my noble friend Lord Pannick, the noble Viscount, Lord Hailsham, and my noble friend Lady Deech.

Having taken part in the debates about Lord Lester, I of course recognise that when the House has the responsibility of reaching a verdict on the conduct of one of its own staff or Members and on any sanctions attaching thereto, it is vulnerable to the appearance of conflicts of interest. Quite understandably, this debate has concentrated on the subjects of bullying, harassment and sexual misconduct, which come into the code of conduct for the first time. But we have to remember that the code of conduct is hugely about other matters, not just those three; in fact, paragraphs 10 to 106 are about other matters that reflect the rules of the House.

Breaches of the code of conduct, including those in the future relating to bullying, harassment or sexual misconduct, will often be breaches of the criminal law. In those cases, it is obviously right that the inquiry should be entirely independent. It should be carried out by the police, have lawyers on each side and be subject to the courts of law.

In this case, even with our distaste for bullying, harassment and sexual misconduct, we are talking about something short of breaches of the criminal law. We are talking about the rules of the House. It seems anomalous that, in a self-regulating House, the ultimate decision on those breaches and the sanctions that attach to them should not be a matter for the House itself. I therefore agree with the report, which introduces a procedure in which there is an independent investigation and a committee with a significant element of independent members, but the discipline committee is chaired by a Member of the House and has a small majority of Members of the House on it. When we are talking about the rules of this body, like any other institution, it should ultimately be for this body to decide whether those rules have been broken and what sanctions should attach to it.

I welcome the respects in which the report makes changes. I welcome that it brings in bullying and sexual harassment, and I support the other changes, including the widening of the code of conduct to parliamentary activities, not just parliamentary duties. As I have said, I believe it is right that the discipline committee should have a small majority from the House because that seems consistent with a self-governing House. I also welcome the encouragement to the commissioner to call upon the support of teams of independent investigators to help establish the facts; in the case of Lord Lester, I felt that aspects of the way in which the commissioner carried out her investigation were defective.

One aspect of the report gives me pause—here, I follow the noble Lord, Lord Thomas of Gresford—and that is the proposed change to Standing Orders so that a report of the discipline committee is put to a vote of the House without debate. I see the dilemma here. On the one hand, like others, I am anxious to avoid the House getting involved in distasteful debates and votes, as in the case of Lord Lester. On the other hand, it seems that to vote on a question without any opportunity for debate is to go through the formality of obtaining the House’s assent without any reality in the substance; it is, to coin a phrase, “a meaningless vote”. Therefore, like the noble Lord, Lord Thomas of Gresford, I would prefer that the report of the disciplinary committee be subject to a take-note decision and not to a vote without debate.

My Lords, I welcome the report. I see it as an important step forward. It is right that a new committee is established and I support that committee including lay members. Whether or not there should be more lay or independent members in due course is a topic for further consideration. I am not sure I support those noble Lords who have argued for complete independence for the disciplinary regime of this House, because it is an important responsibility for us as Members to uphold the House’s reputation by being prepared to take appropriate action when one of us does something wrong. As the noble Lord, Lord Butler, said, it would be a mistake for us to completely delegate responsibility for that to an independent body.

Paragraph 24 of the report mentions a disrepute clause. My position on this does not lend itself to the debate on investigation versus inquisition but, since the report refers to disrepute, I want to take the opportunity to highlight why I think it is important for us as a House to understand that we carry a reputational risk at the moment. If a Member’s misconduct outside this House is so serious that their continuing membership would bring the House as a whole into disrepute, currently we are powerless to act. This is compounded because, being an unelected House, we are powerless to act if a Member in such a situation does not resign. I am talking about disrepute in a way which refers to something happening outside a Member’s parliamentary responsibilities and activities—in another part of their life—but which is extremely serious and becomes public. If that person continued to be a Member of this House, it would bring the whole House into disrepute.

When I was Leader of your Lordships’ House, I spent about a year working on a disrepute clause and was assisted by several noble and learned Lords. This work was presented to the Privileges and Conduct Committee and was accepted by the committee at that time, but it never made it to the Floor of the House. It has remained in abeyance ever since. When making her argument about the need to specify what might constitute disrepute, the noble Baroness, Lady Deech, indicated, as does the report, that it is too difficult to define what would be captured by such a clause—I believe this is one of the reasons why this measure has never become part of our disciplinary actions. However, that somewhat misses the point. We should never have to define what would be caught by such a power. We need to understand that if and when something so serious occurs, we would have the power to act in the way the public expect, precisely because the public do not have the power to act themselves.

I just wanted to note the fact that there is reference to disrepute in the report and that I hope very much that when the new committee is established it will consider this as part of its overall work plan, to strengthen our disciplinary regime.

My Lords, will the noble Baroness confirm that the UK’s departure from the EU will not become final until our negotiations over the next two years are complete? Since the terms of our departure will only be known then, will it not be the duty of the Government to give the people a chance to take an informed view on those terms before the UK’s departure becomes final?

It sounds as if the noble Lord is trying to suggest a second referendum at a later point. This has been a once-in-a-generation decision. The people of this country have been clear. When we trigger Article 50 the clock on the two-year process will start. The Prime Minister has not triggered it now because he believes that it is right that when going into that process the Government are clear on what kind of relationship they want with the European Union in future. That is why he is not doing so himself but is leaving it to his successor.

My Lords, the House of Lords Appointments Commission does an effective job in recommending candidates for non-party peerages and vetting the propriety of all those nominated as life Peers. There are no plans to amend its remit.

My Lords, I ask this Question on behalf of my noble friend Lady Boothroyd because she is having to spend a few days in hospital. I am sure that the whole House will want to wish her well.

The last triennial review of the House of Lords Appointments Commission took place in 2013. Is the next triennial review not now due? Is it not necessary to increase the powers of the House of Lords Appointments Commission in view of the widespread concern at the Prime Minister’s use of his unlimited powers of patronage in making appointments to this House?

My Lords, I echo the noble Lord’s remarks wishing the noble Baroness, Lady Boothroyd, a speedy recovery. On the Question he raised, the House of Lords Appointments Commission does indeed play a very important part in vetting all nominees and recommending excellent candidates for the Cross Benches, but it is the political parties that must be accountable for the Members who sit on the political Benches. That is an important principle that should continue. It is also important that we maintain appointment to the Cross Benches, as well as to the political Benches. That is why the Prime Minister appointed 10 Peers to the Cross Benches in the last Parliament, alongside those appointed independently through the HOLAC process.

My Lords, will the Leader agree with me that, for many years now, there has been dissatisfaction in all parts of the House with the binary choice that is open to us for either accepting or rejecting statutory instruments? Will she also agree that it is relevant that the procedure recommended by the noble Lord, Lord Strathclyde, is very similar to that which was recommended by the all-party royal commission under the noble Lord, Lord Wakeham, by the Leader’s Group in 2011 and by the Hansard Society and others? It would therefore be unfortunate if the circumstances in which this issue has arisen were to close people’s minds to positive consideration of the procedure that the noble Lord, Lord Strathclyde, has recommended.

I am hugely grateful to the noble Lord for that very important contribution. My noble friend has drawn on some of the extensive work done over the past decade or more by the commission chaired by my noble friend Lord Wakeham. The noble Lord, Lord Butler, is right; my noble friend Lord Strathclyde has come forward with a recommendation that deserves proper consideration, and I really hope that that is what this House will give it.

My Lords, it is important to clarify what I said. When I repeated the Statement, I made the point, which I stand by now because it is still the case, that, procedurally, this House is not affected by the changes being proposed by the Government to amend Standing Orders in the other place. When I said at the time of repeating the Statement that I did not feel it was necessary to provide time for further debate, I did so because at that time the House of Commons was planning to proceed quite quickly to debate and decide the amendments to its Standing Orders. However, given that the House of Commons has decided to take a bit more time over this, I felt that there was therefore an opportunity for us to debate it. However, if it had stuck with its original timetable, my original position would have remained the same.

My Lords, the noble Baroness appears to be saying that she does not recognise that there are constitutional implications on which this House should have a debate, but I thought that she had accepted that.

I am so sorry. The Government are proposing to introduce changes now and to review the implementation of these changes in a year’s time, so of course there will be an opportunity for us to contribute to that process and consider the implications of the implementation of these changes. That is what I said at the time of repeating the Statement, and that is what I say now. My main point now is that there is no way of finding a perfect solution through continuing to debate the issue. What we have now is a good way forward that should be implemented, tested, debated and reviewed in a year’s time.

My Lords, I will not detain the House longer. As the noble Lords, Lord Cormack and Lord Reid, said, we cannot, of course, compel another place to set up a Joint Committee. However, what we can do today is to say that we believe that this is a matter for Parliament as a whole, not just for the House of Commons, and that it is best approached by Parliament as a whole through a Joint Committee of both Houses. I wish to seek the opinion of the House.

My Lords, on a point of clarity with regard to the first issue of the Joint Committee of the Lords and Commons, my understanding, from all the conversations I have had with the noble Baroness the Leader of the House, is that there will be completely equal representation between both Houses. I think that she has heard the mood of the House—that is what this House expects. I think she said that that was likely, but she did not give the guarantee that the House is seeking. Can I therefore press her, because that is my understanding of the present situation anyway, to give a guarantee that there will be equal representation between both Houses?

On the noble Baroness’s second point, in which she responded to my noble friend Lord Grocott, as much as we welcome the QSD in the name of the noble Lord, Lord Butler, next week on 16 July, that does not replace the need for a proper debate on the proposals for English votes for English laws, which impact on the work of your Lordships’ House. It is all very well for the noble Baroness to say, “We are not affected by it”, but we are. It affects how legislation is conducted in Parliament, and we are part of that process. I know that when she responded to the debate on the Statement the Government made last week she rejected the notion, but she will have heard that noble Lords across the House are very concerned at the lack of debate in this House on that issue, and I urge her to reconsider. It is the view of the Official Opposition and, I think, of other noble Lords around this House, that there should be a full debate, perhaps on a Motion that can be divided on as well. To deny this House the opportunity to debate this in government time is totally unacceptable.

Further to the point made by the Leader of the Opposition, I understand that in another place the Government have decided not to go ahead with the changes to Standing Orders next week but to have a two-day debate on them. Does that not strengthen the case for there also being a full debate in this House, in addition to the Question for Short Debate?

Coming back to the topic of this Motion, I make it clear to the noble Baroness and to the House that it has been my view that the membership of the restoration and renewal Joint Committee should be equal in numbers and in approach in terms of this House and the other place. I am just waiting for the House of Commons to confirm its approach before we finalise our own because I am trying to achieve exactly that aim—making sure that there is a proper balance in the way that the Joint Committee is formed. I hope that that gives the noble Baroness and the House the assurance that they are looking for. Therefore, we will be equally represented in number, and I might even suggest to your Lordships that the team of members from this House will be more powerful and more authoritative, because, quite frankly, that is what I think we are.

I note what the noble Lord, Lord Butler, said about the decision in the House of Commons regarding English votes for English laws, but I say to him, as I say to the noble Baroness and to the House as a whole, that the House of Commons is debating changes to its Standing Orders.

I am very grateful to my noble friend. He described exactly the issue that we are trying to address here. At the moment, a lot of people who live in England feel it is unfair that Scottish Members of Parliament are able to contribute to decisions on matters that affect only people in England. That is what we are trying to address with our pragmatic and proportionate approach to giving MPs in England a stronger voice.

My Lords, I, like the noble Lord, Lord Baker, welcome the fact that the Government are grasping the nettle of the West Lothian question. If the result of the election had been a Labour Government with a Conservative majority in England, this question would have become very urgent. As things are, with a Conservative overall majority in the House of Commons and a Conservative majority in England, there is not the same urgency about it, and there should at least be time to have a thorough debate about the Government’s proposals.

The noble Baroness said that the result of these proposals is that the majority in the House of Commons will not have a decisive say on only English and Welsh questions over English and Welsh Members, and vice versa, but surely that is not correct. As things stand in these proposals, the English and Welsh Members of the House of Commons will have a veto in the House as a whole on Bills that affect only England and Wales. The Conservative Democracy Task Force, which I advised in 2008, proposed an alternative way of dealing with this, which was that on England and Wales-only Bills, English and Welsh MPs should be able to vote on amendments but the House as a whole should have a vote on the Third Reading, thus preserving the supremacy of the House of Commons overall. Would that not be an equally effective but also simpler and less divisive way of dealing with this question than the proposal for an English and Welsh veto, which seems to be both provocative and possibly unconstitutional?

I shall try to explain why I do not quite accept what the noble Lord has said. First, once an England-only Bill or a Bill with provisions for England and Wales gets through its Report stage, there will be a grand committee where the relevant MPs from England or England and Wales consider what was agreed on Report. If the English and Welsh MPs do not accept what the House wishes to do and the matters concerned affect only their constituencies, they will have the option of disagreeing. However, there will be a process whereby the whole House will then reconsider the legislation. The point is that these two groups of MPs will be seeking to reach agreement. If agreement cannot be reached between the relevant MPs and the House as a whole, the matter will fall. However, this is about agreement or consent. It is not about having a veto; it is about trying to find the right way forward.

I say to those who are concerned about whether Members from Scotland will have a proper role in this process that this is designed to ensure that they continue to be included, as they should be, in matters that are considered in the UK Parliament. Therefore, I do not accept the description that the noble Lord has given.

My Lords, I am grateful to the noble Lord, Lord Dear. In introducing his amendment he reminded us again that we should try to ensure that we are tolerant, generous and courteous, not only in our debates in this House but also in the legislation that we are bringing forward. I argue that we are doing just that. The noble Baroness, Lady Royall, just quoted something I said at an earlier stage. The Government are very clear that the Bill does not only allow same-sex couples to marry; it also protects religious freedom and ensures that no belief that anyone holds now is affected by the introduction of this Bill. As I said at earlier stages, we are clear that the belief that marriage should be of one man with one woman is protected under the Equality Act 2010. It meets the established criteria set out in case law.

The noble Lord, Lord Dear, referred to the case of Grainger plc v Nicholson, which specifically included beliefs worthy of respect in a democratic society. Equally, Article 9 of the European Convention on Human Rights guarantees that everyone has the right to freedom of thought, conscience and religion. This means that everyone has an absolute right to hold any belief. However, of course the right to manifest one’s belief is qualified, and the state can regulate that in certain circumstances where that is necessary for the protection of the rights and freedoms of others. As I have made clear, it is perfectly possible for somebody to not only have that legitimate belief but also to be free to express that belief. To follow up on the exchange that just took place between my noble friend, Baroness Knight, and the noble Baroness, Lady Royall, the difference is that what is not possible is for somebody to withhold their services because of the belief they hold. There is nothing to stop them from having that belief. The amendment is therefore unnecessary. It states something that is entirely true—that the Bill does nothing to undermine the principle that a belief that marriage is,

“union of one man and one woman for life to the exclusion of all others is a belief worthy of respect in a democratic society”.

Of course it is, and this Bill raises no doubt about it.

As has been pointed out, the view that a marriage of a same-sex couple, like the marriage of an opposite-sex couple, is a valid marriage is also a belief worthy of respect in a democratic society. As was said by the noble Baroness, Lady Royall, and my noble friend Lord Deben, if we are going to state that the one belief is worthy of respect, we ought to state that both are worthy of respect. As it stands, this amendment suggests that a belief of the kind it covers, concerning marriage between a man and a woman, is in some way superior to a belief that marriage of a same-sex couple exclusively and for life is to be welcomed as an equally valid relationship. Therefore the amendment goes against the entire point of the Bill.

I also caution the House on a further point of principle. We risk getting into rather dangerous territory if we start to set out in statute which beliefs are worthy of respect or protection in law. It may seem easy here, where there is absolutely no doubt that the belief concerned is mainstream and uncontroversial, but it would not be wise for legislation to list beliefs, just as we do not list religions. Otherwise we get into the arena of state-sponsored religions and beliefs. It would also be an impossible task to list all religions and beliefs that are protected, which would cast doubt about whether unlisted beliefs are protected. That point was made in this debate by some noble Lords who are lawyers.

I now touch on Amendments 5 and 6, put forward by my noble friend Lord Cormack. I will go not into detail, because they do not affect the fundamental point I am making, which is that these amendments are unnecessary. They risk creating the suggestion that a belief in the validity of the marriage of same-sex couples is to some extent less worthy than a belief that marriage should be of one man with one woman. As I have explained, it would be most unwise to seek to legislate for what is or is not a belief worthy of respect.

All that said, and just to be absolutely clear, of course none of that means that it is not absolutely legitimate for people to hold the view that a marriage should be between a man and a woman, and for them to be able to express that view. I have stated that many times and I will continue to do so, because it is such an important part of what we are ensuring will remain the case when, as we hope, the Bill becomes an Act of Parliament.

My Lords, it would greatly reassure me if the Minister were to give an absolute assurance that somebody who says that they believe that marriage is the voluntary union of one man and one woman for life to the exclusion of all others is not in any danger of being charged with making a homophobic remark.

I can give your Lordships absolute, categorical reassurance that anybody who expresses that view is being absolutely lawful. What I cannot give the noble Lord categorical assurance on, which is something that we debated at length at earlier stages of the Bill, is that there may not be somebody out there who decides to try to take action against them. If they were to do that, the law would protect them, because the view that the noble Lord has just expressed is absolutely lawful. It is legitimate, and they can hold that belief and express it. Clearly, as noble friends who are lawyers have reminded me before, whenever a judge hears a case he has to take in all manner of different contexts in order to consider the way in which those words are expressed. But I believe that I can give the noble Lord the reassurance that he is looking for on that point.
