To ask His Majesty's Government, following concerns raised by the Competition and Markets Authority about potential 'over-dependence' on a small number of major tech firms in the AI industry, what steps they are taking (1) to promote competition, and (2) to prevent monopolistic practices, within the AI sector.

The Government is committed to ensuring that digital markets work well for businesses and consumers. It will be for the CMA in the first instance as the independent regulator to decide how to exercise its powers to address any competition issues in digital markets as they develop.

The Digital Markets, Competition and Consumers Bill will give the CMA new, faster and more effective tools to identify and address competition issues in digital markets, including AI markets. These will apply where it finds firms have substantial and entrenched market power and a position of strategic significance in one or more digital activities. Subject to Parliamentary timings, the Bill is on track to receive Royal Assent in Spring, and we expect the regime will come into force in Autumn this year.

To ask His Majesty's Government what steps are being taken to address the concerns of the Chief Executive of the Competition and Markets Authority that a small number of tech companies creating AI Foundation Models are developing partnerships which shape the markets in their own interest.

The Government is committed to ensuring that digital markets work well for businesses and consumers. The Digital Markets, Competition and Consumers Bill will give the CMA new, faster and more effective tools to identify and address competition issues in digital markets, including AI foundation model markets. The Bill is on track to receive Royal Assent in spring subject to parliamentary timings, and we expect the regime will come into force in Autumn this year. In the meantime, the CMA has been using its existing markets and mergers tools to look into AI foundation models.

It will be for the CMA as the independent regulator to decide how to exercise its new and existing powers to address any competition issues in digital markets as they develop.

To ask the Secretary of State for Culture, Media and Sport, whether Bytedance would be required to divest ownership of TikTok under the terms of the provision on Foreign power acquisition of news media organisations added by the Government to the Digital Markets, Competition and Consumers Bill.

The new terms introduced in our amendments to the Digital Markets, Competition and Consumers Bill (DMCC) are based on the Enterprise Act 2002, and will therefore only apply to newspapers and news magazines given the unique role these publications play in contributing to the health of our democracy by providing accurate news and information, helping to shape opinions and contributing to political debate.

These changes would not cover online news providers or online intermediaries, including social media platforms such as TikTok.

To ask His Majesty's Government what steps they are taking to combat anti-competitive practices in the consumer products sector, in particular (1) price-fixing, and (2) collusion.

Price fixing and collusion, in any sector, is illegal under the Competition Act 1998. The Competition and Markets Authority, the “CMA”, is responsible for investigating anti-competitive practices. As an independent authority, the CMA has discretion to investigate competition cases which, according to its prioritisation principles, it considers most appropriate.

The Digital Markets Competition and Consumers Bill, currently being considered by Parliament, will update the CMA’s powers to investigate anti-competitive behaviour. This includes powers to interview a broader range of individuals and require the production of information stored remotely when executing a warrant.

The Government is committed to supporting the growth and dynamism of the digital technology sector and the sustainability of the online press sector. The Digital Markets, Competition and Consumers Bill will establish new, faster and effective tools to address the far-reaching power of the biggest tech firms.

The new legislation will equip the Competition and Markets Authority to address both the causes and consequences of market power in digital markets, and make sure tech start-ups are able to enter and grow in new markets. It will also help rebalance the relationship between major platforms and those who rely on them, including press publishers, through tailored conduct requirements and pro-competition interventions. We anticipate the Bill will receive Royal Assent in spring this year. This is subject to Parliamentary time and scrutiny.

To ask the Secretary of State for Business and Trade, if she will conduct a review into the regulation of (a) sales of caravans and (b) management fees at static caravan sites.

Caravan park owners and operators are subject to consumer protection legislation in the same way as any other business which has dealings with consumers.

For example, under the Consumer Rights Act 2015 (CRA), goods purchased (including caravans) have to be as described, of a satisfactory quality, and fit for a particular purpose.

The CRA also protects consumers from unfair contractual terms being applied by traders such as park operators.

We are further strengthening the enforcement of this framework in the Digital Markets, Competition and Consumers Bill. Therefore, the Government has no plans to further regulate the sales of caravans.
