I think what we actually heard and saw was a dysfunctional former chair of the Post Office; that is what we saw. Interestingly, to the right hon. Gentleman’s point about compensation schemes, the former chair said at one point during his evidence that he had no concerns about the speed of delivery of the HSS—which was extraordinary, because I have many concerns about it.
I hear loud and clear calls from across the House about the role that the Post Office is playing in compensation schemes. These are sensitive matters, because people in the Post Office are employed to manage and administer the compensation schemes. I hear the point made by the right hon. Member for Orkney and Shetland (Mr Carmichael) loud and clear. We are looking at it, but I reassure him that all three schemes have independence in them: an independent panel in the HSS; an independent panel and a reviewer, Sir Ross Cranston, on the GLO scheme; and the independence on the overturned convictions in Sir Gary Hickinbottom. Both latter people are retired High Court judges, which should give claimants and the right hon. Gentleman, I hope, some confidence that the schemes will operate properly.
My hon. Friend the Minister has referred to Mr Staunton, who it seems had serious character defects. How was he ever appointed in the first place, and who provided the character references and oversaw that appointment process? May we have an inquiry into that?
Thankfully, not me. I have nothing against Mr Staunton personally. He had a strong track record as the chair of various large organisations, as he said yesterday. I think we would all agree that the Post Office is a specific organisation with specific challenges. Yesterday’s evidence from Ben Tidswell, the senior independent director, was interesting. He felt that Mr Staunton’s behaviour changed in November last year and became far more “erratic”—his word. I do not know the reasons for that specifically, although Mr Tidswell suggested some yesterday. Whatever the reason, Mr Staunton’s recent conduct is not consistent with remaining chair of the Post Office. That is why we decided to act.

I am sorry that the hon. Member has taken that tone, but that is not true. As I set out, I think Henry Staunton has got this completely wrong. It is not the case, and there has never been any situation while I have been in this role—my predecessors have said the same—where we have tried to delay compensation. If the hon. Member wants to write to me, I am very happy to look at an individual case. Our commitment on the GLO scheme is that once we have received a full claim, we will respond to 90% of cases within 40 days. Some cases are more complex, but I am very happy to look at her specific case, as I have for other Members when people have contacted us directly. I am very keen to make sure that we get a resolution to her constituent’s case as quickly as possible.
I congratulate the Minister on his tenacity in relation to this issue. When does he expect the inquiry to be completed? It seems that Fujitsu is hiding behind that inquiry and is unwilling to commit itself to compensating the taxpayer for the compensation the taxpayer will be paying.
I thank my hon. Friend for raising that important point. The inquiry is due to conclude by the end of this year and to report some time—early, I hope—next year. At that point, we will know more about Fujitsu’s exact role and the amount of the final compensation bill. I welcome the fact that at the Select Committee Fujitsu acknowledged its moral obligation to the victims and the taxpayer in contributing to the compensation bill, and we will hold it to its promises in that regard.

Commons ChamberThe right hon. Gentleman is absolutely right about that. That is why organisations such as the TaxPayers Alliance are trying to work with the general public to raise the profile of these subjects. What is happening is a concerted fraud upon the taxpayer by these officials, who are cosying up to each other and ensuring that they are the only people who do not suffer as a result of their own incompetence.
In one of my small local councils, Hambleton District Council, two officials have had pay-offs in excess of £300,000 over the past three years. One of them was only earning £100,000—“only”, he says. The local authority says that it wants the measures brought forward so that it can cap future payments. Does my hon. Friend not agree that it is high time that we did that?
Absolutely, I agree with that. Of course, the Government said that pending the implementation of the regulations, they would ask the public sector to comply with the spirit of them and the primary legislation that had been passed, but I am afraid that is almost impossible for local councillors and, indeed, the Government to do in practice, because we need to have the law in place. That is why I hope we will hear from the Chief Secretary that we will get the law on the statute book later this year so that public sector exit payments are limited to £95,000.
Clause 2 of my Bill suggests that we should give notice to all people who might be thinking of getting ahead of the game that they would be subject to the provisions of the Bill in respect of any public sector exit payments agreed after 1 April 2020. I do not know whether the Chief Secretary thinks that to be a sensible safeguard, but I hope it will find favour.
It is ridiculous that we should have to legislate to force the Government to introduce regulations. Many new colleagues are here today. I should tell them that on Fridays the Government often promise the earth and never deliver. My right hon. Friend the Member for East Yorkshire (Sir Greg Knight) introduced a Bill to deal with rogue parking operators last year. It got on to the statute book and everyone thought that the Parking (Code of Practice) Act 2019 meant that we would get rid of rogue parking operators. It may be months or years before anything effective is done in regulations.

Why are we preventing letting agents from charging for credit reference searches, identity and passport checks, and all the rest? When one looks at the evidence in support of the Bill, it is quite clear that if the existing laws were properly enforced, the need for the Bill would not have arisen. I am extremely sceptical about the Government’s assertion that enforcement will be a lot more effective. If they really believe that, why do they not place a duty on local authorities to enforce the legislation, rather than leaving it as a mere power?
The legislation will have a lot of unintended consequences. It is already difficult enough for tenants to obtain rented accommodation if they have pets. It is very difficult for tenants on housing benefit to obtain accommodation. It is very difficult for tenants who do not have clear British citizenship to get rented accommodation. All those things will become a lot more difficult as a result of this additional burden on the private rented sector.
Some 30 years ago, I was a junior Housing Minister. I was much associated with deregulating the sector—introducing shortholds, getting rid of controlled tenancies and enabling the growth that has taken place in the private rented sector. I am disappointed to see my Government working in the opposite direction. I signed amendment 4, which was tabled by my hon. Friend the Member for Shrewsbury and Atcham. I understand that he has been bought off by the Government, so I will not press the matter to a vote. However, I think that there is too much crowd-pleasing on the part of the Government and not enough sensible regulation and recognition of the important work done by those in the private rented sector.
This is the perfect opportunity for me to speak. I draw the House’s attention to my entry in the Register of Members’ Financial Interests, as a result of which I recused myself from the Select Committee’s pre-legislative scrutiny of the Bill. On the face of it, the Bill will cost my business more money than I wish to think about, and it is certainly keeping my finance director awake at night; we are talking about significant sums. Nevertheless, I disagree with my hon. Friend the Member for Christchurch (Sir Christopher Chope), because we do not have a free market here. I think that it is an entirely Conservative policy to make sure that we have free enterprise and a free market.
Tenants choose properties; they do not choose letting agents. Landlords choose letting agents. Despite the cost, we should be standing up for the values of free enterprise. The business I have mentioned, which I am still involved with today, could not have been built without the opportunities provided by free enterprise, so there is no way that I could not support the Bill. I appreciate the amendment tabled by my hon. Friend the Member for Shrewsbury and Atcham (Daniel Kawczynski), but I think that even a cap is the wrong approach. We need to abolish these fees completely, as I have consistently argued to the industry.
I want to make a couple of points about free enterprise and the private rented sector. The shadow Minister, the hon. Member for Great Grimsby (Melanie Onn), said that the private rented sector had increased exponentially over the past few years. When I started 30 years ago in this business, I operated in York, where the lack of supply meant that anyone who wanted to rent a home would probably get a shabby, damp, dark terraced house. It is because of private sector investment that we now have such tremendous supply in this marketplace, generally at fair rents.
I am not sure where the hon. Member for Oxford East (Anneliese Dodds)—she is not in her place—got the figure of an 18% yield from, but that seems incredible. On that basis, there is probably a march of investors heading down the road to Oxford East to buy property. Generally, yields in the sector are very tight—about 4%, not 18%—because of the competitive nature of the market.
I support the Government amendments to ensure that any charges are clearly defined in a tenancy agreement.
