Commons ChamberMy role is to help the parties but, clearly, if they are able to reach an agreement, I am sure that they will want things from the UK Government, and I will consider those when we are at that stage. If my hon. Friend will forgive me, we are at a delicate stage in the negotiations and I would not want to compromise anybody’s position at this point.
One of the issues that has to be addressed in the talks is justice for victims. The Secretary of State will be aware that the late William Frazer, who was laid to rest this Monday, devoted his life to fighting for victims; I pay tribute to him and his work. Does the Secretary of State agree that one of the biggest issues must be addressing the definition of a victim, so that innocent victims are entitled to the pension they need?
The right hon. Gentleman refers to a number of issues, and he is right to do so. He refers to dealing with the legacy of the past. He will know that we have consulted on the institutions agreed at Stormont House and will publish a response to the consultation in due course. He also mentioned pensions for severely injured victims, which have been promised to them for far too long. I am determined to make progress on that matter.
Another issue that is causing real problems across the community in Northern Ireland, in the absence of devolved government, is the atrocious waiting lists in the health service, with cancer victims being made to wait a horrendously long time and targets being missed. Surely in the last days of the Prime Minister’s tenure, she will address that point and ensure that something is done to bring waiting lists under control. It is not good enough that the Government sit on their hands while this is happening.
I do not accept the right hon. Gentleman’s comment that the Government are sitting on their hands; the Government are absolutely determined to see these matters addressed and the best way to do that, as he knows, is through devolved government in Stormont. I pay tribute to him and his party for the willingness that has been shown and their determination to engage in the talks very constructively and to make progress. I very much welcome that, particularly from the leader of the Democratic Unionist party, Arlene Foster, whose attitude has been exemplary throughout.

Commons ChamberMy hon. Friend is right to talk about civic society, which has played a role in the talks so far. We have had engagement with Church leaders, who have had their own initiative to get the party leaders together with civic society. Representatives of civic society have also had the opportunity to meet the party leaders to discuss their issues with them. The point of that meeting was that, yes, it is important that civic society can make its points to the leaders about what it wants to see government deliver, but it is also important that civic society recognises that everybody will not get what they want on day one. Civic society needs to show the same restraint that we are asking politicians to show.
I am pleased to say that Senator Mitchell visited Northern Ireland a couple of weeks ago, when he was able to come to the talks to add his support for the work that is happening. I want the talks to succeed, and I am prepared to consider anything that will help that. At the moment, however, the mood is right, the atmosphere is right, and we need to keep working hard on that.
I thank the Secretary of State for her statement. After the outrage expressed following the killing of Lyra McKee, the attack on the PSNI officer shows the depths of depravity of the terrorists who entirely disregard what the communities are saying. Sadly, they will not desist even if the Assembly is up and running, because David Black was murdered when devolution was going on. Such people need to be tackled resolutely. Will the Secretary of State assure the House that everything is being done to ensure proper co-ordination with the Garda Síochána, and that the police are given the resources and everything they need to tackle this scourge in Northern Ireland?
On the talks themselves, may I ask the Secretary of State to ensure that the three-stranded approach to which she referred is kept sacrosanct, so that Northern Ireland’s internal affairs are a matter for the Northern Ireland parties and Her Majesty’s Government?
On the latter point, I assure the right hon. Gentleman that that is the case. He also talked about the threat from dissident terrorists, and he is right that the threat will exist no matter what, but it flies in the face of what people across the community want. We all stand ready to do whatever is required. I spoke to Deputy Chief Constable Martin yesterday, and I continue to offer whatever support is required by the PSNI, which works closely with the Garda Síochána, to ensure that we are all tackling the threat.

Commons ChamberI do agree with my hon. Friend that we need to see the restoration of the institutions. I also agree that we need to see fair redress for those victims of historical institutional abuse. I have met those victims. Their stories are heartrending and absolutely dreadful. No one should have suffered the way that they did. I am not prepared to wait for restored devolution to take action in this matter. I am determined that we will do everything we can for those victims of historical abuse and that we will take measures forward as soon as possible and not wait for restored devolution.
On that subject, the Secretary of State and, indeed, the whole House will be aware of the sense of outrage that there is across the entire community in Northern Ireland and among the victims of abuse about her approach to this issue in recent days. Frankly, many people are saying that far too much time has already elapsed, given the fact that she has the ability to make this move faster. People are outraged at the idea of having to wait another couple of years, as she appeared to indicate. Will she now undertake to bring forward measures immediately to deal with this issue?
I do not shy away in any way from my responsibilities in this area, and I am absolutely determined that we will act as soon as we can. The two years the right hon. Gentleman referred to is an estimate by the civil service of Northern Ireland; it is not an estimate that I have put forward. As he will know, following the end of the consultation that I asked the head of the civil service in Northern Ireland to conduct, a number of decisions need to be taken—decisions that require ministerial input. I have asked the five parties in Northern Ireland to assist me in getting a resolution to those questions as soon as possible, so that I can act as soon as possible, as I am determined to do.
The Secretary of State will be aware that this is one but probably the most terrible example of a whole series of decisions that have cross-community and cross-party support but that she has refused to do anything about, even though this place and her Government are responsible for the administration of Northern Ireland. The fact of the matter is that people are being told that she has now placed another series of questions that need to be answered, and people see this as further delay. What are the questions that she now wants further answers to, who originated those questions, when did they first come to her—when were they put on her desk —and why is this being used as further reason to delay the proper process of compensation for these victims?
I have enormous respect for the right hon. Gentleman—he is an honourable man who works very hard for his constituents and for Northern Ireland—but I disagree with him on this matter. The head of the civil service and Executive Office has put forward 15 questions that need a response. I have asked the parties in Northern Ireland to help me to get decisions on those questions. But I am not shying away from my responsibility in that area; I am merely asking them if they will help me to answer the questions that David Sterling has posed to me to enable me to take this to the next stage so that we can deliver for the victims as soon as possible.

Commons ChamberI join the Secretary of State and the shadow Secretary of State in their powerful words today in this House. Everybody is shocked and horrified at what happened in Londonderry just before the weekend. It has brought a palpable sense of real grief, shock and anger across the community at how a young lady who had so much to offer, Lyra McKee, was struck down in such circumstances. We had the appalling statement by those responsible that this was some kind of accident, as though it was okay to murder police officers. These are people—journalists, police officers and others—going about their proper business on behalf of us all, and they deserve all of our thanks and gratitude. Can the Secretary of State be assured that all of the political parties and all of the community, right across the board, are united in their absolute determination that we will move Northern Ireland forward and never return to the terrible types of incidents that we have seen on such a scale before?
I thank the right hon. Gentleman for those comments. He rightly says that “shocked” and “horrified” absolutely sum up the feelings in Northern Ireland over the past few days. As I said in my statement, there is no apology for this—this was murder. There is no justification. There are no excuses. This was taking the life of an innocent, dynamic, bright, energetic young person, depriving her of her future and depriving her partner and her family of their loved one. There can be no excuse for that.

Commons ChamberI agree that it is in everyone’s interests that we co-operate with all our friends in the European Union, and in particular with Ireland. My hon. Friend is right. Northern Ireland is part of the United Kingdom—a separate jurisdiction and a separate sovereign country—and therefore there are differences. As I have said, the best way for us to leave the European Union—the way that will protect so many of the things that have been achieved in the past 21 years—is to leave with a negotiated agreement.
Of course everybody wants to get a deal that can get through this House of Commons. I remind the Secretary of State that she, along with us and Members from her own party, voted for an amendment saying that the backstop had to be replaced with alternative arrangements. Will she confirm that she still stands by that, and will she encourage her right hon. Friend the Prime Minister to adopt that approach, which the Leader of the House referred to yesterday?
The right hon. Gentleman is right to point out that there was a majority—the only majority in this House for anything—for the Brady amendment. I was one of those who voted for it, because I want to see changes to the backstop. Of course, that is something we have achieved through the agreement that alternative arrangements could be part of the way in which the backstop is replaced. As I have said, we all want a negotiated exit that works for the whole United Kingdom, including Northern Ireland.
I am grateful to the Secretary of State for confirming on the record in the House today that she agrees that changes do need to be made to the backstop—it is important to recognise that. With regard to a no-deal outcome, she will have heard the Irish Taoiseach, and indeed Michel Barnier, say that in the event of no deal there will not be any hard border on the island of Ireland and that arrangements will be made to ensure that checks and controls are made operationally away from the border. Does she understand the frustration, therefore, with people who say that, in the event of no deal, there will be no hard border, but who are insisting on a backstop, which could actually bring about the conditions that they say they want to avoid?
I understand the many frustrations that there are around this process. I voted for the withdrawal agreement—I voted for it three times. I believe that it is a fair and balanced way for the whole United Kingdom to leave the European Union in a way that respects fully the Belfast agreement and its successor agreements, and that is what I want to see us deliver.

Commons ChamberThe reason for the legislation in the first place was that we need to ensure that there is some political cover for civil servants taking decisions. We want to make sure that public services continue to run and that civil servants can take decisions. They cannot change the law and they cannot take major policy decisions, but it is very important that they are able to take decisions on infrastructure, funding for schools and hospitals and so on. The alternative to extending the legislation is, as I set out earlier, one of two things: either a fundamental change in the way that decision making takes place in Northern Ireland—a step that I do not believe is in the interests of the people of Northern Ireland—or the requirement to call an election, which is a very costly exercise that I do not think would see any fundamental change to the political dynamic there.
I thank the Secretary of State for the consultations that she has had with us on this matter. Of course, this is the right thing to do in the circumstances. Regrettable though it is, it is the only possible course at the present time. However, could I suggest that she does something a bit more radical to take the initiative a bit more? What about calling the Assembly together? What about putting it up to the parties as to who is prepared to go into government now and who wants to sit outside? My understanding is that four of the five parties in Northern Ireland would go into government tomorrow, so why not put it up to people? Instead of all the talk about wanting devolution, let us see who will actually vote for it. Please do that.
I thank the right hon. Gentleman for his question. I am aware that he probably has an aeroplane to catch, so I will not detain him any longer than need be. I am looking at what we can do over the next few weeks to get the parties together to start the dialogue and to make sure that when a talks process does start, it has the best possible chance of succeeding.

Commons ChamberThe Secretary of State knows, and the whole House knows, that there was violence on the part of dissident republicans even when we had devolution. However, given yesterday’s improvised explosive devices and the link to dissident republicans, can she tell the House whether there is any prospect of the security threat level being raised, and does she have any more information about the origins of those devices?
The threat level in Northern Ireland—the level of threat from Northern Ireland-related terrorism—is “severe”, and there is currently no suggestion that it will change. I had a conversation with the Chief Constable this morning. In respect of the specific incident to which the right hon. Gentleman has referred, these are the early days of an ongoing investigation, and it would not be appropriate for me to say anything further at this stage.
I thank the Secretary of State for that information, but she will understand the concern that is out there about those devices being sent through the post. May I urge her to ensure that the lack of devolution does not hamper the introduction of any powers or resources that the Chief Constable may need in Northern Ireland—or, indeed, here on the mainland—for the purpose of combating such a terrorist threat?
I can assure the right hon. Gentleman of that. Despite the lack of a devolved Executive, we now have a fully constituted Policing Board to ensure that we have proper governance arrangements in Northern Ireland. That step was taken after the House passed the Northern Ireland (Executive Formation and Exercise of Functions) Act 2018. However, the right hon. Gentleman is right: we need to ensure that the police have the powers that they need, throughout the United Kingdom, in order to challenge and deal with the threat of terrorism.

Commons ChamberMy hon. Friend gives an important example of why we need devolved government in Northern Ireland. He alluded to the Northern Ireland (Executive Formation and Exercise of Functions) Act, which allows civil servants to make certain decisions but is no replacement for having Ministers in Stormont making those decisions. That is why I am determined to find a way to bring the parties back together, and I assure him and his Select Committee that I will update the House at the earliest opportunity.
I welcome the Secretary of State’s response to the urgent question. It will be vital that decisions are taken by Ministers in some shape or form once we get Brexit over the line, because we cannot continue in the current scenario after that has happened; the decisions required will be too great. I remind the House that the reason that devolution is not up and running is not that all parties in Northern Ireland cannot agree—four out of the five parties in Northern Ireland would enter devolution tomorrow. Preconditions are being set by one party, which talks a lot about Brexit being an existential threat and yet boycotts this House, boycotts the Assembly and boycotts the Executive. We all see that as the major challenge. Health, education, police, justice and security are all far more vital than some of the preconditions being laid down by a minority party in Northern Ireland. The reality is that we need to get on with the job without preconditions, and therefore, along with all the other parties, I am up for any measures and discussions that can get that to happen.
I welcome the right hon. Gentleman’s comments. I hope we can find a basis on which to get the parties together, talking about and agreeing a basis for government, because he is right; the people of Northern Ireland deserve that.

Commons ChamberI would very much prefer there to be a devolved Government in Stormont setting the budget for the Departments in Northern Ireland, but sadly that is not the case. Therefore, it is incumbent on me, as Secretary of State, to ensure that we have a proper statutory basis for public spending in Northern Ireland, and I am working on that budget. I will, of course, talk to other parties about the matter.
In relation to budgetary matters, the Secretary of State will be aware of the massive extra boost to the block grant as a result of the confidence and supply arrangement. Will she ensure that the Northern Ireland Office works closely with devolved Departments to ensure that progress is made on all blockages to the proper roll-out of all that money, and the other major infrastructure projects for Northern Ireland, as quickly as possible?
I want to make sure that all projects in Northern Ireland are properly delivered. Clearly, I do not have executive powers to ensure that they are delivered, but I am working closely with the Departments to make sure that money, particularly confidence and supply money, is spent properly.
In relation to devolved issues more generally, does the Secretary of State accept that there could be a greater role for Assembly Members, who are currently not meeting, in input into decision making and policy making in Northern Ireland? It is deplorable that certain elected representatives from Northern Ireland do not take their places here, and that the same party refuses to get the Executive up and running.
I want the institutions in Stormont to be restored as soon as possible, and I want to work with all parties to make sure that that can happen. It is important that where there are roles for Members of the Legislative Assembly, they continue to contribute. I pay particular tribute to the Churches, which have organised a number of meetings to allow civic society, MLAs and others to get together and discuss important matters. Those are great initiatives.

Commons ChamberI thank the Chair of the Northern Ireland Affairs Committee. I am absolutely sure that its members will enjoy themselves immensely in what is a wonderful, welcoming, friendly and vibrant city. He is right that there have been, and will continue to be, a number of ministerial visits, including from my right hon. Friends the Chancellor of the Duchy of Lancaster and the Secretary of State for Housing, Communities and Local Government, and from me.
My right hon. Friend the Chancellor of the Exchequer visited and wanted to meet people to talk about the Derry and Strabane city deal. My hon. Friend is right that prosperity is the answer. If people see a bright future for their city, they want to stand tall and fight for it. They want to stay and work and enjoy jobs and opportunities.
I agree with my hon. Friend that the reaction of the people of Derry/Londonderry has been extraordinary. It sends a clear message that the people of Northern Ireland do not want a return to the troubles of nearly 21 years ago. They want to go forward with peace on their streets.
I join the Secretary of State in saying that parties and communities across Northern Ireland are utterly united in their condemnation of this terrible event. I also join her in praising the work of the PSNI and the emergency services, who have provided and continue to provide safety and security on the streets of Northern Ireland.
I also welcome what the Secretary of State said about this being unrelated to the current debate on the EU. It is also somewhat unrelated to what has happened in Stormont. The murders that I referenced earlier, which were committed by those same people, happened during a time when we had devolution and functioning democracy in Belfast at Stormont. Let us not legitimise in any way what these people are about by ascribing to them a cause. These people want to destroy communities on both sides and they want to disrupt. They want to bring nothing positive and have no agenda whatsoever. Therefore, I totally support what the Secretary of State said in that regard.
The right hon. Gentleman puts the point extremely well. There is no excuse and there can be no justification whatever for those activities. He is right: these are activities that have gone on for far too long. A very small number of people—but determined people—want to cause damage. But he is right: we are all united. It reminds us that there is far more that unites us than divides us. We should all bear that in mind. I thank him for his comments. I agree with everything he said.

Commons ChamberLast week, the Secretary of State was telling everybody that this was the best deal and the only deal. The Prime Minister now says that that is not the case and she needs changes. What does the Secretary of State say to that?
As I have said, this is the best deal. This is the best way for the United Kingdom to leave the European Union as a whole in an orderly way, but the Prime Minister has recognised and listened to the concerns of the right hon. Gentleman, his colleagues and many others in the House about the backstop, and she is looking to assuage those concerns.
The Secretary of State cannot have it both ways. She is telling everybody that this is the best deal, it is a wonderful deal and everybody should accept it. However, the Prime Minister is telling everybody that nobody likes it, the Irish do not want it, Europe does not want it and the British Government do not want it. How does the Secretary of State explain the utter contradiction in those arguments?
I disagree with the right hon. Gentleman that there is a contradiction. I think he is talking about the backstop. We all agree that the backstop is a very uncomfortable thing that none of us wants to see introduced, just as we never want to see any insurance policy called upon, because the fact that it is called upon means that the worst has happened.

Commons ChamberThe point of the legislation is that it provides the space and the time for the parties to come together and put the best conditions in place for those parties to come back around the table, do the right thing by the people who elected them, and form an Executive and get back into the Assembly.
In the continuing absence of devolved Government, the Secretary of State will be aware that a further 1,044 neurology patients have been recalled following the further revision of the notes of Dr Michael Watt in the Belfast trust area. That brings the total number of patients recalled to 3,544. Has the Secretary of State spoken to the Health Department in Northern Ireland about this issue, and what can she say today to provide assurance and relieve the anxiety and worry that many of these people will obviously have at the present time?
My Department’s officials and the Minister of State, my hon. Friend the Member for North West Cambridgeshire (Mr Vara), speak regularly to the permanent secretary and other officials in the Department of Health. I also meet the permanent secretary to discuss various matters, including those we discussed in terms of the Bill last week, which, when it becomes an Act of Parliament, will give civil servants the ability to make decisions, as they rightly should. But that is not a substitute for devolved Government, and we need to have Ministers in place to make important decisions, because these are devolved matters that should be dealt with by devolved Ministers.
I hear what the Secretary of State says, but these are people living with real anxiety and real worries at the present time, and she has an opportunity to do something about it now. Rather than wait, can she not say something to these people that will provide them with real hope that the inquiry will proceed quickly and that action will be taken to ensure that this kind of thing does not happen again?
I know that the right hon. Gentleman, who as a constituency MP represents many people affected by this, cares deeply about this matter and wants to see action taken. I, too, want to see action taken, and I will be happy to discuss this with him separately in terms of what actually can be done under the devolution and constitutional arrangements in place.

I hope I will not repeat what was said earlier. I thank the Secretary of State for what she has said. May I gently say to her that of course the experiences in my constituency over recent years reflect the fact that we have made considerable progress? There was worse violence at the time when the Executive was actually in place, ironically. I just make the point that these things are not necessarily linked. There are particular circumstances in Londonderry and east Belfast. The need for extra police resources is key. That is what the Chief Constable is asking for, and that is what the Secretary of State has heard today.
As the Chief Constable put it to me today, there has been slow but fragile progress. As the right hon. Gentleman knows, I have received the request from the Chief Constable, and I am considering it.

Commons ChamberThe hon. Gentleman is also persistent in his questioning. As I said last Wednesday in front of the Select Committee, we have received the Chief Constable’s report and are looking at it.
The emergency powers under section 59 of the 1998 Act are intended to be used only in the absence of more orthodox legal authority. I do not consider those emergency powers to be appropriate for managing Northern Ireland finances for a second financial year.
Before the Secretary of State leaves the issue of security and preparations for a no-deal exit from the European Union, I am sure she will remember that at the meeting in Downing Street with the Prime Minister and herself, the leader of my party and I presented to the Prime Minister directly information supplied by the Chief Constable of the PSNI on the issue of extra resources. As well as dealing with the issues that have rightly and properly been raised at the Select Committee, it is important that she recognises that the Prime Minister herself made a commitment to look very carefully at that issue, and we expect an early answer on it.
For clarification, the report I am referring to is precisely the one presented to the Prime Minister by the right hon. Gentleman and the leader of the Democratic Unionist party. We have received it and are considering it across Government, as we rightly should in that situation.
This Bill seeks to put the budget position I set out in March on a legal footing. It does not direct the NICS Departments on how to use these allocations. In the absence of an Executive, it remains for Northern Ireland Departments to implement their budget positions. How Northern Ireland Departments will allocate their budgets is set out in the detailed NI main estimates Command Paper. Passing this budget Bill does not remove the pressing need to have locally accountable political leaders in place to take the fundamental decisions that will secure a more sustainable future for the people of Northern Ireland.
I will now turn to the Bill itself. The Bill authorises Northern Ireland Departments and certain other bodies to incur expenditure of up to £8.9 billion and use resources totalling up to £9.9 billion for the financial year ending on 31 March 2019. While this is a technical budget Bill, I do not dismiss the constitutional significance of Parliament having to deliver this for Northern Ireland. I therefore draw Members’ attention to two important issues that do not form a part of the Bill expressly, but will be of interest to Parliament as we debate the Bill. First, as I highlighted in my March statement, this budget includes a further £410 million of UK Government funding that flows from the confidence and supply agreement. That is in addition to the £20 million already released in 2017-18 to help to address immediate pressures in health and education.
That point has been raised with me on a number of occasions. My right hon. Friend will know that I legislated to stop the increase in salaries that would have happened automatically on 1 April, and we are considering the position with regard to ongoing salaries. I know that he will be surprised, but I am afraid that even cutting Northern Ireland Assembly pay would not quite reach the figure of £100 million that we needed to reallocate from capital to revenue.
I am sure the right hon. Member for Hemel Hempstead (Sir Mike Penning) will be very interested to hear the much more substantial amounts that would be saved if we cut payments to Members who do not take their seats in this House. Since 2005-06, £1,023,334 has been paid to date in representative or equivalent Short money to Sinn Féin Members who do not take their seats, and they have got £4,165,000 in office costs and staffing allowances for not doing their jobs here. That has been tolerated by the Northern Ireland Office and by this House for a lot longer than there has been an issue of pay for Members of the Legislative Assembly. I am all for dealing with the issue of MLA pay, but let us deal with Sinn Féin issues as well.
I have to say that this is not a matter for which the Northern Ireland Office has responsibility, as the right hon. Gentleman knows. This is a matter for the House, because those allowances are paid from the House. I encourage all right hon. and hon. Members who feel strongly about that matter to take it up with the House authorities.
The UK Government remain absolutely committed to providing Northern Ireland with good governance and stability while we continue our efforts to restore devolved government at the earliest possible time. The people of Northern Ireland deserve strong political leadership from a locally elected and accountable devolved Government, and that remains my firm priority. In its absence, however, the UK Government will always deliver on their responsibilities for political stability and good governance in the United Kingdom. On that basis, I commend the Bill to the House.

Commons ChamberDuring my discussions with political parties, I do need to ensure that we discuss a range of issues, such as the appointments that cannot be made in the absence of Northern Ireland Ministers. I am actively considering the issue of those public appointments, including assessing what action could be taken to address the problem. I will return to the House before the recess to set out my course of action in more detail.
May I thank the Government for their engagement at the highest level with the Democratic Unionist party here on these Benches on a continuing and intensive basis? In the absence of devolution, it is important that Northern Ireland’s voice is heard here, in the corridors of power. I ask the Secretary of State to bear in mind that Monsieur Juncker and Monsieur Barnier go to Dublin tomorrow and that we are likely to hear a lot of harsh rhetoric. Will she encourage them to bear in mind the principle of consent in the Belfast agreement and its successors, and not to take a one-sided approach to this issue in Northern Ireland?
I have been clear, as have all Ministers in this Government, that we are committed to the Belfast agreement and all its principles, including the principle of consent. I hope that the political leaders that the right hon. Gentleman referenced have also heard that message.
The Secretary of State referenced the absence of devolution. Of course, one of the issues is the absence of funding for the Commonwealth youth games in 2021. Will she look carefully at what might be done to bring forward funding for this prestigious event? It should not be stopped as a result of Sinn Féin refusing to form a Government.
I met the Commonwealth Games Federation last week and I am aware of the concerns about this matter. I urge political leaders across Northern Ireland to make clear their support for the Commonwealth youth games in order that the Northern Ireland civil service can release the funds.

This is the third important piece of legislation to be brought before the House this week. The Northern Ireland Budget (Anticipation and Adjustments) Bill, which the House debated yesterday, and the Northern Ireland (Regional Rates and Energy) Bill, on which we have just concluded proceedings, focused on increasing clarity and confidence in Northern Ireland’s finances. This Bill will now look to increase public confidence in Northern Ireland’s political institutions.
The Bill addresses an issue of long-standing public concern: the pay and allowances of Members of the Northern Ireland Assembly. That is a subject in which interest among the public has increased with the time that Northern Ireland has been without a functioning devolved Executive—a period that now stands at 14 months.
The Secretary of State will know that our party supports the Bill. We believe that it is right to take the power to deal with MLA pay and to stop the proposed pay rise as agreed by the parties in the Northern Ireland Assembly. We would also ask the Government to look carefully at the situation in which Sinn Féin representatives get representative money in this place without being subject to the same rules as everybody else. The two should go together.
The right hon. Gentleman has raised that point with me on several occasions and it has been discussed in the House. I know the strength of feeling on the matter, but he will also know that it is a matter for the House, not for the Government. That is why we are dealing with the power to vary the pay and allowances of Members of the Legislative Assembly today.

Commons ChamberThe hon. Lady is pre-empting the speech that I will make later—I hope not in six hours’ time—when I will be legislating to bring powers to this Parliament to vary the rates of MLA pay. I am doing so this week to ensure that it happens before the start of the new financial year, so that no pay increases go through. I well understand her strong feeling, which is one that has been expressed to me by many in Northern Ireland.
The Secretary of State will know that the Assembly Commission, which comprises all the parties, recommended that she should take a power to ensure that the pay increase would not go ahead. That is the view of all the political parties in Northern Ireland. It is a sensible step, and we welcome what the Secretary of State is saying.
I thank the right hon. Gentleman. He is right that it was cross-party, cross-community view that the pay rise should not go ahead, which is why we are legislating today.
Returning to domestic rates, I well understand the concerns that people will have, but this important measure will address a hole in the budget for 2018-19, so that public services can still be delivered. In my view, the measure represents an important contribution to delivering a sustainable budget picture for 2018-19. As the budget consultation launched by the Northern Ireland civil service last year pointed out, there are important conversations to be had about the right balance in Northern Ireland between revenue raising and spending efficiencies, and that document discussed rises in regional rates of as much as 10% above inflation. Having reflected on conversations with the parties and stakeholders more broadly, and having understood the pressures on key services, I concluded that it was right that we ask households to pay a little more to help to protect and preserve public services.
However, I also considered that we had to balance that increase at the right level. That is why I propose a 3% on top of inflation rise—less than £1 a week for the average household—to help to address pressures in health, education and elsewhere. It is also why I have held business rates in line with inflation—within a broader budget envelope that allows the safeguarding of the small business rate relief—to keep a focus on the growth that Northern Ireland needs to see. That forms an important part, along with the flexibilities that we set out in last week’s budget statement, of helping Northern Ireland to live within its means at a challenging time, maintaining the UK Government’s responsibilities to uphold good governance in Northern Ireland.
As I have said, the estimated saving for 2016-17 was £27 million. I assume a similar sort of saving this year. The total saving as a result of the cost capping is in the region of £450 million.
The Secretary of State rightly said that this was a continuation of measures that were put in place by Simon Hamilton, the DUP Economy Minister, and which saved money last year. Will the Secretary of State confirm that the Bill replicates the excellent legislation introduced by Mr Hamilton?
I can confirm that that is the case. We are following the same cost capping as was put in place by the Executive and Simon Hamilton as Economy Minister. The right hon. Gentleman will know the restrictions placed on this Parliament in terms of what we can do with changes, and we are very much guided by decisions taken in the last Executive. He will also know that since then there has not been an Executive to undertake that broader consideration of the right energy policy for Northern Ireland. We are now at the point where the existing cost controls are due to expire. If that happened, there would be no legal basis, not only for maintaining the current cost cap but for paying all those who receive payments under the scheme and whose installations were accredited before November 2015. Neither of these would be acceptable outcomes, nor would it be suitable for the Northern Ireland civil service to administer payments on an extra-statutory basis, which would create unnecessary legal uncertainty for all concerned.
That is why clause 2 ensures that the present cost controls, and the legal basis for payments, can continue for the 2018-19 financial year. As with the 2017 regulations, there is a sunset provision that expires after one year. This is a devolved policy matter, and it is right that the longer-term approach is one for a restored Executive to decide. In the meantime, I am assured that the Northern Ireland civil service will undertake detailed analysis to enable a new Executive to consider the right course for the future.
In summary, this is a modest Bill doing two discrete things. In setting a regional rate and extending the cost controls of the RHI scheme, it upholds our responsibilities to ensure good governance and to safeguard public services and finances in Northern Ireland. It does so in a way that continues our approach of intervening only as necessary to meet those aims, and only at a point at which it is critical that the measures are taken forward. I hope that colleagues across the House agree that it is important we now make progress to see these measures passed into law to put Northern Ireland on its strongest financial footing for the year ahead. The UK Government shall continue to meet our responsibilities to the people of Northern Ireland. To that end, I commend the Bill to the House.

Commons ChamberThe hon. Gentleman’s comments indicate to the House that there is perhaps not universal support for every recommendation from the Hart inquiry. That is why it is important that we have a restored Executive in Stormont that can make the decisions about those recommendations and enable justice to be delivered.
The Secretary of State confirmed the legal position of the Bill and what it purports to do and will do, if passed. Will she confirm that, in respect of the written ministerial statement that allocated £410 million of the confidence and supply money, Government Departments in Northern Ireland will be able to plan on spending that money as of the start of the financial year?
The right hon. Gentleman is absolutely right. The statement sets out the departmental allocations; the Bill gives parliamentary approval for Departments to start to spend that money. That is what is required to enable that spending to start at the start of the financial year, but it does not set the final allocations; it merely gives approval such that Departments can start to spend. In effect, Parliament is saying that the money can now be spent so that public services can be delivered. The right hon. Gentleman is absolutely right that the £410 million from the confidence and supply agreement that is allocated for 2018-19 is in the allocations set out in the written ministerial statement, and the Departments can work on the basis that they can start to spend that money.
The Bill provides a secure legal footing for the Northern Ireland civil service. It is on that platform that my budget statement last week sought to build. That statement will need to be the subject of formal legislation in the summer as a further Northern Ireland budget Bill. As I have already said, that is a Bill that I sincerely hope will be taken forward by a restored Executive. If required, though, that is something that we as the UK Government would be prepared to progress with, as we uphold our responsibilities to the people of Northern Ireland. In the meantime, it is those allocations that provide the basis for the NICS to plan and prepare to take decisions for the year ahead.

Commons ChamberClearly, my hon. and gallant Friend is right that those are conversations that the Northern Ireland civil service has had with the parties as well as with the UK Government. It has been incredibly professional in ensuring that it looks at both the decisions made by the Executive before they collapsed and their programme for government. It reflects the priorities of the UK Government in ensuring that health, education and policing are protected.
May I join hon. Members in wishing the Secretary of State every best wish on this momentous occasion? May I thank her for early sight of the statement and for the Government’s clear support in that statement once again for Northern Ireland’s place within the United Kingdom? That is very welcome.
I welcome the budget statement and the £410 million extra for Northern Ireland as a result of the confidence and supply agreement. It will be spent on infrastructure, health and education, and will go to deprived communities, to mental health, to east and west, urban and rural, nationalist and Unionist—everyone benefits. That is a good news story for Northern Ireland, and it has been welcomed across Northern Ireland.
May I also welcome the fact that the Secretary of State said in the statement that she would take a series of decisions—the Government were beginning to take those decisions—for the good government of Northern Ireland? That is long overdue, and I welcome the series of measures that she has announced. I warmly welcome her willingness to look at arrangements that provide for local decision making and scrutiny on a cross-community basis in the meantime. She can be assured of our full support and engagement in that process. We want devolution up and running—she knows that we would form the Executive tomorrow on the basis of the agreed programme for government with Sinn Féin, and we welcome all efforts to return proper decision making to Northern Ireland.
I thank the right hon. Gentleman for his good wishes and for his comments. I thank the DUP for the role that it played, along with all the other parties, in working with the Government to deliver the budget and ensure that we were able to reflect the priorities of the parties of Northern Ireland.
The right hon. Gentleman is right that the confidence and supply arrangement money that we have released will absolutely be spent on a cross-community basis, for all communities, and for all parts of Northern Ireland, dealing with issues that have perhaps been underfunded in the past or, particularly in the case of infrastructure arrangements, very much need funding today. Commons ChamberI thank my right hon. Friend for her question and hers are another pair of shoes that I endeavour to fill. She was an excellent Secretary of State for Northern Ireland. She went through a number of these processes, so she knows only too well how these things operate. I agree wholeheartedly with what she says.
I join others in warmly welcoming the right hon. Member for Old Bexley and Sidcup (James Brokenshire) back to the Chamber. I wish him well.
As the Secretary of State knows, we of course stand ready to form an Executive tomorrow, on the basis of no preconditions and on the basis of the programme for Government that was agreed with Sinn Féin back in December, before Sinn Féin walked out and set preconditions—political demands—that they want to see implemented before they get back into the Executive.
The fact that there is no Executive is not the fault of the Democratic Unionist party. Indeed, it is not the fault of the smaller parties, either—I make that very clear. But in the absence of devolved government, now is the time for the Secretary of State to do right by all the people of Northern Ireland.
I have just come from a meeting of a group of charities and others who want somebody to lobby—a Minister to argue with—about mental health funding in Northern Ireland. There have been no Ministers for 13 months. That cannot continue. Secretary of State, it is time to set a budget. Let the efforts for devolution continue—yes, we want to see devolution—but it is a dereliction of duty to continue without a budget and without ministerial decisions. It is time to get on with it.

Commons ChamberI apologise; I would very much like to give Members much more explicit and detailed answers, but that would simply not be appropriate at this stage. However, as before, I commit to returning to the House as and when I have something concrete to say on the matter.
I warmly welcome the Secretary of State to her new post—and the Under-Secretary of State—and wish her well in her continued efforts to facilitate talks in Northern Ireland. She knows that we are not the stumbling block to the restoration of the Executive. In the meantime, will she give a clear commitment to the people of Northern Ireland, and to this House, that the budget for Northern Ireland will be set as soon as possible, given that the head of the civil service has said
“we cannot go much beyond the beginning of February without clarity about how much departments and various public bodies are going to have to spend next year”
because the lack of a budget is affecting services, including health and social care? The current position is intolerable. We need a budget and we need it now.
I thank the right hon. Gentleman for his comments—he and I have discussed this issue. He will know that my predecessor took action on the matter, and obviously I have had discussions with the civil service in Northern Ireland. I have met some very dedicated public servants who are doing their best to deliver, but in the absence of devolved government that is becoming increasingly difficult. That is why we need devolved government, and we need it quickly. I understand the point he makes. My predecessor took action on the matter and I am sure that he will be assured by that.
I am grateful to the Secretary of State, in so far as that goes, and I look forward to her bringing forward proposals, without prejudice to the ongoing negotiations, so that we do not have a situation in which Departments, people and services are suffering. Does she agree that the recent statement by Alex Maskey of Sinn Féin about Northern Ireland being a “putrid little statelet”, justifying IRA murder in order to bring about rights, shows the sheer disgrace, irony and hypocrisy of Sinn Féin preaching rights and equality by justifying murder and disrespecting the state of Northern Ireland? Does she agree that that sort of attitude must stop? If respect is to mean anything, it has to mean Sinn Féin showing respect towards Unionists and those who believe in the Union.
I think this shows that it is incumbent on everyone in public life to think very carefully about the words they use in public and the way they may be interpreted.
