My Lords, prison and court reform is overdue and I fully support it. I am anxious, however, that the programme of rebuilding should not make it harder for those visiting prisons. Will the Government ensure that the proposed new building uses existing sites rather than moving them to remoter venues where public transport is scarce or even unavailable? Keeping families together is hugely important. Will further thought be given to the teaching of basic skills such as reading, writing and simple maths and IT skills to prisoners? It is surely not right that time spent serving a prison sentence is not better used, enabling offenders to gain some basic life skills that will help them on their return into the community.

The gracious Speech looks forward to universal high-speed broadband availability, to the UK’s continued leadership and development in digital applications and to the invention and development of new transport technology, and it is to be welcomed. It also indicates the determination of this Government to improve the position of all those who suffer disadvantage, poverty, deprivation or ill health.

Looking first at broadband, will the Minister confirm that the right of every householder to have access to high-speed broadband will cover all farms and smallholdings, despite the fact that some of them are classified as businesses and are already required to use digital technology in supplying information to government departments? I want also to ask the Minister whether mobile phone reception is to be radically improved, as it is non-existent in some areas of the United Kingdom and sometimes very poor. I often wonder how other countries achieve a good reception and better coverage when we fail to achieve it ourselves.

The prime responsibility of any Government is to defend and feed their people. In an uncertain world where terrorism and conflicts arise, these challenges are as acute as they were in earlier years and earlier generations. Agriculture, farming and food production do not feature in the gracious Speech, but if we fail to produce food, other aspirations cannot be achieved. The forthcoming 25-year food and farming plan is to be welcomed, with serious thought given to the growing of crops and the need to increase yields for an increasing population against the background of plant and pest diseases and climate change.

These past two years have been difficult for UK farmers. In some sectors of the industry, particularly dairy, a crisis point has been reached. The Government have understood and recognised the problem, responding by extending the period for profit assessment through the tax system from two to five years—help is not necessarily always required with legal bills. This extended overall evaluation is one way in which help has been offered.

Another way in which help can be offered is via government bodies and local authorities. They are well placed to support and encourage the use of local, homegrown food—indeed I believe that the Prison Service has made this move and is basing its food supplies as much as it can on UK-grown food. It is a wonderful start; there is so much more that could be done. This year is the year for great British food and farming, growing the home market in the UK but also, equally and perhaps more important, through our export trade.

The gracious Speech sets out the Government’s clear programme to deliver security and increase opportunity for both businesses and individuals. It has much to recommend it, and I look forward to debating it later on.

My Lords, I declare my interest as the vice-president of the Open Spaces Society, as well as my other outdoor activity interests, which are in the register.

This amendment is a sledgehammer to crack a nut. The noble Lord makes it sound as though the countryside of England is a nightmare. This is absolutely not true. There are perfectly workable procedures for dealing with the kinds of circumstance described by the noble Lord, Lord Skelmersdale. In particular, Defra has found a mechanism through the stakeholder working group, which represents people from all parts of the countryside, from recreation to landowners and other users. This is a mechanism by which changes in the law take place by agreement and consensus. It has been extremely successful, has worked very well and continues to do so. To drive a coach and horses through that at this or at any stage would be very unwise. I hope that the Minister will explain that, apart from anything else, the amendment really does not belong in this Bill.

My Lords, this amendment has my name attached to it. My noble friend has gone into the detail of it, so I will not repeat that. The noble Lord, Lord Greaves, knows that we had quite a long discussion on this issue in considering the Deregulation Act. While he said that on the whole people do not abuse it, trouble is still being caused. He may say that this is not applicable in this Bill, but I think that it is. I shall be referring later to towns and cities as well, so I hope that he will stay with me and forbear my support of this.

It was said at that time by the Open Spaces Society:

“We consider that the discretionary power of moving paths should have low priority and we advocate that councils refuse to consider a path change unless there is a clear public benefit. Otherwise they are using their slim resources on a mere power, to the advantage of owners and occupiers rather than the public, instead of on the duty which benefits everyone”.

This is a very difficult situation. I do not think that the amendment is a sledgehammer to crack a nut. Clearly there are families who are finding this extremely difficult. It was suggested that the working group would get together and that that difficulty would be resolved, and clearly that has not happened. I support my noble friend in raising the issue today.

I move on to a concern—I have given the Minister notice of it—that has been raised with me on existing public paths, as they are, in cities and towns. Public paths that were incorporated into building developments in the 20th century were often acknowledged and placed on a definitive map as part of the planning process. In towns and cities, however, the Edwardian and Victorian developments often included paths to enable easy foot passages from one place to another. The land over which they pass may still belong to the estate upon which the development was constructed, or may have been sold to individual householders, or acquired by the local authority.

The reason that I raise this today is to make sure that, in the enormously important work that we are doing with the Bill, there will not be reflection later on something that we should have spotted at the time. As I said, I have given the Minister notice and it was obvious to me that the issue raised by my noble friend Lord Skelmersdale has not been resolved. I want to ensure that we do not walk into another difficult situation.

My Lords, I thank my noble friend Lady Scott for this debate, which is timely in so many ways. First, there is the nationwide remembrance of the world-shattering events of a century ago. When, on 4 August 1914, Britain declared war on Germany, the Army consisted of 730,000 men, many of whom were territorials. Three days later Kitchener urged all men between 19 and 30 to enlist. Shortly thereafter he promised that volunteers would be able to serve alongside their friends. Childhood friends, football teams and workmates responded to this call. In one week 1,600 City workers joined the Stockbrokers Battalion and 1,500 Liverpudlians joined the King’s Regiment. Within a month 50 new pals battalions were in training. Those men were all volunteers. Conscription for single men aged 18 to 41 was not introduced until March 1916.

It was not just men who volunteered. Those left behind—women, children and men who did not meet the criteria—had to make enormous contributions. There was no National Health Service, no social welfare organisation and no state financial aid. The wounded came home to be looked after by family, friends and neighbours. Today, hundreds of young people give service as cadets, while other individuals join the TA, giving valuable assistance to regular and armed service forces—and it is people and personal commitment that I want to touch on today.

State aid does not replace everything that volunteers can do in all aspects of living. As my noble friend said, the charitable sector includes over 160,000 registered charities, employs around 1 million people and has a turnover of some £38 billion each year. Some 42% of those charities have an income of less than £10,000, and only 25% have an annual income of more than £100,000. Today I do not intend to talk about the larger charities, but I do take the opportunity to register my concern about the six-figure sums that some are paying their chief executives.

I wish to focus on two Leicester charities, and here I should declare my interest as president of Young Leicestershire and as a canon of Leicester Cathedral, among other interests I have declared on the register. Young Leicestershire is an organisation that works with young people and youth groups. It has a lively website which is easy to access with lots of information about joining the clubs and good articles with news of events it is organising. Articles are posted, such as, “What my youth club means to me”, “What we do and why we do it” and “A helping hand”. As one volunteer who does tuck shop duties said, “I like working as a volunteer as it gives me the chance to train in youth work and gain experience. My children love it, too, as we can do it as a family”—her words, not mine.

Hundreds of individuals give freely of their time and energy. Without volunteers, clubs could not keep going. But life has become more complicated, as the right reverend Prelate has just touched on, when helping and encouraging youngsters. Today volunteers often have forms to complete, CRB checks to be taken and training to be given. I hope that in raising standards, the requirement of greater accountability—necessary though it is—does not put people off becoming involved in the first place. While volunteering in Leicestershire has grown with the clubs over many years, Leicester Cathedral faces an enormous problem that many places would be glad to have. The normal annual visitor headcount has been around 30,000 a year and the cathedral has been very grateful for the warm welcome and dedication given by its present volunteers. However, after a certain discovery in a city car park, our visitor numbers rose to 150,000 last year. It considers that the reburial of Richard III within the cathedral will see a further rise in visitor numbers, and more help is needed.

Leicester Cathedral is dedicated to the effective use of volunteers for the promotion of its mission as an Anglican cathedral and for the benefit of the volunteers themselves. Much thought has been given to the best way to attract greater numbers of volunteers. The cathedral needs more welcomers and guides. In its generic agreement it includes a description of what support a volunteer can expect from the cathedral—matters such as training, induction, safety, insurance cover and out-of-pocket expenses, to give just a few. Volunteers in our case have to be over 18 and have a DBS check, which is normal.

I have touched on only two organisations whose challenges are very different, but neither could operate without massive input from volunteers. I have not spoken about others involved in fundraising for charities who respond to special appeals, who work on committees or who give their time to supporting people within their homes and local communities. The traditional way of volunteering is alive and still busy, but the young access calls for help via the modern media, and more flexibility and thought should be given to ways of attracting the young.

Whether you are young at heart, or just young, volunteering is important today. It is not a one-way road. I believe that individual volunteering is most valuable as a foundation for friendship. Those who work together helping others are usually the first to help each other. Those who work to raise funds in all weathers, locations and neighbourhoods have crises to overcome and problems to surmount, and shared laughter carries them through difficult situations of their own. Today’s debate reflects this, and I am very grateful to my noble friend for making it possible.

My Lords, I congratulate my noble friend Lady Scott of Needham Market on setting out so clearly the complex scene within the voluntary sector. I am sure that other speakers will highlight particular aspects but there are one or two areas that I want to mention. My noble friend commented on whether volunteers are valued for the service they give as much as they would be if they were working in the public sector. Her comments prompted me to turn my mind back to when I delivered meals on wheels in my local village—which, unfortunately, is not now done by volunteers, although state provision is doing it very well—and to reflect that it has lost the local link that people had in the village. They knew the person delivering the meal and would talk to them about their family. It is a sign of the times, although I am glad that in some areas such meals are still delivered by volunteers.

My noble friend also raised the important question of why a person joins in the first place—why do they feel there is a need which will cause them to volunteer? Sometimes it is because they had a relative who has been ill or perhaps some type of family problem. Others are particularly interested in wildlife or in community in the wider sense. I suspect that, in the first instance, many volunteer simply because they want to do something to help. My noble friend was right to say that sometimes it is just a matter of determining how they go about becoming involved as a volunteer. My noble friend has explained that issue clearly so I will not go down that line again.

There were difficulties even before this period of austerity. For many charities, the number of new, young volunteers coming forward has been insufficient to replace those who are leaving because of age, ill health or, in some cases, a feeling that they are not appreciated. What a terrible thing it is for these people to feel they are not appreciated. However, I am sure that in this jubilee year—which has been, and will continue to be, a wonderful experience for so many—we can chalk up another success. Younger people have come forward to help organise and run fun jubilee celebrations. They have discovered that volunteering was not only fun, challenging and hard work but also uplifting and rewarding.

Social enterprise organisations—there are some 62,000 of them in Britain today, contributing more than £24 billion to the economy and employing nearly 1 million people—are a new form of non-profit-making companies. This has the potential to become an important way of providing services at sensible prices while creating job opportunities for people who are willing to work for a reasonable reward. There are, however, a number of stumbling blocks to which I should like to draw the Minister’s attention.

Health and safety occupies a particular position in our national life—I wonder whether there has been a radio or television comedy show in the past 10 years that has not had a dig at it. In principle, health and safety is very important; consider, for example, the improvements to car design that were instigated partly by the need to reduce accidents. However, it can also be abused: examples include bans on playing conkers in the playground and the astonishing announcement made by the Royal Mail in Doncaster only last week that it would not deliver mail to a certain area in the rain because a postman had fallen over and been hurt. Where is it leading us?

The next big concern, which my noble friend touched on, is CRB checks. I am glad that the coalition is committed to reducing the number of such checks. Many older people who have been involved in charities for years were insulted and upset when they were asked to have a CRB check. They felt that they were no longer considered trustworthy. It appeared that no limit was placed on the number or purposes of these checks. I know that it was also a big expense for the voluntary organisations.

Perhaps I may also touch on the position in the City of London. The City of London Corporation is supporting the Big Society Capital social investment fund and that is to be encouraged. It is giving grants of £15 million a year through the City Bridge Trust and is very anxious to help and support those who are willing to volunteer.

There is a range of other organisations that I could mention but I will single out just two. The first is our churches, a national organisation which has parishes everywhere. I am deeply concerned, however, about the way that our churches are perceived. People sometimes say to me that they are only for those who are Christian and pray in them, but that is not so. The churches are a welcoming house for everybody and I hope that this role develops in the coming years.

The second group which I should like to cover is those who volunteer to help our police forces. In Leicestershire, we have 174 police volunteers within three local policing units and 290 special constables who give over 79,000 hours of service. They are unsung heroes. They are not always seen as volunteers, as many regard them as part of the force, but they are, in fact, volunteers.

I touch, finally, on the work that we in Leicestershire are doing with young people. Leicestershire has many clubs for young people, and why are these clubs important? It is because they welcome young people and give them opportunities. From there, they can grow to become much fuller citizens and, ultimately, go on to help others themselves.

My Lords, I begin by thanking my noble friend Lord Elton for moving this Motion. As he has said, the Government are committed to open government and transparency. The Prime Minister has set out a series of transparency commitments to be delivered within our key public services, including health, education, criminal justice, transport and government financial information. The open data consultation closed on 27 October and I hope that the Minister will be able to tell us something of the responses received and of the White Paper which will follow.

My noble friend Lord Elton referred to the report on privacy and transparency produced for the Cabinet Office by Kieron O'Hara. He stated that privacy is extremely important to transparency, but that they are compatible only as long as the former is carefully protected and considered at every stage. He came up with 14 recommendations, but there are still questions that I pose to the Minister. When does public interest outweigh privacy? Who makes these decisions? What happens when data held are out of date or incorrect? How will this be rectified?

Here in the House of Lords we have, through Written Questions, Oral Questions, debates and our Select Committees, opportunities to hold the Government to account. If we feel that the explanations given are inadequate, we can rephrase the question. Sometimes, however, the answer will be that the information requested is not held centrally or could only be answered at a disproportionate cost. Again, who decides? I hope that this Government's programme for transparency will ensure that this type of response will not be overused.

Personally, I have grave reservations about the way we use computer systems to achieve our goals and particularly the way in which we cede supremacy to them. I give an example: Defra's single farm payment system has been a nightmare since inception. For many farmers and parliamentarians, transparency in dealing with the Rural Payments Agency has been totally absent. Farmers have been heavily penalised for simple, explicable errors in their returns, while the computer systems have proved incompatible, partial or downright wrong. More than once, I and others have had to refer fairly simple solutions to these problems right to the top. Similar problems exist in other departments, and news items over the past 10 days or so have referred to both HMRC and the MoD, for example.

I ask the Minister what operating guidelines are given to government departments and to other arm’s-length bodies to make their work more transparent. Does she feel the present guidelines are adequate and if not, when will the situation be rectified? Clearly there will be other sections of Government where restrictions must remain. I think of our security services and the work of the police force, which could be compromised if unsuitable material came into the public domain. However, this does not mean that nothing needs to be improved. There are aspects which could be made better. The way in which CRB checks are applied needs to be carefully reviewed to ensure that those cleared for working with young children and older members of our community are not thereby freed from all normal scrutiny.

Although nobody else has mentioned it, I cannot be alone in wondering whether we have moved too far in the use of tick-box forms to replace observations and questioning of behaviour. It is very hard to obtain a sensible response when computer data indicate that all is well. Even when examination of those data confirms that there is a problem, it seems to be more normal to tweak the system than retrain or replace the person responsible. Will the Minister confirm that transparency will not remove the normal sanctions for inefficiency?

It is crucial that greater transparency works everywhere as it has already done successfully in some areas. My noble friend Lord Elton referred to the help and development that has come from sharing information in the medical system. Perhaps I, more than most, have reason to be grateful for all those who helped me. It is just a year ago since I had a triple heart bypass. Six years ago, British heart surgeons decided to publish data on how successfully they treated patients. They compared their results and methods to increase the quality and effectiveness of their work. Survival rates have improved by as much as 50 per cent. Sharing of expertise has brought huge benefits.

If greater transparency improves outcomes and helps people to find the right doctor, the right school for their children or benefits them in their daily life, it surely must be welcomed. Open data should bring greater choice. They must hold public service to account and, as we heard earlier, could help to stimulate innovation and enterprise through the sharing of knowledge. However, they could also be irrelevant, out of date, inaccurate, intrusive and an opportunity missed. I hope that this will prove not to be the case.

Might I also make a plea for those who live in rural areas? For all of us who live in urban areas, access to computers and information is readily available, but I remind the House again that there are huge swathes of this country where that access is just impossible at this stage. I hope the Minister will pass this plea on to other colleagues within those departments.

My Lords, I, too, thank the right reverend Prelate the Bishop of Leicester for obtaining this debate. We have already heard some wonderful contributions.

Volunteering is very much the purpose and at the heart of my life, as it is, I suspect, of the lives of many others in the House today. It is crucial for the health and well-being of society. Rather like the noble Lord, Lord Wei, I made my maiden speech some 14 years ago during an afternoon debate following the Deakin report, which had come out earlier that year, on volunteering in this century. Therefore, it has been an enormous joy to hear him speak on how he sees things developing in the years to come. I thank and congratulate him.

It is, I think, impossible to define the big society, but from my own very narrow perspective it is a reflection of a society that is inclusive and available to all, not just a few. It is not important whether it occurs within a local community or countrywide; what is important is that all citizens, whatever their background and whatever their problems or aspirations, feel that it is for them. However, in some ways we have not achieved that. I am disappointed when occasionally people say to me, “Oh, but you’re one of the do-gooders”. For goodness’ sake, we are involved in the community and helping others to achieve, and those people may then themselves help others to achieve. I hope that the big society that we have will be more inclusive and open-ended than perhaps it has been in the past.

I turn to one or two of the practical problems that our voluntary organisations and charities currently face. In doing so, I hope that the Government will look at whether there are ways in which we can help those involved in volunteering so as to overcome some of the hurdles that they encounter at the moment. As we know, volunteers come in all shapes and sizes. They give freely of their time, skills and good will, and often receive no recompense. The latest figures that I have on cash input into voluntary involvement in the UK put the total expenditure at £35.5 billion, of which 38 per cent, or £13.5 billion, comes from the public sector. Three-quarters of our voluntary bodies receive no public sector funding, while a mere 27,000 out of approximately 180,000 charities take more than three-quarters of it. That means that very few charities are taking a huge amount of money from the available pool. The question of whether the value of what they give needs to be reviewed perhaps deserves reflection.

I shall touch briefly on the importance of tax relief to charities, which in 2007-08 brought in £2.2 billion. I hope that in times of financial difficulty, not just for the Government but for us as individuals, that money will be protected.

Reports on the voluntary sector are regular but contain rather old statistics. To me, the important point about volunteer groups is that they vary so much, whether big or small. One can grasp very easily by looking at the Honours List the depth and breadth of voluntary activities, but perhaps I may highlight one that I noticed in the most recent Honours List. It is a recently formed charity that was established in reaction to a need—Help the Heroes. In moving forward, I hope that whatever view the Government take, they will be flexible in their approach and that they will allow new charities to come about in response to society’s needs as they arise.

Many of us have worked in long-established and well recognised charities and organisations. It is well known that I spent time with the WRVS. The noble Lord, Lord Judd, said how important it is that one is innovative. From the WRVS, which started in the Second World War as the WVS, came Meals on Wheels, work in hospitals and work with children. It was very innovative. Some of that work has been taken on by the state, but that organisation allowed individuals to develop in ways that perhaps has not been so easy to do in more recent times.

Some of our volunteers are frustrated by faceless individuals in London demanding the completion of many forms. They resent the implication that they are not competent to act on their own without supervision from afar. They also abhor the emphasis on training, which often requires them to travel some distance at their own expense to attend courses which help them not at all, but just inform them about new legislative interference. I was surprised to be told by a friend, who is a long-term volunteer, that she was expected to obtain CRB clearance to work for nothing for four hours a month in a charity shop and was then expected to attend a further two hours training for each of the first six months. Some requirements are certainly over the top.

I ask the Minister whether the Government will look again at CRB clearance. If someone gains a certificate of clearance, that should cover them for more than one charity and more than one responsibility. There is also a cost to organisations as an individual volunteer cannot do it. That is one practical, important suggestion. It is ludicrous that someone who gets clearance with one organisation cannot then perform a job with another organisation.

I am aware that there is some difficulty in attracting younger people to support the elderly or to encourage children to play football, join the Scouts or Guides or take up a hobby. Their abilities to raise the funds necessary to do short, intensive stints abroad building schools, digging wells, teaching English, and so on, fill me with admiration, but they have a problem in acquiring the support they need. I hope that we shall look at new ways to help individuals to volunteer in a more fulfilling way.

I count as volunteers those who serve on parish, town and borough councils. They are hugely important, particularly at election time. However, sometimes we cannot attract young people to stand for what I call traditional posts. Young people who come into voluntary organisations perhaps did not volunteer some years ago and they tend to want to respond to a cause, to a particular charity or event. For example, my granddaughter will shortly be walking the three peaks to raise money for a local hospice. That is a one-off, very good example of slightly more informal volunteering which perhaps is not recognised in the bigger society but which plays an important part.

Returning to CRB clearances, I was very upset to hear that on one occasion a local authority organised a Scout camp which had to be cancelled due to a local flu outbreak which reduced the number of vetted parents available to volunteer. One parent had St John Ambulance clearance but he was not cleared to volunteer with the Scouts. That is madness. I hope that these practical suggestions will receive consideration.

Noble Lords have also talked about the most precious part of volunteering within families. We have mentioned the role of grandparents helping out with their grandchildren, but I pay great tribute to many young people who are the main supporters of some families because a parent is unwell and cannot cope. They hold the family together and attend school. In that context, I pay great tribute to the organisations that give such carers a break and give those children a chance to be children, because so often in their daily routine they are unable to.

With the spending review looming large and money being tight for individuals, charities and the Government, there are ways in which we can try to help to encourage communities to grow. I would hate to think that there is a “one size fits all” answer, because life is not like that. Things that work in a little village where I may live may not work in an inner city. On the other hand, London is a big city but it has its own communities within it. They are literally little parishes. If the Government can help and encourage them to feel an identity and to grow, that will be a huge success.

Another thing that worries me, with the cuts and the financial difficulties that we face, is how we as individuals and a community respond to these challenges. It is all very well coming here with rose-tinted glasses saying, “Everything will be all right and if we all pull together, it will be wonderful”. But there are real problems and real challenges along with real opportunities as well. I was taken by a recent article by Stephen Bubb, the chief executive of the Association of Chief Executives of Voluntary Organisations, entitled:

“The Big Society: Moving from Romanticism to Reality”.

We need to be very firmly placed, with our feet on the ground, to realise what we can and cannot do together. There is nothing worse than taking on something, realising that we cannot do it and therefore failing. On the other hand, in whatever way we can, we should help others.

I hope that I have given one or two practical suggestions to the Minister when she comes to wind up. There are no easy answers. I have worked in big organisations; I have worked in very small ones. The organisation that I mention in particular is the Leicestershire Clubs for Young People, which the right reverend Prelate the Bishop of Leicester and I know well. It is a very good example of young people coming in to help each other. In the old days, it was the Leicestershire Boys’ Clubs, and a lot of youngsters joined because they liked playing football and being together. Of course, nowadays, in our modern society, you cannot have boys clubs, so they are clubs for young people and we have boys and girls, some of whom play football. The whole idea is that, through the development and experience they get, many of them stay on to become leaders in the group. The difficulty for them, the Scouts and many other organisations with which I am involved, lies not in the younger group but in retaining some of the more senior teenagers to help with the older ages within those groups.

That is but one challenge. There are many out there but, to me, the concept of the big society is the crux of making sure that everybody feels that they can play a part. Although they come from different areas and may not have those aspirations, I hope they feel that this Government welcome them and that they have a role to play.
