Lords ChamberMy Lords, the Question of the noble Lord, Lord Hylton, is topical for the worst of all possible reasons—we have heard of another appalling atrocity this weekend. I am sure that the Government are very concerned about these terrible reports of slaughter after slaughter, but will the noble Lord tell us whether, the Annan plan notwithstanding, any thought is being given to the creation of safe havens on the borders of Syria, where people can go when they feel that they are in such appalling danger? I am sure we all feel that this is a terrible situation, but we seem utterly stuck in it.
I can understand the noble Baroness’s feelings. On the broad issue, Kofi Annan is now in Moscow pressing the Russians who—with the Chinese—are a key part of this story, so that we can move to a Chapter 7 UN resolution. As for safe havens, of course thought is being given to these matters, but the noble Baroness knows that for them to be policed and operated on Syrian soil means the involvement of personnel and conditions inside Syria which simply do not exist at the moment. They would involve much higher risks and many more dangers than we face even at present. As to safe havens, the authorities in Turkey have created some refugee havens and areas to which many people have crossed the border and entered. However, safe havens and corridors within Syria have been considered but are not a realistic possibility as we see it at the moment.

Lords ChamberWell, it is not quite pointless. As my noble friend knows well, China, although reluctant to commit itself to legal binding global agreements for which some others have argued, is in fact investing enormous amounts in decarbonisation and low-carbon technologies. It is working very closely with the United Kingdom and our technologies and developing in those areas. All these are very valuable moves forward in the decarbonisation movement and, one hopes, effective moves worldwide against climate violence in the future. I think there is value in this.
The pursuit of international global targets that are legally binding is going to be a very uphill task in relation not merely to China but to other countries as well. The general message coming to us from Beijing and the vast Chinese industrial machine is that they are well on the path to low-carbon technologies, and we are going to work with them on that.
My Lords, I draw attention to my declaration in the register of interests. Is it not true that these are largely state-sponsored Chinese acquisitions? They very often come with promises of collateral benefits for the growth of infrastructure in the countries concerned, such as railways and roads. Have the Government done any assessment of the level of delivery from the Chinese on these collateral benefits? There is evidence that much is promised that will go along with access to these mineral resources, and very often not much is delivered. Would the Minister initiate looking at the evidence for what is really the benefit to the country concerned?
We follow these things very closely. The noble Baroness is entirely right that in some cases the benefits have disadvantages attached to them. I am not talking so much about their failing to deliver fantastic new developments in sports stadia, schools, railways, government offices and so on, although that certainly happens. In other areas, the benefit for local people turns out to be non-existent because labour is just imported from China and taken away again. There are lessons to be learnt by our Chinese friends, which, again, we can possibly help with, on the basis of our own experience in the past, as to how to conduct operations that bring real benefit to local people and do not just leave them feeling that they have been ripped off.

Lords ChamberI am sorry to hear that. The Harare principles, and another whole series of declarations, are those drawn up by the Commonwealth network—that is, the Commonwealth at its Heads of Government Meetings—over the years. The Commonwealth today is a completely modern network, which is engaged at this moment in developing an even more ambitious charter that not only asserts the commitment to democracy, the rule of law, good governance and respect for human rights, but sees that these things are effectively policed so that the Commonwealth is a network of nations that uphold the values that we admire most.
My Lords, will the Minister tell the House whether the Government discussed with the Pakistani Prime Minister the problem of young British Pakistanis—young men as well as women—who are taken to Pakistan by their parents for the purpose of forced marriage? If it was raised, what response did the Government receive?
I do not have that on a specific list of issues that were raised in the meeting to which I referred. However, it is certainly a matter that is on our desks and we raise it in dialogue with the Pakistani Government. I cannot be more specific than that, but if I can find a more specific answer I will convey it to the noble Baroness.

Lords ChamberThat is certainly possible. The position vis-à-vis the International Criminal Court is that the commission of inquiry of the UN, as I think the noble Lord will know, clearly stated its concerns that crimes against humanity have been committed in Syria and that this may be a matter for the International Criminal Court. The United Kingdom will not rule out referral to the International Criminal Court, as suggested by Mrs Pillay, the human rights commissioner. The COI report does not specifically recommend a referral to the court, nor does the Human Rights Council have the power to refer cases. It would be for the UN Security Council to refer the situation in Syria to the ICC prosecutor. That is the formal position and I must stick closely to those words about it.
My Lords, is not the difficult thing that human rights abuses are being carried out every day? Does the noble Lord have any information about the appalling report that boys over the age of 11 are being arrested and face a very uncertain and horrible future in the city of Homs? Does he agree that, without the courageous reporting of people like the late Marie Colvin, we do not have the information on a day-by-day basis? We have it only retrospectively. What we need to know is what is happening while it is happening. Can the Minister give us any information about what our colleague, the noble Baroness, Lady Amos, has been able to say following her visit to President Assad?
I have to agree with almost all that the noble Baroness says. Our friend, the noble Baroness, Lady Amos, has, indeed, been there and did get some access to Baba Amr. She has reported back to the United Nations in very grim terms about what she found; practically every building had been destroyed. As for the other news we get— inevitably not directly because of the access problem and the fact that not a single journalist alive remains in the area—that may well be true. There are clearly horrific events and horrific murders and atrocities taking place. Not every one can be corroborated, but it is unquestioned that there are evil doings almost beyond the power of words being conducted in the name of the Syrian Government and perhaps on the opposition side as well. These are revolting events and in due course I hope all responsible will be held to account for them properly.

Lords ChamberMy Lords, can the Minister tell us what action the Government are taking over the abhorrent policies in some countries to exact the death penalty on young people under the age of 18?
I suspect that the noble Baroness is referring particularly to some of the horrific stories from Iran. We regard those with horror, and we continue to press extremely hard, in line with our general desire to see the abolition of the death penalty worldwide, where those kinds of particularly repulsive and ugly penalties are inflicted.

Lords ChamberWe are concerned about the matter as well. There is some evidence that some relief is being organised, but the situation remains far from satisfactory and we will keep a very close eye on it.
My Lords, following on from the excellent question of the noble Baroness, Lady Falkner of Margravine, can the Minister tell us what direct support the Foreign Office is able to give through financing the work that the Westminster Foundation for Democracy was doing in Libya, as well as that of the Law Society, which was engaging on some of the very points that the noble Baroness raised, on judge training and establishing the rule of law and functioning courts?
We support all these aspects. As I think the noble Baroness knows, although there was a dip in the funding for the Westminster Foundation for Democracy, there has been a modest but welcome increase for the current year. That reflects our belief, which we share with her, that its work is an extremely valuable part of the scene. As to the Law Society and other non-governmental but very important operations of the kind that she has mentioned, these are things that we encourage. We should certainly look at and develop judge training. We are looking at projects in civil society, electoral preparations, prison reform, asset tracking and public financial management. We are supporting the role of women through funding the first women’s convention in November; we are helping the Libyans strengthen their institutions and restore public services. There is a whole list of other areas in which we are involved. All these are very important. We want to see Libya emerge as a stable, democratic country, bringing peace and prosperity to its much benighted citizens.

Lords ChamberThis kind of approach would be very good, if we could get Iran to recognise that it must conform to the IAEA requirements and if we could have some trust and reassurance that it is not moving surreptitiously to the full weaponisation of its nuclear programme. If that assurance was there and if Iran was prepared to talk, we could certainly develop closer relations with what, after all, is a very great country that deserves respect—although it forfeits it by some of its actions—for its history and prominence in the region, and we could move in that direction. However, to get Iran even to come to the table on that basis has so far proved impossible.
My Lords, I regret to say that I very much agreed with the Minister when he rightly said that whichever part of the Iranian Government one looks at believes that Iran has the right to develop nuclear weapons. The problem with that is that it does not stop with the conflict with Israel; it drips into the conflict right across the Gulf, including, as he said, Saudi Arabia. Perhaps I may ask him about the short-term issue of access to oil. Can he tell us anything about Saudi Arabia’s undertaking to make up the shortfall in any Iranian crude, and whether its undertaking to try to hold the international price at $100 a barrel has been dealt with officially by Her Majesty's Government and that of Saudi Arabia?
We cannot yet to talk in terms of undertakings, but there have been indications. Obviously it is up to Saudi Arabia and other major oil producers in the region, such as Kuwait and the United Arab Emirates, to undertake to make up the shortfall. The indications are that this will be possible but we are not yet at the stage where I can say that undertakings have been officially agreed; they have not.
There is also a problem of matching the quality of oil concerned. As the noble Baroness knows, although the Iranian oil that Greece, for instance, has been heavily reliant on is slightly sour, the make-up oil from Saudi Arabia would be considerably sourer and would carry a much heavier sulphur content as well, so there would be difficulties for refiners. The usual complexities that arise when one moves oil flows around inside the oil market would occur, of the kind that I have just described. Therefore, I cannot say that there is a neat package of additional oil supplies ready to come into place. One has to realise that the Iranian oil does not necessarily disappear; it will not stop being produced and will probably continue to enter the market, although one imagines at a certain discount in relation to the major customers such as China.

Lords ChamberMy noble friend is absolutely right about the first point. The peoples of Europe, the communities of Europe and the interests of Europe are binding more and more closely together in the internet age and in the age of the information revolution, but the question of how this resolves at governmental level is obviously much more complex. She is absolutely right about that. As far as the financial transactions tax is concerned—the so-called Tobin tax—Her Majesty’s Government’s view is that if this was a universal tax, the chances of which are frankly pretty remote, it would begin to make sense to apply it, but that if it was merely going to be for the European Union or even for selected countries in the European Union, it would not make much sense at all. That seems to be a view that increasingly the Germans are sharing.
My Lords, if what the noble Lord says is true, that everyone throughout the European Union agrees that there are better arguments for the future, why were we left isolated on 8 and 9 December? Why did nobody agree with us then?
The precise issue was that the safeguards against additional incursions into financial interests, of which this country holds a very large proportion in Europe, were not going to be agreed. This led my right honourable friend the Prime Minister reluctantly to say that he could not agree to the kind of treaty being proposed. The other 26 countries are looking at it—as are we, in participating in the current operations and examination—and are finding out whether it works for them. I am not sure that in the end either the 26 or even possibly all 17 countries will be really prepared to go along with every detail of the treaty so far. However, a new draft has been produced that already begins to adjust somewhat to the concerns that my right honourable friend voiced and that other countries have expressed as well.

Lords ChamberThere is no room for satisfaction either in our own minds or, as I understand it, in the minds of the Egyptian Government. A government commission has been appointed to examine the situation, but on 12 October my right honourable friend had a detailed conversation with Mr Amr, the Egyptian Foreign Minister, during which he urged him most strongly to establish the facts and, in the words of the Egyptians, to see what went wrong. There are several different versions of what occurred, but the clear result is that many people died. This kind of violence is completely unacceptable. As my noble friend will know, we have a very close dialogue with Egypt at the moment. We are involved in a helpful and supportive way—not interfering but encouraging and supporting the de-escalation of the situation, the restoration of law and order, the call for civilians not to be tried in military courts and the removal of the state of emergency. The dialogue and the pressure are there, and I believe that the Egyptian Government realise that this kind of appalling event will greatly damage their future and must on all accounts be prevented and avoided.
My Lords, is the Minister aware of reports that judges in some Egyptian courts are refusing to accept evidence from Copts? Does he know if there is any truth in such reports? If he is not aware of them, would he be kind enough to make inquiries and write to me?
Assessing the truth of these reports is difficult, but one proposition that we have offered in support of the situation in Egypt is that civilians should not be tried in military courts. That is not quite the point that the noble Baroness made, but it is related. As for the question about their judgments, I will make further inquiries and see if I can illuminate my answer.

Lords ChamberMy Lords, Trinidad and Tobago has just been through the UN universal periodic review process, looking at human rights across the board. It has also announced the abolition of the death penalty for felony murders, although that does not meet the problem that my noble friend rightly raised. The United Kingdom raised the issue of the death penalty during that UN review process. I observe that the debate over the death penalty in Trinidad and Tobago is closely linked to problems of serious crime and a related state of emergency, as my noble friend indicated. The UK has seconded a criminal justice adviser to work alongside the Trinidad and Tobago Government. That is all I can tell my noble friend at the moment.
My Lords, one of the most repellent aspects of this issue is when the death penalty is used against young people under the age of 18. The Minister spoke of progress in his initial answer. Can he tell us whether any progress has been made in respect of approaches to Iran over its use of the death penalty for crimes of a so-called moral nature, particularly for young women under the age of 18?
I must confess to the noble Baroness that I find it difficult almost to find the words to express my disgust and contempt at the news coming out of Iran, in this case relating to the execution not of a young girl but of a young boy. I was appalled to hear of that execution, which was conducted in the most revolting way. He was subjected to the worst form of execution—suspension and strangulation—in front of a public crowd. The president of Iran has said that Iran does not execute children under the age of 18, but that appears to be contradicted by that horrific event, which contravenes the international obligations to which Iran has signed up. We have of course raised this case with the Iranian authorities and will work extremely hard to secure a strong resolution on human rights in Iran at the UN, which will include language on the use of the death penalty in Iran. However, I feel that the words that I am uttering are hardly adequate to express the horror that we all feel.

Lords ChamberThe quartet, alas, in its recent meetings found itself unable to establish even enough agreement for a statement, so this indicates the continuing difficulty, tensions and disagreements underlying this whole scene. The noble Lord is absolutely right about the creation of facts on the ground, which are obviously an obstacle to a return to negotiations and a serious impediment to the long-term prospects for peace. It is particularly concerning that the building of settlements and these demolition programmes in East Jerusalem, which are illegal, are continuing, particularly the very provocative building and demolition operations going on in the Sheikh Jarrah district. I have to agree with the noble Lord, but these are matters that we keep raising with the Israeli authorities. These are not just UK matters; they concern all countries that want to advance the peace process, including of course the United States.
My Lords, the noble Lord said that Mr Burt raised the hope of the United Kingdom Government that there would be negotiations, but he was not explicit about how the Israelis responded. He has implied negativity but has not been explicit. Can he explicitly tell your Lordships’ House what the Israelis did say in response, and, if it was negative, does the noble Lord really believe that there is any realistic possibility of negotiations with a Netanyahu-led Government?
I was not explicit because, as the noble Baroness will know—she is better equipped than most of us in these sorts of areas—what one often gets when making representations that are not welcome to the recipients is a shrug of the shoulders and a polite nodding of the head but no action. I am afraid that the most visible action is of the opposite kind—buildings have continued to be demolished, which gives rise to a question about the prospects for progress.
No one can disguise the fact that most of the responsible world—the Arab world, the western world, the European Union, the United States, the UN—believes that the present fluidity and turmoil in the region provides an opportunity for Israel and a Palestine that we hope is moving towards a united Government, although it is not there yet, to start serious negotiations. That is what we want, but it has to be said that this has appeared not to be the opinion of the Israeli authorities at the moment. Their inclination appears to be just to hunker down and hope that something else will turn up.
It is not a situation in which we are optimistic. None the less, we think that continual pressure and the continuing presentation of the realities of the destructive path on which an Israel that refused to negotiate would set itself will eventually move things, but I cannot pretend that it will happen tomorrow morning.

Lords ChamberThis Question is about Yemen. We certainly aim for even-handedness in pursuing our own principles and values but, unfortunately, as every country has different situations that require delicate and different handling beyond the general principles, we have to appreciate, respect and understand the inner workings of these countries to be effective.
My Lords, the situation in Yemen has been very grave—it has been a fragile state—for a long time. We all owe a debt of gratitude to those members of the Foreign Office who are still prepared to stay in the embassy, given that it has come under attack on a number of occasions. I know that this is very difficult, but, given that we know that Yemen will be the target of groups such as al-Qaeda, will the Minister assure us that in the possible eventual absence of British personnel on the ground, none the less we will be able to monitor properly what is going on in Yemen and not leave it solely to Yemen’s neighbours to pass information to us? I hope that the noble Lord can give us that assurance, without going into detail.
That clearly would be the ideal. I cannot go into precise contingency arrangements for the channels and passage of our information. Obviously, we need to get high-quality information of the best kind. On the question of al-Qaeda involvement, there is constant concern that al-Qaeda training groups are operating in the area. Some people have an interest in pursuing and purveying the story in one way and others in presenting it in another, so getting accurate information is bound to be difficult. Of course, the noble Baroness, with her considerable experience, is right to urge that our channels of information should remain as good and direct as we can possibly engineer.

My Lords, today in New York, Britain and France, along with Germany, are asking for Security Council support for a resolution condemning the repression in Syria and calling for the Syrian Government to meet their people’s legitimate demands, release all prisoners of conscience, lift restrictions on the media and the internet and co-operate with the UN High Commissioner for Human Rights. The violence being meted out against peaceful demonstrators in Syria is an appalling response to the people demanding their basic rights and freedom. It is time for the Assad regime to stop the violence and reform or step aside.
My Lords, I thank the Minister for that very full response—but is it really enough? There are hundreds of Syrian civilians who have died in terrible circumstances; worst of all is the report of a 13 year-old boy who was tortured, emasculated and murdered. There are thousands pouring over the Turkish border and reports of police officers being executed for refusing to fire on crowds of civilians. Does not the Minister believe that the situation in the town of Jisr al-Shughour is so like that in Benghazi that similar measures should be taken to protect the civilians there? Does he agree with the French Foreign Minister, Alain Juppé, with whom the British Government are sharing the platform today, who said that the process of reform in Syria is dead and that Syria’s president has lost his legitimacy to govern?
The noble Baroness is absolutely right that the situation is far from getting better: it is getting worse. The reports of atrocities are disgusting. We have all been shocked by the news of the apparent treatment of a young child—indeed of many young children—in the mayhem of violence. All these questions are being debated today at the United Nations. We and the French—the noble Baroness mentioned Monsieur Juppé—are putting forward sentiments very similar to those that she suggested. It is a question of carrying all opinion in this direction in order to get effective co-operative and co-ordinated action. Not everyone, particularly in the Arab world, has yet reached the point where they have united in seeing that further measures are required beyond those that we are already proposing. I myself was able to consult with a number of Arab and Gulf leaders last week in that region and had some mixed opinions on whether this was the time for more forceful action. The noble Baroness can be assured that Her Majesty’s Government hold this matter in the strongest-possible and deepest concern. We believe, and fear, that stronger measures will indeed be needed.

Lords ChamberI have not had reports this morning about the first point that my noble friend raised, but obviously there is concern in all the international bodies about what has been happening. As I have said, we have urged the Government of Bahrain to create the environment in which a dialogue can take place. This is the pressure being put on the Bahraini authorities at the moment and we intend to pursue it. The issue of taking wider action at the UN has not arisen and, at the moment, there is no sign of organised support for any movement of that kind. But, obviously, these matters are always in our minds.
My Lords, does the Minister agree that the situation in Bahrain is very complex and different from a lot of the other centres of unrest that we are witnessing in the Middle East, not least because of the problems alluded to by my noble friend? There is the Shia-Sunni conflict, the problem of outside influences and, indeed, tensions within the Bahraini Government themselves. Would the Minister consider chairing a meeting of those of us who are interested in Bahraini issues so that we might have an opportunity to discuss some of these issues in perhaps greater detail, perhaps with some briefing as well from the Foreign Office? I think that that would be immensely helpful and I would be grateful if the noble Lord would consider doing it.

Lords ChamberMy Lords, I should like to talk about Clause 3 standing part of the Bill, if that is agreeable to your Lordships.
The EU factsheet that the Government put out stated that the Bill is designed to strengthen the connection between the British people and the European Union. Actually, Clause 3 seems to be almost perversely designed to do the exact opposite of that perfectly reasonable ambition. The noble Lord, Lord Waddington, who, sadly, is not in his place, said that those of us who had supported the amendments to Clause 3 were in denial about the lack of popularity of the European Union. I am afraid that that is simply not true. I agree with much of the diagnosis about the EU’s lack of popularity, but I absolutely disagree with the treatment that the Government are putting forward by means of Clause 3.
The exceptions to the referendum lock are very limited. On most issues, that lock is unbreakable, as was pointed out earlier. It is enormously strict, and the purpose of the amendments has been to give Parliament greater flexibility in respect of whether or not a referendum is necessary. The Government are on record as saying that referendums should be kept for exceptional issues and important decisions that ought to be taken on a nationwide basis.
In an earlier debate in your Lordships’ House, the noble Lord, Lord Williamson of Horton, described this as a “watershed” Bill. The measures in Clause 3 are watershed measures that need to be tempered by greater flexibility—the sort of flexibility that the amendments provided for—that will maintain the authority of this Parliament, which would otherwise be hugely undermined. We are a parliamentary democracy; that is the basis of our government. This Bill drives a coach and horses through that concept.
The noble Lord, Lord Hannay of Chiswick, said that it cannot be denied that the frequent use of referendums will seriously damage the legitimacy of Parliament. I think that the situation is much worse than that. The measures in Clause 3 will engender enormous cynicism among the British people if they are asked to take part in referendum after referendum, as the noble Baroness, Lady Williams of Crosby, said. Worse, there will be not just cynicism, but ridicule—the worst of all possible weapons that can be used.
In time, Parliament will recognise that that is the case and will probably, therefore, avoid using referendums. The noble Lord, Lord Waddington, said earlier that he would welcome avoiding such referendums, because it would mean that a block on EU decision-making could be made. Of course we may be able to block EU decisions in order to avoid a referendum, but other countries may have decided to go ahead under the enhanced co-operation provided for in the Lisbon treaty. The Minister has not answered that point. There is no such thing as an absolute block in many areas because of the provisions of the Lisbon treaty in allowing for that enhanced co-operation, and I should be grateful if the Minister said a little more about those provisions and the likelihood—indeed, some would say, the inevitability—of them being used. If that is the case, this country would be pushed to the margins of Europe again—as a result, distancing the British people even further from Europe and even further from the objectives that the Minister so passionately espoused when putting forward the Bill.
The amendments that we discussed today have been designed to provide that greater flexibility and to give Parliament the ability to look at what really merits a referendum and consider the serious issues on which the people of this country, on a nationwide basis, should be called upon to take decisions. Somehow the impression has been given—notably by the noble Lord, Lord Waddington—that if the United Kingdom blocks a measure, that is the end of it. Those of us who went through the Lisbon treaty know that that simply is not true. On this issue I look particularly at the Liberal Democrat Benches. They are good Europeans. I regret to say that in many ways they have been better Europeans than my own party. That is the truth of the matter, and that they can go along with these sorts of measures in Clause 3 frankly beggars belief.
My Lords, we have discussed the principles and details embraced in this clause at some length and I am grateful for the additional points that have been raised in the stand part debate.
I apologise straight away if the noble Lord, Lord Stoddart, thought that I cut him short or intervened as he expressed his very sincerely held views. I thought that he had commented earlier but I am very glad that he has now had an opportunity to speak. He raised issues that go wider than the Bill, although they are not totally unrelated to it. He raised the question of scrutiny in our two Houses, which is something that we want to strengthen. He is absolutely right that in the past the reasons for not observing or waiting for the scrutiny process were possibly a little too cavalier. These are matters that we have all argued for and there is a constant search for improvement. However, I think that the operation of our own European Union Committee and the European Scrutiny Committee in the other place are commendable. They cover an enormous amount of ground with very great thoroughness. Speaking from this government position, I can say that it certainly is right for the Government to pay maximum attention to that. It makes complete sense.
There is the broader question of the democratic nature of the European Union and the kind of issues that were addressed in the Laeken declaration. That declaration pleaded with the European institutions and national Governments to seek ways to bring European affairs closer to popular consent and to the people so that they had a greater understanding of where the European Union benefited its members—as a home club or home team it could achieve greater things in combination—and where it should not necessarily intrude on affairs that were properly the concern of nation states and those close to the ground of intimate local issues, which were best governed and decided at national or local level and possibly not at the loftier level of the European Union. That is a broader issue which we shall perhaps come to.
The European Union, like any great institution and certain institutions of the last century, needs reform. We are now facing totally different conditions from the ones that we faced even a couple of years ago, and so is Europe. Power has moved, wealth has moved and economic activity has moved. The things that some of us forecast 15 years ago, such as the rise of easternisation, as we called it—the rise of the eastern powers—have taken place. That is a question not just of shifting economic gravity but of shifting political gravity as well. In those conditions, Europe as an institution needs to move ahead and the nation states within it need to achieve greater popular support and democratic consensus than they have achieved so far. I shall come to that point again in a moment when I address the views of the noble Lord, Lord Mandelson, which were extremely interesting and stimulating.
I turn, first, to the noble Lord, Lord Kerr. I am sorry that he did not think that my answers were serious. They were intended to be deadly serious; obviously I did not have quite the right tone. However, I emphasised as strongly as I could that we need Clause 3 as well as Clause 2. Clause 3 is needed to address areas where there can be transfers of power and where the special short revision procedure is employed. The noble Lord asked why there was no significance test in the case of Clause 2. The answer is that in Clause 2 we are dealing with treaty changes where competences are shifted or not. In the case of the judges that he mentioned, there would not be a transfer of powers, so there would not be a transfer of competences. If more judges were appointed, the issue would not arise, so there would be no need for any of these procedures at all. Otherwise, all the issues in Clause 2 require treaty changes; and treaty changes, unless they are exempted or unless there is no transfer of power, qualify for and attract a referendum. In Clause 3 the pattern is completely different. There, we are dealing with transfers of powers which are not defined in the treaty, although they are defined to a considerable extent in the Bill. I have listed them again and again until I have become almost short of voice. This is a whole range of powers that can be transferred, and a degree of judgment—although not a vast degree—is required in relation to their significance. That is the difference.

Lords ChamberMy noble friend raises three questions. The no-fly zone is authorised over Libyan airspace, not over the back channels through which manpower and weapons may continue to be supplied into Tripoli and into the hands of Gaddafi’s forces. That is not a possibility consistent with strict adherence to UNSCR 1973.
On the Middle East peace process, we are arguing strongly that this is an opportunity, not a time for the Israeli authorities to draw back, hunker down, hope that things will pass over and wait and see. On the contrary, this could be a large and open window through which those who genuinely want peace and a two-state solution, and who want to see Palestine emerge as part of a two-state pattern in a sensible relationship, should now be pressing forward. That is a view that we have pressed very strongly and which is represented by our actions at the United Nations in support of certain relevant resolutions, which my noble friend will know all about.
As for the Bahraini situation, we are concerned about what has happened and we think that the pattern of handling the protests has not been successful or the right path. We have urged that the whole emphasis should be on seeking a national dialogue, which the king himself and some of his advisers always wanted from the start. We think that that is the right way forward. We believe that the concern of surrounding countries, including that expressed by Saudi Arabia in physical form through its support of security in Bahrain, if rightly handled, is part of a beneficial theme, in that we are seeing the GCC countries and the leading Arab regional authorities take seriously the internal security of their own region. The same applies in Yemen, where there may be some hope, as the Statement said, that the GCC solution is going to bring a breakthrough and a pattern of less bloody and less violent development. These are early days, though, and all that I can tell my noble friend is that we are in constant contact with the Bahraini authorities and urging the sensible course, which we believe lies along the path of national dialogue and reform.
My Lords, one of the striking points in the Statement was the fact that only six Arab countries attended the meeting on 14 and 15 April. There are of course 16 countries in the Arab League, not counting Libya, which might have been there. It is worrying that 10 Arab League countries did not attend. Can the Minister offer an explanation for this? It was of course the support from the Arab League countries for the humanitarian objectives of the action in Libya that neutralised opposition at the United Nations and allowed the Security Council resolution to go forward, so it is enormously important that the support of those countries is maintained during this period.
While we are looking so hard at Libya, I ask the Minister to assure us that we are observing and, as the Statement says, concerned about the carnage on the streets in Syria. It would be difficult to defend going in on a humanitarian basis to stop the wanton killing of unarmed civilians in Libya while doing nothing at all about the newsreels that we have seen of the Syrian armed forces simply gunning down people in the streets in a number of different cities in Syria. We must not be caught on the argument of double standards. It is important that we respond in equal measure to equal problems.

Lords ChamberYes, that is absolutely correct. I think there are some small signs that one or two things are getting better, but there is a long way to go, as my noble friend on this side has just observed. The conditions for many younger women are appalling. An estimated 70 per cent of all marriages are still forced and half of all young married girls are under 15, which opens the way for victimisation and violence on an appalling scale. It is slightly improving, as the Government are under constant pressure to observe human rights standards and have committed themselves to the United Nations undertakings. There are efforts and we are going slowly forward, but it is still a very ugly situation.
My Lords, will the Minister publish the paper giving the comments and concerns that he said in his initial Answer had been the Government’s response? It would help the whole House if he were able to do that. Can he tell us what resources are available to our embassy in Kabul to make contact with women and help to develop women’s role in civil society in Afghanistan?
Resources are available. Our officials in Kabul are involved in regular meetings and there is one going on now to see whether the women’s shelter idea can be taken forward. That is a valuable input and we will continue to do more than monitor the situation by pressing for the right solution for women’s shelters and for protection of women generally. As for the publication of detailed pressures and exchanges, I will look at that, but sometimes the full publication of these exchanges undermines the degree of trust and confidence one needs to make progress. It may not work, but I will certainly look at it.

Lords ChamberThese are all very serious social problems but I think my noble friend would agree that if there is to be change, the aim must be to achieve the most peaceful and bloodshed-free transition. That is what we want. Obviously, we are in talks with all our opposite numbers in the Arab world and in the Gulf countries, including Saudi Arabia, as my noble friend suggests. These matters have to be dealt with and we raise them, but if we can make progress in a peaceful, orderly way, that must be the best way forward.
My Lords, I am sure we all agree with the Minister that the most successful outcome is one that involves a peaceful and orderly transition. However, in the Government’s view, is that most likely to be attained through President Saleh stepping aside very soon or through his engaging in the sort of dialogue with dissidents elsewhere in Yemen that the Minister described a moment ago? The noble Lord talked about the support of neighbours. What support does he have in mind that Yemen’s neighbours might give? Might it be troops on the one hand or direct aid on the other?
President Saleh has already said that he will step down—we all know that—but it is a question of the timing and, no doubt, the question of to whom power should then transfer. These are obviously very sensitive and delicate questions inside Yemen. Sensible people, supporters and friends of the country and its people want to see the president step down as quickly as possible but in an orderly way. As to outside support, aside from the substantial aid which countries such as our own give to Yemen, the Friends of Yemen group has said that it is very ready to support training and to offer social support, all kinds of social programmes and a variety of other support. It has made clear that that is what it wants to see. However, I am afraid that it is from within Yemen—this is often the case in other Arab countries—that the movement has to come for an orderly transition of power, which is about to take place.

Lords ChamberOne can never say, speaking in general terms, that one is happy. Perhaps a year or two ago, many people in this House would have been happy with the number of licences going to Libya, but it turns out that a great many of these—I think 118 of them—have been revoked, and rightly so. All licences for weapons of any kind of concern for Libya have been revoked. In the case of Indonesia, the process of rigorous control is there. We watch it all the time, and we will monitor it. These things are regularly revisited, and one hopes that any doubts about any weakness in the application of criteria will be strengthened. So I cannot say that one is happy or unhappy, but we are applying the best possible filter and controls, possibly by world standards, that are available to ensure that weapons are not misused, or used for repression in horrible ways.
My Lords, I refer to the question which the noble Baroness, Lady Falkner of Margravine, asked about re-exports. This has been a very vexed question, and I know that we have discussed it before in your Lordships' House, but the issue here is whether the use of end-user certificates would be of any real value. In my time as a Minister, we discussed end-user certificates and there was a good deal of international support to ensure that those buying arms from this country were prepared to say something about their eventual re-export. Can the Minister say whether that will be a subject for negotiations next year?

Lords ChamberI can certainly confirm that, as the noble Lord said, al-Shabaab is a vicious and dangerous group which has been responsible for numerous terrorist attacks in Somalia and the killing of soldiers, AMISOM troops, innocent civilians and parliamentarians, and which shows no regard for human life. The noble Lord asked what we could do. Her Majesty's Government have a Somalia strategy which they are pursuing. We are working with the AU, the EU and other allied forces and we are doing everything we can to establish a political strategy for the area. It is called a “dual-track” strategy, whose objective is to encourage both the transitional Government, provided that they commit to the right degree of reforms, and the bottom-up development of responsible and constructive groups who can oppose these very unpleasant people. They are a real danger, and the noble Lord is absolutely right to draw attention to their vicious and unacceptable activities.
My Lords, may I press the Minister a little further on the question of reform? In his Answer, he said that there would be no extension of the transitional institutions’ mandate without reform to make them more legitimate in the eyes of their own people. What help is being given by DfID in this reform process and how is it being co-ordinated with help from the European Union?
I say in response to the second part of the noble Baroness’s question that we are supporting the European Union training mission, which trains up personnel and returns them to Mogadishu to assist policing and the upholding of law and order, such as it is in the area. We are working with it on a number of other programmes as well. As a result of the DfID review, the UK has agreed to provide up to £250 million—a very considerable amount indeed—in support of Somalia over the next four years, but we shall have a review of how that is going halfway through, in 2013. Our objective is to help support prosperity and tackle poverty across Somalia and to support efforts at peacebuilding and reconciliation at national, regional and, as I was saying a moment ago, at local level. It is the co-operation of the transitional Government and their commitment to this programme that are the conditions on which we base our support for them.

Lords ChamberMy Lords, I am sure the House is very grateful to the noble Lord for giving us that update on the political situation in Bahrain. However, the Foreign Office is having to assess not only the political situation in Bahrain but the consular implications, given that we hear today that Britons are being advised to move out of Bahrain if they can. This is not the only crisis that the Foreign Office is dealing with, as there is the crisis in Japan—of which we are all acutely aware—and the crisis in Libya, too. We have three major crises, any of which would at one time be a huge burden on Foreign Office capacity. We have heard that there have been slip-ups over people going into Japan. I am not making an issue out of that but I am saying to the noble Lord that the Foreign Office is working all hours with this huge burden of three simultaneous crises. The noble Lord is a wise man and a very sensible man, and I do not say that in a back-handed way but because I think he is the most experienced head around the ministerial table. Will the noble Lord now ask his colleagues to look again at Foreign Office staffing, and in particular at the staffing for consular issues that arise out of such crises?
The noble Baroness speaks from considerable experience and she offered, I think, some kind words—I am not quite sure how kind they were. She is absolutely right that these crises come not in ones and twos but in battalions. I actually make it that we are dealing with five major crises at the moment in the Foreign and Commonwealth Office, and this of course places a considerable strain on our extremely dedicated and hard-working staff. The question of support at the consular and other levels is under constant review. We believe that in the present situation—she has mentioned Japan, but there is also the Libyan problem, the Middle East generally and Bahrain, which we are talking about—we can cope with these matters efficiently and are doing so in terms of giving the right travel advice. For those who have been advised to get out of Bahrain, we are offering support for their travel and removal with charter flights. These things can be done. Occasionally there are, inevitably, some hiccups and problems, but we believe we are on top of the situation, and the question of staffing is under constant review.

Lords ChamberThe short answer is yes. My noble friend is completely realistic in pointing out that there were some undesirable practices and programmes in the past. Our view is best encapsulated by a quotation from the Prime Minister when he said in Kuwait the other day:
“It is not for … governments outside the region to pontificate about how each country meets the aspirations of its people. It is not for us to tell you how to do it, or precisely what shape your future should take”,
in these countries. He continued:
“But we cannot remain silent in our belief that freedom and the rule of law are what best guarantee human progress and economic success”,
in each country. That is the principle on which we proceed. Where we find obstacles, we will seek to overcome them.
My Lords, I am delighted to hear that the Prime Minister gave such enthusiastic support to an initiative that was actually begun by my noble and learned friend Lord Falconer of Thoroton when he sat on the Woolsack. Are the Government specifically encouraging the very useful work that the Law Society and the Bar Council have undertaken in a number of countries in the Middle East?
I also agree with the points made by the noble Baroness, Lady Falkner of Margravine, that human rights lie at the heart of the rule of law. In so far as that is concerned, will the Government particularly direct their attention to encouraging the countries of the Middle East to sign up to the protocols against the death penalty and the use of torture, and the protocol for joining the International Criminal Court, as Tunisia has done since the revolution?
My Lords, the answer is yes to all those points, and certainly to the support of the Bar Council. There is also the Justice Assistance Network, a cross-governmental network that draws on UK expertise to provide coaching, mentoring and twinning support for judges, prosecutors and court staff. We are active and positive in all these areas, and we recognise the work done by both the noble Baroness and the previous Government in this area.

Lords ChamberNot necessarily. The reality we all have to face is that there are plenty of arms in the world and these arms can be obtained from anywhere, in various forms. We control very carefully our exports of arms, in a very tightly regulated way, and we do not believe that merely creating substantial unemployment here and damaging our well regulated industry, paving the way for less regulation and possibly worse and more dangerous arms in many countries in the Middle East, would help one iota towards peace and stability in the area.
Does the Minister agree that in fact we have two sets of circumstances here? On the one hand, there is the sustained and absolute refusal of Israel to stop building settlements in the Occupied Territories—no matter who asks, including the United States—and that makes the possibility of a viable and contiguous Palestinian state less likely. Combined with that, as a result of the unrest we have the possibility, no matter what the root causes are, of elections that may well lead to the establishment of Governments in the Arab countries with a mandate against the Middle East peace process based on a two-state solution. That toxic combination makes the issue very urgent now. Does the Minister believe that there is a very short window of opportunity for the resumption of these negotiations?
I agree strongly with the noble Baroness’s analysis. The dangers are very great from all these developments. We have said several times in these exchanges that it does not take a genius to see that the Israeli Government are much more worried by the uncertainty, and therefore pushing them toward negotiation is going to be tougher still. However, there is a little window for us to push to try to achieve something, and we are going to do so very hard indeed.

Lords ChamberThe Minister is quite right to describe these as elaborate treaties. Perhaps I can press him a little further on the defence treaty, which talks about extending bilateral co-operation on the acquisition of equipment and technology, such as complex weapons systems, submarine technology and satellite communications, and developing stronger defence industrial and technology bases. I applaud all that in theory. Does that mean the end of competition between our respective companies which deal in defence equipment? My experience has been that competition was always very fierce indeed and, if there is this degree of co-operation, it will be interesting to know how that is to be resolved.
As I suspect the noble Baroness fully realises, the answer falls in two parts. In some areas, competition will and must continue in the interests of the Government getting a good deal and not becoming vulnerable to having one supplier and therefore confronted with one price and one deal; but in other areas, which were specified in the two treaties—including developing capabilities and equipment, common support for the A400M and a joint user group to develop the A400M training systems, construction of nuclear hydrodynamics facilities at Valduc and a whole range of detailed technical operations—there is bound to be co-operation. I applaud the noble Baroness’s concern to keep up competition; that is right, but in some areas co-operation will secure major economies and efficiencies, which we should support.

My Lords, I thank the noble Baroness for her Question. Jordan is a close ally and we value the support that it offers on regional issues such as the Middle East peace process. We are watching closely the situation in Jordan following the disbanding of the Cabinet. It is important that Jordan continues its programme of political and economic reform, and we will work with the Jordanian Government to support that goal.
I thank the Minister for that response. Jordan is indeed a close ally and I imagine that there are many in your Lordships’ House who have longstanding friendships with Jordan. The noble Lord mentioned Jordan’s role in the Middle East peace process. Jordan and Egypt, taken together, have been very steadfast in their support of that peace process. Given the level of public unrest in both countries, perhaps I may ask him whether there has been any direct contact between Ministers in Her Majesty’s Government and the new Prime Minister of Jordan.
In addition, Jordan has some really appalling economic problems, some shared with the rest of the Middle East, such as high unemployment and the high prices of commodities, and others very particular, such as no water and very little energy. These demonstrations are spreading around the Middle East. We hear today that demonstrations are planned in Syria, Algeria and even possibly in the Gulf states. There are even some reports—I do not know how reliable—about demonstrations in Jeddah. Will the noble Lord very kindly consider arranging for a briefing in your Lordships’ House, so that those who are interested in these matters may have a somewhat deeper opportunity of discussing them with him, with the benefit of the wisdom of the Foreign and Commonwealth Office?
I thank the noble Baroness for those queries. The new Prime Minister has only just been appointed and the Government are yet to be formed. However, I can tell your Lordships that my right honourable friend the Prime Minster spoke with King Abdullah on Sunday, three days ago; my honourable friend the Under-Secretary of State Alistair Burt visited Jordan on 20 January, about 10 days ago; and our ambassador there is of course in regular contact with a great many people involved in the situation. We are keeping close contact in what is obviously a very fluid and evolving situation. The noble Baroness is quite right that the threat of contagion is certainly seen there. There seems to be some evidence that, thanks to modern global communications—mobile telephones and so on—news and views are travelling very rapidly through the entire region. We will have to see how things turn out in Jordan and whether there is a similar pattern to what we have seen in Tunisia and Egypt in recent days. It is early days, and each country of course has its completely different and separate qualities and patterns of events, which may affect the outcome in different ways. I would be delighted to provide a briefing and would like to make arrangements with her and other interested parties as soon as possible.

Lords ChamberThe noble Lord is quite right to begin the catalogue—sadly, it goes on even further than he mentioned—of the persecution of religious minorities. The Foreign and Commonwealth Office and Her Majesty’s Government are determined, wherever we see such persecution, to make the strongest representations through our posts. The noble Lord mentioned three instances of hideous persecution and I have a list in front of me of four or five more areas of the world where there is direct persecution of religious minorities of a highly intolerant kind. In every instance, personnel in our posts and in the Foreign Office here in London continuously and vigorously pursue our concerns, suggestions and proposals that this intolerance should cease forthwith.
My Lords, the Minister said that there is a reason to separate religious organisations from government—on the whole, I suspect that many of us might agree—but, on the Question raised by the noble Lord, Lord Hylton, I point out that Religions for Peace has been working on a code for the holy sites, which will have a particular resonance for those who are interested in Jerusalem. This is a matter where Governments must take a serious role because of the implications for all the parties involved. Have the Government looked at the work done by Religions for Peace on the code for the holy sites and, if so, do they agree with its outcome?
I cannot give a detailed answer to that. I accept the noble Baroness’s proposition that religion and politics become intertwined, sometimes disastrously and sometimes to the benefit of those who seek peace, stability and worthwhile aims. I shall look into the matter of the holy sites. It is not a situation with which I am familiar but, obviously, anything to do with Jerusalem and the holy sites has a highly political content and raises all sorts of sensitive issues.

Lords ChamberAs my noble friend knows, the one exception was made very properly by the previous Foreign and Commonwealth Secretary, Mr Miliband, allowing the US a temporary extension of its right to keep cluster munitions while it went through the process of getting rid of them as part of the running down of cluster munitions stores in UK territory and in the United Kingdom. That is the only exception that has ever been made. For the future, we will consider bringing to Parliament and recording any decisions that may be proposed for temporary extension, and we will do that on a case-by-case basis. I have to say that in a number of instances it could be governed and limited by security considerations.
My Lords, do we retain some cluster munitions for the right purposes of training personnel in the detection and destruction of such appalling weapons? Do we export any weapons to foreign Governments for the purposes of training their personnel in detection and destruction of those weapons; and, if so, which countries do we export to for those purposes?
In this country we have destroyed 48 per cent of all cluster munitions weapons and intend to destroy the remaining 52 per cent well within the schedule—by 2013. As for the training and technology associated with their destruction and the necessary designs of equipment to destroy them, that continues. I cannot answer the noble Baroness precisely on whether there are export clients for this technology but if there are this would be a positive area where the more information we have in the rapid destruction of these weapons and the better the training we can press round the world for their destruction, the better off we all are.

Lords ChamberMy Lords, I thank the noble Lord for repeating the Statement. This is a very sad day for all supporters of the BBC World Service—a service that has unrivalled reach across the globe and has a reputation for independence and fair mindedness. The BBC World Service is loved by many people who listen to it every day and is envied by many Governments, who wish they had it. It is known for its authoritative news reporting and relied upon for such reporting by many people. Will the Minister tell us why this uniquely valuable service is being cut so much more savagely than the rest of the FCO?
There were of course cuts and changes under Labour. They were criticised at the time, but these cuts today go much further than a mere realignment of resources. This is not just a realignment of priorities; it is a real and huge cut of 650 jobs out of a workforce of 2,400. The BBC director-general has said that these cuts will,
“inevitably have a significant impact on the audiences who use and rely upon the relevant services”.
He also exhorted supporters of the international role of the BBC “not to despair”. What a far cry that is—do not despair—from the Foreign Secretary’s exhortations on 1 July last year that the Government’s new approach to foreign policy would include “cherishing” and “growing” the networks around the world through our language. He said:
“The English language gives us the ability to share ideas with millions—perhaps billions—of people in the biggest emerging economies and … to build networks across the world”.
Those were high sounding ideals, which of course Mr Hague explicitly said were underlined by the essential importance of the BBC World Service. He said that together with the British Council, the World Service,
“gives Britain an unrivalled platform for the projection of the appeal of our culture and the sharing of our values”.
He was right. The World Service is the envy of the Americans—of Voice of America. The Americans have nothing that has the reach; nor do the French or any of our international competitors in this field.
Radio programmes in seven languages will cease altogether and one of those languages is Turkish. Does the Minister recall that only two weeks ago he agreed that Turkey has a growing and huge importance around the world? He said:
“We have already taken decisive steps to inject a new dynamic into UK-Turkey relations”.—[Official Report, 13/1/11; col. 1576.]
I am sure that at the time the Minister had no idea that the BBC World Service would cease to broadcast in Turkish shortly. After all, it was only on 1 July 2010 that the Foreign Secretary boasted of a new relationship with Turkey, Europe’s biggest emerging economy. Does the Minister recall his right honourable friend saying that there would be a,
“particular diplomatic effort with Turkey”?
This is a very odd way to implement that diplomatic effort.
The Minister is well known for his steadfast and passionate commitment to the Commonwealth. Again, he is at one with the Foreign Secretary, who castigated the Labour Government as being “oblivious” to the value of the Commonwealth. He said that the Commonwealth was not mentioned in the FCO’s strategic plan in 2009. He was right. It was not and it should have been. But in Mr Hague’s approach, which has been set out today, many people will see the cut of English for the Caribbean regional service as a bit more of a blow for everyday life in the Caribbean than the lack of a mention in a document in 2009 of which none of them has probably ever heard.
In July, Mr Hague claimed that he was introducing a “distinctive foreign policy”. Today, the results are seen in the cuts in FCO funding, which are becoming clearer and clearer. They are very destructive. The director-general, in making the cuts announcements, said today that he wanted to make it clear that these are the direct result of last autumn’s spending cuts. Will the Minister tell us why the BBC World Service is taking such an extraordinarily heavy cut? He mentioned 16 per cent. I believe that the figure is anything between 16 per cent and 20 per cent in real terms, as opposed to 10 per cent elsewhere in the Foreign Office.
The National Security Forum gave advice to the Labour Government of the crucial importance of the BBC World Service in nation-building and in making the world a safer place. It did that and it does that. What has changed? We have the ready-made vehicle to help us in nation-building, to foster understanding and to make the world a safer place, as the Foreign Secretary exhorted that he wanted to do.
The Government know that, as was shown in November 2010 when the FCO’s business plan was published. It said that the coalition priorities were, among other things, the use of,
“‘soft power’ to promote British values, advance development and prevent conflict”.
To do this, the Foreign Secretary claimed that he would:
“Devise a strategy to enhance … the impact of the … World Service”.
That was his promise and his commitment. Will the Minister tell us how today’s announcement fulfils that promise, that commitment? Will he give us concrete examples of how these cuts will enhance the role of the World Service? The Foreign Secretary said:
“Britain will be safer if our values are strongly upheld and widely respected in the world”.
The BBC World Service has an audience of more than 180 million people a week, which is far higher than other international broadcasters.
Finally, does the Minister recall, in July 2010, being asked:
“Is not the World Service an unrivalled way of demonstrating the values of this country?”
Does he recall his answer, which was:
“I heartily endorse everything that my noble friend”,
has said. Indeed, the noble Lord, Lord Fowler, posed the question. The Minister continued:
“The World Service is an immensely powerful network for soft power and for underpinning and promoting the values for which we all stand. Everything that he says is right”.—[Official Report, 13/7/10; col. 600.]
On 13 July 2010, the Minister was 100 per cent right. Today, sadly, in the Statement which he has had to repeat to us, he is not.
My Lords, I say straight away that I heartily endorse many of the sentiments expressed by the noble Baroness about the BBC World Service. This is indeed a precious asset and, as the Statement of my right honourable friend says, we wish it to be an articulate and highly effective voice for Britain in the world. There is no disagreement about that.
The noble Baroness first asked about the size of the cut of 16 per cent in real terms over three years and asked why it is, or appears to be, larger than the overall real-terms cut in the Foreign and Commonwealth Office as a whole during the period of the spending review. It is not the biggest cut—the British Council has been asked to take a 25 per cent cut in real terms—but it is larger than the 10 per cent because we have to start from the position we inherited. The noble Baroness will recall that the Foreign Office took a fearful blow when the mess over the exchange rate had to be negotiated, which involved a large cut in its overall budget. At that time, the cut imposed on other ancillary bodies, including the BBC World Service, was somewhat less. If one looks at the arithmetic, all that is happening is that having to suffer 16 per cent now, which no one welcomes but is the reality that we have to face, merely brings the BBC World Service back to the same proportion of expenditure of a total FCO budget as was the position in 2008. We are back where we are.
Of course, it would be nice to be much further ahead and to have more resources, but we do not have more resources. The outgoing Minister—I forget his name—left a letter behind saying, “There is no more money”. We have had to impose on ourselves and in many parts of government inevitable cuts. Not this evening are we going to go into an argument about why those cuts were imposed or why the situation in budget terms was so utterly disastrous, which I know is a huge debate going on in this country. But disastrous it was and repaired it has to be.
As to specific services that were mentioned, five language services have been stopped, which my right honourable friend has outlined. On top of those, there are the effects of the changes in a number of other areas. The noble Baroness mentioned Turkey, for which there will be a stopping of radio programming and a concentration on online, mobile and TV distribution in a number of languages, and a phased reduction in medium and short-wave radio distribution.
That tells us something very important, which I am not sure that the noble Baroness or some other critics fully appreciate. We are dealing with a rapidly changing technology. The short-wave arrangements are not reaching the audiences. Short-wave is being cut out by the development of the technology, and by resistance in some parts of the world. In addition, millions of people are moving to online reception of news and views. They are using mobiles and television as well. This is changing the whole pattern of radio broadcasting across the planet.
Quite aside from these substantial economies, which cannot be denied, there has to be an evolution of the technology and the changes in the BBC World Service. If that is not understood, I am afraid that very little is understood about the world into which we are moving. Of course these are not the sort of things one wants to welcome—there are difficulties, there are challenges and this is the greatest matter for regret, redundancies. However, one has to also accept that we have to move on in the evolution of the World Service. In three years’ time it is going to be in a much better position, completely independent of my department or the Foreign and Commonwealth Office and therefore reasserting its wonderful independence in the world in its voice and its opinions. This is something for the future which I think deserves some optimism rather than the concentration on what the noble Baroness calls “huge and savage cuts”. I believe these are overused as adjectives.

Lords ChamberMy Lords, I declare an interest as chairman of the British Egyptian Society and I associate these Benches with the condolences expressed by the Minister in his opening Answer. Is the Minister able to confirm an article that appeared in the Spectator on 15 January, which reported that on the Copt Christmas Day, on 7 January, hundreds of Egyptian Muslims turned out to be human shields to protect Christian worshippers going to church that day? Also, there was a big gathering in the Cairo district of Omraneya where the front pew of the Copt church was filled with Muslims taking a stand against terror and offering themselves as protection. If the Minister is able to confirm that from independent reporting and from the embassy in Cairo, will he join me in praising these brave Muslims who were prepared to risk their lives in order to demonstrate exactly the sort of fellowship that we would like to see between Christian and Muslim in Egypt?
My Lords, I cannot confirm those precise details, but if the noble Baroness's reports are broadly correct, and I am sure they certainly are, that is a reassuring aspect of an otherwise very grim situation—that members of different religions are prepared to risk their lives and protect each other in the ways that one would like to see more widely throughout the whole region and throughout the whole world. I cannot confirm the details, but the investigation is ongoing about how this whole matter developed in the first place. We are in close touch with the Egyptian authorities about it, but what the noble Baroness described is a good and lighter aspect of a very dark episode.

Lords ChamberMy Lords, in the third of the priorities that the Minister enunciated a moment ago, he said that he wanted to see more concentration on the relationships with strategic partners. Which strategic partners will this country prioritise in that discussion within the European Union?
We have in mind Russia, China, the United States, India and Brazil. We are developing these strategic partnerships both bilaterally and, where it makes sense and where we can combine effectively, with our EU partners. Those are the strategic partnerships on our priority list.

One has to echo the words of the noble Baroness about the sadness and tragedy so graphically depicted in photographs in our newspapers this morning of these refugees—boat people of a kind—going to a terrible death in the storms off Christmas Island. It is very sad.
My Lords, the Minister was kind enough to tell us that the ambassador raised these issues, as did the Deputy Prime Minister at the summit a couple of months ago. Will he tell us what the response of the Indonesian Government was to having these matters raised?
Not in detail, except that they recognised we have these concerns. The ambassador was in the West Papua region and talked to the governor and to the police authorities. He made the point very clearly that the reported abuses of human rights are completely unacceptable and that we are very concerned. As far as concerns their response, we must try to look forward to the possibility of getting a dialogue going so that an acceptable solution can be found. However, from outside it is very difficult for us or for any other international partner to define what that solution should be and how it should go forward.

Lords ChamberWe are constantly looking at ways of bringing more effective global pressure to bear on this unpleasant regime and its practices. Any developments of this kind need to be measured and calibrated very carefully, but it is the direction in which we should go.
My Lords, do the Government believe that there is any truth in the suggestion that the Chinese are helping the authorities in Burma to develop a nuclear capability?
I have no evidence or proof of that, beyond media suggestions. There is no established evidence or clarity on that matter which I can share with the House today.

Lords ChamberI do not know where my noble friend gets this concept of a cover from, except presumably from WikiLeaks. There is no question of a cover; they are completely separate issues. However, when it comes to handling them, we are concerned because we have inherited a situation in which there was certainly a lot of misunderstanding and even ill feeling between us and the Mauritian Government. We are very anxious to talk to the Mauritians again and to try to handle this matter better than it has been handled in the past.
My Lords, has the Foreign Office had the opportunity, since the coalition came into office, to discuss this issue directly with the United States Government?
There are ongoing discussions with the United States Government about this and other matters related to broad defence needs and to the particular problems we are discussing today. So the answer is yes: discussions have been ongoing at various levels.

My Lords, the Minister has been very good at explaining what he would like to do but rather less good at explaining how he would do it. The question posed by the noble Lord, Lord Spicer, was what mechanism would bring into effect all this work that he has described the Foreign Office as undertaking, or is the work really pretty pointless because there is no way of bringing it into effect?
With great respect to the noble Baroness, the Question, which is in front of me, asks,
“which powers they are seeking to repatriate from the European Union”.

Lords ChamberYes, we think that those are very valid ideas. We would not back every detail of every idea, but many of them are certainly worth backing and supporting.
My Lords, the noble Lord has my sympathy: I remember being asked a very similar question, quite possibly by my noble friend Lord Judd, in 1997, and, I am bound to say, giving a very similar answer. The noble Lord has listed four countries and they are indeed the same four countries as I think I listed way back then. There is, however, the question of Africa. What the noble Lord has proposed as the British Government’s position does not envisage any direct African representation. This is not a question of individual countries; it is a question of a whole continent. I wonder whether he would reflect on that.
The noble Baroness is almost certainly right about the similarity of the answer—we have not made much progress in the past year or two. She is also right to open the question of African representation. We have argued—as I think the previous Government of whom she was a distinguished member argued—that, as well as the four countries, there should be African representation. If she then presses me to say which countries, I would have to say that it is a little difficult to decide. However, the general proposition that there should be African representation as well is part of our policy and fully taken on board.

Lords ChamberI agree; indeed, the UK is one of the largest bilateral donors to Burma. We have significantly increased our humanitarian assistance from £9 million in 2007-08 to £28 million in the current year. Our aid focuses on health, basic education, rural livelihood, civil society and helping the refugees. I add as a personal observation that China is deeply involved in Myanmar, getting more involved all the time, pouring in vast sums of money for schools, infrastructure, and so on. We have a real problem considering aid—which is right—against the apparent determination of the People's Republic of China to have a massive involvement in Myanmar in every conceivable way.
My Lords, I am very pleased to hear about the Prime Minister's call; that is something to be very well regarded. Can the Minister tell us whether other EU leaders have made similar calls to Aung San Suu Kyi? Can he also tell us whether there is now an EU resolve to re-engage with the ASEAN countries? After all, they value the EU-ASEAN relationship very highly, and were the countries of the European Union really to make a push on that at the moment, there might be a realistic possibility of getting more positive engagement.
I certainly hope that that will be so. It obviously makes complete sense that the EU must be extremely vigorous in such an approach. As to who has been making telephone calls to Aung San Suu Kyi, I have absolutely no idea; but I bet people have.

Lords ChamberWith respect to my noble friend, that point is slightly “yesterday”. There are definite signs of an improvement in US-Russian relations. Of course, there are all sorts of collateral issues, of which he has mentioned one, but the general trend is in a positive direction with the START negotiations moving to a signature and a whole variety of other developments. Therefore, I do not think that the situation is quite as bad as my noble friend suggests.
My Lords, I believe that there was a suggestion a while ago that there would be Russian observers or visitors to the forthcoming NATO summit. Indeed, I think it was even suggested that the Russian President might be invited. Can the noble Lord tell us whether there will be any Russian observers at the summit? Can I also press him a little further on his answer to my noble friend Lord Judd? He talked about the importance of human rights. Can he tell us whether that issue has been raised specifically in the context of security discussions? It is in the balance between security and human rights that the problem so often lies.
The answer to the noble Baroness’s second question is yes, we do combine. Concern for human rights and the rule of law are two facets of the same issue. Upholding the rule of law and the broader security issues are all one ball of wax, if I may use that phrase. As to Russian involvement, President Medvedev has said that he will go to the NATO-Russia Council summit in Lisbon on Friday. So, he will attend—that is what my brief says and I am glad to learn it.

Lords ChamberI must say frankly to the noble Baroness that I was not aware of the date of the moratorium on the death penalty, but I greatly welcome it. Indeed, the Foreign and Commonwealth Office and some of my fellow Ministers have been active in carrying this message of, one hopes, the almost universal end of the death penalty to as many areas as possible. It is certainly something that we as a civilised nation believe in and we hope that that message can be spread. As to judicial training and other forms of training and technical assistance, there is a programme of help in that direction. We intend to do more, but there are limits to our resources and we must spread them as effectively as we can. These are valuable additions and we want to develop all kinds of assistance in the best way that we can.
My Lords, I have a quick question. In the past there have been discussions between the United Kingdom and Tajikistan over a double taxation agreement and an agreement on provision of investment on both sides—an investment protection and promotion agreement. Do the Government have any plans to take forward discussions on those important agreements with Tajikistan?
I will certainly look into that. The general level of trade with Tajikistan, as the noble Baroness probably knows better than me, is fairly modest, but we are keen to do more on the commercial and financial side. I will look into the issue that she raised on tax arrangements and write to her if there is more news to tell.

Lords ChamberMy noble friend puts it extremely well. I have a long list here of individuals whose particular problems have arisen and whose instances have been raised by our ambassador and our representatives at different times. We will continue to press for an enlargement of freedoms and human rights with the Chinese, but there are different ways of doing it and my noble friend is right: some are best done publicly while some are best done in a more sensitive way.
My Lords, perhaps I may ask two questions. First, have the Prime Minister or any member of his entourage met any Chinese dissidents in the past few days while they were in China? Secondly, does the Minister agree that members of the public who are interested in human rights in China might look at the human rights overview on the FCO website? That is exactly what I did today, and I was interested to see that the latest update was that Prime Minister Gordon Brown has discussed human rights with China’s Premier and that Foreign Secretary David Miliband has spoken to his counterpart on the same subject. Does the Minister think that that really is prioritising human rights in China?
I do not know whether the noble Baroness slipped into a time warp; it sounds as though the website did. I will look into that. When I glanced at the site this morning I thought that I saw a more up-to-date version, but strange things happen in the cyberworld of the internet. It may be that the noble Baroness was misled by the machinery of the FCO’s website. I will examine it to see what went wrong.
My Lords, the first question was on meeting dissidents.
I do not have any information on meeting dissidents. The visit is continuing and I do not know what the rest of the programme will involve. However, I will write to the noble Baroness when I have precise information on that, as opposed to the other official-level meetings about which we have already heard.

Lords ChamberYes, we will certainly ask for that information to be put forward. I possibly did not fully answer my noble friend Lord Grenfell who implied that India was perhaps not the best place to hold the Commonwealth Games. The Government would disagree with him about that. There were some undoubted hiccups, but in the end the Commonwealth Games went ahead very successfully, helped cement relationships and carried forward the value of the Commonwealth network, which is the one of the most powerful platforms of the 21st century for the entire globe.
My Lords, the noble and right reverend Lord, Lord Harries of Pentregarth, is to be congratulated for his persistence in pursuing this question in the way that he has. Is the Minister aware of whether any money from DfID was involved in this unfortunate use of funds that should have gone to the Dalits? I wonder whether the Indian high commissioner has been asked into the Foreign Office to ascertain whether any DfID money has been involved and, indeed, whether he is satisfied that DfID money will be used for the purposes for which the British Government provide aid to India and not for other purposes, as was the case in this instance.
Yes, we are aware of the situation, which is that no money from DfID has been involved in this situation or, indeed, has been given to the provincial Government of Delhi, although obviously DfID money goes to the federal Government, which is a different matter. No money at all is involved in this issue. As for discussions with the Indian high commissioner, we all see him from time to time and hold very fruitful discussions with him. I am not sure when he was last in the Foreign Office, but the noble Baroness can be assured that we are in constant contact.

Lords ChamberI recognise my noble friend’s continuous concern on this issue. It is the concern of all of us that we do not want to see suffering, violence or worse. However, as has been acknowledged by the United Nations, the people of Camp Ashraf do not have refugee status under the fourth Geneva convention, nor are they prisoners of war under any other part of the Geneva convention. Our concern must be the concern of any civilised nation—that this matter can be handled properly. The UN does not find the idea of a permanent military force there acceptable but, as I said, it is keeping the matter under constant monitoring and we shall continue to press it strongly.
My Lords, does the Minister not agree that, irrespective of our legal obligations, we have an enduring obligation to the people in Camp Ashraf, as the noble Lord, Lord Waddington, indicated? After all, we do not hand anyone over to any sovereign power if we think that they would be tortured or in any other way mistreated. Does the Minister believe that there is any truth in the allegations that United States officials are not allowed into Camp Ashraf for inspections? I am pleased to hear that our officials have been allowed in, but will he assure us that they will continue to visit the camp? Is there any hope that in the future there will be UN inspectors in Camp Ashraf, as the noble Lord, Lord Waddington, rightly requested?
I can give hopes and intentions rather than assurances because, as the noble Baroness knows well from her own experience, this is a difficult area. Obviously, we intend to continue having access and monitoring. We intend to continue pressing the UN, which appears to be ready to visit and maintain a close eye on the situation. The overall pattern, however, is governed by the fact that this is Iraqi sovereign territory and Iraq is a sovereign state, although the Iraqis will be watched carefully by the world and will be expected to police and manage this matter in a civilised way.

Lords ChamberMy Lords, does the Minister recall that, in a speech at the New York Stock Exchange on 22 September 2010, the Foreign Secretary said that,
“it is this extraordinary level of personal connection that makes the relationship between our two countries irreplaceable”?
Often, those relationships that are made as students, very early in life, are so important. Does the Minister agree that the Marshalls have played a strong role in that extraordinary level of personal connection? Does he not think that, were the scholarships to be reduced any further, that personal connection would suffer, maybe not next year but in 10 years’ or 15 years’ time?
One has to look at all the relationships as a whole. Certainly, I do not dispute for a moment that the Marshall scholarships are an important part, nor can I reject the point made by the noble Lord, Lord Hannay, that their numbers have been falling. However, many other things have been increasing. As I mentioned earlier, under the Government of which the noble Baroness was a distinguished member, there was a dramatic increase in the number of US students in the United Kingdom. There are many other programmes, such as Fulbright and Gates, which make a contribution. I have to reveal to your Lordships that I stand here in the knowledge that I was supported by an American scholarship through my time at Cambridge, which may be welcome or not. Such scholarships are a feature of a whole network of relationships with the United States that we treasure greatly because we still regard the United States, through all its difficulties, as the home of liberty.

Lords ChamberThe noble Lord puts the issue very clearly. There are the two sides. There is the question of the security of Israel and attacks on Israel, and there is Hamas, which some people urge should somehow be brought into the talks, but the question is: should it be when it is continuing provocative rocket attacks against Israel? Once Hamas takes immediate and concrete steps towards quartet principles, the matter might look different, and perhaps once it unconditionally releases Mr Gilad Shalit, ends interference with the operation of aid agencies in Gaza and ceases its rocket attacks, we might look at the matter differently. However, until then, the noble Lord’s point is very valid.
My Lords, I am sure that we on these Benches share the views that the Minister has put forward about ending the settlement freeze. However, the Foreign Secretary made another very interesting speech at the UN on 23 September, when he advocated a wider role for the UN, not only in peacekeeping but peacebuilding. I thought that that broke new ground. Do the Government have any plans to advocate the use of UN peacekeepers and peacebuilders in the West Bank?
I cannot give the noble Baroness a specific answer to that question but that indicates the trend of our thinking. Our intention is to mobilise more UN activity, just as we want to use our membership of the EU, our own bilateral contacts, our position in the quartet and indeed the role of former Prime Minister Mr Blair. All those are instruments through which pressure can be mounted. However, the noble Baroness will have to await a more specific answer.

Lords ChamberMy noble friend is talking about a particular case and it is quite difficult to talk about the details of an individual case where permission has not been given by the individual for it to be discussed. However, if, as I suspect, he is referring to the case of Mr Al-Hisabi, who has been detained and about whom a lot of allegations have been made, this matter was indeed raised at very high levels—whether by telephone or face to face. Consular access has been offered to the individual because he has dual nationality. In the future, there could be further consular access. I am advised that there will be no problem at all about further access and about the issue that my noble friend raised on the position of the families and their support.
As to visits from outside bodies to examine the situation, I agree that this is possibly a worthwhile idea. I am advised that the Bahraini authorities would not be averse to the right kind of inspection or visit from outside authorities to monitor the truth of the allegations—some of which may have a basis and some of which may be false—and to present the Bahraini authorities’ case, which is that there is no real evidence of torture.
My Lords, I am sure that we all agree that wherever torture occurs it should be condemned in the unequivocal way that the Minister has done, and we welcome that. But Bahrain is a relatively liberal Gulf state: its elections have been inclusive of women; there have been women at senior levels in the Bahraini Government and it is inclusive of different religious groupings. Given that history and the excellent relationship to which the Minister referred, does he believe that now really is the moment to approach the Bahrainis on inspections of their prisons and places of detention, because, like the Minister, I believe that that sort of approach might be well received?
I agree with the noble Baroness. This may now be an idea that we are certainly prepared to consider and, as I said earlier, my impression is that the Bahraini authorities themselves would be favourable towards some proposition of this kind. It is certainly something that we will consider putting to them.

Lords ChamberMy noble friend is quite right. At present Russia is not complying with its commitment to evacuate Georgia, where it still has troops, as well as South Ossetia and Abkhazia. We are all the time raising this issue and pressing the Russians to get into a more acceptable and positive position but progress is slow. At the moment they are not moving.
My Lords, the noble Lord mentioned the economy and the important issues between Russia and us. He will know that the UK-Russia intergovernmental steering committee on trade was successfully relaunched in 2008 and last met last November. Are there any plans for that steering committee to meet again this year and, if so, will it be touching on some of the thorny issues such as international banking standards, concerns about corruption and corporate governance taxation?
I cannot answer the noble Baroness on her precise question about the meeting at this moment, but I will check. On corruption, she puts her finger on one of the central problems. There is no doubt that there is a very great deal of corruption still in Russia today and some of it at alarmingly high levels. President Medvedev has highlighted this and says he wants to tackle it. We will do everything to support him but we would like to see more results in certain cases than we have seen so far. Corruption is the cancer that could undermine the whole Russian progress.

Lords ChamberI am grateful to my noble friend. On her second point, William Patey, a very able ambassador, is appointed to be our man in Kabul and fulfils that role. I had the pleasure of meeting him only two or three days ago when he was here. I was enormously impressed by his experience and grasp of the complexities. This is, in effect, not quite the replacement but the development of the role that Sherard Cowper-Coles had previously. He has now completed his assignment there.
Pakistan’s role is vital—my noble friend is completely correct. My right honourable friend the Foreign Secretary has visited Pakistan and discussed in detail with the Pakistani leadership how we can work more closely together, how we can support them, and how in particular they can achieve their twin aims: to defeat—that is a strong word—the Taliban elements on their own territories and their side of the border; and to help contain—that is perhaps not quite such a strong word—the Taliban activities on the other side of the border in the Pashtun-related areas. This dialogue is crucial. Without sensible progress on that front, there will be no stabilisation in Afghanistan. That is why we place the highest priority on a very close dialogue with our Pakistan colleagues.
I agree with every word that the Minister said about William Patey. He is an excellent diplomat, one in whom we can have the utmost confidence. Perhaps I may remind the Minister that, on a recent occasion when we discussed this issue, he assured the House that the 2015 date was not a “deadline”. It now seems that it is a firm date. It is a bit hard to discriminate between a firm date and a deadline. The problem is the implied comfort that it gives to the Taliban.
Can the Minister tell us what action is being taken in relation to Yemen? There is a genuine fear that the Taliban are melting away in the way that Osama bin Laden has evaded all capture over recent years, however hard the allied forces have tried. The Taliban will melt away into Yemen and will simply re-emerge after 2015. What can the Minister tell us about that?
I return to the point made by my noble friend Lady Kinnock. She did not say that there were no women at the conference. She said that the women at the conference did not feel that their concerns were being taken seriously. I can understand that. There are 10 important commitments in the Statement, but there is not a single mention of women, although the noble Lord in answering the question said that the issue was immensely important. If it is immensely important, why is it not mentioned properly and prominently in the Statement?
Women had a terrible time under the Taliban. We all remember those terrible newsreels of women being shot in the football stadium. The Government have to do better on bringing women’s points more to the fore. I would suggest that, among the many able women I see on the government Benches, it might be sensible to ensure that there is an envoy on women for Afghanistan so that we can be assured that women’s rights are being properly dealt with.
The noble Baroness again raises a vital point and perhaps I may reassure her. The communiqué also develops and strengthens commitments made initially at the London conference in January to implement the national action plan for women and the elimination of violence against women in law. The noble Baroness probably took part in that very constructive conference. Certainly, I would be the first to recognise the valuable work done by the previous Government in creating that conference and in providing a foundation on which to build.
We welcome the Afghan Government’s continuing commitment to protect the human rights of the Afghan people, which is enshrined in the Afghan constitution and the national action plan for women. If it was not in the 10 commitments in my right honourable friend’s Statement, I will note that and see that it is pointed out in my department. It is certainly plumb in the middle of the communiqué, which is valuable.
As to what women’s organisations felt, I am sorry if I got that slightly wrong. I thought that the noble Baroness, Lady Kinnock, was saying that they were not represented, but she did not say that; she said that they were not satisfied. I obviously cannot comment on the state of satisfaction except to say that the endeavour was there and the realisation is there, as is the central importance of women’s role in all this. Given the horrors of women’s treatment in the past and the evil viciousness with which under Taliban rule girls’ schools were closed, women were abused and so on, this issue could not be other than absolutely central to the future. I emphasise that and I am glad that the noble Baroness, Lady Symons, raised it again.
On the date by which combat troops will be withdrawn, I think that I said the other day—I am always ready for correction—that it was an aspiration. Perhaps that word was a little weak, because of course it remains an objective. However, one cannot in a thousand years be sure that everything will work exactly to plan. We just do not know. I think that the Deputy Prime Minister in another place made a point about it not necessarily being crystal clear or carved in concrete or whatever. That is our plan and our intention; it is the firm Kabul process and what it leads to.
As to the Taliban melting away and the old story that the Taliban disappears by day and comes back by night, one would not want to underestimate the fact that in the next five years—five years is a long time—there will not be a free ride for the Taliban. The combat troops—our marvellous troops—will continue to fight and to carry on their operations. The American surge army is still not complete. There are another 30,000 American troops to come. The Taliban will have a very hard time. If it thinks that at the end of five years it will be intact, it will have another think coming. I hope that that will reassure the noble Baroness to some extent on the important points that she raised.

Lords ChamberYes, my Lords, we were disturbed, and indeed the Secretary of State launched an immediate inquiry when some of these statements and allegations appeared in the media. However, although the noble and right reverend Lord is correct about the likely overrun of costs—which were estimated to be £250 million but are probably going to be considerably more than that—from our examination we are satisfied and have full confidence that the Games will be properly financed and that there will be no diversion from the very important funds that go via the Indian Government and DfID to the scheduled castes, slum clearance and other crucial issues. Therefore, we have full confidence in India’s commitment to deliver a secure and successful Commonwealth Games and to avoid the very problems that have been raised.
My Lords, the noble Lord used the word “examination” in relation to what was happening over the costs but he also said that a statement had been made on behalf of the organising authority that the costs were being drawn in the way that he described. When he used the word “examination”, did he mean that he and the Secretary of State have had the opportunity for independent verification or are they proceeding on the basis of an assurance?
