Question to the Ministry of Justice:
To ask the Secretary of State for Justice, what training he plans to provide to staff responsible for assisting with the work of the upper tribunal in relocating asylum seekers to Rwanda; who will provide that training; what estimate he has made of the cost to the public purse of that training; and whether he plans to issue a contract for the recruitment of those staff.

HM Courts & Tribunals Service is responsible for the administration of the Upper Tribunal (Immigration & Asylum Chamber) and has been working with the Ministry of Justice to increase capacity in the justice system in preparation for the commencement of the Illegal Migration Act.
An additional 25 hearing rooms have been prepared with remote hearing technology to allow for either in-person or remote hearings to maximise flexibility.
Approximately 100 additional staff have been recruited to support the Upper Tribunal’s work and are currently undertaking training ready for the commencement of the Illegal Migration Act. These staff have been recruited on Fixed Term Contracts following external campaigns on the basis of fair and open competition. This training is being delivered internally within HMCTS as part of existing programmes of operational training.
This training is in relation to HMCTS processing of applications and appeals pertaining to individuals under the IMA scheme and is separate to any training given to Home Office staff in support of the decision making or removals of illegal migrants.

Question to the Ministry of Justice:
To ask the Secretary of State for Justice, pursuant to his Department’s Greening Government Commitments for 2021-25, how many tonnes of food waste were produced from his Departmental estate in financial year (a) 2021-22 and (b) 2022-23 up to the end of December 2022.

In line with Greening Government Commitments (GGCs), the Ministry of Justice (MoJ) has developed a food waste reporting process that enables the department to work towards further reducing its food waste.
The requested information for 2021-2022 will be published in the Greening Government Commitments Annual Report for 2021-2022, due later this year. The data for April 1st 2022 to December 31st 2022 will be published in the Annual Report covering 2022-2023.
GGC annual reporting is delayed due to Covid-19 impacts, but government remains committed to reducing the environmental impact of its estate and operations.
Established in 2010, the GGCs set out the actions that government will take to improve the environmental impact of the government estate and its operations. They demonstrate how the UK government is leading by example and working to improve the environmental performance of its own estate and operations, in line with our 25 Year Environment Plan commitments to improve the environment within a generation.
Since inception of the GGCs, government has halved its greenhouse gas emissions and waste, in addition to making many other efficiencies. Progress against the commitments is published in GGC annual reports.
MoJ is currently developing a Circular Economy strategy setting out our approach to reducing waste and improving resource efficiency, including food waste.
The department is also committed to meeting Government Buying Standards for Food and Catering Services which include specific requirements to reduce food waste in our service contracts.
In 2021-22, the Ministry of Justice (MoJ), together with HM Prison and Probation Service (HMPPS) and HM Courts and Tribunals Service (HMCTS), produced 4,383 tonnes of food waste, disposed of through composting and anaerobic digestion. This represents a reduction from 5,633 tonnes the year before.

The 21-22 Annual Report & Accounts figures are subject to audit and expected to be published in early November. We are unable to provide data on consultancy spend prior to the conclusion of the audit.
The 20-21 consultancy spend as per DCMS 20-21 published accounts (page 135) was £16.6m. The listing for the £16.6m is set out below and is net of a credit of £1.914m on reversed expenditure.
The 19-20 consultancy spend as per DCMS 19-20 published accounts (page 135) was £3.9m. The listing for the £3.9m is set out below including £0.164m relating to corrections to the data.

The Ministry of Justice has a predetermined set of requirements for linguists, developed to meet the interests of justice. The level was agreed at the start of the contract by judiciary and subject matter experts for each commissioning body.
The MoJ regularly reviews the assigned complexity level attributed to assignment types. The discretion to amend the complexity assigned to a booking is afforded where there is judicial direction to do so, or by those officials acting with delegated authority. This is decided on a case-by-case basis to meet the requirements of the specific booking.

The Ministry of Justice is committed to ensuring the justice system is supported by a suite of high- quality language service contracts, that meet the needs of all those that require them.
Language professionals provided by our contracted language service providers are sourced from the Ministry’s register. Only language professionals that meet the Ministry’s contractual requirements are included on the register, which is managed and audited by an independent language service provider, The Language Shop.
The contract has a clearly defined list of qualifications, skills, experience and vetting requirements language professionals must meet, which have been designed to meet the needs of the justice system.
All interpreters are also required to complete a justice system specific training course before they are permitted to join the ministry’s interpreter register.

To ask the Secretary of State for Justice, what steps HM Courts and Tribunals Service is taking to ensure that interpreters are on his Department's list of interpreters in order to improve the vetting of evidence relating to their experience and qualifications.

The MoJ does not directly employ interpreters. The MoJ commissions the services of suitably qualified interpreters through its contracted service providers, thebigword and Clarion Interpreting.
MoJ accepts individuals who hold (a) Level 1 foundation in public service interpreting, a two-to-four-week course, (b) Level 2 public service interpreting qualifications, (c) Level 3 and Level 4 community service interpreting qualifications, A-level standard, (d) a bachelor’s degree in philology but no public service interpreting qualifications and (e) a bachelor’s degree in linguistics onto the MoJ Register. They would however only be engaged in work for MoJ if other requirements are also met. These requirements include the hours of experience they have, the complexity of the booking itself and whether the language in question is considered as rare or otherwise.
The contract has a clearly defined list of qualifications, skills, experience and vetting requirements interpreters must meet, which have been designed to meet the needs of the justice system. All interpreters are also required to complete a justice system specific training course before they are permitted to join the MoJ’s interpreter register.

Currently there are 1073 interpreters across the MoJ register that hold a Diploma in Public Service Interpreting (DPSI) or Diploma in Police Interpreting (DPI). The number of interpreters listed on the MoJ register fluctuates regularly. The data that has been provided here is accurate to March 2021. Each interpreter has only been counted once irrespective of whether they hold multiple DPSI’s/DPI in different languages.
Evidence of public service interpreting is vetted and accredited via references obtained by our Service Provider thebigword. Thebigword contacts each of the referees to validate all of the information that has been provided.
The hours of experience that are required to be evidenced varies according to the complexity levels and the language itself (rare or otherwise) The contract has a clearly defined list of qualifications, skills, experience and vetting requirements that interpreters must meet.
The MoJ does not hold information regarding the number of interpreters that hold a Level 6 public service qualification and (b) have more than 400 hours’ public service interpreting experience that comply with the National Register of Public Service Interpreter’s Code of Professional Conduct. as there is no requirement to do so within the contract.
Data concerning NRPSI registration is not routinely recorded and is not a requirement of working for the MoJ. The MoJ requires all interpreters to abide by a code of conduct specific to the MoJ. This code of conduct forms part of their contract with the Service Providers under the language services contract.
Since 1st January 2019, 118 unique language professionals have had either a spot check or an In Person Assessment (IPA) performed by The Language Shop as the result of a referral, 59 of these passed their spot check/IPA and were not removed from the register. Of the 59 that failed their first assessment 5 of these have successfully completed an In-Person Assessment to enable them to re-join the register.
The Justice Sector programme is facilitated by the International School of Linguists Ltd and takes approximately 4 hours to complete.

To ask the Secretary of State for Justice, whether any companies stated during the recent bidding process for the HM Courts & Tribunals Service's security guarding service contract that they would pay employees the Living Wage as certified by the Living Wage Foundation; and if he will make a statement.

The recent tender for security services for HMCTS had two bidders who stated they would pay the guards over the National Living Wage and towards a level approaching the UK Real Living Wage. The offers were a mix of base pay, based on the National Living Wage, and attendance bonuses and therefore not completely aligned to the Real Living Wage.

HM Courts & Tribunals Service seeks to make sure that the court and tribunal estate is in the best possible condition to provide appropriate court and hearing room facilities.
Since the commencement of the Reform Programme, we have spent over £167m on capital projects investing in our buildings. This has delivered significant improvements, including replacing heating and cooling systems, lifts, roofs and windows.
We have also re-procured our facilities management contracts from April this year, which will allow us to improve the way our buildings are maintained day to day. Under the new arrangements, facilities management work will be more user focused with new objectives based on previous customer experiences. Repair and improvement works will also be more efficient, with response times that match industry standards.

HMCTS was created on the 1 April 2011. We are unable to provide information for financial years prior to that date. This question has been interpreted to mean costs for all language services, both translators, and interpreters provided in a court setting, and for printed materials available in HMCTS buildings.
The contract with Capita commenced on 30th January 2012, and ended on 30th October 2016. The new Language Services Contracts commenced on the 31st October 2016, with services provided by thebigword Group Limited, Clarion Interpreting and The Language Shop.

Our most recent statistics show language service requests are at their highest since the new contract was introduced in 2016 the clear majority – 97% - were fulfilled. It is vital that victims, witnesses and defendants understand what is happening in court to ensure justice is done, and we will always take steps to ensure a qualified interpreter is provided when needed.

To ask the Secretary of State for Justice, whether his Department has sold Camberwell Green Magistrates' Court building.

HM Courts & Tribunals Service has exchanged contracts on the sale of Camberwell Green Magistrates’ Court. The sale will only be completed following the closure of the court and once vacant possession has been confirmed.
The decision to close Camberwell Green Magistrates’ Court was not taken lightly and followed a public consultation that concluded the local community will have reasonable access to alternative courts.
All money raised from the sale of the surplus property will be reinvested in the reform of HM Courts & Tribunals Service.
