I am glad that the hon. Member has highlighted the role that the EU would have in state aid, not only in Northern Ireland but in Scotland, Wales and England where those firms have any connection with Northern Ireland. Does he therefore find it surprising that, while Opposition parties have been complaining about state aid rules not being devolved to them, they are quite happy to have the EU plunder through any support given to industries in their own country?

They do not have a clue. They are going to get clobbered—they really will—and they do not get it. They just want to go on about devolution without regard to the effect that all this will have. I entirely agree with the right hon. Gentleman.

The Bill itself defines aid with reference to EU law—it refers to article 107 of the treaty on the functioning of the European Union. This is something that we will be affected by, because that amendment is not sufficient to enable us to maintain our sovereignty on all the matters relating to state aid rules. I look to the Prime Minister, I look to the Chancellor of the Duchy of Lancaster, and I look to the Government and the negotiators to get this right. This is the moment to do it. We are at a crucial moment. I trust the Prime Minister. I believe he will deliver. He said he will, and we will hold him to that promise.

It would go against UK national interest to accept EU demands of agreeing to legally binding commitments to mirror the EU state aid regime, given that EU state aid rules are created on the basis of objectives of common interest of EU member states, which no longer includes the UK, and are tested by the Commission on the basis of compatibility criteria that it has developed. They are non-binding guidelines, and therefore they can be changed at will. Under article 132 of the protocol and article 174 of the withdrawal agreement, provisions of the withdrawal agreement and the protocol referring to EU law or to EU law concepts or provisions are to be

“interpreted in conformity with the relevant case law of the Court of Justice of the European Union.”

That duty continues beyond the end of the transition period on 31 December and includes European case law handed down after the end of that period.

There is a real problem here. This is down to the negotiators as well as to those who are responsible for this Bill. We are faced with a very difficult situation, which impinges on our sovereignty and on our necessity to avoid, indeed to prevent, EU state aid rules from continuing to apply to the United Kingdom. This is a crucial moment in our economic, political and constitutional history. We must maintain the sovereignty of the United Kingdom. That is the message that I send to the Government and I trust that the Government and the Prime Minister will deliver it.

May I say at the very start that we support the Government in getting this deal done by the end of this year, and in honouring the commitment that has been made, including in manifestos to the people of the UK?

I could rehearse the things that we in Northern Ireland want to see undone in this withdrawal agreement. Of course, it is most damaging to the Northern Ireland economy and Northern Ireland businesses—it puts burdens on them and puts additional administrative checks on them—and, indeed, it leaves Northern Ireland open to anti-competitive dumping by EU countries. However, I want to widen this today. Many people see the Northern Ireland protocol as something that simply affects Northern Ireland: “It was unfortunate; we had to do it; we had to get a deal through; we don’t like parts of it, but given the special circumstances, it was the best we could do.” The point of the Northern Ireland protocol is this: it is the back door through which the EU is going to continue to undermine the sovereignty of this Parliament.

The Minister congratulated the hon. Member for Stone (Sir William Cash) on the fact that he has worked tirelessly to restore the sovereignty of this House. This withdrawal agreement and the protocol undermine and continue to undermine the sovereignty of this House. It does that through article 10 of the Northern Ireland protocol, which insists that the state aid rules will apply not to Northern Ireland, as paragraph 40 of the Government’s Command Paper suggests, but to the United Kingdom as a whole. Any state aid that the Government of the United Kingdom give to any firm that trades in Northern Ireland, as this therefore has an effect on possible trade by those firms through Northern Ireland into the rest of the EU, will be subject to EU laws, and the final adjudication on that, according to article 12 of the Northern Ireland protocol, will be by the European Court of Justice.

Let me give an example about any support that the Government give. Nissan has been mentioned today. If the Government decide they are going to help Nissan to develop battery cars, as Nissan sells cars in Northern Ireland, other car makers in Europe could challenge that, and the final adjudication on it will be not in the British courts, but in the European Court of Justice. That could extend to almost any activity, and for that reason it is important, if the Government are to live up to the commitment in the third part of their motion, that they address the withdrawal agreement. In the Command Paper, they see the withdrawal agreement as temporary anyway. They see it going along with a future trade arrangement.

I did, and I appreciated the point that was made. It is important that this is revisited, and not just for the good of the economy and businesses in Northern Ireland. It is essential that it is addressed for the sovereignty of this Parliament and for the freedom of this Government to use fiscal policy, monetary policy and any kind of state support policy for the whole of the United Kingdom.

There is hardly a business in GB that does not trade with Northern Ireland, so either they do not invest in or do not trade in Northern Ireland, or else they will find that they are subject to EU laws, and any Government policy addressed to them would be perceived as giving an advantage. By the way, that advantage only has to be theoretical, according to EU law. The effect does not have to be real, it does not have to affect sales—in theory, it does have to affect sales—and it does not have to be substantial; it can be a very small proportion of help or a very small proportion of the market. This is a huge foot in the door.

I say to the Government that, during the scrutiny of and in the reports on this, we want to see what has been done. The withdrawal agreement must not be seen as set in stone if the Government, in their own Command Paper, see it as temporary anyway, albeit with the consent of the Northern Ireland Assembly. They also have to address the issue of how the withdrawal agreement impacts on sovereignty and on the ability of this Government to conduct their own economic policy in the United Kingdom.

I endorse my right hon. Friend’s intervention. It also made me particularly angry to hear Mr Juncker say that Eurosceptics should go and visit war cemeteries—people will understand the impact of that comment on someone like me—and I deeply resented President Obama’s reference to the same matter with respect to both United Kingdom and American troops. My father fought with American troops, and I am absolutely certain that the kind of undemocratic, dysfunctional, authoritarian, centralised system represented by the European Union, which does not work, is the antithesis of what they fought for. I want to get that firmly on the record.

Does the hon. Gentleman accept that it is a measure of the remain campaign’s desperation that it has to invoke the memory of those who died fighting dictatorships in order to try to present its case as patriotic when, in fact, we know from all the language that the campaign uses that it wants to do the country down?

The hon. Gentleman is right. I would go further, with reference to the historical analogies that permeate these documents and what the Prime Minister said today, and say that the very idea that Brexit would create war completely turns on its head the reality that, for at least four centuries, this country was drawn into all the wars in which it has been engaged by the desire of those in Europe to create European empires. That started, for example, with Philip of Spain and the armada, and later there were the Dutch wars, the Napoleonic wars and the first and second world wars. Those are realities. We were drawn into those wars. If we leave the European Union, we will be able to stand alone and, as we did in 1940, remind people that we are not going to be part and parcel of this dysfunctional system, which has so much instability and insecurity built into it that it is bound to lead to deep disturbance. Our attempt to make sense of all that has led us to argue so strongly for so many years that this European Union is dysfunctional, which is why, ultimately, we have to leave it.

The hon. Member for Vauxhall referred to the European Scrutiny Committee’s reports. She is an excellent member of the Committee, which I have the honour to chair. In the Liaison Committee’s examination of the Prime Minister last Wednesday, I was asked to go first after the Chairman, my right hon. Friend the Member for Chichester (Mr Tyrie). I explained to the Prime Minister and to the Committee why I believe that the voters are being cheated on 23 June and, ultimately, a false prospectus is being offered to them. The reason is simple: the outcome of the question of whether there will be a full-on treaty change, which we were promised, cannot be guaranteed, if at all, until after the vote. When the voter goes to the voting booth and votes, they simply will not know whether, for example, there will be a treaty change, whether the European Court will intervene, whether there will be a change of Government or whether there will be a referendum in any other country on the basis of the changes that are made. The outcome of any one of those questions cannot be guaranteed under any circumstances, so I allege that requiring people to vote in such circumstances is cheating the voters.

I was most impressed to see the numbers on the petition, and it may be of interest to Members to know that the clip of my allegation that the Government and the Prime Minister are cheating the voters has now reached 175,000 viewings on Facebook, which is quite a lot. I strongly believe that that message is getting home to all the people who need to hear it.

The question of the single market seems to be so central to the economic case, the political case, the democratic case and the accountability case for why we should leave because it is in contradiction to what the people fought and died for in the last war. That is extremely important, but the Government also make an economic case in the leaflet, which talks about our having a massive single market:

“EU countries buy 44% of everything we sell abroad, from cars to insurance.”

What the leaflet does not say is outlined in a note I received from the House of Commons Library, and it is as simple as this. When we are trading with 27 other member states, the question of whether we have a deficit in goods and services, and in imports and exports, is the equivalent of asking whether we are making a loss in relation to those 27 member states. This is the answer from the House of Commons Library:

“UK trade deficit with EU countries: £67.8 billion”.

That is annual, and it is going up. That is a vast amount of money in our dealings with the single market, and it demonstrates that the single market does not work for us across the board. On the other hand—this is important—Germany has a £81.8 billion trade surplus with the 27 other member states. We make a loss of £67.8 billion, and they have a surplus of £81.8 billion. I do not have time to go into all the reasons, but it is a salutary lesson about the real value of the single market to us.

The UK’s trade surplus with the rest of the world, in relation to the same goods and services on which we make such a monumental loss with the other 27 member states, was £31.1 billion last year, and it is growing. We have a bright future. The Chancellor of the Exchequer’s accusation that leaving the single market would be catastrophic, the idea that we would end up at war if we do not carry out the diktat that the Government are issuing to the British people, and all the accumulated international bodies that are being brought in to support this flimsy argument that we should stay in, are all to be taken into account when people come to vote on 23 June.

I reject the manner in which the Government have gone about this. My hon. Friend the Member for Sutton and Cheam has done us a service in bringing this issue to the House, as have the petitioners. Jayne Adye deserves 100% credit for doing so. There is only one answer to this shambolic European Union, and that is to vote to leave it.

I do not know what the motive is, but I do know what the outcome will be: it will be damaging to the Union. As a convinced Unionist, I do not want to see that happen.

We heard assurances from the Leader of the House today that Members would have every opportunity to debate legislation that might affect their constituents, but what is English-only legislation, and what kind of legislation will carry Barnett consequentials? I remember in a previous role as Finance Minister in Northern Ireland having discussions with the Treasury about legislation that seemed to have no financial consequences for Northern Ireland. It was about the Olympics and spending in London. When I looked at it, however, I saw that it did have financial consequences for Northern Ireland, and the Treasury had to admit that there were Barnett consequentials—not that I got any money out of the Treasury, but at least it had to admit it.

Let me give another example. Education policy here in England might be regarded as English-only legislation, but changes in exam structures have consequences right across the United Kingdom, and many students from Northern Ireland apply to English universities. Dramatic changes in the exam structure here will have consequences in Northern Ireland, and we often have to reflect such changes. However, the current proposals would not allow us the opportunity to have an input.

As the hon. Gentleman well knows, I am extremely sympathetic to all matters relating to Northern Ireland, but I just want to ask him one question. It is completely mind-boggling to imagine how anybody will make their way through 30 pages of proposed changes to Standing Orders, so is he attracted to my proposal, which would simple do it by order of the Speaker and in seven lines, which would at least bring clarity?

The role of the Speaker has already been discussed. I fully appreciate the work that the Speaker does and do not wish to cast any aspersions about that, but I think that we would be putting him under huge pressure. We would be expecting him to make a decision for which he would not have to give any explanation, and about which Members would have no opportunity to make representations. That puts a huge onus on the Speaker. Such decisions would not be the end of the matter, because every time he made a decision there would be opposition to it. It would be an open sore, or a scab to be picked at. It would be another opportunity to cry foul, with claims that Members have been excluded. Not only would that be unfair on the Speaker, but it would perpetuate the grievance that many people would feel.

Of course, but I want to develop this point first.

There is nothing new in this. The chattering classes have all come together to condemn the Prime Minister for standing up for Britain and for our interests in Europe. There is nothing new in those who see the European project being attacked using that tactic in debates such as this. In fact, a leader of the Liberal Democrats said, as revealed by Hansard:

“There will be a second-tier Europe”—[Official Report, 24 September 1992; Vol. 212, c. 34.]

in which we will be led into “isolation”. People may wonder how on earth that can be, when the Liberal Democrat leader has not been in the House since these events happened. How can he have anything on record in Hansard? Of course, I quoted not the present Liberal Democrat leader but the Liberal Democrat leader from 1992—nearly 20 years ago—when we had exactly the same situation. They have not even learned new lines, for goodness’ sake. If they are going to criticise someone for undermining the European project, one would have thought that they would learn to find some new arguments.

People have said that we are isolated in the world. It is interesting to note that when Hillary Clinton commented, she said that she was not concerned at all about what the Prime Minister did in Europe this weekend. She was more concerned—and America is more concerned—about whether this will be an effective way of dealing with the crisis of the euro. As a number of hon. Members—including even the hon. Member for Cheltenham (Martin Horwood) —have pointed out, even the markets agree that this has not been a good deal. How on earth can we be isolated and left alone on the edges of Europe on this issue if we find that all those looking at the effectiveness of the deal have found it wanting?

The second argument is that Britain will be left alone and other nations in Europe will not support us. Hon. Members, including again the hon. Member for Cheltenham, and the hon. Member for Folkestone and Hythe (Damian Collins) and even the hon. Member for Foyle (Mark Durkan), have pointed out that this is not the end of the matter. Many of those hailed as supporting the deal are already beginning to have second thoughts. The list is endless: Denmark, Sweden, Poland, Finland and Czechoslovakia. Ironically, even one of the candidates who might well be the next Prime Minister of France has said that he would undo what has happened. I think that, far from being alone, we will find this issue being revisited by others. That requires a word of caution: if it is to be revisited, it is important for the Prime Minister to take the same stance again.

Does the hon. Gentleman agree that, in the light of everything he has so soundly said, it would be extremely unwise for our own Government to make any attempt to endorse the arrangement, given its uncertainty and apparent instability?

Absolutely. As other nations start to look at the implications of the deal and see the essentially undemocratic nature of it, they will ask themselves whether they are prepared to put their destiny in the hands of the European Commission.

I find it strange that the party that has opposed the Government’s austerity measures in the United Kingdom has taken the view that it is better to hand the ability to impose those measures to the unelected bureaucrats in Europe. At least the Prime Minister can be held to account in this place every Wednesday and the Chancellor can be held to account here, too. We will not be able to hold European bureaucrats to account if we give them this power. That is one reason why I find the attitude of Labour Members very strange.

The third argument that has been made is that we have gained nothing and lost everything. The hon. Member for Wolverhampton North East put it succinctly: it was bizarre of us to support the Prime Minister, she said, because decisions will be made that will affect us, and we will not even be in the room when they are discussed; it has failed to stop any changes in the financial system; and it is bad for Britain, and bad for jobs. Therefore, she and the Labour party oppose what the Prime Minister has done. With such an argument, she should have found it easy to say, “We want to be in the room, we want to safeguard financial institutions, and we want to create jobs, so we will support the deal.” But no matter how many times those in the Labour party have been asked the question, they have not been able to say that they would have supported the deal. Perhaps she will now tell us that the Labour party will support the deal.
