My Lords, Amendment 112 is in the names of the noble and learned Lord, Lord Phillips of Worth Matravers, and myself. The noble and learned Lord is abroad today and sends his apologies to the House.

The amendment seeks to give security officers at the United Kingdom Supreme Court the same powers as those available to court security officers in the other courts of England and Wales under Sections 52 to 57 of the Courts Act 2003. Those sections give court security officers statutory powers to search people, to exclude or remove people from court buildings or to restrain them in court buildings, and to seize, retain and dispose of offensive articles in court buildings. The provisions also create a criminal offence of assaulting or obstructing a court security officer.

There is at present a gap in the law because the Courts Act 2003 confers these powers only on staff appointed and then designated as security officers by the Lord Chancellor in relation to those courts where he is responsible for running an efficient and effective service. In the case of the Supreme Court, the Constitutional Reform Act 2005 vests in the president of the court the power to appoint staff, and the chief executive is under a duty to run an efficient and effective service. The powers conferred by the Courts Act are therefore not at present available to Supreme Court security officers.

Although, of course, Supreme Court security officers would hope never to have to use such powers, it is necessary for them, and for the judges, lawyers and members of the public they are protecting, to know that they have these vital powers at their disposal as security officers should the need arise. Unhappily, as we all know, there have been cases of such powers being needed in courts around the country.

I am sorry that your Lordships do not today have the advantage of hearing from the noble and learned Lord, Lord Phillips, the immediate past president of the Supreme Court, but I hope I have said enough to persuade noble Lords, and, in particular, the Minister that this amendment is necessary. I beg to move.

My Lords, I support this amendment. I understand that the Government may be in a position to say something favourable about it, so there is no need to say anything further, other than that the amendment may anticipate a little bit the debate that may take place on the next amendment about the importance of recognising the Supreme Court as an independent court no longer dependent on the Lord Chancellor.

My Lords, this is a delicate and sensitive matter and I will spend a few moments on it. I entirely understand why noble Lords who have spoken have raised the points that they have. There are some footnotes as well, but two major things emerge from the debate so far. First, it is interesting that, despite the fact that certain noble Lords have said, “Let’s leave the system exactly as it is, there’s nothing wrong with it”, everybody who has spoken so far has proposed a change to the present system, either by supporting the Government or by tabling amendments as the noble Lord, Lord Campbell-Savours, has done—

That is the point. The Government could have said that they had decided that they wanted the term to last for five years, that they would do that by making a commitment now for it to last for five years, unless there are unforeseen circumstances, and that they would legislate for future fixed-term Parliaments of a different level. It was not at all a question of the committee recognising that five years, as a legislative fixed-term as opposed to as a result of the exercise of prerogative, was right for this Parliament.

My Lords, I, too, support these amendments. If we are to have fixed-term Parliaments, a change to the constitutional practice over the past 100 years advocated by the noble Lord, Lord Tyler, then four years is manifestly preferable to five. The Constitution Committee, of which I, too, am a member, heard evidence from a vast number of witnesses who advocated four years. Almost all of them did so on one simple, fundamental ground: you do not enhance the accountability of Parliament to the people, which is the aim stated in the coalition agreement, by reducing in practice the length of time between general elections.

There was a further piece of evidence, which I add to that cited by the noble and learned Lord, Lord Falconer of Thoroton, which came from the Deputy Prime Minister himself. At paragraph 57 of our report, we quote the extraordinary evidence given to us by the Deputy Prime Minister last October, when we considered the Government’s programme for constitutional reform. Mr Clegg told us that he did not accept that,

“people are straining at the bit to vote in elections more frequently”.

He added that he had never met anyone who had said to him,

“‘Well, I kind of like voting every four years.’”

I can introduce the Deputy Prime Minister to many people in the Dog and Duck referred to by the noble Lord, Lord Cormack, who are very keen to exercise a right to vote in general elections at least every four years to determine who represents them in Parliament and what the policies of their Government should be.

It is quite bizarre that the Government's response to the diminution in public respect for Parliament and the search for methods of making Members of Parliament more accountable to their constituents should be to propose to insulate Members of Parliament so that there will be a longer period, in practice, before they are answerable at the ballot box. When the Minister responds to this debate, will he please tell the House how a five-year term promotes accountability?
