I associate myself with the comments of the right hon. Member for Kingston upon Hull North (Dame Diana Johnson). I agree that it is important to keep the victims and their families at the heart of this debate. We should all take a moment to remember and to pay our respects to those who lost their fight and are no longer with us.

It is only due to the persistence of activists that the scale of the disaster and the cover-up began to be revealed in 2017. I pay tribute to their determination not to give up, despite some of them being in poor health. I particularly thank Sean Cavens and Bruce Norval, who have provided me with so much information and support over the years. Their effort meant that there was strong cross-party support for a public inquiry before the emergency debate on 11 July 2017.

In that debate, I explained how, as a young surgeon, the revelations of the early to mid-1980s shocked me to my core: to think that in transfusing a patient, I might have exposed them, while trying to save them from trauma or surgery, to HIV or hepatitis. It led me to totally change my surgical approach, and to use every technique available that could reduce blood loss and minimise the need for transfusion. That was 40 years ago. My entire surgical career has passed while the victims are still seeking justice.

My hon. Friend has worked tirelessly on this matter, and she is right to refer to Bruce Norval and his work. Bruce Norval has pointed out that up to 100 people affected by this scandal are dying each year, and they have not been able to access compensation. It is time to get on with this, isn’t it?

I absolutely agree with my hon. Friend.

I pay tribute to Sir Brian Langstaff and his team for their meticulous, forensic and dogged examination of all the evidence, and for their sensitivity to the witnesses. They have helped reveal the truth about 60 years of disastrous policy decisions and individual decisions, including the failure to ensure blood transfusion services are self-sufficient and the failure to switch to safer treatments more quickly. In particular, the inquiry exposed systematic attempts to cover up the scandal.

I am not sure whether the Minister attended any of the hearings but, if he did not, he should watch the video recordings, and maybe he would get the merest hint of the suffering of those infected by contaminated blood and their families. I attended a couple of sessions in London and Edinburgh, and it was harrowing even as an observer, let alone for those who had to recount their experiences and relive their pain. Their bravery and determination were humbling.

The inquiry staff did an incredible job of providing support to the victims who came to bear witness, while Sir Brian ensured that they and their representatives were involved in steering the inquiry to its conclusion, with the final report due in the autumn. While that report will seek to ensure that the lessons from this disaster are learned, one of the key aims of the inquiry is to achieve just compensation for the victims and their families.

The proposal for this economy, as I said at the beginning of my speech, is not just for the people of Scotland: it is for the people of the four nations of the UK. The review of the TCA will come up in 2026, and while it is not possible to make Brexit work, it is possible to mitigate some of its worst effects. For that, though, we need to understand what Brexit is doing to the UK’s society and economy and have proposals that we can bring to the EU to ask for change.

Unfortunately, the opportunity to change to a different economy and society has not been taken. We already see poverty and inequality rising, and the climate emergency being pushed off the action list—including by Labour, which has just U-turned on its pledge to invest £28 billion in the transition to a green economy. Unfortunately, the climate crisis cannot wait. Scotland is blessed with extensive green energy potential, from wind and tidal power to green hydrogen and pump storage hydro. The current Government have failed to support Scotland’s green energy potential, and sadly there is now little reason to expect much change under Labour, either.

My hon. Friend talks about Scotland’s energy opportunities, and green hydrogen is indeed one of the key ones. Does she agree that it is perhaps illuminating that the Foreign Secretary himself does not even know about those opportunities, nor has he taken the opportunity to engage with the US on its Inflation Reduction Act regarding the supply pipeline for green hydrogen? Does she think that is absolutely indicative of the relationship of the Government of this place with the needs of the Scottish people?

I thought you were going to give me an instruction to sit down there, Mr Deputy Speaker, but thank you for allowing me to speak in this cost of living debate.

The shadow Secretary of State, the hon. Member for Edinburgh South (Ian Murray) and I share an allegiance to a football team, and when we go to some stadiums, particularly for the big events, we often look across and see the empty seats, and go, “Did the opposition come dressed as seats?” I look behind him today, and wonder if the rest of his party have done the same. But no—they have not bothered to turn up because, as the hon. Member for Leicester East (Claudia Webbe) has just pointed out, this is an issue about whether people can afford to heat their homes or to eat. In fact, it is worse than that, because in Scotland during the winter we had people who could not afford to heat their homes or to eat. This is an important thing that we should have seen the Labour party turn out for, but of course we did not.

When it comes to Brexit, what about the harms? We have heard about quite a lot of the harms today in this Chamber. My colleagues have covered a number of them—from the economy and trade to the impact on our population, education, rights and devolution, as well as on the cost of living and the cost of food. As my hon. Friend the Member for Edinburgh North and Leith (Deidre Brock) pointed out, when food price inflation goes up, it disproportionately hurts the least advantaged in our society and the poorest. However, it is worse than that, because food price inflation on basic foods is actually higher than the headline rate. It goes up even more, and these are the basic staples that people rely on, yet Labour Members could not even bother to turn up to discuss that with us in this debate.

The Brexit that has been forced upon us is the gift that Scotland didnae want and that keeps on giving misery. It keeps on delivering misery across Scotland for people. I will just mention some of the things it affects. Of course, Labour Members now support Brexit. In fact, as we heard from the Labour leader, if that “sounds Conservative”, they just “don’t care” about it. Brexit has made sure that GDP is 4% lower across the UK. There has been an £800 per year increase, on average, in the cost of living. By the end of last year, according to the London School of Economics, Brexit had already cost nearly £6 billion across the UK in higher food bills, and some £100 billion in lost economic input. When it comes to business, the British Chambers of Commerce has said that more than half its members have faced difficulties because of Brexit. It quotes one of its members saying:

“Leaving the EU made us uncompetitive”.

That is the fairly standard comment that it gets from its members.

The cost in human capital has been tremendous for us. Before Brexit, 6% to 9% of care home staff used to be EU nationals, and now we are struggling to find spaces in care homes for people because we cannot get the staff. The UK Government are doing nothing—nothing—about getting that sorted out. They are doing nothing to solve the misery for people who need that kind of support. Of course, we have the unemployment rate at a record low in Scotland, at 3%, so where are we supposed to get the people? Brexit has starved us of the human capital we need.

We have heard the I-word, and I thought the hon. Member for Edinburgh West (Christine Jardine) was going to talk about Ireland—independent Ireland—which over the next two years will have a €27 billion surplus, but no, she did not want to do that. She did not want to talk about the success stories of those small independent countries with fewer resources than Scotland that have stayed in the European Union and grown as a benefit of that.

On energy, I want to reflect on an issue I raised with the Secretary of State for Energy Security and Net Zero about the higher energy tariffs we face in the highlands and islands of Scotland. I said that we needed to do something about that, and I offered to work with him to see what we could do. But no—the answer I got back is that geographic circumstances are the issue: the distances involved result in higher costs of distribution than in other places in Britain. Well, that is rich, because we export our renewable energy around the UK. The distances do not matter when that advantage is being taken, do they? It only matters that it costs us more in Scotland, and the Government are not willing to do anything about it.

Similarly, people are struggling in rural communities with the off gas grid regulations, because they pay a much higher premium for their energy than anywhere else and probably have to use more electricity at a higher rate than for mains gas, and of course face higher costs for liquid petroleum gas and for heating oil as well. The answer I got back on that from the UK Government was, no; their aim is to protect suppliers before people. It is not good enough for them to just wash their hands of a situation where people are struggling, particularly in rural communities, with exorbitant costs to heat their homes during the winter.

I am grateful for the mention earlier of my campaign on credit balances. People are struggling, but electricity companies hold on to their money, in credit, sometimes thousands of pounds—one pensioner in my constituency was nearly £2,000 in credit, yet the company was looking to increase her direct debit even though she had that money with them for safekeeping or use. That money should be returned to people—but, no, that is not going to be done either. What we get back is, “Customers can ask for that money back.” Some people are of course too frightened to look at their bills because of the costs they are facing, while others do not know about this or are intimidated, and some people are told by electricity companies that they cannot get that money back or they can get only a portion of it back. People have rights, and they should be fulfilled. They should be able to get their money automatically returned; it should not be kept on credit balances for companies to use for their own ends. That is exacerbating poverty for people.

I am grateful to the hon. Member for Edinburgh West for raising the issue of business rates. The small business bonus has been mentioned, and we have 100,000 businesses in Scotland that pay no rates whatsoever; if our aim is to help people in Scotland, including small businesses, we should realise that there are a lot of micro and small businesses across rural communities, and that directly assists them.

So too do the actions we take on child poverty. The child poverty rate across the UK is 27%: in Wales it is 34%; in England it is 29%; in Northern Ireland it is 24%; and in Scotland it is 21%. The Institute for Fiscal Studies says that among the poorest 30% of households, incomes are boosted by around £2,000 per year in Scotland compared to England and Wales.

There are transformational policies to help people: free bus travel for young people in every part of Scotland; the expansion of free high-quality childcare to 1,140 hours, available for three and four-year-olds, and to two-year-olds from lower-income households; the best start foods grant, which helps with the cost of buying healthy food for families with young children; and three best start grants, which could be pivotal in a child’s life—for low-income families, £600 for the first child and £300 on the birth of a later child. There is also the Scottish child payment, the baby box, the free childcare extension, free school meals, free bus passes and much more from the Scottish Government to help out.

Does my hon. Friend agree that the problem with 13 years of austerity is that austerity may make the Treasury balance sheet look good in the first year but it starves local economies because people have no money to spend, so we see boarded-up high streets, and in the end that reduces the tax take to Government, so it simply does not work?

My hon. Friend is exactly right that it starves communities, and, worse than that, it starves families—it starves children. It starves people of the opportunity we could give them, because we do not have the advantages that we should and would have if we had the powers to make the decisions we need to make.

Absolutely. An amendment was tabled by one of their own Members—the Chair of the Environment, Food and Rural Affairs Committee, the hon. Member for Tiverton and Honiton (Neil Parish)—to protect food standards in farming.

Universal Credit and Terminal Illness

My hon. Friend mentioned working with groups such as the Motor Neurone Disease Association. As many Members know, my experience has been walking that journey with women with breast cancer. I always used to say to them, “Make sure that you put every day in your back pocket when you go to bed, and say, ‘That was a good day.’” In Scotland we are trying to extend the period so that we recognise people as terminally ill for a much longer period so they will receive their benefits. To waste the months that someone might have left by haggling about money while the days are ticking away is just cruel and uncivilised.

My hon. Friend has identified the nub of the issue. People literally do not have time for this.

I recently set up an all-party parliamentary group on these issues, which is supported by many of the organisations that I have mentioned, but the issues are still ignored. This evening, as I relay to the House the specific impact that universal credit is having on people with terminal illness, I ask the Minister not to follow the same path, but to listen carefully to the very real experiences of the families who face the prospect of losing loved ones, yet have to watch them fight for financial support.

Before the introduction of universal credit, terminally ill people with six months or less to live were able to fast-track their benefit claims to ensure that they could spend at least their last weeks and months with the support to which they were entitled. That has not been the experience of those who are unfortunate enough to be terminally ill in an area where universal credit has been rolled out. It is the worst kind of postcode lottery, and it will reach many more places if the Government proceed with the roll-out in its current form.

The first issue that I want to discuss is the Government’s legal definition of terminal illness. The Motor Neurone Disease Association and Marie Curie, among others, tell us that it seriously restricts access to benefits for those living with a terminal illness who do not fall into the “last six months of life” category specified in the Welfare Reform Act 2012. People with conditions such as terminal heart failure, chronic obstructive pulmonary disease, MND and other terminal conditions who may live longer than 10 months, but equally may die in a shorter period, must apply for social security in the usual way, and will be subject to all the normal assessments, which—unbelievably—can include work assessments.

People living with such conditions, and their families, face a significant financial burden as a result. Some 82% of people with MND describe the financial impact of the disease as “very negative” or “moderately negative”. People of working age and people with children living at home are particularly vulnerable to negative financial consequences. I note that people with MND will once again be protesting outside the House on 16 May, and I look forward to supporting them there until there is movement on this issue.

The financial effect of MND on those living with the condition becomes more difficult to manage as the disease progresses and a person’s care, support and equipment needs increase. On average, the cost of living with MND is an extra £12,000 a year, not including loss of income. So why should an arbitrary time limit of six months be attached to the status of the terminally ill? It is a timescale that means nothing to people with degenerative conditions with no cure, who have no hope of improvement. There is no evidence-based reason why the Minister cannot choose a different path, as the Scottish Government have done with their new limited powers relating to disability benefits. They see support for people who are terminally ill as a complex, sensitive and difficult issue, but they have put dignity and respect at the heart of their Social Security (Scotland) Bill. Jeane Freeman, the Minister for Social Security, has said:

“We are very aware that behind the decisions that we make, are thousands of people who we put front and centre of our actions. The central principle is that terminally ill individuals should be provided with the support they need, quickly. ”

That is all that we ask of this Government. We ask them to see those people as people, and not as the number that they represent on a spreadsheet.

The Scottish Government’s amendment to the Bill was framed carefully to ensure that the sensitive and difficult conversations between an individual and their clinician, which are required in these difficult circumstances, are held when they are medically necessary to allow for optimal patient care. Providing for maximum clinical judgment is the best way to achieve that.

The Scottish Government have opted to set no arbitrary timeframe to the definition of terminal illness; instead they allow the chief medical officer, in consultation with the registered medical practitioners, to set a framework in guidance. It is this guidance that will decide when an individual has a progressive disease that can reasonably be expected to cause that individual’s death. Both the chief medical officer and the chief nursing officer, and national experts, have reviewed and fully support the Scottish Government’s proposals as the best way to achieve timely support for those with terminal illness.

Also embedded in Scotland’s Social Security (Scotland) Bill—and therefore enshrined in legislation—are clear “special rules” for terminal illness cases. These guarantee terminally ill people quick access to disability assistance, ensuring that an individual does not have to satisfy a qualifying period in relation to their diagnosis and that they will not have to undergo further assessments to prove that they have a terminal illness. The awards will be calculated at the latest from the date of application and they will automatically get the highest rate of financial support to which they are entitled. That is in line with the Scottish Government’s commitment to the principle of providing support when it is needed. It maintains fast-tracking for the people with terminal illness to remove barriers to their receiving care as soon as possible.

Marie Curie has echoed its support of the Scottish Government and would like to see the UK Government follow their lead in setting a fairer definition of terminal illness. It asks that decisions around a terminal illness diagnosis be clinically made and supported through the issue of a DS1500 to a patient by their health professional. Ahead of this debate, Marie Curie told me:

“With the Scottish Government defining terminal illness on clinical judgement and Universal Credit remaining the purview of Westminster, we are concerned that differences between the two systems will create administrative problems. If Westminster were to follow suit and amend its definition of terminal illness to a clinical judgement, we could avoid a potentially harmful situation when Universal Credit is almost fully rolled out.”

Marie Curie is joined by 58 clinicians who signed a letter in support of changes to the Social Security (Scotland) Bill.

Similarly, MND told me:

“The UK Government should adopt the definition of terminal illness set out in the Social Security (Scotland) Bill 2018”,

and that

“The DWP should update its guidance to assessors and claim managers, to emphasise that the validity of a DS1500 signed by a health professional should not be challenged.”

I therefore have some asks for the Minister. I ask her to listen—to really listen—to what she is hearing from people suffering from these terminal conditions and really listen to the professionals and clinicians. I also ask her to scrap the arbitrary six-month definition. It means nothing to 90% of people with a condition medically classed as, or linked to, a terminal illness.

Even those who have been identified as terminally ill, as defined by this Government, with less than six months to live do not escape the nightmare of universal credit. That includes 65,900 people across all the nations of the UK. They continue to experience delays upon delays. I join MND and Marie Curie in their calls for cuts to those unreasonable delays.

Therefore, I have another ask for the Minister. The benefits for those with a terminal illness under universal credit should be fast-tracked, ideally paid in advance and within a calendar week of when the application has been made, and a DS1500 given to the DWP. The current wait of five weeks for “fast-track” support is simply unacceptable.

There are also those on universal credit who have lost the right not to know they are dying. Instead, they are forced to complete the forms, which force them to answer the question, effectively saying, “Yes, I am dying.” Before the introduction of universal credit, advocacy could do this for them. What possible reason could there be to remove this right? A completed DS1500 form should be considered sufficient evidence by the DWP that a person is terminally ill and will not get better, and that their condition will deteriorate from that point until their death. A DS1500 should be allowed to be issued on behalf of a person and accepted by the DWP in the same way as if submitted by the applicant themselves.

So I have another ask for the Minister: the DWP should immediately establish a process to ensure that DS1500s can be submitted by a third party without the explicit consent of the claimant.

Then there are those people left with a devastating cut to their income due to the removal of the severe disability premium. Without any change in their diagnosis, such people are left around £2,000 a year worse off, and the sad reality is that they will not even live a year as this Government’s definition of terminally ill means a predicted life expectancy of less than six months. I have another ask: the DWP should urgently review its policy on the inclusion of severe and enhanced disability premiums within universal credit to ensure that disabled adults do not experience a reduction in vital support. Perhaps one of the most shocking issues is that people with less than six months to live have been asked to meet a job coach to justify their unemployment because the guidelines around forms are unclear. Someone with a terminal illness, as evidenced by a DS1500, should not be required to undergo any face-to-face assessment for support under universal credit or undergo any further assessment or reassessment. I ask the Minister urgently to set out clear guidelines on that because the guidelines are not working.

These are just some of the issues that people with a terminal illness face because of this Government’s failure to put dignity and respect at the heart of their welfare policies. I ask the Minister to imagine what it must be like to face all this stress in the last months of life—a time when the person and their family should be cherishing every precious remaining moment together. People should not have to jump through welfare hoops and spend their final weeks and months dealing with a broken system. Getting financial support is not an option for them; it is a necessity to keep a roof over their head.

I fully expect the Minister to tell me that I am wrong and that all is well with the system, because that is all that I have heard whenever I have raised such issues. Perhaps we will even hear that, despite the evidence and the testimony of all the groups involved, that this is simply scaremongering, and I have heard that response on the many times I have raised this issue. I have raised it at Prime Minister’s questions three times in a row. I have raised it many more times in debates, and I have heard the claim that terminally ill people are being served well. Terminally ill people and their families watching this debate are seeking an answer.

The reality is that, because of this Government’s failing welfare system, people are spending their last days fighting a cruel and broken system. The Minister has the power to change that. She can do as the Scottish Government have done and think about the people concerned, about their debilitating illnesses, about their families and their children and about their final days. I believe that the Minister wants to do that, and this is her opportunity to prove it. She can make a start by making the changes that I have outlined.

I would be delighted if the Secretary of State and the UK Government wanted to hand control of UK infrastructure development to the SNP, because as with the Borders rail link and the Queensferry crossing, we deliver things on time and under budget. By all means, give us the decision and we will make the choice.

Let me come on to why the decision is important for Scotland. More than 90% of international visitors to Scotland travel by air. More than a third use Heathrow as a hub and, if that is combined with Gatwick, I reckon that around half our international visitors travel through the south-east. It is not just about tourism; it is the £5 billion a year whisky industry and the £500 million salmon industry, and other shellfish and exports need to get to international markets. All the time the decision is pushed out and fudged, it harms the Scottish economy.

Another opportunity is open to the UK Government to assist not just Scotland but many other parts of the UK by bringing forward a commitment for public service obligations for linking regional airports point to point with the London hubs. That straightforward measure would point to a much more enlightened and inclusive air transport strategy. Market forces alone cannot provide fairness across all the regions and nations of the UK, and a strategic choice is needed.

We also support the establishment of the UK spaceport, which is an exciting opportunity.

On my behalf, will my hon. Friend ask the Secretary of State to clarify his comments about this issue? I wanted to intervene on him, but unfortunately he did not hear me. He said that it would be up to market forces to decide the location of the spaceport. We have had discussions in this place about awarding a single licence to a UK spaceport, but multiple licences would be needed, because every vehicle has to be licensed. I hope that the Secretary of State will clarify whether he will let the market make the decision and if it will be possible to have multiple spaceports?

That is a very important point, and I am delighted to underline it and to ask the Secretary of State to respond. We see this development as having great possibilities and we would anticipate that, when making their decision, the UK Government will fully appreciate the excellent potential sites in Scotland. We encourage the UK Government to work with the Scottish Government, Scottish local authorities and our public agencies to realise this potential in Scotland.

We would also welcome more detail on developing a genuine aerospace strategy, which must include supporting the industry to address the skills gap in the engineering sector. I urge Ministers to consider some of the work on gender-balance issues. Not long ago in the Chamber I quoted Bridget Day, the deputy director of the national aerospace programme with more than 40 years’ experience. She has highlighted her struggles as a woman in the industry. Only 11% of engineers are women, even though more than 20% of graduates are women. That is the lowest percentage of female employment in the sector across Europe.

There are also apprentice opportunities in shipping—transport should include references to shipping. The Scottish Government worked tirelessly, as they did on the Scottish steel issue, to save the iconic Ferguson shipyard, which is vital to providing vessels and employment for the future. Of course, this place has decided to delay the BAE order for the Govan and Scotstoun yards with the review of shipbuilding. That delay threatens jobs in Scotland and I hope that Ministers will take that message back to the Cabinet and get the Treasury to release the brakes on that development.

On the subject of shipping, we also have an opportunity to put right the dangerous deficit that has been allowed to continue around the seas of the UK, nowhere more strikingly than on the west coast of Scotland. My right hon. Friend the Member for Moray (Angus Robertson) has highlighted on many occasions the dangers and folly of removing maritime patrol aircraft from Scotland, but when the removal of one of Scotland’s two emergency towing vessels and the ongoing uncertainty over the remaining tug are added to that, it is easy to see why Ministers are facing calls from every quarter to commit to permanently securing the remaining vessel and reinstating the second. Those vessels, if deployed sensibly, can assist drifting ships, therefore preventing them from running aground, and head off disaster, protecting human lives and fragile environments. They are called emergency towing vessels for a simple reason: they are available for emergencies, such as when they were called in to rescue one of the UK’s nuclear submarines that had run aground off Skye. Their retention and reinstatement has been strongly urged by everyone who understands the risks from the seas around Scotland—the marine industry, marine unions, including Nautilus, every highlands and islands MP and MSP, local authorities and agencies. They have all pointed out that we cannot wait for a disaster to happen before there is a reaction, so protection is needed so that a disaster can be prevented.

The nations of the UK need not just warm words of support for good ideas, but a connectivity strategy: a plan for air; a plan for technology; a plan for suitable sustainable fuels; a plan for marine operations; a plan for health and wellbeing; a plan for tourism; a plan for trade and enterprise; and a plan for productivity. We must see more and better work from the UK Government on those fronts.
