Commons ChamberFor once, I have great sympathy with the hon. Gentleman. That was why I chose to aim at the issue by saying that people could come here and work, but could not get full access to our welfare system for four years. That addressed the concern that his and my constituents have that there should not be something for nothing. The point that we have to understand is that European Union countries see the single market as consisting not only of the free movement of goods, people, services and capital. They see those things bound together, but they also see the single market as including the payments that countries make into the EU to strengthen the weakest members and those that have recently recovered from communism. Of course, one can try to negotiate amendments to these movements—and I did—but one has to think about that mindset as we go into the negotiation.
The Prime Minister will be aware that North Hertfordshire voted to stay in the EU. Many of our businesses rely on the single market, and many of my constituents work in London in insurance, financial services and legal work. Does he agree that part of this negotiation must be about the passporting arrangements that enable these service interests to do so well? I do not know whether that was mentioned at the European Council. May I also thank him for everything he has done?
I thank my hon. and learned Friend for his remarks. The issue of passporting will loom large in the negotiations because financial services are 7% of our economy and two thirds of the jobs are outside London. We are the financial centre for Europe—40% of financial services are in Europe—and we will be strong in that area whatever the outcome, but it is undoubtedly true that the passport does help British firms, and it helps other countries’ firms come to Britain. One of the reasons why the Swiss banks are here in such large measure is that they do not get passporting rights through Switzerland. This should be a very important feature; it is one of the aspects of what access to the single market actually means.

Commons ChamberWhat I would say to the hon. Gentleman—and to everyone—is that we must examine what the alternatives are, how much uncertainty there will be, and how long these processes will take. Therein lies the importance of this decision for businesses, families and people’s prospects up and down our country.
Does the Prime Minister agree that one of the key benefits of his agreement is to give legal clarity to Britain’s special status within the EU? He will be aware of the uncertainties there have been for those advising the Government on the law, which this resolves. Does he also agree that it is wrong to say that this is not legally binding when it is, and that it is irreversible unless we choose otherwise? For those who want to look at the legal niceties, I point to a very long opinion by Professor Sir Alan Dashwood, Queen’s Counsel, the leading EU constitutional lawyer in this country, which can be read on the Henderson chambers website.
I am grateful to my hon. and learned Friend for what he has said, given that he was a senior Law Officer in the Government. I have also listened very carefully to my right hon. and learned Friend the Member for Beaconsfield (Mr Grieve), who could not have been clearer on this point. I have also read the judgment by Dashwood and seen the Government’s own legal advice, all of which says that this is legally binding and irreversible. People who question that should look at the Danish protocol, which has been in existence and worked very well for 23 years.

Commons ChamberI have been very clear. If we can achieve this negotiation, I will work very hard to convince people that Britain should stay in a reformed European Union. That would be very much in our national interest. I am not an expert on JK Galbraith, but when people have serious concerns—as people in this country do about the levels of immigration—it is right to try to act to address them, which is part of what this is about.
I welcome the Prime Minister’s substantial progress towards an agreement that would allow us to stay in the EU, but does he agree that one of the most important aspects of such an agreement is that it is legally binding and provides a lot more clarity about Britain’s role within the EU—in terms of the new dispensation, and of existing treaties? That makes it extremely powerful from a legal point of view as it can be revoked only if we agree. It therefore has embedded force to it.
We have heard from the former Attorney General and the former Solicitor General, who have great legal expertise. The point that they make is right: this agreement will be legally binding on member states as a matter of international law. First, of course, it has to be agreed, but once it has been agreed, my hon. and learned Friend is absolutely right that it would be irreversible because it could be amended or revoked only if all member states, Britain included, decided to reverse it. Therein lies its irreversibility.

Commons ChamberI have studied the report carefully, and it says that the rise in adult poverty outlined by the report occurred on Labour’s watch. Since the election, we have seen 600,000 fewer people in relative poverty, 670,000 fewer workless households, and 300,000 fewer children in poverty. The other point about the report—I am sure the House will want to hear this—is that it covers only the income figures up to April 2013. It says:
“since the middle of last year, there have been huge increases in employment, which will surely impact on incomes and risks of poverty.”
That is absolutely right.
Q3. In my constituency, we are very proud of local boy, Lewis Hamilton. Will the Prime Minister join me in congratulating Lewis, Ross Brawn, who helped to design the car, and Mercedes? Does he agree that the British motor racing industry not only gives us a lot of entertainment, it also gives us jobs, engineering skills and British business success?
I certainly join my hon. and learned Friend in praising Lewis Hamilton. He is a young man with nerves of steel and huge ability, and he made everyone in our country proud. But my hon. and learned Friend is right: we should not just be proud of the drivers; we should be proud of the industry. All 19 of the Formula 1 races last year were won by British-built cars. This is an enormous industry for our country. There are 43,000 people employed in Oxfordshire alone in this industry. It is also worth remembering that it is not just Formula 1. I had a reception at No. 10 Downing street for the whole motorsport industry, and it is important to remember that that goes all the way from go-karting up to Formula 1, and Lewis Hamilton started off in a go-kart.

Commons ChamberLocal councils can put up CCTV cameras and they will continue to be able to do so. We can all see how effective CCTV is when we see people walking out of court trying to hide their face because they know that is how they got caught.
Does the Prime Minister agree with me that those who are found guilty of committing crimes during the riots should be forced to face up to the full consequences for both their communities and individual victims of the damage they have done? That means tough sentences, but should it not also mean reparation? Does he agree that those young people should be forced to listen while the victims of their crimes explain what the damage to communities means, the jobs that will be lost, the damage to buildings and the sense of tragedy that many feel?
My hon. Friend is right. We should use all means to bring home to those criminals the damage that they have done to their communities and to local people, and he makes a number of suggestions in that regard.

Commons ChamberI think it is difficult to bring forward specific legislation for a specific company; we have got to be a Government under the law. The hon. Gentleman shakes his head, but it is worth reminding Labour Members that a US-based company is able to purchase all of a UK broadcaster because of an Act that their Government passed.
I welcome the Leveson inquiry and agree very much with the Prime Minister that our focus should be on the innocent victims whom we have heard about recently, but he will be aware that there were concerns in the House that the hacking of telephones has impeded MPs in their work and interfered with freedom of expression, which is one of the most deeply felt and important aspects of our work. The Standards and Privileges Committee produced a report—its 14th report—on this subject. Will the Prime Minister ensure that it is fed into the inquiry and fully considered?
I will, of course, do that. This inquiry gives us an opportunity to look at some reports that a lot of work has gone into, but, sadly, that have gathered dust, rather than having been taken as seriously as perhaps they should have been.

Commons ChamberThat is absolutely the Government’s view. I had very good meetings with Premier Wen this morning and a lunch with him and there has never been anything in the Britain-China dialogue that is off limits, including individual cases. Nothing is off limits, but it is right to have the dialogue at both the leader-to-leader level and the human rights level. As I said, nothing is off limits and we have a very frank relationship.
May I thank the Prime Minister for standing up for the important principle concerning the Dublin process? Does he share my concern about the people traffickers who are stuffing unseaworthy boats full of people and casting them adrift in the Mediterranean? Does he agree that more needs to be done to patrol that area? Were there any discussions about positive moves to attack that problem?
There were long discussions about this issue because the Mediterranean countries in particular feel extremely strongly that we have got to do more to strengthen borders and Frontex, which can help to secure Britain’s perimeter. Britain is fully supportive of that, and we are not in the Schengen area, which means that we are protected from some of the problems that Schengen countries are suffering from. I think we have the best of both worlds—backing the action taken at Europe’s perimeter while at the same time being able to maintain tough and strict border controls for our own country.

Commons ChamberWhat is clear is that only one side in this House has a plan at all. The Opposition have absolutely no plan apart from to deny the deficit, to say there was not a problem, and to pretend that somehow they handed on a golden inheritance when in fact we had the biggest budget deficit of advanced countries and an absolute pile of debt to deal with.
Given the commitment of the coalition Government to reinvigorate occupational pensions, will the Prime Minister welcome the launch yesterday by the National Association of Pension Funds of its workplace retirement income commission, which is designed to produce proposals to improve the adequacy of pensions so that people can live with dignity and with enough money in retirement?
My hon. Friend makes a very good point. We want to see strong private sector pension provision. The history of that provision over the past 13 years has been depressing, because so much money has been taken out of the pension system, not least by the pensions tax that happened year after year, and which was probably proposed by the two people who now run the Labour party. We want to see stronger private pension provision so that people can have independence and dignity in their old age.

Commons ChamberThe hon. Lady asks a reasonable question. The Bill that we will be looking at will say that there should be a referendum on any transfer of power—a proper transfer of competence. As a general principle, the House should not give away powers it has without asking the people who put us here first. That is the principle that we should adopt. I do not want us to give any further powers from Britain to Brussels, so I am not proposing that we should. Further to answer the hon. Member for Vauxhall (Kate Hoey), I am not anticipating us having a referendum, because I do not want to see that transfer of powers. What is being proposed by the Germans and will be finally agreed at the December Council, yes, is a transfer of powers for countries in the eurozone. It definitely means that as well as having the euro, they will have more co-ordination of their economic policy, and punishments if they do not do certain things. That, to me, is perfectly logical if they are in the euro. It was one of the reasons why I did not want to join the euro in the first place and why, as long as I am Prime Minister, we will not do so.
Does the Prime Minister accept that it is welcome, if unusual, to see so many Heads of State supporting a British Prime Minister on an issue on which the European Parliament takes a different view? Does he agree that perhaps there is a role for national Parliaments, which, right across Europe, are facing difficult economic decisions, to support these Heads of State, including, of course, the Prime Minister, because it is right—
I hope the former Europe Minister, the hon. Member for Rhondda (Chris Bryant), will stay calm. My hon. Friend the Member for North East Hertfordshire (Mr Heald) makes a good point. Part of the problem in the past has been that other member states have not been as focused on the budget and the impact on their own publics as they are now. They are focused on it now because they all have to make difficult decisions. When we sit round the European Council table, we are often discussing what we are having to do with public sector pay, pensions or other difficult decisions, so there is a common interest which the Parliaments of Europe can help remind their Governments about.

Lady makes a very good point, which is that, in making spending reductions—whoever had won the last election would have had to make spending reductions—it is vitally important that we try to protect economic growth. The last Government were committed to 20% departmental spending reductions, and I can say—without, I hope, pre-empting all of my right hon. Friend the Chancellor of the Exchequer’s statement—that I hope she and the whole House will find that we have struggled hard but we have been able to freeze the science budget in cash terms, which is a good outcome for science.
Will the Prime Minister join me in paying tribute to the work of Save the Children and other charities that deal with development work in some of the most difficult places in the world? Does he share my delight in today’s news of the release of Frans Barnard in Somalia?
I do, and I am very grateful to my hon. Friend for raising this case. We have been in close contact with Save the Children over the kidnap of Frans Barnard, who is doing vitally important work on its behalf in Somalia, and we are delighted by the news that he has been freed by his kidnappers. Let me praise the professionalism of Save the Children and thank the Somali clan members who were involved in his release. I am sure that it will be good for him to be back with his family after what must have been a very frightening and difficult few days.

Commons ChamberI welcome the statement, but does the Prime Minister agree that one of the problems with delaying decisions over the years is that one ends up with a military strategy that does not meet modern threats? Does he agree that, for the future, it is vital to have a flexible, adaptive strategy that means that we are up to date with modern technologies, whether they are action in cyberspace, unmanned aerial vehicles, or other technologies?
My hon. Friend is right. One of the reasons for having more regular defence reviews is so that we force ourselves to ask these difficult questions more often. Where one can sometimes bring forward a programme that has been delayed, one should. That is what we are doing with the A400M because, frankly, we need to replace the ageing transport fleet, and the sooner we do it, the better.
