According to figures from a Freedom of Information request by the Royal Osteoporosis Society cited in an All-party Parliamentary Group inquiry report in 2021, 51% of National Health Service trusts in England provided a fracture liaison service in the same year. A copy of the report is attached.

NHS England does not record this information centrally, in the format requested. The majority of complaints and concerns raised would be made to the employing National Health Service trust or NHS employer, and not to NHS England directly. I feel strongly that the NHS must support and welcome all staff to speak up. It is the duty of a health practitioner to speak up whenever they are concerned.

In response to a recommendation of the Sir Robert Francis’ Freedom to Speak Up Review in 2015, we established an independent National Guardian to help drive positive cultural change across the NHS, so that speaking up becomes business as usual. The National Guardian also oversees a network of local Freedom to Speak Up Guardians across all trusts in England. The National Guardian has also issued guidance and training on how to speak up. NHS England has developed an updated model of the Freedom to Speak Up policy, which they expect all NHS organisations to adopt by 31 January 2024.

The UK-EU Trade and Cooperation Agreement allows for a new relationship with the EU, giving us the freedom to do things differently and better.

The Department is leading a cross-government effort to identify trade barriers and break them down with our EU partners. For example, in the year to March 2023, we broke down 45 market access barriers in the HMTC Europe region, a 10% increase year-on-year.

HMG provides a wide range of support, including help to grow overseas by providing information, training, and expert support to exporters, whilst HMRC’s Customs & International Trade Helpline ensures businesses have access to the additional support they need.

To ask His Majesty's Government, further to their response to the report from the House of Commons Justice Select Committee, Private prosecutions: safeguards (9th Report, Session 2019–21), in which they confirmed that a registry of private prosecutions would be made available, why this has not yet been made available; when this is expected to be made available; and how much taxpayer money was paid to legal firms prosecuting private prosecutions (other than legal aid) between 2015 and 2023.

In 2020, the Justice Select Committee (JSC) undertook a review of private prosecutions and provided nine recommendations.

The Government agreed to two of these recommendations:

  • To introduce a central register of private prosecutions;
  • That we would take steps to ensure costs recoverable from central funds by a private prosecutor are limited in the same way as costs recoverable by an acquitted defendant.

Private Prosecution Register

In the Government’s response to the JSC report, we agreed that a central register of private prosecutions would be introduced to include the names of the prosecutor and defendant, the offence in question, and whether the summons application was granted. This register was introduced by HMCTS in late 2021.

The register is not publicly accessible, and it was neither a recommendation made by the JSC report nor an undertaking agreed by the Government for it to be. The register contains personal data including where people have been accused of crimes where the court found there were no grounds to commence a prosecution. The register is a court record and there are no grounds provided under rules of court, the Data Protection Act 2018 or the Freedom of Information Act 2000 for these personal details to be released to the public.

Requests for non-personal information from the register are accessible through a Freedom of Information request to HMCTS.

Cost of Private Prosecutions

The Government has committed to bringing forward legislation to ensure costs recoverable from central funds by a private prosecutor are limited in the same way as costs recoverable by an acquitted defendant and will enact this when parliamentary time allows.

The assessment of claims and payment of prosecutors’ costs out of central funds for cases brought in the magistrates’ court and Crown Court is undertaken by the Legal Aid Agency’s (LAA) Criminal Cases Unit (CCU) unless the court summarily assesses the claim under s.17(2B) of the Prosecution of Offences Act 1985. Information about central funds expenditure, including private prosecutions, is published on a quarterly basis within the LAA’s official statistics. A copy of the relevant data is attached at Annex A.

Other Recommendations

Sir Wyn Williams’ Post Office Horizon IT Inquiry is examining, in detail, the failings that led to the Post Office scandal. It is possible that this will provide insight on the extent to which the private prosecution regime played a role in this particular injustice.

The Government is, however, examining the wider question of private prosecutions and is therefore committed to looking again at the Justice Select Committee’s recommendations in their 2020 report as part of this work.

The BBC is operationally and editorially independent from the government and the Government cannot intervene in the BBC’s day-to-day operations or decision making.

The Charter sets out that the BBC must exercise rigorous stewardship of public money. The BBC Board is responsible for securing the effective and efficient management of the finances of the BBC.

As part of the most recent Charter Review the Government put in place arrangements for the National Audit Office to become the BBC’s independent auditor. The NAO is responsible for auditing the BBC accounts and ensuring value for money in the way the BBC uses its funds. This ensures that there is appropriate scrutiny of how the BBC spends its public funding.

Our online hate speech programme is helping to make digital spaces safer for women.  The UK will continue to support civil society and NGOs in lobbying the Government of Pakistan to honour its international commitments on Freedom of Religion or Belief (FoRB) and women's rights.

Question to the Department for Education:

To ask the Secretary of State for Education, what steps she is taking to support local authorities with finding homes for children with complex needs.

Answered by David Johnston - Parliamentary Under-Secretary (Department for Education)

All children should live somewhere that meets their needs and keeps them safe. Under Section 22G of the Children Act 1989, it is the duty of each local social services authority to provide suitable accommodation for children in their care. However, the government recognises the challenges local authorities face, and the need for system-wide reform.

To support local authorities, the department has allocated £259 million in funding to maintain capacity and expand provision across open children’s homes (OCHs) and secure children’s homes (SCHs) within England, up until March 2025. Funding to develop OCH provision is provided on a match-funding basis with the department and the local authority local authority contributing 50% funding. For SCH provision, the department provides local authorities with 100% funding. Additional capacity has already been developed, with 36 smaller projects being complete and becoming operational within the SCH estate since the programme launched in 2021.

The government recognises the need for long-term, system-level reform of children’s social care. In February 2023, the government published “Stable Homes, Built on Love – Implementation Strategy and Consultation”, which set out the government’s proposals to reform children’s social care following reviews from the Competition and Markets Authority and Independent Review of Children’s Social Care. The report recommends system changes to ensure suitable placements are available to meet the needs of children.

The department recognises that some children and young people can fall between gaps in a complex system of education, social care and justice services, and there is a lack of evidence-based, integrated, co-commissioned models of care. These gaps are being addressed through a jointly led departmental and NHS England cross-government work programme to improve how system partners work together to improve outcomes for children who are in the most complex situations.

The department has established an ‘‘Improving support for Children in Complex Situations with Multiple Needs” Task and Finish Group (TFG), which aims to enhance support for children in complex situations. The goal is to improve collaboration among system partners to better serve children, particularly those at risk of losing their freedom. The group aims to align government efforts to design, commission and deliver integrated care models, including social care, health, education and youth justice, with the support of key stakeholders.
