Commons ChamberI am most grateful to my right hon. Friend. Is she aware that the EU itself and indeed many other states throughout the world, including many democratic countries, have persistently broken international law, and that this applies not only to other countries, but to the United Kingdom? There are many overrides of international treaties by the UK itself.
Let me get this right. My hon. Friend seems to be saying, “If somebody else does something wrong, it’s okay for us to do something wrong.” I am sorry, I do not agree with him on that point.
I recognise that my hon. Friend the Member for Bromley and Chislehurst (Sir Robert Neill) has taken every effort to ameliorate the impact of these clauses, and the Government have accepted and put down their own amendment. But, frankly, my view is that to the outside world, it makes no difference whether a decision to break international law is taken by a Minister or by this Parliament; it is still a decision to break international law. This can only weaken the UK in the eyes of the world. One of the great strengths we have as a country is our commitment to the rule of law, and this will have been damaged. Our reputation as a country that stands by its word will have been tarnished, and the willingness of other countries to trust the United Kingdom and its values will have been reduced. So much for global Britain!
In 2018, when Russian agents used a chemical weapon on the streets of Salisbury to attempt to murder Sergei and Yulia Skripal—a nerve agent that led to the death of Dawn Sturgess and affected her partner, Charlie Rowley—I led the action. I called on our friends and allies to stand alongside the United Kingdom, and I led the action that resulted in 29 countries expelling an unprecedented 153 Russian agents from their borders. We were able to do that because those countries had trust in the United Kingdom. Where will that trust be in the future if they see a United Kingdom willing to break its word and international law?
If we pass this Bill with clauses 41 to 45, and in so doing accede to the Government’s wish to break international law, I believe it will have a detrimental effect on people’s trust in the United Kingdom. As the United Kingdom negotiates trade deals around the rest of the world, why should anybody we are negotiating with believe that we will uphold what we sign up to in those agreements if we have said clearly, “If we don’t like it after we’ve signed up to it, we’ll break it”?
This is a country that upholds the rule of law. That is one of the things that makes us great; it is one of our characteristics. We propound and uphold the rule of law around the world. The Conservative party upholds the rule of law—it is one of our values and characteristics—yet we are being asked to tear up that principle and throw away that value. Why? I can only see, on the face of it, that it is because the Government did not really understand what they were signing up to when they signed the withdrawal agreement.
My right hon. and learned Friend the Member for Torridge and West Devon described the Government’s action as unconscionable. As has been said, Lord Keen resigned because he said that he found it increasingly difficult to reconcile his obligations as a Law Officer with the Government’s policy intentions. Frankly, I find it difficult to understand how any Minister can go through the Lobby to support these clauses.
I consider that, in introducing clauses 41 to 45, the Government are acting recklessly and irresponsibly, with no thought to the long-term impact on the United Kingdom’s standing in the world. It will lead to untold damage to the United Kingdom’s reputation and puts its future at risk. As a result, with regret I have to tell the Minister that I cannot support this Bill.

Commons ChamberI had noticed that the House had not supported the plans that I brought forward but, once again, it is a bit of a nerve for a party that consistently says it wants to leave with a deal to consistently vote against leaving with a deal.
The right hon. Gentleman talked about going back to the people on Brexit. He talked about the delay and uncertainty. We have been waiting for weeks for the Labour party’s policy on Brexit. We keep being told that the shadow Cabinet is taking a decision on a second referendum and, week after week, we still wait to hear it. It is little wonder that the shadow Home Secretary says she is beginning to worry about Labour’s Brexit policy.
As you know, Mr Speaker, since the 1980s I have consistently raised the question of Germany’s increasing dominance in the European Union and the European Commission. In his recent book “Berlin Rules”, our former ambassador to Germany states that the EU is and will remain “a German Europe”. Nine of the 28 European Commissioners have German leaders of their cabinets. There are six German directors general. He says that:
“it is Germany’s view which is sought by the Commission before it acts, and by other governments before they decide”,
in the Council of Ministers by majority vote behind closed doors. Is that not a grave concern and a reason why we should leave the European Union by 31 October?
I am a little disappointed. Germany has not had presidency of the European Commission since something like the 1960s, so it is a bit churlish of my hon. Friend to suggest that we should not have voted for a German President. May I also point out that Ursula von der Leyen was born in Brussels? That might make it worse for my hon. Friend than the fact that she is from Germany. It is important that we see not only a gender balance but a geographical spread across the Commission in the appointments. He talks about us leaving the European Union. I want us to leave the European Union. I voted three times for us to leave the European Union. Had he voted with me, we would already be outside the European Union.

Commons ChamberI am grateful to the Leader of the Opposition for saying that the Labour party and the Opposition support the bid, which I think is supported on both sides of the House.
The European Council meeting I attended did not discuss Brexit, no deal or the views of the candidates in the Conservative party’s leadership election, on which the Leader of the Opposition focused the majority of his comments and questions. I am supposed to be talking about what happened at the European Council. Nevertheless I am in a generous mood, so I will respond to a small number of his points.
The Leader of the Opposition talked about the talks on trying to find a compromise and a majority across the House, and we did, indeed, enter those talks. I think both sides entered the talks in a constructive spirit, and I remind him that it was he who actually terminated the talks.
The Leader of the Opposition talked about the position in relation to a no deal, which is, legally, the default option that remains on the table for 31 October if a deal is not agreed. The Government are rightly continuing their preparations for a no deal. He asked about my view on a no deal. I wanted to leave the European Union on 29 March with a deal. If he and his colleagues had voted with the Government, we would already be out.
I remind the Leader of the Opposition that I have done everything to avoid a no-deal Brexit by voting for a deal three times in the past year. He has done everything to increase the chance of a no deal by voting against a deal every time.
“Rejecting any Brexit…deal risks the worst outcome—a No Deal Brexit.”
Those are not my words but the words of his own Labour Members of Parliament.
Finally, the Leader of the Opposition talked about Conservative Members being divorced from reality. I have to say that the person in this House who is divorced from reality is the Leader of the Opposition, who thinks the economic model that we should be following is Venezuela.
My right hon. Friend will be aware there is an accelerated regulation relating to the question of payments into the EU budget. The Government have the power to veto the proposals. I received a letter from the Chancellor today, in reply to my urgent letter to him last week. Will this matter, in fact, be decided on 25 June, as originally proposed? Will the Government exercise their veto, and not merely abstain?
Yes, I understand the matter will be considered on 25 June. It is the Government’s intention to abstain. This does not bind us, and I remind my hon. Friend that the measure could be taken by the European Union at any stage in the future.

Commons ChamberAs I have indicated in a number of answers to questions this afternoon, I have not changed my view on a second referendum. I believe that we should be putting into effect the views of the people expressed in the first referendum, but I recognise the strength of feeling in the House on this issue from the right hon. Gentleman and others, particularly on the Opposition Benches. That is why it is important that we in this House are able to determine this issue, which is best done through the passage of the withdrawal agreement Bill. That is why I have confirmed yesterday and today that there will be a vote during the passage of the withdrawal agreement Bill on whether to hold a second referendum. The Government’s position will be clear: we do not think it right to hold a second referendum. But it will be for Members of this House to come together and determine that, for those who believe there should be a second referendum to put their case to the House and for the House to come to a decision.
The Prime Minister tells us that, if MPs vote for the withdrawal agreement Bill—which we have not even seen, let alone the amendments that will be tabled to it—we would leave the European Union by 31 July. How on earth does she know that?
Because I have been discussing, and business managers have been discussing, a timetable for the Bill’s passage. Obviously, a business motion and a programme motion have to be agreed by the House. It is very clear, and the determination of the last European Council makes it clear, that bringing the Bill back for Second Reading after the Whitsun recess would enable us to do exactly what I said and leave the European Union on 31 July.

Commons ChamberThe Government have not offered a second referendum. I said to the right hon. Gentleman yesterday in Prime Minister’s questions that our position on that issue had not changed. A second referendum has been rejected twice by this House. But, of course, once we have agreed a deal and the Bill is going through that puts that in place, I am sure there will be Members of this House—because there are Members who do support a second referendum—who will want to press their case.
There is not an issue of an excuse about timing. I believe it is important for us to deliver on the result of the first referendum that took place in 2016. And can I just say this to the right hon. Gentleman? If he is so interested in referendums, the question is, will he now abide by the result of the 2014 Scottish referendum? Yes or no?
Does my right hon. Friend appreciate the anger that her abject surrender last night has generated across the country? Having broken promises 100 times not to extend the time, she knows what I am saying—and she has done that. Does she also accept that this withdrawal agreement undermines our democracy, the constitutional status of Northern Ireland, our right to govern ourselves, our control over our laws, and our national interest? Will she resign? [Interruption.]

Lady wants to ensure that we are able to deliver on the overall vote of the referendum in a way that protects jobs, our Union and our security, and in a way that is orderly and guarantees Brexit for the British people—she said that she did not want a second referendum—I suggest that she gets behind the deal.
Two days ago, I asked the Prime Minister if, as absolutely required under the ministerial code and the Cabinet manual, she sought the Attorney General’s advice on her authorisation of the extension of the exit date, and whether she would publish that advice. She refused to answer. Distinguished lawyers and former judges are convinced that the so-called international agreement is unlawful; I sent her a letter about that yesterday. The Joint Committee on Statutory Instruments has not yet considered the regulations at all. The motion to approve the regulations will come before the House this evening. The European Scrutiny Committee and the Joint Committee will need to see the advice of the Attorney General before the end of the day, when the motion will be received by the House. Where is the advice of the Attorney General? Will she produce it and withdraw the motion?
It is a matter of international law that the date of the UK’s exit has been changed. The purpose of the SI this evening is to reflect that change in domestic law. Should the SI not pass, there would be severe uncertainty for citizens and businesses, and contradictory provisions between EU rules and UK rules, but it would be clear that the date of our exit had changed. The House of Commons voted to seek an extension to article 50, and an agreement was reached with the European Council in relation to that. My hon. Friend has raised the question of the commencement order with me previously. The commencement order is due to come into effect on the date that we leave the European Union. I know that he wants to leave the European Union, and we can of course leave the European Union. Dare I suggest to my hon. Friend that, if he cares to back the deal, we could guarantee leaving?

Gentleman says, “Give it a rest!” He stands up here proclaiming the benefits of democracy and yet tells me to give it a rest when I point out that the people of Scotland voted to remain part of the United Kingdom. He talks about coming together. This House has a duty to deliver Brexit. That means, I believe, delivering a Brexit with a deal that enables that smooth and orderly exit. He asks whether his vote counts and votes in this House count. Of course votes in this House count, but so do the votes of 17.4 million people who voted to leave the European Union.
The statutory instrument for the extension of time was laid one hour ago. There is grave concern that there was no lawful UK authority for the decision on 22 March to extend the exit date. Did the Prime Minister seek the Attorney General’s advice beforehand, as clearly required by both the ministerial code and the Cabinet manual, and will she publish that advice? Why did she not invoke the commencement order for section 1 of the European Union (Withdrawal) Act 2018, repealing the European Communities Act 1972?
My hon. Friend talks about the decision to extend article 50. This House had supported an extension of article 50. Yes, the Council took a different decision in relation to the length of time that that extension could take place for, but the House was clear—people are saying to me, “Listen to the House and respect the House”—that an extension of article 50 should be sought, and an extension was agreed.

Commons ChamberThe hon. Gentleman has raised a very specific case in relation to a certain type of funding. I would be very happy to ask the relevant Minister to respond to him on the specifics of that case in relation to his constituency.
Will my right hon. Friend rule out introducing the withdrawal and implementation Bill if her withdrawal agreement is voted down yet again by the House next week, and then let the United Kingdom leave the European Union on 29 March, as per the people’s vote in 2016, as Parliament has enacted, and as the law requires?
What I have done today in writing to President Tusk is ask for that extension to article 50 until the end of June. I have been clear that, as I have said, I do not believe that Brexit should be delayed beyond that point. That would give us the opportunity to ensure that the House can consider again a deal, and then take forward the withdrawal agreement and implementation Bill in the circumstances that a deal was passed. In the circumstances that a deal was not passed, then it would obviously be necessary, as I have just said to my right hon. Friend the Member for West Dorset (Sir Oliver Letwin), for the House to consider how we should proceed. I would also say to my hon. Friend that, as he will have heard the Secretary of State for Environment, Food and Rural Affairs saying in the debate on no deal last week, there are particular issues, particularly in relation to the governance of Northern Ireland, in relation to leaving the European Union without a deal on 29 March. I continue to hope and continue to believe that the best way for this country to leave the European Union is to do so on the basis of a negotiated deal, and the extension to 30 June would allow us to do that.

Commons ChamberI am grateful to my right hon. Friend for giving way, and I feel for her with the throat condition she has at the moment, I really do. Having said that, she referred to the fact that the backstop is very important. We all know that, and rightly so. The question, however, is also about the withdrawal agreement and implementation Bill, which is to come. First, we have not seen a draft of it, and I hope that we can get that very soon, as my European Scrutiny Committee has just said in its report. Secondly, it is quite clear in the withdrawal agreement that we will not be discharging what she said herself at Lancaster House. We will not truly leave the European Union unless we regain control of our own laws. Under article 4, it is clear that that is not the case. What is her answer to that point?
First of all, I am pleased to hear that my hon. Friend is keen to see the withdrawal agreement Bill. That Bill, of course, as I have said, will be presented to the House this week, if my hon. Friend and others vote for this deal tonight to get it through. I also say to him that yes, there are provisions in relation to the role of the European Court of Justice during the period of our winding down and winding our way out of the European Union, and that covers the implementation period. But what is absolutely clear is that once we are beyond that point, there is no jurisdiction of the European Court of Justice other than for a limited period of years in relation to citizens’ rights. There is no jurisdiction of the European Court of Justice in this country.

Commons ChamberFirst, the right hon. Lady references the Cabinet. This has been discussed by Cabinet, so this is a position that the Government have taken. I would not have brought it before the House today if it were not a position that the Government had taken on this issue.
I have set those dates. If she would care to look at what I have been doing over recent weeks, she will see the points where I have said I would come back today. On the previous time I came back to the House there was a guarantee that I would come back to the House. I said I would bring a motion, and we brought a motion. We will bring a motion tomorrow. So there is a clear and firm commitment from this Government to ensure that we bring those votes to this House. The House then has that opportunity.
I recognise the concern of right hon. and hon. Members to ensure that the voice of the House is heard. That is why I said that those votes will be brought before the House should we lose the meaningful vote. I continue to want to see this House supporting a meaningful vote, so that we can leave with a deal. As she will have heard in my statement, in the case that a vote for no no deal and then a vote for an extension had been put forward, we would take that to the European Union. The decision would not be entirely ours. There has to be a unanimous decision of the 27 member states of the European Union to agree that extension, but were that agreed, we would bring forward the necessary legislation.
Will my right hon. Friend accept that the Bill to delay article 50, to which the right hon. Member for Normanton, Pontefract and Castleford (Yvette Cooper) has just referred, would incur many billions of pounds of taxpayers’ money that would otherwise be available for public services and would otherwise not be handed over to the EU if we left on 29 March? Will she also accept that the Bill is effectively aimed at overturning the democratic will of the British people, which Parliament itself expressly entrusted to the British people and must be honoured?
My hon. Friend raises a number of points about the Bill proposed by the right hon. Member for Normanton, Pontefract and Castleford. Given the commitments the Government have made in relation to these issues, I hope Members would consider that the mechanisms in the Bill have constitutional implications beyond simply the Brexit issue, in terms of the relationship between Government and Parliament, and our democratic institutions going forward. I have been clear today. I want to see a deal that this House can support and which enables us to leave on 29 March with a deal. That is what the Government are working on and that is what the Government continue to work on.

Commons ChamberI have consistently said— and I made the point in my statement this afternoon—that what I want and what the Government want is a deal with the European Union. But there is only one way to ensure that we avoid no deal. I know I say this a lot, and I know right hon. and hon. Members shout out at it and so forth, but if they do not want no deal, they have to agree a deal.
My right hon. Friend is facing intransigence both from the undemocratic EU and from MPs who voted for the European Union Referendum Act 2015, the European Union (Notification of Withdrawal) Act 2017, the European Union (Withdrawal) Act 2018 and the repeal of the European Communities Act 1972 but who are now trying to reverse this with their own votes. She has not signed the withdrawal agreement, which itself contains undemocratic and unconstitutional features, including the backstop and article 4, which removes control over our lawmaking. If this undemocratic intransigence continues, will she therefore walk away from the negotiations?

Commons ChamberMembers across the House have put forward a number of proposals on how this issue can be addressed. They are not indulging in fantasies—they are coming forward with serious proposals, on which this Government will work with them.
On the question of our control over our laws, to honour the referendum, will my right hon. Friend give instructions to make certain that in any future withdrawal and implementation Bill, there will be an express repeal of the European Communities Act 1972, so as to dovetail with section 1 of the European Union (Withdrawal) Act 2018, which we have passed?
As my hon. Friend knows, in the European Union (Withdrawal) Act, we repealed the 1972 Act. It would be necessary to replicate the impact of some aspects of that Act for the purposes of the implementation period, but I certainly take what my hon. Friend has said. Within the withdrawal agreement Bill that we will need to bring before the House, we will make absolutely clear the arrangements for ensuring that the European Communities Act, and its impacts, do not go beyond the end of the implementation period.

Commons ChamberIt is of course right that the Government are taking the necessary contingency arrangements for the situation. The right hon. Gentleman will find that we are talking about those troops perhaps being able to relieve others who are undertaking roles such as the guarding of certain sites. That is what we are talking about.
On the vital issue of UK tax policy, will my right hon. Friend also reconsider the provisions under which the United Kingdom will embrace EU state aid rules? With the European Commission supervising our Competition and Markets Authority, a veto will be given to the Commission over future tax incentives for investment developments such as free ports, airports, and industrial and enterprise zones.
If my hon. Friend looks back at the discussions that have taken place in the European Union, he will see that it has often been the United Kingdom that has been promoting fair competition, including in relation to state aid rules. The question of those state aid rules and what will be included in any future trade agreement with the European Union is, of course, a matter that we look at in detail in the next stage of the negotiations.

Friend confirm what she said at Stoke today: namely, that she will never extend—never extend—the date of our leaving beyond 29 March this year, and never in any circumstances whatsoever allow the repeal of the European Union (Withdrawal) Act 2018, or of the repeal of the European Communities Act 1972 under that Act?
I did indeed confirm that our intent and what the Government are working for is to leave the European Union on 29 March. There are those who may try to find ways to prevent that from happening—I think that is a real risk—but the Government are firm in their commitment in relation to leaving the European Union.
On the issue that my hon. Friend has raised on the withdrawal Act, we have passed the withdrawal Act through this House—through this Parliament—and it does repeal the European Communities Act 1972. Of course, for the period of the implementation period, it would be necessary within the WAB—the withdrawal agreement Bill—as my hon. Friend knows, to ensure that we are still able to maintain the rules that we need to operate by in order to abide by the negotiated agreement on the implementation period, but I can assure him that it remains the commitment of this Government to leave the European Union on 29 March.

Commons ChamberI am not sure that the right hon. Gentleman should spend too much time in the betting shops. I am not sure that the odds on the Liberal Democrats are very good at all.
Will the Prime Minister confirm that, despite the European Council’s so-called legal endorsement of the withdrawal agreement, which it says is not open for renegotiation, this agreement has not been initialled or signed by her and is only a draft—it is no more than a political agreement under which nothing is agreed until everything is agreed, including the backstop—and therefore she can still walk away?
I can certainly confirm that this deal has been negotiated between the UK and the European Union, but it has to go through certain processes in order to be ratified. Part of that is ratification here in the United Kingdom Parliament, and part is ratification in the European Parliament. It is those processes that lead to the final agreement and the withdrawal agreement.

Commons ChamberThe Prime Minister knows that the withdrawal agreement and the political declaration both cover many legal issues beyond the backstop, important and vital though that is. Those issues include the European Court, control over our own laws and questions relating to compatibility with the European Union (Withdrawal) Act 2018. Under the ministerial code, there is an absolute obligation to consult the Attorney General formally and in good time before committing to critical decisions that involve legal considerations. Under the order of the House of, I think, 4 December, the Government must publish in full the Attorney General’s advice on both the withdrawal agreement and the framework. So far, the only advice that has been published is on the Northern Ireland protocol. Did the Prime Minister seek the Attorney General’s advice, under the code, on both these matters in good time, or did she not? If she did seek his advice, why has it not been published?
I think my hon. Friend has asked me variations of that question each time I have made a statement recently. I am clear that the Government undertake their responsibilities in relation to the seeking of legal advice entirely properly and appropriately. Of course, the Government published a full legal position on the withdrawal agreement, and that contained more detail than Governments have previously published on any such occasion or in any similar event. Not only have we done that, but the Attorney General came to the House, made a statement and took many questions from Members on these issues.

Commons ChamberI thank the hon. Gentleman for his remarks about the Government’s decision. This is an exciting opportunity for the United Kingdom to take a leading role in the new commercial space age. He has referenced the new spaceport and the ambition we have for it. I understand that, following a report by the local crofters association, Highlands and Islands Enterprise is moving ahead with its plans, which could create 40 skilled jobs locally in spaceport construction and operation. I recognise the importance of the skilled jobs he is talking about locally. This is a real opportunity for his constituency, but it is also an opportunity for the UK to be at the leading edge of this technology.
The motion relating to the Attorney General that was passed yesterday related to the whole agreement, not just to the question to which the letter that has now been published relates, which is exclusively the protocol on Ireland and Northern Ireland. Given that the ministerial code states:
“The Law Officers must be consulted in good time before the Government is committed to critical decisions involving legal considerations”,
and that the Attorney General has stated that the international agreement is binding on the United Kingdom and the EU, why have we not had an opinion on matters such as the control over laws, European Court of Justice jurisdiction and the incompatibility of the agreement with the repeal of the European Communities Act 1972—matters that are of seminal importance in deciding this question?
I suggest that my hon. Friend looks at the remarks that were made in the Chamber yesterday following the Government’s announcement that they would publish the final advice given by the Attorney General that was asked for.
My hon. Friend has referred again to the repeal of the European Communities Act 1972. As I have said in answer to him on more than one occasion in this Chamber and in the Liaison Committee, it was always clear during the passage of the European Union (Withdrawal) Act 2018, which did indeed repeal the 1972 Act and bring the EU acquis—EU law—into UK law, that in the event that there was an implementation period in which we were to operate much as we do today as a member of the European Union, it would be necessary to ensure that any necessary changes were made, and those changes will be made in the withdrawal agreement Bill, which will be brought before Parliament.

Commons ChamberThe right hon. Gentleman and his hon. Friends have asked me this question about the people’s vote—the second referendum—on a number of occasions, and my answer to that has not changed. I believe that it is important, having given the choice to the British people as to whether we stay in the European Union, that we now deliver on the choice that the British people made. That is a difference of opinion between myself and him—I recognise that—but I think that the majority of the British public want us to get on with doing what they asked us to do.
Does the Prime Minister appreciate that the withdrawal agreement is incompatible with the European Union (Withdrawal) Act 2018, which expressly repeals the whole of the European Communities Act 1972? In this event, we would truly regain our laws. Does the Prime Minister accept that this agreement, being only a treaty, cannot override the statutory provisions of the 2018 Act, and is therefore unlawful? Did she seek the legal opinion of the Attorney General on this question in good time before the agreement was signed by her yesterday, as required under the ministerial code?
I make two points to my hon. Friend. First, one of the things that the European Union (Withdrawal) Act does is bring European Union law into UK law, such that there is that smooth and orderly transition when we leave the European Union, and, of course, the withdrawal agreement will be implemented in our legislation through the withdrawal agreement Act.

Commons ChamberThank you, Mr Speaker. The right hon. Gentleman devoted all his response to the issue of fishing. He is sitting there chuntering that this is a sell-out of Scottish fishermen. I will tell him what a sell-out of Scottish fishermen would be: the policy of the Scottish nationalists to stay in the common fisheries policy.
Does my right hon. Friend accept that this declaration is self-contradictory in that it insists on the sovereignty of both the EU and the United Kingdom legal orders, and that without control of our own laws and by surrendering to binding rules of the European Court, this declaration cannot be reconciled with the repeal of the 1972 Act or with the referendum vote? Will she further note that the European Scrutiny Committee has resolved to hold an inquiry into the Government’s handling and the outcome of these negotiations?
This political declaration asserts the sovereignty of both sides of the agreement—the United Kingdom and the European Union—because that is exactly what will persist. We will be a sovereign nation. We will no longer be under the jurisdiction of the European Court of Justice. There are circumstances where a point that is being looked at—for example, in arbitration—is considered to be a matter of the interpretation of European Union law. There is one body that interprets European Union law: that is the European Court of Justice. What we make clear is that, in those circumstances, the arbitration panel may ask the European Court of Justice for an opinion on the interpretation of European Union law; the arbitration panel will then consider its decision in the light of that opinion.

Commons ChamberWhat is in our national interest is ensuring that we continue to have a good trading partnership with the European Union once we have left. That is why we have put forward a proposal, which is reflected in the outline political declaration, for a free trade area in goods. It is why we have also put forward a proposal that would ensure the frictionless trade of goods across the border. The right hon. Gentleman and I disagree. A customs union is not the only way to ensure that we continue to have a good trading relationship with the European Union. We have put forward a proposal that is reflected in the outline political declaration to achieve that, while also ensuring that we are able to take advantage of operating an independent trade policy.
These 585 pages are a testament to broken promises, failed negotiations and abject capitulation to the EU. Does my right hon. Friend understand that they represent a list of failures—on Northern Ireland, on ECJ issues, on indefinite extension of time, on customs, on full independence of trade and of fisheries and, above all, on our truly leaving the EU, because it will control our laws? Furthermore, there have been some very serious breaches of ministerial responsibilities, the ministerial code and collective responsibility.
What we are looking at here is a withdrawal agreement that determines the withdrawal of the United Kingdom from the European Union and a declaration that identifies the scope and structure of our future relationship. Our future relationship is one that will not see the European Union controlling our laws because, in those areas where we choose to align with the European Union, it will be for this Parliament to decide that, and that decision will therefore be taken here by the United Kingdom. There will not be European Court of Justice jurisdiction in the United Kingdom. That is what we have negotiated in the outline political declaration for our future relationship.
I recognise my hon. Friend as one of the Members of this House who has campaigned on this issue probably since the day—maybe even since before—he came into this House. He has continued to campaign on this issue with a passion, and I recognise the concerns that he has expressed. As Prime Minister and as a Government, it is our duty to ensure that we put together a deal that not only respects the vote of the British people—it does, in the ways that I have said, and it also ends free movement—but does so in a way that protects jobs. That is why I believe it is important not only that we take back control in the areas mentioned, but that we maintain a good trading relationship with the European Union, as well as having good trading relationships elsewhere. That is in our economic interest and in our national interest, and that is what we will deliver.

Commons ChamberThere was an awful lot in the right hon. Gentleman’s comments about process, but not much about substance, and what Labour actually wants to see. It is incumbent on all of us in public life to be careful about the language we use. There are passionate beliefs and views on this and other subjects, but whatever the subject we should all be careful about our language.
The right hon. Gentleman said a lot about process, as I said, and at one point he seemed to be asking us to set out our plan. I have to say to him that we set out our plan in the White Paper of more than 100 pages back in the summer. He talks about a future relationship of a customs union, but whatever future relationship we have, we do have to deal with the backstop issue. Without a backstop in the withdrawal agreement, there will be no withdrawal agreement. Without the withdrawal agreement, there will be no future relationship—nothing is agreed until everything is agreed—so it does not matter what future relationship we want, we still need to deal with this backstop issue.
The right hon. Gentleman’s position has been that no deal is not acceptable in any circumstances. That means accepting any deal that the European Union wants to give us, including a deal that would carve Northern Ireland out of the United Kingdom. Perhaps, though, his shadow Chancellor, who made the comment that he was longing for a United Ireland, might actually welcome that.
All I have to say to the right hon. Gentleman is that, throughout all this, all we have seen from the Labour party and from him is them playing politics with this issue. One minute, they want to accept the referendum, the next they want a second referendum. One minute, they want to say that free movement will end, the next they say that free movement is still on the table. One minute, they want to do trade deals, the next they want to be in a customs union that will stop them doing trade deals. He is doing everything he can to frustrate Brexit and trigger a general election. He has voted against sufficient progress, he has tried to block the withdrawal Act, and he has vowed to oppose any deal that the Government bring back. I am looking and working for the right deal in the national interests of this country; he is putting politics ahead of the national interest.
My right hon. Friend has stated:
“We will not have truly left the European Union”—
I emphasise the words “truly” and “left the European Union”—
“if we are not in control of our own laws.”
Chequers is still on the table. Its common rulebook allows the other 27 EU countries in their Council of Ministers to make our laws for goods and agricultural products with no transcript and no effective veto and undermines the total repeal of the European Communities Act 1972. How can she possibly claim that we will be in control of our own laws and sustain the national interest?
May I say to my hon. Friend that, yes, we have proposed that common rulebook? They are rules that our manufacturers say that they will be abiding by in any case. It has been a pretty stable rulebook for many years. However, it is not correct to say that there will not be a parliamentary lock on those rules. Yes, the process of determining any change to those rules will be up to the European Union, but some of those are international standards and we will, as an independent member of the international standards bodies, have a say in relation to those rules. Parliament will have a lock. We have been clear about that and we set it out in the proposals published after the Chequers meeting in July that any decision to accept or to diverge from those rules—there is a process about determining materiality—will be one that is taken by this Parliament.

Gentleman frequently stands up in this Chamber to complain about the lack of members of the Government coming to the House of Commons to inform Members about matters, but I have come here today to inform the House of Commons about the position, and he complains about that as well. That is typical of the Liberal Democrats; they do not know where they stand on the issue.
Will my right hon. Friend confirm that if we go one second beyond 31 December 2020, we will automatically fall into the multiannual surveillance framework and will therefore be accumulating tens of billions of pounds extra year on year? Does she accept that, and does she also accept that if we continue to be dictated to by the EU in the way in which things are going at the moment, this country will be brought to a humiliating conclusion?
My hon. Friend is obviously one of my hon. Friends who has paid particular, very careful attention to these issues, but I do not agree with the situation that he has set out. We have been negotiating with the European Union. That has seen both the European Union recognising our arguments and moving its position in relation to some issues, and our recognising our need to put forward proposals that are acceptable to us but that recognise the concerns that have been expressed by the European Union.
But what we are doing, and what I am doing, is making sure that any deal that we have is the deal that is best for the future of the United Kingdom. That is a deal that delivers on the Brexit vote but does so in a way that protects jobs and livelihoods.
In relation to the future relationship, I want to ensure that that future relationship can start at the end of the implementation period, in which case, of course, there would be no question of a different relationship with the European Union for any period of time. We have agreed the financial settlement as part of the withdrawal settlement, as my hon. Friend knows, but I remind the House, yet again, that—this was a phrase first used, I think, by the EU itself—nothing is agreed until everything is agreed.

Commons ChamberThe right hon. Gentleman commented on the preparations for no deal. It is entirely right and proper for this Government to make preparations for every eventuality, because we are going into a negotiation. It is right that we step up our preparations for no deal to ensure that we are able to deal with whatever comes at the end of the negotiations. The right hon. Gentleman’s key question—he asked it twice—was whether I would work with people across this House to stay in the single market and in the customs union. The answer is an absolute unequivocal no. We are leaving the single market and we are leaving the customs union.
How does my right hon. Friend reconcile the Chequers statement with the recent repeal of the European Communities Act 1972 under the European Union (Withdrawal) Act 2018 and with the European Court of Justice and with democratic self-government in this country?
We have, as my hon. Friend says, repealed the 1972 Act, but we have also ensured that we will take EU laws into UK law at the point at which we leave the European Union, such that we see a smooth and orderly Brexit. In the future, the European Court of Justice will not have jurisdiction over the United Kingdom, and this Parliament will make sovereign decisions. The decision as to whether Parliament is willing to accept the deal that has been negotiated will be made when the meaningful votes in the withdrawal and implementation Bills come before the House. Thereafter, it will be up to this Parliament to decide whether it agrees with any changes to the rules or any laws that this Parliament wants to pass. That is sovereignty—taking back control of our laws. That is what I believe people want and that is what we will do.

Commons ChamberI set out clearly the progress made in our talks since we triggered article 50. The right hon. Gentleman says it is wrong for the national health service to prepare for no deal. Actually, it is right that contingency arrangements are being put in place across the Government, because the negotiations have not yet been completed. The European Union itself—we agreed with this—is looking to the October deadline. As I said in my statement—if he noticed that paragraph in my statement—I believe it is right that, when this House looks at the details of the withdrawal agreement, it should have sufficient detail about our future relationship with the European Union to be able to make that decision. Finally, he talks about role of the United Kingdom and the importance of jobs in the future. I say very simply to him—I have said it before, but I will continue to repeat it—that if he is interested in jobs in Scotland then he should make sure that Scotland stays in the United Kingdom.
First, I congratulate my right hon. Friend on Royal Assent being granted to the European Union (Withdrawal) Act 2018, which repeals the European Communities Act 1972 in line with the wishes of the voters in the referendum. This repeal, as my right hon. Friend knows, means no freedom of movement, no customs union, no single market and no European Court of Justice. It is a sovereign Act returning to this country self-government and is the law of the land. There are, however, some disturbing reports in parts of the press that the Government may have in mind proposals for some form of legal re-entry into a form European unity of some description—for example, in the context of the European economic area. This is preposterous, and I simply ask my right hon. Friend to dismiss those reports, as they are completely unfounded and would undermine trust in our democracy if they were true.
In relation to the point my hon. Friend makes about the EEA, I have been clear from the start that that is one of the things the European Commission suggested was on the table. The EEA is not right, because it would not deliver—particularly in the form the European Commission proposed it—on the vote of the referendum and the vote of the British people.

Commons ChamberWe are very clear that we are going to leave the European Union on 29 March 2019. We will be leaving the customs union, and we want to ensure that we can have an independent trade policy. We also want to ensure that we deliver—we are committed to delivering—on our commitment to having no hard border between Northern Ireland and Ireland, and that we have as frictionless trade as possible with the European Union. There are a number of ways in which that can be delivered—[Interruption.] There are a number of ways in which that can be delivered, and if the hon. Lady is so interested in the whole question of a customs border, she might like to ask her Front Benchers to come to a decision on what the Labour party policy actually is on this.
The European Scrutiny Committee, which I have the honour to chair, has invited Mr Olly Robbins to appear before the Committee on several occasions since February, but so far this has not been arranged. Will my right hon. Friend be good enough to use her charm to ensure that Mr Robbins does appear, as have already the Chancellor, the Secretary of State for Exiting the European Union and Sir Tim Barrow?
As my hon. Friend will know, it is not normally the case that any request to a civil servant to appear before a Committee is automatically accepted; decisions are taken about the levels at which civil servants should appear before Committees. As he said, he has had a number of my right hon. Friends appear before his Committee—I remember, I am not sure I can say with fond memory, the time when I appeared before the European Scrutiny Committee when I was Home Secretary—but I will certainly look at the request that he has made.

We raise a number of cases with the Indian Government, as I did this morning. It is important that we recognise the independence of the judiciary in both countries.

Commons ChamberI join the right hon. Gentleman, as I am sure everybody in the House does, in wishing the very best to Nick Bailey and his family as he completes his recovery. I also thank the NHS staff who not only treated him, but continue to care for Sergei and Yulia Skripal. I was pleased to meet some of those staff and talk to them about their experience when I was in Salisbury just over a week ago; their dedication was very clear.
The right hon. Gentleman raises a number of issues. We have had discussions with the Scottish National party and others about what a Magnitsky amendment might look like. We have already taken some action, but we are looking to ensure that we take the strongest possible action. Of course, a number of my colleagues in the European Council mentioned their own Magnitsky legislation and that issue.
I will write to the right hon. Gentleman on SLPs, if I may. We have taken some action, but are looking further at what we might be able to do.
On Catalonia, we continue to wish to see the rule of law upheld and to ensure that the Spanish constitution is upheld. On Northern Ireland, talks are starting today with the European Commission on the details of the ways in which we will be able to ensure that there is no hard border between Ireland and Northern Ireland. Where appropriate, those talks will also involve the Irish Government.
Finally, the right hon. Gentleman mentions the common fisheries policy. We will be leaving the common fisheries policy and taking back control of our waters. But it is a bit rich for him to make those comments, given that he belongs to a party that wants to stay in the CFP in perpetuity.
The European guidelines of 23 March and the EU proposed legal protocol both insist on the autonomy of the EU legal order and the jurisprudence of the European Court of Justice. Will my right hon. Friend give the House an absolute assurance that in these negotiations the Government will not accept exclusive or sole jurisdiction of the European Court over the UK from 29 March 2019, nor after 30 December 2020—at the end of the implementation period—and that the Government will not enter a treaty or introduce legislation that confers such jurisdiction, which a recently retired European Court judge said would be a “legal viper’s nest”?
As I have said before in this Chamber in response to a question from our hon. Friend the Member for North East Somerset (Mr Rees-Mogg), during the implementation period, there will of course continue to be that role for the European Court of Justice, because we will be continuing to operate on largely the same basis as currently. Once we have ended the implementation period, it will be a very different story. We will then be absolutely in a position that I know that my hon. Friend the Member for Stone (Sir William Cash) wants: one of taking back control of our laws. As I said in my statement, there are some issues still to be addressed on the withdrawal agreement, including the governance of that agreement. A number of interesting ideas have been proposed that do not give sole authority to the European Court of Justice, which is not something that we would want.

Commons ChamberFirst, I remind the right hon. Lady that the 80% reference was in one of the options on future customs arrangements between Northern Ireland and Ireland. Of course, what I set out in the speech in relation to that border issue was about not just the customs arrangements, but the regulatory standards that this country will be following once we have left the European Union. We are not going to be in a customs union—we are not going to be in the customs union—because that would prevent us from being able to follow an independent trade policy, which is something that we should be following because we can see great opportunities for companies, businesses, jobs and prosperity in the UK as a result.
Given my right hon. Friend’s confirmation in both her speech on Friday and her statement today that our EU policy rightly rests on fundamental UK principles in our national interest—namely, the sovereignty of our own Parliament and our own judiciary, our own democracy and the integrity of the United Kingdom—does she agree that the official Opposition’s continuous unprincipled reversals of their policy betrays not only their own voters, but the country?
My hon. Friend is absolutely right. We consistently hear the Opposition saying one thing about their Brexit policy one minute and something else the next. Crucially, they would not be delivering for the British people, because they would stay in the single market and the customs union, they would see the jurisdiction of the European Court of Justice, and they would continue to pay sums of money over to the European Union. Those are the very things that people voted against.

Commons ChamberWe recognise that we need to take action in relation to rough sleeping, which is why we are putting more money into projects to reduce rough sleeping. That includes projects such as Housing First, which are being established in a number of places to ensure that we can provide for those who are rough sleeping. None of us wants to see anybody rough sleeping on our streets, which is why the Government are taking action.
Today is the anniversary of the signing of the Maastricht treaty, and we have come a very long way. May I congratulate my right hon. Friend on her approach to the customs union? May I also mention the fact that, in the Liaison Committee last December, I warned her about ultimatums from the EU, as I did again in my urgent question only last week? Will she be good enough to be very robust when discussing these matters in the Brexit Committee, as I am sure that she will be, so that we ensure that we repudiate any of these EU threats?
At the time when the Maastricht legislation was going through this House, I suspect that there would not have been many thinking that my hon. Friend would stand up to recognise the anniversary of the signing of the Maastricht treaty. I suspect that he feels able to do so only because we are coming out of the European Union. I assure him that we will be robust in our arguments. As I have said right from the very beginning, we will hear noises off and all sorts of things being said about positions, but what matters is the position that we take in the negotiations as we sit down to negotiate the best deal. We have shown that we can do that; we did it December and we will do it again.

Commons ChamberAs the right hon. Gentleman knows, there will now be a process of completing some of the details behind the withdrawal agreement such that the withdrawal agreement can then be put to this House, to this Parliament and to the European Parliament. We have always been clear that there will be a meaningful vote for this House. Subsequently, as we have stated to the House, we will have the EU withdrawal agreement and implementation Bill, which will put the various provisions of the withdrawal agreement legally into UK law. That was a key element in relation to citizens’ rights in the phase 1 negotiations.
May I urge my right hon. Friend to give equal consideration, in the Cabinet and elsewhere, not only to the vital issues of our trading relationships and regulatory divergence, but to the perpetual, ever-escalating, undemocratic centralisation of the EU itself, which remoaners, reversers, status quo-ites and the Opposition seem incapable of grasping, and which absolutely proves how right the voters were in June last year in voting to escape from the European Union?
I can assure my hon. Friend that in the negotiations that we hold with the European Union, we will ensure that the British national interest is represented and that we come away with a deal that is in the interests of the UK. I believe that that will also be in the interests of the EU. How the European Union develops once we have left is, of course, a matter for the EU27. As he suggests, a number of recent speeches have suggested an increased centralisation of the European Union, but that will be a matter for the 27, not for us.

Commons ChamberThere is a huge assumption underlying the right hon. Gentleman’s question, because he says that the Labour party actually agrees with us on membership of the customs union and the single market, but there are many views on that in the Labour party. It is not at all clear that it agrees with the Government on the future relationship with the internal market and the customs union, because it keeps taking different positions. If the right hon. Gentleman has inside information on the Labour party’s position, I would be very glad to hear it.
Does my right hon. Friend welcome the outbreak of unity on the Government Benches regarding the outcome of the progress report? Does she agree that a number of matters still need to be resolved? Serious questions will be addressed, and the European Scrutiny Committee will be paying serious attention to those questions. Does she also agree that the Opposition have demonstrated not only today but over past weeks a complete inconsistency on every point of principle and detail? They are simply a national disgrace.
I certainly agree with my hon. Friend, and I am grateful to him for his reference to the statement of unity. I know that the European Scrutiny Committee has always taken its role very seriously and will continue to do so. Its role is particularly important as we reach this point in time and as it considers these particular arrangements. Yes, there are serious issues that still need to be addressed and will be addressed in phase 2 of the talks, but the important thing was getting on to phase 2 so that we can look at such issues in much more detail. As he says, the Labour party has distinguished itself only by the fact that it has had 12 different Brexit plans over the past 18 months. It really does not know what its view is on this at all.

Commons ChamberAs I just said in my response to my right hon. Friend the Member for Chingford and Woodford Green (Mr Duncan Smith), an implementation period is about a period of adjustment to the future relationship. That is the basis on which I have put it forward to the European Union, and that is the basis on which we will be negotiating an agreement on it.
Does my right hon. Friend accept that it is a potential bear trap if the European Court is directly involved in any implementation period? Its case law asserts its supremacy over our Parliament and our courts, and includes a commitment to the charter of fundamental rights and political integration.
As my hon. Friend knows, I have been clear that one of the intentions of people who voted for the UK to leave the EU was to ensure that in future the jurisdiction of the European Court of Justice no longer covered the United Kingdom. We will of course have to negotiate the basis of the implementation period. If we are going to ensure that we have the greatest possible certainty for business during that period, it will be necessary for us to see as little change during that period as is commensurate with that certainty for business. Indeed, one of the purposes of the European Union (Withdrawal) Bill is to bring the EU acquis—the EU law—into UK law to give that certainty to businesses and individuals here.

Commons ChamberI have to say to the right hon. Gentleman that, as we leave the European Union in March 2019, we will leave full membership of the customs union and full membership of the single market. What we then want is a period of time when practical changes can be made, as we move towards the end state—the trade agreement—that we will have agreed with the European Union. We have to negotiate for the implementation period what the arrangements would be. We have suggested that that should be a new agreement—an agreement that we should be able to operate on the same basis and on the same rules and regulations.
My right hon. Friend’s Florence speech stressed the fundamental principles of UK democracy and accountability in this House, upon which all else depends. The Opposition voted against the withdrawal and repeal Bill, and the repeal of the European Communities Act 1972. Does she agree that our voters have every right to hear a public explanation from the Opposition—remainers and reversers—about why, despite the referendum vote, they still subscribe, under the EU’s undemocratic system of lawmaking, to the closed-door Council of Ministers, where decisions are taken behind closed doors and largely in secrecy, which contrasts so vividly with what goes on in this House, with Bills and amendments, and with speeches and votes recorded?
My hon. Friend is absolutely right to point the finger at the Opposition on this particular issue. They claim they are going to support the result of the referendum, yet they vote against the very Bill that will put that in place. Not only do they do that, but in voting against the European Union (Withdrawal) Bill, they have voted against bringing environmental regulations into UK law and bringing workers’ rights into UK law. The Labour party voting against bringing workers’ rights into UK law; it is this Government who are supporting them.

Commons ChamberThe right hon. Gentleman talked about a variety of issues. He talked about Parliament and transparency. We have been very clear that there will be a vote in this Parliament on the deal that has been negotiated with the European Union, and we expect that to take place before the European Parliament has an opportunity to vote on it. There will be many opportunities—in legislation and in other ways—in the coming weeks and months for Parliament to make its views known on these various matters.
Let me come on to the position that the right hon. Gentleman referred to in relation to workers’ rights. We are very clear, as I was in the objectives that I set out in the Lancaster House speech in January, and as I have continued to set out, in the article 50 letter and elsewhere, that we want to protect workers’ rights—indeed, we want to enhance workers’ rights.
The right hon. Gentleman talks about there being no plan. I set out our objectives in that Lancaster House speech and in the article 50 letter, and have continued to set out those objectives, whereas the Labour party has had seven plans on Brexit in nine months. We have members of the Labour party Front Bench—the shadow Home Secretary, the shadow Chief Secretary and the shadow Attorney General—who want to retain free movement. We have 35 Labour MPs who want to retain membership of the single market. Neither of those, as far as I am aware, were actually in the Labour party manifesto that people stood on at the last election.
Then we get on to the whole issue of the negotiations on EU citizens and their rights here in the United Kingdom. I have to say to the right hon. Gentleman that I find it bizarre, if not worrying, that, in the position he holds, he is willing to stand in this House and say he has no care for UK citizens living in the European Union, because that is what he is saying. I said at an early stage that we wanted to address the EU citizens’ rights issue early. The European Union were clear that there was no negotiation before notification. It is one of the first issues that we are addressing after notification. They were clear it had to be undertaken on a reciprocal basis, and they were clear that, whatever the United Kingdom said, the European Union would still be arguing about its proposals in relation to the protection of rights for EU citizens. So people who say that we should not be dealing with this on a reciprocal basis simply do not understand what negotiations are about, because the other side will be negotiating on these issues.
The right hon. Gentleman talks about the issue of no deal being better than a bad deal. I will tell him what I worry about in terms of a bad deal: I worry about those who appear to suggest in Europe that we should be punished in some sense for leaving the European Union, and I worry about those here—from what he says, I think the Leader of the Opposition is in this particular camp—who say we should take any deal, regardless of the bill and regardless of the circumstances. He would negotiate the worst deal with the biggest possible bill.
Finally, the right hon. Gentleman talks about wanting a future relationship based on a partnership of shared values with trade deals across the world. That is exactly what I said in my statement, so I suggest he start supporting the Government on their Brexit arrangements.
Given Brexit and our vital red lines on the European Court, and the repeal of the European Communities Act 1972, does my right hon. Friend agree that a reasonable framework to protect reciprocal citizens’ rights while making no concession at all on preserving our own Westminster jurisdiction and our own judicial sovereignty would be a tribunal system such as I outlined in the House last week which would be along similar lines to the EFTA Court and a parallel source of law agreement?
My hon. Friend raises an interesting proposal. Of course, we are looking at a variety of arrangements for the enforcement of agreements that we come to. In relation to the EU citizens’ rights, if these form part of the withdrawal treaty, they will be enshrined in international law. But we should also recognise that our courts are world-renowned—they are respected around the world—and what I want to see, and would expect, is that these citizens’ rights for EU citizens in the UK would be upheld and enforced by our courts in the same way as UK citizens’ rights are upheld and enforced by our courts.

Commons ChamberI am grateful to the right hon. Gentleman for saying that the Labour party respects the outcome of the referendum and the process that is now under way. He said that the next steps are the most crucial—the most important—and, of course, we now enter that formal process of negotiation.
It does seem, however, that the message that the right hon. Gentleman has sent today has not got through to all his Front Benchers. I understand that as the Cabinet met this morning to approve our course, his shadow International Trade Secretary tweeted a photo of me signing the A50 letter, claiming I was “signing away” our country’s future. I am afraid that that is what we see all too often from Labour: talking down Britain; desperate for the negotiations to fail; and out of touch with ordinary working people.
The right hon. Gentleman referred to the tests—I will come on to those—and asked me specifically about EU nationals. I expressly referred to that in the letter to President Tusk and made it clear that I would hope that we could deal with this issue of EU nationals here and UK nationals in other member states at as early a stage as possible in the negotiations. As I have said in this House before, I believe that there is good will on both sides to do that.
The right hon. Gentleman mentioned the tests that the Labour party has set out for the negotiations. I have been looking at those tests because, actually, there are principles that the Government have, time and time again, said we are determined to meet. He asks if the final deal will ensure a strong and collaborative future relationship with the EU. Yes, and in my letter to President Tusk, that is exactly what I set out our intentions to be. Will the deal deliver the same benefits we currently have as a member of the single market and the customs union? We have been clear that we want to get the best possible deal, and free and frictionless trade. Will the deal protect national security and our capacity to tackle cross-border crime? Yes. Will the deal deliver for all regions and nations of the UK? We have been very clear that we are taking all nations and regions into account, as I say in the letter to President Tusk. As I said during Prime Minister’s questions, we expect that, as powers are repatriated, the devolved Administrations will see a significant increase in their decision making.
The right hon. Gentleman’s fifth test is: will the deal defend rights and protections and prevent a race to the bottom? We have been very clear that workers’ rights will be protected—they are not up for negotiation under this Government. Perhaps he should listen to his own Mayor of London, who has said:
“to give credit to the government, I don’t think they want to weaken workers’ rights…there’s been some anxiety…I’ve seen no evidence from the conversations I’ve had with senior members of the government that that’s their aspiration or their intention or something they want to do.”
But the Labour party has set out a sixth test that I do not think the right hon. Gentleman mentioned specifically, and perhaps that is because of the confusion in the Labour party. The sixth test is, “Will the deal ensure fair management of migration?” What we see on that is a confused picture from the Labour party. The shadow Home Secretary says that freedom of movement is a worker’s right, and the right hon. Gentleman himself said:
“Labour is not wedded to freedom of movement for EU citizens as a point of principle, but I don’t want that to be misinterpreted, nor do we rule it out.”
Little wonder that nobody has any idea of the Labour party’s position on that issue.
As I said earlier, on today of all days we should be coming together. We should be accepting the ambition for our country for the future. We should not be talking down the negotiations as the right hon. Gentleman does. We should set our ambition, our optimism and our determination to get the best possible deal for everybody in the United Kingdom.
The Leader of the Opposition’s remarks were breathtaking. For decades, from Maastricht onwards, he voted with us over and over and over again.
Today is an historic day indeed. Can my right hon. Friend reaffirm that at the very heart of this letter lies the democratic decision of the referendum of UK voters, given to them by a sovereign Act of Parliament by six to one in this House, enabling the British people to regain their birthright to govern themselves for which people fought and died over generations? The referendum was followed by a massive majority of 372 in this House of Commons on the Third Reading of the withdrawal Bill itself. Trade and co-operation, yes; European government, no.
I think I can give my hon. Friend the reassurance that he seeks if I quote from the opening paragraph of my letter to President Tusk. The very first line reaffirms:
“On 23 June last year, the people of the United Kingdom voted to leave the European Union.”
But I go on to say that we want
“the European Union to succeed and prosper.”
The vote was not a
“rejection of the values we share as fellow Europeans…Instead, the referendum was a vote to restore, as we see it, our national self-determination.”

Commons ChamberThe right hon. Gentleman mentioned a range of issues. He spoke again about the issue of EU nationals. As I have said in the House and as has been said by others from this Dispatch Box, we do want to ensure that the issue of the status of EU nationals who are living in the UK is dealt with at an early stage in the negotiations, but we also have a consideration for the UK nationals who are living in the EU. He said that the EU nationals living here are individuals who have contributed to our society. Indeed they are, but UK nationals living in EU member states are individuals who have contributed to their society and economy. I want to ensure that their status is also ensured. We hope and expect that this will be an issue that we can address at an early stage.
The right hon. Gentleman talked about the need to come forward and be very clear about the need for a transitional period. I refer him to the speech I gave in Lancaster House in January and to the White Paper that we published. The need for an implementation period so that we have a smooth and orderly Brexit process is one of the objectives that was set out in that speech and in that document.
The right hon. Gentleman talked about refugees from north Africa and the middle east. What we want to ensure is that people do not feel the need to make the often dangerous, life-threatening journey across the central Mediterranean. Many of these people—more than three quarters of the people who are doing this—are not refugees; they are economic migrants. We need to ensure that we are providing facilities and working with countries in Africa—which the EU and other countries are doing—to ensure that the circumstances are such that people do not try to make a life-threatening journey. We also need internationally to be able to make a better distinction between refugees and economic migrants, so that we can give better support to those who are refugees.
The right hon. Gentleman appeared to suggest that the UK Government are doing absolutely nothing to break the vile smuggling rings. In my statement, I quoted a recent example of the work of the National Crime Agency; I might add that it was a Conservative-led Government who set up the NCA and the Organised Immigration Crime Taskforce. The Government are dealing with these issues. He talks about abuses and the movement and trafficking of people, but it is this Government who brought in the Modern Slavery Act 2015. I am very proud that it is this Government who did so.
The right hon. Gentleman referred to global Britain and what it means. I will tell him what it means. It is about a strong, self-governing Britain, a Britain that is trading around the world with old friends and new allies alike, and a Britain that is proud to take its place on the world stage.
I congratulate my right hon. Friend not only on her statement and the way in which she dispatched the Leader of the Opposition, but on the passage of the European Union (Notification of Withdrawal) Bill. Does she accept that now is the time for the UK to do all the things that she has recommended in her statement and, in addition to that, to take urgent legal advice in respect of the legal warnings that have been given by Lord Hope of Craighead to be sure that we do not have any unforeseen further attempts to undo that Bill in the courts?
I can assure my hon. Friend that, as we move ahead with this, as we have at every stage, we will take appropriate legal advice, but as he will know we do not discuss that on the Floor of the House.

Gentleman is right that I have confirmed our commitment to the common travel area; I have been discussing that with the Taoiseach, and officials continued those discussions. The right hon. Gentleman referenced EU citizens; as I said in my statement and in response to the Leader of the Opposition, in the United Kingdom we all value the contribution that EU citizens have made to the United Kingdom—to our society, to our economy, to our public services. We want to be able to give them the reassurance at as early a stage as possible of their continuation. As the UK Government, of course we have a duty to consider UK citizens living in other EU states as well and, as I have said, it has been clear that there is good will on all sides in relation to this matter, but there is an expectation that this will be considered in the round and that we can look at EU citizens here and UK citizens in other member states.
The right hon. Gentleman also asked a number of questions about what I was putting forward to the European leaders of the 27. Of course, what I was putting forward was the views of the United Kingdom. It is the UK that will be negotiating; we listen, we take account of, and we incorporate views of Scotland, Northern Ireland and Wales, but when I am sitting there around the EU Council, I am doing so as the Prime Minister of the United Kingdom.
Did my right hon. Friend observe that after she had spoken to the 27 they were far more realistic, particularly with respect to the question of defence and NATO, than they had been beforehand, and in particular than in respect of Donald Tusk’s letter to the 27, which he sent them on 31 January?
My hon. Friend is absolutely right; there is a growing recognition among the member states of the European Union that within NATO it is important to meet the 2% commitment for expenditure on defence. I am pleased to say that a small number of other European member states have already reached that 2% level, but others are actively moving towards that 2%—most notably, perhaps, some of the Baltic states.

Commons ChamberIn their joint statement of 15 December, the Presidents of the European Council and the European Commission, and the Heads of State of all 27 member states, unanimously insisted that
“access to the Single Market requires acceptance of all four freedoms”
including freedom of movement and the European Court of Justice. Does my right hon. Friend agree that such an ultimatum is unacceptable and that it will not be accepted by the British people?
I have said all along that I believe that underlying part of the vote to leave the European Union was the desire of the British people to have control over immigration, and for decisions on immigration to be made by the Government here in the United Kingdom. We should deliver on that. I look at these issues in terms of the deal we want to negotiate and the outcome we want, which is the best possible deal for trading with, and operating within, the single European market, but that should be commensurate with the other requirements we have: British laws made here in Britain and control on immigration.

Commons ChamberThe right hon. Gentleman said at the beginning of his response to my statement that he had been over in Brussels last Thursday, meeting various socialist leaders who listened to him. I suppose that, from his point of view, it is good to know that somebody is listening to him.
May I address the last two issues to which the right hon. Gentleman referred? As I said in my statement, and as he knows, my right hon. Friend the Home Secretary will make a statement on Calais and our response to the issue of unaccompanied minors, bringing children to the United Kingdom and the details involved. All I will say now is that we have been working very carefully, for a considerable time, with the French Government, not only to improve matters in relation to Calais, but to ensure that we abide by our requirements, under the Dublin regulations, to bring to the UK children —unaccompanied minors—who have family links here. That process has speeded up. We have put in extra resources from the Home Office and we have seen more children brought here.We have also adopted a scheme to bring 3,000 vulnerable children from the region—the middle east and north Africa—to the United Kingdom, working with the United Nations High Commissioner for Refugees. We are putting in place the Dubs amendment —the Immigration Act 2016 proposals—which require us first to negotiate and discuss with local authorities their ability to receive children in the United Kingdom. The overriding aim of everyone in the House should be to ensure that it is in the best interests of the children who are being looked at and dealt with. It is no help for those children if we cannot properly provide for them when they come to the United Kingdom.
The right hon. Gentleman did not discuss the wider migration crisis, other than to make a reference in which he said it was mainly due to Syrian refugees. What we have seen in the migration crisis is large numbers of people moving, not from Syria but mainly from parts of Africa, which is why the United Kingdom has consistently argued for more work upstream to stop the numbers of people coming through and to ensure that people have opportunities in source and transit countries, rather than requiring to come here to the United Kingdom.
The right hon. Gentleman made a reference to the indiscriminate bombing in Aleppo. I assume that he was referring to Russian action as well as to Syrian regime action. It was important that the UK put that matter on the table for the agenda of the European Council, which made the agreements that it did.
Coming on to Brexit arrangements, the right hon. Gentleman referred to the tone since the Conservative party conference. I have to tell him that when I was in the European Council last week a number of European leaders commended the speech that I gave at the conference, including one or two socialist leaders who may have talked to him.
The right hon. Gentleman says that we do not have a plan. We have a plan, which is not to set out at every stage of the negotiations the details of those negotiations, because that would be the best way to ensure that we did not get the best deal for the UK. He talked about free movement, and I notice that at the weekend the shadow Foreign Secretary once again refused to say what the Labour party’s position on free movement was and whether it would bring an end to it.
The right hon. Gentleman talked about indecision. I have to say to the Leader of the Opposition that he could not decide whether we should be in or out of the European Union, and he could not decide when we should invoke article 50. The only thing we know about his position is that he would have unfettered immigration into this country—the very thing that the British people have told us they do not want. Unlike him, the Conservative party is listening to the British people.
In congratulating my right hon. Friend on her principled stand in implementing the verdict of the British people, despite the doom and gloom that pours out from parts of the media, may I ask whether she is aware that last week the Chairman of the European Parliament’s Committee on Budgets stated that the EU was too intrusive, it broke its own rules, its members did not trust one another and that it needed, as he put it, an electric shock? Does she agree that the EU itself is in deep trouble? It knows it, and the British people got it right.
One of the challenges for the 27 remaining states of the European Union is to decide the shape and way in which the EU acts as it goes forward. They have seen the views of the British people, and that a number of elements led the British people to decide to leave the EU. It is for the remaining 27 to think carefully how they want to take the EU forward in future.

Commons ChamberThe right hon. Gentleman raised a number of issues. First, he referred to the question of hate crimes that have taken place in the United Kingdom. We have a proud history in the UK of welcoming people into this country, and there is no place in our society for hate crime. The Government have already published a new action plan to take action against hate crime. We are concerned about the levels of hate crime that we have seen. My right hon. Friends the Home Secretary and the Foreign Secretary met Polish Ministers earlier this week to discuss the particular concern about some terrible attacks that have taken place on Polish people here in the UK. We are very clear, and the police are very clear, that they will act robustly in relation to hate crime. Anybody who has been a victim of this or who has allegations of hate crime taking place should take those allegations to the police.
The right hon. Gentleman talked about what we will be doing in our negotiations with the European Union. I covered this in my statement, but just to reiterate: what we will be doing as we negotiate our leaving the European Union is negotiating a new relationship with the European Union. That will include control on the movement of people from the EU into the UK—I do not think he referred to that—but it will also be about getting the right deal for trade in goods and services that we want to see. It will be a new relationship. As I indicated in my statement, and indeed in Prime Minister’s questions, I will not be giving a running commentary, and the Government will not be giving a running commentary, on our negotiations. There is a very good reason for that. We want to get the best deal. We want to get the right deal for the United Kingdom, and if we were to give a constant running commentary and give away our negotiating hand, then that is not what we would achieve.
The right hon. Gentleman referred to the issue of steel. I raised the issue of over-production in the plenary session. That was important, because it was not just being raised with the Chinese Government but with all the leaders around the table. Crucially, the G20 has recognised the significant of this and recognised the steps that some Governments are taking, which are leading to some of the problems that we see. That is why the new forum has been introduced, which will be looking at these issues. The Chinese will be sitting on that forum, and they will be part of those discussions.
On Hinkley, I have said it before and I will say it again: the way I work is that I do not just take a decision without looking at the analysis. I am looking at the details and looking at the analysis, and a decision will be taken later this month.
On Saudi Arabia, I met the deputy crown prince at the G20, and I raised with him the concerns about the reports of what has happened in Yemen. I insisted that these should be properly investigated. The Leader of the Opposition referred to our relations with Saudi Arabia, and I think he implied that what happened in Saudi Arabia was a threat to the safety of people here in the UK. Actually, what matters is the strength of our relationship with Saudi Arabia. When it comes to counter-terrorism and dealing with terrorism, it is that relationship that has helped to keep people on the streets of Britain safe.
Finally, I hold the very clear view, as does the Conservative party, that if we are to see prosperity and growth in the economies around the world, the way to get there is through free trade. Free trade has underpinned the prosperity of this country. I will take no lessons from the right hon. Gentleman on action to help developing countries and those who are in poverty elsewhere in the world, because this Government have a fine record of humanitarian support, educating girls and others around the world and helping to give people access to the medical care, water and resources that they need. It is free trade that underpins our growth, and we will be the global leader in free trade. Free trade can also be the best anti-poverty policy for those countries. I will unashamedly go out there and give the message that we want a free trade country, and I am only sorry that the Labour party is turning its back on something that has led to the prosperity of the United Kingdom.
May I congratulate my right hon. Friend on her emphatic support for free trade? In the European Union, according to the Office for National Statistics, we run a deficit with the other 27 member states of £62 billion a year. However, we run a surplus of more than £30 billion on the same goods and services with the rest of the world, and that surplus went up about £10 billion last year alone. Will my right hon. Friend therefore continue her crusade for free trade to develop our world opportunities through Brexit and to make sure that the European Commission and the European Union no longer continue to run our trade policy? We will do it ourselves, and we will do it really well.
My hon. Friend is right. We have an opportunity, and I want to ensure that we are ambitious in seizing that opportunity to develop trade deals around the world. We will be developing the new relationship that I have referred to with the European Union, part of which will obviously be about how we trade with the EU in relation to goods and services, but we have the opportunity to develop trading relationships around the rest of the world. Of course, we cannot formally have those deals in place and operating until we leave the European Union, but we can do the preparation to make sure that they are there when we need them.

Since 2010, the Government have removed over 30,000 foreign national offenders, including 5,692 in 2015-16—the highest number since records began. The number of removals to other EU countries has more than tripled, from 1,019 in 2010-11 to 3,451 in 2015-16. We aim to deport all foreign national offenders at the earliest opportunity; however, legal or re-documentation barriers can frustrate immediate deportation. Increased rates of detection can also lead to the population of foreign national offenders increasing despite a record number of removals.
Over 6,500 of the FNOs in the UK are still serving a custodial sentence. The Ministry of Justice has been working to remove EU prisoners under the EU prisoner transfer framework decision, which is a compulsory means of prisoner transfer that allows us to send foreign criminals back to their home country to serve their sentence. The record number of FNO deportations we have achieved has been due to changes made by the Government. We have reset the balance between article 8 of the European convention on human rights and the public interest in deportation cases. We have also introduced a “deport first, appeal later” power, which means foreign national offenders may appeal against deportation only from their home country, unless they will face a real risk of serious irreversible harm there. More than 3,500 foreign national offenders have been removed since that came into force in July 2014, and many more are going through the system.
The police now routinely carry out checks for overseas criminal convictions on foreign nationals who are arrested, and refer them for deportation. In 2015, the UK made over 100,000 requests for EU criminal record checks—an increase of 1,100% compared with 2010—and in December, the European Council agreed that conviction data relating to terrorists and serious and organised criminals should be shared systematically. We must never give up trying to improve our ability to deal with FNOs and tackle the barriers to deportation: we have just legislated to GPS-tag FNOs who are subject to a deportation order, and we are legislating to establish an FNO’s nationality as early as possible to avoid delays during deportation proceedings.
Before 2010, there was no plan for deporting foreign national offenders. Their rights were given a greater priority than the rights of the public here, and they were routinely abusing the appeals system to avoid deportation. This Government have put in place a strategy for removing foreign national offenders, which is increasing removals, protecting the public and saving the taxpayer money.
Does the Home Secretary agree, given that today, 6 June, is the anniversary of the Normandy landing, that those who fought and died there did not do so to enable convicted EU rapists, paedophiles and drug dealers who are now here in prison to be protected under new European human rights laws, including the European charter, and the European Court; that they should be deported; and that the Home Affairs Committee was clearly right to indicate that, in these circumstances, the public will
“question the point of the UK remaining in the EU”?
Furthermore, why have the Government failed to introduce our own Bill of Rights and remove us from the EU charter? Does it not make a mockery of the Queen’s Speech that the Government continue to uphold, as they say,
“the sovereignty of Parliament and the primacy of the House of Commons”?
I accept that my hon. Friend has his own personal reasons for remembering very much the impact of the D-day landings. It is true that those who gave their lives on the beaches of Normandy did so to protect our freedoms. The Government, as I indicated in my response to his question, have put in place a number of measures, and we continue to work to do more to ensure that we can protect the public from those serious criminals—rapists and others—who may choose to come here from whichever country they come from. My hon. Friend referred to the Bill of Rights: it is the Government’s intention to bring forward a Bill of Rights, and that was referred to in the Gracious Speech that we heard a few weeks ago. I can assure him that the action that the Government have taken, for example in rebalancing the interests of the public and the interests of foreign national offenders, in the reference to article 8, show that we take seriously the need to ensure that the human rights of the British public are recognised when we deal with these issues.

That this House, wishing to see serious crimes solved, to counter terrorism and to see foreign criminals prosecuted and deported, supports opting in to the Prüm Decisions; notes the views of senior law enforcement officers that the Prüm Decisions are an important aid to tackling crime; notes the success of a pilot that demonstrated that the Prüm Decisions mechanism is both swift and effective; and further notes that only a subset of the relevant national DNA and fingerprint databases, containing data relating to individuals convicted of recordable offences, will be made available for searching by other participating States, and that the higher UK scientific standards will be applied to matches in the UK.
Recent events in Europe, particularly in Paris, have highlighted the very real need to co-operate with other countries in order to keep our citizens safe and to hunt down criminals and terrorists. Following the attacks in Paris, we know that the French authorities have been co-operating and co-ordinating with a wide range of law enforcement agencies in other countries, and that one of the tools they have found most effective has been the Prüm mechanism, the subject of today’s debate. Indeed, it is thanks to Prüm that they were able to identify at least one of the attackers so quickly.
Prüm—so-called after the German town in which it was agreed to develop the mechanism—is about the sharing with other countries, in strictly controlled circumstances, of DNA profiles, fingerprints and vehicle registration data in order to prevent and investigate crime. My French counterpart, Bernard Cazeneuve, wrote to me recently to set out his first-hand experience of Prüm and his hopes that the UK and France can improve our co-operation through it. While I never accept the views of others unquestioningly, I think it is wise to listen carefully to those with recent experience of such chilling events, and they believe this system to be hugely beneficial. The experience of France and others, and our own detailed study of Prüm, leads me to conclude that it is in the national interest to sign up to it, and I will set out in more detail why I think so.
I am sure that my right hon. Friend accepts that the dreadful carnage in France was to some extent the result of the failures of the authorities in that country. Why should we place so much trust in those who have had that kind of experience?
I have to say that the blame for the carnage in France lies fairly and squarely with the terrorists who caused it. I believe it is absolutely right to listen to those with experience. I will come on to describe other examples of how the exchange of data is beneficial in a variety of circumstances. Before I do so, it might be helpful to the House if I set out how we have come to this point, exactly what the system is and what it is not.
As I have said, Prüm is primarily about the sharing of DNA profiles, fingerprints and vehicle registration data with other countries in order to prevent and investigate crime. It is worth noting at the outset that we already share such data with other countries via Interpol, so this debate is not about whether we should do so, but about how. This system automates the front end of an existing manual process to access that information. It will make information exchange subject to the touch of a button, rather than a lengthy manual process. That means that it will be quicker and easier for our police to check the national databases of other member states, hugely increasing the reach of UK law enforcement. It is important to remember that this is not a centralised EU database.
It does not. The reasons why that terrible carnage took place have a great deal to do with insecurity and instability as a result of the failures of border controls and the manner in which people made their way to Paris. We do not have time to go into all those matters, and they are not the subject of this debate, but I question whether national security for United Kingdom citizens, which is our prime concern, will be advanced by surrendering these powers to the European Court of Justice.
The Government concede that accepting the Court’s jurisdiction is not risk-free. They should have explained what practical impact they expected the extension of the Court’s jurisdiction in relation to the UK to have, and they have not done so.
Thirdly, the Government say that they intend to put into place extra safeguards to ensure that Prüm would operate in a way that
“respects fully the civil liberties of British citizens.”
Liberty gave evidence to the House of Lords on a number of matters in this respect.
In the report of the European Scrutiny Committee that was published the other day, we make it clear that there is an important balance to strike between law enforcement co-operation, especially when it involves the exchange of personal data, and the need to protect individuals against the risk of false incrimination and unwarranted interference with their right to privacy. The Government’s business and implementation case can provide only anecdotal evidence of cases in which Prüm has been instrumental in advancing an investigation or securing a conviction. The paucity of evidence that we have been given on the value and impact of Prüm in respect of law enforcement makes it difficult to measure its added value and to ensure that an appropriate balance is being struck. We find that lack of transparency and accountability troubling.
I can only assume that I slightly misheard what my hon. Friend said. He seemed to say that the only evidence that we had given about the benefits of Prüm was anecdotal. We have undertaken a pilot with four other EU member states. That pilot was based on the exchange of a certain number of DNA profiles. It led to hits. As in the case of the Romanian that I identified, it led to someone being charged, who is now on remand. That is not anecdotal; someone has been brought to justice as a result of Prüm.
I think that the Home Secretary used the expression “pilot scheme”. She surely concedes that it was a small scale pilot scheme. That is the basis on which I question the extent to which the evidence is sufficiently broad-based to justify this extremely grave extension of powers to the European Court of Justice. The main risks highlighted by the Government are the remaining possibility of false positives, leading to the false incrimination of innocent individuals, cost, conferral of jurisdiction to the Court, and a high volume of requests, bearing in mind the fact that the UK has the largest criminal fingerprint and DNA databases.

Commons ChamberAs the right hon. Lady says, this is indeed a battle for hearts and minds. As she will be aware, we have launched a counter-extremism strategy. We wish to work in partnership with mainstream voices in communities across the country to ensure that we promote the values that we share, and that we challenge the ideology that seeks to divide us. It is important that that work is undertaken in a variety of ways. A concern that people in many communities have had about some of the Prevent work is that it has been too much in the security space, and not enough about the integration and cohesion of communities. It is absolutely right that our counter-extremism work is done in partnership with people in communities, so that we work together to promote cohesive communities and mainstream voices.
Will my right hon. Friend explain why the Government have, for four months, blocked debate on the Floor of the House on the European agenda on immigration and refugee smuggling and relocation—a debate that has been demanded by the European Scrutiny Committee? Will she meet me and other MPs to review the Government’s rejection on 6 January of my amendments to the Counter-Terrorism and Security Bill, which would have prevented UK jihadists from returning to the UK? Could we also discuss the disproportionate legal protections conferred through human rights legislation, including the charter of fundamental rights, which can and do endanger human life, and override the Supreme Court and our Parliament? The European Union, far from enhancing national security, often undermines it.
I understand that it should be possible, in the not-too-distant future, to debate on the Floor of the House the matters that my hon. Friend raised. Of course, in the Counter-Terrorism and Security Act 2015, we took in hand a number of powers relating to those who would travel to Syria, or are returning from it. That has increased the powers available to the police, and to security and intelligence agencies.

Commons ChamberMay I start by welcoming the right hon. Member for Leigh (Andy Burnham) to his place? I would also like to pay tribute to his predecessor, the right hon. Member for Normanton, Pontefract and Castleford (Yvette Cooper). She was appointed as shadow Home Secretary in 2011, before the Syrian conflict started, but since the beginning of that conflict she has shown great passion for the concerns of those displaced by it. She has continued that approach in recent weeks and continues to work on that particular area. I wish her the very best for her time on the Back Benches.
The right hon. Member for Leigh is, of course, a former Home Office Minister, so he will be aware of some of the issues that are likely to be the subject of our debates. I welcome the fact that he has said he will approach his role constructively and that he will wish to work with the Government on some areas. Obviously, I think we are all agreed on the need to take action on the issue under discussion, but it is clear that it is in the British national interest for this House to be able to work constructively on other issues, not least national security.
The right hon. Gentleman asked a number of questions. To be absolutely clear on the numbers, the Prime Minister set the figure at 20,000 by the end of the Parliament and that is the figure we are looking at. We have not set a year-by-year quota or a target for the numbers before Christmas. As I explained in last week’s debate, we are working with the UNHCR and have expanded the criteria of vulnerability that will be used to identify refugees to come to the United Kingdom. We want to work with the UNHCR to ensure not only that we are taking those whom it is right to take according to those criteria of vulnerability, but that we have the right support for them when they are in the United Kingdom. I am sure that everybody will agree that we need to ensure that it is not a question of just taking people from Syria and putting them somewhere in the UK; it is about making sure that their needs have been identified and that they are given the right support when they arrive.
That ties in with the right hon. Gentleman’s question about local authorities. As I have said, Local Government Association representatives were present at the meeting I chaired on Friday. They have already been working with local authorities across the country and looking at the offers and the capacity of various councils to receive refugees. My right hon. Friend the Secretary of State for Communities and Local Government met the LGA leadership again this morning to talk through the issue. As I indicated in my statement, this is one of the practical issues that my hon. Friend the Minister with responsibility for Syrian refugees will address at a granular level in his discussions, making sure that those offers are being made and that they give the correct support.
The right hon. Member for Leigh talked about European support and Monday’s meeting. We have, over time, been giving practical support to other EU member states. As I indicated in my statement, we have been supporting asylum systems in Greece, initially as part of the Greek action plan but also subsequent to that. We have also been looking to work with the Italians and others to break the criminal gangs. Crucially, I encouraged other member states to support us in that work. We have worked bilaterally, particularly with the French, and broken a number of criminal gangs dealing in people smuggling, but more effort needs to be made.
The right hon. Gentleman referred to the UK’s historic tradition of helping. That is why it is absolutely right that the United Kingdom is at the forefront of the humanitarian support for people who have been displaced from Syria. That is why it is right that we are the second biggest bilateral aid donor to those in refugee camps and communities in Lebanon, Jordan and Turkey. The Foreign Office is working with others in the region to encourage increasing support for those in the camps. The UK can be rightly proud of the effort we have put into that humanitarian support. There are people today who are fed, watered and sheltered because of the generosity of the British taxpayer. We should recognise that.
There was some confusion in relation to one or two references the right hon. Gentleman made about the return of individuals and the immediate establishment of hotspots. I think I heard him suggest that the hotspots were in the transit countries in Africa, but actually they are in countries such as Italy and Greece. They are part of the EU’s collective support for those countries and provide a system whereby people who cross the border can be properly identified and registered. Those who are claiming asylum appropriately are identified, but it is those who are illegal economic migrants that we are talking about returning to their countries of origin. That is, of course, all within arrangements relating to the Department for International Development.
On the question of aid from other countries in Europe, my right hon. Friends the Prime Minister and the Secretary of State for International Development and I have consistently made that point to other EU countries. Indeed, only this morning my right hon. Friend the Secretary of State for International Development was in touch with the European Commissioner concerned to discuss the issue.
My right hon. Friend and the Government are to be congratulated on the manner in which they have dealt with the problem of migration at source, but will she do what the European Scrutiny Committee has insisted on and agree to a debate on the document on the relocation of migrants, which we will discuss with the Minister for Europe in about an hour’s time? We have asked for it to be debated on the Floor of the House, but without success. Will the Home Secretary agree to that request?
Will the Home Secretary also recognise that Germany, despite all the hype, has not done anything like as well as the United Kingdom in respect, for example, of the money we have provided to the World Food Programme? Some of its policies have clearly been orientated to assist its own internal economic problems. She should have a word with her counterpart to ensure that Germany does actually step up to the mark in doing the sorts of things that are really going to help and stop the tsunami of millions of people who could well come over here and swamp Europe.
My hon. Friend has long championed having debates on the Floor of the House on various matters put forward by the European Scrutiny Committee. The business of the House is of course a matter for the Leader of the House and the business managers. I simply point out to my hon. Friend that how the EU has responded on this matter has already been addressed by Members in our debates. Last week we had a number of discussions on this whole question, including three in the Chamber on various aspects of the refugee crisis and, indeed, migration.
In relation to aid, my hon. Friend is absolutely right that the United Kingdom has, as I said in my statement, given financial support to the aid programme adding up to virtually the same as that of the rest of the European Union put together, so I think we can be justifiably proud of what we have done. I think I am right in saying—I will correct this if I am wrong—that we are actually giving about double what Germany is giving in aid to refugees in the region.
I reiterate that the reason why that is important is that it helps people to stay in the region, where many of them want to be, so that they are there and able to return to Syria when the conflict is over and they can do so, and so that they are not encouraged to make the perilous journey that, as we have seen—sadly for some, including for some very young children—has led to a loss of life.

Lady raised, as I said in answer to another question, we will have to look at the investigative capacity that needs to be available to the inquiry panel, but under Operation Hydrant, Chief Constable Simon Bailey will work to ensure that there are appropriate links between the inquiry and the police investigations. What is important is that nothing falls between the various exercises and that information is shared appropriately between the investigations and the inquiry panel.
On the second point, the hon. Lady is absolutely right about language. It is important that we use the language of survivors or, in some cases, of victims and survivors. There is another element in respect of language. Sometimes people refer to “historic” cases of child abuse. Many of these cases took place in the past, but for those who suffered them, they are not historic—they live with them every single day. I say to the House and to all outside who comment on this matter that we should be very careful about the language we use. We should not use inappropriate terms that are hurtful and that could cause harm to individuals.
I congratulate my right hon. Friend on arriving at the right solution to the heinous, dangerous and difficult situation that she has been faced with. May I say on behalf of those of us who campaigned for a 2005 Act inquiry to be applied to this matter because of our experience of other 2005 Act inquiries that she has done exactly the right thing? May I also say what a good move it is to ensure that Ben Emmerson stays as counsel to the inquiry? This is a tremendous move in the right direction and I am certain that my right hon. Friend is completely right.

Earlier today we heard about an appalling attack on the office of a magazine in Paris. Twelve people are reported to have been killed, and a number injured. We do not yet have full details of the attack, but I reiterate the Prime Minister’s comments in the House earlier today, and we stand with the French people at this time for freedom of speech and democracy, and against terror. Our thoughts and sympathies are with the families, friends and colleagues of the victims.
Last month we also saw deadly and callous attacks in Sydney and in Peshawar, Pakistan, where it beggars belief that terrorist gunmen should carry out the horrific and targeted murder of children at a school. In 2013 we saw the first terrorist attacks on the streets of Britain since 2005, when Fusilier Lee Rigby was brutally murdered by Islamist extremists, and Mohammed Saleem was stabbed to death by a far right extremist. There can be no doubt that the terrorist threat we face is grave and relentless. It is a threat that takes many forms and causes suffering in many countries.
I have always been clear that we need to keep our terrorism laws and capabilities under review, and ensure that the police and intelligence agencies have the powers they need to do their job. That is why the Bill is so important. As I told the House on Second Reading, Parliament must have sufficient opportunity to consider the Government’s proposals, and I believe that the House has had that opportunity. We have had full and frank debates on the measures in the Bill, and the timetable has allowed us to consider all the amendments that were tabled. The Bill, and the powers within it, have benefited from robust scrutiny by the House.
We are agreed on the need for these powers. I am grateful to the shadow Home Secretary and her colleagues on the Opposition Front Bench, the right hon. Member for Delyn (Mr Hanson) and the hon. Member for Kingston upon Hull North (Diana Johnson), for their constructive approach throughout. I pay tribute to the right hon. and hon. Members who have contributed to the debates in Committee and on Report, and, in particular, to a number of members of the Intelligence and Security Committee: the right hon. Members for Salford and Eccles (Hazel Blears) and for Knowsley (Mr Howarth), my right hon. and learned Friend the Member for North East Fife (Sir Menzies Campbell) and my hon. Friend the Member for New Forest East (Dr Lewis). Each has brought considerable knowledge and expertise to the proceedings, but all contributions have ensured that our debates have been enlightening and valuable. I thank the members of the Panel of Chairs who presided over the Committee of the whole House, and the officials, Officers and staff of the House, and those in the Office of Parliamentary Counsel, who have enabled the House’s expedited consideration of the Bill.
In the past two days, we have again had a full and detailed discussion of the Bill on Report, with many excellent contributions from all parts of the House. The Bill will strengthen our existing powers, so that we can disrupt the ability of people to travel abroad to fight, and to control their ability to return here. It will enhance our ability to monitor and control the actions of those in the UK who pose a threat, and it will help us to confront the underlying ideology that feeds, supports and sanctions terrorism.
During the Bill’s passage through the House, we have considered the powers in part 1 of the Bill relating to temporary restrictions on the travel of those seeking to engage in terrorism-related activity overseas, and on those suspected of involvement in terrorist activity abroad who wish to return to the UK. We have considered the safeguards that should circumscribe the use of the powers.
My right hon. Friend will be aware of the amendment I moved yesterday regarding the question of jihadists of British origin who decide that they wish to return to the United Kingdom, even though they have repudiated allegiance to it and sworn allegiance to another state or entity. Will my right hon. Friend at least be good enough to say that she would be prepared to consider the amendment when the Bill goes to the House of Lords?
I recognise that there will be those who wish to return to the United Kingdom. The measures we are taking on the temporary exclusion orders are about ensuring that those who wish to return and have been involved in terrorism-related activity may return on our terms. They will be determined on a case-by-case basis.
On other matters, in particular safeguards, as the Minister for Security and Immigration, my hon. Friend the Member for Old Bexley and Sidcup (James Brokenshire) made clear to the House yesterday, in the light of the views of David Anderson QC, as well as of many right hon. and hon. Members, the Government have committed to look very carefully at judicial oversight of the temporary exclusion order power. We will return to this issue in the House of Lords.
The House has also debated the duty on a range of authorities, as at part 5, to have due regard to the need to prevent people from being drawn into terrorism. If we are to counter poisonous extremist ideology and prevent vulnerable people from becoming radicalised in the first place, we must ensure that we have the necessary provisions. I appreciate the considerable interest that has been shown in how the duty will work in practice, and trust that the draft guidance, on which we are currently consulting, has helped to address the concerns raised by a number of right hon. and hon. Members.
We discussed the nature of the privacy and civil liberties board, which will support the independent reviewer of terrorism legislation. I reiterate the point made by the Under-Secretary, my hon. Friend Member for Staffordshire Moorlands (Karen Bradley), who has responsibility for modern slavery and serious and organised crime, that we are consulting on this proposal at present and it is right that this consultation should conclude before the final detail of the board is agreed.
The House is aware that the need for this legislation is significant and pressing. Our security and intelligence agencies tell us that the threat we face from terrorism is now more dangerous than at any time before or since 9/11. The appalling conflicts in Syria and Iraq continue, with ISIL solidifying its hold on much of the region. More than 550 people from the UK who are of interest to the security services are thought to have travelled to the region since the start of the conflict, and we estimate that about half of those have returned. Some have become disillusioned and simply wish to reintegrate into British society, but others pose a significant threat and in recent months the police have arrested and prosecuted a number of these people. The Bill will help us to counter that threat.
The powers in the Bill should be used only when it is necessary and proportionate, and their use will be subject to the appropriate level of safeguards and oversight. The Bill represents a considered and targeted approach that strikes the right balance between civil liberties and security, but we must not delay. The threat from terrorism is ever present and evolving. We are in the midst of a generational struggle, and we must ensure that the police and the intelligence agencies have the powers they need to keep us safe. The Bill will help them to do that, and I commend it to the House.

In July, we announced a range of other measures, including the creation of a new cross-Government FGM unit to work with criminal justice agencies, children’s services, health care professionals and affected communities. I hope that, together, these measures, including the changes to criminal and civil law, will help to tackle this appalling practice.
The hon. Lady makes a point not just about FGM but more generally about refuges. Before Christmas, the Government announced the availability of a further £10 million for refuges as a recognition of the valuable work they do, particularly in relation to women who are leaving a domestic environment where they have been subject to domestic abuse. On female genital mutilation, it is important to ensure that the young people involved are aware of what they are able to do in order to escape this danger. It is also important that we send out very strong messages from this place, and generally, about the fact that it is a criminal act that we are not willing to accept in this country, and that we will make every effort we can to ensure that we eradicate the practice.
I commend my right hon. Friend and the Government for this incredibly important provision and the manner in which it has been handled in the House of Lords. My hon. Friend the Member for Mid Derbyshire (Pauline Latham), who is away at the moment, is chairman of the all-party group on FGM, of which I am also a member. We wonder whether it will be possible to insert in Committee arrangements ensuring that where the court makes an order it should protect a girl against not only the commission of but the risk of commission of a genital mutilation offence. I will deal with that when, I hope, I speak subsequently in this debate. Will my right hon. Friend be interested in listening to those arguments?
I look forward to hearing what my hon. Friend says about this later and the detail that I am sure he will fill in. We are addressing the whole question of the risk that an individual may face from female genital mutilation in the new offence of failing to protect a girl from the risk of FGM. It is important that those who have responsibility for these young girls and are aware of what might be happening recognise that they need to do something to ensure that the individual is not at risk and is not put through FGM. I look forward to hearing the arguments that my hon. Friend will advance later in relation to his point.
Part 5 of the Bill includes another child protection measure in making it an offence to possess so-called paedophile manuals—material that contains practical advice on how to commit a sexual offence against a child. It beggars belief that such things actually exist, but regrettably the Child Exploitation and Online Protection Centre, a command of the National Crime Agency, has seen a number of examples. That being the case, it is right that we act to outlaw the possession of such material. In doing so, I pay tribute to my hon. Friend the Member for Mole Valley (Sir Paul Beresford), who has campaigned assiduously on the issue.
If there are other gaps in child protection legislation, we are determined to take the necessary action to safeguard those at risk of harm. That is why last month my right hon. Friend the Prime Minister announced that we will amend the Bill to make it an offence for an adult to communicate sexually with a child. Many hon. Members have supported the campaign by the National Society for the Prevention of Cruelty to Children, and I pay tribute to them for highlighting this gap in the law.
Before leaving this part of the Bill, I confirm that we will table amendments in Committee to strengthen the protection afforded to the victims of domestic abuse. As the House knows, over the summer the Home Office ran a consultation seeking views on whether a specific offence was needed to criminalise coercive or controlling behaviour in intimate personal and family relationships, and 85% of respondents agreed that the law in this area needed to be strengthened. With over 1 million calls for assistance to the police each year for domestic abuse-related incidents, but only 78,000 prosecutions, it is clear that the criminal justice response to domestic abuse is woefully inadequate. The new offence will provide an additional charging option where there is a pattern of non-violent controlling conduct, the cumulative impact of which can be no less traumatic for the victim.

Commons ChamberI will give way to my hon. Friend in a moment. We were very clear that the only measures that needed legislative motions in this House were those in the regulations. We would be bound by the vote on those regulations as a vote on all the other measures in the package of 35. As I have said, this is the sixth debate we have had on this matter.
As my right hon. Friend knows, I accused her and the Government last week of chicanery, which, put another way, means relying on legal quibbles to try to achieve an objective. The fact is—I am sure she will accept it—that these issues involve the application of the European charter of fundamental rights. In that context, is she now going to tell us that the charter of fundamental rights does apply to the United Kingdom?
I am tempted to say to my hon. Friend that I suspect he knows more about legal quibbles, and has more experience of them, than I do. I have to say to him that the view the Government take on the charter of fundamental rights is the same view. We are consistent in that view: we consider it to be declaratory only and we do not consider that it applies to the United Kingdom. I know he has a different view on this, but that is the consistent view the Government have taken on this matter.

Commons ChamberThis is a disgraceful way of going about a very important matter. It is tainted with chicanery. It is not the way that Parliament should be treated. Right from the very beginning of this issue, the European Scrutiny Committee, the Home Affairs Committee and the Justice Committee have complained about the lack of transparency and consultation and the manner in which the Home Secretary has been treating the House. It is completely unbelievable that she should come to the House and, presumably, try to argue—as we shall discover in due course—that this is about the EAW when it clearly is not.
If the motion were a Bill, it would be dealt with in separate clauses and parts, all of which could be amended, but this motion is unamendable. That has not yet been properly considered. This is being done to avoid a real decision being taken today, as was promised to us by the Prime Minister only a few weeks ago, and by the Home Secretary in the article in The Sunday Telegraph and in the letter that the shadow Home Secretary referred to. This is a travesty of our parliamentary proceedings, and that is a reason in itself to vote against the business motion, as I shall be doing. I could give many other reasons for doing so, but it is fundamentally about a lack of transparency and honesty in going about issues we need to deal with.

I am sorry that the Home Secretary is shaking her head, because she knows perfectly well that this is a trick and an attempt to get round the reality of what is facing us: this is not just about law and order, but about the European Court of Justice and the opportunities being created to bypass this House and our own courts. It is a disgrace.
No, I will not give way. Members have been calling for me to stand up and speak, and that is exactly what I am doing.
There is no legislative requirement for us to bring this package of 35 measures to this House for Members to consider and vote on. There is a legislative requirement for us to transpose certain measures into UK legislation. The normal way of doing that is upstairs in a Standing Committee, on a one-and-a-half hour debate on a negative statutory instrument, after 1 December and after the decision by this Government to opt in to a certain number of measures had been taken.

Commons ChamberThere is considerable benefit, and I point my hon. Friend towards the measures on minimum standards for the justice system—there are about 20, I think. It is not the view of the Government, and it is certainly not the view of the Conservative party, that we should be part of the European justice system that some people think some of Europe wishes to introduce. Coming out of the minimum standards measures was an important part of ensuring that we did not go in that direction.
My right hon. Friend mentioned the scrutiny process, but, as she well knows, all three Select Committees—the European Scrutiny Committee, the Select Committee on Home Affairs and the Select Committee on Justice—have said that there has not been proper consultation with Parliament on these matters. What has happened today amply demonstrates our concerns and nothing has emerged to change our view. Will my right hon. Friend explain how on earth all this has happened?
I am aware of the views expressed to this House by my hon. Friend and by the Chairmen of the Justice and the Home Affairs Committees. I remind my hon. Friend that I, the Justice Secretary and other Ministers have appeared in front of the Select Committees of this House, of the European Scrutiny Committee and of Committees of the House of Lords on a number of occasions on the subject of these measures. We have also held a number of debates on the Floor of the House and varying views have been expressed from both sides of the House about the measures that have been proposed.
I am grateful to my right hon. Friend for his comments. I assure him that I will refer to a number of measures that will ensure that there is judicial oversight of the European arrest warrant and proper consideration of such cases in the United Kingdom. He is absolutely right about another thing. The Government have negotiated this package and are bringing it to the House because we believe that these measures are necessary to ensure that we can continue the job of keeping people safe and bringing criminals to justice.
I will outline some of the other vital measures in the package of 35 measures. However, I said earlier that I would say a little about the timing of today’s debate, which I think is relevant to the consideration that Members have given to the motion. Now that the final reservation has been lifted on our deal, which, as I said, happened on Friday, we must allow for discussion at a Council in Brussels before the month is out. Very few appropriate options remain. We must add items to the agenda of a Council 16 days in advance to guarantee their inclusion. That means that we do not have long to complete our domestic processes. To avoid an operational gap for our police and law enforcement agencies, we must complete the entire process before 1 December. That involves formally notifying Brussels about the measures that we wish to remain part of.
I hope that my hon. Friend will forgive me for just one moment. He will know that I am usually very generous in giving way to him during debates on European matters, even though I sometimes disagree with the points that he makes. However, the point that I am about to make is important too.
If we do not complete the entire process before 1 December, including notifying Brussels of the measures that we wish to remain part of, we will have an operational gap, which I believe would be a real problem for our police and law enforcement agencies. We must be ready to transpose those measures fully into our domestic law. That is why it is important that we hold votes in this House and the other place, and complete the necessary legislative steps as soon as possible—hence the motion before us.
In the light of what has happened so far and the fact that we do not have the opportunity to vote on the European arrest warrant, as Mr Speaker has indicated, will the Home Secretary confirm that we will have an opportunity to do so, as was promised not only by her, but by the Prime Minister? We have not had such a vote. Will she guarantee that we will have one after a proper debate on the matter?
I have set out quite clearly the Government’s view on the motion before the House and the debate that we are having. I will attempt to make progress, because I want to get on to some of the other issues, including the European arrest warrant. I recognise the degree of interest in that and the concern that remains among some hon. Members. That is why I wish to have time to speak about that particular measure.
Thank you, Mr Speaker. I am grateful for your ruling on what matters are relevant to the speech that can be made in relation to the question that has now been put.
The motion is about whether or not we should vote on the regulations that are before the House today. As I have made very clear, we put those regulations before the House today because of the timetable with which we are dealing in relation to ensuring that we are able to opt back in to the measures that we need to opt back in to by the requisite date—1 December—if we are to ensure that there is no operational gap.
As my right hon. Friend will know, the European Scrutiny Committee has considered all these matters carefully. If, as is the normal course of events, we were debating a Bill rather than what is provided for by the Lisbon treaty, all 35 of these measures would be before us in the form of separate clauses, and amendments would have been tabled. What we have been debating, however, is a non-amendable motion. Is my right hon. Friend aware that the Home Affairs Committee itself said that there must be a separate vote on the European arrest warrant? How does she reconcile what she said this afternoon—and, indeed, what she is saying now—with the fact that there will undoubtedly be no vote on the European arrest warrant, although several Select Committees have said that there should be?
I would have called the hon. Gentleman to speak on this proposition in due course, but I have a feeling that he has already done so. So be it. I call the Home Secretary.

As I made clear earlier, I am well aware that my hon. Friend the Member for Stone (Sir William Cash), as Chairman of the European Scrutiny Committee, and his colleagues who chair the Justice and Home Affairs Committees, have indicated their wish for separate motions and separate debates on particular parts of the measures, including the European arrest warrant. However, I have also made clear that the Government put the regulations before the House today so that the House could see the legislative process that would be put in place. There is no requirement in legislation for any measure to be put in place for us to remain party to the European arrest warrant.
I must point out, with great respect, that what my right hon. Friend is saying is, “We will go by prerogative.” That smacks of everything that is in direct contradiction to the evolving democracy of the House of Commons. The fact is that it was the prerogative that was displaced by parliamentary change and reform. What she is saying is that, on this particular matter, she will decide on behalf of the Government without regard to what Parliament has to say, and that is unacceptable.
I am not saying that. I suggest to my hon. Friend that I have been very clear about this matter. The Government have negotiated with the European Commission, and with other member states, a package of measures for us to opt back in to. We believe that those law and order measures are necessary for ensuring that our law enforcement agencies have the tools that they need to catch criminals and to deal with matters of justice, which is why we have put before the House legislative measures that will enable United Kingdom law to accord with that package of 35 measures.

Commons ChamberThe right hon. Gentleman makes an interesting suggestion, which was proposed to me by another Member this morning. The point of having a panel is that not just one individual or indeed potentially two co-chairs will be undertaking this work. The idea is to have a group of people coming together with different experience and different expertise. Unlike in simple judge-led inquiries where one person leads, it is very much the case that all the panel members will contribute. The chairman’s role is about the management of the inquiry, but the management in this case will be through a team of people brought together to ensure that the work is done properly.
The Home Secretary is to be commended for the tone in which she has delivered the statement. Is there not a problem, however? If the chairman asked for an Inquiries Act 2005 inquiry—I experienced this when I had to demand the public inquiry into the Mid Staffordshire hospital, which proved to be a significant success—does the Home Secretary realise that she would have to disband the whole thing and go back to square one? Would it not be far better to start off with an Inquiries Act 2005 inquiry, which would allow evidence on oath, compulsion of witnesses and other matters to help us get to the bottom of this as we did with the Mid Staffs inquiry?
I hesitate to question my hon. Friend’s comments on such matters, but my advice is that it would be possible to turn the inquiry into a statutory one—namely, an inquiry with the powers of a statutory inquiry to compel witnesses—but for that to happen it would be necessary to have a request from the chairman. At the moment, it is not possible because we do not have a chairman. Once the chairman is in place, they will be able to make that judgment and come forward if they wish to turn this into a statutory inquiry.

I am grateful to the right hon. Gentleman for his points. The Home Affairs Committee has considered this issue on a number of occasions and has taken it very seriously, and we look at the proposals that it makes. Next month the Met will be introducing the full checks against the ACPO Criminal Records Office, so action is being taken in that area. Of course it is under this Government that the links between immigration enforcement and, initially, the Metropolitan police through Operation Nexus were put in place, and that has meant that we have seen more than 2,000 foreign criminals being removed from this country. Operation Nexus has expanded into other parts of the country, and I hope that we see it expanding throughout the United Kingdom. In relation to stopping people coming here in the first place, we have been working on agreements with other countries. Membership of the European Criminal Records Information System, which has been part of the 2014 debate and is one of those areas that we wish to opt back into, is an important part of the process.
The Home Secretary is completely right in saying that there are inherent problems in the law, and also that the whole matter is very challenging. I am glad to note that the repeal of the Human Rights Act is now being reintroduced, having pushed it through when I was shadow Attorney-General in the years 2001-03. Will the Home Secretary please acknowledge that an even bigger problem is the Charter of Fundamental Rights, which is enforceable by the European Court of Justice? The other day, the European Scrutiny Committee said that the only way to deal with these problems in the European Communities Act 1972 is to amend it. If we do not do that, we will end up having continuing legal problems of the kind she has identified and no solution.
My hon. Friend makes a point that he has made on a number of occasions on the Charter of Fundamental Human Rights. I am afraid that he will not get a different response now from that which he has had either from me or other Ministers in the past. The Government believe that amending it will not change the position. He refers to the Human Rights Act and as shadow Attorney-General he did work on this matter. Repealing the charter was a Conservative party manifesto commitment before the last election, and that will be repeated as we move forward to the next election.

The Home Secretary has given a good account of what the Government are proposing. She mentioned ministerial meetings. Will she take regard of what Margaret Oliver said on the “Today” programme, which is that she believed that this problem existed at the “very top”? Given the fact that criminal offences may be involved—including that of aiding and abetting, which has been engaged in by people at very senior levels—is it not appropriate for the Attorney-General to attend those ministerial meetings to give advice, because there will be some very deep inquiries about some apparently very important people?
My hon. Friend makes an interesting point. Obviously, a number of investigations are taking place to identify whether action needs to be taken against individuals who were involved in these matters. As I bring Ministers together to look at these issues, I will ensure that, where necessary, we take the best legal advice.

No doubt she will also understand that the Bill is itself subject to future challenge by the European Court of Justice. I draw attention to my manuscript amendment, which I hope will be selected, and which would remove any doubt about the fact that the Bill, if enacted, will have full effect notwithstanding the European Communities Act 1972
I note what my hon. Friend has said, but, having examined the judgment of the European Court of Justice, we believe that UK legislation already complies with many parts of it, and we have specifically ensured that other issues that were not addressed in the judgment are addressed in the Bill.

Commons ChamberAs my right hon. Friend knows—she has said this already—there are concerns that our laws are being made elsewhere in this context. She then says that in fact we will keep control over our laws. That is precisely not what is happening because, as she knows from the statement she made earlier today, through section 3 of the European Communities Act 1972, the European Court of Justice overrides not only this Parliament voluntarily, but also our Supreme Court.
As I indicated earlier, the House will introduce its own legislation to ensure that we are able to do what we wish to do in terms of the powers of our law enforcement agencies and our security and intelligence agencies. We must, however, make a choice on some of these measures, and the question is whether we believe that we need such measures to keep the public safe and ensure that people are brought to justice, or not. I believe that with the measures we have negotiated, both I and the Justice Secretary—he has also been working hard on this matter—have recognised those issues and will ensure that our police and law enforcement agencies are able to do the job we want them to do.
I find my hon. Friend’s argument strange. He says that, simply because a small number of serious criminals such as murderers are extradited on the European arrest warrant compared with the number indicted here in the UK, we should not worry. If somebody has committed a murder and we wish to extradite them from another European member state, we should be able to do so. The EAW, as all those who work with it will recognise and confirm—it has been confirmed in evidence to Select Committees—is a better tool to use because it enables extradition to take place more quickly.
As I have indicated, the Council of Europe arrangements, which were in place previously, had a time limit. Had the European arrest warrant not been in place, we would not have been able to extradite the individual I mentioned earlier, Mr Cullen, back to the UK to face justice, and his victims would not have seen justice done. All the provisions—[Interruption.] My hon. Friend the Member for Shipley (Philip Davies) mentions the DNA database from a sedentary position. He and I have a different opinion on the database because he would like everybody in the UK to be on it.
All the EAW provisions to which I have referred have been made in UK law and will commence later this month. I believe they will make an important difference in the operation of the arrest warrant. The Labour Government could have made all those changes during the eight years they oversaw the EAW, but they failed to do so. That failure has coloured the views of many in the House and beyond it about the EAW, but it should not cloud the fact that the EAW is a vital tool for ensuring that justice is done in this country and for keeping the British public safe, as has been so clearly impressed on me and Committees of the House in evidence given by the police and prosecutors who use it. I take that responsibility as Home Secretary very seriously, and it underpins everything I say in the debate and the process that has brought us to this point.
It might be helpful to remind hon. Members of the background. When without the promised referendum the previous Prime Minister, the right hon. Member for Kirkcaldy and Cowdenbeath (Mr Brown), signed the UK up to the Lisbon treaty, he ceded more powers to the European institutions and gave up our veto over police and criminal justice matters. We got very little in return, but one of the few things we got from that flawed negotiation and imperfect treaty was the option to opt out of all the police and criminal justice measures that were agreed before the Lisbon treaty came into force. However, that opt-out had to be exercised en masse before the end of May 2014. Following votes in both Houses of Parliament last year, that is exactly what the Government did. That decision is irreversible and will come into effect on 1 December 2014. From that date, we must either opt back in to the smaller number of measures that we think are vital for the protection of the British people and other victims of crime, or face an operational gap that will hamper the efforts of our police and law enforcement agencies.
When the Justice Secretary and I came to the House last July, we explained that we had listened carefully to the views of our law enforcement agencies and prosecutors, and concluded that a small number of measures that were subject to the opt-out decision add value in the fight against crime and the pursuit of justice, and that it would therefore be in our national interest to rejoin them. We listened to right hon. and hon. Members, and carefully considered the reports of the European Scrutiny Committee, the Home Affairs Committee and the Justice Committee, before opening formal negotiations with the European Commission, the Council and other member states.
Good progress has been made, and I am pleased to be able to report that we have reached an in-principle deal with the Commission on the non-Schengen measures, which fall under its purview, and we have made good progress on the Schengen measures, on which the outline of a possible deal is now clear. I indicated earlier that the matter was discussed at the General Affairs Council on 24 June, but technical reservations remain, and discussions continue with the aim of allowing those reservations to be lifted. Therefore, the negotiations are ongoing, but, as I have said, the Justice Secretary and I have been clear throughout that we will update Parliament as appropriate and give right hon. and hon. Members the opportunity to debate the issue. That is what we are doing today. Last week, we published the Command Paper—Cm 8897—which includes the full list of measures that were discussed at the General Affairs Council, and impact assessments on each of the measures. That fulfils the Government’s commitment to provide those impact assessments and further demonstrates our commitment to parliamentary scrutiny of the matter.
Many were sceptical that a deal could be done, and many believed that the European Commission and other member states would force the UK into measures that we did not want to rejoin, but I am proud to say that we have been able to resist many of the changes demanded by others, and have not been pushed into rejoining a larger number of measures. We are clear that the deal is a good deal for the United Kingdom.
One measure that we have successfully resisted joining is Prüm, a system that allows the police to check DNA, fingerprint and vehicle registration data. I have been clear in the House previously that we have neither the time nor the money to implement Prüm by 1 December. I have said that it will be senseless for us to rejoin it now and risk being infracted. Despite considerable pressure from the Commission and other member states, that remains the case.
All hon. Members want the most serious crimes such as rapes and murders to be solved and their perpetrators brought to justice. In some cases, that will mean the police comparing DNA or fingerprint data with those held by other European forces. Thirty per cent. of those arrested in London are foreign nationals, so it is clear that that is an operational necessity. Therefore, the comparisons already happen, and must do so if we are to solve cross-border crime. I would be negligent in my duty to protect the British public if I did not consider the issue carefully.
Will my right hon. Friend explain to the House why it is so important to have those cross-border co-operation arrangements with the EU and not with the entire world?
Our police forces of course co-operate with other police forces throughout the world in bringing criminals and perpetrators to justice. The European arrest warrant—I will repeat myself—is an extradition arrangement that improves on the extradition arrangements that we had previously. I recognise that there have been concerns about it, but we have legislated on those concerns here in this Parliament.
I was describing the Prüm system, which is about the easy, efficient and effective comparison of data when appropriate. We have been clear that we cannot rejoin that on 1 December and would not seek to do so. However, in order for the House to consider the matter carefully, the Government will produce a business and implementation case and run a small-scale pilot with all the necessary safeguards in place. We will publish that by way of a Command Paper and bring the issue back to Parliament so that it can be debated in an informed way. We are working towards doing so by the end of next year. However, the decision on whether to rejoin Prüm would be one for Parliament. Unlike the Labour Government, who signed us up to that measure in the first place without any idea how much it would cost or how it would be implemented, the Government will ensure that Parliament has the full facts to inform its decision.
On another subject, I know that my right hon. Friend the Justice Secretary will want to address the probation situation in his closing remarks—that is another measure we have successfully resisted rejoining.
The Government propose to rejoin other measures in the national interest. We wish to rejoin the European supervision order, which allows British subjects to be bailed back to the UK rather than spending months abroad awaiting trial. That will stand alongside the reforms we have made to the European arrest warrant, and make it easier for people such as Mr Symeou to be bailed back to the UK and prevent such injustices from occurring in future.
We are also seeking to rejoin the prisoner transfer framework decision, a measure that my right hon. Friend the Justice Secretary considers important. The framework helps us to remove foreign criminals from British jails—prisoners such as Ainars Zvirgzds, a Latvian national convicted of controlling prostitution, assault, and firearms and drug offences. In April 2012, he was sentenced to 13 and a half years imprisonment in the UK. Last month, he was transferred out of this country to a prison in Latvia, where he will serve the remainder of his sentence. Had it not been for the prison transfer measure, he would have remained in a British prison, at a cost to the British taxpayer of more than £100,000.
We wish to rejoin the measure providing for joint investigation teams, so that we can continue to participate in cross-border operations such as Operation Birkhill. That collaboration with Hungary, funded by Eurojust and assisted by Europol, led to five criminals being sentenced at Croydon Crown court last month to a total of 36 years’ imprisonment for their involvement in trafficking more than 120 women into the United Kingdom from Hungary, the Czech Republic and Poland. One of those convicted, Vishal Chaudhary, lived in a luxury Canary Wharf penthouse and drove a flashy sports car bought from the money he made selling those women for sex. Chaudhary and his gang managed their operation from a semi-detached house on a suburban street in Hendon, and operated more than 40 brothels across London, including in Enfield and Brent. Their victims were threatened with abuse if they tried to contact their families. Some were forced to have sex with up to 20 clients a day. These are the victims of crime that the measures we are debating today help. Joint investigation teams are a vital tool in the fight against modern slavery, a crime this House so passionately demonstrated earlier this week it wants to see tackled. I hope the House will support rejoining the measures that will help us to do that.

Commons ChamberI will refer to one or two specific measures in relation to that, but as I have just indicated to the House, the Government have exercised the block opt-out. It is open to us to seek to rejoin any of the individual measures covered by it. If we do not negotiate to rejoin those measures, we will no longer be part of them from 1 December 2014.
When I came to the House last July, I explained that my ministerial colleagues and I had concluded that a number of the measures subject to the opt-out decision added value in the fight against crime and the pursuit of justice, and that it would therefore be in our national interest to seek to rejoin them. We believe that there are only a limited number of such measures—we set those out in Command Paper 8671 for the House to see before it voted on our decision to exercise the opt-out.
They were always separate decisions, and the Government have always been clear that Parliament and its Committees should have adequate time to scrutinise both. To make that explicit, we listened to the concerns of hon. Members, and particularly to the Chairmen of the Committees to which I have referred, and amended the motion for last July’s debate to invite the European Scrutiny Committee, the Home Affairs Committee and the Justice Committee to submit reports before the Government opened formal discussions with the European Commission, the Council and other member states.
I endorse what the Chairman of the Home Affairs Committee said with one qualification. It is not just a question of whether Parliament is given the opportunity to deliberate before decisions are taken behind closed doors, but a question of whether Parliament is, in effect, being asked to rubber stamp something that has already been decided in negotiations behind those closed doors. The problem is one of the matter therefore being hidden from the searching gaze of the public and Parliament itself.
Of course, by definition, the Government’s role is negotiating with the parties I have just indicated—the Council, the Commission and the member states—on those measures to which they agree it is possible for us to opt back into. That process, which takes some time, has been put in motion. I will describe where we are a little later but, by definition, the process must be undertaken by the Government. We have been clear that we will come back to Parliament, which will have the opportunity to debate and vote on the package of measures.
As my hon. Friend the Member for Stone (Mr Cash) is well aware, we have indicated the measures on which we wish to opt back in. The discussions are in place with the European Commission and the other member states as to their views—whether or not they wish the UK to opt back in—and any other matters they wish to discuss with us as part of that negotiation.
The argument I make in relation to the European arrest warrant is on both those aspects of its operation. I have just cited a case where there was an issue of whether an individual would have been able to be extradited back to the UK had we not had the European arrest warrant. There are other cases where it is a matter of fact that the European arrest warrant has been able to be exercised more quickly on average than extraditions were before the EAW was in place. So it is not just that there are people who would not come back unless we had the EAW; it is that it also smoothes the process and makes this quicker and brings people here to justice quicker.
The Home Secretary has given us a number of indications of concerns that have arisen in some member states. Is she conscious of the fact that the French have said the UK requirements risk imposing an undue burden on other member states, that the Germans raise serious doubts about compatibility with European law, that Spain says the Legal Service should give its opinion and that the Dutch have said that there are a number of fundamental and practical problems? Is it not all rather running into the sand?

Commons ChamberIt is a bit rich of the Scottish National party to talk about not having a clue. I must say to the hon. Gentleman—I have said it before and I will say it again as many times as necessary—that we are giving effect to our declaration under the United Nations convention. That position applied in the United Kingdom until the previous Government changed the law in 2006, and we will return to that position.
I am sure that my right hon. Friend appreciates that the way in which the provision is expressed will give the Secretary of State enormous power. Effectively, it involves the opinion of the Secretary of State, which will make it largely non-justiciable. Given its width and the cases of which the Home Secretary has given examples, is there a danger that we might be regarded as a nasty party if we put this kind of provision into effect?

Member for Cambridge (Dr Huppert) seemed to suggest that the speed with which he advocates the sorting out of the opt-ins might truncate the amount of scrutiny that is needed. I thought, as a result of the amendment tabled by me and other Select Committee Chairmen to the original motion, we had established that progress had been made on that point. Will my right hon. Friend make the situation clear?
I am happy to make it clear and sorry if my remarks to my hon. Friend the Member for Cambridge led my hon. Friend the Member for Stone (Mr Cash) to interpret my response in that way, because that was certainly not my intention. I will specify more clearly the process as I see it in due course.

Commons ChamberThe right hon. Lady referred to a motion tabled by the Opposition in an Opposition day debate, and identified seven measures that she said it was necessary to rejoin. What about measures such as the European supervision order or those to do with removing criminals’ assets? Are those powers not important as well? They are on our list, but they were not on that of the right hon. Lady.
Finally, I failed to hear in the right hon. Lady’s comments whether those on the Labour party Front Bench support the decision to opt out—a decision available only because her Government negotiated it in the first place. We believe it is absolutely right to exercise that opt-out, and to negotiate and rejoin those measures that are important for cross-border operations and co-operation between our police forces. Labour Members may come to the House and the right hon. Lady may stand up, foam at the mouth and rant at the Government about these measures, but it is high time she put her position on the line and made clear what her party will do in the debate next week.
My right hon. Friend’s statement simply aggravates concerns that the European Scrutiny Committee has expressed since her October statement. Why has the Committee been consistently denied the information and consultation that it, the Justice Committee and the Home Affairs Committee were promised? We have been given neither proper time nor opportunity to consider these matters. We shall be meeting tomorrow and considering those questions in line with Standing Orders, and we shall then decide what action to take.
We brought the proposals forward now because it is right that we have time to negotiate with the European Commission. As I indicated in my statement, there will be further opportunity for the House to consider the list of measures that we negotiate with the European Commission. I say to my hon. Friend and to other right hon. and hon. Members who chair the Committees to which he referred that the total list of measures has been available for those Committees to consider for some considerable time. The Government are indicating today which measures we wish to seek to rejoin. There will be a debate next week in the House and an opportunity to vote on that. As I have indicated, there will be further consideration and a vote at a later stage.

Commons ChamberThe shadow Home Secretary made a number of points, some of which, I have to say, were either wrong or irrelevant to what we have heard today. She seems to be trying to argue that the Government have not been doing enough to deport Abu Qatada. I can assure her and the whole House that, if it was the case that this was one of those situations where it was just a question of a decision by the Home Secretary, Abu Qatada would have been on the plane on 12 May 2010. However, it is not that simple and we have to work in accordance with the ruling of the courts.
The work that we have undertaken with the Jordanians, which she referred to and seemed to brush to one side as if it was nothing, is unprecedented. The security Minister visited Jordan; I visited Jordan; and the Prime Minister has raised the issue with the King of Jordan. We have secured information and assurances that I still maintain should enable us to deport Qatada. Although the right hon. Lady was dismissive of those assurances, I will remind her, as I said in my statement, of what Mr Justice Mitting said about them. He said that the Jordanian Government
“will do everything within their power to ensure a retrial is fair.”
He continued:
“The Jordanian judiciary, like their executive counterparts, are determined to ensure that the appellant will receive, and be seen to receive, a fair retrial.”
SIAC stated that
“if the only question which we had to answer was whether or not, in a general sense, the appellant would be subjected to a flagrantly unfair retrial in Jordan, our unhesitating answer would be that he would not.”
The right hon. Lady asked whether we will continue our negotiations with the Jordanians. We are very grateful for the significant assurances the Jordanian Government have already provided. Of course, our work with the Jordanians will continue in the light of today’s judgment. The Jordanian Government put out a statement earlier today, which said:
“We understand there will be an appeal and accordingly we will work with them”—
that is, the UK Government—
“to be able to bring him back to justice here in Jordan. Concerning the fear of a fair trial for him—there were guarantees for the British government on that, but also our constitution and our judicial system guarantees him that.”
I am grateful to the Jordanian Government for that support.
The right hon. Lady raised the issue of bail conditions. Abu Qatada will be subject to a 16-hour curfew. Other conditions will be determined by the court and announced tomorrow. I believe that a 16-hour curfew is as strict as the strictest of control orders, so I am afraid that what she says is not the case, and she needs to look at that issue again.
The right hon. Lady referred to the new test and to the relative merits of the article 3 and article 6 issues. Those are different matters: Governments have for a long time been able to seek assurances about article 3 —that process is mature and has existed for many years—whereas the need for assurances about article 6 emerged only because of the European Court’s unprecedented judgment early this year.
The right hon. Lady asked whether it would have been better had we referred the case to the Grand Chamber of the European Court. On that, she is wrong. Her argument seems to be that the European Court—the very court that has caused this difficulty by setting up a new barrier to deportation—is the solution to the problem. Not only is that palpably ridiculous, but an appeal to the Grand Chamber would have risked our wider deportation policies—[Interruption.] I suggest that she listens to this point. An appeal would also have made it harder to deport further terrorists, had we lost the appeal. It would have been unwise, as well as fruitless.
In April, and again today, the shadow Home Secretary told the House:
“We all want Abu Qatada deported as soon as possible, under the rule of law”.—[Official Report, 19 April 2012; Vol. 543, c. 508.]
Unless she is prepared to break the rule of law, she has no solutions other than what the Government have already done. I suggest that, instead of trying to score a political hit, she supports the Government, is straight with the public and supports us in what we are doing to deport Abu Qatada.
The Home Secretary will recall that she has herself urged the repeal of the Human Rights Act 1998. In the light of these events, is it not now time to get on with this urgently? In that way, we will be able to protect not only the public from the likes of Abu Qatada but those alleged terrorists who deserve a fair trial. Let us give them a fair trial, legislate in this country and work out our own answers to these questions, rather than leaving it to the Strasbourg Court.
I am tempted to refer my hon. Friend to the answer I gave on this issue in my last statement on human rights, because I am afraid that I am not going to depart from the answers I have given him in the past. I have made clear my position on the Human Rights Act. Work is being done on it, including by the commission looking at the possibility of a British Bill of Rights in line with our human rights requirements. That commission will report in due course. On the operation of the European Court, as he knows, we have already taken steps to ensure that the Court focuses on the complex points of law that it was originally set up to address, instead of becoming just a court of appeal in so many cases.

Commons ChamberThe right hon. Gentleman makes the valid point that this has been an issue for some time. I think it would have been possible for the previous Government to have done what we are doing today and bring a motion before Parliament, but we have done it and we are giving people that opportunity.
The motion recognises the qualification of article 8 and invites the House to agree that it is set out in the immigration rules. The immigration rules themselves have been laid before Parliament—[Interruption.] I am very happy to read the motion again. It states that the House
“agrees that the conditions for migrants to enter or remain in the UK on the basis of their family or private life should be those contained in the Immigration Rules.”
I am much encouraged by the line the Home Secretary is taking on all this. Over and over again, as she knows, I have raised the question of the interpretation by the courts of matters relating not only to the European convention but to European Union law. Is she taking the opportunity, by one means or another, to have discussions with those in the superior hierarchy of the judiciary? To bolster the assumptions that lie behind what she is saying in defence of the sovereignty of this Parliament, does she want to put the words “notwithstanding the Human Rights Act 1998” in front of the legislation so that the courts are under no misapprehension about what they are to do?
I think my answer to my hon. Friend will be shorter than his question. The motion makes it absolutely clear what we are asking people to do today and I am certain that the judiciary will take into account the view of Parliament. Indeed, as I have said, members of the judiciary have suggested that it would be helpful to have the view of Parliament.
Since the Human Rights Act was implemented in 2000, it has become clear that the existing immigration rules do not properly set out how article 8 should be qualified in real cases. As a result, foreign criminals and those who failed to meet the requirements of the immigration rules and who should not be allowed to come to or stay in the UK have increasingly been able to challenge their decisions in the courts on the grounds of a breach of article 8. So, for those who do not meet the requirements of the rules, grants of discretionary leave outside the rules on article 8 grounds have risen steadily to the point that in 2010 the UK Border Agency granted discretionary leave on the basis of article 8 in around 9,500 immigration cases. That means that in 9,500 cases, applicants could not meet the requirements of the immigration rules but were allowed to stay in the UK none the less. In addition, reflecting established policy on dealing with such cases, they were automatically granted full and immediate access to the benefits system. Perversely, that placed them in a better position than applicants who had met the immigration rules and were denied such access while they served a two-year probationary period.

I repeat to the right hon. Gentleman what I said in response to an earlier question. The arbiters of whether a request for a referral put in by Abu Qatada should be accepted—whether in response to a deadline or, as we believe, outside the deadline—or whether discretion should be applied to accept it outside the deadline are not a north London firm of lawyers but the five judges who will be sitting on the panel of the Grand Chamber of the European Court.
The Home Secretary is trying her best—there is no question about that—but unfortunately it is not working. The root causes of this problem are the questions of what the rule of law is, whose rule of law is applicable and who interprets it. Those questions should be decided in this House. We should withdraw from the European convention, repeal the Human Rights Act 1998 and get the matter straight because the people of this country demand it.
I thank my hon. Friend for his question, which I think is fairly similar to previous questions that he has asked me on this issue. Let me assure him that I take this issue extremely seriously and I am absolutely clear that we want to deport Abu Qatada. However, I also made it absolutely clear in the House earlier this week that the Government must operate within the rule of law, and that a number of legal avenues would be available to Abu Qatada. It is no surprise that he is using delaying tactics to try to delay his deportation from this country. It is right to say that we need to reform the European Court of Human Rights, and that is exactly the work that is being undertaken by my right hon. and learned Friends the Justice Secretary—I think I inadvertently referred to him earlier as the shadow Justice Secretary; I beg his pardon—and the Attorney-General.

Commons ChamberMay I first say that I welcome the support the shadow Home Secretary has given to the resumption of deportation and to the work that has been done to receive assurances from the Jordanian Government? A number of the points she made in response to my statement were made in her press release yesterday, but I recognise that she received my statement late. Although I covered a number of her questions in my statement, I will respond to the points she has made.
The right hon. Lady asked whether the SIAC proceedings this afternoon were properly applied for. Of course they were, but I am sure she will understand that when we are moving to arrest an individual whom we intend to deport, there is a limit to the number of people we tell before we move.
The right hon. Lady seemed to suggest that the Government had done nothing about the Strasbourg ruling until the bail hearing a few weeks later, and quoted Mr Justice Mitting, the judge at the bail hearing. The quote she gave made clear that negotiations with the Jordanians had already begun at the time of the bail hearing. I know she is always keen to attack, but her arguments might have a little more strength if they did not contradict each other.
The right hon. Lady asked about my estimated timetable for Abu Qatada’s deportation. As I said in my statement, we have resumed deportation against him and he was arrested earlier today. He has the right to appeal to SIAC, and I understand that he or his lawyers have made it clear that he intends to appeal and to ask for revocation of the deportation, possibly beyond SIAC—there are rights of appeal beyond SIAC. Because any appeal will be based on narrow grounds and because of the quality of the assurances we have, I am confident of our eventual success, but the process could take a number of months. I have been clear about that and said it in my statement.
The right hon. Lady appears to misunderstand the process. She says that we are going back to the beginning. In fact, we are resuming the deportation, which was set to one side during the appeals that went through to the European Court. She asked why we were not referring the case to the Grand Chamber. Again, I covered that in my statement. I said absolutely clearly that referring to the Grand Chamber would open up the whole of the judgment set down by the court on 17 January, part of which was positive for us. We have looked at the issues involved and taken the decision that the appropriate and right course of action that will ensure we can deport Abu Qatada is to follow the action we have taken of gaining assurances from the Jordanian Government and resuming the deportation.
The right hon. Lady asked about the length of time it is taking to deport Abu Qatada. May I remind her that deportation proceedings began in 2001, nine years before the end of the Government of whom she was a member? The time it is taking to deport Abu Qatada is not down to political will, but down to the nature of our legal system. As I said in my statement, I am willing and keen to look at how other European countries deport dangerous foreign nationals quickly, which is something that the last Government never did. We are following what I believe to be the right course of action to ensure that we can deport Abu Qatada. I have been clear in my statement—and I am willing to repeat it—that I believe that Abu Qatada should be in custody. That is why we arrested him this morning, have taken him to SIAC and are asking for his detention. The work that we have done has resulted in assurances from the Jordanian Government that I believe will enable us to deport Abu Qatada. That is what the whole of this House should want: Abu Qatada deported from this country, back to Jordan.
Having made a powerful statement in favour of the deportation of Abu Qatada, will the Home Secretary confirm that at the Brighton conference, which begins tomorrow, it will be made clear that, as far as the United Kingdom is concerned, a British Bill of Rights will be determined by legislation passed in this House, and not based on the European convention on—but increasingly against—human rights?
My hon. Friend is right to refer to the Brighton conference, which starts tomorrow. It will be chaired by my right hon. and learned Friend the Justice Secretary, who has been working with the other 46 members of the Council of Europe to do what I believe we all want, which is to ensure that the European Court operates appropriately and in a way that reflects its original intentions. The Prime Minister made a speech earlier this year in which he made it clear that there were a number of issues that we wanted to look at, such as subsidiarity and the efficiency of the European Court. It is those matters which the Brighton conference will be discussing.

The right hon. Gentleman has raised several issues in his supplementary questions, some of which relate to the approach that Justice Mitting might take in certain circumstances, but obviously it is not for me to indicate what approach the judge would take. However, were assurances received from the Jordanian Government—we are working hard on that—obviously that would change the scenario and, by introducing a new factor, would enable the Government to take action that would, I think, change SIAC’s approach. If any case were to go before it again, though, it would be for it to determine.
The right hon. Gentleman referred to the work being done on the ECHR. As he will be aware, because of our chairmanship of the Council of Europe, we are in a position for six months to take action on this matter, and we are working actively with other countries with a similar interest in ensuring that the European Court acts as originally intended, which is as a Court considering the most serious issues and key points of human rights law, rather than as a body to which people automatically appeal once they have gone through national courts. That work is being actively led by my right hon. and learned Friend the Secretary of State for Justice. Furthermore, as I mentioned, the Prime Minister has been to Strasbourg, spoken on these matters and explained our position.
The right hon. Gentleman mentioned TPIMs and bail, but of course they are two separate matters—one should not conflate the two. The Home Office made vigorous representations to SIAC arguing that Abu Qatada should not be released on bail, but that were it to happen, the most stringent conditions should be applied. As I said, these are among the most stringent conditions applied to anybody we are currently unable to deport from the UK.
As the right hon. Gentleman said at the end, it is absolutely right that in this country we do not have indefinite detention without trial. However, everyone on both sides of the House wants to ensure that we can deport those who represent a danger to the United Kingdom and whom we believe should be deported. That is why we are considering our options within the legal process, and why we are negotiating with Jordanians on further assurances in order to deport Abu Qatada. However, it is also why we are working to make the changes in the European Court to which the right hon. Gentleman referred, and looking at the whole issue of assurances with other countries, to ensure that we strengthen our ability to deport people who are a danger to us.
The Home Secretary has made a robust statement; the Prime Minister has made robust statements. Unfortunately, the declaration that she made some months ago—that we would repeal the Human Rights Act—is the remedy. I would like to know, and I would be grateful if the Home Secretary would say, whether she intends to carry through our commitment—her own statement that she would repeal the Human Rights Act—return the remedy to this House and pass the legislation necessary to get this right; otherwise it will be all talk and no action.
I have been used, over time in my political life, to words that I have said being taken slightly out of context. I said that it was my personal view that the Human Rights Act should be repealed, not that I was about to repeal it—which my hon. Friend sort of implied in his question. I would simply remind him that even if we were to repeal the Human Rights Act, we would of course still be subject to the European convention and the European Court.

The first responsibility of any Government is to keep the British public safe and free. That means protecting them from crime, terrorism and other threats, but it also means defending our democratic institutions, our liberties and our way of life. This Government are determined to cut crime and reduce the risk of terrorism, at the same time as we restore the freedoms and liberties that define British society.
I am grateful to the Home Secretary—and may I congratulate her on her staunch statement at the party conference on the repeal of the Human Rights Act? As she has not yet an opportunity to do so, would she like to reaffirm on the Floor of the House that she would like to see it repealed?
I am happy to confirm that to my hon. Friend. At the general election, Conservative Members, of course, stood on a manifesto that promised to do just that. As I have said, we will also bring forward some changes to the immigration rules to ensure what we consider to be the correct balance in the operation of article 8 of the human rights convention.
My hon. Friend the Member for Stone (Mr Cash) was trying to tempt me to go down a road that I know I should not go down any further on Third Reading of this Bill. Let me return to the point I was making about the balance between keeping the public safe and defending our liberties.
For 13 years the previous Administration chipped away at those freedoms and liberties, and in doing so, they did not protect the public. They chipped away at the notion that a person is innocent until proven guilty. Not only did they fail to take the DNA profiles of all of those guilty of a crime; they also provided for the indefinite retention of the DNA profiles of more than 1 million innocent people. They treated more than a quarter of the whole work force—some 11 million people—as potential abusers of children and vulnerable adults, by requiring them to be monitored as part of an overbearing vetting and barring system.
The previous Government chipped away at the right to liberty by seeking to extend the maximum period of pre-charge detention to 42 and even 90 days—until forced by the will of this Parliament to settle for 28 days. They then made 28 days the norm rather than the exception. They chipped away at the historic right of trial by jury; they chipped away at the notion that people should be able to live in safety and security in their own homes by creating hundreds of new powers of entry; and they chipped away at our right to privacy by creating a number of enormous Government databases—the national identity register and ContactPoint being but the worst examples.
The Bill continues the work of this Government in repairing the damage done to our traditional freedoms and historic civil liberties, while at the same time taking a careful and proportionate approach to protecting the public. In adopting the protections of the Scottish model for the national DNA database, it strikes the right balance between protecting our communities and protecting the rights of the innocent. When people are convicted or cautioned for a recordable offence, their DNA and fingerprints will be retained indefinitely, exactly as happens now. In all cases in which DNA and fingerprints are taken on arrest, they will be subject to a speculative search so that past offenders cannot evade justice, exactly as happens now. Under this Government, criminals who leave their DNA at a crime scene will not be able to escape justice if they are arrested again.
Moreover, we are now taking the DNA of all convicted prisoners, including hundreds who were convicted for the most serious offences such as murder and rape. That is something that the last Government failed to do. In June last year, we started a programme to identify individuals in the community who have previously been convicted of either a sexual offence or homicide, and whom the last Government failed to place on the DNA database. That process has so far identified more than 13,000 people whose identities have been passed to local police forces, and we are now working with the police to find the individuals and obtain samples. When someone is not convicted of an offence, however, there will be strict limits on the period during which that person’s DNA and fingerprints can be retained. That is exactly as it should be: justice is not served, and our communities are not made safer, by the stockpiling of the DNA and fingerprints of hundreds of thousands of innocent people for year after year.
The Bill includes sensible measures to help to maintain public confidence in the use of CCTV and automatic number plate recognition systems. CCTV is a valuable crime-fighting tool, which also helps to reduce the fear of crime—we saw that most recently after the summer’s riots—but it will not be able to continue to deliver such benefits if cameras are perceived to be spying on communities, or if they simply do not work as they should. We saw that most recently in the west midlands, where the installation of CCTV systems without the support of the local community meant that public confidence was lost and the cause of community safety was set back. By providing for a code of practice overseen by a new surveillance camera commissioner, the Bill will help to ensure that CCTV retains public support and therefore continues to be an effective tool in fighting crime.
The Bill also applies much-needed common sense to the criminal records regime and the vetting and barring scheme. Let me make one thing absolutely clear: the protection of children and vulnerable adults is of paramount importance to this Government, and robust systems for employment vetting play a vital part in ensuring that it is provided, but tying up employers and voluntary organisations in red tape and bureaucracy does no one any good. I do not think it is sensible to force some 11 million people to register with a Government agency, and I do not really think—and I doubt that the right hon. Member for Normanton, Pontefract and Castleford (Yvette Cooper) really thinks—that 11 million people should be continually monitored.
There was a real danger that the very scale of the vetting and barring scheme designed by the previous Administration would create a culture of irresponsibility in which employers felt that it was not up to them to protect children or vulnerable adults in their care. Employers must take their responsibilities seriously, and when innocent people are treated like suspects, it is society that suffers.
The Bill has been much improved by the process of scrutiny undertaken by this House. I thank all the members of the Public Bill Committee for their detailed and forensic examination of it, and I thank all Members who contributed to the debates on Report.

Commons ChamberI pay tribute to the way in which the right hon. Lady has entered into the debate generally. Her constituency was particularly badly affected and is a particular example of criminal gangs operating on the streets in order to test and press the police. I will give the same answer to her in relation to police budgets as I gave earlier and as my right hon. Friend the Prime Minister gave to a number of Members who raised the issue. At the end of the spending review period, the police will have the numbers to enable them to deploy in the way they have during the last few days. It is possible to make cuts in police budgets by taking money out of matters such as better procurement to ensure that we can achieve the cuts that we need to make while still leaving police able to do the job that we want them to do and that they want to do.
In January 2011, the chief constable of Greater Manchester police, Peter Fahy, told the Home Affairs Committee:
“we have large numbers of officers still in roles that do not require the skills, the powers and expertise of a police officer. It is through that route over the next four years where we will achieve quite a bit of savings.”
I congratulate my right hon. Friend on the emphasis that she is putting on the gang culture, which the Prime Minister himself referred to when he said that it was a culture that glorifies violence and says everything about rights but nothing about responsibilities. Does she agree that the legal restraints that are placed upon, for example, the police, social services, teachers and parents, in imposing discipline in the home, in school or elsewhere, directly derive from a number of legal constraints that come from, for example, the Human Rights Act 1998, which needs to be repealed? We cannot deal with the culture and with the question of rights and responsibilities unless we deal with one of the root causes, which is this idea that people can do anything and get away with it.
We are taking steps to deal with the culture, and one example is that my right hon. Friend the Secretary of State for Education is taking steps to ensure that we restore discipline in our schools. My hon. Friend refers to the Human Rights Act, which was referred to during questions to the Prime Minister, and my hon. Friend is well aware that we are looking at the issue both through the Bill of Rights commission that has been set up by the Ministry of Justice and my right hon. and learned Friend the Justice Secretary and work that we are doing with the ECHR.

Commons ChamberThe Home Secretary referred to the interaction between the inquiries she has set up and the Leveson inquiry, and her references to the relationship between the police and the media are the right approach. Does she agree that, in the interests of clarity and accountability, to refer merely to the press in the Leveson inquiry would be unsatisfactory and that 17 Select Committee Chairmen, the chairman of the 1922 committee, the chairman of the parliamentary Labour party and the leaders of Northern Ireland, Scotland and Wales have all said that the Leveson inquiry should be extended to the media as a whole?
The terms of reference for the Leveson inquiry which my right hon. Friend the Prime Minister announced last week were agreed not only by the Government but in consultation with the Opposition and, as I understand it, with the Leader of the Opposition, and of course with Lord Justice Leveson himself.

There is no greater task for any Government than to protect their citizens, to uphold their values and to defend their way of life, but when we face such a significant threat from terrorism over so great a period it becomes even more important that the Government ensure that the protection of our citizens does not overshadow the freedoms of us all. That is why we reviewed counter-terrorism legislation and it is why we need this Bill. Let me be clear: I will do nothing that risks our national security or the safety of our citizens, but this Bill is necessary precisely because public safety is enhanced, not diminished, by appropriate and proportionate powers.
There is in this country a small number of people who pose a real threat to our citizens, but whom we cannot successfully prosecute or deport. Prosecution, conviction and prison will always be our priority because the right place for a terrorist is in a prison cell. Where successful prosecution or deportation is not possible, however, no responsible Government could allow dangerous individuals to go freely about their terrorist activities. Since becoming Home Secretary, I have made use of the control order powers available to me to stop terrorist activity and to place restrictions on such individuals on a number of occasions.
I think that my right hon. Friend may have anticipated that I would have something to say. She refers to terrorists and I am sure she realises that what she is talking about in this context is suspected terrorists. Does she recognise that it is the fault of the Government and Parliament if judges are given too much scope in human rights matters? Why produce a Bill here at Westminster that fails to provide for due process and a fair trial according to the basic principles of British justice? The coalition is simply giving in to Lib-Dem pressure for this Bill to comply with the Human Rights Act and the European convention; and it has not even provided for a derogation from article 5.
I did indeed expect that, as my hon. Friend was in the Chamber, he might wish to raise certain matters. I am aware of his private Member’s Bill on the same issue. I have to tell him that I was not entirely clear from what he said whether he was in favour of more human rights or against more human rights. I see him leaping to his feet.
I am grateful to the Home Secretary for walking into that one. I am very much in favour of human rights, but I am in favour of human rights according to principles of British justice, not those devised through the European convention and applied through the Human Rights Act, which has led to so many contradictions and inconsistencies and has raised so much concern among the public at large.

Today we have a rare opportunity. The Bill gives us a chance to roll back the creeping intrusion of the state into our everyday lives, and to return individual freedoms to the heart of our legislation. Under the last Government, we saw a steady erosion of traditional British liberties and a slow march towards authoritarian government. They presented us with a false choice between our future security and our historic liberties, disregarding any notion of balance between the two.
The House rejected that choice on many noble occasions, notably when an extraordinary attempt was made to increase the period of pre-charge detention of terrorist suspects to 90 days. On other occasions, illiberal laws were passed, and on yet others, well-intentioned schemes were left open to abuse. The Bill gives us an opportunity to redress the balance and to right some of those wrongs, although it is not the only such opportunity. We have already repealed some measures, and we will repeal others.
I note that my right hon. Friend did not actually say that she would be happy to do so.
Does my right hon. Friend accept that however good the intentions may be, one of the great problems with the Bill is that it serially adopts, endorses and puts into British legislation European Court rulings, and that that in itself runs counter to the sentiments expressed only a few weeks ago when the House voted against a ruling by the European Court of Human Rights by 222 votes to 15?
My hon. Friend is right, I am afraid; but I almost said I was happy to give way to him. I am not going to rehearse all the arguments we have had on the issue he raises. I am well aware of the vote in the House on the Backbench Business Committee motion on prisoner votes, and the Government have made it absolutely clear that we are not happy about having to give prisoners votes and we will be looking to do so in the most minimal way possible.
The first issue the Bill addresses is DNA. The police national DNA database, established in 1995, has led to a great many criminals being convicted who otherwise would not have been caught, and I am sure all sensible people support it, but in a democracy there must be limits to any such form of police power, and we simply do not accept that innocent people’s DNA should be kept for ever on a database, as the last Government seemed to think was appropriate. Storing indefinitely the DNA and fingerprints of more than 1 million innocent people undermines public trust in policing and goes against any sense of natural justice, so we will be taking innocent people off the DNA database and putting guilty people on.
The Bill introduces a new regime, whereby retention periods depend on a number of different factors, including the age of the individual concerned, the seriousness of the offence or alleged offence, whether they have been convicted, and, for under-18s, whether it is a first conviction. So in future, as now, an adult who is convicted or cautioned will have their fingerprints and DNA profile retained indefinitely, and we will take steps to plug the inexcusable gaps in the DNA database where the profiles of those who have previously been convicted of a serious offence are not currently included on the database.
I am grateful to my right hon. Friend for his intervention and I absolutely agree with him. We will provide three order-making powers in the Bill to allow the repeal of unnecessary powers of entry, the addition of safeguards and the rewriting of powers of entry with a view to consolidating a number of powers in a similar area coupled with the inclusion of extra safeguards. Within two years of Royal Assent, the Government will be required to carry out a review of all existing powers of entry and to report the findings to Parliament. Provision will also be made for a code of practice for powers of entry, adding further protections for home owners.
Will my right hon. Friend note that the Library research paper on the Bill indicates that a third of all powers of entry are based on EU requirements? Will she explain why and how she is going to repeal the provisions that are entrenched in our legislation through the European Communities Act 1972? What formula will she use—will it be the “notwithstanding” formula?
When I gave way to my hon. Friend, I almost said I had a deep suspicion that I knew what he was going to say, and I was absolutely right. Of course we will not be able to get rid of all powers of entry, nor would that be appropriate. It will be appropriate to keep some, and with others we will need to look at the implementation of a request or desire to gain entry in relation to what is at stake, what is the most appropriate use of power and how that power should be used. The process will take some time, but it is essential that the Government are committed to reducing the number of powers of entry, whereas the previous Government oversaw a significant increase in that number.

Commons ChamberIt has been clear from the responses to my statement that there are differing views across the House. We all want to see terrorists investigated, prosecuted and brought to judgment. As I said, the best place for a terrorist is in a prison cell. We want to make every effort to ensure that the processes of investigation and prosecution can be successful, but in a small number of cases prosecution has not been possible and deportation is not possible, so the Government need to act in order to protect the public.
There is no freedom without security, so would the Home Secretary consider changing the proposed Bill’s title from the protection of freedom Bill to the security and freedom Bill? The Lord Chief Justice and many others have highlighted the problem that the principles of habeas corpus, due process and fair trial have been significantly hijacked by human rights legislation and judicial interpretation, which have taken us significantly in the wrong direction.

Commons ChamberI am deeply concerned that the EIO has not been considered by the European Scrutiny Committee, which was formally set up last night, and nor have many other important matters. The legal basis is qualified majority voting, co-decision and the European Court of Justice under the Lisbon treaty. Will the Secretary of State confirm that the EIO applies to all investigative measures, and that it gives undue rights to police officers from other European countries to order our police to gather sensitive personal information —and, furthermore, DNA and banking records—in relation to non-criminal matters, and from those who are not even suspects? The grounds for refusing an EIO request are totally inadequate, and I am sure that the ESC will demand a debate and call evidence, but regrettably, it cannot do so until 8 September, because it has not been called to sit until then.
I must tell my hon. Friend that decisions on when the ESC meets are rather more a matter for him—as I understand it, he is the Chair of that Committee—than for me. However, I share some of his concern. As he and other Members of the House will know, I have written a pamphlet and proposed a 10-point plan on how Parliament can have more of an opportunity to have a say on, and to debate, decisions on European matters.
The instrument came before the Government on 29 April with a three-month deadline for decision. Of course, that period was partly taken up by the election, and the ESC was formed only last night, as my hon. Friend said. In the normal course of events in Parliament, the ESC could suggest the matter for debate. On that point, it is certainly my hope that when the Government propose to opt in on a major JHA issue, Parliament can consider it. However, I hesitate to give more of a guarantee than that, because what happens in Parliament is a matter for the business managers rather than for me. On the powers that my hon. Friend claims the EIO gives to foreign police forces and others, I must tell him that I think he is wrong.

Commons ChamberI thank the hon. Gentleman for focusing on that issue. He asked me to ensure that there were no deportations during the review—a rather wide commitment —but the purpose of his question was to focus on deportations with assurances. Of course, the issue arises because we have had a number of cases here in the UK where individuals have been identified as posing a terrorist threat to the UK, but because of the legal interpretations of our duties and requirements under the European convention on human rights, it has not been felt possible to deport those individuals to certain countries. We wish to continue to work with a number of other countries to ensure that it will be possible to deport people with assurances that they will not be subject to torture.
On the point that the Home Secretary has just made about legal interpretation, has she taken note of the fact that many senior members of the judiciary, including the Lord Chief Justice, have raised serious concerns relating to the manner in which the convention on human rights has been interpreted by the Court in Strasbourg and that, for practical purposes, the balance between protecting civil liberties on the one hand and the security of the people on the other must be maintained? Therefore, the review is welcome, but she must take into account the fact that many senior members of the judiciary do not regard this as xenophobic legal nonsense.
I am happy to take into account the fact that many members of the judiciary have different views on the issues that we will review. Of course, as I said earlier, we aim to get the right balance between ensuring that we can protect members of the public and ensuring our national security, while maintaining our civil liberties.
