Question to the Department for Business, Energy and Industrial Strategy:

To ask the Secretary of State for Business, Energy and Industrial Strategy, pursuant to the Answer of 11 January 2021 to Question 132959, if he will bring forward legislative proposals to amend section 44(1)(d) and (e) of the Employment Rights Act 1996 to extend the provisions to apply to all limb (b) workers, and on what timescale; and if will he make a statement.

Following the High Court Judgment on the 13^th of November 2020, work is underway to amend section 44(1)(d) and (e) of the Employment Rights Act 1996 to extend the health and safety protections contained in these provisions to all limb (b) workers, as well as employees. The Government is committed to making these legislative changes as soon as parliamentary time allows.
