Question to the Home Office:

To ask the Secretary of State for the Home Department, with reference to the Answer of 16 December 2016 to Question 56787, whether the document issued in exercise of her powers under the Road Traffic Act 1988 to approve a breath-testing device was intended to carry legislative weight.

The relevant primary legislation is the Road Traffic Act 1988 which applies across England, Wales and Scotland. This legislation permits the Secretary of State to approve devices. The Secretary of State does this by way of a signed approval order. Such orders are not a form of legislation and do not require any Parliamentary procedure to be followed.
