I support amendment 57, tabled by my hon. Friend the Member for Bristol East (Kerry McCarthy), along with several others, but I wish to speak specifically to new clause 9, which I have tabled and which is on the saving of acquired rights in Anguilla. I do not think there has been any discussion at all of Anguilla in any of the proceedings on the Bill so far.

Before Christmas, I tabled a written question to

“ask the Secretary of State for Exiting the European Union, whether the implementation phase of the UK leaving the EU will be the same for Anguilla as the rest of the UK; and if he will make a statement.”

On 22 December, I received the following answer:

“Both the EU and the UK have been clear that the Implementation Period will be agreed under Article 50 and be part of the Withdrawal Agreement. Both sides have also been clear that the Overseas Territories, including Anguilla, are covered by the Withdrawal Agreement and our Article 50 exit negotiations…In these negotiations, we are seeking a deal that works for the whole UK family, including Anguilla.”

So, there was no clarity there. It is not yet clear what is going to happen with respect to Anguilla.

Why is Anguilla important? We have debated at some length Gibraltar, which has around 32,000 residents. It is a British overseas territory that has been in the possession of the United Kingdom since the treaty of Utrecht in the beginnings of the 18th century. [Interruption.] Yes, indeed, it was 1713. According to the figures I have seen, Anguilla has a population of 15,263, and it has been a British possession since 1650. Just as Gibraltar has a border with an EU country—Spain—so Anguilla has a border with the EU, but with not just one but two EU countries.

Anguilla is in the north of the Leeward Islands, and 8 miles to its south is Saint Martin or, to use the Dutch, Sint Maarten. That island is part of two EU states: the northern 60% of the island has been French territory since an agreement in 1648, and since that same agreement the Kingdom of the Netherlands has possessed the southern 40% of the island. The island of Saint Martin has a complicated history that I do not intend to go into at length, but it is important to discuss its relationship with Anguilla.

Anguilla is one of five British overseas territories in the Caribbean, but it is very much more dependent on its relations with the European Union and with France and the Netherlands than any other British overseas territory. There is an international airport—Princess Juliana—on Saint Martin, but there is no international airport on Anguilla.

Anguilla is economically dependent on Saint Martin. The relationship is essential for Anguilla. The northern part of the island of Saint Martin, which has been since 2007 a French overseas collectivity, has a population of 38,286. The southern part of the island is one of the four kingdoms that make up the Netherlands, the others being Aruba, Curaçao and the Netherlands proper. France and the Netherlands have a different relationship with their overseas territories than the UK has with ours, and that has changed the dynamics. For example, in September the massive, terrible Hurricane Irma hit the Caribbean and wiped out whole communities and destroyed whole towns. President Macron flew very quickly to visit this integral part of France, where there is a tight, close relationship with the Netherlands.

This afternoon, the Foreign Affairs Committee, on which I serve, is discussing the overseas territories and the response to hurricanes. I hope to get to the Committee in time to hear a representative of the Government of Anguilla’s London office give evidence, but I cannot be in two places at the same time. I hope I will be able to speak in advance and ask questions later.

The population of Sint Maarten, the Netherlands part, is around 33,000, so the total population of the island to the south of Anguilla is around 75,000. It is much larger and much more important, so there are fundamental economic questions to be answered about what will happen when—if—the UK leaves the EU.

I actually think, in the case of Anguilla, it is because the Government have never even thought about it. Only now are issues like this coming up to bite them. We could have had an impact assessment on Anguilla. It would be nice to know whether there was such a thing; I suspect not. The Government did not give any consideration to these issues when they triggered article 50, so they probably did not even consider that.

In “Anguilla & Brexit: Britain’s Forgotten EU Border”, which was published last summer, the Government of Anguilla call for four things. First, they want a

“Common travel area between Saint Martin and Anguilla”,

and state that

“protocol 22 of the EU Treaties…provides that the UK and another EU member state…may continue to make arrangements between themselves for the free movement of people within the CTA.”

The same model is adopted for Ireland because of the historical relationships. A common travel area would be a way to prevent an economic and social disaster for Anguilla. In practice, it would mean free movement of nationals of the French and Dutch St Martin and Sint Maarten, and Anguilla, between those islands with a

“frictionless border without the need for passport control.”

It would also allow visitors flying into St Martin from any country in the world to go to Anguilla easily as tourists.

Secondly, the Government of Anguilla call for a customs union in the region

“with European countries, territories and municipalités in the eastern Caribbean.”

There has been a lot of talk about customs unions. I do not wish to repeat the debate that we have already had, as this issue will come back, but a customs union between the European Union territories in the region, the other countries in the region and the overseas territories of the United Kingdom could be really helpful in the Caribbean. Anguilla imports oil and other essential materials that it cannot exist without. It also exports fresh produce, which is predominantly sold to St Martin. There is therefore a real need for some kind of customs relationship that avoids tariffs and barriers.

Thirdly, the Government of Anguilla call for a

“Continued relationship between the UK and EU for the purposes of international development”,

as well as,

“Continued membership of the Overseas Countries and Territories Association of the European Union of Anguilla with full access to European Development Funds and support”.

Now, that may come at a cost. Are the British Government prepared to pay that cost in the negotiations? If they do not there will, as I have already suggested, be a major impact on the Anguillan economy and future development.

Fourthly and finally, the Government of Anguilla are looking to

“Stronger ties between Anguilla and Britain”.

This country has neglected our overseas territories for far too long. We do not give them the status that overseas territories have in France or the Netherlands. There is a wider issue that is not just about Anguilla and on which the Select Committee on Foreign Affairs may well comment after we have completed our current inquiry: we need a better ongoing relationship with these small communities of 15,000 people whose association with the United Kingdom goes back to the 17th century—longer, as I pointed out at the beginning, than the association of Gibraltar with the United Kingdom.

I strongly agree with the hon. Member for Ilford South (Mike Gapes) that the United Kingdom could strengthen her links and ties with Anguilla and could be very supportive as we go through Brexit. I trust that those on the Government Front Bench have listened carefully to what he has been saying. As far as I know, they have good will towards Anguilla. He mentioned some positive ideas about how the UK can help more and develop that relationship, which I welcome and which I suspect the Government may welcome.

I will respond briefly to the remarks of the hon. and learned Member for Edinburgh South West (Joanna Cherry). In her remarks—we have heard this in the many SNP speeches during the debates on the Bill—she referred again to the way in which Scottish voters had a different view from UK voters as a whole on the referendum and she implied that that had great constitutional significance. I urge her to think again. I pointed out to her that, had Scotland voted to be independent in its referendum, I do not think it would have mattered at all if, in a subsequent election—I think that there would probably have been one quite quickly—a lot of people in England had voted the other way and said, “No, we’d like Scotland to stay in.”

States cannot pool sovereignty. They are either sovereign or they have given their power away. The British people do not think the European Parliament exercises control or power over the Brussels machine in the way that this Parliament at its best exercises power over the British government machine. That can be seen from the way that the British electors do not turn out on anything like the same scale in a European election, because they do not believe in that Parliament and they understand that that Parliament has very limited influence over the unelected bureaucratic government in Brussels.

Now that we are in the EEC and it has evolved into the European Union, the fundamental condition that one Parliament cannot bind its successors has been removed. That has completely undermined one of the basic pillars of our democracy. We had the rule that any new Parliament can amend or repeal any law of a previous Parliament. It can reverse or change any decision relating to the future about the expenditure of moneys or the development of policy. The British people now do not have that full sovereignty. If they elect a new Parliament, the new Parliament discovers, as this one is doing, that there are a large number of areas where we cannot change things to reflect the will of the British people because it would be illegal under European law to do so. We find that, because so many vetoes have been removed, we can no longer prevent things happening from the European government that we do not want. Worse still, because there is a whole body of agreed European law and treaty that we inherit as a new Parliament and a new Government, there are very large areas where we cannot fulfil the will of the British people and we therefore cannot please them.

Fortunately, Britain still has a fairly powerful Parliament because we stayed out of the euro. Those countries that went into the euro are discovering that they now have puppet Parliaments. We see the terrible tragedy in Greece, where the Greek people have understandably said that they want a complete change of economic policy. They want to get away from unemployment and recession and austerity from the European Union and have a pro-growth policy at home, and they are told that they cannot do that because it is against European rules.

No, of course I did not, and I gave her very strong advice not to sign up to the Single European Act. She often took my advice. It was a great pity that she did not take my advice on that occasion, because I fear I was also right on that one. She was a very great lady who did hugely important things for this country—not least getting a lot of our money back, which Labour foolishly gave away, meaning that we are much worse off than we need be—but she was not always right. I think that on that occasion she thought it was going to help a market, whereas the truth, of course, is that we do not need European bureaucracy and a lot of laws to have a market; we just need buyers and sellers and one simple rule, which is that, if something is of merchandisable quality in Britain, it should be of merchandisable quality in Germany and France as well. We had that in the Cassis de Dijon judgment and we did not really need all the extra laws that were being imposed on us.

As we can no longer change things, the British people are going to get very frustrated. We saw their frustrations in the last election. Looking at constituencies that elected Conservative MPs and MPs of other parties, it was very clear to me that there was a strong majority feeling that this Parliament should be able to decide who comes to our country and who is given admission, and that this Parliament should decide how generous we should be on welfare benefits and to whom we should pay them. We might disagree among ourselves about how many people we invite in, how much money we give them and when we first pay them—that is a healthy part of our democratic debate—but the position we find ourselves in today is that we cannot decide those things, because the powers to control our borders and to settle our welfare system have gone to the bureaucracy and courts of Brussels and the continent. They are no longer present in the United Kingdom.

Whenever we have these debates, they often come down to a simple issue of trade. I would like to reassure anyone watching or listening to this debate that our trade is not at risk, whether we stay in or leave. There is no need to accept my word for that—I am sure that many people will not—but they may accept the word of the German Finance Minister, who has very clearly stated that he would like Britain to stay in, but that if we leave, of course Germany would want to trade with us on the same terms as she currently does. And why is that? It is because Germany sells us twice as much as we sell her.

I say to my right hon. and learned Friend the Member for Rushcliffe (Mr Clarke), who would not take an intervention, that there is no way that Germany would want to pay a 10% tariff on exporting Mercedes and BMWs to the United Kingdom; and, because Germany will not want to pay a 10% tariff, nor will our motor manufacturers have to pay a 10% tariff. So worry not: our jobs and our trade are in no way at risk.

We should remember that Britain has faster growing trade with the rest of the world, where we do not belong to a special club, than it does with the rest of Europe, where we do belong to a trade club. There are many such trade clubs around the world, but very few of them are evolving in the European way of imposing more and more government and bureaucracy on their companies and traders, because they believe in prosperity and more free trade. We do not belong to any of those clubs, but we trade extremely successfully with the countries that are in them. If someone is in a club that genuinely promotes trade, they are happy to trade with people from outside that club as well, because they obviously need to be able to trade with the whole of the rest of the world.

Many of us feel that the EU as currently constituted is thoroughly undemocratic. It stifles and prevents the will of a once-sovereign people from being properly expressed. It means that a Government cannot be elected on a prospectus that they can implement in all respects, because the European Union will not let them do so. Above all, the European Union represents the past: it is holding us back. It is something from the last century.

It is a complete myth that the European Union is a body that keeps the peace. The peace is being kept by NATO and by the fact that our partners—France, Germany, Italy and Spain—are all peace-loving democracies. I am amazed that pro-Europeans have such a negative view of our partner democracies in Europe that they think that, without a European bureaucracy, they would all be at war with each other. Of course, they would not, both because they now believe in peace themselves and because NATO and mighty America, as she has done since 1945, are guaranteeing the peace.

Let us get rid of these myths. Our economy is not at risk, and being out of the EU or in a better and new relationship with the EU is the future: it means we can be more prosperous, have more freedom and, above all, restore the sovereignty of the British people. We can restore our parliamentary democracy.

The Prime Minister’s speech last week was much delayed, much anticipated and over-hyped. It is already clear that the blip in the opinion polls is much less than he had hoped for. I therefore look forward to the internal debate in the Conservative party over the coming two years, and to the Prime Minister continuing to try to appease and assuage the egos of many Conservative Back Benchers.

I want to consider the so-called five principles and aspects of the Prime Minister’s speech. He said that

“we…need to address the sclerotic, ineffective decision making that is holding us back.”

Much of that sclerotic decision making in the EU happens because of unanimity rules. Can we therefore take it that the Prime Minister has called for more qualified majority voting? Conservative Back Benchers are shaking their heads, but Ministers cannot tell us the answer, because they do not know what the negotiating position will be.

Similarly, the Prime Minister questioned whether we can justify an ever-larger Commission, but the Commission gets larger because of EU enlargement and the accession of more member states. If the Prime Minister does not wish the Commission to become larger, the long-standing policy of successive Governments for further European enlargement has presumably been ditched. Alternatively, is the Prime Minister arguing that there should be a limit on the number of commissioners and saying that there might be future circumstances in which there is no British commissioner? We do not know the answer to that question because, again, the Government are unable to tell us.

Does the hon. Gentleman recollect that the Labour Government sold the pass on the number of commissioners by saying that not every state should have one? Perhaps that was one of the few sensible things they did to drive home the point that the Commission is a European government, not a representative government.

If my hon. Friend looks at Hansard, he will see that I was not blaming Britain for the problems in the eurozone, but saying correctly that our influence in the European Union will be reduced because of the misguided tactics adopted by the Prime Minister.

I will make some progress first.

As a result of the European Union Act 2011, the Prime Minister has boxed himself into a position in which there must be no potential for a referendum in this country. As he was trying to assuage his 81 Europhobic Back Benchers, he took the easy option of making a political decision rather than one in the national interest, which would have been to remain in the negotiations and to carry on trying to influence the outcome. As a result, when discussions conclude on the arrangements, if they are based on the fourth draft agreement—I quote the House of Commons Library Paper—

“the Heads of State or Government of contracting parties whose currency is not the euro who have ratified this Treaty and have declared their intention to be bound by some of its provisions”

would be invited

“to a meeting of the Euro Summit”.

However, those who did not agree to the intention to be bound by the provisions and were not participating would have no automatic right to attend. The Library paper states:

“This would appear to exclude the UK as a non-Euro, but crucially also a non-contracting State.”

There is a potential, therefore, for us no longer to be in the room, even as an observer, because of our misguided decision in December to walk away from the process.

I suspect that when the eurozone finally resolves the crisis, whether this week, which is doubtful, or on 1 and 2 March, which might be more likely, and when the 20 or so countries—perhaps 25 or 26, depending on how many of the existing 17 euro countries and the others eventually sign up to the package—agree to abide by the provisions, our influence will cease to be as strong as it has been. As a result, one other thing will develop: the pre-meeting discussions that take place within the European People’s party network, the conservative group that dominates the politics of the European Union—the right of centre, not the left of centre, are in control in the EU—the Sarkozy-Merkel meetings, or meetings involving Poland and the new right-wing Government in Spain, will not include the UK. When the bigger countries pre-cook the agendas, we will not be there and we will not be heard. That is potentially very dangerous.

Does the hon. Gentleman not understand that one has to pay to play? If we were in the room, the other countries would expect us to divvy up, as they are short of money.

More than half our trade is with the European Union. Our companies, and the future of the City of London and its relationship with the eurozone economy, are greatly affected by what happens in Europe. Those who want to move out to the middle of the Atlantic or who believe that somehow we can reinvigorate the Commonwealth and go back to imperial preference, are not living in the real world for the British economy. Our national interest is to have prosperity and success. As the Chancellor of the Exchequer has made clear, it is in Britain’s national interest for the eurozone to succeed and for the current crisis to be resolved. Clearly, Conservative Members do not agree with the Chancellor’s words. They wish to see the eurozone fail—[Hon. Members: “Rubbish!”] Well, the hon. Member for Gainsborough (Mr Leigh) seemed to say that. If he disagrees, he can intervene again. They want to see the eurozone fail because they believe that somehow that will be in the national interest of this country. It will not.

Of course the Prime Minister is right that we are in the European Union and all the time we remain in it we have to use our membership as best we can to protect the interests of the British people.

The main purpose of the summit must be to try to deliver greater prosperity and some growth and some hope to the peoples of Europe, because their hope has been depressed and their prosperity is being destroyed by a system that cannot conceivably work. The euro area is now locked into a system of mutually assured deflation, a mad policy, and the more those countries’ economies decline, the more the deficits go up, the more they have to cut. They cannot get themselves out by monetary means, in the way that the United Kingdom and the United States can, by creating more money in their system, and they cannot get out by having a competitive exchange rate.

If the right hon. Gentleman is so against the austerity deflation policies in the eurozone, why is he supporting the austerity policies of his own Government?

As I just explained, it is totally different if a country has its own currency and can use monetary mechanisms to try to grow its way out of the problems, and can establish an exchange rate that allows it to export its way out of the problems, which is exactly what these countries have to do, yet are unable to do because they are locked in.

I am sure that the hon. Gentleman has been here long enough to know that signing an early-day motion never succeeds in doing what we wish. Does he have any better ideas for saving our fish? I am with him in wanting to do so.

We need a general approach that recognises that the planet’s resources are finite, so we need to try our best to conserve them. In saying that, however, I am sure that I am moving well away from a clause stand part debate or indeed from a debate on any of the amendments to clause 6.

The hon. Member for Westmorland and Lonsdale (Tim Farron), who is no longer in his place, tried to explain why the Liberal Democrats support the Bill and clause 6 in particular. I was struck by the fact that the real reason for that support was not explained. The real reason lies in the fact that a party that is allegedly pro-European—and whose Chief Secretary to the Treasury used to work for the European Movement—has become very European in the sense of taking on the Stockholm syndrome.

The Liberal Democrats have been captured by their partners to such an extent that they have signed up to making a gesture towards the Eurosceptics, giving the impression to the hon. Member for Witham (Priti Patel) and others who would rather have an in/out referendum—she said as much in response to an intervention—that the proposals before us are highly significant. I suspect that, in many respects, they are not significant, but if they were, and if many referendums were to be triggered in respect of the list of items set out in the Bill, and particularly those in the amendments in the group, the cost of having them would be enormous. I refer not just to the costs of running the referendums, but to the costs of the litigation and judicial reviews that would be incurred—as usual, it would be the lawyers, not the British people, who reaped the financial benefit out of the provisions. We would simply have to pay for the processes brought about by these measures being incorporated into the Bill.

The hon. Member for Stone (Mr Cash), the Chairman of the European Scrutiny Committee, and I had an exchange about these issues on Second Reading. He seemed to agree that there are dangers in bringing about a large amount of litigation and in conferring extra powers on the courts, taking them away from our parliamentary democracy. What we face today is the potential for this to become a dog’s breakfast and a lawyers’ paradise.

Amendment 8, tabled by the Chairman of the European Scrutiny Committee, deals with the European financial stability mechanism. This would not only be costly; it would not be in this country’s national interest. As the hon. Member for Stroud pointed out, more than half our trade—I think it is 60%—is with our fellow EU member states. We therefore have a national interest in the success of the euro; we have a national interest in growth in the German, French, Danish, Dutch, Spanish and Portuguese economies, for example; and we have a national interest in the prosperity of the European region.

It follows that measures will be required to stabilise the financial institutions in the EU, to stop the collapse of banks, to deal with a crisis such as we have seen in Greece, and to deal with the change in the Irish Government that is likely to happen in the next few weeks or perhaps to respond to the welcome return to government of a man who was a Finance Minister under the excellent Labour Government in Ireland, Ruairi Quinn. In light of that, it will be in our national interests to assist the stability and success of the other European economies. Amendment 8 should be opposed vigorously, because it is not in the interests of this country.

The hon. Gentleman and I have been debating these issues for nearly 20 years. We have never agreed on matters relating to the European Union, and I do not think that we are going to do so now.

I do not believe that it will benefit our country if the European Union and the European economies implode, as the hon. Gentleman seems to wish them to do. Certainly there are problems in some—not all—European Union economies, and some, including the German economy, are growing quite rapidly. At the same time, the world’s economic centres are shifting, overwhelmingly to Asia but also to other parts of the world, and as a result we as Europeans will face a very difficult period in the coming years and decades. We need to think carefully about what will happen if the British economy is speculated against in the next 10, 15 or 20 years, and—given that the coalition Government are presiding over a return to recession—about what will happen to the long-term future of the economy if, as the hon. Gentleman wishes, the European economies fail and the European Union implodes.

I certainly do not want those economies to fail. However, if, according to the hon. Gentleman’s analysis, it is right to involve ourselves in economic governance and in mutual subsidies to protect our trade in physical goods with euroland, should we involve ourselves in the same way with the rest of the English-speaking world? Should we aim for stronger economic governance and more transfer of subsidies to protect our extremely important trade in services, most of which takes place outside Europe?
