Answered by Minister for Economy The mortarium contained in section 82(1) of the Coronavirus Act 2020 has ended. The end of the temporary moratorium period contained in the Commercial Rent (Coronavirus) Act 2022 (“the 2022 Act”) depends on whether or not the matter of relief from payment of rent debt falling in scope of the protection of the 2022 Act was referred to the arbitration regime within six months, beginning on the day on which the 2022 Act was passed. Generally speaking, if there was such a referral, then the moratorium period for the purposes of the 2022 Act ends when the arbitration concludes, but if there was no such referral, then then the moratorium period for the purposes of the 2022 Act has ended. |

Answered by Minister for Health and Social Services The Coronavirus Act 2020 was passed by the UK Parliament in March 2020 and provided the UK Government and devolved administrations with additional powers to respond to the Covid-19 pandemic. The provisions in the 2020 Act were the result of significant and collaborative work between all four nations, and cover a range of matters including specific powers for Wales to be exercised by the Welsh Ministers. The 2020 Act is due to expire at the end of the period of 2 years beginning with the day on which it is passed; on midnight 24 March 2022. The UK Government is required to review the non-devolved provisions of the 2020 Act every six months and the 2020 Act provides a mechanism enabling provisions to be expired earlier than the planned, at the 2 year expiry, or extended beyond the planned 2 year expiry as necessary. In relation to devolved provisions of the 2020 Act however this could not be done without the consent of the devolved administrations. Alongside the powers in the 2020 Act, a wide range of coronavirus-related legislation has been made using pre-existing powers. For example The Health Protection (Coronavirus Restrictions) (No. 5) (Wales) Regulations 2020 and The Health Protection (Coronavirus, International Travel and Restrictions) (Amendment) (Wales) Regulations 2021 Under these regulations the Welsh Ministers must review the need for the restrictions and requirements imposed by such Regulations, and whether those restrictions and requirements are proportionate to what the Welsh Ministers are seeking to achieve. The reviews for the Coronavirus Restrictions Regulations must be held at least every 21 days. Written statements have been issued to inform Members of the making of key coronavirus-related legislation and to help improve the accessibility of Welsh law relating to coronavirus, subordinate legislation made by the Welsh Ministers in response to the pandemic has been published on a single page on the GOV.wales website (https://gov.wales/coronavirus-law), while statutory instruments also continue be published on the legislation.gov.uk website. While there is no statutory obligation on the Welsh Ministers to report on the use of these powers, the Minister for Health and Social Services gave an undertaking to the Senedd to do so. These reports includes details of all subordinate legislation relating to coronavirus made by or on behalf of the Welsh Ministers during a period of time, not just legislation which originates from the Coronavirus Act 2020. Three reports have been published to date and another report will be provided for the period September 2021 – March 2022. Answered by Minister for Climate Change On Friday 17 December 2021, I laid the Coronavirus Act 2020 (Residential Tenancies: Extension of Period of Protection from Eviction) (No. 4) (Wales) Regulations 2021 in response to the ongoing pandemic. The number of people under immediate threat of eviction from their homes must be kept low, in order to continue to contribute to the range of measures in place that respond to the continuing effects of the pandemic. These regulations will be kept under review but will end on 24 March 2022, which is when the Coronavirus Act 2020 expires. We are aiming to commence the Renting Homes (Wales) Act 2016 before the 2022 summer recess, and I have committed to provide stakeholders with a minimum of six months’ notice of the implementation. More broadly, providing renters with more security forms part of the Cooperation Agreement between the Welsh Government and Plaid Cymru. |

Answered by Minister for Finance and Local Government The regulations issued by the Welsh Government on 14 September 2021 suspended the temporary emergency provisions relating to the transportation, storage and disposal of dead bodies introduced by section 58 of the Coronovirus Act 2020 in response to the onset of the pandemic (links to these are included below). In consequence the regulations re-introduced the arrangements that applied prior to the enactment of the 2020 Act and at the start of the pandemic. Our decisions will continue to be informed by the evidence and the prevailing conditions across our communities. We have established a range of measures to evidence the impact of the coronavirus across social care. Since March, we have provided a dedicated cross-sector weekly forum for stakeholders, including carers to engage on the commencement of the provisions and the associated guidance. It remains a key conduit for informing their repeal. In addition, we convened a dedicated task and finish group of policy officials and senior representatives from national carers’ organisations, which discusses a wide range of issues, including carers’ wellbeing, and the impact of the pandemic on carers, the impact of modifications to care and support services. This group will support us to consider the specific needs of a broad range of carers as lockdown restrictions are eased. The Carers’ Ministerial Advisory Group (MAG) remains the key strategic mechanism for advising Ministers about the issues that affect carers. I have attended virtual meetings of the group in late April and early July to hear directly about the impact of the coronavirus on carers, and the work across the public and third sector to support them. The MAG will be supporting us in developing our new national plan for carers, which will take into account the impact of coronavirus. |

Asked by: Rhun ap Iorwerth (Plaid Cymru - Ynys Môn) Friday 3rd July 2020 Question What is the Welsh Government’s strategy to ensure that essential care for dementia patients and their families including respite care, that were withdrawn because of the current pandemic, are reinstated? Answered by Minister for Health and Social Services Welsh Government has supported health boards, local authorities and the third sector to continue to provide support to those in receipt of dementia services, ensuring that funding remains available to enable services to adapt to the current situation. This includes the release of the Integrated Care Funding monies allocated to Regional Partnership Board (RPBs) to support the implementation of the Dementia Action Plan. Where individuals are struggling, support is also available through their local voluntary organisation. https://thirdsectorsupport.wales/contact/.
Some services have had to change the way they deliver in order to minimise face to face contact. As service delivery has changed, we are aware that some of the innovation and hard work has resulted in positive changes. However, we know that innovative practices utilising telephone and digital services have not worked for everyone and there is a need to ensure that those who are most vulnerable are not disadvantaged.
We have set out very clearly our expectation (in the statutory guidance published under the Coronavirus Act 2020) that any changes to individuals’ care and / or support, which may include an identified and eligible need for respite care, will be returned to their pre-modification arrangements at the earliest possible opportunity. Local authorities need to establish arrangements and communicate to those impacted, how this will be achieved. The onus should not be on individuals or their families/carers to ensure that their care and support is restored. The abilities of people to cope during a period of crisis is not an indication of their ability to provide care and / or support for prolonged periods.
The Welsh Government has developed guidance to support local action to identify and meet the anticipated increased rehabilitation needs of people affected directly and indirectly by the pandemic. This includes people living with dementia whose skills have deteriorated during the period of lockdown.
In order to support the identification of these priorities, Welsh Government’s Dementia Oversight of Implementation and Impact Group (DOIIG) has been reinstated and will meet virtually to ensure that the actions set out within the Dementia Action Plan continue to be worked towards in the COVID-19 context.
Support continues to be available through the Wales Dementia Helpline, the Carers Support helpline and the Alzheimer’s National Helpline. |

Answered by Minister for Health and Social Services We are working with stakeholders across Wales to ensure that we protect our frontline social care staff, who play a vital role in caring and supporting the most vulnerable in our society. I recently announced an extra £40m to help meet the extra demands placed on adult social care services and cover the increased costs associated with the coronavirus pandemic. We will continue to work with our partners to monitor this ongoing situation. We have developed and implemented a robust system for NHS Wales Shared Services to provide PPE directly to local authorities for onward distribution to care providers. If a care provider is in need of PPE support they can contact their local authority which will authorise the release of available PPE kit for immediate use. To date more than 10m individual items of PPE have been distributed for use by social care providers – this includes aprons, gloves, facemasks and reusable goggles. Further deliveries are being coordinated by NHS Wales Shared Services. We are working to ensure that care providers are fully informed about the process to access stock and that they are using it appropriately in line with the latest guidance. The latest UK PPE guidance for health and social care is available at: https://www.gov.uk/government/publications/wuhan-novel-coronavirus-infection-prevention-and-control We are rapidly increasing our capacity to test social care staff, opening drive-in testing centres in Cardiff and Newport. Centres are also being set up in West and North Wales. The Chief Medical Officer wrote to all health boards on April 22 informing them all care home residents would be tested if they have symptoms. The Welsh Government continues to examine all the levers available to us to ensure that providers can continue to deliver this vital support, including additional powers granted through the four nations Coronavirus Act 2020 should these be necessary. We have asked all health and social care professionals who are able to help at this time to make themselves available. This includes retired social workers, as well as others that have worked in the wider social care sector and advised them that to return all they need do is temporarily register, without a fee, by contacting Social Care Wales and expressing their interest in re-joining the workforce to help out in these unprecedented times. We have supported Social Care Wales to launch the social care worker card to help identify social care workers and recognise their hard work and status as critical workers in Wales. |
