Lords ChamberMy Lords, such a brief and effective speech is not unusual of the noble Lord, Lord Hain, with whom I have worked on a number of important issues over the years.
I want to make one or two new points if I can, although that is extremely difficult. Indeed, I am reminded of a great friend of mine who was getting married for the fourth time. As his son, who proposed the toast, rose to his feet, he said, “Here we are again”. The Brexit debate in your Lordships’ House is a bit like that. One can guarantee that whenever two or three noble Lords are gathered, whether in this House or outside, one short phrase will be uttered within a matter of moments: “What a mess”. It is our duty, so far as it can be, to help to steer the country out of this mess.
We are constantly reminded of the 17 million people who voted leave. Of course, they were in the majority: 52% of voters voted to leave the European Union. We must respect that. However, 48% voted in the opposite direction. Two statistics are even more stark and telling: 37% of the electorate voted to leave and 34% voted to stay. Those figures put things into perspective and ought to induce a little humility in us all. I have always studied the English Civil War with great interest, with its fascinating people, great issues and extraordinary events, but I have come to understand it only over the past three years. We all have a duty to try to heal some of the rifts and breaches. My noble friend Lord Dobbs, who is not in his place at the moment, referred to last weekend’s polls saying that a large number of remainers would not wish to marry a leaver, and vice versa. We all know from our circles of friends that this is all too true. I speak as one whose sons married remainers a long time ago and are both happily married, one after 20 years and the other after 25 years. That was absolutely a good thing.
We need to bring our nation together. How can we do that? I suggest two things: first, we will all be looking to the other end of the Corridor tomorrow night. There will be a series of votes. We do not know exactly how many; that depends on Speaker Bercow. I believe that even at this late stage, the Prime Minister should make the decision that the votes are free ones. I was in the other place when we voted to enter the European Community, or the European common market, as it then was. It was the courageous but realistic decision of one of the most accomplished Chief Whips in post-war history, translated by then to Prime Minister, that led to a free vote. I can see the noble Lord, Lord Taverne, smiling and nodding because he remembers that every bit as well as I do. That decision had a profound influence on the result because although only the Government side was officially given a free vote, it had a real effect on the Official Opposition of the day, as I knew from talking to many of them at the time.
The Prime Minister would be performing a great parliamentary and national service if she were to sanction a free vote tomorrow. I also think she would do rather better as a result of that magnanimity than by imposing Whips, which did not work terribly well two weeks ago. Assuming for the moment—I hope correctly—that there is a consensus following tomorrow night and the other place is able to concentrate on one or two not mutually exclusive but complementary avenues towards a settlement of this issue, I hope something else can be done. When my noble friend the Leader of the House was introducing this debate, she referred to cross-party talks and to confidential briefings, so that Members of both Houses could have a clearer insight into the precise details of the negotiations. That is good so far as it goes, but I want to resurrect an idea that I first voiced on the Floor of your Lordships’ House in June 2016, when I said it would be a very good thing if we could have a joint committee—based on the Scottish and Welsh committees—of both Houses, not just one House, on the European issue.
If we are to come together—if those of us who accept that there is to be Brexit, but are proud that we are one of 48% of the electorate and 34% of the nation, are to bring people together—it would be good to have a joint committee of both Houses and all parties meeting to discuss the details. It does not need to prolong the issue indefinitely. I was taken with what my noble friend the Duke of Wellington said about a three-month extension; because of the burden of legislation, that may be necessary. Nevertheless, I was brought up sharp, as I am sure many of your Lordships were, by the speech of my noble friend Lord Balfe. He pointed out some of the practicalities involved, and that the European Parliament that meets on 18 July will be different—perhaps very different—from the Parliament that meets on 18 April. It may have a very different angle on some of the great issues.
I am following the noble Lord with a lot of interest. A free vote could, no doubt, stimulate the possibility of a different consensus— or of getting a consensus at all. Given that there are 14 amendments and four amendments to the amendments, and no certainty as to how they will be selected, there is no guarantee that a consensus that may exist in the other place will translate through to here. In those circumstances, might we not need more time in this Chamber to handle legislation that could come from the Commons? A No. 3 Bill is already mentioned in an amendment. Even if we are constrained to 13 June, we certainly do need more time.
As I said, I am attracted by some of the propositions put forward by my noble friend the Duke of Wellington. The fact of the matter is that, as my noble friend Lord Balfe has pointed out, there are practical difficulties. What we want is a united Parliament—so far as we can—and a united nation. Whatever motivated those who voted to remain and those who voted to leave, one thing underpinned whatever that individual motive was: at the end of the day, each man and woman who cast a vote surely wanted a prosperous, peaceful Britain in a prosperous, peaceful Europe. We should focus on that sentiment, because it ought to unite us all. If that needs more time so that we can properly fulfil our parliamentary duties, so be it, but let us get on with it.
I hope that we will see some clarity from the other end of the Corridor tomorrow. I hope also that when we next have a debate, it will not be in the rather sterile and unhelpful atmosphere we are forced to debate in today.
Because the noble Baroness is asking us to take no deal off the table, and we do not think that that is possible because it is the legal default—as I have said many times in this House—because of the notification of withdrawal Act, because of the Article 50 process and because of the withdrawal Act passed in the summer.
My noble friend Lord Balfe asked me how much discussion there has been between Her Majesty’s Government and the incoming Finnish presidency. We are engaging with the Finns through our embassy in Helsinki. This engagement will increase, including potential secondees, as their preparation for the presidency develops.
As I conclude, I think it would be helpful to recap the way forward for this House and the other place. The rejection of the deal two weeks ago was obviously a disappointing moment for this Government. We are mindful that we cannot legally ratify the withdrawal agreement until a deal has been approved, and therefore the defeat precipitated some serious reflection on the concerns expressed by both MPs and Members of this House.
The best way forward, I repeat, is to leave in an orderly way with a good deal. It is not our strategy to run down the clock to 29 March. As the Leader of the House set out in her opening speech, the Prime Minister has highlighted a number of areas in which we intend to address concerns going forward. I have expanded on some of those this evening, including responding to concerns on the backstop, engaging with Parliament as we head to the second phase of negotiations, and demonstrating our commitment to social and environmental protections. It is these proposals, along with amendments to the Government’s Motion, that the other place will consider tomorrow. As the Prime Minister has said, we should all be prepared to work together to find a way forward, given the importance of this issue.
I know that many noble Lords will be following the debate there as keenly as we in government are listening to what is said in this place—and noble Lords’ words will be heard in the other place. We believe that the way forward that we have set out is the only way to seek to address the concerns of Members in both Houses at the same time as respecting the 17.4 million people across the UK who voted in favour of leaving the European Union.
As one who genuinely wants this to work out—as the Government wish it to work out—I ask: why are we going to the trouble of dividing on an unexceptional, entirely sensible, logical Motion that almost all of us in our hearts believe to be right?

I wonder if my noble friend the Minister has read the splendid statement by the boss of Wetherspoons, the pub owners, setting out his method for dealing with a possible no-deal Brexit. He has ceased buying brandy from France and is buying better and cheaper brandy from Australia, and so on with his wines and others. The customers are getting better and cheaper liquor, and the company is making better profits. Is that not a typical result of leaving with no agreement?

Lords ChamberMy Lords, I regret that I cannot agree with the concluding words of the noble Lord, Lord Kerr of Kinlochard, for whom I have, as we all have, great respect and to whom we should always listen with great respect. This has been a remarkable debate so far. There has been one extraordinary suggestion made by my noble friend Lord Howell. I am afraid that my reaction is similar to that of Brenda from Bristol: “Not another one”.
The most important single point that has been made was in the very notable speech of the most reverend Primate, when he reminded us that we are not at the end of the Brexit process. We are not even at the beginning of the end of it; we are at the beginning of the beginning. We have to get on with it. I speak as one who was deeply distressed by the result of the referendum, who believes we are giving up far more than we will be able to retain but who has to acknowledge that a referendum—I do not like referendums—has produced a narrow but decisive result. We have to work on that basis.
I could not take part in the debate in December. I was in hospital, but I was able to follow it at a distance. I talked to doctors and nurses who came to see me fairly regularly, all of whom were extremely exercised by this issue. Those nurses came from Italy, Portugal and Latvia, as well as from the United Kingdom, but they were all united in one thing—they were very concerned about what was going to happen. When you are away from a place, as I was—it was deeply frustrating to be away from your Lordships’ House—you tend to see things from a different perspective: in the words of the great Scottish poet, as others see them.
One thing that perplexed people was all this emphasis on Northern Ireland. I have a great love of Northern Ireland. I had the honour to chair the Select Committee on Northern Ireland Affairs in the other place for the whole of my last Parliament. But we have to remember that in Northern Ireland a significant majority of people voted to remain. Our colleagues from the Democratic Unionist Party should remember that, and take note of what people in Northern Ireland have been saying about the agreement that has been negotiated. Many of them, as we have seen on the television and heard on the radio, say that—as I would say—this is certainly not a perfect deal, but they would much rather end uncertainty and agree it, than do what the DUP want to do. A degree of humility on the part of the DUP would be no bad idea. We all have to recognise that compromise is essential. To those of my noble friends in this House and honourable friends in another who are Brexiteers: it was a narrow victory—a victory certainly, but one that means those who won should look very carefully at the fears and misgivings of those who lost.
The noble and learned Lord, Lord Hope of Craighead, said in his excellent speech that he felt trapped. I know the feeling—it is rather how I feel. I have come to similar conclusions as the noble and learned Lord, Lord Hope. I recognise that leavers cannot dictate terms from the club or institution that they are leaving. But I also recognise that it is completely morally wrong—the most reverend Primate touched on this—to take risks for other people. Take risks for yourself, but not for others. One of the most interesting speeches during the recent Christmas Recess was made last week at the Oxford Farming Conference by the Secretary of State, Michael Gove. He said that no deal would mean great uncertainty, and he even used the word “chaos”, for farmers. I wish he had thought of that two or three years ago. Nevertheless, far better a sinner who repenteth. If he can say that, we have great knowledge that that would be the worst of all outcomes.
We then come to the second referendum. The noble Lord, Lord Kerr, spoke in favour of it, and the most reverend Primate did not totally dismiss it. But just look across the road from your Lordships’ House. See the passions that have been aroused over the last two years, and particularly in recent months. See what would happen with another divisive referendum. Reflect on the tactics displayed in that brilliant Channel 4 film on Monday night. If you do all those things and think you are confident that there would be a sweeping victory for what I would consider to be the best outcome, I would say “Think again”.
We have a deal before us. It is not ideal, but much can be developed from it. The noble and learned Lord, Lord Hope, referred to that. I plead with my honourable friends in another place particularly: let us take what we have and build upon it, and not prolong the chaos and division that have done so much to disfigure our country since 23 June 2016.

Lords ChamberAs on so many things, the most reverend Primate makes important points that we should all take careful heed of.
Does my noble friend accept that the referendum of June 2016 divided this country more bitterly than anything else in living memory? What is the point of exacerbating that division by having another referendum for which there is clearly no groundswell of public opinion? As someone who deeply regrets the result of the referendum of 2016, I endorse, as I hope will my noble friend, the most reverend Primate’s plea for reconciliation.
My noble friend is absolutely correct. There are many arguments against a second referendum, but I think the most powerful one is that it would not necessarily solve anything.

Lords ChamberI have discussed this with the noble Baroness before, but following the conclusion of the negotiation and ahead of the meaningful vote we will make available to all Members of the House a full, reasoned position statement laying out both the political and legal position of the Government on the proposed withdrawal agreement, including any protocols that might be attached to it.
My Lords, while I endorse what the noble Baroness just said, is this not a time when we should remember that it is always a mistake to rush to judgment? We have not seen this document yet; I await it with great interest. It is important that we have proper time to consider it. But we also have to bear in mind that in negotiations there has to be compromise on both sides. If those who have been ramping up the rhetoric in another place would only be calm for a week or two, we might come to a considered judgment.
I agree with my noble friend; a little calmness on all sides would help a lot. But it is amazing to see the number of people rushing to judge something that they have not read yet.

Lords ChamberI understand the noble Lord’s point, but I am not sure that he is correct. We published extensive details on the withdrawal agreement in March. The chapters on citizens’ rights and on the financial settlement have been published, and the details of the implementation period have been published—so I do not think that the European Parliament has access to any more information than this Parliament does. But obviously nothing is agreed until everything is agreed, and the danger of publishing some aspects, particularly with regard to the implementation period, is that they are already being re-discussed in the negotiations. But we will share as much information as possible, and extensive amounts have already been published. We have appeared in front of numerous committees and we will do so again once we have a final agreement.
My Lords, does my noble friend take the point that the committee of the noble Lord, Lord Boswell, could be briefed behind closed doors, as it were? The Cabinet leaks like a sieve but I suggest that members of the noble Lord’s committee would not—and it would help them, if they were so briefed, to advise us properly.
I am sure that the committee of the noble Lord, Lord Boswell, does not leak at all. We are committed to providing as much information as possible, but it is important that we protect the sanctity of the negotiations. Many EU member state Governments have also not been briefed on the final detail and compromises that inevitably will be arrived at. But when we are in a position to share as much detail as possible on the final agreement of course we will do so, alongside the appropriate economic analysis.

Lords ChamberMy Lords, naturally I wish my noble friend and his colleagues in government well; we all do. But could he give the House some indication of what he expects the timetable to be between now and the rising of the House for the Christmas Recess? Could he also have a gentle word with the Foreign Secretary and point out that, while it is humorous if he confuses Japan and China, it is serious if he confuses the European Union with the Soviet Union?
On my noble friend’s last point, I am not sure I am in a position to give the Foreign Secretary advice. But, to be fair, I looked at his comments, and he did not compare the EU to the Soviet Union; he was making a point about how difficult it is to leave various organisations. I think afterwards he withdrew the exact words he used.
Regarding timescales, it is difficult to be precise. We are still trying to target an agreement by the October summit. As I mentioned in my answer to the noble Baroness, Lady Hayter, we are conscious of the need for proper parliamentary scrutiny of the withdrawal Act, and we are preparing for that, but we need appropriate time to get the legislation through both Houses before 29 March. We have made the EU aware of that timescale, but of course we want to ensure we get the right deal for the United Kingdom. As soon as I have more information on the timescale, the noble Lord will be the first to hear about it.

Lords ChamberOf course, in the event of no deal—which, as I repeat ad nauseam, we do not want to happen—we can be responsible for what happens in this country but it is the responsibility of other member states and the European Union to fulfil their side of the bargain and agree what will happen on their side. The border has two sides to it. We can say what will happen on the British side, but what happens on the Irish side is the responsibility of the Irish Government and the European Commission.
My Lords, does my noble friend accept that many people in this country in all political parties are looking for leadership? Will he convey to the Prime Minister, whom I wish to see remain to lead us through these difficult times, not only my very good wishes, but that it would be a very good idea if she were to consult leading figures in other political parties in this country and if she were to use the facilities of Chequers to invite some of our European friends and neighbours over for private discussions? We have to compromise, whichever side we are on, but if we allow ourselves to be led by the European ruination group in the other place, the future will be dire.
The noble Lord was doing so well until he got to the second part of his question. Yes, of course we will provide leadership, and we are. We have set out a plan as to how we think this can be delivered. I am not sure it is a practical suggestion that we consult the leader of the Opposition, who I think is providing a dire example at the moment, but we in our department and other Cabinet Ministers are having ongoing, regular discussions with other European leaders and Ministers. I am travelling abroad regularly myself, as are other Ministers, to try to convince other member states of the viability of our plans and the options that we have presented.

Lords ChamberMy Lords, can I draw my noble friend’s attention to paragraph 7, on page 5? It says:
“There has been agreement to establish a Joint Committee of UK and EU representatives to oversee and discuss the implementation and application of the Withdrawal Agreement”.
That is obviously eminently sensible. Can he possibly give us some details of that group, and reflect on whether there might be wisdom in a suggestion which I made over two years ago that there should be a special Joint Committee of both Houses, as we go through these crucial stages, to look at critical issues? Could that matter please be looked at again?

Lords ChamberMy Lords, I thank my noble friend for remaining in the Government to fight for meaningful negotiations. Will he do all in his power to convince the triumphalist brigade of Brexiteers, of whom there are far too many, that they represent only a small fraction of the population and have to accept that the solution at the end of the day cannot be winner takes all? We have to have realistic negotiations in a spirit of constructive compromise. Will he assure the House that that is how he will play his part in going forward from this document, which is much more realistic than many of us feared it might be?
I thank my noble friend for his comments. I never had any intention of resigning, despite the optimistic tone in the Twitter feed of the noble Baroness, Lady Ludford, which somebody pointed out to me. It was a great amusement to wake up on Monday morning and find the number of people—including the noble Lord, Lord Adonis, the noble Baroness and others—who had been speculating on my demise. Of course, these are difficult times. There were always going to be difficult and tricky negotiations and I have always said that we need to try to come up with a solution which everybody in the country can support. That will be a challenge but we will do our best, because we have to move forward in a spirit of unity and not division.
