The Secretary of State has regular discussions with Cabinet colleagues and has discussed EU exit with the Secretary of State for Scotland on a number of occasions, including at the Joint Ministerial Committee on EU negotiations, the most recent meeting of which was on 19 December. We also regularly engage with the Scottish Government, including through the Ministerial Forum on EU negotiations, and I look forward to attending the next meeting of that in Edinburgh next week.

I thank the Minister for his response. Thousands of jobs in my constituency and beyond rely on programmes such as Horizon 2020 and Erasmus and the freedom of movement on which universities depend. Given the short timescales, what reassurance can he give to universities that those programmes will continue and that we can fully participate in them?

The hon. Gentleman makes an excellent point. I have met a number of the Scottish universities to discuss that issue. It is right that universities in Scotland and across the UK are at the forefront of programmes such as Horizon 2020, which is why we have negotiated a deal that specifically envisages participation in them. We have had a positive reaction from the European Union to that. Of course, we need to secure the deal in order to secure the next round of talks and ensure we can take that forward. In the meantime, the Government have guaranteed Horizon funding until the end of the current multi-annual financial framework.

I am glad that the Minister is nodding. To charge EU nationals £65 a pop just to remain at home is outrageous and shameful, and it should shame the rest of us.

We should also think about the fact that our universities rely on initiatives such as Horizon 2020 and that our farmers rely on seasonal workers. I benefited from the Erasmus programme, but young people might not do so in future. Winnie Ewing, a former SNP MEP, was key to the success of bringing in Erasmus, working with members of other parties, including in other parts of Europe. I wanted to mention that so I can wish Winnie Ewing a happy 89th birthday—she was also a Member of this place.

One of the saddest things is that those of us who are in this place now will leave fewer opportunities for young people than we enjoyed. They will have fewer opportunities than we had when we started off in politics. We should all have at least an aspiration to leave more, but that is not the state that we are in at the moment. The Parliamentary Secretary, Cabinet Office, the hon. Member for Norwich North (Chloe Smith), who is not in her place at the moment, talked about trust in the Westminster Government. The recent social attitudes survey showed that, in Scotland, levels of trust in the Westminster Government are down at 20%. That means that only 20% of people in Scotland think that Westminster is working in their best interests, and is it any wonder that that trust is at such a low ebb? The figure for Holyrood sits at 61%, which is much higher than the figure for this Government.

For the future, there is a need to reach out to other parties and to the devolved Administrations. The Scottish Government set out a plan just after the referendum in a way that the UK Government have yet to do—we have been waiting years for any plans from the UK Government—to stay in the customs union and the single market. I pay tribute to the Liberal Democrats, Plaid Cymru and the Green party for joining us in that aspiration and that work. In fairness, some Labour Back Benchers have also had the aspiration to work towards that goal.

The UK is hopelessly divided at the moment. Scotland did not vote to leave the European Union. The Scottish Parliament has acknowledged, and this place acknowledged only last week, that according to the claim of right, Scotland should remain sovereign and make its own decisions in the future. I hope that the Minister will reflect on that claim of right when he winds up the debate. We are in this mess because of a Conservative civil war, but bringing an end to it cannot be done merely by seeking solutions within the Conservative party. It can be done only by reaching out before it is too late.

The British public had to wait 41 years from 1975 for another referendum on EU membership, and while we have heard today that some may hope another one comes along very shortly, they do not represent a majority either in this House or in the country.

We have heard some excellent speeches in this debate. My hon. Friend the Member for Berwickshire, Roxburgh and Selkirk (John Lamont) pointed out the ludicrous position whereby Lib Dems in Scotland are so clearly opposing a second indyref while arguing that a second referendum on EU exit is vital. He also spoke very well about the sea of opportunity for Scottish fishermen as we leave the commons fisheries policy.

We heard a brilliant, short and direct speech from my hon. Friend the Member for Mid Dorset and North Poole (Michael Tomlinson), and I agreed with every word that he said. My hon. Friend the Member for St Austell and Newquay (Steve Double) clearly set out why, by ignoring the views of the electorate, the Lib Dems lost the support of people in Cornwall, and how his constituents, like mine, want to see the Government getting on with the job. I also pay tribute to the hon. Member for Darlington (Jenny Chapman) for a strong and typically humorous speech from the Opposition Front Bench, and to the hon. Member for Stoke-on-Trent Central (Gareth Snell), who spoke against the motion.

The referendum question agreed by this Parliament and presented to the people was simply whether we should leave the EU or remain in it; it was as simple as that. Parliament attached no conditions or caveats to that vote. The people voted to leave, and that is what the Government are delivering. I would be the first to accept that we must do so in a way that brings people together whether they voted leave or remain and that secures the best interests of our economy, and that is exactly what this Conservative Government are seeking to do. We have heard a great deal of nostalgia from Lib Dem MPs for their time in government, but we do not need job applications from former Lib Dem Ministers in search of a ministerial car to enable us to deliver for the economy.

Some Members have suggested today that the Government have not made progress in negotiations with the EU, but I would contest that. The vast majority of the withdrawal agreement is now agreed and we remain on track to finalise its terms, alongside agreeing the framework for our future relationship, by October. I pay tribute to my right hon. Friend the Member for Haltemprice and Howden (Mr Davis) and my hon. Friend the Member for Wycombe (Mr Baker) for their work on that process. I noted the kind comments of the hon. Member for North East Fife (Stephen Gethins) about the courtesy with which he was always treated by my right hon. Friend, and I will give way to the hon. Gentleman now.

The Minister talks about reaching out. Can he tell the House one area this Government have changed because of an intervention from the Opposition Benches or from a devolved Administration that the Conservatives would not have taken on board otherwise?

We have listened very carefully to views across the whole House. I was interested to hear the hon. Gentleman and his hon. Friends speaking about Erasmus. As the Prime Minister set out in her Mansion House speech, we are seeking cultural and educational co-operation with the EU. That is an issue on which Members across the House can agree and, of course, there have been many other issues where we have listened. During the passage of the EU withdrawal Act, we listened to views across the House and engaged on those. I personally was very pleased that we were able to engage with the cross-party amendment in the Lords on the Good Friday agreement—the one supported by Labour’s Lord Murphy and my noble Friend Lord Patten.

In March we reached a significant milestone, reaching agreement on wide areas of the withdrawal agreement, locking down the full chapters on citizens’ rights and the financial settlement, and providing certainty to businesses and individuals, with both sides committing in principle to a time-limited implementation period. Last month, building on the progress made in March, the UK and EU negotiating teams made further significant progress towards finalising the withdrawal agreement, with the majority of text on other separation issues now agreed. These cover a range of areas, including arrangements for goods on the market, Euratom-related issues, and co-operation in civil and commercial matters. We have had constructive discussions with the EU on the few remaining issues in the text, including data, police and judicial co-operation in criminal matters, and governance arrangements for the agreement, and we look forward to finalising all these areas soon.

Under the terms of article 50, we are also in the process of negotiating the framework for our future relationship with the EU. Last weekend at Chequers, the Cabinet agreed the collective position on the UK’s proposals for that future relationship. This will create a free trade area between the UK and the EU which establishes a common rulebook for industrial goods. The hon. Member for Westmorland and Lonsdale (Tim Farron) spoke about the importance of that to food and agriculture. High standards will be maintained, but we will also ensure that no new changes take place without the approval of our Parliament. We will have a new business-friendly customs model, with freedom to strike new trade deals around the world. These proposals avoid frictions in trade, protect jobs and livelihoods and, crucially, meet the commitments made by both sides to avoid a hard border in Northern Ireland. Even the right hon. Member for Twickenham (Sir Vince Cable), in opening the debate, recognised that as an advance, but it represents the consistent position of this Government.

The hon. Gentleman makes a good point, and it is why today’s debate on associate citizenship is so important and why I am so glad it has been brought forward.

I will talk a little about Scotland’s own experiences—you will be well aware of this, Madam Deputy Speaker. This idea of European citizenship is not a new concept that arose in the 1970s; it is a historical one. It is said that in 1295 Scots looked at the idea of dual citizenship with the French as part of the auld alliance. If we go down the Corridors through to the House of Lords, we see the English Tudor monarchs on the wall, along with the Scots Tudor monarchs, some of whom were French—the Dauphin of France at that time is up on the wall there. If we look at the rights of Scots traders as citizens in places such as Veere in the Netherlands, we see that a former Member of this House, Winnie Ewing, was the honorary conservator of the privileges of the Scottish staple of Veere back in the day. Going back even further, to the letter of Lubeck, we see that the first thing that William Wallace did after the battle of Stirling bridge and Scottish independence was to get back in touch with our European partners, because this idea of citizenship—this idea of working together and that Scotland is a European nation—does not go back just to the 1970s; it goes back many hundreds of years. I will move on from that point, but I encourage Members to read and listen to the works of my constituent Billy Kay, who has been excellent on the impact of the Scottish diaspora elsewhere in Europe.

The hon. Gentleman is making a fascinating speech, but he is illustrating the point beautifully that our European identities, whether we are English, Scottish, Welsh or Northern Irish, relate to our relations in Europe, not with the European Union.

As usual, the Minister leads me nicely on to my next point: this is about more than history and identity. I hope that at some point he will be able to tell us how we will replicate these ideas of citizenship and the benefits we have as citizens—our right to study, to work and to travel, our right to healthcare and our human rights that derive from our European citizenship. One Member made the good point about people who work here being able to work elsewhere at short notice. That goes to the heart of European citizenship, and it is why I am so grateful to the Minister, as usual, for intervening on that point.

The value to our economy of European citizenship is crucial. I think of the academics at the University of St Andrews, who can go to work and collaborate with their partners elsewhere in Europe, but it works in both directions: I think of farmers such as the one next door to me, James Orr, who relies on seasonal workers to pick his broccoli, which must still be picked by hand. The Minister for Immigration talked about certainty. I have heard other Ministers say that EU nationals should now feel a sense of certainty in their citizenship, but my postbag tells a different story, as, I suspect, do the postbags of other Members. That is why I raised the point about military families, but we must also keep in mind other EU nationals, who contribute so much, just as UK citizens in other EU countries do.

The hon. Gentleman makes an interesting suggestion. I said that we listened carefully to the debate, and of course we always listen carefully to decisions of this House. In response to the calls from my colleagues in this House and the other place, and from Members of the European Parliament, to argue for the continuation of EU citizenship for UK nationals, let me say that, as my right hon. Friend the Minister for Immigration confirmed earlier, we will always be very happy to listen to any proposals on our exit from the European Union. However, as EU treaty provisions state that only citizens of EU member states are able to hold EU citizenship, when the UK ceases to be a member of the European Union, UK nationals will no longer hold EU citizenship, unless of course they hold dual nationality from another EU member state. It is important that we respect the EU’s legal order, and of course our own, when EU treaties and EU law no longer apply to the UK.

I wish to take this opportunity to respond on the doctrine of acquired rights, which I know the House of Lords EU Committee looked into, expressing some concern about the validity of acquired rights in this context. Article 70 of the Vienna convention was mentioned by a number of colleagues, including the hon. Member for Ceredigion (Ben Lake). To be clear, article 70 is a “default” rule, which does not apply where the parties to a treaty agree arrangements relating to a particular party’s withdrawal. The UK and the EU will agree these arrangements under the article 50 process, to be defined in the withdrawal agreement. The argument on acquired rights under article 70 does not, therefore, apply in the context of these negotiations.

My right hon. Friend is right to say that the Government have to prepare for all eventualities, and I am working closely with the Under-Secretary of State for Exiting the European Union, my hon. Friend the Member for Wycombe (Mr Baker) to ensure that we do just that. However, I am also very clear, as is the Government’s policy, that it is in the interests of the UK and the EU that we secure a partnership between us, and the implementation period is a bridge to that future.

We are just over a year away from leaving the EU, yet the only thing we can rely on from this Government is chaos. It has been said in the past that the Scottish National party is the real opposition to this failing Government, but I have to say that we are being given a good run for our money by Tory Back Benchers at the moment. The Scottish Government have published their analysis of what leaving the European Union will mean, and they have done so publicly. When will this Government publish their analysis?

If the hon. Gentleman is seeking to provide the real opposition, he might want a few more of his colleagues to turn up for debates in this House. Of course the Government will continue to carry out all the analysis and work that are needed to prepare for this process, but we are going to stick to what this House has repeatedly voted for, which is not to publish anything that would be prejudicial to our negotiating position.

I apologise to the hon. Lady. I think I mentioned that amendment in the run-up to addressing the detail of new clause 70 in the name of the hon. Member for North Down, but let me say that Ministers will not and cannot legislate incompatibly with the Good Friday agreement. We are bound by that agreement, and I have been very clear that this Government remain absolutely committed to the Good Friday agreement and have already put our obligations under it at the heart of our commitments.

On amendment 160 in the name of the hon. Member for North East Fife, I want to comment on the fact that such powers have previously been used, because it is important to recognise that this issue has already been addressed. For instance, the Treaty of Lisbon (Changes in Terminology) Order 2011, which was made under section 2(2) of the European Communities Act, amended the Scotland Act 1998, the Northern Ireland Act 1998 and the Government of Wales Act 2006 to give effect to new terminology relating to the European Union. Leaving the EU will require changes of a similar technical nature across the settlements, and that is what the powers enable.

I cannot say at this stage, but let me repeat that in both this debate and the debate on clause 11, we have been clear that we are listening to the Committee and engaging with it, and we will give the matters raised careful consideration. I think the comments made by the Secretary of State for Scotland reflect that approach. It is important that we move forward together with all the devolved Administrations and ensure that the United Kingdom and each part of it can deal properly with their statute book.

I am grateful to the Minister for his detailed responses. He talks about consulting. In an internal market, about which the Minister has spoken, there are different states that have an equal say. What will the arbitration mechanism be and will the Government go further than merely consulting the devolved Administrations?

As we discussed in great detail on day 4, direct Government-to-Government contact is happening on those issues. We have the JMC process—it will meet next week—and I hope that we can all agree ways to move forward that allow this to be delivered for each part of the UK. The consultation process will ensure that we take the approach that works best for the UK as a whole and takes into account the needs of each part of the UK. It will also ensure that existing common approaches are not undermined while we work through with the devolved Administrations where they will and will not apply.

I congratulate the hon. Member for North East Fife (Stephen Gethins) on securing this important debate and his thoughtful comments.

The six founding members of the European Economic Community—Belgium, France, Italy, Luxembourg, the Netherlands and West Germany—signed the treaty of Rome on 25 March 1957. The treaty built on the pre-existing European Coal and Steel Community, which was founded in the aftermath of the second world war as a project for peace. Its primary aim was to ensure that the European continent would never again suffer the blight of war that it had seen, generation after generation, in the run-up to that period. In that regard, I agree with the hon. Gentleman that the legacy of the treaty of Rome is one of great historical achievement, and its anniversary marks the longest period of peace in Europe’s written history.

The treaty was a major step in the journey of European integration. It was followed by the treaty of Maastricht, which established the European single market, and then the treaty of Lisbon, which established the European Union as we know it today—an organisation that is dramatically different from the European Economic Community, which the UK joined under a Conservative Government in 1973, against the opposition of the Scottish National party. This weekend, not only the six founding member states but 27 European nations will meet to celebrate those achievements and to reflect on the next steps in their journey. To that end, the European Commission recently published a White Paper on five future scenarios for the EU. Those range from reducing the EU to nothing but the single market, to a major push towards greater integration. It is a matter for the remaining members of the EU to decide which course they choose to follow, but whatever they decide, we know that it will be a future where the United Kingdom is not a member, but a partner. It would therefore not be appropriate for us to attend the treaty of Rome celebrations or to speculate about the future direction of the European Union, but as the EU approaches its 60th anniversary we wish them well.

It remains overwhelmingly and compellingly in Britain’s national interest that the EU should succeed both politically and economically. Let me be clear: as the Prime Minister has said, while we are leaving the European Union, we are not leaving Europe. We are seeking a new, strong and constructive relationship with the European Union—a partnership of friends and allies, interests and values.

While the institutions and remaining 27 member states of the EU consider their future, we are of course focused on the future of the United Kingdom. As a Minister at the Department for Exiting the European Union, I know well the strength of feeling that surrounds our withdrawal from the European Union, and many of the complicated issues—some of which the hon. Gentleman touched on—that it throws up. I made the case to remain in the European Union during the referendum, but I always committed to respect the result and I understand that we required the consent of the British people to remain a member of the EU. Now that we are focused on implementing the result of a UK-wide referendum, we should all focus on delivering the best possible deal for the whole of the UK.

Leaving the EU offers us an opportunity to forge a new role for ourselves in the world—not isolationism, as the hon. Gentleman suggested, but negotiating new trade agreements and being a positive and powerful force for free trade. Britain’s economy is one of the strongest in the world.

I am grateful to the Minister for his helpful and thoughtful comments. Will he take this opportunity to reflect on the education sector in particular? As I mentioned, the principal of St Andrews is visiting, along with a number of colleagues, and the university sector is important across the United Kingdom. It is an area of particular concern, and I would be grateful if the Minister addressed it.

Absolutely. I was going to come to that issue later in my comments, but I am happy to address it now. From having a large and growing university in my constituency, meeting people at universities around the country and attending the higher education councils of the Minister for Universities, Science, Research and Innovation, my hon. Friend the Member for Orpington (Joseph Johnson), I recognise the importance of some of these issues for the university sector. I was glad to see the commitment in the Government’s White Paper to continue research collaboration with the EU, to be forward-leaning in our approach to making sure that Britain remains a scientific superpower and to building on our excellent record. I recognise that Scottish universities play an important part in research collaboration, and hope that through negotiations we will be able to agree to an approach that secures the benefits of it.

This is one of many areas where we in the UK Government agree with elements of the Scottish Government’s White Paper that set out the benefits of areas where we can continue to work with European friends and allies. While we accept that we are leaving the EU, there are still areas where we will want to be able to work closely together. I recently visited the University of Glasgow and spoke to academics there about the importance of EU funding and structures for them. I recognise those issues, and we are certainly taking them on board as part of our negotiating strategy.

As I was saying, Britain has a strong economy and we are well placed to face the future. We will remain the bold, outward-looking nation that we have always been, and being a scientific superpower and a research leader in the world is an important part of that. Global Britain will be more than just a trading nation; we will continue to play a significant role in defence and security, promoting and protecting the interests of our people around the world. That will not change. The hon. Gentleman mentioned the peace process both in Northern Ireland, which we are absolutely committed to continuing and made a prominent part of our White Paper, and in the western Balkans. I recognise the important role that the European Union and NATO have played in that, and that the UK can continue to play in supporting peace in Europe. We should certainly continue to lean in and play that role, and we are able to do that partly as a result of our investment in defence as well as in soft power. The European Union will continue to be an important partner as we do that, as will many of its member states. The negotiation is not just about what is good for the UK; it is about what is good for the remaining European Union as well.

As the European Union considers its future and the UK builds its new role in the world, we will also redefine our relationship with the EU. We will approach the negotiations as friends. A constructive and optimistic approach to the negotiations is in the best interests of both the EU and the UK. The Prime Minister has now set out the Government’s plan to achieve a new positive and constructive partnership between the UK and the European Union. We have set out our objectives to give as much certainty as possible throughout the process. Now, the overwhelming majority of people, however they voted, want us to get on with it, so that is what we will do.

We will negotiate and leave as one United Kingdom, seeking the best possible deal for the whole of the UK as we do so. We are not trying to cherry-pick aspects of EU membership. The Prime Minister has been clear that she respects the position taken by European leaders that membership of the single market would mean accepting all four freedoms. As the Prime Minister has also stated, being out of the EU but a member of the single market would mean complying with the EU’s rules and regulations to implement those freedoms, but without having a vote on what the rules and regulations should be. It would mean accepting a role for the European Court of Justice that would see it have direct legal authority over our country. To all intents and purposes, it would mean not leaving the EU at all. We are leaving the EU and seeking a bold and ambitious partnership with the EU from the outside. Such an agreement will be in the interests of both the UK and the EU.

The Minister will be aware from visiting the University of Glasgow, where I suspect he met Professor Anton Muscatelli, that there has been a debate among academia and the business community, and on a cross-party basis in Scotland, about having differential immigration systems in the UK. That could help to bridge the gap between England and Scotland on this issue. What consideration has his Department given to the differential immigration systems in other countries around the world?

We are carefully considering all the elements of the White Paper that the Scottish Government presented to us. On immigration, we are aware that we have to meet the needs of the whole of the UK, including all its industries and all parts of the United Kingdom. I did indeed meet Professor Muscatelli and had a very useful conversation with him. That is part of the stakeholder engagement process that our Department has been undertaking throughout all the parts of the United Kingdom to make sure that we are looking at the opportunities of EU exit, as well as the risks.

We are looking for a mutually beneficial deal. In our future relationship with the EU, we want clarity and certainty. We want to take control of our laws.
