It is a great pleasure to serve under you today, Mr Twigg—I do not think that I have had the pleasure before, so it is very nice to see you in the Chair. Indeed, it is a pleasure to see all hon. Members and Friends here for this debate.

First of all, I must thank my hon. Friend the Member for Stockton South (Matt Vickers) for introducing the debate and for making a very clear case, as he always does in these petition debates. He referred to the debate in 2015, and I think a number of hon. Friends and Members were probably at that debate. I do not know if you were there, Mr Twigg, but I must say that it was one of the best debates I have ever attended in Parliament—and it was about hedgehogs. It was responded to by my then right hon. Friend for Penrith and The Border, and it has stayed in my mind.

Today’s debate has demonstrated, with the number of speakers we have had and the number of people who have signed the petition, just how heartfelt this whole issue of hedgehogs is—they are wonderful creatures. We have had wonderful references to all sorts of hedgehog charities and organisations, and I thank them all. We had Hessle Hog House, Hedgehog Street, the Wildlife Aid Foundation and the British Hedgehog Preservation Society, which arranged the petition and does so much good work. It is based in the constituency of my right hon. Friend the Member for Ludlow (Philip Dunne), who could not be here today but wanted to ensure that we thanked it for all the work it does in his constituency. We have also had Snuffles Hedgehog Rescue, and we must not forget Horace the film buff hedgehog—I am sorry that he is outdoing my right hon. Friend the Member for Harlow (Robert Halfon) when it comes to his other debates, but that just goes to show the strength of feeling.

This Government are absolutely committed to ensuring that our native species thrive, as we take action to address the declines that we are all so sad about. We—and I as the Minister—are deeply concerned about the findings of the red list for British mammals, published in 2020 by the Mammal Society, which has classed hedgehogs as vulnerable.

I am a great fan of hedgehogs, not least from reading all my children Mrs Tiggy-Winkle, the amazing Beatrix Potter book. As a Back Bencher, I worked with others, and we secured a reference in the national planning policy framework for hedgehog highways—that reference is in there now. Only today, I made a speech on green infrastructure to the Town and Country Planning Association, and I referenced hedgehog highways again.

I warmly congratulate the Minister on that success. Now she has a real opportunity in her current role, because she will be signing off on environmental land management schemes. A good, simple scheme to promote hedgerows is great for farmers and even better for hedgehogs. I hope that we will see that in the ELM scheme.

I thank my right hon. Friend very much for that intervention; she is obviously passionate about this issue and indeed worked in the Department. I am sure she knows that we have just announced the details of our sustainable farming initiative and the ELM scheme is very much about habitats, bringing nature back and being able to produce food sustainably, and there will be an emphasis on wildlife corridors and particularly river corridors. All these things will benefit our native wildlife and particularly hedgehogs. So my right hon. Friend is right, and I shall be taking advantage of the opportunity; indeed, I have been speaking up for hedgehogs.

I must mention West Hatch Animal Centre, which is just over the hill from where I live. It does absolutely brilliant work when hedgehogs are orphaned. I have been up there, and the centre has all these baby hedgehogs that are underweight and cannot get through the winter. The centre takes them on and literally drip-feeds them with pipettes to keep them alive. I was then very honoured that my garden was vetted and was deemed acceptable—I garden for wildlife—to receive some of these, now fattened-up, hedgehogs. I had some released in my garden. I was in Parliament one day, and the centre said, “You have to have a hedgehog house.” I thought, “What is that?” So I googled, “What is a hedgehog house?” I then had to build one in order to receive a hedgehog, which we duly did.

Of course he doesn’t, Mr Speaker, and he won’t be able to now. I hope he will be pleased by what he hears about what we are doing to protect trees.

Finally in this toolbox of measures to improve nature, we have conservation covenants to protect natural features of the land for future generations. Just last week, we announced a raft of significant measures to further deliver for the environment, and I am absolutely delighted to say that we have committed to an historic new, legally binding target on species abundance for 2030, which aims to halt the decline of nature in England. We will table an amendment on that in the other place and we will set a final target in statute following the agreement of global targets at the UN conference on biodiversity in Kunming, in China, in autumn 2021.

It is essential that we seize this opportunity to set our ambitions high and take action to deliver them. I think it is clear in the Bill that we are doing that. That is why, in addition, I am pleased to propose two Government new clauses today—new clauses 21 and 22, which will not only help us halt the decline in species but drive recovery. New clause 21 provides for a power to refocus the Conservation of Habitats and Species Regulations 2017 to ensure that our legislation adequately supports our ambitions for nature, including our new, world-leading 2030 target to halt the decline of species. New clause 22 will allow us to amend part 6 of the 2017 regulations to improve the habitats regulatory assessment process. Where the evidence suggests that amending the regulations can improve the natural environment, make processes clearer and provide more legal certainty, to help improve the condition of our sites, we will have the means to do so swiftly.

I thank my right hon. Friend for giving me the opportunity to mention our peat action plan, which was launched just last week. Restoring our peatlands is a crucial part of improving nature. It is essential that we get the 30,000 hectares that we have pledged to restore restored. We have the funding and measures behind it to enable us to do that.

Thank you, Mr Deputy Speaker—Mr Speaker! Goodness gracious me, I am so sorry. Gosh! Apologies.

Biodiversity definitely matters, and it is critical that we act now internationally and at home in this crucial year for nature and biodiversity. In England, our Environment Bill sets out a strong legal foundation for improving the environment, and we have introduced substantial new funding for nature, including the nature for climate and green recovery challenge funds. We have protected 40% of English waters across 178 marine protected areas, and we have committed to protecting 30% of our land by 2030.

Will the Government ensure that nature-friendly farming is at the heart of our replacement for the common agricultural policy, and will securing a global switch to sustainable and nature-friendly farming be a core goal for us at COP26?

I am pleased that my right hon. Friend has given me the chance to say that we on the Front Bench—every single one of the Ministers and the Secretary of State—are absolutely committed to nature-friendly farming, and there will be schemes through the new environmental land management system that will reward it. The sustainable farming incentive will support approaches to farm husbandry that will help the environment. That might include propagating integrated pest management and actions to improve soil health and water quality. Local nature recovery will pay for actions that support local nature recovery and deliver local environmental priorities, with farmers potentially collaborating. Finally, landscape recovery will support much wider landscape-scale and ecosystem recovery through long-term change of land use and projects. Internationally, that work continues with our Darwin initiative and many more things, and we will bring all those into COP26.

I wish to thank the Backbench Business Committee, my hon. Friend the Member for Tiverton and Honiton (Neil Parish) and the EFRA Committee for putting animal welfare on the agenda in Parliament today. I have found it distressing to listen to the brutal examples of animal cruelty we have heard about, particularly those detailed in the speech by the hon. Member for Redcar (Anna Turley). I emphasise that animal welfare and action to prevent animal cruelty is a very high priority for many of my constituents, who contact me regularly about this. I warmly and strongly support the campaign for stiffer maximum sentences for those who abuse animals, act with unnecessary cruelty or otherwise fail to comply with our animal welfare rules in this country.

In the few minutes I hope to detain the House, I wish to focus on the welfare of farm animals, because I feel strongly that all of us who take animal welfare matters seriously should focus on the billions of animals used in agriculture across the world. If we want to ensure that, as a civilised society, we maintain high standards of animal welfare, it is vital that we extend this to farm animals. I thank Peter Stevenson of Compassion in World Farming for providing me with some help in preparing for this debate.

My hon. Friend the Member for Southend West (Sir David Amess) said that he was sick of talking about Brexit, but Brexit does have relevance today, because about 80% of our animal welfare rules are currently part of EU law. Leaving the EU will give us back control over many policy decisions on animal welfare and farming. As I said when I had the opportunity to raise this matter during Prime Minister’s questions, we should use Brexit to reaffirm our support for the highest standards of animal welfare. We should also use it as an opportunity to see how we can strengthen protection for animals.

Food and farming is one of the most important parts of our economy, supporting many thousands of jobs. I welcome the fact that last October the Secretary of State for Environment, Food and Rural Affairs said that high standards of animal welfare should be one of the unique selling points of UK-produced food in the post-Brexit era. If that is to be a reality in post-Brexit farming, we need to ensure that animal welfare is at the heart of our new system of farm payment support. It is crucial that we maintain that financial support for agriculture if we are to ensure that food produced in accordance with high welfare standards is not priced out of the market by cheaper, less compassionate, alternatives. In future trade talks, we should be prepared to ask those countries that wish to sell into our market to commit to acceptable standards of animal welfare, as was emphasised in the Conservative manifesto. It is my understanding that World Trade Organisation case law does allow us to do that, so long as we apply the same rules across different countries.

The compassionate treatment of animals should be at the heart of the UK’s post-Brexit brand for food and farming. We should recognise the efforts made by UK farmers already, as the majority take animal welfare very seriously. Our new system of farm support should reward farmers who adopt higher welfare standards, for example, through compliance with recognised schemes such as those run by RSPCA Assured or the Pasture-Fed Livestock Association. We need to provide incentives to move away from industrial livestock production towards free-range systems.

In particular, we should aim for an end to the zero grazing of dairy cows. Industrial systems that keep cattle indoors all year round are not capable of delivering high animal welfare standards, no matter how well-managed. I welcome the acknowledgement the Minister gave in responding to my Westminster Hall debate on this issue, when he said that

“any farmer who has turned cattle out to grass in April and watched their reaction knows that cattle prefer grazing, all other things being equal.”—[Official Report, 24 January 2017; Vol. 620, c. 95WH.]

As part of our efforts to end the practice of zero grazing, I hope that the Government will consider measures to enable consumers to make informed choices on the milk they buy. At present, most milk, other than organic milk, is pooled together, making it impossible to distinguish intensively produced from pasture-based milk. We need to consider separation, to enable farmers using good practices and pasture-based grazing to advertise this fact to consumers in the way free-range egg producers have for many years.

Recently, I raised with the Minister the idea of having a “Buy British Food” button when people buy food on the internet, and I hope to talk to him shortly. How about having some sort of guidance or button about standards and animal care, too?

Both are good ideas, and I hope the Minister will respond to them when he sums up.

A further very important reason why we should discourage intensive farming methods is antimicrobial resistance, a matter the Select Committee has examined carefully. Industrial-style farming can lead to the overuse of antibiotics to fend off diseases and infection caused by keeping animals in unnatural and crowded conditions that compromise their health and their immune responses. Antimicrobials are often given to whole herds or flocks of intensively farmed animals via feed and water. Unless we draw a halt to the trend that antibiotics are gradually becoming less and less able to protect us, we could face the risk of a return to the situation of previous centuries where such matters as childbirth, non-serious injuries and routine operations frequently gave rise to a risk of death. This is a very serious risk faced by our society, and many will no doubt have listened to the harrowing Radio 4 drama, “Resistance”, which was based on one of the worst-case scenarios feared by scientists. So it is necessary to find ways to reduce overall antibiotic use in farming, and our goal should be higher-welfare farming where animals are kept healthy through good husbandry practices rather than routine antibiotic use.

As we scrutinise the great repeal Bill and associated legislation, we will need to ensure that the enforcement powers currently vested in EU bodies are transferred to domestic alternatives. Here I wish to echo a point made by a number of hon. Members: enforcement is crucial. There is no point in having rules on our statute book that are not properly enforced. This has been a long-standing concern in relation to EU rules; I recall working with my hon. Friend the Member for Tiverton and Honiton when we were both in the European Parliament to try to improve enforcement. This debate is a good opportunity to emphasise that the proper enforcement of rules on animal welfare and preventing animal cruelty is vital for our constituents, who care so much about this matter. Analysis by the Food Standards Agency indicates that between July 2014 and June 2016 there were more than 4,000 serious breaches of animal welfare legislation relating to slaughter and transport to slaughter. We need to do better.

In conclusion, I urge the Minister to consider an end to the export of live animals for slaughter overseas. I believe that this trade would have been banned years ago if the decision had rested with Westminster rather than Brussels. The referendum vote means that very soon this House will have control over this decision once again, and I hope the Government will press ahead with a ban to end this cruel trade.

Q Part of this has been covered by John Mann’s questions, but just to be clear, it seems to me there are far fewer neighbourhood plans in big cities than elsewhere. It would be useful to understand from you what you think the main cause of that is. Is it because it is very difficult to identify a community small enough to be viable for a neighbourhood plan within a bigger urban area?

Jonathan Owen: I think it is that, and I think those communities need support from their local planning authorities. Of course, the absence of a parish or town council in those areas means there is no institution that can drive it forward and raise funds through precepts to support the neighbourhood plan, with an ongoing democratic existence over time.

Q One of the things so many communities want is to have an influence on how their communities look and feel, what nice places they are to live in and all of that. Do you think the changes proposed in the Bill will help that? Will people really feel that they are going to influence the places in which they live?

Ruth Reed: I think it would be helpful if it was explicit that provision is made for enabling the capacity for local communities to express what they want out of the quality of their environment. I do not think it is explicit. It is implied that there will be funding provided for guidance, but it does not say that that should be what it is. I think it would be good if the Bill made a clear statement that good design will be brought forward through this process.

Q I was pleased to hear that answer, Mr Whitaker, because that issue was on my mind as well. You suggested earlier that planners might focus on the essentials of preconditions. We have to be clear about who determines what the essentials are. For example, when is a bat more essential than a ditch? I think you have made it quite clear, and I do not think that those of our environmental colleagues who are listening will feel you are trying to steamroller over the environment. Can you just give me a yes or no?
