May I thank my hon. Friend again for her powerful questions and her speech? I know how important this is to her. I reiterate that the Foreign Secretary announced a series of measures on 12 January in response to the human rights situation in Xinjiang. This will help to ensure that UK businesses are not complicit in human rights violations. We are leading international efforts to hold China to account, and of course I would be delighted to meet with Rahima, the Uyghur lady whom my hon. Friend referred to.

Importantly, we will continue to work on this incredibly crucial issue alongside our international partners, pulling together, including making the statement that we did late last year alongside Germany and 38 other countries. We will work with the new US Administration, under President Biden. May I thank my hon. Friend again for bringing this incredibly powerful testimony to the House? Anybody who has seen the report by the BBC—I congratulate the BBC on producing it—cannot help but be moved and distressed by what are clearly evil acts.

The Chinese Government’s brutal campaign of oppression in Xinjiang is a scar on the conscience of the world. The Labour party stands shoulder to shoulder with the Uyghur people. We already know about the forced labour camps, and yesterday we heard utterly heartbreaking testimonies from Uyghur women who have been systematically raped, sexually abused and tortured. This follows last summer’s harrowing accounts from Uyghur women who are victims of forced sterilisation and forced intrauterine device insertion. The Chinese Government’s own statistics show that birth rates in Xinjiang fell by a third in 2017-18—further evidence that what is happening may meet the international legal definition of genocide, which the new US Administration have already acknowledged.

Last month the Foreign Secretary rightly condemned the events in Xinjiang as

“barbarism we had hoped was lost to another era”—[Official Report, 12 January 2021; Vol. 687, c. 160.]

Surely the time for tangible action has now come. First, where on earth are the Magnitsky sanctions that the Opposition and Members across the House have been calling for since last June? The Foreign Secretary said that the body of evidence in Xinjiang is “large, diverse and growing”, and we know the names of the senior Chinese officials who are responsible for these atrocities. The US sanctioned them last summer. Who in Government is holding this up?

Secondly, 20% of the world’s cotton comes from Xinjiang. We welcome the steps that the Government have taken to help UK business cease being complicit in forced labour, but they did not go far enough. Companies must be accountable, not simply transparent. Rather than tinkering around the edges of the Modern Slavery Act, will the Minister commit himself to bringing forward legislation that moves us to a system of mandatory due diligence?

Next Tuesday, when the Trade Bill returns, the House has the chance to send a united message to the world that genocide can never be met with indifference, impunity or inaction. This should not be a partisan issue. Given that it is a long-standing Government commitment that courts, not the Government, must rule on genocide, will the Minister join with us and colleagues across the House to give UK courts the powers to determine genocide and therefore prevent the UK from ever doing trade deals with genocidal states?

I thank the hon. Gentleman for his questions, which raised a number of issues. He mentioned the US announcement regarding genocide. It is worth pointing out that the US has a different process for determining genocide that is not linked to a court decision. With regard to sanctions, we have had targeted measures in response to this matter. On 12 January, the Foreign Secretary announced a series of robust actions to ensure that no companies profit from forced labour and we will target in a forensic way those companies that are doing so, whether deliberately or otherwise. Of course, we are carefully considering any further designations under our global human rights regime. We keep all evidence and potential listings under review.

I thank the Minister for advance sight of his statement.

The Labour party will always speak up for universal rights and freedoms, the rule of law and democracy across the world, including in Myanmar. We know that democracy is in retreat around the world, and for the first time since 2001, democratic Governments are outnumbered by authoritarian regimes. What took place in Myanmar yesterday and over the weekend serves to remind us of the daunting scale and nature of the challenge we face. This military coup is a flagrant breach of the constitution of Myanmar, and must be condemned in the strongest terms. The army’s claims of voter fraud are utterly spurious. This is a naked power grab.

While Aung San Suu Kyi’s failure to stand up for the human rights of the Rohingya people has been deeply troubling, the fact is that her party secured a landslide victory in the November elections, and Myanmar’s young democracy must be respected and protected. Let us not forget the human cost of this coup: many brave elected representatives and activists were rounded up in the dead of night, their families terrified by the men in uniform on the doorstep. Now they languish in prison cells.

How has it come to this? Well, for decades, the power-hungry Myanmar military has oppressed and persecuted the Burmese people, committing countless atrocities—most notably against the Rohingya, for which it currently stands accused of genocide in the International Court of Justice. Experts on Myanmar are clear that the tacit support of China, combined with the rest of the world turning a blind eye, has given the military the confidence to enact this coup, based on the assumption that the international backlash will be negligible and lethargic. The UK and the wider international community must act swiftly and effectively to prove the military wrong on this. The UK Government must move from warm words of condemnation to tangible action. As the penholder on Myanmar at the Security Council, the UK has a particular and unique responsibility to lead the international response. We welcome the Security Council session the Government have convened today, but we believe there are further steps that must be taken.

First, the Government must lead by example by imposing sanctions on the Myanmar military and all its business interests. When I urged the Minister to take this action last year, he argued against such measures on the ground that it would have a negative impact on foreign investment into the Myanmar economy. Well, there is nothing like a military coup to damage foreign investment, so surely the Minister must now accept that his argument no longer stands up to scrutiny and that the Government must immediately impose sanctions that directly target the military and its financial backers. We on the Opposition Benches strongly support the Magnitsky sanctions against individuals in Myanmar, but let us be clear that they are designed predominantly for countries where senior officials have economic interests in the UK, such as Russia and China, and this is not the case for Myanmar.

Secondly, the UK Government should seek to extend the arms embargo against Myanmar so that it is as close as possible to global in its scale and scope. Clearly, authoritarian regimes such as Russia and China will be unlikely to participate, but we must seek to build the broadest possible coalition of countries committed to not selling weapons to Myanmar.

Thirdly, now must surely be the time for the Minister to commit the UK to joining the Netherlands and Canada in formally supporting the Gambia in its case of genocide brought against Myanmar at the ICJ. Will he also call for Myanmar’s first report to the ICJ, published last June, to be made public in order to shine a light on the atrocities committed by the military? I would also like the Minister to set out what conversations he has had with the Bangladeshi Government to ensure that humanitarian aid contributed by the UK is sufficiently reaching the Rohingya who have fled to Cox’s Bazar.

Finally, what consular support are the UK Government offering to UK citizens who are in Myanmar and caught in the middle of this appalling military coup?

I respect the Minister, and I know that his heart is in the right place on this issue, but I have to say to him that this statement falls far short of what we need and what we expect—nothing on sanctions, nothing on the ICJ. The people of Myanmar need a stronger response, and they need it now.

I thank the hon. Gentleman for the tone of his response, and also for welcoming the international engagement, in particular at the UN Security Council. As he rightly remarks, as penholder, we have brought forward by a day a meeting on Myanmar at the Council as a matter of urgency, and that meeting will take place in New York this afternoon.

The hon. Gentleman mentioned sanctions on the military. I politely point out to him that we have already imposed sanctions on 16 individuals responsible for human rights violations in Myanmar, including six individuals named by the UN fact-finding mission report. However, of course we will work closely with our international partners to consider next steps in that regard and we will constantly consider all the tools at our disposal.

The hon. Gentleman asked whether we would support an international arms embargo. We are a long-standing supporter of an arms embargo in Myanmar. We worked with EU partners to secure and tighten a strong EU arms embargo following the 2017 Rohingya crisis. Since we left the EU, we have transitioned this into domestic law. Our autonomous sanctions regulations prohibit the provision of military-related services, including the provision of technical assistance, to or for the benefit of the Tatmadaw.

The hon. Gentleman mentioned the case brought by the Gambia. We have been very clear in our support for the ICJ process, which is putting pressure on Myanmar, and particularly the military, to do more to protect the Rohingya. We have pressed the civilian Government to engage constructively and transparently, and we urge the military to comply with the provisional measures ruling.

The hon. Gentleman mentioned Bangladesh. We are working very closely with the Bangladesh authorities and we are speaking with the Bangladesh Government. We are the second largest donor to support the Rohingya who are currently in Bangladesh.

We are following the advice very carefully of our post in Yangon on the situation involving UK nationals. We will continue to update British nationals in that regard. They are advised to stay at home, to make only essential journeys and to continue to check travel advice and embassy social media pages. I have spoken with our ambassador on a couple of occasions over the last 24 hours, and we continue to closely monitor the situation.

We on the Opposition Benches believe that the Government’s foreign policy should be rooted in our country’s commitment to human rights and the rule of law. Therefore, we deeply regret that in February 2020 the Sri Lankan Government withdrew from their Human Rights Council obligations to promote reconciliation and accountability following the country’s devastating civil war. More recently, the Sri Lankan Government have introduced forced cremation for covid-19 victims, a policy that has absolutely no basis in science, rides roughshod over the traditional practices of Sri Lankan religious minorities and has rightly caused hurt and outrage among Muslim and Christian communities across the UK. So I ask the Minister: what steps has he taken to persuade the Sri Lankan Government to end forced cremations, what work is he doing with international partners ahead of the next Human Rights Council session in March to ensure that the Sri Lankan Government re-engages with the peace, reconciliation and accountability process, and what discussions has he had about human rights in the context of UK-Sri Lankan trade deal negotiations?

I thank the hon. Gentleman for his question and he is right to raise it. We have shared guidance and scientific background with the Government of Sri Lanka on how the UK has ensured that burials can continue to operate in a safe format within the World Health Organisation guidelines. We also discussed, via my colleague Lord Ahmad, the importance of minority rights with the Sri Lankan Foreign Minister in November. Our high commissioner to Sri Lanka has raised forced cremation several times with the Sri Lankans—most recently, just over a week ago. We continue to speak with Sri Lanka, and have done so within the last week, and with Geneva regarding its commitment to upholding this resolution. We are certainly committed to it, and we will continue that dialogue.

It is a pleasure to serve under your chairmanship, Mr Davies. I congratulate my hon. Friend the Member for Luton North (Sarah Owen) on securing this vital debate. She made a powerful speech that painted a harrowing picture of the plight of the Kashmiri people and the human rights crisis that they are facing. I also thank the other contributors to the debate, who made a number of compelling points— not least my hon. Friend the Member for Brent North (Barry Gardiner), my right hon. Friend the Member for Warley (John Spellar) and my hon. Friend the Member for Bradford West (Naz Shah).

The Labour party’s new foreign policy puts the rule of law, democracy and human rights at the very heart of our global agenda, and we of course apply those principles to Jammu and Kashmir, as we do consistently to every other part of the world. The situation in Kashmir is defined tragically by a long history of political and military conflict. In 1947, the British state was a signatory, as the departing colonial power, to the instrument of accession, which gave Kashmir a high degree of autonomy, while granting India control over Kashmir’s communications, defence and foreign affairs.

Countless attempts have been made to resolve the Kashmir issue through UN resolutions and by other means. Perhaps the most significant was the Simla agreement, which was concluded following the Indo-Pakistan war of 1971. The Labour party strongly supports the conclusions of the Simla agreement and agrees that issues involving India, Pakistan and Jammu and Kashmir should be negotiated between the parties, and that no state should deploy force or act unilaterally. We also recognise that the UK has a particular responsibility to do all it can to help secure a peaceful resolution to the conflict.

If we fast forward 50 years from Simla, we see that the situation on the ground in Kashmir is bleak. At 72 years, the conflict is the longest unresolved conflict on the agenda of the United Nations. Some accounts claim that as many as 95,000 have been killed in the past 30 years alone. Kashmir is the most militarised place on earth. Moreover, it has become a political football in almost a great game, a great power competition between India, China and Pakistan, all of which have nuclear capability. This is a very dangerous game to be playing.

On 5 August 2019, the Indian Government’s Jammu and Kashmir Reorganisation Bill unilaterally revoked article 370 and replaced the autonomous state of Jammu and Kashmir with two new union territories governed directly by New Delhi: Jammu and Kashmir, and Ladakh. Further to that intervention, Jammu and Kashmir has been in an Indian army-imposed lockdown, with the Indian Government citing security risks and the need to prevent violence. The lockdown, along with a communications blackout and an internet ban, has had a profound and far-reaching impact on every aspect of life in Kashmir, including health services, school closures and media freedom. The Indian Government maintain that their decision to unilaterally revoke article 370, and the ensuing lockdown, is an internal matter, as such actions do not interfere with the boundaries of the territory or the line of control. India also cites security concerns, based on attacks by what New Delhi believes to be Pakistan-backed militant groups. Indeed, we recall with sadness the tragic suicide-bomb attack on 14 February 2019, which targeted Indian soldiers in Kashmir.

Meanwhile, the Labour party recognises that those who are opposed to the revocation of article 370 and the subsequent lockdown are understandably angered by what they see as a unilateral act of aggression on the part of the Indian Government. I assure hon. Members that the Labour party will always speak up vociferously in defence of the human rights of the people of Kashmir. We also recognise the hardship faced by those living in Pakistan-administered Azad Kashmir, where the Azad Jammu and Kashmir Elections Act 2020 clearly contravened universal freedoms of expression, association and peaceful assembly.

In a letter to the Muslim Council of Britain on 8 May, my right hon. Friend the Leader of the Opposition made clear that all sides must play their part in ending the conflict, which has gone on for far too long. He said that

“the Labour party will always uphold and respect international law and will always stand up for human rights and for the rule of law.

Our position on Kashmir has not changed, we support and recognise previous UN resolutions on the rights of the Kashmiri people but maintain that if we are to find a lasting settlement, to end this ongoing conflict, that can only be achieved”

“India and Pakistan working together, with the people of Kashmir.”

What can the UK Government do to support the peaceful resolution of this conflict and defend and uphold the human rights of the people of Jammu and Kashmir? Well, let me ask the Minister a few questions. Will he impress on his Indian and Pakistani counterparts the need for a plan to demilitarise the larger Kashmir region, and ask what steps the Indian Government are taking to uphold human rights in Jammu and Kashmir, particularly in the light of the events of 5 August 2019? That conversation must include the rights of political prisoners.

What meetings has the Minister had with human rights organisations about the situation in Jammu and Kashmir? Does the Minister give support to the International People’s Tribunal on Human Rights and Justice in Kashmir, which seeks to address the human rights situation in Kashmir following the events of 5 August 2019? Does the Minister have any plans to send his own UK delegation to Jammu and Kashmir to assess the human rights situation and report back to our Parliament? Finally, will the UK Government commit to doing all they can to support and work with, wherever helpful and necessary, representatives from India, Pakistan and Jammu and Kashmir, including all five regions, to deliver justice, peace and resolution to that terrible conflict. I look forward to the Minister’s response.

It is a pleasure to serve under your chairmanship, Mr Robertson. I would like to start by congratulating the hon. Member for Strangford (Jim Shannon), who I thought gave a passionate account of his views on this matter, along with other Members who secured this debate, including the hon. Members for Glasgow East (David Linden) and for East Londonderry (Mr Campbell). I would like to thank hon. Members on these Benches for their contributions. I thought my right hon. Friend the Member for East Ham (Stephen Timms) gave a particularly compelling and balanced account of the issues we are facing. Other contributors, not least my hon. Friends the Members for Bradford West (Naz Shah) and for Brent North (Barry Gardiner), made a number of very important points.

I want to stress that those on the Labour Front Bench stand firmly behind the rights of minorities to religious freedom, both in India and across the world. The Labour party’s new foreign policy puts the rule of law, democracy and human rights at the very heart of our agenda, and we are absolutely clear that religious freedom is a critical right that must be universally upheld. However, the wider picture is that, according to recent research by the V-Dem Institute, for the first time since 2001 authoritarian regimes outnumber the world’s democracies, and the number of such regimes is growing. That is why it is essential for democracies, of which India is of course the world’s largest, to stand firm together in defence of universal human rights. We must lead by example in standing up for freedom of expression and freedom of religion. They are the cornerstones of the values that we in the United Kingdom, and particularly the Labour party, hold dear. They should be the values that democrats across the world cherish.

We have consistently stood up for religious freedoms throughout Asia. We have called on the UK Government to take action against the Chinese Government for their persecution of Uyghur Muslims in Xinjiang by deploying Magnitsky sanctions against senior officials. We also consistently urge Ministers to defend the rights of minorities in Sri Lanka, and to act far more robustly on to the appalling treatment of the Rohingya people in Myanmar.

The Labour party has stood up for human rights in India, including by standing by Amnesty International in India, which was recently forced to discontinue its operations due to what it described as “persistent harassment” by the Indian Government. I also recently expressed our strong belief that the farmers protesting in India must have the right to peaceful protest, and that the Indian authorities must commit to upholding that right. Again, UK Ministers should be engaging far more actively and effectively with their counterparts in New Delhi to convey that message clearly.

The religious rights of minority groups in India are a hugely important issue. In the three years to June 2019, India’s national human rights commission registered 2,008 cases of minorities being harassed. Every one of those events is heartbreaking for those affected, who in some instances lost their lives, for their families and for all of us who wish to see India thrive as a nation.

Religious minorities constitute one fifth of India’s population. Articles 29 and 30 of the constitution protect the rights of those communities, including the right to use their own language and to form their own educational institutions. Article 15 prohibits discrimination on the grounds of religion, caste, sex or place of birth. In spite of those constitutional protections, however, in late 2019, the Indian Government’s Citizenship (Amendment) Act caused concern because it failed to state that it would offer a path to fast-track citizenship for Muslim immigrants, while explicitly committing to fast-tracking Hindus, Parsis, Jains, Buddhists, Sikhs and Christians from Bangladesh, Pakistan and Afghanistan.

More recently, in late February 2020, New Delhi experienced terrible communal violence. The initial attacks were predominantly by members of the majority Hindu population against Muslim minority groups. The death toll reached 53. The majority of those who died were Muslims, but many Hindus also lost their lives and parts of north-east Delhi were put under lockdown. Every section of the population is profoundly damaged by such violence and strife.

Later in 2020, the persecution of Muslims continued as they were blamed for the spread of covid-19, as many hon. Members have mentioned. Hon. Members have also eloquently pointed out that Christians have suffered some persecution. According to Persecution Relief, between January 2016 and January 2020, there were 2,067 crimes inspired by religious intolerance against Christians in India.

India is the world’s largest democracy. As such, it can and should take its place as a leader in global affairs and a shaper of the global agenda. It is also a hugely diverse rainbow nation. As such, it has an opportunity to be one of the world’s most successful multi-ethnic, multi-faith and multicultural societies. The vast majority of the Indian population, whatever their ethnicity or religion, are rightly proud of their country’s vibrant diversity and are committed to the principles of religious freedom that are important in any healthy democracy. The Indian Government have, of course, made some effort to support minorities through their multi-sector development programme, with the majority of the spend going on education. We are confident that those interventions will yield positive results.

In the light of the above, we call on Ministers to engage actively with their counterparts in New Delhi; to set out the role of the new special envoy on freedom of religion and belief, the hon. Member for Congleton (Fiona Bruce), and what she will do to encourage tolerance and inclusion; to explain the Government’s plan to compensate for the abolition of the Department for International Development, which did some outstanding work promoting religious freedoms across the globe; and to explain the decision to renege on the Government’s manifesto commitment to spend 0.7% of GDP on development. Can the Minister tell us which DFID programmes for freedom of religion and belief will survive these swingeing cuts?

It is vital that the Government take a serious and strategic approach to defending religious freedoms, and we look forward to the Minister’s answers on these vital issues.

I thank the Chair of the Select Committee on Foreign Affairs for his question and for his ongoing leadership on this particular issue. Trade with China is absolutely pivotal and crucial to the UK. Figures over the last six months show that China is only one of two countries where our exports have actually grown over a very difficult period. We have a high level of ambition for our trade partnership. We want to work with it to increase trade, but as we strive for that positive relationship we will not sacrifice our values or our security. We are very clear-sighted about the challenges. As we continue to engage, we will always protect our national interests. Absolutely and imperatively, as the Foreign Secretary has said at this Dispatch Box on many occasions, we will continue to hold China to its international commitments and its promises.

This assault on democracy represents not only a clear breach of the Basic Law and the joint declaration; it also confirms that the Chinese Government and the Hong Kong Executive are committed to the removal of dissenting voices from the democratic process, and to the repression of the rights of the people of Hong Kong. The Labour party stands in solidarity with the four pro-democracy representatives who have been removed from the Legislative Council, and with the 15 additional Opposition Members who have resigned in protest. Their departure leaves Hong Kong without an Opposition in the legislature, removing one of the vital checks on the Hong Kong Executive and effectively denying the people of Hong Kong the right to choose their own representatives.

The UK Opposition welcomed the Government’s recent announcement regarding BNO passport holders, but it would be unacceptable for the UK Government now to conclude that they have done all they can for the people of Hong Kong. With that in mind, I ask the Minister the following questions.

First, does the Minister agree that the British Government are legally obliged, through the joint declaration, to defend human rights in Hong Kong, and that failure to do so, to the utmost of their abilities, would put the UK in default of its treaty obligations? Secondly, when will we see details of what the UK Government are offering by way of support to Hongkongers born after 1997? Thirdly, will senior Hong Kong Executive officials now be added to the Magnitsky list? The Minister has been asked this question many times and he has consistently declined to give a definitive answer. Who in Government is holding this up? Fourthly, the Foreign Secretary has rightly condemned the likes of HSBC and Standard Chartered bank for their stance on Hong Kong, but could the Minister please update the House on what action, if any, has actually been taken against those two banks?

I thank the Opposition spokesman for his questions. On sanctions, he will be fully aware that it is not appropriate to speculate on who exactly will come under the radar of our new sanctions regime. We are considering further designations constantly. In terms of HSBC and Standard Chartered in Hong Kong, I have had previous conversations with HSBC, and I am very happy to have more. I am also more than happy to write to the hon. Gentleman on that particular issue.

As I said to the Liberal Democrat spokesman, the hon. Member for Oxford West and Abingdon (Layla Moran), our door is always open. Our offer to British nationals overseas of a pathway to UK citizenship is compelling and compassionate, and as I said in my previous answer, the youth mobility scheme is open to people in Hong Kong aged between 18 and 30. I am more than happy to flesh this out with the hon. Member for Aberavon (Stephen Kinnock) when he is next in the Chamber or in London.

Thank you, Mr Hollobone. I thank the Minister for the diligent way in which he is dealing with this matter.

We support the regulations. It is vital that the Government take a tough line on terrorism and use all the instruments at their disposal to limit the ability of terrorists to operate. That includes sanctioning individuals and prohibiting certain activities, such as those that have been laid out today.

To that end, we are satisfied that, as the Minister has explained, the regulations will aid the investigation and prevention of terrorist financing, prevent designated persons acting as charity trustees and managing or operating sensitive financial enterprises, and enable the effective implementation of legal, operational and regulatory measures for combating terrorist financing. We recognise the need for those new provisions, as they ensure that our legislation will be effective once the transition period comes to an end.

Having said that, for sanctions to be effective and robust they should not operate in isolation, and should instead be applied in close co-ordination with our democratic allies and partners, not least the European Union. What conversations is the Minister having, and what mechanisms are being put in place, to ensure that the UK is working hand in hand with the EU to apply the co-ordinated approach to sanctions that we know makes them so much more effective? There is little hope of the sanctions working effectively unless liberal democracies —particularly our EU partners and us—work together effectively to apply pressure.

What additional work is the Minister doing to strengthen the UK’s sanctions regime? The Opposition are very pleased that the Government have finally implemented the so-called Magnitsky sanctions against many human rights abusers, but we have two concerns. First, the legislation does not include corruption. Foreign Office Ministers say that they are looking into including corruption in the scope of the legislation, but could the Minister provide an update on when we might expect an answer on whether it can be included?

Secondly, the sanctions do not appear to be applied across the board. It took the Government just a matter of days to sanction Belarusian officials following the rigged elections and crackdown that ensued, but we have yet to see any Chinese Communist party officials on the sanctions list, despite clear and apparent human rights violations in Xinjiang and Hong Kong. The Government have stated that they are looking into that, but could the Minister provide an update?

We are content for the the terrorist financing definition to be brought up to date. As a Minister recently put it, that allows the Government,

“under Section 49 of the sanctions Act to facilitate the prevention, detection or investigation of terrorist financing, following the revocation of a number of the current offences by the 2019 regulations.”—[Official Report, House of Lords, 29 October 2020; Vol. 807, c. 402.]

However, why did the revocation of these offences occur, and why was everything that we are going through not dealt with in the 2019 legislation the first time around? I thank the Minister for his time, and I look forward to future dialogue on these important issues.

I thank my hon. Friend for raising that. As he will know, on 6 July we established our global human rights Magnitsky sanctions regime, and it is under constant review. However, he will be aware that it is not appropriate to speculate on who may be designated under any future sanctions regime, because to do so would reduce the impact of those designations.

Successive Conservative Governments since 2010 have been naive and complacent in their dealings with the Chinese Government. The resulting combination of over-dependence on China-based supply chains and the breaking of important international alliances has diminished our ability to exert influence on Beijing. Yet, despite these failings, there is clearly more that the UK could be doing for the people of Hong Kong. Will the Minister specify what the Government plan to do regarding citizenship for Hongkongers born after 1997? What consular support can he provide to the four BNO passport holders who are now detained in mainland China after attempting to flee? Will he commit to sanctioning the senior mainland Chinese Communist party and Hong Kong Executive officials who have been committing human rights abuses? It took the Government just days to sanction Belarusian officials. What, or who, is causing this delay?

We are working closely with the Home Office on our response for the BNOs, and there will be much more detail coming out in due course.

With regard to the cases that the hon. Member raises, we have raised the cases of the people detained in Shenzhen with the Chinese authorities in Hong Kong, and we have made it clear that due process should be followed. The rights and freedoms of people in Hong Kong, including their rights to freedom of speech and assembly, are expressly guaranteed in the joint declaration, and rights committed to under the declaration must be upheld. Under the memoranda to the joint declaration, BNOs are entitled to consular assistance in third countries, but not in Hong Kong, Macau or mainland China. The Chinese authorities do not recognise dual nationality, and absolutely would not grant UK consular access for those individuals. On sanctions, I refer the hon. Member to the answer I gave to my hon. Friend the Member for Romford (Andrew Rosindell).

It is a pleasure to serve under your chairmanship, Mr Gray. I thank the Petitions Committee for securing this vital debate. I thank my hon. Friend the Member for Islwyn (Chris Evans) for making such a powerful and passionate speech to introduce the debate, and my hon. Friends the Members for Birmingham, Ladywood (Shabana Mahmood), for Bradford West (Naz Shah), for Mitcham and Morden (Siobhain McDonagh), and for Bethnal Green and Bow (Rushanara Ali), who made compelling contributions, both passionate and forensic. Members across the House have shown today that there is no doubt about the strength of feeling in Parliament.

The plight of the Uyghur people is a scar on the conscience of the world—of that there can be no doubt—and the fact that the Chinese Government continue to act with impunity leaves us all with a sense of burning injustice. It is vital and urgent that the international community comes together to speak with one voice, and to say loud and clear to Beijing, “We will not stand idly by while Uyghur people are imprisoned in these so-called re-education camps. We will not look the other way in response to reports of the forced sterilisation of Uyghur women. We will not react with indifference to any efforts to destroy the Uyghur language, culture and way of life.”

It is equally vital and urgent that the UK Government take a leadership role in convening and co-ordinating the international response. Our greatness as a country is based on our resolute and unshakeable commitment to human rights and the rule of law. The British people know that if our country is to be a force for good in the world, those values must be applied universally. Regrettably, attempts to show leadership on this issue are handicapped by the fact that, for several years now, the approach of successive Conservative Governments to China has been naive and complacent.

In 2015, David Cameron and George Osborne announced a new golden era in Sino-British relations. The premise was simple. The UK would open its markets and infrastructure to China and in return Beijing would reciprocate, while integrating with the rules-based international order.

Fast forward five years and where do we stand? We are still running a £19 billion trade deficit with China, and the Chinese Government have dealt a hammer blow to democracy in Hong Kong, committed egregious human rights abuses in Xinjiang and Tibet, and stepped up their military activities in the South China sea. The fact of the matter is that the golden era strategy has been an unmitigated failure. Successive Conservative Governments have rolled out the red carpet for Beijing in the hope of reciprocity and constructive engagement, but the past five years have seen the emergence of a China that increasingly pursues policies that undermine international norms and violate what should be international and universal values.

We have deep respect for China’s history, culture and civilisation, and we fully acknowledge and recognise its great power status. The relationship between the peoples of the UK and China is deep, of long standing and valued by both. There is a pressing need to improve mutual understanding and friendly co-operation, but the Chinese leadership must understand that their breaching of international law and violation of human rights benefits no one, least of all themselves. China is deeply integrated into the global economy, and it needs globalisation to work for its people, just as much as we do. But if it continues to pursue zero-sum policies that place dominance ahead of consensus and crushing one’s critics ahead of compromise, the international community will have no choice but to toughen its stance by exerting further political, diplomatic and economic pressure on Beijing.

Against that backdrop, we call on the UK Government to commit to a fundamental strategic reset in Sino-British relations. We must seek constructive engagement based on mutual respect, but respect is a two-way street. The leadership of the Communist party of China respects strength and unity, and it is contemptuous of weakness and division. We must find ways to co-operate with the Chinese Government on crucial global issues such as climate change and pandemics, while also challenging them when they undermine international law.

To achieve that, the following needs to happen. First, we must rebuild our strategic independence. Successive Conservative Governments have left our country over-reliant on supply chains that originate in China and open to hostile takeovers by Chinese state-backed enterprises and investment vehicles. The UK is now dependent on China for 57 categories of goods that relate to our critical national infrastructure. This over-reliance on China dramatically diminishes our ability to stand up for our interests and project our values. There needs to be a far more joined-up approach across Whitehall on these issues.

Secondly, the UK Government need to build an alliance of democracies to champion co-operation based on shared values and promoting human rights. Successive Conservative Governments since 2016 have shown that they are adept at burning bridges. This Government must now show that they know how to rebuild trust with our European allies while engaging more effectively with democratic governments, particularly in the Indo-Pacific region.

I turn to the mass atrocities that are taking place in Xinjiang. We urge the Government to take the following actions. First, it is imperative that the UN High Commissioner for Human Rights is given full and unfettered access to Xinjiang and the Uyghur people who are being detained there, so that the true scale and nature of the crimes can be established and documented. For that to be possible, far more intense and co-ordinated pressure must be applied, and we therefore urge the UK Government to publicly oppose China’s election to the UN Human Rights Council in the forthcoming elections, and to hold firm to that position until such time as Beijing provides the High Commissioner with access to Xinjiang.

Secondly, the Government must deploy Magnitsky sanctions against senior CCP officials who are responsible for human rights abuses in Xinjiang. The Minister will say that that is under review and should not be rushed but, frankly, that is not good enough. MPs have been expressing concerns about the plight of the Uyghur since 2017, and the Magnitsky legislation was passed in 2018. I therefore encourage the Minister to provide some clarity: what is the real cause of this mysterious delay, and can the Opposition be of any assistance in removing the roadblock, whatever it is, so that the Government can get on with taking long-overdue action?

Thirdly, the Government should explore additional legal avenues for challenging what is happening in Xinjiang, including an assessment of whether China’s actions constitute a violation of the 1984 convention against torture and other cruel, inhuman or degrading treatment or punishment, to which China is a state party. The Government must consider infringement procedures if such a determination is made.

Fourthly, the Government must publicly support the UN International Law Commission’s draft convention on the prevention and punishment of crimes against humanity, which would close an important gap in international law.

Fifthly, as many hon. Members have raised today, the Government must mobilise action across Whitehall to ensure that British businesses conduct thorough due diligence of supply chains, such that British companies withdraw without delay from any and all supply chains that potentially involve forced labour or other human rights abuses. I trust that the Minister will give careful consideration to those recommendations, in terms of both the fundamental reset that is required, and the specific issues with Xinjiang province.

It is a pleasure to serve under your chairmanship, Mr Hollobone.

I pay tribute to the right hon. Member for Chingford and Woodford Green (Sir Iain Duncan Smith), who gave a powerful speech listing the issues with the behaviour of the Chinese Communist party, whether in Hong Kong, the Himalayas or the South China sea. That set the stage for what has been an excellent debate.

I also pay tribute to my hon. Friend the Member for Bristol East (Kerry McCarthy), who gave a powerful critique of the human rights action plan. She demonstrated that our values are not for sale and that, when it comes to the constant debate on whether to prioritise trade or human rights, there should be no debate at all, because the priority is to stand up for our values and for human rights. As the right hon. Member for Orkney and Shetland (Mr Carmichael) rightly put it, if human rights do not matter in Tibet, in Xinjiang or in other parts of the world, they end up not mattering here either. This is a universal issue that affects all of us. The hon. Member for Bath (Wera Hobhouse) made that point very clearly with regard to the ethnic and cultural survival of ways of life and diversity across China.

The hon. Member for East Worthing and Shoreham (Tim Loughton) has done so much work on the issue of Tibet and has been a leading voice on it for so long. He set out some very tangible and clear recommendations for what we need to do to address these issues. The hon. Member for Congleton (Fiona Bruce) did likewise. Indeed, there were so many other contributions today that unfortunately I do not have enough time to go through them all in detail.

I will say a few words about where my party sits on this issue. It is absolutely clear that we are profoundly concerned by the human rights abuses in Xinjiang against the Uyghur Muslims. We have called repeatedly on the Government to take action and we are deeply troubled to hear that similar abuses of human rights are taking place in Tibet.

The research sets out some very disturbing statistics, including the half a million labourers over the first seven months of 2020. There is strict, military-style management and enforced indoctrination and intrusive surveillance of participants. It is clear that the programme’s aim is to reform Tibetans’ so-called cultural backwardness, through teaching Mandarin, and by weakening the way of life and the religious practices of the Tibetan people.

Before I appeal to the Minister with some specific recommendations, I will say a few words on the wider context of the policies and activities of the Chinese Government. It is becoming increasingly clear that our interaction as a United Kingdom, and the interaction and engagement of the United Kingdom Government—indeed, of successive Governments since 2010—has been characterised, I am afraid to say, by naivety and complacency, both domestically and abroad. Of course, in 2015 David Cameron and George Osborne announced the so-called golden era of Sino-British relations, based on the premise that we would open our markets to China and that the Chinese Government would reciprocate while gradually aligning with the international rules-based order and opening up to trade with the rest of the world. That approach viewed the UK’s relationship with China purely through an economic lens, turning a blind eye to human rights abuses in exchange for the naive and narrow promise of future economic benefit.

The reality is that the benefits of trade have remained largely unbalanced, a process actively encouraged by the Chinese state, which has facilitated the replication of intellectual property and the dumping of heavily subsidised products on European markets, leaving UK firms open to hostile takeovers and driving the UK to a trade deficit with China of around £20 billion a year. Further still, the UK now has 229 supply chains dependent on China, 59 of which relate to our critical national infrastructure.

Moreover, we are increasingly isolated on the global stage. Over the past decade, I am afraid we have gained a global reputation for being alliance breakers, when one of the great strengths of our country has traditionally been our role as alliance makers. The UK’s relative isolation has made it easier for President Xi to press ahead with the imposition of national security legislation in Hong Kong, which has been met with international condemnation; the persecution of the Uyghur and Tibetan minorities; and destabilising actions in the South China Sea, which are a violation of international law. To summarise, our supply chain dependence on China clearly constrains our ability to stand up for our national interest and national security, while this Government’s approach to international relations has hindered our ability to convene and lead an alliance of democracies, to stand up for our values and interests.

The golden era strategy was an unmitigated failure. Britain alone—an agenda that the current Government appear to be pursuing—is not a strategy at all. It is a recipe for disaster. China respects strength, unity and consistency, but we are in a position where we are starting to look weak, divided and inconsistent, and that has to change. We need a fundamental reset in Sino-British relations and, indeed, in relations between China and the rest of the world.

It is against that backdrop that we debate Tibet today. Our central message to the Government is that expressions of outrage are not sufficient. Tangible action is required and we recommend three initial responses. First, the scope of legislation that underpins the so-called Magnitsky sanctions must be broadened. The senior Chinese Communist party and Hong Kong Executive officials, who are clearly responsible for breaches of human rights in Xinjiang, Tibet and Hong Kong, must be added to the list. The rapidity of the Government’s recent decision to add senior Belarusian officials to the Magnitsky list was very welcome. Why, then, are they dragging their feet when it comes to Chinese Government officials?

Secondly, we urge the UK Government to revise their risk advisory for British companies that source goods and services from areas that may involve Tibetan forced labour. The vast majority of British companies want to do the right thing. They want to behave ethically, and the Government must act to support them in doing so.

Thirdly, we support calls for the UK Government to push for the appointment of a UN special rapporteur for the full and transparent investigation of forced labour and ethnic persecution in Xinjiang and Tibet. The issue of genocide has been raised, but in order for that to be classified as genocide, very clear and compelling proof and evidence are required. The way to get that is through international action to get that special rapporteur; otherwise, we cannot move forward with the debate on genocide.

I trust that the Minister has taken note of the strong views expressed by right hon. and hon. Members from across the House. I look forward to his response to the specific points and recommendations.
