In the response to the consultation on the Gender Recognition Act 2004, what consideration is being given to the approach of the International Association of Athletics Federations and its use of testosterone levels to determine whether a trans athlete competes in a women’s or a men’s race?

The hon. Lady raises an important issue, although it is slightly separate from the very narrow remit of the Gender Recognition Act. Every Department is facing all sorts of issues in relation to trans people, so we have brought together a team of Ministers and officials across Government to make sure that policy is where it needs to be. I have also had separate meetings with the Minister for Sport to discuss both elite and community sport. Many of these decisions, particularly at the elite level, are for sporting bodies to lead on, although there are safety issues as well. I can assure her that these will be ongoing meetings across all Departments and that we will make sure that every Department provides services and support and has the right policies in place for modern times.

I have made clear our concern about human rights, but the idea of banning such agreements is nonsensical. This country has £1.3 trillion of stock overseas. Our investors are important in providing development in a lot of these countries, yet they are not given sufficient legal protections, which they would normally get under systems such as the UK’s. That is why those provisions are put in—to protect our investors overseas.

Supporting UK-based companies to invest and operate overseas is a key pillar of the Department’s work. In 2017, UK companies brought home £86 billion as a result of those investments. The Department provides market information and identifies investment opportunities and potential partners. We have developed a new suite of products to help UK businesses as a result of outward direct investment pilots in New York, China, Turkey, Brazil, South Africa and Ethiopia.

I thank the Minister for that answer, but people are quite rightly concerned that setting up overseas subsidiaries or acquiring foreign enterprises could lead to job losses or relocations. Will the Minister confirm the net number of jobs created in the UK as a result of his Department’s support for outward direct investment?

I am grateful to my hon. Friend. As I say, the organisation Women in the Fire Service does great work at local level in encouraging women to join the fire service. Again, as role models, we have the five women we know are heading fire and rescue services currently—of course, of the 45 fire and rescue services in England and the three fire and rescue services in Wales, that is a tiny fraction, but they are very positive role models. I also hope that the Fire Brigades Union will manage to bring a woman on to its executive council in the future. It is through that sort of positive work that we will get women into these services.

Flexible working is crucial to support women and men in balancing work and caring responsibilities. That is why the Government Equalities Office is working with the Department for Business, Energy and Industrial Strategy and the flexible working taskforce in using our research programmes to develop evidence-based guidance for employers.

I thank the Minister for that answer, but the right to request flexible working is not the same as an entitlement to work flexibly. Given that so many of these requests are refused and that the Government have said that they want to encourage flexible working, will they consider placing a duty on employers to advertise jobs as flexible?

We have announced our intention to consult on these very matters, but I would also say that, as that will take a little while, employers should not wait for it. We know that by offering flexible working they are going to have a bigger pool of talent from which to pick their employees.

I have noted some of the discussions on the Agriculture Bill, which I read earlier today, and I have noted the discussions on this. I have to say, and the hon. Lady should take some real encouragement from this fact, that the standards on these issues in the UK are already higher than they are in the EU. That, I think, should give the House confidence as to the UK’s intention on this. I will repeat one more time: there is absolutely no intention that the Government will reduce their standards in this area.

I am committed to ensuring that UK trade policy supports gender equality. I will be publishing scoping assessments on each new free trade agreement and these will consider the effects of concluding trade deals on different groups, including gender groups.

The hon. Lady raises a very important point. It was one of the points we considered at the World Trade Organisation meeting of Trade Ministers in Buenos Aires. We looked at a study showing that of companies that trade only offline, four out of five are owned or run by men. Of those that run only online, four out of five are run or owned by women. This indicates that e-commerce is one of the prime development tools that we can use. The liberalisation of e-commerce and creating a global network of regulation is therefore one of the best ways we can combine trade and development policy, specifically to help women experience the benefits of the global economy.

The law is very clear: employers are not allowed to discriminate against women on the basis of pregnancy or of their maternity commitments. As part of dealing with the gender pay gap, employers are beginning to talk about how they treat their workforce in a way that they did not a year or two ago. To me, this is part of readjusting what we expect from employers and what employees expect of the people for whom they work.

5. What steps the Government are taking to ensure that training and information on the menopause is provided for managers and other employees in the workplace.

The Government commissioned an evidence review of menopause, published last July, which highlighted the important role that employers can play in supporting women. Following that, the Women’s Business Council developed a toolkit for employers, which enables employers to make the right adaptations to physical workplace environments, support flexible working, and raise awareness to help tackle this issue. To date, social media awareness-raising activity has reached nearly 300,000 people.

I thank the Minister for that answer. The TUC and the trade unions have produced some excellent guides to menopause policies in the workplace. Does she agree that menopause policies should become statutory for employers in the same way that maternity policies are statutory?

This is part of our changing expectations of employers. We now know that the employment rate of older women, aged 50 to 64, has risen more than any other age group since 2010. With more women over the age of 50 remaining in work, more women will experience the symptoms of menopause while at work and so it is in employers’ interests to ensure that they have policies that adapt.

The £5 million available for returns programmes will also be aimed at employers. We must understand that a complex set of reasons put people off returning to work, and the evidence that will be gathered will be important in ensuring that the best practice guidance published in spring gives a clear direction to employers, to ensure that they can harness the skills of those who take time off work.

Will the Minister explain what steps are being taken to ensure that older workers, including women born in the 1950s, who wish to return to work are given access to adequate training programmes in their local communities?

The hon. Lady makes an important point—I declare an interest as I consider myself an older worker. She is right to say that people choose to return to work at various times, and we must ensure that facilities and retraining schemes are available. We must also dig deeper to find out what the obstacles are. Confidence building with women is a significant issue when they have taken time off, and the longer that someone is out of the workplace, the more difficult that becomes.
