Lords ChamberMy Lords, I congratulate the noble Lord, Lord Randall of Uxbridge, on sponsoring this important Bill and on its introduction. I can honestly say I have never spoken in a debate on such a short Bill before—four paragraphs in two Clauses—but length does not indicate importance, and this is a very important Bill.
I am grateful to the House of Lords Library for their briefing. The Crown Estate Act 1961 grants a lease to the Zoological Society of London, for their use of the land in Regent’s Park. This Bill seeks to extend the length of the lease, in order to carry out much-needed modernisation. I remember in 2019, when the noble Lord, Lord Gardiner, was the Defra Minister in this Chamber, the passage of the Kew Gardens (Leases) Act, which had a similar clause to extend the lease to a maximum of 150 years. Both Kew Gardens and the Zoological Society of London require long leases in order to operate and plan for the long term—not dissimilar to farmers; for farmers, a much shorter lease than 150 years is required but certainly one that provides for future planning.
Members taking part this afternoon have eloquently listed the extensive benefits of the work of conservation done by ZSL. Both at its Regent’s Park base and at Whipsnade, ZSL does a tremendous amount of work ensuring the more vulnerable of our planet’s species do not become extinct. At one end of the scale, we have the black rhino in Kenya, which has been decimated by poaching, and at the other end, our own indigenous hedgehog, with currently dangerously low numbers. Both species are iconic in their own way. Sadly, it is the intervention of the human species that has led to the decline of both those species but in different ways.
The noble Lord, Lord Evans of Weardale, referred to the essential preservation work done by the ZSL. The zoo at Regent’s Park and the wildlife park at Whipsnade are efficiently and creatively run by ZSL. I am a great supporter of zoos, and while it is undoubtedly true that animals should be living in their natural homelands and habitats if at all possible—I have been very lucky to experience some of this—this is not always in their best interests, especially when their numbers are dangerously low. The noble Lord, Lord Camoys, told us about the vital work of the ZSL in Nepal, and I am grateful to have heard that.
The work done by zoos is essential in helping children to understand the breadth of species in the world, the difference in their habitats and the need to preserve those habitats for their survival. We can all watch wildlife programmes on the television, which broaden our knowledge of the animal, bird, insect and sea-life kingdoms, but there is nothing quite like seeing live animals at close quarters. The immense wonder and awe at standing the other side of the barrier to a giraffe, or watching a chipmunk scurrying at top speed through overhead tubes and tunnels, is something I and my children have enjoyed. I want this experience for every child, if possible, as demonstrated so eloquently by the noble Lord, Lord Bethell, and his—delightful, I am sure—children. My noble friend Lady Featherstone also referred to this sense of wonder.
I want this experience for every child, as I said. It is only by demonstrating the vast number of species there are in the world that children will grow to understand how important it is to protect them and preserve their habitat. The Zoological Society of London does a first-class job in conservation, preservation and education. It does not benefit from grants, as has already been said, and needs investment in order to expand its vital work. I fully support this Bill, which will allow the ZSL to continue well beyond my lifetime.

Lords ChamberMy Lords, I congratulate the noble Lord, Lord Bragg, on securing this important debate and on his excellent and powerful introduction. We have heard some very knowledgeable contributions today. Mine is very different.
Small children can express themselves through art with paper and crayons. A roll of lining paper and a pot of felt-tip pens and they are away. Do not ask, “What is it?” but try, “Tell me about your picture”. Have at least one contribution pinned up around the home somewhere. Plasticine and FIMO are also great starting tools to encourage children. If talent is there, nurture, develop and encourage it. Art therapy and the use of drawing is often used in cases of children’s bereavement or abuse, to help them express what they are feeling and to say what happened when they do not have the words to do so.
The digital age and the computer have moved the pace on significantly towards graphic design. Advertisements and packaging are there to sell us something that we did not know we needed or wanted, but this all helps the economy. The cultural aspect of the creative industries is unquestionable. From deciphering the contributions of a four year-old to standing in front of a work of art from a grand master, our hearts and spirits are lifted, making us smile and sometimes cry. Art improves our mental health, keeping us going and economically active.
Whether inside or outside, art has a part to play in the economy. We flock to see a play in a theatre; we save up to visit the Royal Opera House to see ballet, which is so transporting, or an opera, which is so dramatic; we visit galleries, which are calming and thought-provoking. A visit to the cinema gives a much better experience than viewing on the small screen at home, more convenient though this may be for many. Music calms the troubled soul and there is nothing that comes close to the experience of a live concert.
I return now to the younger generation, the classroom and the national curriculum, which other noble Lords have referred to. Art is squeezed out. Visits by theatre groups to schools lift the children out of their routine and give them a different aspect on life. Playing an instrument gives a great sense of achievement. Some art forms are more squeezed than others: music, for instance. Drama, acting and painting get a reasonable allocation of time. Ballet tends to be after school and at weekends. Sculpture is not so good. For ceramics or craft pottery, it is reasonable, but if you might be the next Grayson Perry someone will need to keep a foot in the door for you.
Art foundation courses give limited time to various art forms. Two weeks for clay is insufficient to discover if it might be your medium. All art forms need space on curriculums at all education stages to ensure they survive. There would undoubtedly be an effect on the economy from their disappearance, but the effect on the mental health of us all would be very significant if our art choices were restricted and some forms disappeared altogether.

Lords ChamberThe noble Lord is right and, as my right honourable friend the Secretary of State set out in her Statement in another place, we are conscious that this is something that millions of people do for enjoyment with their own money and without harm. We are also conscious of the significant changes to gambling since Parliament last legislated on this matter in a substantial way through the 2005 Act. That is why we held the consultation, have taken action and are carrying on with that work in the meantime. The noble Lord is also right to point to the dangers of the black market. We are very mindful of where people will turn if we do not get this right.
My Lords, I declare my interest as a member of the executive of Peers for Gambling Reform. I welcome the contents of the White Paper on gambling, which, at last, takes us forward in helping those trapped by addiction to gambling. However, I was extremely disappointed to see that gambling advertising continues unabated; it is virtually impossible to avoid. TV advert breaks all include the dubious benefits and enjoyment of gambling. Similarly, radio stations are peppered with adverts for the large sums of money that can be claimed for the price of a £2 phone call. Can the Minister say why that invidious advertising has not been tackled in the White Paper?
We have been led by a close assessment of the latest evidence on the impact of advertising, which suggests that there is little evidence to show that exposure to advertising leads directly to harmful gambling. However, we recognise that it can have a disproportionate impact on those already suffering harm, and our aim therefore is to tackle aggressive practices. Robust rules are already in place to ensure that advertising is socially responsible and that it cannot be targeted at children, as I mentioned earlier. New rules were introduced recently to strengthen protections for children and vulnerable adults. Targeted restrictions on advertising are just one part of our wider approach to protections, which also includes making products safer and introducing financial risk checks.

Grand CommitteeMy Lords, I congratulate the noble Lord, Lord Grade of Yarmouth, on setting out the case for gambling reform so eloquently. I regret that I was not a member of his Select Committee. I declare my interests as a vice-president of the LGA and a vice-chair of Peers for Gambling Reform.
The report Gambling Harm—Time for Action covers many aspects, including personal and economic. It made more than 50 recommendations to alleviate the problems associated with gambling harm, including bringing loot boxes in video games within the scope of the Gambling Act 2005. Children are particularly targeted via these, as the noble Viscount, Lord Colville, alluded to. Gambling can take place in many ways: at a racecourse, at a sporting event, online, at a casino or in a betting shop—there are myriad ways to do it.
District and unitary licensing authorities have a statutory role in regulating local gambling premises. Licensing and planning teams do their best to prevent gambling-related harms occurring on premises. This may include identifying specific local gambling risks. Currently, councils do not have the power to prevent new gambling premises opening. These could be sited close to schools, treatment centres or housing estates, thus leading to a situation where several gambling outlets may be close together, making it very difficult for those with addictions to avoid the temptation to gamble beyond their means. It is therefore important that councils are given powers over the possible location of gambling outlets in their areas in order to prevent clustering. This would help reduce the risks to the vulnerable. Are the Government prepared to consider this?
There is a difference between gambling in betting shops, online gambling and the gambling that takes place at a racecourse. Being shut indoors with a computer or mobile phone and continually betting online because you have an addiction that is ruling your life is a miserable existence. But the gambling that takes place in the open air at a racecourse needs a more nuanced approach. The business models that apply to off-course and on-course gambling should be acknowledged and dealt with differently. In both instances, the identification of problem gamblers should be simplified, and effective measures should be taken to ensure that those addicted cannot gamble beyond their means.
Running up thousands of pounds’ worth of debt is deeply depressing, and help should be readily available to those affected. Gambling can be fun—many enjoy the occasional flutter—but it can also become an overwhelming addiction that ruins lives. It is important that gambling harms are clearly understood and that education, prevention and treatment programmes are sufficiently well funded to be accessible and effective. The isolation caused by the pandemic and the current cost of living crisis, coupled with a significant move to online gambling, are putting an increased number of people at risk of becoming entrapped by gambling.
The introduction of a mandatory 1% levy on gross gaming yield for the gambling industry, to help to fund a significant expansion of gambling treatment services, is essential. During the passage of the Environment Act, the phrase “the polluter pays” was frequently used. It is appropriate to use the same phrase in relation to a levy on the gambling industry.
Much of the support and prevention work for those suffering from gambling harms is provided by charities outside of the NHS. However, it is often the case that the NHS picks up the cost of dealing with the aftermath of the mental health issues of families affected by gambling-related suicides. The National Gambling Treatment Service, which is funded by GambleAware, provides advice through a helpline and essential treatment for sufferers of gambling disorders—I hear what the noble Lord, Lord Smith of Hindhead, says. Raising awareness is essential, especially for young men, who may regularly gamble at sporting events. It is clear that no one organisation has a catch-all solution but, by working in partnership, more is achieved, much suffering is alleviated and tragic deaths are avoided.
A levy would help pay for extra capacity in health officials, debt advisers and faith leaders to respond to the likely growth in the number of those suffering from gambling harms. Can the Minister say whether the Government are ready to acknowledge the need for a 1% levy on the gambling industry? Raising awareness of gambling harms is essential before young people and children become entrapped. Children are particularly susceptible to online games and television advertising, which draw them in. The stigma associated with gambling harms needs careful handling in order to allow those affected to access the services which will help them.
I am pleased that we are holding this important debate shortly—I hope—before the publication of the gambling White Paper. One crucial reform the committee called for was online gambling affordability checks to ensure that people do not lose more than they can afford. There can be catastrophic consequences for those who gamble beyond their means and for their families, who are often left devastated. I was encouraged to hear that in a speech to the GambleAware conference in December 2021, the Minister responsible for the gambling industry recognised that these checks are key in helping to prevent gambling-related harm. The question now is how they should apply.
The Social Market Foundation published a powerful report in August 2020 which recommended the introduction of a standardised affordability threshold set at losses of £100 per month. At this stage customer due diligence checks should be applied by gambling operators. However, this does not always happen. A study carried out by the University of Liverpool found that 73% of slot players and 85% of non-slot players have a monthly loss of £50 or less. Other studies have similar conclusions, with the PwC report for the Betting and Gaming Council stating that the median spend is up to £75 per month. The proposed soft cap of £100 would allow most gamblers to enjoy a flutter without any major checks. Do the Government agree with the SMF’s carefully developed proposals and will they consider setting the affordability threshold at £100 per month?
The Government’s review of the gambling White Paper has taken place, but it has not yet been published. Can the Minister give an undertaking that that will take place in the next Session of Parliament and before the Summer Recess? Public Health England estimates the economic cost of gambling harms at £1.27 billion per year. Given this figure, surely there can be no reason not to take action now, especially as many families are suffering as a result of the increased cost of living and energy prices as well as struggling with gambling debts.

Lords ChamberMy Lords, I congratulate my noble friend Lord Foster of Bath on his excellent speech and declare my interest as a member of Peers for Gambling Reform.
In September 2021, Public Health England published its conclusions on the six harms caused by gambling. These are: financial, relationship breakdown, mental and physical health, employment and education, criminal and anti-social behaviour, and cultural.
We have heard some powerful speeches this evening. It is attractive to have a little flutter, and this could be quite exciting, but when this gets out of hand it is much more serious. Taking part in fundraising bingo evenings at Christmas and Easter for the local school, where parents give gifts, usually chocolate, as prizes, is a family event enjoyed by everyone. This is a very different matter from a serious gambler who stakes everything on one last throw to see if they can recoup their considerable losses. I hear what the noble Lord, Lord Bourne of Aberystwyth, says about premium bonds—but you do get your money back.
Advertising different aspects of gambling on television gives the impression that it is a social, enjoyable experience, but the reality is very different. It can be a lonely, isolating and often sordid experience for those totally hooked. Often the gambler is aware of their addiction and does everything they can to avoid the temptation, but the offer of a free bet is often too tempting.
Regarding the gambling tax, research by NERA shows that curbing gambling will lead to more jobs, more money for research, education and treatment, and more tax reserves for the Exchequer.
The government response so far has been to review the Gambling Act 2005. In July 2021, DCMS promised a consultation later that year—nothing happened. In January, it said it would be coming soon—a favourite phrase of Governments. The Government further indicated they would consider banning VIP schemes and free bets in their review of the Gambling Act.
While the Government are havering, lives are being ruined and, in extreme cases, lost. Gambling and the advertising that promotes it need to be regulated more strictly than currently. Therefore, my question to the Minister, who has fielded many of the arguments raised this evening on previous occasions, is this: just when are the Government going to review the 2005 Act? Will the review and action be this month, in three months, in six months or never? Can the Minister please commit to a firm date?

Lords ChamberThat research by the Social Market Foundation was, I know, noted in the letter sent to my honourable friend the Gambling Minister. We see a clear role for considering an individual’s financial circumstances to help stop devastating losses, but to be workable and to prevent harm, checks need to be proportionate and done in a way that is acceptable to customers, too. We continue to work with the Gambling Commission on this issue in the run-up to our White Paper.
My Lords, further to the answer the Minister gave to the right reverend Prelate, can he give a categoric undertaking that the gambling industry will have no influence whatever in how the levy is allocated to research, harm prevention, education and the treatment of those affected by gambling addiction?
The Government have always been clear, as I said, that we will look at the case for alternative funding mechanisms and all options remain on the table. Of course, we are taking views from industry, as we are from everybody with an interest in this area. We will take all those views into account as we prepare the White Paper.

Lords ChamberThe noble Lord raises an interesting point. It is significant, in relation to disorders such as gambling problems remaining hidden, that the Gambling Commission has recently appointed a panel of individuals with lived experience to advise it formally on player safety. We hope this means that currently hidden issues will become more visible, and we will be able to address them.
My Lords, despite the Government’s cross-departmental insistence that treatment for gambling problems will be prioritised, the scope of the call for evidence in the review of the Gambling Act 2005 made no mention of a public health approach. Such an approach would allow the treatment of gambling problems to be delivered in the same way as drug and alcohol addictions are treated. The Minister is aware of this. What action does she intend to take to rectify it?
I recognise the noble Baroness’s point about the specific language around public health, but if we look at what constitutes a public health approach, we see that it is inherent in the work being carried out. In particular, the Gambling Commission, as part of its role, looks broadly at the products, the players and the environment in which they operate.

Lords ChamberThe noble Baroness makes an important point. The latest data that we have shows that 87% of women gambled at the same level or less during the past year, while the quarterly survey that is run shows 0.3% of women gamblers identifying as problem gamblers. The noble Baroness is right that this data relates to the last year so more work and research needs to be done to understand the true extent, and therefore the need for additional treatment and support when we have understood that fully.
My Lords, it has been suggested that stake limits online may drive gamblers to the unregulated black market. The most addictive form of online gambling is slots with no stake limit. Does the Minister agree that, while concerns around the gambling black market should be addressed, these should not impede reform of the regulated sector, including online gambling?
We are very keen to address all issues, such as online slots, which, as the noble Baroness says, is one of the most harmful and riskiest forms of gambling with the highest loss ratios. That is why these recent changes which affect the design of games are so important, but we will need to navigate in the review a number of overlapping factors, including the black market.

Lords ChamberThe noble Baroness raises important points about online gambling, which is one of the fastest-growing areas of gambling. We are looking at the case for increased protections online, including in relation to stake limits. However, as I said in response to my noble friend Lord Grade, we are not waiting for the review to make online games safer, so the Gambling Commission will shortly publish its response to a consultation on a number of tighter controls on online product design which will aim to protect exactly those vulnerable groups to which the noble Baroness referred. She was also right to raise the issue of women gamblers, where we have much less evidence. We look forward to building a much more comprehensive picture and will aim to use that evidence to get the regulatory balance right.
My Lords, I declare an interest as a vice-chair of Peers for Gambling Reform. We tread a fine line between allowing people to spend their money freely and preventing them from the extremes of their actions on their health and well-being. We ban the advertising of smoking and smoking in public places to prevent health deterioration. We encourage healthy eating and exercise to curb obesity levels and diabetes, but we have a reluctance to ban advertising for gambling, despite the misery that the addiction can bring. Italy, Belgium and Spain have introduced bans, while Australia has introduced a ban on gambling advertising during live sporting events between 5 am and 8.30 pm. Would the Minister consider following this lead on banning advertising to protect the young and vulnerable from falling into addiction?
The noble Baroness has raised serious issues and has made some interesting suggestions. To be fair, I think that the noble Baroness would agree that gambling advertising is already subject to very strict controls. It cannot be targeted at children and it cannot appear during TV programmes or on websites that are aimed primarily at children. In fact, the ASA is currently consulting on further tightening these rules to limit gambling ads that appeal to children and vulnerable people. Gambling advertisers online have to obey the same rules as offline, but as I have said, the point of this review is to get the most convincing evidence possible from which we can move forward.

Lords ChamberThat may well have been the intention: I do not doubt for a second that the National Trust was intending to audit its houses, but our view is that the way in which it was done was unfortunate. While the trust may not have intended to cause offence, the feedback from members and parliamentarians suggests that it did.
My Lords, the National Trust has fulfilled its charitable objectives over many decades. The country has benefited both from the preservation of cultural heritage and from the nature and beauty of its open spaces. Two of the greatest challenges of our age are tackling climate change and dementia. Will the Minister confirm that the National Trust agreement with the Alzheimer’s Society to make its places dementia-friendly and its zero-emissions target of 2030 are great steps forward?
I was not aware of the specific initiative with the Alzheimer’s Society to which the noble Baroness refers, but I am happy to share her positive remarks in relation to both things.
