Lords ChamberI thank my noble friend for her Question, her follow-up question and the tenacity and commitment she has shown on this issue. The new specialist course will form part of a continuous training package for asylum decision-makers, technical specialists and senior caseworkers. UKVI expects to roll it out in early 2019. UKVI has an internal audit process to assess the quality of decisions and interviews and the application of policy. Allowed appeals are also regularly analysed. In addition, independent audits are carried out by the operational assurance and security unit.
My Lords, there was considerable publicity around the case of the Pakistani humanist Hamza bin Walayat who failed his asylum application in part, it is thought, because he failed to identify Plato and Aristotle as humanists. What steps will the Home Office take to ensure that asylum assessors are better educated about the beliefs of non-religious people, including humanists?
The noble Baroness outlines precisely why training in religious literacy and indeed about those who have no beliefs or are humanists, which is a belief in and of itself, is required in order to make proper decisions.

How could one not have realised for so long that mothers’ names have not been on marriage certificates? What an extraordinary accident of history that that has not been acknowledged. I relish the idea of putting the 84,000 marriage registers out of order and digitalising the process. It is well overdue as an enterprise.
As the noble Baroness, Lady Meacher, has already said, I am using the occasion to raise an issue where this Bill, by amendment, could bring to fruition a long-hoped-for reform of marriage laws, which I understand is within the scope of this Bill—the legal recognition of humanist marriages in England and Wales.,
Let us revisit the history, because it is very telling. As we have heard, five years ago the Marriage (Same Sex Couples) Act promoted major debates in the House of Commons and in this House in which many spoke in favour of such recognition, but the Government did not act as we had hoped. Their own amendment gave a power in the future that is enshrined in Section 14 and which mandated the Government to consult. They did so and found that more than 90% were in favour of registering humanist marriages. They asked the Law Commission to do a scoping exercise. The commission did so and emphasised the unfairness of the situation as it exists. There has been consultation and there has been inaction.
Elsewhere, things have changed. In Scotland, legal recognition of humanist marriages was passed in 2005 and by 2016, 17% of marriages in Scotland were humanist. This is a popular format for people of humanist belief—I will expand on that term in a moment. Humanist marriages were given recognition in the Republic of Ireland in 2012 and by 2016, 7% were humanist. Northern Ireland is similar to England, so civil and religious marriages are legal but humanist marriages are not, or at least not yet. Last summer, the High Court in Belfast ruled that under Article 9 of the European Convention on Human Rights, recognition must be extended to humanist marriages. That decision has been stayed pending an appeal to the Attorney-General for Northern Ireland and a decision is expected soon. Meanwhile Jersey has issued a new draft law which is expected as soon as next week. Change is afoot to recognise with generosity and sincerity a commitment to acknowledge humanist marriages.
Humanism and a humanist marriage are not the same as a civil ceremony. Humanists have a set of moral beliefs that command huge respect throughout the belief communities of this country. Humanist beliefs involve an acknowledgement that we can live ethical and fulfilling lives on the basis of reason and humanity. These beliefs are recognised and widely held in this country. They put the burden of moral behaviour on the here and now in this world. It is an increasingly popular way of expressing a spiritual outlook that does not acknowledge the supernatural, and it is recognised by many of my Christian friends.
I am most grateful to the noble Baroness. Along with other speakers, I strongly support this admirable Bill which has been introduced by the right reverend Prelate. I hope that he and the House will be able to accommodate the amendment which is being moved by the noble Baroness.
I will move the amendment when, as I hope, the Bill goes through to the next stage. It is time to legally recognise such sincere marriages where people come together with a shared set of beliefs that simply have not yet gained recognition in England and Wales.
The issue is not solemnisation but registration, which the Government have shown no opposition to. They merely ask for consultation; the consultation approves. They refer to the Law Commission; the Law Commission approves. It is not an issue on which the Government are offering any opposition; it is simply a matter of implementation according to their judgment.
Perhaps I may continue to explain. The Bill only includes provisions to introduce a schedule system and to change how marriages are registered to facilitate the changes to the marriage entry to include both parents. That is the scope of the Bill. It is very narrowly about marriage registration and not about solemnisation. It is not intended at all to include wider marriage reform.

Lords ChamberMy Lords, I confine my comments on the shortcomings of this Budget to the two words: social care—a sin of omission, if you like. The subject has been raised by my noble friend Lord Tunnicliffe, and others have mentioned it. We are promised a Green Paper in the summer. How long do we have to wait?
The social care budget and its policy was already a problem in 2008, when I took up the position of voice of older people for the Government. It was still a problem in 2011 when Andrew Dilnot published his report proposing a cap on individual costs. At that time a sum of £35,000 a year was suggested, it went up to £50,000, then it went up to £72,000 and now we understand that the idea of a cap on individual contributions has been dropped. A rather cobbled-together proposal in the hurry to get the Conservative manifesto together had the seeds of a good solution in it, but it was dismissed by the tabloids as a “dementia tax” and when you invent such a phrase, it spreads like wildfire and the issue becomes politicised. Social care has become politicised. That is because the older generation—older people—are often represented by the media, but also in people’s minds, as doing very well at the moment.
The noble Lord, Lord Tugendhat, said how privileged we all are, because those of us of a certain age can draw the heating allowance. The heating allowance is the same amount as our daily allowance—we are, indeed, extremely privileged—but “the old” is not a single cohort of people like us. The Rowntree report this morning announced that there are 300,000 more old people—pensioners—currently in poverty than there were, so the old are not a single unit. The triple lock, much used to reinforce the well-being of the less well-off, is used to hammer the likes of us, who are seen to be benefiting. Something needs to change about the use of social care as a political weapon. Would the Budget do something about it? It failed.
The heating allowance is £300 a year. Who needs it? I was stopped in the street by Robert Plant, a multibillionaire rock star, of Led Zeppelin. He said, “Joan, I’ve been sent £300 by the Government. Why?”. Why indeed? The heating allowance for older people should be means tested. When I first received it, I tried to send it back but I was told it could not be accepted. There was no facility for taking it back. I, like many others like me, and perhaps like other noble Lords, give that heating allowance to charity, but it could be means tested if it were added to the income tax statement of our income.
When I speak to young people about how they are going to live their life and choose a career, I say to them, “Have you thought about the care sector?”. It should be a marvellous opportunity. It should be a booming sector of the economy. In fact, it is a basket case. There is a huge demand: there are 15,000 centenarians this year—this will have doubled by 2030—and 500,000 people aged over 90. The numbers are increasing. This is a demand that will go on increasing. In market terms, that is a marvellous invitation to people to supply social care. Why is it not happening? It is not happening because society has not decided who is going to pay for it. There is an illusion, shared by many, that social care came in with the National Health Service and support from the cradle to the grave included social care, so people resent the idea that they have to contribute to it. It comes as a shock to them and causes resentment. At the same time, it suits many people to feel that it is the burden of the state to pay for them, whatever their wealth assets might be, and there is an unwillingness to contribute from assets such as their own houses.
So we have a situation of an increasing demand that we are failing to meet. This is a failure of a Tory Government who supposedly believe in the operation of the market. Yet there is a funding gap now predicted for social care of £1 billion. The Government spend £140 billion on old people; 6% of that goes on social care. This is bad economics and bad social care. Will the Government please sort it out and will the Minister use those two words—social care—in his response?

Lords ChamberMy Lords, it gives me great pleasure to speak immediately after such an excellent maiden speech from the noble Lord, Lord Palumbo. It is great that he chose such a debate—it was rather bold of him—and very indicative of his business acumen that he should be contemplating the appointment that we would all welcome among his senior staff.
Today we have heard lots of statistics and a scattering of percentages, full of aspiration and achievements so far, and I commend my fellow Peers on the range of subjects that they have already covered, praising things that have gone well and expressing widespread concern for remaining issues. I will take a different, slightly lighter note.
I will begin by celebrating a single overarching triumphant professional success. The novelist JK Rowling has now earned her way to being the richest working woman in the country. She is currently worth £220 million and last year earned £45.5 million—not bad for someone who trusted to her own talent and began her first fiction at a table in a café in Edinburgh.
Now I want to celebrate some less well known names: a group of women, some of whom your Lordships may have heard of and others you may well not have. They do not earn a great deal of money—yet. Indeed, their chosen path has often involved denying themselves any kind of decent living as they struggle to get started. They are not household names—yet—but their influence is manifold, and I will explain why. I refer to the surprising blossoming and coming to top professional recognition of a whole swathe of women playwrights. This has happened in the past 10 years or so, encouraged by a background of arts funding in this country that allows for the experiment, daring and risk-taking that a fully commercial theatre world would never make possible.
I will name some names. The grandmother of them all is probably Caryl Churchill. She is now 74 and she established an international reputation in 1972 with her inspirational play, “Top Girls”, at London’s Royal Court Theatre. This sensational work broke new ground in dealing directly and vividly with the situation of women in society. Many of these young writers do the same. Nina Raine is the author of a searing, witty and critical look at the National Health Service. April de Angelis is the author of “Jumpy”, a play starring Tamsin Grieg, currently in the West End. debbie tucker green won an Olivier award in 2003. Polly Stenham’s first play, “The Face”, written in her early 20s, transferred to the West End and then to Broadway and won a shoal of awards. Laura Wade’s play “Posh”, a satire on a club not unlike the Bullingdon, was a West End hit. Lucy Prebble wrote “Enron”, a hilarious and clever take on the Enron scandal—you could not get a ticket. Lucy Kirkwood, Bola Agbaje and Abi Morgan are of that number, as are Sarah Daniels, Helen Edmundson—your Lordships get the idea. Rebecca Lenkiewicz was the first woman to have an original play, “Her Naked Skin”, performed on the National Theatre’s main stage. Moira Buffini’s play “Handbagged” is coming to the West End.
All those primarily young women write of the world they know and as women in that world. They are significant in two ways. First, they put ideas into circulation: ideas about women, their rights, lives, problems, humour and situations. Those ideas are not only entertaining in themselves but are challenging for the audiences who see them and spill out into the world beyond to families, communities and public life. They help shape and change national attitudes.
Their second significance is in contributing to the thriving cultural industry of this country. The turnover of the arts last year was £12.4 billion. Despite the economic downturn, the arts economy did not suffer; it kept on growing. There are many women among its leaders. Women run the Donmar Warehouse, the Tricycle Theatre, the Liverpool Playhouse, the Royal Court Theatre, the British Film Institute, Film4 Productions, the Whitechapel Gallery, the Serpentine Gallery, Tate Modern and the South Bank arts complex, and they do this with the overt and positive encouragement of their male colleagues. It is an ongoing and impressive story of creative and economic success.
There is a completely different story of success that I think we should remark on. It is totally unlike the bright lights of the theatre but it is a success that contributes some £119 billion to the economy, not in direct earnings and income but in economic value to the country. There are some 7 million carers in this country, many offering their care totally freely, others in receipt of a derisory carer’s allowance. Unpaid carers are the backbone of our health and social care system: it would collapse without them. Now, 58% of those carers are women. Women have a 50:50 chance of becoming a carer by the time they are 59; for men, it is not until they are 75. Many of them give up work in order to care. It is this cohort of women, mostly in their 50s, who, in giving up their working lives, indirectly contribute to the saving of £119 billion for the country. They deserve our respect.
My Lords, it is an immense privilege to take part in this debate. We are treading the courageous path of brave women and we are emboldened by their struggles and confidence. It is a pleasure to follow the noble Baroness, Lady Bakewell. I would have added Gurinder Chadha and Meera Syal—
—to her illustrious list of those who have contributed immensely to the arts.
I speak today in recognition of the centuries-long struggle by women to participate freely and equally in the workplace. When New York’s garment workers took to the streets on 8 March 1857 to demonstrate for a 10-hour day, better conditions and equal rights, they inspired the first International Women’s Day half a century later. Remembering their march, I also remember the more than 1,000 women who perished only last year in the Dhaka factory disaster. We continue to mark the day, not out of nostalgia but because we are still plagued by inequality and injustice in all our worlds.
Too many women want to work but are prevented from contributing as fully to the economy as they wish. I have spoken in this Chamber on a number of occasions about the fact that only a quarter of Bangladeshi and Pakistani women are economically active. That is a terrible waste of talent. At Questions we spoke about the role of women in public life. I want to trade some statistics with your Lordships. There are about 300,000 Bangladeshi women who are British citizens and not one of them has made it to the Benches opposite. I hope that the noble Baronesses, Lady Jenkin and Lady Northover, will do something to address the lack of Bangladeshi women on their Benches.
This is not just a question of prosperity for our country but is about justice for women. We cannot have whole communities of women excluded from our mainstream institutions and workplaces. Over the past year, I talked with a number of women’s groups that visited Parliament and asked their views on why women feel excluded from the workplace. The reasons they provided are not new. Many face social, cultural and institutional barriers. Many say they are not qualified or educated enough or do not have access to adequate childcare. The Family and Childcare Trust revealed only this Tuesday that on average the annual cost of childcare exceeds the repayments on a mortgage. As childcare costs soar, women are pushed out of the workforce to care for their families or into other caring responsibilities. Many will never return full-time, at a cost to their career progression and our economy.
Many women, including those from minority communities, who care for children or adults with disabilities face insurmountable obstacles and prejudice that prevent them working. It has been mentioned that nearly 7 million carers—nearly one-10th of the population of England and Wales—provide unpaid care for a disabled family member or friend. We know that the majority of them are women. They make a huge contribution to the economy as well as enhance the quality of the lives of those for whom they provide care. We have come a long way in providing safety nets within the framework of the law and have countless examples of good facilities in the education and childcare sector. Yet so often parents hesitate to explore outside work, lacking confidence that those they care for are in safe hands. There is a huge disparity between the intentions and rhetoric of institutions and service providers on the one hand, and the reality on the ground and the experience of carers and people with disability or disadvantage on the other.
I speak from personal experience as the mother of an autistic son. We have struggled for more than three decades and I confess that it has been without any support or co-operation from the education system or local authority. I have been fortunate to have support from my husband and I managed, mostly badly, a full-time career. Too many others are not so fortunate and paid work and caring responsibilities are often incompatible. The National Autistic Society discovered that a third of carers under the age of 40 would like to work but feel unable to do so. I know that many employers have adapted good practice in enabling flexibilities in their workplace to accommodate carers’ particular needs but this is not universal. Do the Minister and her department have statistics on how many parents with disabilities or disabled children work in the department? What lessons, if any, can we impart to others as good practice?
There has also been remarkable progress about working hours even in this House. I recall my early experience of this House when motherhood and childcare were absent from Parliament’s cultural DNA. A number of noble Lords here today will recall when a number of us made our maiden speeches about family-friendly policies in the House. I think that began at 10.40 pm and finished about 12.40 at night. When I brought in my then seven or eight month-old son for one hour on the first day I arrived here, the following morning a newspaper reported it as a slur on the professionalism of the House. Little known at the time or since is that as I was breast-feeding the entire side of my shalwar kameez was wet and it got on to the table. I have often wondered what the newspapers would have made out of that. The following morning, the honourable Black Rod promptly came over as soon as I entered the House and gave me a key. He said: “Here, Baroness Uddin—a key to the House’s family room we have just made for you downstairs, off the Peers’ Entrance”. Needless to say, I have never brought my son in since then or used that room. It was such a harsh lesson. I am glad to say that children can now accompany noble Lords—their parents—through the Lobby when we divide. That is, even symbolically, a definite triumph.
Like thousands of others, my family had to adapt all aspects of our lives in light of our son’s autism. We encountered a system of social care unresponsive to his and our needs and unwelcoming of us as carers. Securing the support of social services demands the tenacity to navigate a labyrinthine system and strength to endure scepticism and delay. Accessing these services while caring for a disabled person can be a full-time job. Our failure to serve the needs of those with disabilities and those who care for them comes at a human cost and with misery, as well as causing economic disadvantage. We as a family just gave up and opted out of the system into the family support structure—which was often at breaking point.
That is not an option for all and there have been many tragedies. Let us not forget the tragic case of Fiona Pilkington and her daughter Francesca Hardwick, a person with severe learning disabilities who suffered bullying and harassment. The failure of institutions and society overall to protect her family meant that Fiona Pilkington chose death for herself and her beloved daughter. In a civilised nation, that woman’s choice of suicide and death is a profound indictment of our support for society’s most vulnerable. How will the Government improve daycare for people with disabilities—autism in particular—to better enable their mothers and carers to pursue paid work where they desire, without putting into jeopardy the well-being of those they care for?
Finally, how do the Government intend to increase the employment prospects of Muslim women, who remain in the periphery of our society and are so poorly represented in the workforce, institutions and the boardroom? Will the Minister agree to meet the British Bangladesh Chamber of Women Entrepreneurs, which is working towards addressing some of these goals?
As a House, we are vocally committed to freeing women from violence, forced marriages and female genital mutilation but pay too little attention to the part that poor education and lack of economic independence play in these scourges. Debarring women or carers from opportunities for paid employment is a matter of not only individual interest but national prosperity. Without addressing these questions, we will hold a large number of women back from making their rightful contribution to our economy. Yes, we celebrate today the record proportion of women in the country who work and are in positions of authority. Long may that emancipation continue and widen. I salute those women who have blazed the trail of equality and justice for us all. Now we must be brazen about demanding the changes required. Above all, we must acknowledge that our economy and the fabric of our society will benefit exponentially when we are inclusive of all our countrywomen.

Lords ChamberMy Lords, I welcome this debate enormously and pay tribute to the noble Baroness, Lady Massey, for initiating it. I agree with what has been said so far, that this is a core undertaking for our society at this time.
I pay tribute to the previous speakers for their detailed knowledge of the complexity and sheer bureaucracy involved in trying to acquire childcare at all. However, I thought that I would take a longer view and look at how we got into this mess in the first place—of patchy, expensive and unsatisfactory provision, which must be addressed. I go back a long way. For the generation before mine there was no childcare. My mother left school at 13 to help look after her seven siblings. The women of my generation who went to university and certainly wanted to have jobs made do with au pairs—untrained, unchecked young students from abroad who had to be given time to study and who “babyminded” for a few hours each day. They were not always satisfactory. One of them filled the wastepaper baskets in my home with syringes, another started to wear my clothes when I was not there and a third set the house on fire. This form of childcare is not recommended.
However, in the 1960s, John Bowlby developed his attachment theory, which was an extremely important part of the research into childcare. He wrote Separation: Anxiety—what a phrase. This enormously important research seeded a sense of guilt across the whole female population about their responsibilities to their children. Before then we had not realised how guilty we should feel about the way we treated our children.
From another direction came Dr Spock and Penelope Leach, who told us how important it was for children to be at the centre of family life. They became the focus of attention and concern to a far greater extent than they had ever been in the past—indeed, that was certainly not the case in Victorian times—so we have a collision course between child-focused families and guilty parents.
Women will rush into the workplace more and more; there is no going back on that social trend, which is the most important one for women that has occurred in my lifetime, but public policy is slow in catching up with that trend. Eventually, flexible parental leave and maternity leave were introduced, so progress has been made. We now have job sharing, LA funding and the provision of childcare places. Progress is slow and, for historical reasons, is patchy. No one has really taken on board the fact that this is a large-scale, ongoing social change that cannot be defied. We have to go forward. However, in some regards we appear to be going backwards. It is amazing that that could happen after a history of some 50 or 60 years of progress.
I am glad to see that a plaque has been unveiled to Mrs Pankhurst and acknowledge her achievements in the area of childcare, but that occurred a long time ago. There are now 575 fewer Sure Start establishments than was the case previously. That serious and important loss will increase the anxiety and guilt felt by mothers looking after children. We are seeing the costs go up all the time. That, again, creates anxiety for women. I hope that it also creates anxiety for fathers. It is interesting to note that this debate is dominated by women recounting their experiences, anxieties and guilt. Can we make this a social issue which needs to be resolved for everyone?
We have heard about the importance of this issue in terms of social mobility and its value to the economy. There is no doubt that the direction of travel must be sustained. I simply ask the Government to endorse the fact that this major social change has to go forward. Will they please resume the progress that has been made so far, take on board the status of this issue, pledge resources and planning to it and remove the bureaucracy and problems that have stood in the way of women and which continue to make them feel anxious and guilty? They should not feel that way.

Lords ChamberMy Lords, I am delighted to speak in this debate and I congratulate my noble friend Lady Jones on bringing it forward. It sits very happily in parallel with the debate brought forward by the noble Baroness, Lady Wheatcroft, some weeks ago. She made the economic, nuts-and-bolts argument for the arts, and today we deal with the real core, civilising values of the arts in our lives.
What is the price of joy? What is the price of celebration? How do you cost the human rewards of the Last Night of the Proms? That is the climax of more than 100 concerts, over eight weeks, playing every night in the Royal Albert Hall to audiences of more than 6,000 people. It is the world’s largest, most democratic musical festival. It is, in many ways, beyond price. It involves enormous performances of world class. As you will be aware, the last night inspires sentiments of warmth, loyalty, patriotism and fellow feeling. People come pouring out of the Royal Albert Hall, alive with joy. How can you cost that?
At the other end of the year, there is the Messiah, sung in 1,000 churches and enjoyed by amateur groups who come together to give their own performances. It is true that singing is an exercise for the lungs and for breathing, but it is an exercise also in the recognition of the awesomeness of music. Choirs across the country share pleasure in that—a pleasure beyond price. Music also plays a big part in the lives of the handicapped. I have personal knowledge of this. Small children who cannot speak can sing. I bear witness to the fact that they can sing loud and often and that they enjoy it very much.
I will be more serious for a moment because I want to speak of the more profound rewards of the arts. The arts teach us what it is to be human, to know ourselves and to know others. In the 1790s Wordsworth stopped at Tintern Abbey and tried to recall how he had been moved when he had been there five years earlier. “Lines Composed a Few Miles above Tintern Abbey” reminds us that,
“with an eye made quiet by the power
Of harmony …
We see into the life of things”.
That is what the arts do. We see into the life of things. Consider human activities which we all take for granted such as the relationships between the sexes and the joys and crises of marriage. Think of Shakespeare’s Beatrice and Benedick, “the married man”, Strindberg’s “The Dance of Death”, Ibsen’s “A Doll’s House” or Edward Albee’s “Who’s Afraid of Virginia Woolf?”. Who can say that seeing these works does not help us see into the life of things? That is what we seek when we teach children through the curriculum about the lives that they will live in the communities that they will be a part of.
It is not just personal, either. Empathy matters in the lives we live, one with another. Empathy is the understanding of the other. It is the attribute psychopaths lack—the capacity to understand others. Callousness, cruelty and murder follow. That is why, when the arts go into prison, they make a real difference. Acting companies take the plays of Shakespeare to prisoners and then stay to discuss with their audience, the inmates, what are human motives and what are the feelings of other people. That helps the prisoners grow to see their own lives. It helps them to see into the life of things.
Finally, as it is summer, I must mention literary festivals. There are now more than 250 of them in this country, events to which authors come to talk about their books to audiences that grow year on year. These festivals have spin-offs abroad. There are now festivals in north Africa and Mexico that are run from this country, and next year I will go to Burma in the footsteps of George Orwell. These festivals are arenas of ideas. I chaired a debate in which two Egyptian feminists came to discuss the role of women in Islam. There was an audience of more than 1,200 people. These places are indeed the cradle of ideas, debate and exchange. At a time when human discourse and the popularity of political meetings are perhaps on the wane, these places are locations where the debating of ideas and politics is gaining strength. They are places of ideas, opinions and cultural exchange.
That is my case to the Government: celebration, insight, empathy and intellectual exchange. The arts lead us to see into the life of things. They deserve a higher place in the school curriculum than at present. As we know, dance scarcely figures and music is neglected. We want our children to see into the life of things.
