Question to the Department for Transport:
To ask the Secretary of State for Transport, what assessment his Department has made of the implications for its policies relating to the seaworthiness of vessels of the decision in Alize 1954 and another v Allianz Elementar Versicherungs AG and others, [2021] UKSC 51.
The Maritime & Coastguard Agency is the enforcement body for investigations and criminal prosecutions under Merchant Shipping legislation. The outcome of these civil proceedings will be taken into account when considering evidence and culpability in the event of any prosecutions in similar circumstances that are judged to be in the public interest.
