Ensuring individuals have access to Primary Care is a key component in tackling the Drug Crisis we face in Scotland, MAT Standard 7 specifies ‘All people have the option of MAT shared with Primary Care’

The Scottish Government provides funding to the Royal College of General Practitioners to deliver the Certificate in Management of Problem Drug Use. This supports primary care professionals within Scotland to provide care for people who experience problem drug use.

Those who have undertaken the course report improved knowledge of the MAT standards and how to appropriately incorporate these into clinical practice.

The Scottish Government also provides funding to Scottish Recovery Consortium to deliver the Humanising Healthcare Conversation Café project. This is a project which provides medical students across Scotland with the opportunity to engage with people with lived experience of substance use through guided roundtable discussions in medical schools across Scotland.

It is for local planning authorities to implement relevant planning legislation, policies and guidance as they deem appropriate and to ensure that the provisions of the planning system are applied properly within their areas. General guidance on the processing and determination of planning applications is available in Planning Circular 3: Development Management Procedures.

In line with long-established planning legislation, planning applications are determined in accordance with the development plan unless material planning considerations justify a departure from the plan. National Planning Framework 4 (NPF4) forms part of the development plan, alongside the local development plan for each area.

NPF4 signals the key priorities for ‘where’ and ‘what’ development should take place and is combined with national planning policy on ‘how’ development planning should manage change. It places climate and nature at the centre of our planning system. NPF4 Policy 11 provides support in principle for all forms of renewable, low-carbon and zero emission technologies including small-scale renewable energy generation proposals. However, it also confirms that potential impacts on communities and individual dwellings, the environment and other receptors are important considerations in the decision-making process.

In some instances, solar panels and wind turbines can be installed on domestic properties under permitted development rights without the need for a planning application. Guidance on this is contained in Section 6 of Planning Circular 1/2024: Householder Permitted Development Rights.

Caring for our peatlands, and reducing peatland emissions, through protection, management and restoration is critical to achieving net zero by 2045.

Through the Peatland ACTION partnership we are funding the restoration of our peatlands. We are also working hard with our Peatland ACTION delivery partners to tackle the many barriers to upscaling peatland restoration in this relatively young sector

In addition to interventions on herbivore control as well as other farm management interventions, we are also considering the regulatory and fiscal measures that could further incentivise peatland restoration and create the conditions to keep our peatlands in good condition.

Alongside this, work continues towards implementing a ban on the sale of peat in Scotland and we have established an expert group to develop the guidance and tools needed to inform decisions on windfarm development on peat.

The Scottish Government, through Transport Scotland’s Trunk Road Casualty Reduction programme of works, is delivering a speed management scheme on the A75 at Crocketford. Construction is programmed to commence by November 2024 through the delivery of an additional electronic vehicle-activated sign (VAS) to encourage vehicles to comply with the speed limit in addition to two existing VAS in the town. Changes to the signs and footway are programmed for the 2025-26 financial year, but subject to the availability of resources. This will involve upgrading the existing signs to current standards and providing a new section of footway and uncontrolled crossings at Park of Brandedleys.

As set out in the 2024-25 Programme for Government, the Natural Environment Bill will include provisions to modernise the way in which deer are managed in Scotland.

In January the Scottish Government consulted on a range of potential reforms to deer management, including the introduction of new powers designed to secure effective deer management that supports Scottish Government nature and climate objectives (Deer Management Nature Restoration Orders). The 'Managing Deer for Climate and Nature: consultation' closed on 29 March 2024. We received around 1600 responses and the full analysis report of the responses was published on 9 September 2024.

The Scottish Government is currently giving careful consideration to all of the consultation responses, which will inform the development of the provisions to be included in the future Natural Environment Bill.

We have no plans to publish all correspondence and advice on the development of planned legislation. The minutes of the Strategic Deer Board relevant to the legislation are published on the Scottish Government website.

We recognise the key role that private deer managers play in managing deer across Scotland. We expect to continue to work in collaboration with private deer managers in our objectives to modernise deer management across Scotland and want to work collaboratively with them.

As stated in the answer to S6W-30037 on 1 October 2024, we have consulted on a range of potential reforms to deer management. Alongside our public consultation we will also continue to speak with stakeholders to help inform any new legislation.

In addition to this we will be undertaking a number of impact assessments in relation to any provisions included in the Natural Environment Bill, including a Business and Regulatory Impact Assessment (BRIA).

BRIAs are used to assess the costs, benefits and risks of any proposed or policy changes that may have an impact on the public, private, third sector or regulators. These impact assessments will be an integral and necessary part of evidenced-based policy development in relation to deer management.

The citation of witnesses is a matter for Crown Office and Procurator Fiscal Office. As outlined in the 2022 Vision for Justice, and Programme for Government 2024-25 Serving Scotland, the Scottish Government is supporting justice partners to drive key areas of reform to make our criminal justice system more efficient and work better for everyone who experiences it.

Our vision is our criminal justice system will work better for everyone who experiences it, cases will take less time, more cases will conclude early, and fewer witnesses will have to come to court. Summary Case Management (SCM), which provides a new approach to summary criminal cases and aims to improve the summary criminal process to benefit justice users; and DESC (Digital Evidence Sharing Capability), which is a critical enabler for criminal justice reform and allows digital evidence to be collected and shared at every stage of a criminal case at the earliest opportunity are two of the key programmes the Scottish Government is working together with justice partners to deliver this vision.

The responsibility for development and delivery of flood protection schemes rests with individual local authorities, who are best placed to respond to local resilience needs.

Proposals to improve flood resilience in potentially vulnerable areas, including flood protection schemes, are set out in Flood Risk Management Plans published on SEPA’s website, and Local Flood Risk Management Plans, published by local authorities.

These plans are renewed every 6 years. The current plans are valid until 2028.

There are no environmental regulations which specifically control the release of non-biodegradable material in sky lanterns. The Environmental Protection Act 1990 includes the offences of littering and offences relating to waste management, including the handling and disposal of non-biodegradable waste. Any event that results in waste generation, such as lantern festivals, must ensure proper disposal of waste to avoid environmental harm. These offences may be relevant where the release of lanterns was determined to have met the statutory definitions for those offences, which would be determinable on a case-by-case basis.

Organisers of public events, like lantern festivals, are required to ensure waste materials are collected and disposed of in a manner that minimises environmental impact. The Duty of care: code of practice for managing controlled waste provides statutory guidance on the duties that must be complied with by anyone who produces, keeps, imports or manages controlled waste in Scotland.

Organisers of events, including lantern festivals, must comply with the legislation, and will be subject to enforcement if offences are committed. Zero Waste Scotland’s guide “How to Plan and Deliver Environmentally Sustainable Events” provides guidance for event organisers and suppliers. Scotland’s River Basin Management Plans 2021-2027 (RBMP) set out a range of actions aiming to improve the overall condition of Scotland’s water environment by 2027.

The Scottish Government invested almost £5m last year in the Water Environment Fund, a key element of the RBMP. Work continues this year providing access to rivers for migratory fish and restoring urban rivers providing benefits for biodiversity, climate change adaptation and flood management.

Funding for flood resilience is distributed to local authorities through the general capital grant. The allocation mechanism is agreed by Ministers and COSLA Leaders on a national basis.

The current distribution agreement is that 80% of available funding is allocated to a list of prioritised flood protection schemes, and 20% allocated to local authorities to fund other actions within Flood Risk Management Plans.

Since 2008, the Scottish Government has made available £42 million per year to local authorities to invest in flood risk management actions – a commitment that is in place until 2026. The 2020 Programme for Government also committed an extra £150 million for flood risk management.

Whitesands is one of the 31 flood protection schemes eligible to receive this funding, as long as the scheme remains viable. 15 such schemes have already been completed across Scotland, with a further 5 due to be completed in 2024.

The Environmental Protection Act 1990 (“the EPA’’) regulates waste management, including the handling and disposal of non-biodegradable waste. SEPA and local authorities both have statutory enforcement functions under the EPA. Any event that results in waste generation, such as lantern festivals, must ensure proper disposal of waste to avoid environmental harm.

In addition, under section 87 of the EPA it is an offence to throw down, drop or otherwise deposit, and then leave, litter in an area which is open to the air and to which the public has access. Local authorities have powers to issue fixed penalty notices if they have reason to believe a littering offence has been committed. Section 89 of the EPA places duties on certain organisations to keep land free from litter, as far as is practical. The 2018 Code of Practice on Litter and Refuse gives practical guidance on fulfilling these duties.

Many Local Authorities have put restrictions in place to prevent the release of sky lanterns and helium balloons on Council owned property and land and when an event is supported by the local authority.

The Duty of care: code of practice for managing controlled waste sets out duties of care for disposal of waste and specific information for waste producers. This includes complying with special requirements for the disposal of waste batteries and waste electrical and electronic equipment which are covered by producer take back schemes.

Transport Scotland considered carefully the respective roles of ScotRail Trains, Scottish Rail Holdings and Transport Scotland when establishing the appropriate arrangements under the requirements of the current flawed UK rail legislation.

An important consideration has been that the cost of these arrangements would be significantly less than the alternative management and contract costs associated with the previous private franchise arrangements.

Seafish have a wealth of experience and knowledge, and have been well placed to carry out stakeholder engagement in relation to Nephrops, and to produce drafts of the FMPs.

Local authorities are responsible for service provision at household waste recycling centres, and for any decisions regarding any expansion of reuse options. The Scottish Government has, through the Recycling Improvement Fund, supported projects led by Aberdeen City, Aberdeenshire and Stirling Councils to improve reuse at household waste recycling centres. This includes setup of a reuse shop and enhancing on-site facilities to enable storage of reuse items. In addition, guidance was published by Zero Waste Scotland in June 2024 to help local authorities move to a reuse first approach at Household Waste Recycling Centres. The guidance, Making reuse happen at Household Waste Recycling Centres: Guidance for local authorities, is available on the Zero Waste Scotland website: mf-kq5rq09l-1720088177d (zerowastescotland.org.uk).

The Circular Economy (Scotland) Act 2024 requires Scottish Ministers to prepare a circular economy strategy. In preparing the strategy Scottish Ministers must have regard to the waste hierarchy, including preparing for reuse.

In addition, a new statutory Household Recycling Code of Practice, which will be co-designed with local authorities and other stakeholders, will set out standards expected of, and steps to be taken by, local authorities in carrying out their waste management functions in so far as they relate to the collection and recycling (including preparation for reuse) of household waste. The co-design process may also create an opportunity to agree that information is provided to householders about reuse and repair opportunities in their area. However, the new Code could not prescribe mandatory requirements for reuse or repair services as these do not fall within local authority statutory waste management functions.

The spawning in Gairloch was a short-term event, lasting only a few days, and has not occurred there in recent years apart from this spring. This is not sufficient evidence to justify immediate protection as a spawning area, especially as measures that will remove the fishing pressure in this area are already being developed. Based on the available evidence, an immediate spawning closure is also not required to preserve the overall sustainability of the herring stock.

Therefore, in line with the advice we have received from NatureScot,we are prioritising bringing in protection for this site as part of the wider programme of fisheries management measures for inshore MPAs and PMFs. NatureScot will advise us if, and when, they consider that there is a requirement for additional protection.
