Commons ChamberNever before has such rubbish been uttered about a piece of legislation as has been uttered about the Hate Crime Act. In one week, the Tories have tried to repeal it—which, given that it mainly consolidates existing legislation, will leave us unprotected against islamophobia, racism and homophobia. Will the Secretary of State now issue one of his famous colonial decrees and tell the Scottish Tories to back off?
First of all, those laws already existed—that is the important thing. Secondly, I was right about police resources. There were 8,000 hate crime reports in the first week, more than in any of the seven preceding years. It is a ridiculous, unnecessary piece of legislation.

Commons ChamberI am sure the Secretary of State will agree that his mission to constrain and bypass the Scottish Parliament has been an absolute disaster for devolution. Relationships across the UK have never been as such a low level. Will he acknowledge that his version of aggressive Unionism has utterly failed? As he is leaving his office, will he pledge to abandon it entirely?
I am not entirely sure what I have done that has been a failure, to be honest. This Government protect devolution and the settlement. If he is referring to the section 35 order that I used, that was in the Scotland Act 1998 and was voted for at the time by SNP MPs. It is there to protect devolution when a devolved Administration legislates on Great Britain or UK matters.

Commons ChamberI am sure that the Secretary of State will be assisted in determining Scotland’s place in international arrangements by the Scottish Affairs Committee’s report, “Promoting Scotland Internationally”, which was released today. In it, he will find that the working arrangements between personnel in both Governments are consensual and productive. Does he not therefore feel slightly embarrassed by the ridiculous diktat from the Foreign Secretary, intended to put the Scottish Government back in their place? The Scottish Secretary told our Committee that it was necessary because, among other insignificant things, Scottish Government Ministers had the temerity to say that Brexit is a bad thing for Scotland. Does he not think that nearly all of Scotland thinks that Brexit is a bad thing for Scotland?
I stand by the words that I said to the hon. Member’s Committee.

The Scottish National party likes to blame everything on Brexit, but for the past two years we have had record immigration into the United Kingdom. That is a simple fact—record numbers since immigration figures began.

Commons ChamberThe Secretary of State will know that the Scottish Affairs Committee is currently conducting an inquiry into how Scotland is promoted internationally, and all we have heard is just how well the UK and the Scottish Government work together, and about the added value that the Scottish Government mission brings to that promotion. Why is he determined to pick a fight unnecessarily and get in the way of that business?
As the hon. Gentleman will know from my submission to his Committee and its inquiry, that is not what I think. I think that the UK Government should work with the devolved Administrations to promote them, and to promote trade, overseas. I also believe that when the devolved Administrations are using our missions overseas, they should not be using them to promote their plans for a separation, or to undermine our foreign policy.

May I say to the Secretary of State that the Union is in trouble because there is no longer a case for the Union? We know that because a significant number of under-50s now support independence. Could he tell us what the Union’s greatest achievement has been in the past few years? Is it a Brexit that Scotland does not support; is it high-rise energy prices in energy-rich Scotland; or is it being run by a bunch of Tories that most of Scotland rejected?
I notice that the hon. Gentleman did not quote any opinion polls to me this time. Nor, as he mentions Brexit, did he call for another—[Interruption.] The result was 52% to 48%—[Interruption.]

Commons ChamberThis is the single biggest attack on Scottish devolution and Scottish democracy since the establishment of the Scottish Parliament in 1999. A move to strike down a piece of legislation that is supported by every single party in the Parliament is as provocative as it is anti-democratic. When the Scotland Act went through Parliament back in 1997 and ’98, the Conservatives called section 35 the “colonial general rule”. Is the Secretary of State now the real-life colonial general imposing his view on a reluctant Scottish Parliament in the name of his and his party’s culture wars?
I come back to my original point. This is a decision that I did not take lightly. It was taken after much consideration of the legal advice that we received and it is based on a section 35 order, which is in the 1998 Scotland Act—an Act brought forward by the Labour party, led through Parliament by Donald Dewar and voted for by the Scottish National party.
Regarding any amendment to the Bill, if the Scottish Government want to bring it back, they have to address the central issue—I know there are difficulties for them with this—which is that we do not believe, in the cross-cut against GB legislation, that there are sufficient protections and safeguards for women and children, as reflected in existing Westminster legislation.

Commons ChamberMy hon. Friend is right. It is not just about what is in front of us, but what is behind us. Behind us is the furlough scheme, which supported 900,000 jobs during the pandemic, and the £1.5 billion of Barnett support that the Chancellor announced in his autumn statement; in front of us is not just the growth deals, but freeports and forthcoming cost of living support.
This ruling is bad for the Government, and I do not think they quite see that yet. This ruling confronts the Scottish people with the fact that there is no legal or democratic route to a referendum. All that will do is to infuriate the Scottish people and make sure that they have their demands for Scottish democracy in place. What we have not had is the how. How do we now get to a referendum if the legal and democratic means are closed? The Prime Minister was asked, and the Secretary of State has now been asked, so will he now please answer?

Commons ChamberThe benefits are enormous. Scotland plays a crucial role in the defence of the UK and our NATO allies. The UK strategic bases in Scotland, RAF Lossiemouth and the UK’s nuclear deterrent at Faslane, serve to make the whole of the United Kingdom safer. The economic benefits for Scotland as a result of MOD investment are significant. MOD expenditure with industry and commerce in the last year alone totalled almost £2 billion. Defence investment in Scottish shipbuilding will see order books full until the 2030s. Construction is under way to deliver three cutting edge Type 26 frigates at BAE Systems in Govan, five Type 31 frigates at Babcock in Rosyth, and only this week the MOD awarded a £30 million contract to Babcock in Rosyth to maintain the Royal Navy’s two aircraft carriers, securing 300 jobs for the next 10 years.
The Secretary of State will know that the Scottish Affairs Committee, of which the hon. Member for Hastings and Rye (Sally-Ann Hart) is an assiduous member, is conducting a series of inquiries into defence in Scotland. One of the things the Committee has found in its almost concluded report on the military landscape in Scotland is that only 2.5% of total military spending is spent on Scottish small and medium-sized enterprises. What is the Secretary of State doing to ensure that situation is rectified?
The hon. Gentleman mentions SMEs. The bulk of the spending—literally billions of pounds, worth thousands of jobs—is with British Aerospace and Babcock.

Commons ChamberIs it not the truth that Scotland has never experienced such sustained attacks on our democracy and our democratic institutions? As we have heard, legislative consent is now almost dead and buried, a feature of history, with Westminster now legislating in devolved areas. What is next in the Secretary of State’s sights?
There are various Bills that come through that are Brexit related: the Professional Qualifications Bill, which is linked to trade Bills, a reserved matter, would be one of them, and the Subsidy Control Bill would be another where we will not get an LCM. We know that, but we need to bring in subsidy controls, because state aid has reverted to the United Kingdom from the EU and it is a UK matter.
The Secretary of State does not get an LCM because Scotland’s directly elected representatives do not agree with it and do not want it. That is why LCMs are withheld. Everybody can see what is going on, and everybody can see his attempts to undermine our democracy. Is it not the case that his muscular Unionism has been a disaster for Scottish democracy? In fact, it has even been a disaster for the Scottish Conservatives, who may or may not now have confidence in their Prime Minister. Is it not also the case that the Scottish people have no confidence in this Government to defend our parliamentary institutions?
Absolutely not. We do the right things for Scotland. On the United Kingdom Internal Market Act 2020, we brought the Bill forward without an LCM to protect Scotland’s trade with the rest of the United Kingdom. The two principles that underpin it are mutual recognition and non-discrimination. That is because 60% of Scotland’s trade is with the rest of the UK and a lot of jobs rely on it.

Commons ChamberI do share the disappointment that the Scottish Government did not engage in the Union connectivity review. In fact, the Cabinet Secretary for transport, Michael Matheson, instructed his civil servants not to engage with Sir Peter Hendy, the author of the review. But the UK Government have invited the Scottish Government to work closely in partnership to consider the recommendations and identify solutions that work best for all people in the United Kingdom.
There is no doubt that the UK Government speak a lot about improving connectivity with Scotland, but what is the Secretary of State specifically doing to improve connectivity between the UK Conservative Cabinet and what they refer to as the political lightweights of the Scottish Conservative party?

Commons ChamberMy hon. Friend makes a very good point. I know that there are over 40 distilleries in his constituency, so I understand why he feels very strongly about this issue. I agree with him. We were successful in taking the 25% tariff away, but it needs to be removed completely and not just suspended for a number of years. The way to do that is for us to also remove our tariffs on bourbon. I would be very happy to meet him to discuss that.
Brexit has been nothing other than an unmitigated disaster for Scotland. We now have food shortages, labour shortages, businesses unable to export their products and food rotting in the fields. Is it not about time, instead of all this mealy-mouthed nonsense, that the Secretary of State got to his feet and apologised to the people of Scotland for dragging our nation out of the European Union against its national collective will?
I simply do not recognise what the hon. Gentleman says. We have been through the pandemic and it is far too early to say what any impacts are to make predictions, but what we do know is that our economy is growing. We are doing fantastic trade deals around the world, which will benefit the Scottish economy, and Scottish food and drink. He just needs to get positive about that: stop talking down Scotland’s businesses, stop talking down Scotland, and start to get optimistic about the opportunities we face.

Commons ChamberThe Prime Minister has previously provided assurances that our plans to replace structural funds will at least match the figures of the EU funding. We are confident that will start with the community renewal fund this year, and will lead next year into the UK shared prosperity fund, as I mentioned earlier, in April 2022. That will reach £1.5 billion in total, and I can assure my hon. Friend that her area will be receiving its fair share.
Under the EU structural funding arrangement, the Scottish Government played a role in determining the allocation of that funding. This ensured that funding was allocated based on the democratic choices of the people of Scotland, reflecting the priorities that they voted for. Will the Secretary of State now commit the UK Government to give the devolved Governments a formal say in the delivery of the SPF to ensure that democratic working continues?
What we are doing is working with all responsible delivery partners in Scotland, as I have said, and the community renewal fund will be an example of real devolution at work. We will be working with local communities and local authorities in ensuring that the projects respond to local wishes and meet local needs.

Lady that in 2014 there was a referendum; it had been many years since the question had been asked, and that was with the consent of both Scotland’s Governments and all the main political parties. I am glad to say that in Scotland people shared my opinion in 2014 and consented to continue being members of the UK.
There is only one sure-fire way for the Union to be strengthened in the next week and that is to get the Prime Minister to Scotland and on the campaign trail. The Secretary of State surely knows that there will be throngs of happy Scots rejoicing in the Prime Minister’s sleaze-free presence, helping the Electoral Commission with its inquiries and sharing anecdotes about bodies piled high on the streets—what could possibly go wrong for the Scottish Tories? Can the Secretary of State and I start working on the itinerary? Surely Scotland deserves to see its Prime Minister before he inevitably has to resign.

Commons ChamberMy hon. Friend is absolutely right. This is brilliant news for the Scotch whisky industry, in the same week that the Chancellor announced a freeze on alcohol duty. The UK Government have fought incredibly hard on this issue, petitioning the highest levels of the US Administration to remove these tariffs, which were harming our Scottish exports.
During the comprehensive economic and trade agreement talks between the EU and Canada, little Wallonia, as part of Belgium, managed to block the agreement until the concerns of its Parliament were resolved. Meanwhile, the Canadian state legislatures were in the next room to the Canadian federal delegation during those negotiations, putting their case. Will Scotland, with the most powerful Parliament in the world, as we are always told by the Secretary of State, have similar powers? If not, what will be the role of the Scottish Government in these trade talks?
It is a pity that the hon. Gentleman could not bring himself to welcome the suspension of the US tariffs, in the same way that the Scottish National party has not welcomed any of our trade deals, but maybe he and his colleagues have other things on their mind at the moment. I also noticed that he did not raise separation, for the first time in my almost two years at the Dispatch Box—always separation, but not today. I think he has finally thrown that broken record away. We consult the Scottish Government on these trade deals, but they are a reserved matter and they are for the whole United Kingdom. As I stressed in my earlier answer, they will be very beneficial for the Scottish agrifoods industry.

Commons ChamberI wish my hon. Friend many happy returns, and my birthday present to him is to say that I could not agree with him more. Rather than waste time on a divisive separatist agenda, the Scottish Government should be working with us to defeat the pandemic and to recover our economy.
I did not quite detect an answer to my hon. Friend the Member for Paisley and Renfrewshire South (Mhairi Black) when she asked how the Scottish people could now secure a referendum on independence. We can dispute the merits of that, and I am sure we will, but does the Secretary of State accept that this is now what the Scottish people want? Twenty opinion polls in a row indicate that, so how do the Scottish people democratically acquire the right to have what they want in a referendum?

Commons ChamberThe Union connectivity review that I referred to earlier and the United Kingdom Internal Market Bill, which is currently going through Parliament, will both promote the economic ties that my hon. Friend refers to. They will protect vital trading links and improve transport links.
The Secretary of State is doing such a fantastic job of strengthening the Union that support for independence is at a historic high and has been at a sustained majority all year. Saying no to a majority in Scotland is only going to drive support for independence even higher. Apparently, he was only joking when he said that there would be no indyref for 40 years, just after John Major said that there would be two referendums in the next few years. The Secretary of State is renowned for his legendary wit and humour, but the Scottish people are not finding this democracy denial funny anymore. What is the difference between denying a majority in the Trump White House and denying a majority in the Scotland Office?
That is quite a tenuous link, but I will answer the question. To be quite simple, my belief is that we should stick to the referendum from 2014 and respect it. It was very clear—the SNP said it at the time —that it was a once-in-a-generation referendum. I do not believe that we should go into a process of neverendums, which are divisive, unsettling and bad for jobs in Scotland. We should respect democracy, and that is what I am doing—democracy that was handed out by the Scottish people in 2014.

Commons ChamberThe Union connectivity review, which is being led by Sir Peter Hendy, who I met yesterday, is a really important initiative for Scotland and the whole United Kingdom, and it will create very exciting opportunities. However, I am concerned that Transport Scotland has been told by the Cabinet Secretary for Transport, Infrastructure and Connectivity, Michael Matheson, not to engage with the review, and I urge Mr Matheson to think again and to ensure that his officials take part. It cannot be in Scotland’s interest for the SNP to play politics with an issue that is so important to our economic future.
The Secretary of State says that the job retention scheme is a great example of their Union, but according to his boss, the ever-cheerful hon. Member for Moray (Douglas Ross), the Westminster Tories are not interested in their Union anymore. He says:
“The case for separation is…being made more effectively in London than…in Edinburgh”.
Is his boss right? Are the Westminster Tories full of defeatism about their Union? And if they do not care about their Union, why on earth should the Scottish people?
First, the new leader of the Scottish Conservatives cares deeply about the Union, and that is something that we cannot say for the Scottish nationalist party. But I would go further: he was making the very clear point that Westminster should not devolve and forget. Huge sums of money and support go to Scotland and other parts of the United Kingdom, and he was just pointing out that Departments in Whitehall should stay focused, stay connected and follow up on those funds.

Commons ChamberI congratulate my hon. Friend on his appointment as leader of the Scottish Conservatives. I was sorry to lose him as a Minister, but I got to know him well, and I know very well that he will do an excellent job. He does make a very good point. It is important that we come together to fight this virus and not go back into division and constitutional wrangling. That just basically creates uncertainty and is bad for the Scottish economy and bad for Scottish jobs.
May I just say ever so gently and candidly to the right hon. Gentleman that he is not presiding over the strengthening of the Union—he is presiding over its demise? Support for independence is now at an all-time high at 55%—but after today it is going to get a lot, lot worse for him. If there was ever any doubt that this Government were determined to override the authority of the Scottish Parliament, it is clause 46 of this disgraceful Bill today. Why does he not man up? Why does he not confess and be honest with the Scottish people and tell them that this is an unadulterated power grab?

Commons ChamberYes, I agree. I think Scottish Ministers need to wake up to the fact that we have left the European Union and we will leave the transition period on 31 December. I know that the Scottish Government do not like the outcomes of referendums when they do not go their way, but this is another one we are delivering on.
An opinion poll recently found that 63% of the Scottish people back a Brexit extension—that is on top of the overwhelming majority who oppose the Brexit disaster in its entirety—and the Secretary of State has probably seen an opinion poll that found that 54% of the Scottish people now want an independent Scotland. What does the Secretary of State believe links those opinion polls, and what does that tell him about where our country is heading?
I was going to say I was pleased that for once that the hon. Gentleman had not made it all about independence, but he managed to weave it in. I think the whole House would like to congratulate him on giving up his own independence by getting engaged last weekend.
The answer is that we had a general election and we had a resounding majority across the United Kingdom for a manifesto that said we would honour the result of the referendum. We are going to honour that result: we are going to take back control of our laws, borders and money and we are going to leave the hated common fisheries policy and become—here is the independent bit for the hon. Gentleman—an independent coastal state.

Commons ChamberThis is not the time for the Scottish fiscal framework to be opened up and looked at again. The UK Government have given huge support to the whole United Kingdom through the furlough scheme, the self-employed scheme, the bounce-back loans and the coronavirus business interruption loan scheme. There has been a huge package of measures to keep money in people’s pockets and to keep the economy as strong as it can be when we return to something near normal. Have I argued Scotland’s case? Yes, I have. We have an extension coming on 1 August, running to 31 October. I hope that we can get people back to work over that period and get the economy up and running, to save people’s livelihoods. While we are very focused on saving people’s lives, we must remember that after that comes saving their livelihoods.
It is so disappointing to see the Secretary of State and his “better together” shadow in the House of Commons in London today. Their Government are telling them to stay at home and not to travel unnecessarily, but there they are in the House of Commons today. The Secretary of State is right that virtual proceedings allow Scottish Members of Parliament to work from home, so why are the Government pulling the plug on the virtual proceedings today? He is the voice of Scots in the Cabinet. What is he doing to ensure that Scots’ voices continue to be heard in the House of Commons on behalf of our constituents and to allow us to do our work?
The hon. Gentleman might be jumping the gun on that, because discussions are ongoing between the Whips Office and the House authorities. I want to make it clear to him that we are not going to put anyone at risk. However, we have to recognise that if we are asking schools to go back and the public to go back to work, we should lead by example, and we should return to a covid-safe—I emphasise that: covid-safe—working environment.

The hon. Gentleman speaks in apocalyptic tones. Can he explain why the Scottish Government do not have a schedule to the Bill? Their refusal of any offers from the UK Government will leave us in a position where, in 2020, Scottish farmers will have no mechanism to enable them to receive their support payments.
I am grateful to the hon. Gentleman, because I was just coming on to that. I thought that he would perhaps lead me on to the key of this agenda—and the objections and screams from the Scottish Conservatives. We will not agree to a schedule to this Bill for as long as this Parliament and this Government fail to respect the devolution settlement and indulge in this grotesque grab of powers that should rightly belong in the Scottish Parliament. That is what has happened. As long as it continues to happen, and as long as the Secretary of State refuses to respect devolution, there will not be a legislative consent motion from the Scottish Parliament. We are happy to have common frameworks across the United Kingdom, as we have said again and again, but they have to be agreed and negotiated; they cannot be imposed. As long as he continues to approach devolution as something that he can control and manipulate, this is not going to happen. The sooner he gets beyond that mindset, the better things will be.
The key dispute, where I ask the Secretary of State to respond, is about the World Trade Organisation regulations in the Bill. In his view, everything to do with the WTO is reserved. Does he not accept that the administration of WTO terms is a matter for the Scottish Parliament? We do not have to take the Scottish Government’s word for that, because in a piece of very useful legal advice from NFU Scotland yesterday we learned that it is indeed the case. The advice says that
“Scottish Ministers will not have total freedom to apply domestic support as they see fit if the Secretary of State makes regulations setting limits in relation to WTO classifications.”
It also says that
“it would not be a legitimate use of regulation-making power to prescribe within the limits how Scottish Ministers would be able to exercise the powers to apply support.”
NFU Scotland agrees with us that WTO rules administration is a matter for the Scottish Parliament. [Interruption.] If the Secretary of State does not agree, what is his basis for not agreeing with the legal opinion of NFU Scotland?
