Commons ChamberI totally agree with my hon. Friend. Joint working has been done on delayed discharges of care. It is about ensuring that there is good practice and sharing that more broadly. We are doing that equally in children’s social care, where the Department for Education is providing funding to ensure that that is better adopted. It is about good practice and looking at the outcomes. The simple binary approach that the Opposition take is, I think, mistaken.
Another issue on which the hon. Member for Denton and Reddish was fulsome was that of council tax. I want to remind Labour Members that it was the Labour Government who made ordinary families pay the price for their failures, with band D council tax more than doubling under Labour and families paying an extra £750. Even now, Labour wants to abolish the council tax referendum limit, which prevents excessive rises in council tax. It is all very well for the hon. Gentleman to suggest that he is on the side of ordinary hard-working families, but that is not what we saw from Labour in government and it is not what we are seeing now. The real price of Labour is that it always costs you more. This is not just about the cost of a Labour Government; it is also about what people are paying now. Households in Labour-controlled areas have to pay higher council tax to make up for incompetent collection. In the worst-hit areas, Labour councils have unpaid council tax bills of up to £100 million, which is the equivalent of £439 for every household. The 10 councils with the worst collection rates in England are all Labour-run.
It is true that Labour is promising £500 billion of extra spending, but what it is not telling ordinary hard-working families is that that will mean an increase in income tax and a doubling of national insurance, council tax and VAT. Those are not my words, but those of a former Labour shadow Chancellor.
The interesting thing about some of our earlier exchanges was the acknowledgement that the last Labour Government, going into the 2010 election, did not guarantee to protect local government. We have had to make difficult choices and confront difficult issues to put the public finances back on an even keel, and that has not been easy. I pay tribute to the innovation that councils have been engaged in up and down the country to help us to put this right. It is telling that there was no acknowledgement of that in the hon. Gentleman’s opening remarks.

I would point to the additional funding that the rough-sleeping strategy seeks to deliver on the very important elements that are focused on providing support on mental health and other health services, because those issues do, very directly, matter. The rough-sleeping strategy is not set in stone. I have said that there will be annual reviews of the strategy, because I know that we need to respond to changing evidence and changing circumstances. I am determined that where further steps are required, we will take action.
Lewes District Council has a new homelessness outreach team that visits people who are rough sleeping. I welcome the £100 million for the rough-sleeping strategy, but does the Secretary of State not agree that many of the budget cuts to local government, which have reduced mental health services and help for ex-offenders and those with addiction, have cut preventive work to the bone, and that local government needs that funding to be able to prevent rough sleeping in the first place?
I hope that my hon. Friend will recognise the provisional statement that I made last week on local government finance, which gave a real-terms increase to local government for the 2019-20 financial year, and indeed provided £650 million of additional support for social care and dealing with some of the most vulnerable to whom she is very firmly pointing. In making her points, I hope she recognises that we have listened to a number of the concerns of local government in seeking to provide that additional finance. Obviously, I will continue to make the case as we look to the spending review next year.

Commons ChamberWe intend to provide guidance on those issues. I do not accept that that would automatically be the situation. It is why we have taken the steps that we have in considering what the right action should be in setting a number of these issues. It is important to recognise that the Bill proposes a number of enforcement measures that offer a strong deterrent to irresponsible agents and landlords, and in doing so protects tenants.
Does the Secretary of State agree that this is very much a geographical issue? In London and the south-east, tenants have really suffered at the hands of lettings agents and their fees. Tenants can pay anything from £175 to £900 just in fees alone. My local citizens advice bureau in Lewes found that on average tenants are paying, for eight weeks’ deposit, nearly £4,000 in advance. This is a real problem for London and the south-east.
My hon. Friend highlights the issues that go to the heart of the Bill—that is why I hope that it will command broad support across the House.
The Bill places a duty on trading standards authorities to enforce the measures it contains. It also makes provision to enable tenants and other relevant people to recover unlawfully charged fees. It prevents landlords from recovering their property, via the section 21 of the Housing Act 1988 procedure, until they have repaid any unlawfully charged fees. A breach of the fees ban will usually be a civil offence, with a financial penalty of £5,000. However, if a further breach is committed within five years this will amount to a criminal offence. In such a case, local authorities will have discretion about whether to prosecute or impose a financial penalty. Guidance on that will be issued. They may impose a financial penalty of up to £30,000 as an alternative to prosecution. Local authorities will be able to retain funds raised through financial penalties, with the money reserved for future local housing enforcement.
Finally, the Bill makes provision for a lead enforcement authority to provide oversight, guidance and support, with the enforcement of requirements on letting agents. This includes the ban on letting fees and related provisions.

Commons ChamberI do not agree with the hon. Gentleman’s assessment in relation to the European Union and the steps that lie ahead. Again, I underline my sense of continued engagement and focus in ensuring that the voice of Northern Ireland continues to be heard and helps to shape the best possible outcome for Northern Ireland as we look to our departure from the EU. The hon. Gentleman speaks about the process moving forward, and I can assure him of the focus on intensification and on seeing that we get a more inclusive approach to the talks ahead, because that will provide the strongest possible foundations in getting that positive outcome and getting the Executive back on their feet again.
With article 50 to be triggered in the next 24 hours, and the impact of that on Northern Ireland being quite significant, will the Secretary of State outline what representations have been made on behalf of Northern Ireland at the Joint Ministerial Council so that the people of Northern Ireland are not left behind in the Brexit negotiations?
My hon. Friend properly highlights the role the Executive have played to date, and I would again point to the joint letter signed by the then First and Deputy First Ministers about the priorities for Northern Ireland, which has helped to shape our response and thoughts on this issue. Yes, there are significant issues in respect of the border, and there are other issues, such as the single electricity market and agrifoods. There is a range of issues that the Executive have underlined, and those have been very much in our thoughts as we prepare for the days ahead.

Commons ChamberThe Government are committed to the resumption of devolved government in Northern Ireland, and I believe that the parties and the Irish Government share this commitment. Later today, I will return to Belfast to continue intensive discussions to establish a partnership Executive within the short timeframe available. Progress has been made but it needs to continue, with urgency, if we are to achieve a positive outcome.
As a nurse, I am acutely aware of the need for the Northern Ireland Executive to set a budget to ensure that public services, particularly health services, are adequately funded. Without an Executive in place, that is almost impossible. Does the Secretary of State share my fear that the failure to restore the Executive is putting Northern Ireland at severe financial risk?
My hon. Friend highlights some of the issues surrounding setting a budget for Northern Ireland, which is a key priority. She highlights the health service, and I pay tribute to all those who work in the health service in Northern Ireland. They do an incredible job. There is a sense of the real potential and opportunity that a new Executive can take forward, and we must equally reflect on the £120 million identified in last week’s Budget that an Executive could invest, through to 2021, to really take Northern Ireland forward.

Commons ChamberIt is unhelpful to talk about either the suspension of devolution or direct rule—that is entirely premature—as the tone of the hon. Gentleman’s point and the way in which he made it suggests. If we are not able to reach a resolution in these next seven days, the next stage is for an election to be called. As I have indicated, it is likely that that election will be divisive, difficult and tough, and therefore the ability to reach a resolution at the end of it may be very challenging. That is why we need to use the time we have now to address a number of the points raised.
The Secretary of State’s statement touched on the possibility of an impartial inquiry into the energy deal. Will he give a bit more information about that and the timescale involved? With possible elections looming, will such an inquiry happen quickly?
Ultimately, that will depend on the Executive and the parties in Northern Ireland reaching a resolution on it. As I have said, this is entirely within the devolved space, so it is right and proper that a solution should be created within that environment. Equally, this underlines the need for us to get on with it, where possible, to give that sense of assurance, to respond to the concerns that have been raised and to show where accountability may or may not rest, depending on the evidence that emerges.

Commons Chamber8. What steps she is taking to ensure the security of the UK border at Newhaven port.
Border Force officers in Newhaven maintain 100% checks of arriving passengers and undertake intelligence-led activity to tackle both people-based and commodity-based threats. They collaborate effectively with the police, the National Crime Agency and their French counterparts in Dieppe to identify and disrupt attempts to smuggle migrants and commodities into the UK illegally through that port.
I thank the Minister for his reply. I recently met Newhaven Port Authority to discuss the future of the Newhaven ferry, and I was told that last year was its most successful ever, with a 50% increase in passengers and freight. That is welcome, but it is putting extreme pressure on the existing Border Force officials. Will the Minister reassure me that this Government are doing everything they can to ensure that this vital travel and trade link is kept secure?
I congratulate the port operators on the work they have done to see the success that my hon. Friend has highlighted, and I am sure her work has given them support, too. I assure her that Border Force’s model operates not only to ensure that we have the necessary core team to tackle business-as-usual activity, but to surge additional resource, in line with intelligence, where we have identified particular threats.
