Question to the Ministry of Justice:

To ask the Secretary of State for Justice, what recent discussions he has had with stakeholders on (a) plans to re-open and (b) plans for alternative uses of Hartlepool Magistrates' Court.

Answered by James Cartlidge - Shadow Secretary of State for Defence

There are no plans to re-open this court. Hartlepool Magistrates’ and County Court closed in 2017 following a full public consultation and workloads were successfully transferred to Teesside Magistrates’ Court and Middlesbrough County Court.

The property is owned by the local council and HMCTS are contracted under a long lease agreement that allows the property to only be used for court operations. HMCTS are in conversation with the local council to find a suitable alternative use for the building, which will benefit the local community.

We will continue to keep our court and tribunal estate under close review to make sure it meets our operational requirements.

Ensuring that we can operate safely during the Covid-19 pandemic is our top priority. We have put in place measures in our court rooms so that they can hold Covid-19 secure trials, moved to virtual hearings where possible and opened additional court rooms in Nightingale courts as part of a package to increase available capacity.

We have now opened Nightingale courts at 21 locations, including the use of former court buildings, bringing the total number of temporary court rooms set up nationwide to 40. These additional temporary courtrooms have allowed us to increase capacity, particularly for jury trials, in locations where there is an operational requirement and hold additional hearings within a safe environment.

Since 2015/16 HMCTS has raised approximately £129m from the sale of surplus buildings to reinvest in the wider reform programme

The decision to close any court is not taken lightly – it only happens following full public consultation and only when effective access to justice can be maintained. Courts that have closed were either underused, dilapidated or too close to one another.

The decision to close a court is never taken lightly. Court closures have taken place following a public consultation and only when the Lord Chancellor was satisfied that effective access to justice could be maintained. We have closed less efficient courts allowing for resources to be concentrated into a smaller number of better quality and more flexible buildings.
