Armed Forces: Right to Buy Scheme

To ask the Secretary of State for Housing, Communities and Local Government, if she will make an estimate of how many (a) serving armed forces personnel and (b) veterans have benefitted from the Right to Buy scheme in each of the last five financial years.

The Ministry of Housing, Communities and Local Government does not hold information on the number of serving armed forces personnel, or veterans, who have benefitted from the Right to Buy.

People who live in armed forces accommodation do not have the Right to Buy. The Right to Buy is only available to secure council tenants, and to some housing association tenants who were living in the home when it transferred from a council to a housing association, known as the Preserved Right to Buy. Any period spent in armed forces accommodation by eligible social housing tenants prior to applying can, however, count towards the minimum public sector tenancy qualifying period for Right to Buy and towards the discount entitlement.

Prisoners' Release

To ask the Secretary of State for Justice, what steps she is taking to ensure that people on early prison release have (a) housing, (b) employment and (c) sufficient probation provision to support them.

Individuals released through the Standard Determinate Sentence changes, known as SDS40, and at risk of homelessness can be referred to HMPPS’s Community Accommodation Service Tier 3 (CAS3), which can provide up to 12-weeks temporary accommodation. We are working closely with the Ministry of Housing, Communities & Local Government and the Welsh Government to mitigate any impact on Local Authorities, as well as taking practical steps to minimise the chances that individuals are released homeless. This includes ensuring data is shared with the 49 Strategic Housing Specialists based in prisons and the Probation-based Homeless Prevention Teams to make sure plans are in place for those who need accommodation support.

We are also working closely with the Department of Work and Pensions to ensure that prisons and Jobcentres are prepared to support temporarily higher volumes of prisoners approaching release. We will collectively ensure that relevant staff in prisons and Jobcentres have the right data on prisoners who are being released and will provide guidance and regular communications to those staff, so they are aware of what actions to take. This will ensure that prisoners are supported on release in the community with provision of bank accounts and ID, referrals to work programmes on release, arranging employment pre-release, and timely access to benefits where appropriate.

It is vital there is sufficient probation capacity to manage these individuals upon release. The move to SDS40 gives probation staff more time to prepare and plan for release, compared to the previous government’s End of Supervised Licence Scheme meaning there will be more resilience in the system. We are also onboarding 1,000 new trainee probation officers by March 2025.

Once released, offenders will be subject to the same set of strict licence conditions that would apply had they been released at a 50% automatic release point and will be liable to recall to prison if they do not comply with these conditions or are judged to be a risk to public safety. These could include electronic monitoring, alcohol tags, and exclusion zones.

Prisoners' Release: Kent

To ask the Secretary of State for Justice, how many people will be released early from prison due to overcapacity in Kent in September 2024; and how many units of accommodation are available for those people.

As the allocation process is still in progress, the total number of individuals in Kent to be released from custody at 40% of their standard determinate sentence is not yet known. It is also therefore not possible to ascertain how many units of accommodation would be needed.

Certain offences have been excluded from the SDS change. This includes sex offences irrespective of sentence length; serious violent offences with a sentence of four years or more; specified offences linked to domestic abuse irrespective of sentence length (including stalking, coercive or controlling behaviour and non-fatal strangulation); as well as offences concerning national security. The change will also not apply to sentences subject to release at the discretion of the Parole Board, or to offences which currently attract automatic release from a standard determinate sentence at the two-thirds point (certain serious sexual and violent offences).

Once released, offenders will be subject to the same set of strict license conditions that would have applied had they been released at a 50% automatic release point. They will be liable to recall to prison if they do not comply with these conditions, or are judged to be a risk to public safety.

Any who are at risk of being homeless upon release can be referred to H M Prison & Probation Service’s Community Accommodation Service, which can provide up to 12 weeks’ temporary accommodation, and we are working closely with the Ministry of Housing, Communities and Local Government to mitigate any impact on local authorities, as well as taking practical steps to minimise the chances that individuals are released homeless.

The Government and justice system have taken decisive steps to address the disgraceful violent disorder that was seen in a number of towns and cities in August and we have now seen 1,280 people arrested and over 570 appearances in court which has provided a strong deterrent and demonstrated our determination to keep people safe and restore order.

The Government is determined that we now support the recovery of the towns and cities affected, and also invest in community cohesion. The Ministry of Housing, Communities and Local Government (MHCLG) is leading cross-Government efforts to help places recover – working in partnership with communities and local stakeholders to rebuild, renew and address deep-seated issues. Alongside this the Home Secretary has ordered a rapid review of extremism to ensure the strongest possible response to ideologies that erode community cohesion and our democracy.

Refugees: Homelessness

To ask the Secretary of State for the Home Department, what steps her Department is taking to help ensure that people who have recently acquired refugee status do not experience homelessness after leaving asylum accommodation.

Individuals granted asylum have access to the labour market and to mainstream services that support their integration, including benefits and healthcare. We are working across Government to ensure these services meet the needs of all newly granted refugees.

Migrant Help or their partner organisation support all individuals when they receive a decision on their asylum claim.  This support includes providing advice on accessing the labour market, on applying for Universal Credit and signposting to local authorities for assistance with housing.

We continue to work with colleagues at the Ministry of Housing, Communities and Local Government to understand rough sleeping and homelessness pressures within local authorities (LAs). In our continued commitment to supporting LAs and statutory partners in planning for move on, we have shared enhanced data sets (The Place Based Visibility tool - PBVT) which we are continuing to develop further. The PBVT is complimented by the Discontinuation Prediction Tool (DPT) which is shared weekly; this data provides real time view of discontinuation notices likely to be served in the next following 4-6 weeks and the volume of people (including whether it is families, single males or single females) who may seek LA assistance following a positive decision.

Where a decision is made on an individual's asylum claim, the Asylum Accommodation Support Contract (AASC) provider notifies the relevant local authority within 2 days of notification by the Home Office.

The Ministry of Housing, Communities and Local Government is a minor tenant in the buildings it occupies. At only one, the Department's second HQ at Wolverhampton, does it control of what flags are flown. In the next 12 months at the Wolverhampton HQ, the Ministry will fly flags in addition to the Union flag to mark events of national and international significance, as directed by the Department of Culture, Media and Sports Ceremonial Team.

The business rates policy change will be legislated for through a Local Government Finance Bill led by the Ministry of Housing, Communities and Local Government, which will be introduced following the Budget and is intended to take effect from April 2025, subject to Parliamentary process. The Secretary of State for Housing, Communities and Local Government has made two non-statutory direct ministerial appointments since being appointed to the role: Sir Michael Lyons as the Chair of the New Towns Taskforce, and Dame Kate Barker as the Deputy Chair of the New Towns Taskforce. The New Towns Taskforce will be responsible for recommending locations for new towns within the next year. We will set out further details of the Taskforce in the coming weeks, ahead of the appointment of the other Taskforce members and its first meeting in the autumn.

Prisoners' Release: Homelessness

His Majesty’s Prison and Probation Service delivers a transitional accommodation service, known as the Community Accommodation Service – Tier 3 (CAS3), which offers prison leavers who are subject to probation supervision and at risk of homelessness on release up to 12 weeks of basic, temporary accommodation to provide a stable base on release. The service has been gradually rolled out nationwide since July 2021 and since then has supported over 12,200 prison leavers who would otherwise have been homeless.

However, we know there is more to do to ensure people leaving prison can move to long-term settled accommodation, and will work closely with the Ministry of Housing, Communities and Local Government to develop a long-term strategy to put us back on track to ending homelessness.

In response to HMT’s savings commission, MHCLG has agreed £154 million from the department’s budgets. This comprises of several savings options on non-essential spending including:

  • Cancelling the Investment Opportunity Fund, which had not started, saving £122 million;
  • Cancelling the Antisocial behaviour (ASB) pilot programme, which had not started, saving a lifetime cost of £20 million. This Government believes there are more meaningful and better value-for-money interventions that would genuinely reduce incidents of ASB;
  • Reducing funding for legal fees we no longer expect to arise from the previous Government’s approach to extremism by £5 million; and,
  • Savings from the Cambridge Growth programme totalling £7 million, including reduced spend on consultancy activity.
