Question to the Attorney General:
To ask His Majesty's Government how many prosecutions for corporate manslaughter there have been in each of the past three years, and how many of those prosecutions led to convictions.

There have been 13 prosecutions for corporate manslaughter in the years 2022-23, 2023-24 and 2024-25. 10 of those prosecutions were successful and led to a conviction.
A breakdown of each year is listed below:
2022-23: 6 prosecutions, 6 convictions (1 guilty plea and 5 convictions after trial).
2023-24: 4 prosecutions, 2 convictions (1 guilty plea and 1 conviction after trial), 2 unsuccessful (1 no evidence offered after trial began and 1 left to lie on file).
2024-25: 3 prosecutions, 2 convictions (both convictions after trial), 1 unsuccessful (no evidence offered after trial began).

The Crown Prosecution Service (CPS) holds management information on its Case Management System showing the number of defendants allocated the Principal Offence Category of Homicide at completion of prosecution. Please note that homicide consists of a range of offences, including, among others:
The Principal Offence Category indicates the most serious offence with which a defendant is charged.
The table below shows the number of completed prosecutions and convictions for homicide from the start of January 2005 to the end of September 2015. The data provided in the table is in financial quarters.
‘Total completed prosecutions’ refer to the conclusion of a prosecution case against a defendant such as conviction after trial, guilty plea, acquittal, or the prosecution against the defendant being dropped. ‘Convictions’ refer to convictions after trial and guilty pleas.

Question to the Department for Transport:
To ask Her Majesty’s Government what consideration is being given to bringing charges of corporate manslaughter against VW executives who authorised the sale of diesel vehicles in the UK which did not meet the regulatory standards.

The Government wants to see Volkswagen face the appropriate legal consequences for its actions. Whilst we expect that the vast majority of the wrongdoing took place in Germany and so it is appropriate that the German authorities lead the investigation, the offence of corporate manslaughter would require clear evidence of a link between the actions of VW and the death of specific individuals and no such clear evidence exists at present. A decision on whether to pursue corporate manslaughter charges would be for the Crown Prosecution Service (England and Wales), the Crown Office and Procurator Fiscal Service (Scotland) or the Director of Public Prosecutions (Northern Ireland) to determine.

To ask Her Majesty’s Government, further to the Written Answer by Lord Keen of Elie on 9 March (HL5640), whether the legal guidance for prosecutors concerning the Corporate Manslaughter and Corporate Homicide Act 2007, as set out on the Crown Prosecution Service’s website at 14 March, is current; and whether the Special Crime Unit in the Special Crime and Counter Terrorism Division, CPS Headquarters, continues to maintain an overview of corporate manslaughter cases, as set out in the penultimate paragraph of that advice.

The Crown Prosecution Service’s publicly available legal guidance concerning corporate manslaughter accurately reflects the CPS’s policy on prosecuting for this offence. The guidance includes a requirement for cases to which the guidance may ultimately apply to be referred to the Special Crime Unit of the Special Crime and Counter Terrorism Division.
