Social Security Benefits: Fraud
Asked by: David Davis (Conservative - Goole and Pocklington) Thursday 23rd May 2024 Question to the Department for Work and Pensions: To ask the Secretary of State for Work and Pensions, if he will make an estimate of how much monies his Department expects to recover via the powers in Clause 128 of the Data Protection and Digital Information Bill for fraud related to (a) the Attendance Allowance, (b) Universal Credit, (c) the State Pension, (d) the Personal Independence Payment, (e) the Disability Living Allowance, (f) carers allowance, (g) housing benefit, (h) child benefit and (i) pension credit as (i) an annual sum and (ii) as a proportion of overall estimated fraud for each of those. Answered by Paul Maynard Whilst the power covers all benefits to ensure we are empowered to address fraud and error wherever it arises, the Impact Assessment makes clear that we initially intend to use the power for Universal Credit, Employment Support Allowance, Pension Credit and Housing Benefit (passported from Pension Credit). DWP can also only exercise this power in relation to benefits for which DWP is responsible.
The Third-Party Data Measure is estimated to save up to £600m by 2028/29. This was certified by the Office for Budget Responsibility (OBR) during the Autumn Statement 2023 and updated for the Spring Budget 2024. This is based on the initial use of the power which includes savings from the four benefits outlined above and the pilot period. Further information about the methodology can be found in the published impact assessment (DWP_third_party_data_impact_assessment_november_2023.pdf (publishing.service.gov.uk)).
The table below shows savings are split by each of benefit and that we are testing the measure. Estimates of these savings as a proportion of overall estimated fraud for each of these benefits is not available as the AME savings modelled are not directly comparable to the Monetary Value of Fraud and Error.

Artificial Intelligence: Data Protection
Asked by: Lord Freyberg (Crossbench - Excepted Hereditary) Friday 3rd May 2024 Question to the Department for Science, Innovation & Technology: To ask His Majesty's Government, further to the Written Answer by Viscount Camrose on 12 April (HL3677), what practical steps data subjects can use to verify that their personal data are being processed (1) in accordance with any consent they have granted, and (2) only insofar as is "necessary" for the intended purposes; how they can exercise their right to object; and whether all of these processes will remain in place following the passage of the Data Protection and Digital Information Bill as currently drafted. Answered by Viscount Camrose Data controllers should inform individuals of how they are going to use their personal data and set this out in their privacy notice. Individuals have a number of rights under the UK’s data protection framework, including the rights to access their personal data, to object to its processing and to rectification and erasure. If an individual is concerned about the handling of their personal data, they can contact the ICO for advice or to make a complaint. These rights, along with core data protection principles, will continue to apply under the reforms within the Data Protection and Digital Information Bill. |

Answered by Paul Maynard We are committed to tackling both fraud and error. DWPs quality assurance framework plays an important role in identifying common errors which contribute to over and underpayments. In addition, the department and HMRC has committed to provide assurance this winter over the integrity of the National Insurance records and how they interact with DWP’s benefit system.
The Department launched a robust plan to drive down fraud and error from the benefits system, alongside investment of £900 million that will deliver £2.4 billion of savings by the end of 2024/25. This plan includes proposed powers to require the transfer of data from third-parties, which has been introduced as part of the Data Protection and Digital Information Bill (No.2). This legislation is forecast to save up to an additional £600m over the Treasury scorecard period. |

Answered by Paul Maynard The department has assessed the impact of the third-party data measure in the regulatory impact assessment scrutinised and green-rated by the Regulatory Policy Committee. This was published on the 27th November 2023 as part of the supporting documentation for the Data Protection and Information Bill and is available here: Data Protection and Digital Information Bill: supporting documents - GOV.UK (www.gov.uk).
The department has fulfilled all the requirements of the Public Sector Equality Duty (PSED) as set out in section 149 of the Equality Act 2010 and in line with our statutory duty keeps the impact of this measure on groups with protected characteristics under continuous review.
In 22/23, DWP overpaid over £8bn due to fraud and error. This is unacceptable and we are taking robust steps to tackle this.
The third party data legislation we are seeking is one such approach. The focus of this power will be about finding signals of potential benefit fraud and error. The measure does not target a particular group of benefit claimant and we have tried and tested safeguarding procedures to protect vulnerable groups and will follow business as usual processes.
