Lords ChamberTo ask Her Majesty’s Government what assessment they have made of the current situation in Sudan, with particular reference to the recent protests in that country.
My Lords, we are very concerned by the current situation in Sudan. Together with our troika partners, Norway and the United States, we continue to call for restraint in policing the protests, for the release of detainees and for accountability for those killed. We expect the Sudanese people to be allowed to exercise their right to freedom of peaceful expression. Sudan’s response to these protests will shape our approach to engagement with the Government of Sudan in the coming months and years.
My Lords, I thank the Minister for his reply. Is he aware that I visited war zones in Sudan virtually every year during the self-avowed jihad waged by its Government from 1989 to 2005 and, subsequently, saw people suffering from its genocidal policies in the Nuba mountains and Blue Nile? Every time that I have returned and raised these issues in your Lordships’ House, the Government’s reply has always been, “We are talking to the Government in Khartoum”. That Government there love talking to the British Government but continue to kill while they talk. So what specific requirements are the Government placing on the Sudan Government after their current atrocious perpetration of human rights abuses against peaceful protesters, including reportedly killing 40 and injuring and arresting hundreds more—or will Her Majesty’s Government allow the Government of Sudan to continue their violations of human rights with impunity?
My Lords, I am fully aware of the work done by the noble Baroness in Sudan and the support she extends to people there who are suffering oppression and the denial of their human rights. As Minister for Human Rights, I assure her that I am acutely aware of these challenges. During a visit to Sudan last year, I raised these directly with government officials as well as civil society leaders. On the issue of our engagement, our excellent ambassador there, His Excellency Irfan Siddiq, met directly with the acting Foreign Minister immediately after these protests. As I outlined in my original Answer, we will hold the Sudanese Government to account if they persist in the brutal suppression of the longest protests we have seen since the independent Sudan came into being.
There have been some positives, however. Through our direct engagement, we saw a humanitarian corridor open to South Sudan to address some of the issues beyond the borders of Sudan itself. So engagement does have some positive returns.

Lords ChamberI agree with the noble Lord. He will be pleased to know that this morning I was with Kate Allen of Amnesty International as part of today’s celebrations on the declaration of human rights. The points he made are pertinent. We continue to hold them accountable on that very basis.
My Lords, a representative of the Foreign Office said at an open meeting that the UK Government’s policy regarding Sudan had changed from sticks to carrots. The regime in Khartoum is enjoying munching those carrots, but on this Human Rights Day I ask the Minister: what conditions are the UK Government applying to the Government of Sudan to justify those carrots, particularly regarding the arrest and detention of human rights activists, often with torture, including Mohamed Boshi, who was forcibly removed while in exile in Cairo and is detained in Khartoum’s notorious Kober prison simply for being a member of an opposition political party—despite the fact that, in April, President Bashir issued a decree to release all political detainees?
Let me assure the noble Baroness that I visited Sudan recently and did not go equipped with any carrots. It was quite a candid conversation concerning priorities of human rights, including press freedoms. Civil society organisations were present. I conducted a round table, meeting with one of the senior vice-presidents, and we had some productive outcomes. For example, we will now be pen-holders at the Human Rights Council, and will use that as a means to push further reforms that are required on the ground. The detention of political prisoners, as the noble Baroness and others have made clear, is unacceptable.

Lords ChamberIn terms of how many times there have been actual referrals, I will have to write to the noble and learned Lord. I assure him that the Government are fully supportive of the ICC and its efforts in this regard. We support all mechanisms in bringing the perpetrators of crime to justice.
My Lords, is the Minister aware that the last time I was in Kachin state I visited a village where I was told of how a local woman was abducted by the Burmese army, tied to a post in the army camp in full view of her family, repeatedly dragged away presumably for rape or other maltreatment, and eventually disappeared? A recent statement from the Kachin global network claims that:
“There have also been ongoing abductions, deaths, and injuries by landmine explosion, torture and subsequent health problems, and mortar shells exploding on civilians’ houses”.
Will Her Majesty’s Government raise as a priority with the Burmese Government the issue of the atrocities and violations of human rights perpetrated with impunity by the Burmese army?
Let me assure the noble Baroness that we are doing just that. We have all been horrified, first by what we saw in the Rohingya crisis, and now by the situation we see unravelling in Kachin. I assure her and all noble Lords that we will continue to implore the Burmese authorities, and that includes bilateral visits such as those made by my right honourable friends the Foreign Secretary and the Minister of State for Asia, Mark Field. We will continue to raise this through international fora, both at the UN and at the Human Rights Council.

Lords ChamberMy Lords, I agree with the noble Lord that our aim must be to end this civil war as soon as possible. However, I assure all noble Lords that the Government have been and continue to be committed to the UN Geneva process, because it brings together all the Syrian parties required to ensure the stable settlement that we all desire. If we look at what Staffan de Mistura is actually presenting, a whole constitutional commission is proposed, which, yes, includes members of the Assad regime being present. The only reason why that meeting has not been held in Geneva since January is that the Assad regime refuses to engage. We implore Russia, and indeed Iran, to put on the utmost pressure to ensure that the regime takes part in those talks so we can achieve the lasting settlement that I know the noble Lord and all of us desire.
My Lords, why does Her Majesty’s Government’s policy—including funding armed groups and local councils affiliated to jihadists and maintaining a special forces presence in Syria, in breach of international law—demonstrate a commitment to removing President Assad, which can only help ISIS to recover territory? Surely, the priority must be to eliminate ISIS and related terrorist forces from Syria?
I agree with the noble Baroness that this is about eliminating ISIS, which is why the anti-Daesh coalition of 70-plus nations has managed to achieve that in Iraq. I have seen it at first hand myself. However, the perverse ideology of the hijacking of the noble faith remains. Therefore, we must prevent ISIS coming to the fore, not just in Iraq again—we must also eradicate it from Syria. However, I refute totally the allegation that the Government are supporting the regime. We are supporting organisations such as the White Helmets, which provide essential assistance, including sanitation and emergency health provision, to address the civilian population’s needs as a priority. That should be commended, not condemned.

Grand CommitteeMy Lords, I too warmly thank the noble Baroness for promoting this important debate. I share the deep concerns over the suffering of the Rohingya people, but I shall focus on northern Shan and Kachin states as these have received less media coverage and desperately needed humanitarian aid. Renewed offensives by the Burmese military are causing mass displacement of civilians throughout north-east Burma. There has been sporadic fighting over several years, but recently this has intensified with daily attacks, displacing thousands and killing hundreds in the past few weeks. On 1 May, the UN expressed grave concerns over increased fighting in Kachin state. Many civilians are trapped in conflict zones, without access to humanitarian aid. UN Special Rapporteur Yanghee Lee has made repeated calls for the safety of civilians and provision of aid, but the Burmese Government have blocked access to all humanitarian aid international organisations and the UN in ways similar to their treatment of the Rohingya.
The latest wave of displacement adds to the over 100,000 already displaced from Kachin and Shan states. Many remain trapped by the military in conflict areas, forced to seek shelter in nearby forests, without access to food, water or medical supplies. More than 3,000 are confined in dangerous conflict areas in Kachin state.
The suffering inflicted by military offensives is exacerbated by frequent violations of human rights and crimes against humanity, with reports of extrajudicial killings, sexual violence and torture. Interviews with internally displaced peoples, or IDPs, in Shan camps tell of horrific stories of civilians beaten and used as forced labour by the military, farms taken from villagers and children recruited by the military. The Shan Human Rights Foundation reports arbitrary arrests and Amnesty International found treatment of ethnic minorities in Shan and Kachin states similar to that of the Rohingya. There are also reports of extortion, of villages being levelled to make space for hydro projects along the rivers, and land-grabbing for the expansion of mining and hydro projects.
The numbers of IDPs has grown alarmingly. On 14 March, over 800 people were displaced in three towns in northern Shan state; on 17 March, 200 civilians were displaced from the Namtu township in Shan state; on 28 April, following a month of intensified military attacks, 4,000 more were displaced from Kachin state; on 6 May, another 500 civilians were displaced from Shan state, seeking refuge in monasteries and churches; on 8 May, the figure increased to over 6,000 civilians displaced from Kachin state and a further 600 were displaced from the Namtu township. Around 2,800 villagers in Kachin state are seeking refuge in churches in the capital or nearby villages. Displacement continues and the chance of return, as is recommended by current policy, is prevented by continuing offensives, destroyed homes and landmines restricting access to villages. There is also restriction of access for essential aid supplies and the blocking of escape routes for civilians by the destruction of bridges and road closures.
The Rohingya crisis has shifted the provision of aid from the eastern border to Rakhine state, where it is much needed, but this has caused severe malnutrition for many living in camps on the eastern border. Humanitarian and local agencies have been refused access to townships in Kachin state. For example, on 23 April, a Red Cross food convoy was reportedly blocked from entering Man Wai village, where over 100 civilians are trapped.
My small NGO, HART, with which I work and with which I have visited these people, works in partnership with the Shan Women’s Action Network, or SWAN, which provides healthcare and education in camps in Burma and for Shan civilians forced to live in Thailand. In 2017, it lost its DfID funding. Could the Minister tell me what the UK position was regarding the policy change which led to the cessation of funding for local aid organisations along the eastern border in favour of working with government-approved organisations? Will a reversal of that policy be considered to allow direct funding to NGOs such as SWAN, which carry out vital work for local people? Finally, what representations have the UK Government made to the Government of Burma to cease military offensives in Shan and Kachin states, to ensure the protection of civilians and to allow for urgent humanitarian assistance?

Lords ChamberTo ask Her Majesty’s Government what is their assessment of recent developments in Nigeria, with particular reference to attacks on civilians by Boko Haram and the Fulani.
My Lords, we welcome the news that some of the Dapchi girls have been released and offer condolences to the families of those reported to have died. We call for an immediate release of all those abducted. Such attacks are abhorrent and must stop. We are also deeply concerned about ongoing clashes involving pastoralists and farmers, and have raised the issue with the Nigerian authorities. We urge the Nigerian Government to bring the perpetrators to justice and implement longer-term solutions.
My Lords, I thank the Minister for his reply. Is he aware that, last time I was in Nigeria, I visited four Christian villages in Plateau state that had been attacked by the Fulani herdsmen, stood in the house where they had murdered the pastor, visited the homes which had been destroyed and saw Fulani cattle grazing everywhere? This situation has been multiplied many times, with the murder in recent months of hundreds of Christians and the destruction of their villages by increasingly well-armed and aggressive Fulani. Will Her Majesty’s Government therefore make rather stronger representations to the Government of Nigeria to fulfil their obligations to ensure the protection of all their citizens, especially given recent developments of Christians being deliberately targeted?
Let me assure the noble Baroness and all noble Lords that wherever in the world we find minorities being targeted, we raise that as part of our prioritisation of the freedom of religion and belief. I assure her further that we have raised the issues of the current and recurrent clashes between the herdsmen and the local farmers. We welcome President Buhari’s commitment to assist the affected communities. I agree with the noble Baroness that this has had a devastating impact on lives and communities, as well as on the general safety and security of all citizens. We are engaging with the federal and state Governments to encourage them to work with all parties, so that we can develop safe solutions for all communities in that part of Nigeria.

Lords ChamberOn the latter point, I agree with the noble Baroness. As I said, the UN is already set up, and the district of Eastern Ghouta is very near Damascus, so agencies are already set up to act promptly. I also agreed with the noble Baroness’s earlier point: we need international action on this. The Government have repeatedly asserted—I acknowledge the support we have received from across the House—that the Assad regime is unrelenting in its brutality. As the noble Baroness pointed out, we have seen this in Homs and in Aleppo. This must stop. There are 400,000 people under siege in Eastern Ghouta; 200,000 are children. The world needs to act, and we will play our part in that.
My Lords, is the Minister aware that Eastern Ghouta has been occupied by ISIS and other jihadist groups, such as the Army of Islam, which have been bombing Damascus for years—I saw that bombing coming in when I was last in Damascus— and that recently the shelling on Damascus has become so intense that the sky is blackened, especially over Christian areas, and reports are coming in that many people have been killed and injured in Damascus itself? Does the Minister therefore agree that one of the best ways forward would be for those who support the jihadis, such as Saudi Arabia and Qatar, to encourage them to accept the peace arrangements that have been offered to them by the Government of Syria, which would shorten the suffering which everyone sees and knows is horrendous?
The noble Baroness talks about peace, and of course any initiative which is aimed at that is important. But let us be clear. She raises an important point about groups that operate within Syria. She knows that I am aware of this and that I support ensuring that they are not armed in a way which can cause further destruction to Syria. But at the same time, when we look at the situation in Syria today, the continuing war has been caused by the persistence of the Assad regime. It is backed by Russia, which is why we are imploring Russia to take action. What we are seeing happening in Eastern Ghouta is because of what the Assad regime is doing. It needs to relent in its bombardment, and action needs to be taken so that we can get the 700 people who need medical aid out and provide humanitarian assistance to the 400,000 under siege.

My Lords, we welcome the progress made in the fight against Daesh, including the liberation of Raqqa. However, the Syrian crisis is far from resolved. Violence continues and the humanitarian situation is dire. Eastern Ghouta, which is besieged by the regime, is a particularly tragic example. A political transition is the only way to bring sustainable peace to Syria, and we support the Geneva process. All parties must work constructively towards a political agreement.
My Lords, I thank the Minister for his reply. Is he aware that, during a recent visit to Syria, I and colleagues met faith leaders, medical professionals, intelligentsia and parliamentarians, including the political opposition? All expressed deep anger at the UK Government’s massive funding, of at least £200 million, of bodies allied to jihadists. A recent BBC “Panorama” programme showed UK taxpayers’ money given to police assisting atrocities such as stoning victims. Can the Minister say when the UK will stop funding Islamists? As the end of the war against ISIS and other Islamist militias approaches, will the UK Government help all the people of Syria with urgently needed funding for reconstruction to enable people to return to their homes?
My Lords, on the second question raised by the noble Baroness, the Government’s position has been clear: we will aid the reconstruction of Syria once a peace process has been resolved and the prevailing conditions are such that there is stability in Syria. On the noble Baroness’s first question, she referred to the “Panorama” report and the £200 million. That relates to the CSSF, which the Foreign Office administers. As she will know, there are various parts of that funding; the component part that was reported on in the “Panorama” programme related to funding of the police force. The source of that funding, including who we fund through, has been put on hold pending full investigation. I am sure, however, that she would also acknowledge that £45 million of that particular funding pot supports the initiatives—and indeed the incredible courage—of organisations such as the White Helmets.

My Lords, the dinner break business is down at least one speaker—the right reverend Prelate the Bishop of Salisbury has scratched—and the noble and right reverend Lord, Lord Harries, may be detained in getting here. That means that speeches can be slightly extended, but please show due balance and understanding and do not go over the top. Six minutes, or a little more, will be perfectly all right.
My Lords, I am very grateful to all noble Lords who are contributing to this debate on two countries where people are suffering so much, but for very different reasons.
I begin by focusing on Sudan because through my small NGO, Humanitarian Aid Relief Trust, or HART, we work with local partners who can provide information not readily available, especially in South Kordofan’s Nuba mountains and Blue Nile state, known as the Two Areas. I visited the Nuba mountains earlier this year and witnessed the destruction perpetrated by the GOS—Government of Sudan—armed forces, including the destruction of homes, in which many civilians were killed, a school and the office of the local commissioner. I climbed for two and a half hours up a mountain to visit civilians forced to flee their homes by GOS military offensives and live in caves with deadly snakes. I listened to many people who described their anguish including a father, five of whose children had been burned alive when a bomb from a GOS Antonov set the hut ablaze. His sixth child, whom I met, is suffering from burns and mental trauma. I also met a girl who survived a cobra bite; most do not.
Where fighting has subsided, the humanitarian situation in the Two Areas continues to deteriorate: 23.9% of children suffer from acute malnutrition and 8.4% from severe malnutrition, increasing the risk of child mortality. Overall, stunting rates are a staggering 38.3% with severe stunting at 14.7%, creating a high risk of physical and mental developmental disorders. GOS troops still occupy vast tracts of ancestral farmland, displacing a substantial proportion of the population. Farmers who plant in these areas risk losing their lives or crops. Many villages remain ghost towns, as the 2016 offensive forced civilians to flee to the mountains. In many places I have seen, schools, churches and markets remain in rubble and people still live with the inherent fear of further attacks by the GOS. Episodic attacks continue. For example, on 10 October a long-range missile was fired from Dilling into Hejerat village and, according to local monitors, a significant amount of houses, farms and pastoral land have been destroyed by fire along front lines in South Kordofan.
In Blue Nile, 39% of households had reached levels of severe food insecurity in July and 11% are at the highest possible level of household hunger. Those numbers are expected to rise. There are also acute health problems. For example, there was concern over the spread of acute watery diarrhoea just north of the border and going into Blue Nile, where such few clinics as there are have no drugs to treat this condition. The internal SPLA-North conflict in Blue Nile ceased in October, allowing relatively free movement of civilians and goods. However, tensions remain high as the two SPLA-North factions have shown no signs of reconciliation. There is therefore an urgent need for initiatives to bring an end to this conflict, which has undermined the planting of crops and will lead to even more severe food insecurity in coming months. My small NGO, HART, has been one of very few NGOs enabling aid to be taken into Blue Nile. May I again—I have done this before—request that Her Majesty’s Government increase efforts to allow cross-border aid to reach these people? I appreciate the political complexities, but those heighten the need for an emergency response by the international community to fulfil the mandates to provide protection for vulnerable civilians.
I do not have time to discuss Darfur, where GOS aggression continues, but much of that aggression is well reported. I turn briefly to examples of concern elsewhere in Sudan. On 6 December, Sudan’s security forces or their apparatus kidnapped Mr Rudwan Dawod, a leading member of the Sudanese Congress Party, an adviser to the “Sudan of the Future” campaign—SoF—and a well-known human rights defender. He has been taken to an unknown place after he showed solidarity with the people of Elgiraif, who are struggling to protect their land as the GOS has been illegally confiscating lands from indigenous people to give to so-called foreign investors. Several other supporters of the SoF campaign have also been arrested. Will Her Majesty’s Government urge the Government of Sudan to release these civilians immediately and stress that President Omar al-Bashir will be held responsible if they are subjected to torture or any other harm? Is the UK embassy in Khartoum aware of the GOS policy of land confiscation from Sudanese civilians and has it made representations to the GOS regarding this serious violation of human rights?
A recent report by Global Justice Now shows the UK providing £400,000 from CSSF funds to strengthen the capacity of the Sudanese armed forces. Is this accurate and, if so, what is the justification for this support? Regarding all discussions with GOS, especially in the context of the Sudan strategic dialogue and the conditions for lifting sanctions, will Her Majesty’s Government ensure that there will be a thorough, accurate monitoring of compliance and genuine, demonstrable proof of the meeting of these conditions for the lifting of sanctions?
I turn briefly to South Sudan, where the UK has an important role as the second-largest bilateral donor and a member of the troika. I offer a brief overview of the situation there nationwide: 7.5 million people are in dire need of humanitarian assistance, with 6 million severely food insecure; 1.8 million have fled to neighbouring countries, more than 85% of whom are women and children; there are 2 million displaced internally. Disease outbreaks, including cholera, kala-azar and measles, along with more than 2 million cases of malaria, were reported between January and November 2016, with at least 246 deaths from cholera since June 2016. More than 1.17 million children aged three to 18 have lost access to education due to conflict and displacement, while about 31% of schools have suffered attacks. An adolescent girl is three times more likely to die in childbirth than to complete primary school and 76% of school-aged girls are not in school.
Our HART partner, Archbishop Moses Deng Bol, sent this update from Wau in Bahr el-Ghazal. He said:
“The most pressing issues in South Sudan are as follows: Insecurity has increased all over South Sudan. Dr Riek’s rebel movement the SPLM-IO is still fighting inside South Sudan and still considers him as its leader. More rebel groups have also been formed, including the National Salvation Front. As a result of the insecurity and hunger caused by the wars, thousands of civilians are still crossing the borders daily. More than 2 million people are now internally displaced in IDP Camps. New camps are being established, including one on the outskirts of Wau town and hundreds of civilians are entering the camp daily. The UN has stated that over 6 million people will be in need of food assistance in the coming year. The Inter-Governmental Authority on Development (IGAD) has initiated a process known as High Level Revitalization Forum (HLRF) to try to revitalize the peace agreement by asking the warring parties to recommit themselves to the agreement and to bring new rebel groups on board.
It is very important that the UK Government, especially with TROIKA, uses the forthcoming meetings to ensure sustained pressure on the warring parties to revive the collapsed peace agreement; to recommit themselves to permanent ceasefire; to open humanitarian corridors so that civilians can be given food aid; and to reach a political settlement so that the millions of refugees and IDPs can return to their homes and rebuild their lives”.
The archbishop also highlights problems of bureaucratic procedures for emergency funding—for example, food to save the lives of starving IDPs. When many hundreds of IDPs flooded into Wau earlier this year, he had to borrow money from local traders to obtain food and save them from starvation. Might Her Majesty’s Government urge DfID to consider working more with local partners such as the churches, which have the confidence of local communities, and to make the application process more user-friendly and the response to emergencies more rapid? The archbishop urges the UK to ensure that the HLRF process is genuinely inclusive and gives a strong platform to the voices of grass-roots South Sudanese groups, including churches, traditional leaders, women’s and youth groups. He also urges the UK’s approach to conflict resolution not to focus solely on the high-level peace process but to address root causes of conflict on the ground, investing in community-based peacebuilding and locally led reconciliation initiatives.
I greatly appreciate this opportunity to put on record some of the problems causing such suffering to the peoples of Sudan and South Sudan. I am very grateful to those noble Lords who will be able to highlight issues I have not had time to mention or discuss adequately. I sincerely hope that the Minister will be able to reassure the people of these countries so that when I send them this debate, they will see a response by the UK Government compatible with the responsibilities which we have a duty to fulfil.

Lords ChamberTo ask Her Majesty’s Government what is their response to the recommendation of the Henry Jackson Society’s report Trafficking Terror that an International Legal Task Force should be established to gather evidence on sexual violence as a tactic of terrorism.
My Lords, we condemn the use of sexual violence by terrorist organisations and are committed to holding perpetrators to account. UK law enforcement agencies are already assessing the threat posed by terrorism and human trafficking globally with our multilateral and bilateral partners. Our team of experts is also supporting efforts to gather evidence of sexual violence in conflict. The report makes a number of valid points and we will give them due consideration.
I thank the Minister for his sympathetic reply. Is he aware of the scale of money flowing from modern slavery to terrorist organisations such as Islamic State and Boko Haram? According to the report, from just 16 victims taken hostage, Islamic State gained between £98,000 and £198,000 from ransom payments. Slavery is also used to provide a plethora of non-monetary incentives to attract and reward terrorist fighters. Will Her Majesty’s Government consider the broader implications of laws, including the Modern Slavery Act 2015 and the Terrorism Act 2016, to reflect adequately the spectrum of crimes committed by individuals using sexual slavery and violence as a tactic of terrorism?
I assure the noble Baroness that we not only condemn it but act on that. She will be aware of our action at the highest level at the UN Security Council with the passing of Resolution 2331, which addresses the nexus between human trafficking, sexual violence and terrorism. More recently, as I have said to the House, in September this year at the UN Security Council we passed a resolution specifically to set up an investigative team to gather greater evidence on sexual violence and crimes committed by Daesh in Iraq. That demonstrates the action we are taking at an international level to ensure that we tackle this head on.
