My Lords, what a pleasure to follow the noble Lord, Lord Lipsey, with whom I agree. I felt that the Minister’s opening remarks were so full of mistakes that I shall go through them tomorrow in Hansard with a red pen and pass them back to him, if that is all right, so he can see exactly where I think he went wrong.

It was expected that the other place would take out all our important amendments, but at the same time you have to say that it was not the move of a democratically minded Government but that of an authoritarian, tyrannical one. This Government are choosing tyranny over democracy in this instance. We now have the job of revising the Bill again. As the noble Lord, Lord Lipsey, said, the British public are actually kinder and more concerned than this Government. The Government do not represent the public any more, and it is time they went.

My Lords, I am not a fan of the Bill but I think it is time for it to pass.

I want to respond to the noble Lord, Lord Lipsey, who asked if it is always right that the elected House must prevail. The truth is that the elected House must prevail and that yes, that is always right. We are an unelected House. We have a job to do, but at some point it has to be the elected House that decides in a democratic society.

I want to comment on the remarks made about compassion. I too disapproved of Members of the other place who tried to suggest that anyone arguing against the Bill lacked compassion. That is a ridiculous accusation and does not hold. However, I also make the point that the inference in reply—that anyone who is trying to push the Bill at this point lacks compassion—is equally low politically. It is irritating to have a situation where people start to try to compete with each other in the kindness stakes. The big political issue is that this country has lost control of its border and the asylum system is not fit for purpose. This Bill—not one that I support—is trying to tackle that. No one is doing it because they are lacking in compassion.

There are double standards here. I have heard that anyone who supports this Bill must be verging not just on the right but on the far right, does not care about anyone crossing in the boats and is actually a racist. I have heard that said by people active in political life. I ask that, for the remainder of the discussion that we have, we take each other seriously enough not just to dole out insults but to say that, if we are genuinely committed to tackling the problem of border control, this is the Bill that is on the table now and has been accepted by the House of Commons a second time, and, even if we disagree with it, we have to go along with it.

As for the people who have argued that this was not in the manifesto, the suggestion that there is no public concern about control of the borders has no finger on the pulse of any public. However, it is true that there will be elections shortly. It seems to me that people who feel strongly that this is the worst piece of legislation ever passed will stand on that in their manifesto and will commit, here and now, to overturning the Bill once it goes through. Then we will see where the votes lie and, if the Opposition become the Government, whether they stick with that and tear up the Bill. Fair dos if they do.

My Lords, I support all the amendments in this group. I am interested in verbal harm because it is true that, as politicians, we get a lot of that. I have had verbal abuse from that Front Bench, in fact, but I am old enough that it has not affected my behaviour.

Amendments 5 and 6 are quite crucial here, as is Amendment 10 on child criminal exploitation. On top of all the important points made by noble Lords here about child victims, I want to ask the Minister about the Government’s role in re-victimising children and young people by deploying them as covert human intelligence sources or child spies. I have raised this issue a few times over the past few years. It is still a practice that absolutely horrifies me—that the Government would actually encourage the further criminalisation of children. In recent years, the Government have actually expanded the use of child spies, including authorising them to commit criminal offences. I do not expect the Minister to answer this this evening, but I would like a full answer, because this is an issue that fills me with horror.

The Government’s actions obviously meet the definition of child criminal exploitation in Amendment 10, as these children are being

“encouraged, expected or required to take part”

in criminal offences by the police. Can the Minister therefore outline what victim support and other help is provided to these child spies when they are being sent back into dangerous criminal situations? Will they be eligible as victims under the victims’ code—I assume they will—and can the Minister give up-to-date figures on how many child spies are currently being used by police forces? I have been consistently told that it is a very small number. In my view, any number is wrong, but if I could have that information, I would be very grateful.

My Lords, I was quite surprised to see the amendments, and also the way they have been motivated—by the need to get children in the Bill, as though there were a lack of sympathy with children as victims, particularly of sexual abuse. That is not something that I am aware of in society, which seems to me to be more than preoccupied with that issue, and rightly so.

If anything, as the right reverend Prelate the Bishop of Manchester made clear, it depends which children you are talking about, because one of the shocking aspects of the Rochdale grooming scandal was that a particular group of children were seen to be the wrong kind of children—in the words of the perpetrators, “white trash”. If you read the many reports on this, as I have done, even the officialdom—the police, local authorities, social workers and all sorts of things—saw these children as perpetrators who could be ignored. In general, society is horrified, it seems to me, at child abuse, but it depends which children. I did not know that we needed to get the idea of children as victims on the face of this kind of Bill in order to be sympathetic to children as victims, so I am a bit confused about the necessity of that. However, I am open to being convinced.

As it happens, I completely agree with the horror of the noble Baroness, Lady Jones of Moulsecoomb, at child spies, and I share that point of view as well. But she does raise a problem that I have with Amendment 10, inasmuch as I think it is unclear what the definition of “child criminal exploitation” would be. Where it says that

“a child under the age of 18 is encouraged, expected or required to take part in any activity that constitutes a criminal offence”,

first, there would be an argument about those child spies. Other people would presumably say that that was not what was happening there.

But there is a danger, particularly when we use that wording: “encouraged, expected or required” is very loose in terms of problems we might well have with agency of young people. We have already heard about anti-social behaviour; often that is committed by under-18s. Knife crime is often committed by under-18s. There is a danger that, in our attempt at fighting genuine exploitation of children to force them into criminal activity, we end up in a situation whereby young people, who I am afraid can on occasion be responsible for crimes, are able to say that they did not do it because they were encouraged or put under pressure and so on. I am just worried about the wording there.

Finally in this group—and this is not something I like doing, because I have enormous respect for the noble Lord, Lord Hunt—I absolutely disagree with his Amendment 9 on verbal harm. One thing that is quite interesting is this idea that we have to make young people—or everybody—aware of the dangers of verbal harm. The one group of people who are very aware of the dangers of verbal harm are young people and children because they are reared in a society that tells them that words are harmful. They are so embroiled in that notion that, as we know, they will say that they are victims because of words that have been said to them. We see this played out in schools, sixth forms and universities all the time, to the detriment of free speech.

People might think that is glib, but I am constantly involved in arguing the point with young people who say that words are as harmful as fists, knives and anything else and that they should not be exposed to individuals saying certain words because they are just as harmful as criminal activity. I do not want the Bill to give even more succour to this idea that words, which are often opinions that people do not like, are harmful. Even though words can make you feel uncomfortable, we must distinguish between words and actions, in my opinion, and not encourage young people to always think that they are victims of some crime if they hear words that they find unpleasant, even though I understand that some words are unpleasant to be on the receiving end of.

My Lords, I have been trying not to get into a lot of the groups on the Bill but I regret not getting into this one. Amendment 198 makes such good sense because politics is a fairly dire arrangement these days. A lot of voters have lost interest and do not trust us. Getting people involved at the local level is an excellent way of stimulating their appetite for more politics at different levels, so I very much support Amendment 198.

I quite like Amendment 209, but somehow “environmental issues” is just thrown in—you have to say it, do you not? I do not know what it means. I would like it to mean a lot but I am not sure that it means very much at all.

The noble Lord, Lord Young of Cookham, quotes to us the Conservative Party manifesto when the Government have broken so many promises and back-tracked on so many things. I hardly think it is a very good example for any of us to hold up as something we need to follow. Plus, his comments about the green belt were absolutely outrageous. It is not for people with gardens or people with country estates; it is for people who live in inner cities, who have no gardens or green space to walk about in. The green belt has a huge value for them, so please let us not forget that.

Amendment 211 is from the noble Lord, Lord Lansley, and the noble Lord, Lord Young of Cookham, for whom I have huge respect, by the way. My telling him that the Conservative Party manifesto might as well be thrown in the bin—as it has been by the Conservative Party—does not mean that I do not have huge respect for him. Again, this amendment is about economic growth. We went through this in the Budget. Growth is not about well-being or prosperity; it is about grabbing more and more of the earth’s resources. It is not necessarily something that we want to keep promoting. If we are going to talk about growth, can we please talk about well-being, green spaces and environmental support, and not just constantly about businesses, inward investment and that sort of thing?

Let us please try to remember that we have a climate crisis. It does not matter whether you believe it or not; the fact is that the IPCC has published a report that was gone through by dozens of Governments and hundreds of scientists. They all quibbled over it, but they finally came to a report that is absolutely devastating. We really should be looking at that. Every time we put down an amendment, we should have that at the back of our minds, so that we say things that will help us in the future and help our children and grandchildren. At the moment, we are not doing that.

My Lords, I was not going to speak, but the noble Lord, Lord Young, summed up one of the problems with this Bill in general: we have an important Levelling-up and Regeneration Bill that does not tackle the crisis of housing supply—something I talked about at Second Reading.

I want to clarify at this stage in the evening that, while the points made by the noble Lord about the green belt are not by any stretch of the imagination that every part of the green belt should be built on or concreted over, it is a misnomer to suggest that the green belt is a beautiful green area for people who do not have country homes, gardens or parks to go to. Lots of it is actually unusable by the public. What the noble Lord suggested was a review. If the review indicated that it was valuable for the well-being of the nation, that would be fine, but it would be able to show that huge swathes of the green belt are misnamed and could be productively used for housing for young people and people who are desperately in need of homes.

My final quick point is that economic growth has to be the solution for austerity and the cost of living crisis. You cannot tackle the fact that people are too poor unless you produce more. That is called economic growth. Austerity is unpleasant, nasty and brutish, even when dressed in eco clothes. We need more growth, not less, especially at this time. People’s well-being will not be tackled or helped if they do not have the proceeds of economic development and growth.

I appreciate that we disagree. I thought the point was that we would disagree well in Committee. I have sat and listened to this debate for many hours. I just wanted to clarify why I think economic development is important: we will not be able to build any houses and nobody’s well-being will be helped if we stand still economically or go backwards. I do not relish austerity for the masses. Therefore, I think we need economic growth, mass housebuilding and the supply side to be tackled.

My Lords, while I hope the Commons will look again and restore some version of Clause 4 and material remedies for victims of cancel culture on campus, I am still really glad that we have passed the Bill. I think our deliberations have been worth while and even now are having an impact, so I thank all involved.

A highlight for me was when the noble Lord, Lord Collins of Highbury, made his “confession” last week that he had originally thought the Bill “not necessary”, but

“during the process of Committee and the dialogue and discussions … I was persuaded that there is an issue to address.”—[Official Report, 7/12/22; col. 222.]

That is a win, in my book. Credit, then, to those who have spoken so articulately on threats to academic freedom, but also to those who have been open-minded and listened. Does that not remind us of the gains of hearing all sides of a debate, the importance of free speech and why it is so valuable?

In another instance, I have a confession. The noble Baroness, Lady Royall of Blaisdon, was keen to correct any impression I had given that the University of Oxford was creating a hostile environment to academics who might oppose moves to decolonise classical music. I apologise if I was too sweeping, but I am in touch with music scholars who are extremely worried about the dogmatic atmosphere surrounding the classical music canon, disparagingly dubbed

“white European music from the slave period”.

They claim that the debate on the topic is toxic and mired in accusations of racism, so I enthusiastically welcome the University of Oxford’s insistence that this is just not true. Perhaps this shows that university authorities can be sensitised to the reputational damage of not defending academic freedom or their own academic staff’s reputation if they disagree with critical theory orthodoxies. That is a shift away from worrying only about the reputational damage of being mislabelled as bigots by campus activists, and I think the Bill has helped.

A final positive note: I was shocked last week when the UCU, the trade union of Edinburgh University, shamefully demanded that the university cancel the screening of “Adult Human Female” organised by their own colleagues, Edinburgh Academics for Academic Freedom and—not a good example of collegiate atmosphere. I was nervous that Edinburgh University would succumb. After all, it had only recently given into pressure to cancel the titan of Scottish Enlightenment philosophy, David Hume. But no, the university stood firm. The documentary will be shown at the university’s theatre tomorrow night, despite transphobic accusations—

Perhaps the debate we have had has already given authorities a bit more backbone, and therefore I congratulate and thank everyone concerned for allowing a freer spirit and discussion around academic freedom to take place, at least outside this place.

My Lords, the Minister gave a powerful justification for upgrading and updating the criminal law to deal with these new forms of protest. She made the point that the general public have had enough, and we recognise that. We have all seen instances of workers begging protesters to let them through to go to work, parents trying to get ill children to hospitals and so on. We have seen frustration turn to fury and people often taking action on their own, dragging protesters away as the police have stood by. At least this section of the Bill makes sense to me based on that motivation, but we have spent hours and hours on previous sections on banning the types of protest in Part 3, which was justified on the basis that it was dealing with those kinds of actions, when in fact none of the measures that we previously discussed would deal with them at all.

The measures that we previously discussed in Part 3 elicited some very fine speeches about the right to protest. I was struck most recently by the speech by the noble Lord, Lord Coaker, which I related to. We were probably on the same miners’ demos. It properly and entirely understood why people were demanding the right to protest. All those fine words were effectively shot down by the Minister on the basis that these are things that we need to do to deal with Extinction Rebellion and these different kinds of protest. In fact, the only dealings that I had when I got caught up in an Extinction Rebellion protest—I mean that I was trying to get through it, rather than that I was on it, in case anyone panics—was when they were doing a five-hour silent vigil in mime. There was no noise involved. But we have spent all that time discussing how noise is going to trigger the police having a huge amount of power to deal with those people.

I find it utterly galling, because now we have a set of amendments, and at least I can understand why the Government have brought them in—and the public will think that they will tackle what they are furious about—and we should therefore, in this House, be able to scrutinise them line by line, as has been explained. People will probably like the locking-on offence—I say “people”, meaning that there might be popular support for it. But the noble Lords, Lord Paddick and Lord Beith, have done a really good take-down of what the consequences of these measures would be beyond the headlines, and people might be less keen on the equipped to lock-on offence. Certainly, when they work out the frightening aspects of the serious disruption prevention orders, they might want to think again. The “causing and contributing to” aspect, as the noble Lord, Lord Paddick, noted, really is a very serious threat to free speech—absolutely. And this is a Government who claim all the time that they are here to defend free speech, but they are introducing, without even casually noting it, something that would absolutely have a damaging effect on free speech.

Maybe I am wrong, and maybe the Government could persuade us that these special kinds of protests need special laws, in which case we should have hours and hours to discuss it. Instead, here we are, fed up, having discussed a whole range of other legislation that was supposed to deal with these issues when in fact, it did not; and now, the things which might deal with those issues we do not have time to discuss. It is frustrating for all of us.

When Boris Johnson was Mayor of London, he brought in a rule about not drinking on the tube, which was a solution in search of a problem—because it was not a problem at the time. But it immediately made me want to run out, buy a bottle of gin and go drinking on the tube, because it was such a stupid rule. This provision is a little bit like that: I do not really want to carry a tube of superglue around, but I have on many occasions carried a bike lock. It is absolutely ludicrous.

When the Minister read out the list of amendments, my heart sank. Although I had looked at them all individually, somehow hearing them one after the other made me feel that this is totally wrong. If the Government do not withdraw all these amendments, we should vote against the Bill in its entirety.

The Minister talked about protestors, referring to the issue of whatever their cause may be. But the HS2 protestors, of whom I consider myself one, have actually been trying to save precious things for the nation. It is not fun to be out on a picket line, being shoved around by security guards and hassled by the police constantly. I was standing next to one man on a picket line who said, “I retired last year and I thought I would be birdwatching, but here I am holding a placard”. Those are the sorts of people who have been protesting about HS2; they have been trying to save precious eco-systems for the nation, for all of us, and to prevent the chopping down of ancient woodlands. We really cannot dismiss these people as troublemakers, deserving of all these amendments. I admire the attempts of the noble Lord, Lord Paddick, to improve these measures, but it is a hopeless case.

The Government are very quick to talk about the views of the public and what the public want, perhaps from a few clips on TV and a few emails, but on the sewage amendment to the Environment Bill, they had thousands and thousands of emails, but they absolutely ignored them and carried on allowing sewage to be pumped into our rivers and on to our coastline. So please do not tell me that the public want this. The public did not want sewage, but the Government ignored that. The Government pick and choose to suit themselves what they design legislation around.

As the noble Lord, Lord Beith, mentioned, there is also the late tabling of these amendments. It is a democratic outrage. They are of such legal significance and such a threat to people’s human rights that they should be the subject of a whole Bill, with public discussion about it, public consultation, human rights declarations and equalities impact assessments. Every MP should be furious that they have been bypassed, because the only scrutiny they will get is, if they are lucky, a quick 20 minutes during ping-pong to find out what they are all about. Because they are whipped, they will probably not pay any attention to it anyway. This is nothing more than a naked attack on civil liberties and a crackdown on protest, and we must oppose it for both what it is and how it is being done.

From a woman’s point of view, I would just like to say that there are things I would have done at 20 that I absolutely would not do now, at 70. We can all learn and adapt our behaviour, so the past may not be relevant.

As a woman, I say that the past might not be relevant but the truth might be, if you have just said, “I would never have done this” or “I have never done this”. I do not understand why the purpose of this amendment is to send a message; the point of the law is not just to send a message. Of course, we want women to get a fair shot at seeing people they are accusing of rape found guilty, but I do not want the state to be in a position where it can find people guilty based on the fact that you cannot probe the truth of what has been said. That is condescending to women, by the way. Women do not need to be so protected; they need people to do their jobs. But we do not need to alter the law to hide the truth in order to give women a fair shot.

My Lords, I enthusiastically endorse these amendments and thank the noble Lords, Lord Moylan, Lord Pannick, Lord Macdonald and Lord Sandhurst, for raising this crucial issue. The issue of non-crime incidents has been of concern to a number of us for some years and it is good that it is getting some parliamentary attention at last. I particularly credit those organisations and publications that have persistently raised it in the public realm and whose research informed my remarks, especially the Free Speech Union, of which I am on the advisory council, the anti-racist campaign Don’t Divide Us, and Spiked online.

Too many avoid the issue because it is rather tricky and contentious. One of the reasons it is difficult to raise is because nobody wants to look as though they are being soft on hate incidents. However, I am concerned that this in itself has led to a degree of chilling self-censorship and allowed some confusion to arise about what is and is not a crime when the police are involved.

When the public hear the phrases “hate”, “hate crime” or “hate incident”, they instinctively think of, for example, someone being beaten up because of their skin colour or being harassed in the street because they are gay, and they are appalled and shocked. We assume the worst kind of bigotry and our instinct is that something must be done. However, it is not so clear cut. According to the hate crime operational guidance issued by the College of Policing, hate crime is often an entirely subjective category, based on the perception of the alleged victim; I will come back to this.

What is extraordinary about the guidance on hate crime is what the police consider to be successfully tackling hate crime. The guidance says:

“Targets that see success as reducing hate crime are not appropriate”.


That completely befuddled me. The guidance says instead that the measure of success for the police is

“to increase the opportunities for victims to report”.

I fear that, in this act of enthusiasm to get more people to report hate, the police have muddied any clear distinction between what is criminal and what is not.

The focus on reporting initiatives led earlier this year to rainbow-coloured hate crime police cars patrolling local areas, with the aim of giving communities the confidence to come forward and report hate crime. However well-meaning, such awareness-raising initiatives often encourage people to come forward and report things that are not crimes at all. In fact, earlier this year, a police digital ad van trawled around the Wirral, warning that

“being offensive is an offence”.

Actually, being offensive is not a criminal offence. After a backlash, local police clarified that this was an error. Why did the police get it so wrong in terms of what is a crime?

This is not an isolated incident. A few years ago, Greater Glasgow Police tweeted an ominous warning:

“Think before you post or you may receive a visit from us this weekend.”


This was posted alongside a graphic that warned social media users to consider whether their treats were true, hurtful, unkind, necessary and then, right at the end, illegal. Then there was the South Yorkshire Police Hate Hurts campaign, which asked people to report any “offensive or insulting” social media posts to police officers. None of these is a crime and, in relation to a Bill named the Police, Crime, Sentencing and Courts Bill, it is a concern if the police do not know what is or is not a hate crime, so much so that Cheshire Constabulary recently admitted to conflating crime and non-crime in its hate crime statistics.

This amendment can potentially start unpicking this muddle, because the source of the confusion about what is or is not a crime lies in the creation of the category of non-crime hate incident. As we have heard, this category was established by the College of Policing and its guidance encourages police officers to overreach and police non-crimes. It is worth telling noble Lords how this is posed in the guidance. The NCHI guidance states:

“Where it is established that a criminal offence has not taken place, but the victim or any other person perceives that the incident was motivated wholly or partially by hostility, it should be recorded and flagged as a non-crime hate incident.”


Note the use of the word “victim” to describe the reporter or accuser, when no evidence exists that any crime has been perpetrated against him or her. The victim has to claim only that some action or speech was

“motivated wholly or partially by hostility”.

“Hostility” itself is a vague and subjective term. The guidance continues:

“The victim does not have to justify or provide evidence of their belief, and police officers or staff should not directly challenge this perception.”


Furthermore, any other person’s perception can be the basis for this, which is even further removed from any real incident, let alone crime.

Finally, the guidance notes:

“Police officers may also identify a non-crime hate incident, even where the victim or others do not.”


Why? It is because:

“Victims … may not be aware that they are a victim of a non-crime hate incident, even though this is clear to others.”


I find this a kind of dystopian, Orwellian, nightmare world. Imagine untangling your way through that; your name, unknown to you, can appear on a database intended for recording details of criminal offences and be subject to checks by vetting officers when you apply for jobs, as we have heard from noble Lords.

I hope noble Lords can see the dangers here. The subjective nature of the NCHI guidelines creates a real possibility of abuse of the system by people acting in bad faith. The NCHI guidance means that unfounded, spurious and malicious reports can be filed and never tested, let alone the fact that this data gathering distracts the police from pursuing real criminals. I was contacted by one person ahead of this debate, who said, “I had a visit from the police because a member of staff offended another member of staff, who works for me. No crime was reported. The police spoke to me for 40 minutes. In the meantime, the 200 pallets that I reported stolen the week before did not generate a phone call or visit.” Then there is the chilling effect of NCHIs on free speech, as other noble Lords have vividly spelled out. NCHIs can act as a threat, a kind of surveillance of free speech, by people who say it will eventually lead to crime. Anyone who is following the fate of gender-critical feminists, who are constantly accused of hate by a particular brand of trans activist, will understand just how damaging that is to free speech.

This Government tell us all the time that they are keen to oppose cancel culture. I fear that these NCHIs inadvertently contribute to that censorious climate of denunciation and the toxic climate of hate, which we are all keen to combat. I therefore urge the Government to consider these amendments carefully and remove this contradictory anomaly, which, I fear, brings the police and criminal law into disrepute.

My Lords, I was not going to speak on this, because there are much bigger issues coming up later, but I had seen this in a reverse way. It is not completely clear, if you do not have a QC’s training or legal training of any sort, whether this amendment is trying to help or hinder the collection and retention of data.

To me, this seems like a good opportunity to talk about misogyny and other abusive behaviour that falls short of a criminal offence but none the less should be recorded on a person’s police record. The biggest benefit of retaining that data is that it might help in the future investigation of criminal offences. For example, if someone is a notorious misogynist but it has never reached the threshold of criminality, this will help the police’s line of inquiry if said person is later a suspect in a violent attack against a woman. As we all know, the justice system is biased very strongly against women committing crimes.

What I did agree with from all those offering support for the amendment is that proper oversight is absolutely necessary. There should be some regulation about this, because some of the anecdotes mentioned seem ridiculous. I still have not decided whether I support this; it would depend on how it dealt with proper oversight.

My Lords, I had to bring this amendment back on Report, because I did not think that the Minister accepted the issues in Committee. They are important: domestic abusers are being granted unsupervised contact with children as a result of an ingrained pro-contact culture. The Ministry of Justice’s own harm review concluded that “the dominance of contact” is seen

“as excluding other welfare considerations, including the child’s need for protection from abuse, or the child’s wishes and feelings.”

Rather than seeing contact as a means to an end and weighing it up against all the harm and damage that an abusive parent has caused, it is seen as the end in itself, almost no matter what the cost. That is deeply harmful.

The debate on parental alienation on Monday showed just how embedded some of these ideas have become. Wanting to exclude an abusive parent can itself be labelled as abusive. Abusive men, in particular, falsely claim that abuse is mutual and reciprocal, and try to label the victim as a fellow perpetrator. As the Minister said on a previous group, an abuser will pursue their victim through the family courts to try to force contact with their child, not because they care, but because it is an extension of their coercive and controlling behaviour and their fury that their victim has managed to escape them. So, the abuse continues through the courts and then into unsupervised contact. More than a dozen children have been murdered by their fathers during unsupervised contact. Can the Minister please tell me what the Government are going to do to stop it?

In my short time in this House, I have been hugely impressed by the fairness, clarity and reasonableness of the noble Baroness, Lady Jones of Moulsecoomb—that might be bad for her reputation—even when we have not agreed. However, in this instance, I am sad to say that I cannot find anything reasonable in this amendment, but it raises some broader issues about the Bill that worry me, so I will make those points.

This amendment effectively argues for denying the right to be a parent to anyone accused of the offence of abuse. In listing those who will be denied unsupervised access to their own children, we have those “awaiting trial”, “on bail” or

“involved in ongoing criminal proceedings”,

all of which—as anyone who knows anything about the criminal justice system knows—can involve months or years of one’s life. That would mean that innocent people, accused, are already treated as guilty.

Of course, we all want to protect children from any risk and, as the noble Baroness has illustrated, those horrifying stories of children being hurt or even killed, sometimes as revenge, are at the forefront of our minds, but I have two points. The amendment refers to ensuring the

“physical safety and emotional wellbeing of a child”.

Those are two distinct threats. The latter, at least, is difficult to pin down. I argue that being deprived of time with one’s parent, free from a court-approved third party, could also be the cause of considerable emotional distress for any child. It could be a recipe for the parental alienation that she mentioned.

Secondly, even the prospect or fear of a threat to physical safety cannot distort our sense of justice or lead to disproportionate or punitive measures in a risk-averse “what if?” scenario. It could too easily lead to the state unjustly alienating children from a parent who is accused but not found guilty. Surely, evidence and facts are key to establishing the level of threat. I note that the amendment would deny unsupervised contact

“pending a fact finding hearing”,

which makes a mockery of establishing facts and tears up any commitment to factual evidence as an important part of judging whether an accused parent can be trusted to care for or parent their children without third-party supervision.

I am even worried that this amendment argues that unsupervised contact would not be allowed for anyone with a “criminal conviction” for abuse. Granted, in this instance the evidence has been weighed and facts established, but consider the implications of this. This amendment would mean that someone found guilty of abuse perhaps when as young as 18 could find themselves, at the age of 38—by now, we hope, a reformed character in a different set of circumstances, maybe no longer drinking, on drugs or mentally ill, as we have heard today, or just shame-faced about their younger self’s abusive behaviour—still denied unsupervised access to their children. To be honest, that seems ungenerous, even barbaric and vengeful. It suggests that we are branding people found guilty as perpetrators with the letter “A” for abuser, for ever.

We also heard earlier that one can gain a criminal conviction for abuse by breaching a domestic abuse order. That breach might be for a relatively minor offence. I worry that aspects of this amendment encourage a lack of perspective and a disavowal from making judgments of different threats. The Government continue to stress that they do not want a hierarchy of abuse or harm—we have just heard the Minister discuss that—but this can lead to a muddle when it comes to parental contact. I want to discourage a lazy, one-size-fits-all approach. When considering risks to children, there is a distinction between, for example, the perpetrator of regular, systematic violence or coercive control and the particular emotional or psychological abuse that one partner might inflict on another in a toxic relationship. The latter may be worse than horrible if you are at the receiving end of it, but it may never be aimed at or even witnessed by children.

To conclude, I urge the Government to maintain the presumption of parental contact. It should be curtailed or removed only with great care. That does not mean putting children at risk, but it means holding justice dear.
